Kyron Horman Case: Terri Horman Attorneys Call Her A Suspect

In court papers filed Wednesday, Bunch went further, noting that Terri Horman is a “de facto suspect” in the second-grader’s disappearance…”

Portland, OR- In a voluntary appearance in court yesterday for matters relating to the pending divorce motion by estranged husband Kaine; Terri Horman showed her face for the first time since the week after her stepson, Kyron, vanished from Skyline School.

Although Kaine Horman opted to be represented by his counsel Laura Rackner and not appear personally to protect himself emotionally, according to Rackner, Terri Horman braved the fray.

Arriving with attorneys Peter Bunch and Stephen Houze, the trio was immediately met and escorted by MCSO deputies in “the box” formation to the 5th floor courtroom where local media scurried in from behind.  Within 45 minutes, Judge Meisenheimer ruled in Kaine Horman’s favor and granted his request that the issues of the mortgage-sized retainer, allegedly furnished by Terri to Houze and other distribution and custody  issues will be heard in a hearing on October 7, denying her request to have the issues bifurcated.

During the proceeding, Bunch argued that his Client cannot properly litigate the divorce and custody actions currently because she is.”..unable to proceed in the ordinary course to protect her rights as to discovery, property division, support and, particularly, custody and parenting time issues.”

In fact, for the first time publicly, we learn a very important detail about the criminal investigation into Kyron Horman’s disappearance.

According to her counsel, who would certainly be “in the know”, Terri Horman has NOT been named a suspect by MCSO in Kyron’s case, but she is painfully aware she is one.

Loosely translated, a defacto suspect is an unofficially declared suspect, but for all intents and purposes is definitely the target of the investigative crosshairs.

The Microsaccade Moment

Microsaccades are tiny involuntary movements of the eye generally caused by visual fixation.  The result on visual perception can cause the beholder to question if they are “really seeing what they are seeing.”

I had a few of those yesterday while analyzing footage of the day’s events in conjunction with known facts of this case.

They Are:

The MCSO guard detail dispatched at the courthouse assigned to Terri and counsel et al for a family court appearance.  I have spoken with a few local family lawyers who do not wish to be identified, with a combined 26 years of practice.  None have ever seen this practice in a similar matter in Multnomah County.  Specifically, the deputies went inside the actual hearing and waited to escort the trio out the back.

During the hearing, there was not a syllable mentioned about the driving force behind the request for expedition of the case in the first place. The very substantive weight that was used to secure an emergency custody and restraining order, which remains uncontested to date: The Alleged Murder for Hire Plot. Why wouldn’t a family lawyer looking to abate the divorce case strike at the very merits on which the plaintiff’s arguments are based? The plaintiff in this case uses an almost one year old mfh plot allegation, which was not carried out, and no person has been declared a suspect or arrested, to control every filing to date and counsel does not refute the claims therein? What possible reason could that be?

A recent interview with Terri Horman’s son James, in which he states that his Mother cannot have a computer, cell phone, or leave her parents home in Roseburg.

Blink Analysis Editorial: Sealed Criminal Indictment OR Civil Commitment?

A Civil commitment, which would have had to been voluntary, such as a concern for Ms. Horman injuring herself, or some sort of dependency is a possibility, but a highly unlikely one considering she appeared in court yesterday.

Strictly my opinion of course, but based on my microsaccades, I think it is entirely possible that Terri Horman is under a pre-arrest indictment in the matter of the alleged murder for hire plot, or some derivative thereof.

It would certainly be unlikely that she could have been booked and granted bail without a leak, but a sealed indictment, which may or may not include a sealed arrest warrant, would follow Oregon’s propensity to use the grand jury as a form of “preliminary hearing.”  In light of the fact that there is an ongoing criminal investigation into Kyron’s disappearance involving Federal, county and State investigative assets, it would be entirely appropriate.

The public would not know until such time as the indictment and any potentially attached writs are unsealed.  Throw in the possibility there is always the chance that Clackamas County may be the charging county for such an offense and not Multnomah.

In which case, this is about to get very interesting.  Recall MCSO chief Dan Staton saying Clackamas County Major Crimes Team is involved in the case?  That would suggest at least part of a crime has been established in their jurisdiction.  Rudy Sanchez resides in Clackamas County.

Clackamas County District Attorney John Foote and Criminal defense attorney Stephen Houze are well acquainted. You might say that Foote owes his very job to Houze in a way-

John Foote  lost as the incumbent DA in 1996 to his own deputy district attorney Terese “Terry” Gustafson.  Terry was in the middle of fighting an Oregon Bar complaint at the time which cleared her name just days before the inauguration.

The embattled DA did not take long to be the subject of more ethics violations including felony perjury charges for lying to a circuit judge about releasing the file of a juvenile that was ordered to be destroyed. Gustafson was disbarred.

Who filed the Bar complaint who also represented the accused boy who was subsequently acquitted?

Who was the prosecuting attorney for the Oregon Bar?

Stephen Houze.

    The sleeves were indeed on the long side…at the same time it seems reasonable to me that LE could have chosen to remove any electronic monitoring device prior to the appearance, and then put it back on directly afterward…As not to tip off any information of a sealed indictment or LE strategy.

    Did anyone else make note of, or find it suspicious, that Terri was transported in a 2-door sedan? The driver was a plain-clothed guy with an ear bud, like you see w/secret service or something. Highly strange, IMO. Especially for a woman wearing a skirt. Perhaps it was to ensure that she remained tightly in custody…Terri in back seat, take device off, from the second she stepped out of the car, she is under direct eyes/supervision of deputies, attorneys, media -LE then escorts her directly back to the 2-door car where she essentially nosedives into the back seat. Then after they drive away, re-attach device…?

    The Multnomah County Sheriff’s Office, a participating agency in the Northwest RCFL (NWRCFL), is continuing the criminal investigation into the disappearance of 7-year old Kyron Horman, who was last seen on June 4, 2010 by his stepmother at his elementary school.     Regarding wearing the wedding ring to court, I saw a very dark, noticable wedding band on her ring finger on her facebook photo where the three kids are around her and she is wearing the green blouse. She is holding Kiara in her lap. I don’t have a link as I am not on facebook.

    But in the first press conferences, she has her left hand over her stomach grabbing her right arm and I see no wedding ring at all.

    So it does seem odd that she would suddenly put a wedding ring on now, therefore I have to agree it was due to coaching by one or both lawyers. But, I haven’t see a photo or video of the wedding ring she wore this week to be absolutely sure it was the same dark, highly visible band.

    Thanks for that link, Lyla. I find it interesting that Desiree continues to address TH specifically in these press conferences rather than either of the landscapers. It almost sounds as if she is giving TH a last chance to come clean before…an arrest, maybe? Hmmm….

    Why is DY always speaking, In today’s OL article she says TH is “angry” but she does not know why. Isn’t it a risk to speak to someone who is “angry” but you’re not sure why or who she is “angry” with. What if she is “angry” with you? If that is the case, you take a HUGE risk by putting yourself out there to PERSUADE her to come forward with information. TH would purposefully withhold information if the target of her anger is the one asking her to come forward. I always assumed the target was KH. What if it is DY?
    DY stated e-mails were always long and on the day Ky went missing they shortened. I can’t help but notice how KH looks at DY affectionately “proudly” as she makes her public statements. I wonder if TH suspected KH harbored feelings for DY. Also of importance is the fact that Ky was taken just before he was about to visit with DY and TY.
    BTW—Blink, you are awesome. I pray Ky will one day be found.

    IMHO TH is a material witness and one time participant in a human trafficking ring. She was not afraid of the LS when he came to her house demanding money. She could tell it was a setup. She was already ticked off because she never got her money, she absolutely did not owe any money. She provided to commodity and trusted the criminals. Terry got burned and she deserved it. Kyron did not deserve any of this.

    This makes the most sense to me — given the amount of security involved in the transport.

    In regards to the long sleeves, I have another point of view. Someone mentioned the possibility of a vest? I think she’s broad-chested — and from personal experience being a former swimmer (and man shoulders) I’ve found when you go up a size in jackets so they can be buttoned all the way, the sleeves end up being too long. I don’t think she was wearing a monitor at all — I would think it would be way more noticeable near the wrist.

    I see an over-sized, ill-fitting jacket.

    That’s exactly the point I’m trying to make.

    Her counsel stating that she is favored suspect via public nomination – which everyone already knows – pretty much does two things:
    1) it gives more strength to their desire to delay the family court issue;

    but most importantly,
    2) it names the white elephant in the room, thereby negating much of its power.

    Her counsel never would have said that by accident – instead, it would have been quite deliberate and intended to defuse it’s importance.

    And still – it’s not news. I understand the mainstream media rehashing things for ratings – what I question is why you would be.

    Some of the news sources started changing their announcement at least by Thursday about the interviews instead of mentioning a televised press conference. None of them made clear it was a change.

    One reporter apologized for the station announcing in error that it would be a televised conference. I think this way was best – although WE and many others want to see them and hear what they have to say, if there is nothing new to report, it tends to make some people whine about missing their shows. This way it shows up on the news and online and works just as well, I think.

    I heard Desiree say in a previous interview very briefly that she has a counselor. I believe Tony will be a strong support for that to continue. No matter what happens, even finding him alive, it will be a long and difficult road. I hope Kaine has support as well. People help each other quite a bit during a period of grief, but this sort of suspension where you can’t grieve and you can’t rejoice and even the “enemy” is not clearly defined, must be an unspeakable hell to go through.

    During the one-on-one interview with Katu Kaine said he feels like he didn’t know Terri really, he only saw what she wanted him to see for years, to paraphrase. I believe that is 110% true. I think that’s been Terri’s whole life actually. She can become whoever she needs to be in any given relationship and then, for whatever reason, tires of it or gets angry or blows the relationship to hell like with Kaine and then it’s time to reinvent Terri again.

    She tries on different “lives” like others try on clothing, IMO. She tries on boyfriends, husbands, children, jobs and friends. She gets what she wants from them and moves on.

    The picture of Terri above, to me, shows nothing but coldness in her eyes, a hardened woman who’s finally been exposed to everyone. This is the true Terri IMO. She was a good actress for a long time. She fooled and manipulated many. I wish Kyron hadn’t been caught in the middle of her web.

    My heart still breaks for Desiree and Kaine. I hope they can get the support and help they need to survive all this. praying for Kyron

    @Wazzupwithu (sorry if I butchered name twice): EXCELLENT article about sustainability in the prison system as it is an intriguing concept to someone who lives in NJ. http://www.portlandtribune.com/news/story.php?story_id=128138362467856500 Between articles like these and the reading on places such as the one Dede works at, the craigs list ad for a bunch of free spirited hippies looking to live off the land (paraphrase), the comments of Portlanders, and other tidbits, it seems to me as if Oregon is very much like California in terms of leading the way into energy conservation/care. (Note “CALIFORNIA emissions” to illustrate the point.)

    BUT: I also do not see a bunch of people growing pot in their yards to be the highly dangerous types that may be involved with this case. I totally agree with you about the loose end aspect of Pumala, and I share your curiosity as to the other 911 calls on Sheltered Nook. I would wager those were not made by the grower homeowners. Who wants the cops poking around in their pot plants? Or, do they just want a flashing light to show up and scare someone out of the crop? Seems more likely they wouldnt want cops. So, is it the neighbors that ARENT growing would be the ones calling the cops, because someone is out in the yard with a flashlight making noise and rustling up plant life with bottles of water and fertilizer.

    @Mockingbirdsings: I watched the videos without sound and the singular thought I got was that the one guy in the corner was watching her legs and her ass as she walked down the hall. That was about the only thing *I* picked up watching it that way. (Interesting exercise btw lol.) She does seem to have slimmed down. WTH else does she have to do under house arrest?

    I would imagine when she gets out of prison, she will be ready for her next body building contest. (Spoken with contempt because I fear she is the reason Kyron is gone.)

    Blink, are u referring to the searches of DeDe’s house & others as what “went down on the night of the 26th”? So many twists in this case I can only actually remember the date, June 4th, that little Kyron went missing.

    I’ve watched the videos several more times now and looked at the still pictures. I do not see a bulletproof vest on Terri. The picture of her getting into the car appears to look odd from the back, but her hair covers part of the jacket and I don’t think there’s anything extra there. Her upper arms appear to completely fill out the sleeves so it doesn’t seem like the jacket is a larger size needed to accommodate a vest, and her bust line is too defined from the side to be covered with a vest, IMO. There’s a little side to side movement of the shoulders when she walks that I don’t see when I watch a female police officer walking with a vest under her uniform shirt.

    I wondered about the long sleeves – both that they were long for a hot day and too long for her. I thought perhaps her mother went shopping for her and brought home the suit. I don’t know if Houze would have specified long sleeves, but she may not have had much choice for a black suit to purchase this time of year. Could even have borrowed the suit from someone.

    I wasn’t looking for an ankle bracelet, but they can be removed when needed. I don’t see her as a risk for running – she wouldn’t be willing to change her appearance enough to hide anywhere and her picture is everywhere.

    I do know someone who was charged and awaiting trial and was held in jail because she was considered a risk for running. She had some medical issues and her lawyer proposed releasing her to a parent with an ankle bracelet she would pay for herself (so I know it’s possible). The court said no for unrelated reasons.

    Being a counselor, I immediately thought of other reasons for hiding wrists or arms, but I don’t think those are likely to be true of her either.

    2 things occurred to me to mention –
    We have mostly talked about death threats as though they were all from angry posters who say ugly things from their home computers, and were “used” by her attorney to get sympathy for her, but it is entirely possible there may have been a threat(s) that LE considered credible enough to follow up on – we’ve also talked about the kind of criminals she may have been involved with. Someone mentioned that if LE were guarding her home now, they would have been spotted by the media – but maybe not. I’m not “voting” either way, just saying it could be. It also was reported a day or two before that she was not expected to be at the hearing, but also that Desiree was supposed to be there – there seems to be a lot of media confusion about who’s where and when, but I would expect some of that to be orchestrated behind the scenes.

    Second, when we talk about leaks, I think of someone leaking something in a way that gets it to the media so we all would know (think Hollywood and politics) the information. However, someone like Houze would find a way to leak critical information to LE that never gets any farther than that – and we would never know – in fact, that seems much more logical to me (and safe for Houze). You probably all already know this, but I just thought of it, so I’m proud of myself. (chuckle)

    Blink – There will be a birthday celebration for Kyron in Medford on the 9th and the Portland area on the 12th. The one on the 12th will be a fundraiser for the search as well. Haven’t seen printed details yet.

    All of us wish we could do or say something that would help, I know. What about finding a contact address for each celebration and starting a “Send a Birthday Card for Kyron” campaign (for want of a better word). I would love to send one to Desiree and to Kaine both, and I feel certain others on this site would too. I think it would encourage them to know so many people care. The Wall of Hope has done that and there may be a lull now with it being moved this weekend.

    Here’s a thought – all the Blinksters (is that a real word?) who send a card could write on the outside back or return area of the envelope something you designate like “BOC cares” or just “Blink” because we are united in our efforts.
