Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today

Orlando, FL– By this afternoon, we could see Casey Marie Anthony convicted of up to 13 felony counts in the fraud trial scheduled for today at 1:30PM EST. Live Link

Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.

According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication.  WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.

The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.

Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.

While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.

I submit aquiring tacky white sunglasses through fraudulent, felonies means, using said stolen property to perpetuate further fraudulent activity, followed by wearing them to your attorney’s office after you have been arrested for same, constitutes a spree.  Adjudicate at will.

    Kleat, I dunno. I think it’s good advice to never take a poly. Since they’re not admissible in court, a poly can practically only work against you if you get nervous and somehow flub it. (it’s kind of widely open to interpretation, so it could happen).

    Well, we’ve gotten our hopes up about the prints for a long time. I guess time will tell. Maybe they have something after all. Seems odd that for all the sensational leaks of kind of fringe things (“was there chloroform in a bottle near the remains??? did casey react to the discovery of the remains on video????) that they would quietly sit on an actual piece of evidence that could convict.

    Without trying to be a blogging hater type, jose baez is really a bad atty. He is childish and surly and really seems confused by proper procedure. He is flippant to the judge and is at the ready to brawl with the State, if JS hadn’t shut him down a couple of times I thought he might start schoolyard name calling.
    There’s been really out there attys. and annoying ones but really he doesn’t have charisma nor does he seem to know the law.
    That being said….he’s perfect for casey. I’m so glad they hooked up together. With him by her side, Kronk and all, she’s going down.
    The above statement is my opinion only but I think years of watching court tv has qualified me to say..he sucks.

    I just re watched the hearing and I must say…

    love how Baez’s papers fell to the floor at the end lol He always stands there with his pooched up lips, like a pouty little boy who didn’t get his way, whenever he’s not liking what he’s hearing.

    Lord help me but this man bothers me. The way he has to dick around for ten minutes to spit out a five word thought makes me nuts.

    Casey…you ought to be scared spitless if you realize this man is what stands between you and the gurney.

    Doubtful at this point. Unless there is a specific allegation made that is designed to malign or harass in some way, in bad faith.

    #101-Suz–Agree on the Poly, but where did Lee Anthony go? After that Depo he gave and the undercover conversation by LE with Jesse—all of a sudden he then made himself very scarce.

    He knows something. He is not talking or cooperating anymore for a reason and too much time has passed since. That has always seemed odd and something just does not add up with Lee Anthony. Perhaps insignificant- but he hushed up and moved further away from HopeSpring Dr. again after the discovery of Caylee’s remains for a reason. He wants to separate himself from the whole situation for more than obvious reason of exposure …. Anyone?

    A couple poeple have posted that Casey looked happy as she entered the court room. She looked absolutely giddy. She’s dropped a couple pounds and looked much better than she has previously. She was probably quite eager to show it off. I loved the little speech she gave! Of course it was well rehearsed, but still, it was rather charming. Now she can use it to her advantage. She apparently has no problem admitting her guilt when she is guilty. So oviously if she killed Caylee she would admit it. Therefore, she must be innocent.

    Casey was smiling today because she is a narcissist/sociopath. Today, she knew that she was the center of attention because the fraud charges were about her, not Caylee. Her apology was well rehearsed but she really has no remorse or understanding for what she has done to Amy. If there were any real tears, they were for herself. When the murder trial starts (which will put Caylee in the limelight again), Casey will return to her sullen state & we will probably see anger, too.

    Someone ought to call Baez on his invitation to Amy anytime comment– quote to him, what the judge said. The judge’s order must be available in written form, in case Baez needs to study it carefully!

    suz, the first thing families of missing children will want to do is to clear themselves so the resources can go to the real search as quickly as possible. Many parents would do that for their children and grandchildren if they were missing. Polygraphs can always be repeated, and since they can’t be used in court, it’s just a tool to maybe clear some people and the information they give.

    Annie, Kleat, I am jumping down to tell what I know about witholding adjudication…If a judge states adjudication witheld I do know almost all crimes can be erased from your record. If you are ajudcated guilty this crime can never be stricken from your record. It’s totally up to the judge on this matter and your lawyer can even ask for it to be witheld ‘nicely’ of course. I know it means a lot more but for us simple folk this is what it means. lol

    adding to my comment–witholding adj. is forever. I guess just a way of a judge being nice to you. Funny though, I thought I heard it being witheld from Casey’s convictions. Am I wrong? To me that’s a little punch in the head cause she’ll never be out of jail to expunge these little check felonies from her record.

    It is moot. That’s a little bit of the “illegality” of it they were referring to yesterday. Technincally, one cant serve probation in prison if the terms of the probation do not match. But if it were “legal”, and she violates probation do her convictions then revert to adjudicated?

    I also thought they discussed that 90% of the eveidence has been presented to the defense but 10% has not been released. Assuming that must be the latent eveidence they were talking about– wonder if anything else in that 10% we don’t know about yet.

    I am convinced Casey thought she was going home yesterday. I think her attorneys told her they would try to get her time served and sent home and she really expected it to happen. Did anyone else hear someone say “he’s an idiot” when Baez made the comment about bond? It was loud and clear on the copy from You Tube

    No way. There is no bond on a capital murder case. Yes, I heard a few more things early on I have chosen to sit on for now.

    A “No Contact Order” includes “NO CONTACT, NOT EVEN THROUGH A THIRD PARTY.” I am supprised the State did not object to this. Would that comment not be a direct violation of the Order? Could a complaint be filed against Baez with the Bar?

    Do you’all realize like me what a horrible mistake it was for KC to plaad guilty to these charges. What kind of representation is she getting from her attorneys? Is there a lawyer on this blog who can explain this? I was fully anticipating her pleading “no contest” and Judge Stan withholding adjudication of all the charges. Did you hear how many times Judge Stan asked if she was sane, on drugs, mentally ill? I’m sure he was saying, WTF? Why are you doing this?

    I’m no lawyer but I’ve had a little experience in court and have pleaded “no contest” when I was guilty as sin and it’s always turned out better for me. I just don’t get this pleaing guilty. KC should fire these lawyers today!

    Please, anyone who has read my comments knows I’m no fan of KC Anthony so am not defending her. I am just shocked by this plea deal. I’ve witnessed sexual predators walk out of court on a plea deal. What the He!! is going on?

    After Lee’s impassioned CMA CMA CMAs, you would think he would take advantage of every opportunity to see his CMA in court, make eye contact, blow kisses, kiss their wrists, say I love you, etc. And yet he doesn’t attend. I really do wonder why.

    Baez clearly does not think prior to speaking, re: invitation to Amy. If I were Casey would make me shiver. I know Ms. Lyons is smart,so can you imagine how she must shake her head and shudder when she reads such things.

    You almost feel that the d-team just has no more fire in them. Yesterday, Baez came off like an idiot (sorry Blink) but he could not put two sentences together and the little bond joke, well that was really professional, let’s all giggle together. Did anyone notice that Casey was just staring down the judge? It felt to me it was almost a power struggle which she definetly lost.

    I think Judge Strickland has just about had enough and that this has gone on way to long. He knows Baez is stalling.

    I disagree. I think this was a long time coming. There was no way to fight the charges, and for Casey to submit to a guilty plea demonstrated that she has the capacity to accept responsibility for her actions. That will help her in the murder trial. It was, in my opinion, the BEST defense strategy.

    He said some time ago that he (paraphrased) “wanted to live his own life”. I can’t fault him for not wanting to have his entire being defined by Casey and her actions. Probably a lot of his life at home was consumed by her problems in the past. Plus, he has a job. Maybe he will be in court for the next trial. If he isn’t, still, can’t blame him.

    Ok Blink- in reference to your reply to my comment #117- I didn’t think there was bond for a capital murder case, but I guess I was confused with Baez asking for Bond. Was he thinking they would pay the bond and the case would be done- without probation?
    This is all so confusing to me. I think I have already touched on this subject, but I was actually charged with fraud in a federal court and federal and state courts seem to work differently. I know everyone claims to be, but I was truly a victim of circumstance and I STILL chose to plead guilty in order to not have to testify against family members.
    I was never arrested, but I had to go through so much that it changed me completely. I didn’t smile in court, I didn’t make faces when the prosecutor said things I disagreed with- I sat there politely and quietly and I damn sure addressed the judge with YES SIR your HONOR every time I had to speak. It was the most horrific ordeal of my life so I truly have a hard time with Casey’s behavior because this tells me she’s not terrified- why not?
    I have learned so much from my experience and I am so careful not to judge quickly by what LE and the media have to say, but still there is no way around this for me- All fingers point back to one person.

    One thing I can teach you ALL here at Blink is to NEVER turn the other cheek- it can be just as bad as the act itself.
    One other thing- someone mentioned Casey having the fraud charges expunged- from what I have learned once you plead guilty and serve any time or probation you can not have records expunged- I may be wrong but I don’t know for sure.

    The most important thing for me yesterday was the discussion of the info that the FBI and Oak Ridge still has. This 10% is THE nail in Casey’s coffin. I believe that as long as the prosecution does not request it in exact terms, then there is no way for the defense to have access to it before trial. I think they can only request things that the prosecution already has. This made me jump for joy and I believe it is the best thing I heard yesterday.

    Dear Blink, I’m new to making comments, but have always kept up on your postings and comments, especially regarding “Justice for Caylee”.
    This is regarding Lee, I don’t know if brother Lee had anything to with Caylee’s demise or anything to do with the facade of her being kidnapped. I don’t know. But I do know I noticed less and less of Brother Lee after the tape of him in Tony L’s car. I also noticed that when he was in public view after the tape was put out, that he was more resistant, in his mind arrogant, but really it was embarrassment covered by defensive emotional mechanisms. Brother Lee found out he was a nobody when he saw that tape, he found out nobody thought he was the diety he believed himself to be. A mere pawn of LE and that truly angered him. I believe the whole family is angry at this inconvience in their lives………I don’t think they have the ability to think of anyone but themselves…….I don’t think anyone of them is clever, they all are simply liars, cheats and Caylee unfortunately was at their mercy.     Couple things I noticed, and I may be repeating what others have already commented on.

    When Baez asked for a “resonable bond” not only is he totaly IGNORED by the judge, but casey slitely smiles and smirks. (So inaproptriate).

    Casey is able to hold back the tears up until she actually walks around the desk, MAKES EYE CONTACT WITH HER MOM, then at that moment breaks down. Wonder if Cindy gave her a nod “I forgive you…..” There are real tears but, only for herself.

    When Linda speaks about Kronk’s exwife and comments that she needs to be depo so she we can hear what she has to say, at the same time you can see Cindy nodding her head up and down and mouth “That’s right.” What a fabrication that she and George are appreciative of him finding little Caylee….she made it clear at that very moment of nodding that she wants Kronk’s head. (Throw him under the bus!!)

    Watch KC, she zones most of the hearing. Someone who is daydreaming or zoning doesn’t care what is going on in their surroundings. Blinking is a sign of paying attention. She RARELY BLINKS. Nice attitued.

    Love how the judge corrects Baez and then Baez goes right back and repeats himself. The judge is irritated and says about Ashton, “His posistion will be and ALWAYS will be…” that Baez has to go after the 3rd party holding the information that Baez wants. It is out of prosecutions hands. Is Baez slow on the uptake or just a nitwit?

    Baez mentioned the words ‘impeachable testimony’ in reference to the Kerley and Kronk. Watching thru to the very end, a producer of ? (John David….., Producer ) steps up, introduces himself, says John David….., Producer) and asks if Baezhas time to swing by…. Baez says yes. This producer wears a blue shirt and red tie. Someone else on the walk, handed Baez a business card, he took it and put it away.

    Then Lyon’s clip appears on Today this morning, to say the media has to ‘back off’.

    WHO was this producer, what show? I couldn’t catch the name of the show. Maybe HLN and the JVM show? (Baez appeared last night)

    I firmly believe that none of Casey’s attorney’s expect her to ever leave jail again. In fact, I would place a bet that they are counting on it. If she is convicted, or pleas, in the murder trial, then they have years and years to take advantage of appeals etc. and to keep their names in the media. Also, for future speaking engagements and book deals.
    I sincerely question the ethics of Jose Baez, he is totally out of his league with this case, and should have stepped aside long long ago. Why Casey is sticking with him is very puzzling to me? She has already waived her right’s to appeal a guilty verdict based on her attorney. This was required to be signed by the SA before they would allow Baez to stay on the case with or without a death penalty qualified attorney being added to the defense. It bogles the mind. But then again, so does much of what Casey does.

    Boz, go to WFTV and listen to the ‘raw interview: Jose Baez TAlks about Casey’s…. ‘ and he answers the question re: no contest vs guilty. Remember that Casey was caught doing the crime, not one time, but several times, and caught with the checks, signing them, with the goods to prove the sale, recieved the goods, handed the check to the cashiers– so pleading guilty it seems, was the only choice if the defense wants to say ‘she takes responsiblity’ and pleads to her mistake. That’s the best tactic for the upcoming murder trial/jury. It’s about the next trial tactics and what is best to play out there.

    Could Jill Kerley be useful in getting Kronk to slip up and say he didn’t do something that he did in the far past, and that Kerley’s use is not really about pointing blame, but about Kronk doing a ‘it’s not relevant’ or just saying ‘no’ to a ‘yes’ question, therefore chipping away at his credibility on the stand?

    If he lies (Kerley can’t be lying, now can she!!) about any tiny detail of his activities in past marriages that are a point of embarrassment, his online Warcraft or whatever, Dungeons and Dragons fantasies, as claimed by people with agendas), then the jury will look at him as not entirely honest in his answers.

    (people play act in social activities all the time– think of the society of creative anachronists– they don’t really believe they are Sir Gallahad)

    Don’t know if it’s been mentioned upthread, but did anyone catch Baez on JVM last night? He went on and on about how Casey ALWAYS planned to plead this case because she felt so bad about what she did to her good friend Amy. Then Mark Iglarsh (gotta love him) gets on and says basically “no way Jose” to that BS. Iglarsh is a defense attorney himself, and he’s the one who always reins in JVM when she gets carried away with her sensationalizing. He said that Jose was full of it; that the only reason a client pleads is because they knew they cannot win the case. That’s it. Period! Jose’s comment was pure crap. They waited as long as they could and finally gave in and agreed to plead.

    One of the issues that just keeps popping back into my mind during all of this nonsense, Zanny took Caylee, no Jesse is involved, No it’s Ricardo or Amy, No Jesse, Viola it’s that Roy Kronk fellow…. is that from one of the first day’s Casey was home from jail, in front of Tracey M., Casey said with a sarcastic lilt “They haven’t even found her clothes yet”. WTH. So, the clothes were “planted” as a clue to the kidnapping? That was a very telling “slip” of Casey. IMHO
    I’m hoping that Judge Strickland is giving Baez enough rope to hang himself with.. otherwise why let Baez have his derogatory comments like “giving Casey a modest bond” when that is clearly not going to happen. I hope Strickland turns Baez over to the Bar so he can’t continue to practice or profit from this case. But I’m probably just hoping.

    I think WESH’s idea that Cindy appeared to turn to George and say ‘I love you’ is off the mark. I saw that in the original hearing, no sound, I did not repeat the portion to try to figure out what she said. All I’m going off is my first impression that looked immediately (I’m not a lip reader) like ‘that’s fair’.

    Then I watched George’s continuing reaction, not just to that comment, but his squirming, his screwing up his face, his looking down and away from Cindy. He was upset at someone, and it seems to me, he did not like the adjudication. It also seemed that Cindy was trying to calm George down.

    Saying ‘I love you’ makes no sense to me, when I’ve heard WESH put those word into the clip. Watch George, what are the parents doing, having a fight and Cindy saying ‘I love you’? I don’t buy it. George was doing his ‘f-n flunkie’ anger thing again. He’s taking living the lie, very seriously now.
