Kyron Horman Missing: Kaine And Terri Horman Face Off In Family Court

Portland, Or– Following one of the largest organized search weekends on Sauvie Island since Kyron Horman, 8,was abducted from Skyline School on June 4, his step-mother and father squared off in family court. Kaine Horman, Kyron’s father, arrived with his attorney, Laura Rackner.

Kaine’s estranged wife Terri Horman, arrived with her criminal defense attorney; Stephen Houze and her family law attorney Peter Bunch.

Mr. Horman appeared in a crisp-white dress shirt and tie, and Ms. Moulton-Horman wore an eggplant hued suit with a long skirt.

Cameras were banned in the downtown Multnomah County courtroom; however, there were apparently several hidden “nests” as the tweets were flying real-time.

Peter Bunch, counsel to Terri Horman, is adamant his client is the subject of more than one criminal investigation:

“The state has the ability to obtain every single bit of information that is produced in this case and that is outside the bounds of what it could do were this proceeding not occurring,” Bunch said in court.

“It is fundamentally unfair for Kitty (Kiara) and for Miss Horman for me to be hamstrung in the divorce case for the information I have compared to what they have.” “The publicity that’s going on is not being driven by Ms. Horman, it’s being driven by Mr. Horman, when he tells national media there’s no doubt Ms. Horman is involved.” “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.” “We’ll concede, Mr. Horman can have the house, right now. Mrs. Horman is going to lose money…”

Terri Horman has not been declared a suspect in either Kyron Horman’s disappearance or the alleged murder for hire plot against Kaine Horman. She is however, seeking access to all of her 911 calls dating back to the DAY AFTER CHRISTMAS.

While this timeline coincides with accusations by Kaine Horman in his filings that Terri attempted to arrange to have him murdered, this is the first public revelation of that call. Bunch went on to say that Rackner and Kaine Horman, who are parties to case sensitive criminal investigation materials involving Terri, are at a supreme advantage to his client who should only be expected to plead her protections under the 5th amendment as a result.

After heated debate by those sides, we learned: Rudy Sanchez, the infamous landscaper/hitman for hire, has an alias, and has eluded service in the civil matter to date, although he appears to have cooperated. Bunch proclaims Sanchez is unlocatable as a result of MCSO unwillingness to share discovery of a witness in the civil case ( blink holds hands over eyes).

Michael Cook, a/k/a sexter king, waited all afternoon via subpoena by Rackner, but was only interviewed by the press. He states he cut ties with both Terri and Kaine days before he was outed for invasive scapular intrusions. No word on that healing process.

Terri Horman had her own personal black Friday this year.

She called 911 THE DAY AFTER CHRISTMAS. Regular contributors and readers of blinkoncrime.com doubt she had sale flyer questions.

Judge Keith Meisenheimer, was sensitive to Kaine and Kyron’s ‘round the clock nightmare, but feels some time may allow things to shake out. January 6, 2011 to be exact.

Following this afternoon’s legal melee, blinkoncrime.com Editor In Chief asked prominent Washington State Family Law Attorney, Lea Conner, to weigh in:

Although I preface my comments with the fact that I practice family law in Washington State and not in Oregon, I am an Oregon native that has followed this case closely.

I’m a bit perplexed by Peter Bunch’s reasoning that if the court were to abate the dissolution, he would respond by filing a motion to modify the restraining order so that Terri Horman could have visitation with the parties’ daughter. Essentially, Mr. Bunch is arguing that the abatement would prejudice his client’s ability to parent her child. My understanding of the Multnomah County local rules is that an abatement means that the entire case is halted. Neither party can bring a motion before the court, nor can the court hear argument or make any ruling on motions.

It was also interesting to hear Mr. Bunch argue that proceeding with the divorce would violate Ms. Horman’s right against self-incrimination in the disappearance of her stepson. This is the first time that Terri Horman has publicly acknowledged any self-incrimination issues. In her motion for abatement, Ms. Horman, through counsel, argued that the ongoing investigation into Kyron Horman’s disappearance had made it “virtually impossible…to proceed with divorce-related issues in an effective an[d] orderly fashion[.]” Were Mr. Bunch to bring a motion to allow visitation, Mr. Horman would no doubt argue that Ms. Horman’s actions demonstrate that Ms Horman or someone she knew was responsible for Kyron Horman’s disappearance, and that her behavior since Kyron’s disappearance shows that she is unstable and poses a threat to their daughter’s safety.

I do not believe Mr. Horman would raise Ms. Horman’s 2005 convictions for DUI and reckless endangerment, as not only later chose to have a child with Ms. Horman since that time, he also left both of his children in her care for extended periods while he was at work. Under those facts, it would be hard to conclude that Mr. Horman believed Ms. Horman posed a threat to their daughter. The judge’s comment that “[e]ventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings,” seems to indicate that the judge may not be willing to hold the action in abatement past the January 6, 2011, hearing.

I’m also interested in Mr. Bunch’s comment that “Rudy Sanchez” is an alias. If that’s true, then what is Rudy Sanchez’ real name, and how exactly did he first come in contact with Terri Horman?

It was also strange to learn that Michael Cook was subpoenaed to testify at the hearing. I’m curious if there were others scheduled to testify as well. I cannot speak to how the Oregon court operates in practice. However, I note that each party provided written affidavits in support of their respective motions.

Is there some reason that Mr. Cook’s statement could only be presented in oral testimony?

I’m not sure I understand Mr. Bunch’s logic in saying “If this is not abated we will not get reciprocal discovery.”

The state is not a party to a dissolution action. In a dissolution action, the parties can seek discovery from each other, and depending on the court rules, from third parties as well.

I’m not sure why Mr. Bunch would have the impression that there would be reciprocal discovery with a third party in a dissolution action, especially when that third party is law enforcement.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

    Dear Blink – Do you want me to post links to every local (Ptlnd. area)news story about sex offenders and crimes, whether they have been arrested or are wanted by police? I have seen many that I have not shared because IMO they were not related to Ky’s case, and I did not want to stir up more speculation on unrelated crimes. We all know that these sex crimes are occurring at an alarming rate, I’m just not sure if we need to share every one of them. Perhaps you want me to share them in the event that others here, yourself included of course, would want to decide for themselves if there was any relevance to this case.

    Thank you! The poster’s item #3 seems to me also to say the muddy bootprints were outside a door to the school bldg–not to Ky’s classroom. And yes, there is such a door just down the stairs from Ky’s class.

    Alas, that now seems less important to me since the ground was wet and a number of innocent people might have left a bootprint there. Good to know evidence was captured, though, and will be analyzed.

You know I’m looking for these guys in my very own hood, makes me sick. We all need to be aware and warn our children. My husband would rather stick his head in the sand, which has been the source of many arguments! IMO it takes a village to watch out for our children, the known perps that LE is seeking and report anything suspicious. None of us like living this way, but it is a cold, hard fact of life these days. The gift of fear, indeed.

    I ask your opinion because I respect your work and believe if anyone would know, it would be you and your sources.     As I read the RO long ago, my interpretation was that it did NOT apply to James. James is neither Kaine’s biological nor adopted child, and I don’t know if Kaine would have standing to make the requests he did under FAPA, anyway.

    Personally, I don’t see TH as a direct danger to him. And, her parents are in the house. And media and possibly LE just down the street. Maybe it’s in the best interests of James to have some parenting continuity since Kaine is apparently not seeing him now either.

    Some comments seem to focus on a “Dec. 26″ 911 call.

    I saw something different in Bunch’s statements about having access to 911 calls back to Dec. 26, 2009. It is possible that he’s requesting 911 call info dating back a specific amount of time, and not requesting a call “on” December 26th.

    Is there a 12/26/09 911 call? Or is that just a cut-off date for calls transcripts that TH’s attorney feels is the appropriate time frame — several months — to review?

    I just want to say a little something here, but please know that I am not going to respond to any questions.

    I speculate just like everyone else does here. I have no inside information or cold hard facts.

    Ultimately, I just think that Blink was trying to be kind in her response to me. Others, in so many words, have indicated what I had, but it just did not dawn on me until it dawned one me. That is all. There is nothing to read between any lines.

    Ultimately, we all make assumptions at one time or another, sometimes based on unrelated knowledge and experiences. It is the way our individual brains work. Nothing more. Nothing less.

    Again, I just think Blink was trying to be kind….. What a difference a kind comment can make lol.

    If in fact boot prints were found as above they say “adult boot prints”. This does not mean they belonged to a man. Also if they are male size it does not mean a woman may not have worn them, just because or JUST because. Blink are the prints a fact and if so of what importance as it was a day with above normal adult foot traffic?

    If there were truly boot prints outside of the door near Kyrons classroom…were they heading in or out? Was there a small set of prints with them? Is that a door that could only be opened from the inside? Don’t think any of us can answer these questions but it sure makes me think. If someone stood at the door (does it have a window in it?) and motioned for Kyron to open the door…would he? If he knew the person worked at the school…or if it was Terri…he probably would. But did Terri have on boots? Did Terri tell Kyron to go on to his room, knowing someone would be at that door? As I said…these are all things I am pondering. Not based on any facts we are for sure on.

    Annals- thanks for answering my query- IMO I find it quite interesting that no parent or local has came forward (that we know of) to say who that plaid shirt guy is- nor has anyone come forward and said who the skinny gray haired man is- I am assuming no one has come forward to say who the little girl is either, at least not publically
    It may mean nothing.It may mean everything.

    I would tend to think that those photos have been picked apart by LE with means to look at the reflections in the tv screen at the corner of the room and I am sure they looked at the difference of shadows shown under the desks to the left of Ky’s project- and they have looked at the angle differences between the photos to determine whether or not the same person took both pics and they have looked at the reflections in Ky’s glasses and in the shadows cast upon his project- IMO they know much more than we about the men and girl in those pics and more about the details than we do.

    PS Thanks to Lea Conner for your comment earlier-your thoughts were very well stated -thank you for explaining some possibilities for us. I feel I have a much better understanding .

    If a body were recovered what new information might be gleaned, other than, of course, he is deceased, identified, manner/cause of death, time of death, location of remains?
    Would finding the body bring us any closer to knowing “who dunnit”?

    Appears that Bunch/Houze are not too worried about what RS may have to say and they probably already have enough themselves to discredit or contradict his testimony. We have to remember that TH HAS been talking to her attorneys.

    IIRC early in the investigation a parent said LE had requested all photos/video taken at the SF, but I don’t believe any of these pics/recordings have been made public.

    Mom, I truly appreciate your response to the questioning and prodding, however there are all kinds on here and that is just a part which makes this site so informative, educational and, well, special. As with the many personalities, there are those who seek attention and revel in literary intrigue as well as those who grind the stone unabashedly for facts only. Most of our beliefs about what happened to Kyron have changed weekly and sometimes daily with each new tidbit of information revealed. Few of us claim special powers of enlightenment which dim the intellectual epiphanies of the stone grinders. Asking specifics about anyone’s post is not necessarily due to a paranoid belief that one has been left in the dust with respect to information. I have two advanced degrees. I’ve read hundreds of papers in my lifetime and I recognize cryptic when I see it. I also recognize most motives for being cryptic.

    I fully understand Blink’s cryptic responses to our inquiries. She is protecting those and that which need protection. She has one goal and kindly (and sometimes hilariously) leads us in the direction to reach that goal.

    I appreciate EVERY post on here. I believe EVERY post has something to add or subtract from the issue we all share our time and brainpower to resolve.

    Mom3.0, thank you, but I did not take it personally. I have a thicker skin than that. I was with idahogal when she said something along the lines of “much adieu about nothing”. I do not think it is a big deal that the mayor knows who the police are looking at in a high profile case like this. A child went missing from a school. Of course he would be briefed. I think Mayor Adams is a bit of a character and foolishly tweeted something after he had been briefed by LE. I then think LE told him to stop tweeting, so he did. I thought I was missing something, because others were asking about it, but I wasn’t. From now on, if something doesn’t make sense to me, I will take some time to think about it’s relevance to the case before I ask for clarification. My bad.

    maybe i’nm naive or not suspicious enough, but i don’t see or view any odd distancing of KH and DY. i mean, i suppose as time goes on, they are slowly returning to some sense of their former lives that means that are not as intensely engaged with one another as they were in the beginning. not like a statement that they are giving up, or that something is “up,” but rather a natural process that would allow them to destress a little. as a matter of one’s survival, i think you have to stop down a little now and then… but really, who freaking knows? could be anything. maybe pigs flew finally.

    hats off to the searchers out on SI this weekend. it is raining like hell here; fortunately, it’s still fairly warm. matt zafino says the wind is coming tomorrow for more outdoor portland fun!(portland marathon tomorrow). he says it might not rain between this hour and that hour, and a DJ on the radio today said, when you’re getting down to trying to predict an hour here and there where it might not be raining, it’s a bad sign…no kidding, eh? maybe the runners will find something relevent to this case. dont they go out thatta way? maybe i’m thinking of the seattle-to-portland thingy. the traffic is out of this world. just took me 1-1/2 hours to get from gresham to beaverton, got stuck in traffic due to 2 accidents and another crash listed on the highway boards of one on I-205. my son’s team won their soccer game though, so there’s that!

I love this site but confess at times I think I’ve landed in a “Twin Peaks” script, and I have trouble reconciling all the complexities of this case with the principle of Occam’s Razor.

    Please understand that I’m not questioning whether you read or heard this information. I’m only trying to track down more details:

    Did you hear this from the employee’s mother, or did you get this from someone who was repeating what someone else said?

    When did Terri and/or DeDe allegedly attempt to rent a PO Box?

    You also used the word “tried,” which suggests that they were not able to get the PO Box. Were they able to get a PO Box, and if no, why not?

    Any other details that you could share? (Pretty please?)

    I think you answered your own question, in your second paragraph. And I have no special expertise here. But they don’t have to agree to it in advance.

    Surely one has some unusual motive at the time he uses a name other than his birth name. Right? How many different aliases do you have? (Not implying anything. Lol)

    KH & Attorney have “used” LE criminal investigation information in their family court proceedings.

    About Rudy Sanchez……Blink, maybe you can help me out here…why would they want Rudy’s input on the divorce? What could he possible have to offer that would help Terri’s attorney’s? He would likely do them more harm than good. I realize the whole idea of a deposition is to figure out what a person knows before you have to prepare to deal with it at trial but if he’s a component of the criminal investigation (which sounds like it’s obviously going to spill into the civil issue) what could they want from him in the divorce arena that could help Terri? They seem miffed about not being to get ahold of him. That puzzles me too….if they’re talking about the same Rodolfo-Sanchez-Rudy-Estrada-Sanchez-Rudolpho guy (lol) that we are there are 5-6 easily accessible addresses to look for him at. Surely, being attorneys their resources would yield twice as much info as my measley ones do! So either they are not looking that hard or they just needed an excuse to bring his name up on the record, not sure what their real intention was on that whole thing.

    Thanks Idahogal…one more question..(or two)..Is this about revenge, an unpaid debt and the biggie….your opinion..why was Kyron disposed of? What satisfaction/reward did the individual(s) receive for participating in his demise?

    @lyla – You’re right, that is the biggie, and I have no freaking idea. Everything I said was just an attempt to fit together our collective puzzle pieces and make some sense of it. It could all look very different in another 24 hours. I just keep trying because I care so very much about one beautiful, precious boy named Kyron.
