Kyron Horman Missing and Endangered: Grand Jury Meets, Indictment Imminent

Portland, OR- In the case of missing 7-year-old Portland child Kyron Horman, developments today continue to unfold at lightening speed.

During a poorly-kept secret convening of a special grand jury that is in session today, sources inside the investigation believe it’s triers of fact will return an indictment against Terri Horman and possibly one other individual.

It is however, unclear as to whether or not the grand jury is hearing evidence in the alleged murder for hire plot MCSO informed Kaine Horman his wife had master-minded, OR evidence surrounding the disappearance of Kaine and Desiree Young’s son Kyron.

KOIN caught Terri Horman’s friend DeDe Spicher, who was subpoenaed to appear in the proceedings this morning, on video with her attorney, entering the courthouse. Spicher was the subject of a public plea asking her to cooperate with investigators by Kaine Horman and Desiree Young last week.  A neighbor of Spicher’s has confirmed the FBI has been seen removing boxes and unknown bagged material from her residence.

According to several sources, DeDe Spicher, Terri’s roommate  post Kaine’s restraining order,  was working in a garden near the Horman home the day of Kyron’s disappearance when she received a call at approximately 11:15 am. She left abruptly, returning at approximately 1:00 pm. DeDe was unreachable on her cell phone during that time and the property owner became concerned. Spicher is a long time friend and workout companion of Horman’s.

Earlier today, Laura Rackner, Kaine Horman’s Family Law attorney filed a motion to find out where the funds are coming from to foot the bill for Terri Horman’s high profile criminal defense attorney, Stephen Houze.

In Horman’s motion, he is seeking the disclosure of the payments made to Houze, and whether or not it came from marital funds. If it has, Kaine Horman wants half the cash to pay his own legal bills. Kaine Horman alleges that Terri Horman disclosed to a third party that she paid a whopping $350,000 retainer to Houze, however, provided no proof of same in the papers filed today.

In what appears to be a media timing coup, tonight’s episode of Dateline NBC will feature Kaine Horman, Desiree and Tony Young, with interviews and coverage of Kyron’s disappearance.

Multnomah County Sheriff’s Office Public Information Officer, Mary Lindstrand, has announced a press conference tomorrow at the MCSO Training Facility, beginning at 2:00 pm PST.

    While watching the video of todays grand jury story and seeing Houze, it showed a man with short, dark hair in blue “jail garb” who looked like he was handcuffed that was standing next to Houze. I cannot find the video link of it. Did anyone catch that?

    My best guess as to what happened:

    Kyron leaves school that day with someone he knows. 75% chance that person is Terri, 25% chance that person is an associate of Terri. There is an associate involved, I believe, and this person is known to Kyron. Most likely – Terri hands boy off to associate. Perhaps the landscaper.

    While Terri runs some errands, associate quickly kills the boy (I hate even typing that). Body is disposed of in a place that is almost impossible to locate. A place that has been per-determined and prepared in advance. On Sauvie Island. A place where the landscaper could be seen digging in the dirt and no one would ask any questions, because they think he is working there.

    Sometime while Terri is supposedly “soothing Kiara’s earache by driving her around” – Terri goes to Kyron’s location to verify that the plot has been carried out. She has DeDe watch Kiara during this time.

    Terri goes to the gym to “work out” ie change clothes and shower and perhaps work off some adrenaline…

    Terri returns home and posts Kyron’s science fair photo on FB and waits… thinking that the photo and her errands + workout will provide enough alibi.

    Motive? She really, really just hates the biological mom. Jealousy gone a many degrees too far. She just wants bio-mom out of her life for good and the only way to do that is to eliminate the one connection between herself and Desiree. She first tried to sever that link with the MFH plot against Kaine. When that didn’t work, she went to the next target.

    If DD was in fact not questioned at the GJ today, do you think that the purpose of having her there might have been that they wanted her to sit through it and listen to all of the testimony and evidence, with the hope that it would shock her enough to turn on TH?

    Alternatively if they have an idea that she will absolutely not turn on TH, did they want to expose her to the details and then observe what actions she takes from there in terms of relaying her new knowledge of the evidence back to TH?

    I am assuming of course that TH was not part of the GJ.

    I was once a part of a GJ and I think they had a subpeona for me, but didn’t need to use it because I agreed to go. And regarding Blinks answer to Shannon, I wonder if DeDe’s lawyer could be bargaining “immunity” for her if she testifies against TH? Which could hold up her testimony…If they know she will plead the fifth, perhaps they can use immunity as a bargaining chip. Please correct me if anyone has knowledge that they wouldn’t do this at this stage.

    I am just curious, if anyone can answer this, can you plead the 5th at any stage in a trial, or just the GJ stage? Or would this be contempt? Wouldn’t eveyone plead the 5th? I don’t understand this aspect of this part of the process…TIA

I am so painfully aware of the reality that I am not as quick as some of the other readers to pick up on some of your subtleties, I know that there is always always information in there.

    TH telling a third party that she retained Houze with $350K was probably just some bragging/lying/sick *^&(.

    I completely understand where Kaine and his attorney stand and why they are doing what they are doing, but if TH doesn’t say anything in a courtroom about the $350K, then I have to wonder what good this is going to do. Even if her claim is in her handwriting, can’t she just say, “I made that up to stop them from asking me personal questions about my attorney,” or some such thing.

    B, do you think Terri will try to run? I don’t think it would be impossible to get out of Roseburg. She could get in the trunk while the car is in the garage. Of course she would have to dye that squirrel.

    I think KH’s attorney is using this newest filing to aggravate and pressure TH into something. She needs to come forward and speak the truth. The more pressure they put on her, the more likely she will cave. I do believe they think it will take a mountain to move her….so this is just another 50 tons added to the pile.

    KH and attorney don’t likely believe they’ll get any money…but, sooner or later she will have to appear in court and respond to these filings. The sooner the better. Also, any more slanderous media about Terri can only help their case. Such as…if Terri has agreed to “tell all” in trade for the funding of her defense…when she is unwilling to “tell anything” now to help Sweet Angel Kyron now, will only help their case.

    Please God, let Kyron be found soon.

    @Shannon- they usually only have one person testifying at a time and their lawyer as they don’t want to let information out if there is going to be an arrest, it is like a secret really.

    In the Dateline episode, when Desiree read the note that she had written as a plea for whoever had Kyron to let him come home, she never looked at the camera once. I know that she meant every word, I don’t question her sincerity and longing at all, but I felt as thought she knows that noone “out there” has him. She read it I think because she wants it to be true, but I think if she believed it to be true she would have been looking at the camera in between sentences. She would have been speaking to that person “out there” who she believed had him.

    Shannon – I agree with you. I felt the same thing. I think because we have been told that LE doesn’t have evidence that has indicated he is not alive, we all want to believe he is alive and being held captive. Just because the perps covered their premeditated tracks well doesn’t mean a heinous crime has not been committed. I feel the only way Kyron will be found alive is if the kidnapper is totally random and not connected to TH. It just doesn’t make sense that he was taken by TH and her posse and still be alive. Surely they would have allowed him to be found safe at this point if they are the perpetrators and he is still alive.

    I pray daily Kyron is found. It’s way past time for this family to know where he is.

    Question for Blink or anyone in the know? Is there any time where you can NOT plead the 5th? It seems if you have valuable information in a case like this you should HAVE to tell all you know. It seems when I was listening to Annie Downing from the Casey Anthony case she did not have a choice and had to answer the questions asked of her when she was subpoenaed by the DA and the OCSO for her police interview with them I remember Linda Drane Burdick saying specifically that she had to answer every question when she started the interview. Could she have then pleaded the 5th? I remember when she was asked a question about giving some of her medication to a friend and not wanting to answer and her attorney (I believe) telling her to answer the question. So could someone give all the information in an interview and then get on the stand or in front of a GJ and then plead the 5th?

    OK I looked at this picture of DD and TH and I thought…BINGO….DD wants her. Then I listened to Desiree on dateline and she said it, ” Kaine had the relationship with TH starting in her 8th month preggers with Kyron”. I’ve suggested to you ladies that Kaine knows what Terri is all about. He sat right there on Dateline denying that he had any clue…BS ladies….he knew. Kaine and Terri did the dirty to Desiree. They went on to have a weird relationship…he disrespected her….he put his hand on her boob and was photographed that way. They are both loosey goosey
    Kaine is a schmuck and Terri is a super schmuck and DD just wants Terri. I’ll bet DD was freaked out about Cook and Sanchez….that’ s what the LE needs to play up. Jealousy runs rampit all over this case. I feel so bad that this sweet little boy got caught up in it, however, both those boys in that house knows what’s been going down. Trust me….this household is messed up! I also go back to the fact that there is no way people at that school do not know the lowdown. I think everyone in that town…ought to just start telling the truth. And if that boy does come home…..Kaine Horman…….he gets to live with his mom! Kaine should of packed that boy up and let him live with his mom. I can throw this stone because I had to do that exact thing. It is the pits…but every kid really wants their own mother. period.

    If there isn’t a body found, couldn’t you still charge someone with kidnapping if you had enough evidence to show that part of it? Then if a body were found later, the murder charge could be used in addition. A child would have to be kidnapped to be murdered someplace other than “on the spot” where he was supposed to be. I have heard people attribute the delay in arresting Terri to not knowing for sure what charge to use and fearing they would only get one shot at proving whatever they charged her with, but it seems there should be ways to deal with that in advance (and I’m sure LE and the DA have worked very hard on getting it right).

    I have always thought the delay was probably to be sure they had as much evidence as possible against any and all others involved – I would hate to see anyone who has even the smallest bit part in this “horror movie” get away with it. I’ve never felt this was a one person crime – but it’s quite possible, like the story of the blind men and the elephant, each participant had (was given) a different view of what was happening and why by the one who set it all up. If that’s true and becomes obvious, “loyalty” may finally be trumped by “reduced charges”.

    Just finished watching my recorded Dateline special on “Little Boy Lost.” (Dear Kyron, I do so badly want for you to be found safe.)

    I am NOT knocking Desiree or commenting on Terri’s guilt or innocence with this, but here’s what jumped out at me as an outside observer:

    (1) Desiree, after learning from both the 911 operator and then Terri herself, that Kyron is missing, says to Terri over the phone that she is on her way to Portland. Desiree is surprised that Terri’s response is along the lines of “You are?”

    (2)Re-watching the first press conference with all four “parents” in light of (1) above: Terri, after looking up at Desiree in what has been described by another commenter as a “Judas look” (and I don’t necessarily disagree) looks down and closes her eyes in a prolonged manner that strikes me as extremely pained (remorseful?).

    What I took away from this was that *IF* Terri is involved (innocent until proven guilty here in the U.S.), she was caught off-guard that Desiree would be this upset over losing Kyron. It speaks more to a perceived lack of Desiree’s involvement or investment in Kyron’s life by his day-to-day caregiver. I guess what I’m saying is that it seems Terri was caught off-guard by just how much Desiree cared for or was invested in Kyron.

    I know it’s going to come across as callous to say this, but when the Dateline reporter says Desiree “wonders what she could have done to spare [Kyron] this nightmare? The thought gnaws at her”–my response was that Desiree could have “spared him” (IF Terri is actively behind his disappearance) by giving the impression to his day-to-day caregiver that he was an integral, primary part of her life; if she had given his day-to-day caregiver the impression that his presence or existence *mattered* this much to her.

    I’m ending this comment with a heart-felt thank you to Blink for being able to stick with these horrendous cases concerning missing, abused, exploited, endangered children–because this academia-oriented commenter is started to learn she may not have the stomach to keep running with the big dogs. WHATEVER the f*cked up family dynamics are in this case, I just want BETTER for Kyron–and all the other real-world potential “Kyrons” out there.

    I agree with Blink, this GJ and the talk of an arrest is probably related to the MFH being the stronger case, having said that I must say this, if that is what the arrest is related to then they still have no hard evidence on what happened to Kyron, only circumstantial. (sp) That breaks my heart.
    The thought of any child out there like this breaks my heart and ALMOST makes me want to implant a GPS in my grandbaby. Now there’s something I never thought I would say.

    @annie and onelil- re immunity and the 5th- I thought of this before they convened. If she stated her intent to plead the 5th, it is likely that they immunized her for a portion of her testimony. Blink may be able to confirm this, but I understand that if GJ wants to hear the testimony, and the person pleads the 5th, they can be immunized for part or all of their testimony. That means that the testimony received by them cannot be used against THEM (it can against another, though, is that right, B?). It’s a way to force a person who doesn’t want to testify to come forth with answers. There is no right to not testify against a friend. There is marital immunity, but DeDe isn’t married to Terri, that I’m aware of. I suspect that she either did plead the 5th, or stated her intent to do so, and that she was immunized for part or all of her (upcoming) testimony. GJ may wait to hear her, and try to find info another way (without immunity). Blink, do I have that right, re immunity?

    There are a few key things that seem to be ignored. If Terri did do away w/Kyron & DeDe was involved during 1 1/2 hrs of her absence from her job, they were both back at home/job by 1:00 pm. I would think that Terri would have wanted to support her alibi further by suggesting to Kaine when he got home, lets go pick him up early, suprise him,& do the ice cream treat & pick-up the project. Why was that extra time needed? Even if she had put him in the water (ugh), police etc. would be looking around the school & would have never started at Sauvie Island. I think their has to be someone else, someone who needed that time. I still go back to Tanner Pumala interview that the family requested he not do, but the grandmother okayed. To me that spells hate.
    Terri sexting landscaper & Mr. Cook leads me to believe that this is not the 1st time she has done this. Usually adults who cheat, cheat w/coworker, w/nieghbor,or parents of their childrens friends. I think maybe Terri sexted Tanners father at some point prior and his wife found out & family knew. I also think that she had something going on with Brians sister Ann who was a nieghbor to the Hormans. Am I the only one that thinks it is odd that she moved to Arizona the day of Kyrons disappearance. Could it be that Kyron was handed off to Ann & that she took him to Arizona (I love him, father abusing him, please help me get him safe, I will meet you there when things die down). I think this extra time was needed because Kyron was sitting up in a vehicle. Everyone was looking around the school, but perhaps Police somewhere in the state would have noticed him the back seat of a car. Ann & Brian Pumala are brother/sister, yet have not talked in a long time. Could she have used them both, thus shame/silence.

    You may invoke your Fifth Amendment Rights at any stage of the legal proceedings. There are different types of immunity, blanket and use. Blanket means what it says. Use means they cannot use your testimony against you, but can use other evidence.

    @Puddenheadwilson: I respect your comments about what you believe that Desiree could have done to show TH how important Kyron was to her, so she would not dare harm him.

    My take on it, however, is that TH is just one of those people who does not pick up on the feelings and non-verbal cues of others and the appropriateness or lack thereof of her own actions. I think we have seen this disconnect in TH’s personality: “not being able to read people and situations correctly in many instances”, 1) not realizing that the dr’s appt vagueness was lame, 2)evidently thinking that her alibi’s and crime would be ‘the perfect crime’, so she could ‘refuse to talk”, and also the main factor: 3) how it looks to the country to have a stepmom who would not bother to help an investigation, and who would refuse to help find the missing child, and 4) not realizing the firestorm that a child missing from school would create in LE and media interest nationwide. I could go on, with the sexting, LS,….as in “just not appropriate, at all.”

    Something is very wrong in TH’s personality, imo, and it is not looking to me like depression, PPD, or insanity. It is just looking like a person who can only assess (mis-assess) other people’s feelings through her own way underveloped and distorted ego-centric narcissism.

    Just about everything TH has done besides “losing” Kyron, and acting nonchalant about it, has been very odd also. The LS sex, the MS sexting, the misjudging that Kyron would be missed by anyone.

    She acted like she thought it would not be a big deal.

    I would say, major mistakes in reasoning and judgement on her part, all through this mess. The public has been sitting back watching her, and thinking, whoa, that just doesn;t add up for a reasonable person to be acting in those ways.

    If that is the case, then perhaps DD will lead LE to Kyron today.

    Interesting that the school area was being searched again in the last couple of days, as if LE wanted to make one last effort to find Kyron before having to grant immunity to DDS?

    I do not know what to make of the bags of items taken by LE from DDS’s home.

    No no not at all, I suspected that was what you meant, but as Cathy Bickel posted that reality makes me sad too. I would like to see the other case gain enough strength to become a reality.

    @Shannon- they usually only have one person testifying at a time and their lawyer as they don’t want to let information out if there is going to be an arrest, it is like a secret really.

    Is it likely that she didn’t testify because she requested immunity, and that she won’t testify until she receives it? I’m not sure if that works in a GJ hearing…

    @Annie – I am thinking that something in terms of that, or a plea deal, is what they are hoping will allow them to finish creating a case if they aren’t able to find Kyron.

    Terri, from what I see of you on the outside looking in through dirty windows, I am willing to bet you read this site. So, if you do…

    It is time for this sick little game to stop!! There is an innocent, young child out there missing and a family hurting. Any mother who has carried a child, bore a child, cared for a child, raised a child, can completely understand that you child becomes your life. Not to mention, a child is definition of innocence, KYRON is innocent in whatever web have been woven here. One thing Kyron should not be, should never have been, is a pawn in a very sick game.

    A missing child, an attempted murder-for-hire, an affair days after your step-son goes missing, a supposed attempted abduction of the baby after the restrining order – Geez Louise, enough already!

    This is not a soap opera, a movie, a game, or anything of the like. This is real life, real LIVES! Somewhere along the line, something snapped, you made a wrong turn, and took a path that is leading you to a very, very dark place.

    You may have gone to far to save yourself, but if you ever loved Kyron, if you have anything at all left in your heart and soul other than coldness, let Kyron come home!!!

    You are not going to get away with this. THIS is not going to go away! The walls are closing in and the net is coming down. We are in the 4th quarter and the two minute warning has just been called – the game is about to be over. Where is Kyron??????

    I enjoyed reading your well written post. I have a different take on the relationship between Terri & Desiree.

    I don’t believe Terri cares what matters to Desiree.

    I base this belief on what Terri did in the family’s first news conference. Terri was all over Desiree physically, even as Desiree stood frozen in a full body cringe. Terri was not comforting Desiree, because if she were, she would have read Desiree’s reaction and repected it by laying off the theatrics. Terri was violating Desiree on that stage and it didn’t matter her that she was causing revoltion on top of pain.

    My conclusion was/is; Terri violates people. Nothing that’s been revealed since that first news conference has contradicted my initial reaction.

    If there is strong evidence in the MFH, I think taking that case to trial first is a positive move. If Kyron’s disappearance is in any way related to the MFH, i.e., if there is a common factor such as “lifestyle choice,” new evidence is likely to surface during the trial, or someone who is implicated in the trial may decide to offer information on Kyron’s disappearance in a plea bargain. Kyron’s disappearance is certainly the more pressing of the two cases since 1) if he is still alive, he is endangered and 2) if he is dead, it is the more serious crime. So, it is understandable that LE would want to wait until they have more substantial evidence to try that case to ensure prosecution.

    @puddnheadwilson – Wow you noticed/analyzed the expressions from that press conference the exact way I did. TH totally looked as if she was surprised and remorseful to see how upset Desiree was, and the look also said to me “What was I thinking? I should NEVER have done this” (whatever “this” is). The classic bored housewife who got into trouble.

    Also check out the look on Kaine’s face. Terri turns to him and wants to be comforted (an act? or did she really want his comfort?) He looks very uncomfortable even touching her, and he also looks GUILTY, as if it has dawned on him that he is partially to blame (indirectly) for causing this through whatever actions or behavior on his part drove Terri to do what she did (if she did it), and that now it has possibly/likely cost him his son’s life. It will be interesting to see how accurate this turns out to be – IMO looks can often be a real giveaway.

    I just want someone to come clean. I don’t hold out a lot of hope for Kyron to be alive and that someone out there is hiding and taking care of him; he would surely have been turned over by now (sorry, odds are way against it IMO). But I want to see justice to whatever crazy idiot would take out their selfish needs on an innocent, trusting child, and I want to see this little boy found, no matter what else happens.

    @blue – sorry you sound like TH or one of her friends, I’m not buying the “creepy guy” theory.

    Hard to conjure up a scenario where Terri could come up with the money at all and second, for Kaine not to know about it. Maybe her family has mortgaged property or cashed in a retirement plan. Not sure if the house was ever jointly in her name. If it wasn’t, she could not encumber it. Personally, I think a $350,000 retainer is high and maybe a boast or a plant to see who is listening. Sometimes if people think they are being monitored, they intentionally will make a false disclosure in an email or text to see if it shows up somewhere.
