Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today
Orlando, FL– By this afternoon, we could see Casey Marie Anthony convicted of up to 13 felony counts in the fraud trial scheduled for today at 1:30PM EST. Live Link
Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.
According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication. WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.
The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.
Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.
While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.
I submit aquiring tacky white sunglasses through fraudulent, felonies means, using said stolen property to perpetuate further fraudulent activity, followed by wearing them to your attorney’s office after you have been arrested for same, constitutes a spree. Adjudicate at will.

cynOmatic, I guess it’s a good way to lure in new ‘customers’, like getting someone to take an ‘innocent’ plunge into child porn by a seemingly innocent means, no one harmed ‘really’, and that could lead to paying sites, to paying for images, image access, but risking boredom, take things up in ‘reality’ by increasing realism, or violence, etc, then where do you go to satisfy the newly created customer pool, now accepting more and more. Maybe it is like leading from a chat room into a real meet up with a child, ‘the next step’. And there’s all the psychopaths or those who have some antisocial deviation that needs more and more intensity for ‘feeling’ anything.
I’m all for artistic expression and freedom of speech, but not when that’s used as an ‘excuse’ for anything ‘performance or visual’ to be called art or poetry or even ‘speech’. There’s always a balance, but how do you know the creator or creators of images, and what their credibility is as an artist creating ‘art’. Art issue should not even be in the discussion of child rape, child molestation, child abuse. I think intelligent people can tell the difference in a social statement by an artist and someone hiding under that ‘disguise’ calling themselves legitimate to continue their abuses of anyone, much less children in our global societies.

A couple of people asked what virtual child pornography is, and I tried to objectively explain what it is, and provide a little context about the free speech issues around it. That’s all.

But cyn0, the subject matter DEMANDS strong opinions, no? I’m an artist and have had lots of opportunities to think about the distinction between artistic freedom and child pornography. I’m also a grandma to two little girls. The issue is black & white. As already stated, depictions of any type of sexual positions involving children whether real or perceived must be considered pedophelia. There cannot be any other conclusion.

The only reason I brought up studies was that if it keeps a certain type of pedophile off the streets, as an alternative, it would be welcomed. Pedophiles can not be cured. Pedophiles beget pedophiles and the damage goes on and on and on. Child sexual abuse creates other types of acting out as well, whether it be damage outward or inward, there is no end to the pain that they create.
I would prefer an aversion type of therapy, but to date, not much, if anything, works to alter this deviance.

I do have strong opinions about this too. Censorship of our freedom of thought and expression is always troubling to me. Especially the sort that tries to reach into our thoughts and make them into crimes. If what Blink hopes about fantasizers comes true, most of us would be thought criminals and would be in prison for the rest of our lives.

Annie, maybe someone should investigate what may be underlying that behaviour, that is, before something happens that causes the child to be blamed for some adult’s ‘interest’. I’ve heard of a case in which an adult male blamed a toddler for his abuse (some sort of blame for teasing him!)– what causes the learned behaviour to be expressed by a child who can’t begin to comprehend, what has happened to this child and by whom, to bring out this behaviour.

Klaet – in response to your comment in #314 …when I was in grammar school (ok -50 years ago!!) – one of my girlfriends (age 10) was fondled by her “uncle” …she was so embarrassed she was afraid to tell any family member – but reached out to several of her classmates to ask if anyone of us had ever had this happen to them. Two of us told her she had to tell her mother. She did – the mother confronted the wife of the “uncle” – and THEY BLAMED THE 10-YR-OLD. How sick is that?? A family rift ensued …the two sides didn’t speak to each other for 30 years ….But after the “uncle” died ..and his wife was all alone and dying of cancer …Guess who took care of her??? My girlfriend!! They say “God don’t like ugly” – but I believe with all of my heart that my girlfriend more than showed her beauty for God to see in taking care of the woman who ridiculed her suffering. Child porn/child abuse is the worst of crimes. These people are sick but need to be isolated from any present or future contact with children. For these people -there is NO cure. I have no idea what Caylee Anthony was forced to endure – not only in life but in death. God bless her and give her peace And I so wonder if the book, The Lovely Bones, is more truth than poetry.
Blink!!! Just saw Comment #232 …how can there be an “interview” with Jeanine Barrett and Casey in jail that goes from 8:46 pm (on 11/14/2009) through 6:20 am (on 11/15/2009)??? How is this allowed?? Aren’t there hours of operation?? At most I could understand this if she was Legal Counsel – but it’s listed as “interview”…What ANOTHER book????????? How can LE allow someone to stay that long?? Wouldn’t non-Legal Counsel be held to visitation during normal business hours??

I would hope that Dom Casey has, waiting patiently, I would love to be the fly on the wall during that one. He knows more then we can even imagine, IMO that is why Baez is fighting (like he has been straving for weeks and there is one cracker left in the box) to protect whatever DC knows…IMO he will loose this…I pray I am right…!

I was thinking about Dominic Casey and hadnt heard anything about a deposition or about a plea lately either. If the trial is put off for a longer time, when do you guys think will hear from Mr Dominic. With all his involvement with the Anthony’s, seems to me he is VERY important to the case. i think if DC got a deal the only reason he would get one would be to spill the beans, which I think he would be very prepared to do. From Blink’s articles, he doesnt seem the type to be very loyal unless it was to his benefit—just waiting for some more depositions or document dumps to come out. But we all know the outcome of this regardless of what the defense does. And thank goodness we have Judge Strickland!!!!!! I dont know if I said this here but I liked the way he handled Casey’s “apology”. He stuck to the facts and didnt let her engage him in Casey speak—-no absolutelys and on and on. Just asked if she had be coerced, or on drugs or alcohol, etc.

I know that Monday is the deadline that Judge Strickland gave the defense to come up with their “proof” that Caylee’s body was put in the woods/swamp area later than the state is claiming.
Is there any kind of hearing for this? Or is it all just done between the parties, and we won’t know about if/when it all happens? I’m in the dark. tia

Chi Town Judy proof there is no proof, if there is a hearing they will loose big time…………proof what a joke, weeds growing through this lil babies bones no way no how is there any proof.

Anyone know what specific topics are covered in ‘Court Motions’ filed with the court ‘on Various Motions’? I suspect this is a pre-Feb 1st recap of all the motions the defense has requested that the court order the state to provide more discovery including non-discovery documents from the FBI and Oakridge to call their own work into question.

Baez again, blames the wrong people.
Say– did anyone see, as Baez argued for the judge to order the state to give Oakridge, Lyon’s headscratching moment? Baez stumbles and bumbles, then comments about the defense having the rug pulled out from under them, she scratches and scratches, looks away from Baez and writes some notes. Was Lyon content to allow Baez the podium in the fraud case because she wanted to see how he handled things in a situation where he could not make things any worse than they already were? (the judge got his two cents in, suggesting Baez and Lyon take a moment to speak to each other at one point, not once, but twice)

The comment by Cindy (“I don’t want to lose another one”) Then there was the comment by Lee (“Is this like the last time”).Could it be that Casey had a baby before and did something to it . No one ever knew about it because Cindy helped her. I may be way off on this but I finally decided to run this by you guys to see what you think? RE Chrystal’s switchover– so it was her believing the defense statements about searches in THAT woods area before Kronk that caused her to begin her task against Roy? Well, Crystal, that is one and the same issue that the defense has for the past year, refused to support with names– there are two in discovery now, but there’s Joy Wray too– BETTER YET– do your own real ‘fact’ investigation. A Chief in the US forces should be able to do objective fact-finding research, but probably not if you are already in an anti-ex mindset.
Monday, Feb 01, is the date given to supply the names of those who claim to have proof that no body was there in the woods prior to October 14 when Casey was incarcerated. They made the claims, but have yet to provide support.
Then, Crystal, go to http://www.thehinkymeter, and check out the well researched, objective reports on waterlevels in the woods at the time of those searches, check out the related stories there, and of course, Blinks article re: the photos of those same woods to show why there was no TES search.

So I watched the ‘I Kill’ video. What was that all about? Why would Casey teach her baby to say that? It’s also odd that there is no interaction between them. It is a very strange video clip. Why would she even keep it for anyone else to see?
I remember taking videos and there was so much of me prompting ‘goo goo ga ga , say momma, say dada’ and making faces to get a reaction. After watching it a few times I thought – what am I a clown?

I have often times wondered about this too. I am not sure how to interpret 90% of what comes out of the Anthony’s mouth. For the sake of any other children I hope not. But Alas, Who knows? Casey seemed to keep the possible pregnancy from Brandon a secret also……or is this all just lies Casey told and they believed?
I don’t know. I thought Cindy meant that she had “lost one” [Caylee] and she didn’t want “to lose another one [Casey]”
That little aside from the Missus A. was one of her statements that made me believe she knew what had happened to Caylee. Maybe not all the particulars, but just in general. Also, with that statement, she was determined that Casey was not going to be punished for whatever had happened to Caylee.
Lee’s question “Is this like the other time” made me suspicious that Caylee had been taken by Casey and kept away from Cindy once before, undoubtedly with some wild Casey story attached to the incident. Or perhaps Caylee had been truly lost before a result of Casey’s negligence.
