Kyron Horman Missing: Kaine And Terri Horman Face Off In Family Court

Portland, Or– Following one of the largest organized search weekends on Sauvie Island since Kyron Horman, 8,was abducted from Skyline School on June 4, his step-mother and father squared off in family court. Kaine Horman, Kyron’s father, arrived with his attorney, Laura Rackner.

Kaine’s estranged wife Terri Horman, arrived with her criminal defense attorney; Stephen Houze and her family law attorney Peter Bunch.

Mr. Horman appeared in a crisp-white dress shirt and tie, and Ms. Moulton-Horman wore an eggplant hued suit with a long skirt.

Cameras were banned in the downtown Multnomah County courtroom; however, there were apparently several hidden “nests” as the tweets were flying real-time.

Peter Bunch, counsel to Terri Horman, is adamant his client is the subject of more than one criminal investigation:

“The state has the ability to obtain every single bit of information that is produced in this case and that is outside the bounds of what it could do were this proceeding not occurring,” Bunch said in court.

“It is fundamentally unfair for Kitty (Kiara) and for Miss Horman for me to be hamstrung in the divorce case for the information I have compared to what they have.” “The publicity that’s going on is not being driven by Ms. Horman, it’s being driven by Mr. Horman, when he tells national media there’s no doubt Ms. Horman is involved.” “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.” “We’ll concede, Mr. Horman can have the house, right now. Mrs. Horman is going to lose money…”

Terri Horman has not been declared a suspect in either Kyron Horman’s disappearance or the alleged murder for hire plot against Kaine Horman. She is however, seeking access to all of her 911 calls dating back to the DAY AFTER CHRISTMAS.

While this timeline coincides with accusations by Kaine Horman in his filings that Terri attempted to arrange to have him murdered, this is the first public revelation of that call. Bunch went on to say that Rackner and Kaine Horman, who are parties to case sensitive criminal investigation materials involving Terri, are at a supreme advantage to his client who should only be expected to plead her protections under the 5th amendment as a result.

After heated debate by those sides, we learned: Rudy Sanchez, the infamous landscaper/hitman for hire, has an alias, and has eluded service in the civil matter to date, although he appears to have cooperated. Bunch proclaims Sanchez is unlocatable as a result of MCSO unwillingness to share discovery of a witness in the civil case ( blink holds hands over eyes).

Michael Cook, a/k/a sexter king, waited all afternoon via subpoena by Rackner, but was only interviewed by the press. He states he cut ties with both Terri and Kaine days before he was outed for invasive scapular intrusions. No word on that healing process.

Terri Horman had her own personal black Friday this year.

She called 911 THE DAY AFTER CHRISTMAS. Regular contributors and readers of blinkoncrime.com doubt she had sale flyer questions.

Judge Keith Meisenheimer, was sensitive to Kaine and Kyron’s ‘round the clock nightmare, but feels some time may allow things to shake out. January 6, 2011 to be exact.

Following this afternoon’s legal melee, blinkoncrime.com Editor In Chief asked prominent Washington State Family Law Attorney, Lea Conner, to weigh in:

Although I preface my comments with the fact that I practice family law in Washington State and not in Oregon, I am an Oregon native that has followed this case closely.

I’m a bit perplexed by Peter Bunch’s reasoning that if the court were to abate the dissolution, he would respond by filing a motion to modify the restraining order so that Terri Horman could have visitation with the parties’ daughter. Essentially, Mr. Bunch is arguing that the abatement would prejudice his client’s ability to parent her child. My understanding of the Multnomah County local rules is that an abatement means that the entire case is halted. Neither party can bring a motion before the court, nor can the court hear argument or make any ruling on motions.

It was also interesting to hear Mr. Bunch argue that proceeding with the divorce would violate Ms. Horman’s right against self-incrimination in the disappearance of her stepson. This is the first time that Terri Horman has publicly acknowledged any self-incrimination issues. In her motion for abatement, Ms. Horman, through counsel, argued that the ongoing investigation into Kyron Horman’s disappearance had made it “virtually impossible…to proceed with divorce-related issues in an effective an[d] orderly fashion[.]” Were Mr. Bunch to bring a motion to allow visitation, Mr. Horman would no doubt argue that Ms. Horman’s actions demonstrate that Ms Horman or someone she knew was responsible for Kyron Horman’s disappearance, and that her behavior since Kyron’s disappearance shows that she is unstable and poses a threat to their daughter’s safety.

I do not believe Mr. Horman would raise Ms. Horman’s 2005 convictions for DUI and reckless endangerment, as not only later chose to have a child with Ms. Horman since that time, he also left both of his children in her care for extended periods while he was at work. Under those facts, it would be hard to conclude that Mr. Horman believed Ms. Horman posed a threat to their daughter. The judge’s comment that “[e]ventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings,” seems to indicate that the judge may not be willing to hold the action in abatement past the January 6, 2011, hearing.

I’m also interested in Mr. Bunch’s comment that “Rudy Sanchez” is an alias. If that’s true, then what is Rudy Sanchez’ real name, and how exactly did he first come in contact with Terri Horman?

It was also strange to learn that Michael Cook was subpoenaed to testify at the hearing. I’m curious if there were others scheduled to testify as well. I cannot speak to how the Oregon court operates in practice. However, I note that each party provided written affidavits in support of their respective motions.

Is there some reason that Mr. Cook’s statement could only be presented in oral testimony?

I’m not sure I understand Mr. Bunch’s logic in saying “If this is not abated we will not get reciprocal discovery.”

The state is not a party to a dissolution action. In a dissolution action, the parties can seek discovery from each other, and depending on the court rules, from third parties as well.

I’m not sure why Mr. Bunch would have the impression that there would be reciprocal discovery with a third party in a dissolution action, especially when that third party is law enforcement.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

    TH didn’t “pay” $350K for legal defense. My guess is that that was an estimate given to her by Houze. Lawyers bill by the hour as services are performed. My guess is that Houze bills out at about $600/hour. Add his time and his minions time and the bill will add up fast.

    Hi Annie. I find the comments of Goodnessme to be of value from a speculative point of view. I don’t take what she says as fact, however I do believe she knows Rudy. So, for instance, I tend to believe that Rudy has a 7 yr old son, based on what she wrote. I don’t believe her when she says that money was never part of the MFH plot.

    She is defending a friend and puts him in a good light. I think he has told her his version of the story and she believes him. But some of the incidentals she mentions are believable to me.

    Her comment about the landscaper is her only comment ever on that site (KATU). I think that when she read the acompanying article, she was moved to write. In other words, she is not a frequent poster, bandying her opinions about.

    Some people must know Rudy Sanchez. It’s not incredable to me that someone who knows him has written in a public forum defending him. Again, I don’t believe everything she wrote, but I find her credible as someone who knows him.

    I have not read anyone alledge that what Goodnessme said is factual. Everything I’ve written about it has been phraised as opinion.

    I understand your perspective, however, I have read all the articles, the comments and the blogs, and have found that there are a ridiculous number of people who seem willing to insert themselves into this case as “people in the know”. Goodnessme could be 100%% legit – but I could site 15 others posting on the news sites that may or may not have legitimate information. I just wish we could find independently verified information about RS and his children before we accepted this poster’s information as factual. It seems to me that RS and his children are really important players in this saga – especially if they are connected to Elsy and her children. I would like more substantial information before taking Goodnessme at her word.

Children today are under so much pressure at school. It’s a struggle to undo some of the things they learn at school. I am a rare parent that doesn’t believe in all these AP classes. If child wants to go to college in high school, go to the community college. Child in Ivy League, burned out! Hard week, when I stress out I remind myself Kaine Horman would love to have my problems.

    Unfortunately some sympathetic judge will most likely give Terri Horman visitation privileges at some point. Courts are notoriously lenient when it comes to granting parental visitations. The goal of family court is to always reunite the family. I’m praying that there will be a thinking, intelligent judge out there who will deny TH visitation, custody and alimony. How could anyone think that a woman who master minded a plot to kill her husband, and is responsible, (for those purists out there who say that she hasn’t been convicted or charged yet) possibly responsible for the death of her step son, grant any type of visitation to this sociopathic predatory female? Also for a woman without any visible means of support (and who wants alimony and child support from her husband) the question arises: how is she paying for Stephen Houze her very high priced criminal attorney (she has already paid Houze a $350,000.00 retainer fee) and for her equally high priced divorce attorney? I think that the judge that postponed this divorce because he didn’t want TH to implicate herself in the Kyron Horman case, should be gotten off of the bench. What about the rights of little Kyron? What about the rights of a husband who was targeted for murder by a vindictive, sociopath?

    @ riverpearl- I posted yesterday in the other entry before this one popped up that i believe the timing ties into the six month window KH and DY have to sue PPS. Six months from June 4th. My belief is that they haven’t seeked damages yet because they don’t want to jeapordize the ongoing investigation. I believe LE understands this and so they are trying to step up their investigation to wrap up the case and name suspects on or before December 4th. By doing this evidence gathered isn’t compromised any a different court matter. This is all MOO. I also want to note, that I don’t believe that TH was involved in KY’s disappearance. My belief is she got involved with the “wrong crowd” and it caught up with her.

    Blink, I get it. I was not addressing you. You commented, so I included you, but my question was directed at satori – I was asking satori, not you. I think that was clear. I know you can’t get into specifics. Satori can’t either? If that is the case, please state clearly why satori cannot post her theory – you do not have to comment on any information that you have that cannot be released. I think a lot of us want to know the details of satoris “AHA” moment. Apparently, even though she is not LE, the rest of us can’t ask her for an explanation?

    The issue is this has been asked and answered again and again and again. I think I saw like 4 or 5 of her posts repeating herself, as a courtesy to anyone that is not following. If someone takes the time to address a question from another poster, it is incumbant upon readers inrterested in the same subject to review it. It was not specific enough, you have the right to discount it, or move on-

    I still think TMH tried to meet up with “The Vampire’s Minion” at FM #1—her frantic behavior, making an alibi for herself were all part of how she was “handling it”. Because she and DDS tried to open a PO box at the UPS store, I think that was a meeting place from previous rendez-vous times—and maybe she THOUGHT Ky would be there, but no—so, go to rendezvous spot #2, no dice. She and DDS would have to work on this alone. Whatever THAT was. It wasn’t exactly what she had planned—or maybe there’s a botched attempt on Ky—and she is so focused on what SHE wants out of this, her lack of empathy allows her to come back home, face Kaine as if nothing happened, and attempt to portray herself as “sad” at a press conference. But she had already made a name for herself with LE with 911 calls, they are suspicious, and move in for those early days of the investigation.

    I can’t imagine LE would “waste” time on SI if there weren’t reason to search. I dread looking at the headlines on weekends now. So sad what some children have to endure because of adult behaviors/choices. If I wake in the night, I pray for this case. My dad used to say, if you can’t sleep, don’t count sheep: Talk to the Shepherd. So I do. The Good Shepherd knows where that little lamb Ky is.

    I couldn’t locate the original article, but I believe it is refering to the man in plaid. He appears in the photograph of Kyron standing in front of his tree frog display. Kyron is not present in the photograph in which a man is standing on the far left side. If I’m not mistaken, both men have been identified and neither is a person of interest in Kyron’s disappearance.

    Several posters have commented on the position of the man in plaid, suggesting he was avoiding being photographed. His body posture is very hard to discern but, after studying the photo over and over, I finally determined that the camera caught a side view of the man. He is bending forward (probably to view a project) while facing toward the right side of the picture, with his right arm at his side. He is a very heavy-set man, judging by the thickness of his arm and his seemingly protruding abdomen.

    Does anyone know in what order the two SF pictures were taken? It just occurred to me as odd that Kyron is one but not in the other. If Kyron’s disappearance was orchestrated by TH, she may have intentionally taken a picture of Kyron in front of his project, followed by one without him, as a clue or “teaser,” in the same vein as the CSI t-shirt: i.e., now you see him; now you don’t. I’ve heard of at least one case in which similar clues were left at a crime scene by a suspected murderer. LE noted that the suspect seemed to be taunting them with the clues, but they weren’t able to gather solid evidence to convict him. Sociopaths often believe they have a superior intellect that can outwit LE.

    Why would he need to be interviewed if he was either? That certainly implies he did not respond and return the “flyer”, no?

    Hi E-rose: I vacillate regarding TMH’s possible level of involvement, so the following remarks are just theory. If you think about it, it really doesn’t take a very sophisticated perp to pull off a crime such as this. If one is able to engage in pillow talk to plot, work with an accomplice, follow directions, AND keep one’s mouth shut, it really isn’t that complicated.

    I could be wrong, but I am not convinced there was a ransom note. I think LE stayed with the family UNDER THE GUISE that a ransom note or ransom call might occur, or perhaps TMH led them to believe this was a possibility. I believe LE’s actual goal was to keep an eye on the Horman family. But, E-Rose, I am really curious. How did you came to believe a ransom note was found? I saw all the other posts speculating about one, but I just wasn’t convinced. Maybe I missed something.

    What I am really going on now is what we know:
    1- TMH’s attorney admits that TMH IS in the cross hairs of the investigation. That tells me after all these months LE still ha snot been able to clear her. IMHO, she is LE’s undeclared No. 1 suspect. I suspect they have no doubt she is involved.
    2- RS appears to be a material witness, and someone so valuable to the prosecution. I doubt that he knows where Kyron is.

    I suspect there may be some other small fish LE have netted and are lining up as witnesses, but I still feel TMH and RS are their primary focus in Ky’s disappearance. IMHO, TMH and RS are the case. Just me mooooo-ing again, of course. :)

    I wonder, at what point did James move in with his mother (I assume she is still living with her parents) and why? I certainly hope he wasn’t moved after the beginning of the school year. That youngster has been moved around enough and has had his schooling interrupted too many times already. The entire family situation must be so stressful for James, I’m sure it’s hard for him to concentrate on academics, anyway. I do hope he stays safe.

    With regards to Peter Bunch’s claim that he needs “reciprocal discovery,” I have some questions for CW Jensen (or whomever):

    + Would the MCSO and/or Portland Police produce the 9-1-1 tapes pursuant to subpoena in the civil matter? Would it matter if Peter Bunch could get the court to sign the subpoena for the tapes? (I’m assuming any such subpoena would specify the court as the issuer of the subpoena, but require Mr. Bunch pay any and all costs related to producing the tapes.)

    + Would it make any difference if the tapes were produced for in camera review as to their relevance, and whether they should be disseminated to the attorneys?

    + What if Mr. Bunch were to depose the records custodian for the 9-1-1 tapes? Would that compel him or her to state dates and times of calls, and the nature of the calls?

    In my humble opinion, Mr. Bunch raised the issue of the December 26 9-1-1 call for a reason. Mr. Bunch would not raise such an issue unless it is helpful to his client.

    It could be that Mr. Bunch was telling Laura Rackner that her client had better agree to modify the TRO and allow Ms. Horman some visitation, or Ms. Rackner’s client would be forced to explain himself — and the December 26 9-1-1 call — at hearing.

    However, I just cannot see Mr. Bunch filing a motion for visitation. In order to have that motion heard, the court would need to remove the abatement, which would allow Ms. Rackner the ability to conduct discovery.

    Any motion regarding visitation would also open the door to scrutiny of Ms. Horman’s parenting. Ms. Horman cannot seek visitation while continuing to dodge that issue. Mr. Horman will get to explore Ms. Horman’s care of Kyron, including the events of June 4, as it is wholly relevant to her ability to parent Kiara.

    As a result, it could be that Bunch invoked the December 26 9-1-1 as a way of telling Kaine Horman that any further attacks on his client in the media will not go unanswered.

    Hypothetically speaking, if the December 26 call to 911 concerned a domestic violence incident at the Horman household, or if it was related to Kyron disappearing from the home — “wandering off,” running away, going to a friend’s house, or otherwise — that phone call will be a game-changer in terms of the dissolution matter.

    Might the 911 phone call on December 26 tell us why why Ms. Horman’s son James moved out? Mr. Horman previously told the media that Ms. Horman blamed him for her son James leaving the parties’ home in early 2010. Maybe that phone call will tell us what exactly was going on at the Horman residence. It might also explain why nobody agrees as to precisely when James moved out.

    If that 911 call demonstrates truthfulness on the part of Ms. Horman, it would mean that law enforcement wrongly painted Ms. Horman as a suspect to other family members, while making no effort to correct the record when that information was disseminated to the public.

    Mr. Bunch claimed, “If this is not abated we will not get reciprocal discovery.” Mr. Bunch’s claim begs the question: Would an abatement of the divorce proceeding cause law enforcement to turn over reciprocal discovery? Under that theory, law enforcement is withholding information in order to affect the outcome of the dissolution proceeding. It’s hard to imagine any scenario in which such a thing would occur.

    Mr. Horman lost a lot of credibility when his only named witness — Michael Cook — claimed he did not have a sexual relationship with Ms. Horman. What proof does Mr. Horman have of his other claims, such as sexting, and might those claims have been exaggerated in order to bolster Mr. Horman’s claims in the dissolution matter?

    Although Mr. Cook’s statements denying any sexual relationship with Ms. Horman were made outside of court, Ms. Horman will no doubt bring them to the court’s attention at the January 2011 hearing.

    Mr. Bunch told the court at Thurday’s hearing that Ms. Horman’s son James was living with her. KPTV is now reporting that Terri has “relocated to Medford.” Of all the places on Earth, why would she move to the same town as Desiree Young? Just as important, why would Ms. Horman uproot James from his father’s home is Roseburg, where, according to published media reports, he was doing quite well?

    At the time Ms. Horman relocated to her parent’s house in Roseburg, James was already on his third home in 2010. James went from living with his mother on NW Sheltered Nook Road to living with her parents in Roseburg, then to live at his father Ron Tarver’s home in Roseburg. If KPTV’s story is correct, James has moved yet again, this time to live with his mother in Medford.

    Ms. Horman does not have a job. This begs the question: How exactly is she paying for housing for James and herself? Is there someone else sharing a residence with her? If so, who is this person, and what is that person’s background?

    As a side note: The time period for the abatement – until January 6, 2011 — is interesting, as the Multnomah County local rule defines abated cases as “those cases placed under a two-year stay order by the Court on the basis of activity external to the case which would have an effect on the outcome or conduct of the case.” Apparently the two-year period is not mandatory, and the court can order an abatement for a shorter period as well.

    After an "absence" [he claimed AGAIN that he would post NO MORE after "seeing" the pain in KH eyes] “he” (or some version) has once more started giving “information” from DDS. Each time he professes he will post no more & states the “thread will die w/o him”, it becomes painfully clear to him that the thread does not stop – because hey, it isn’t about him &/ or DDS & he pops back in to “share his wisdom to the lowly masses. (He “brags/posts” @ times about the # of views the thread gets & how it is because of HIM)

    He has injected himself into Kyron’s case.

    Just as his post states the “information” is from DDS, he also questions it. JMHO it is crazy making. His “goal” seems to be to keep posters “off DDS” while stirring/ mudding the waters.

    A poster on SM “claims” to be a friend of DDS (not sure if this is a “version” of DDS cousin) & has taken questions from other monkeys. You may find the “same” information there as there has been some “exact over-lapping” answers given.

    So if prosecution tries to show Terri’s motive to be involved in Kyron’s abduction was to hurt Kaine, they won’t be able to use the alleged mfh plot in court. I really think without that they are going to have a tough time with motive.

    Before the tides completely shifted against Terri, several interviews were conducted of family and friends who said Terri loved Kyron and he loved her and that their relationship toward each other was loving. The only thing I have read about Terri treating Kyron badly was that gobbledy gook from H Oakes blog about her slapping him in front of teachers and parents at Skyline which I just don’t buy. There were a lot of people upset about him not being able to get out of bed without permission but I believe that can be explained away to be for his protection. Some kids want to get up and wander around after parents have gone to sleep and get hurt. We don’t really know the circumstances surrounding this and it could have been Kaine’s idea to enforce that he stay in bed until allowed to get up. Just saying.

    I think as soon as Bunch and Houze get the discovery which Rackner is privy to they won’t have a very difficult time getting the RO thrown out and Terri Hormon will be allowed to see her daughter. The RO is based on Kaine’s belief that Terri tried to have him murdered. His belief is based on info from LE. LE’s info came from RS AKA ??? I would not be even mildly surprised if Houze (should he be allowed to get the goods on RS) could come up with a number of women in the Portland area who have been lunged at by RS or slapped, or hit, or raped or ripped off. Possibly if any of the Portland MSM would grow a couple and print a pic of Mr. Lawnmowerman, all kinds of women who wish they never met him would come out of the woodwork.

    It’s like the bottom fell out of the June 26th basket and all the eggs were smashed in the dirt.

    Yes, I know this is a tough realization for many, but it is what it is.

    I think if you asked Staton today if they needed a body to prosecute THIS crime, realistically, he would have a different answer. I am truly praying the search teams out there this weekend find our little Ky.

    Lastly, we found Mr. Sanchez, as did The Oregonian in about 5 minutes. Either he is being protected, detained or “other” for Bunch not to be able to subpoena him for Thursday hearing. I spoke to one witness early that was looking out the window while he and his staff were working on her lawn. He testified before the GJ, I would offer it is common practice NOT to subpoena folks who may something you don’t want them to.

    That said, there is gulp in my throat the size of Texas, daily, in this case.

    Visitation for Kiara will likely be based on what Kiara is determined to “need” (i.e. what’s in her best interest) not on whether or not Terri should receive the benefit of being allowed to see her. I’m sure (I hope!) Kaine’s attorney’s will argue it from that standpoint rather than citing all of the reasons Terri doesn’t deserve to be granted the priviledge. I wonder if courts in Oregon are similar to my state where they usually appoint a guardian ad litem for the child? Seems I read she was requesting supervised visitation which I found interesting because she’s practically admitting right out of the chute that there is reason to require that supervision. Most people (I would think) would request and hope for visitation and then “settle” for supervised visitation when requested by the other parent. Of course we’re talking about a woman who (through her attorneys) has all but admitted that by opening her mouth for anything she will incriminate herself so I suppose we should not be all that surprised.

    About Rudy Sanchez……Blink, maybe you can help me out here…why would they want Rudy’s input on the divorce? What could he possible have to offer that would help Terri’s attorney’s? He would likely do them more harm than good. I realize the whole idea of a deposition is to figure out what a person knows before you have to prepare to deal with it at trial but if he’s a component of the criminal investigation (which sounds like it’s obviously going to spill into the civil issue) what could they want from him in the divorce arena that could help Terri? They seem miffed about not being to get ahold of him. That puzzles me too….if they’re talking about the same Rodolfo-Sanchez-Rudy-Estrada-Sanchez-Rudolpho guy (lol) that we are there are 5-6 easily accessible addresses to look for him at. Surely, being attorneys their resources would yield twice as much info as my measley ones do! So either they are not looking that hard or they just needed an excuse to bring his name up on the record, not sure what their real intention was on that whole thing.

    @ falstaff-Amen! Everytime my kids start driving me up the wall and acting like maniacs or I open the bill from the orthodontist and grumble at the check I have to write, I remind myself to think of Kaine & Desiree and all the other parents of children who are missing or gone forever and say to myself, “Stop complaining! Your worst day might be a dream come true to someone else”. I’ve learned a lot since Kyron went missing. And the most important thing I’ve learned is to hug my children more often (even if they hate it and even if they’ve been naughty) because the saying “every day could be your last” doesn’t just apply to us adults as we walk of the door each busy morning. Every day could literally be your last, their last, our last, etc. and I think most of us tend to lose sight of that in the day to day chaos of daily living.

    Please God, Please let Kyron come home NOW! :(

    I’m catching up on all the articles from this week (that darn day job is really slowing me down lol) and I came across this. Now, I realize that this is precisely how rumors get started (and I PRAY that’s ALL this is) but this reporter asks Terri as she is leaving the courthouse the other day if she is Pregnant. Was that a dig just to get a reaction out of her so they have an “evil” picture to plaster across the web? Let’s hope so. But as a reporter, (unless I was working for the National Enquirer) those words would not come out of my mouth unless I could back it up in case somebody accused me of just trying to start trouble or create sensationalism. Of course I have no clue what techniques are considered acceptable in journalism so maybe it’s not as crazy as it sounds, but to me it seems bizarre. I desperately hope there is no truth to it, because all this story needs now is another soap opera like element to distract from 1) finding Kyron and 2) finding justice.

He has obviously sexually abused (more than molested I’m sure) at least one child in each of the other 3 locations mentioned! And really, what does a 16 year sentence turn out to be, maybe a third of that when you factor in “good time” reductions and all that other (undeserved) crap? Sorry, people like this should be shot upon conviction. They should be tried in the damn electric chair. Reading the contents of his bag made me want to cry and vomit at the same time.

    Something about the Kyron’s SF project. There are three kinds of kids projects. Ones the kids do, ones the kids do with the parents and ones the parents do. Looking at the SF pic there is a sharp contrast between his beautiful project and the one next to it that was clearly the work of a small child. The person who did most of the work on Kyron’s project had the software and ability to manipulate images.

    Okay, so here’s where we’re at:

    The mayor tweets about a mystery man. The question is why? LE says they have cleared this man, but we don’t know if he answered the LE flyer. Boot prints found at exit door.

    Bunch mentions 911 call from December 26, 2009. This is the first public mention of a call. James leaves the house sometime after. The contents of this call may reveal what really happened in the house and may contradict Kaines version that Terri was having problems with James and sent him away of her own volition. Bunch mentions this as a message to Kaine. If the call does show that Kaine was less than truthful, what does that show regarding the rest of his public statements regarding Terri? What really went on with Michael Cook?

    Terri now lives in Medford. No job, but she now has James with her. Does James’ adopted dad live in Medford? I am trying to keep track of the husbands. The 2nd husband adopted James and pays support. Where does he live?

    Here’s where I go into the Twilight Zone: Posters have observed a growing distance between Kaine and Desiree. It’s a stretch, but after Desirees last media statement, did Terri talk to her? Did they put everything on the table and Desiree realizes that Terri really didn’t do this? Even if that’s true, would Terri be living with DY? Okay, back to reality.

    As Terri leaves the court house, reporters ask her where the body is and if she’s pregnant.

    The mfh plot may not be allowed in as evidence to prove Terris motive in abducting Kyron was to hurt Kaine. This case will have a difficult time moving forward without concrete evidence. LE needs to find Kyron.

    I’ve probably missed some other important items. I have a feeling that the floodgates will open soon. What is Kaine going to do in response to what Bunch said?

    I just noticed something in your comment, and your not alone in misusing or interpreting something instead of keeping to facts only.

    NO PERSON, NOT ONE, has been publicly cleared by LE in this case. Are there some? Of course, but as a factual matter, saying someone is not a POI, which btw is not a legal or LE term, it is a media term, is not clearing someone by any stretch of the imagination. If it is true he has been interviewed, than the most we could say about him is that he is a potential witness.

    Do we have any more information in regards to the sign posted by a private party? I am trying to ignore it until we learn more – but it is almost impossible. Thank you (kind of) beejay for reminding us about these photo albums again. My first case to follow – I commend everyone that has been able to remain patient and strong throughout all the cases Blink follows. It takes a special person/people to be able to do this out of the goodness of their hearts. Thank y’all for teaching me so much over the past 4 months.

    NO PERSON, NOT ONE, has been publicly cleared by LE in this case. Are there some? Of course, but as a factual matter, saying someone is not a POI, which btw is not a legal or LE term, it is a media term, is not clearing someone by any stretch of the imagination. If it is true he has been interviewed, than the most we could say about him is that he is a potential witness.

And, looks like that statement might have originated, ultimately, at GLP. There are related posts preceding and following fatcatlurker’s post on SM (see below). Looks like newsatfive and Kozyotb had a round about it, on intermediate posts at Willy Week? Best I can make of it. (I just confused things by saying I’d dismissed it as Kozyotb’s theory. Sorry. It might trace back to jonesr??)

    Is this a reference to Rick Spicher? If so, I don’t understand the relevance.

    IMHO, it sounds like the “little girl” is his daughter, and that she was at his house for residential time (visitation).

    There’s been a lot of speculation about a Dec. 26th 9-1-1 call, but I don’t think there was actually any implication that a call was placed on that date.

    Dec. 26 is exactly 6 months prior to June 26th, the date Terri placed 3 calls to 9-1-1. I believe her attorney requested the calls placed on June 26th and any calls placed in the 6 months prior to those calls.

    So, while something may have transpired during that period of time which resulted in a call to 9-1-1, I don’t think the Dec. 26 date has any significance.
