Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today

Orlando, FL– By this afternoon, we could see Casey Marie Anthony convicted of up to 13 felony counts in the fraud trial scheduled for today at 1:30PM EST. Live Link

Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.

According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication.  WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.

The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.

Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.

While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.

I submit aquiring tacky white sunglasses through fraudulent, felonies means, using said stolen property to perpetuate further fraudulent activity, followed by wearing them to your attorney’s office after you have been arrested for same, constitutes a spree.  Adjudicate at will.

    It was a huge victory for me just to watch Baez try to do some lawyering! I thought Lyons was going to reach around the back of Casey and slap his head a couple of times.

    And congrats to the State. One trial down and another to go.
    Thought it was interesting that Ms Burdick was concerned about the time dragging on and the mention of the expected slew of motions from the defense.

    What did y’all think of Casey’s demeanor when she arrived in the courtroom? Lots of smiling today — haven’t seen that for a while. Any ideas what that was about? Maybe they gave her a little valium to calm her nerves, and she forgot the rules and reverted back to her old smiling self? I found it very weird.

    Chi Judy I was just thinking about it seems at times the defense table has forgotten what brought Ms Casey to court in the first place and how one can muster a smile at anytime since the day baby CAYLEE went missing is an outrage IMO…

    we will see who gets the last laugh….I don’t care that Casey got time served it aint like she is goin anywhere anytime soon.

    Chicago Judy — I agree. If you look at some of the still photos on various news sites, there are some where she has a smirky look on her face — she still doesn’t get it! The tears at the end — they were only for herself.

    A couple of things stood out to me today…

    The “poor pathetic Casey” look was relaxed for this hearing. She was allowed to wear normal clothes (not the ugly green poofy-sleeved number), she was allowed to wear all the eye make up she could apply, and she was allowed to smile.

    The BEST part was about the latent prints… Did everyone notice that Baez couldn’t even say the WORD “prints?” Hahahahha! After latent…his voice trailed off.

    The prosecution didn’t seem too worried about the Kronk ex, either.

    Does anyone think Casey planned her speech for before her sentence was decided? It was a done deal by the time the floor was hers.

    Baez is just awful… I hope the discrimination clams die off soon. It’s getting old — playing Casey as a victim.

    Chicagojudy~ sometimes i think she is totally clueless about the situation she’s in. I blame baez for a lot of it. Don’t know if he really has a grasp on things. He seems to act like this a misunderstanding that can be talked out instead of a crime that needs to be defended. I wonder that what she gets from him is that all this is much ado about nothing.
    It’s strange to see her smiling but maybe it’s that old Anthony kneejerk reaction of laughing/giggling at inappropriate times? Today was a glimpse into his inexperience and his arrogance.

    I thought Baez was TERRRRIF today!!!! He never disappoints us does he! He was right on the mark when he said the whole thing is in the MUCK!

    The white shirt looked new to me, Lyon in her dark top/jacket, Casey stood out, appeared in a freshened state, center of focus. That is what the defense wants us to remember, the seafoam green was to ‘blend’, today was about being memorable and professional and sorry for deeds and being less good a friend to Amy.

    Job well done, did what they could– now to see if they can use the future ‘probation’ legality issue, to their advantage in the future. Still, we now have a convicted felon!

    George was unhappy, squirmy, Cindy said something consoling to him, and she was the optomist with her smiles– Casey was ONLY convicted of a few charges, like she was happy when Casey wasn’t charged with anything in July 2008 (by her view through the rosey 2″ thick glasses)

    “I just want everyone to know I’m sorry for what I did,” Anthony told the judge. “I take complete and full responsibility for my actions.”

    Second part of her Statement—Well, Apparently NOT. Otherwise, we still wouldn’t be listening to her Lawyers allegations & accusations being tossed around naming others for Murder in the First Degree.

    Even if the Murder trial is delayed once again past a date of Summer ’10, confident now more than ever she is going down in a ball of fire. This is all manuevering by Baez/A.L. et al to implant reasonable doubt in the minds of potential Jurors who will not be fooled. As they say in the world of Crime solving, “DNA doesn’t lie” and neither do prints where they don’t belong. She’s toast.

    Oh, one more big thing—-now that Casey Anthony, has in fact been guilty as charged for Fraud & is a convicted Felon—-this will play heavily into consideration come time for the Guilty or Not Guilty plea to be handed down. As well it should.

    I think that Casey actually felt some relief. It was amazing to watch her take responsibility for her actions. It was the only thing that the defense could do, but it was also the best thing because it softened Casey’s image, in my opinion. I watched it and didn’t notice smirky expressions, only smiles to her family and defense lawyers when she first entered.No doubt Lyon had a lot to do with this decision and it was a good one.

    Blink, do you think the latent prints that were discussed in court are from the duct tape or another piece of evidence? Also when would this have to be given to the defense team? Can the state wait until right before trial? TIA

    I’m thinking that because Casey said she’s sorry to “everyone” and to “Amy”, her mother is probably thinking of ways to go to the media to tout those apologies and to tell us that all should be forgotten (and forgiven)now because the little angel said she was sorry.

    Baez was truly, terrifyingly (if I were his client Id be
    terrified) incoherent. If this is the way that he will stammer and mumble about come murder trial the defense will go down quite handily.
    He just couldnt seem to get out what he wanted to say. I was really surpised at just how badly he did this time out. He seemed very nervous too. Lyons always speaks fluidly and clearly and so do the State lawyers. But today Baez’s tongue was all thumbs!

    Maybe a stupid question, but here it goes. Since casey was credited 422 days, as time served, can they use this same 422 days (or whatever the actual days were) towards time served in the murder trial??

    According to discovery docs, I have that Q100/Q104 – Henkel duct tape was recovered from remains site 12/12/2008; Item 16H, 60493 (Note FBI seems to refer to this tape as Q104 but OC refers to it as Q100)

    I really thought that Baez was looking very nervous and at times frustrated. #72 The bond remark being really dumb, I agree.

    Casey Anthony and her defense team now have 30 days to appeal the sentences. Casey’s defense attorney told reporters afterward he won’t appeal, that Casey had always intended to plead guilty to the check fraud charges, but he wanted to make sure the she was treated fairly. He says Casey will always be victim Amy Huizenga’s friend.

    “Should Amy ever want to contact my office, she has an open invitation to,” Baez told Eyewitness News after the hearing.

    Eyewitness News called Huizenga to find out whether she still wants Casey’s friendship, but she didn’t want to talk about it.

    I think he has really gone over the edge with this case.

    Rhonda, you are right. I have a large hi def monitor. She said Thank You at 3:50 into the video. At 4:06 into the video Cindy smiled at George and said I love You. George did not respond to her except to tighten his lips and look straight ahead. Also, for whoever said it, Cindy DID NOT rush out of the Courtroom.

    Is there a chance that the latent prints on 104 belong to Lee. Maybe this is what LE meant when they said that Lee knows what he has done. LE believes that Casey killed but that Lee added the extra tape to look like a kidnapping.
    Remember, Lee never wanted to give his DNA nor have a polygraph. There must be a reason he didn’t want to do this…

    EXCUSE ME…………..How the HELL, can it be permissible to hand anything from the peanut gallery to the prisoner without it being checked first for drugs, weapon, etc….Remember tissue is very porous since we can put lotion in it, imagine what else it can be laced with, without being visible to the eye, also a razor blade could easily have been passed in the folds of the tissue….helloooooooo?

    As the trial was beginning and the golden blonde deputy was standing at the door to let KC in, she opened the door slightly for a second and you could see what I am sure was KC fixing her hair. This girl seems like she is not human. Who fixes there hair and is all smiles at such a gut wreching tragedy. She gets under your skin because it seems as if she just does not give a damn.

    How can this girl not seem terrified when the court mentions the word “PRINTS”. I hope there is total 100% proof that she has committed this crime and we can all have our prayers answered for Caylee.

    Jose has said on JVM that he will not Plea Bargain. going to court for sure.

    From the pics over on WFTV.com, although I did see the ones of her smiling, it looks like she cried more today, for herself, than she ever did combined (if ever) for Caylee.

    It makes me sick what happened to this precious girl. The video of her singing makes me cry everytime. What this girl suffered, at the hands of her own mother, is heart-breaking, sickning. And, from what I understand, if she died the way they believe she died, bond by her own mother, that little girl suffered and knew that it was home mom doing it. Makes me sick to my stomach.

    I do not believe we have any obligation to people like this to protect them from other inmates or anything like that. Who was there to protect Caylee? This woman deserves everything and anything that she gets. And, once sentenced, placed in general population with the other inmates, many of whom with children of their own and albeit committing criminal acts of some kind of their own, none against children. I think that is where most people, inmates included, draw the line.

    As far as George and Cindy, I do believe that they love Caylee, but for some reason instead of seeking justice for her, are too busy trying to prevent their daughter for paying for what she did. I think it is this very confliction that caused George to go over the edge. I think Cindy is more concerned with the family image. I also think that they feel some guilt as to not following through with their threats to take custody of Caylee, maybe feeling that she would still be here if they did. But, who would ever have forseen this? Maybe they have some warped belief that they couldn’t save Caylee but maybe it’s not too late to save Caycee, I don’t know. But, for whatever the reason, justice for Caylee seems to be on their back burner, if it’s there at all.

    reinin, my guess is that Lee didn’t want a polygraph because of the questions LE could ask him that would paint Casey in a bad light– past bad behaviours, what his mother suspected, what Casey might have told him, what he might have done with the computer etc etc etc. What his intentions are in his investigations, who is the father, etc.

    Did anyone see Lee Anthony there today. I mean this was pretty big, you would think that he would want to be there to support his family, although none of them seemed to be overwraught. I noticed Casey when walking back to her seat looking over at mom & dad as the kleenex was held up to the eyes almost as if saying, Look,see me cry, I can do it.

    I really don’t think that any of the Anthony’s really get this at all.

    So she’s “sorry for what she did”, 90% possibility she’s “sorry” she got caught and is being held accountable for the first time in her life, 10% possibility she believes it was Amy’s fault for leaving her checkbook in such an accessible place. It was practically screaming out “Take me! Take me!, No strings attached!” If I were Judge Strickland, not only would I have found her guilty on the charges and classify her as officially a felon, in addition to time served, I would have her out in full orange jumpsuit gear complete with “sheriff’s office” van with flashing light, picking up trash along the highway, along with a stationary sign that reads “This is what happens to someone that continually feels the need to satisfy their self-serving nature”….only my opinion ofcourse

    This was a slam dunk for the Prosecution as far as evidence on
    this now convicted felon. Baez is now trying to spin CAsey was always going to plea guilty to the crime. The reality of it was, they had no other choice. She was caught red handed and Amy pressed charges. Casey wants to again be a friend to Amy. Sure Amy will testify at the murder trial so Casey wants to use her again as a friend. Becareful Amy. You might be used again by the sociopath Casey. She will defintely ruin your life, just she and Baez are trying to ruin Kronks life. And according to Thinker we have Padila to blame for this information of a dying EX bitter wife.

    Since I read the information on Padilla, I no longer have any respect for him. He was dead wrong on everything he did. His only motivation was to make himself look good and he failed in all his efforts. Blackwater divers would have gained a better image. Ha! He wanted to find Caylees body. He failed. Now he wants to prove his daisy chain to gain the lime light again. What pathic looser. If Kronk never found the body we would still have Cindy screaming get off your arses and look for her and the money would be pouring into their foundation for a missing child who was never missing but dead on July 16th 2008.

    Although I am no defense attorney, common sense would appear to be a needed quality in a job such as that. They are continuing to pursue Roy Kronk as a suspect in order to create the reasonable doubt illusion. They have already been through the norm of Zenaida, Mr.Grund, and everyone in between. Now they land on Kronk. I would think that by turning to Kronk, they are falling deeper down the rabbit hole. Had Roy Kronk been in any shape, manner, or form involved, he wouldn’t have received that reward, be it that I am sure LE had investigated him thoroughly before taking a basic political risk of allowing payment to be made to a possible person-of-interest, had they not vetted him completely. The fallout from that would be a lot of pink slips
