Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today

Orlando, FL– By this afternoon, we could see Casey Marie Anthony convicted of up to 13 felony counts in the fraud trial scheduled for today at 1:30PM EST. Live Link

Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.

According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication.  WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.

The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.

Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.

While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.

Caseybofa

I submit aquiring tacky white sunglasses through fraudulent, felonies means, using said stolen property to perpetuate further fraudulent activity, followed by wearing them to your attorney’s office after you have been arrested for same, constitutes a spree.  Adjudicate at will.

By Casey pleading guilty to the fraud charges, and going before the court to admit her wrongdoing, then she is saying to the world that she is taking responsibility for her actions. When it comes to the murder trial, the defense can argue that she takes responsibility for her actions, but she did not kill her daughter, and therefore is not going to admit to charges she is not guilty of. They are laying the groundwork for the murder trial and already instilling reasonable doubt as to her guilt in the murder of her child. She is a six time felon now in the eyes of the world – if she can admit to that and feel such remorse, then certainly she would admit to the murder of Caylee – IF she did it! NOT!

I too noticed how baez stumbled all over himself it almost seemed like he was disoriented. I didnt watch JVM because he never has anything new or intelligent to say. He rambles about things making no sense. He real doesnt have a big vocabulary does he. I too think the man is in way over his head and has not a clue as to what he is doing
I was waiting for him to say to the judge uh uhuh wassup doc. I noticed lyons looking over at him like ok say something we can understand. I think as he gets further into it its only going to be alot of the same ramblings. He just cant get it together he has no business representing this kind of case without any experience geeez.

And as for Cindy’s “I love you” I’m pretty sure that is what she said although you can see it more clearly in other videos. Also Lillian Glass who adds “Utley Lip Reading Skills” to her credit agrees that is what she said.

  10. PAMELA says:

#148 NJSLEUTH It is my understanding that Casey had to sign a waiver of appeal for ineffective counsel, and get a death penalty qualified attorney on her panel before the courts and SA would allow Baez to continue to represent her, both of which are recorded as satisfied in the Court Clerks office. There was no way the SA would allow her to use Baez as a means of appeal, when he wasn’t qualified to handle her case to begin with.
I also find it hard to believe that she or anyone else would go solely on Baez’s word, that he “has it all covered, and she’s going to walk”. If Lyon’s didn’t discuss all the possiblities with Casey, then she might be held liable in an appeal, and I believe…love her or hate her…Lyon’s is a good attorney and gives Casey ALL the facts for Casey to make an informed decision. Baez want’s to look like he’s driving this train, but by his court performances alone, we know he is incapable.
It would be very, very turnabout if after this is all over George and Cindy say they left Casey in Baez’s hand to make sure she was punished for her crimes, and they knew all along that her goose was “cooked”, but because of their parenting, they had to let Casey put her “goose” in the oven herself and finally take responsibility for once in Casey’s life for her actions. After all, she did kill their “beloved” granddaughter. IMHO

She is not his peer…agh..he makes me insane. He genuinely seems to think this all his opportunity to be the class clown.( on this UTUBE someone within microphone range does say “what an idiot”

He is totaly unprofessional in his actions and the comments that he makes to her and the viewers when he appears on tv or in front of a microphone. the man loves to hear himself he needs to replay some of those back and see how dumb he looks.. He has a hard time trying to bring his thoughts across. he is so scattered and I wonder if he is feeling inept next to lyons. she was giving him some looks yesterday. and by the way he and lyons need to stop pampering casey its just so unprofessional. casey was unusaly happy for some reason only god knows what he is telling her or giving her false hope. I think lyons is more direct with casey and baez isnt as forthcoming for whatever reason. nonetheless yesterday baez was nervous and appeared stressed and disoriented.

  18. Kleat says:

The defense does NOT need to pin this murder on him, they want to entrap him in a lie, then they can say if he lies once under oath, he can not be believed in his account of finding the body in the woods, and that leaves the door open for him lying about the body being there in August. The defense wants to make the jury believe that there is reasonable doubt that the body was in the woods before Casey was incarcerated– if they can do that, the jury would also be able to draw the same conclusion about Casey not being the killer.

They don’t have to prove anything about Kronk, except discredit him as a credible, truthful witness.

  19. Kleat says:

If the fired snake fearing cop had done his job, called in help to search if he could not do it, this may not be a winnable situation for the defense. (if they get the right jurors– they only need one, don’t they, for the guilt phase?)

  20. Kleat says:

Amy, apparently a blood sample is required by law for each guilty charge, nothing to do with the murder investigation. Maybe it’s for a database of offenders.

WFTV has put a new page up with links for all the videos/stories etc. Not searchable by date yet, but that link will get you to an early report on the leak of a movie deal (09/24/08)

Interesting review of the early stories– the Nov 14th Leo-Pad-Eeo Dive team at Blanchard Park, interestingly was a coincidental little diversion from people’s attention on Hopespring Drive, and gave Dominick Casey a clear unobstructed, and probably very private, 14th, 15th, 16th to go search those woods on Suburban. We also now know of the ‘meet and greet’ which took the Anthony’s themselves, away from that home area too.

And in the report about Blanchard Park, called Blanchard Park, ‘the new Hopespring Drive’ as people began to gather there instead, with Padilla convinced that this was where Casey dumped Caylee because she mentioned it something like 8 times.

    #168 Kleat.

Thank you. At least, now, (knocks on head) I finally understand the Kronk thingy. Don’t know why I was soooo slow to really see what Baez was doing. Discredit Kronk with his past or lies and one or more jurors will not believe anything he says concerning the finding of the body.

The team is really depending on getting at least one juror to believe that the body was placed there after Casey entered the clink.

So Kronk doesn’t have to be Zannie, to have kidnapped Caylee, or to have had any connection with the Anthony residence or items found with Caylee’s body.

Baez won’t try to claim Kronk as killer…just Kronk as liar. And that’s enough?

  30. Kleat says:

Two early revisionist points in this video newsreport from November 08, 2008– one, comments from TES about search conditions having been too wet and now they could resume. Airport area a focus, and remember Blinks article about the aerial photos and the dates still too wet in November for the Suburban woods search.

If there was someone wanting the body to be located by the family, it would certainly be before TES was to search again and find it themselves.

    http://www.wftv.com/video/17983708/index.html

And the second point to review, is the defense putting in writing, that IF CAYLEE was not alive, then surely it was because of some tragic accidental poisoning.

Interesting that they would choose this scenario, knowing what Jeff Ashton stated in the recent toss the DP hearing. Did Baez know something back then to cover all bases?

  31. Kleat says:

The Kronk thing ain’t going to work, but the defense has to try something! And the state will be ready for this one and probably a few more defense twists to come.

Refraining from blinking your eyes, do that long enough and your eyes will water, or possibly she has some sort of oil that is put on her hands, and when she goes to wipe the dry eye, she’s actually coaxing her eyes. Just a thought

“They don’t have to prove anything about Kronk, except discredit him as a credible, truthful witness.”

Kleat, are we holding to much hope on Kronk, isn’t he just a very smal piece of this huge pie of evidence against Casey, he found Caylee, he reported seeing something back in August 3 times before he found her in December. I don’t think Kronk finding Caylee is anything more than just that, I think it is huge that he noticed and tried to report something in August and nothing was done about that, that proves to me that lil Caylee was there and had been there all that time. But everything else in this case, the lies, the trunk of the car, the duct tape, the 31 days will hang this woman…Kronk was just an unlucky soul that happened to find Caylee, I am glad he was persistant.

Other than the death of Caylee the finger pointing to RK makes is one of the most low down acts to date by Casey and her defense and I would really like to know why it is even being entertained, it is sleazy and wrong and the defense should be ashamed. It is a joke that they are moving away from the Zanny the Nanny did it, the whole damn thing is a joke, the SA needs to really just demand that this trial start moving forward, I can see the defense continue to pull monkey’s out there rears for eternity to save Casey, that shows me what a weak defense they truly have, I can hear them behind closed doors, “Who can we blame next to keep from going to trial and loose” delay delay delay, is that how the Mighty Lyon saves her clients? If so that is pretty poor council, she is not as brilliant as she thinks she is.

    Blink,
Is there a chance that the latent prints on 104 belong to Lee. Maybe this is what LE meant when they said that Lee knows what he has done. LE believes that Casey killed but that Lee added the extra tape to look like a kidnapping.
Remember, Lee never wanted to give his DNA nor have a polygraph. There must be a reason he didn’t want to do this…

My husband, Jack, had Non-Hodgkins llymphoma and passed away in March, 2003. With my daughter being an only child, she acquired Non-Hodgkins as well. Shehas recentally been diagnosed with Bipolar. She gets depressed and writes checks. (Doesn’t keep up with the money) She has served time in Jail. She is in the hospital at present. She has been through chemo twice. Now she has been passing out-causing her to fall. The Doctor’s really don’t know anything except her potassium was low and a new pill fro raising her blood pressure.

She has one daughter, who will be 15 in September. She was arrested but released and still faces court. I pray and need everyone’s help in getting her out o0f this.
No one contacted her about the checks. She will probably have to have a stem cell down the road. She and my Granddaughter is all I have. She couldn’t survive

There was a community yard sale held that weekend in the Anthony’s neighborhood which was planned by the HOA at least 3 weeks in advance, the sale lasted for 2 days and the signs went up at the entrances on Friday night. This community holds several community yard sales a year and it’s off of Chickasaw Trail in Orlando which is a very busy street, that area is known to be very busy during the weekend. The neighborhood receives a lot of traffic during one of there yard sales. There were cars all over the neighborhood, if you look at the video of Dominic Casey in one of the scenes you can see people behind him parking cars to the side of the road and you can see people walking behind him in a distance. IMO that is why he (they) went out there that particular weekend because normally cars aren’t parked on the road and people aren’t walking into the woods in dress slacks and dress shirt. I think this weekend was chosen because he could blend into the crowd of people on the streets no one would think twice about him parking his car on the road and walking around;eventually walking around into the woods when no one was looking. IMO it was the perfect cover. He wouldn’t have stood out that weekend.
