Tiffany Hartley emerged on CNN’s Anderson Cooper 360 yesterday after her 16th hour of interviews at the Mexican Consulate in McAllen, Texas.

Hartley recounted the events of September 30, ending with the alleged murder of her husband David. Ms. Hartley gave both new testimony and confirmed her previous statements according to reports from the Mexican Attorney General and Ms. Hartley herself, without the presence of an attorney.

According to several statements from Hartley, David was shot “off his jet ski” while the couple was returning from the Mexican side of Falcon Lake, where they briefly took pictures of the historic church on Old Guerrerro. Neither David Hartley nor his Sea Doo watercraft have been recovered.

One of the most baffling aspect of the case, is the fact that Ms. Hartley claims the pair were shot at at as they were driving their jet skis away from alleged “pirates” they both waved a friendly hello to, seconds before.  Tiffany Hartley was uninjured in the attack, and her jet ski was not hit in the gunfire. Although media was alerted last week that tests on a possible blood source on Tiffany’s life vest were due back that afternoon, we were quickly told there would be no updates about the possible blood evidence at this time.

This afternoon, blinkoncrime Editor spoke with Chuck Smith, owner Smith Marina USA about specifics of the Sea Doo RXT.

..Your correct, the RXT has a chip in the starter that is electronically programmed to “match” the owners lanyard key. If he was wearing the lanyard, whether attached to his vest, or in some cases the arm, and he was thrown off the ski, it activates a kill switch and will not start without the key it is programmed to without a factory reprogramming, which of course, one would need the paperwork for. In short, no matter what, they would need his key to start it.

Blink Question: What if he was not attached to the key, and he was shot and flew off the unit “in motion”, this would not shut the engine off, correct?

CS: Correct. The ski would continue in the direction the handlebars were pointing and continue to throttle in that direction.

Blink: How hard are these models to sink?

CS: Virtually impossible. I have never actually heard of, or seen one, sink to the bottom. The way the Coast Guard standards are now with these, they have hulls similar to boats.

Blink: Could enough bullet holes sink it? What about if the contiuum– could that have caused it to flip? Could anyone right it?

CS: No, not unless we are talking morter rounds. I guess in theory an automatic weapon could put enough holes cut it in half if that was the goal, but again, your still going to see shards of fiberglass all over the water, remnants similar to a boat accident or crash. Again, under these circumstances, I don’t see how he could flip it, but if it were, again, harder to see because the bottom is black, but any SAR or Coast Guard deployment knows what abnormalities to look for on the water surface. It would be next to impossible to “right it” in deep water. It would be more likely they would drag it to shallow water.

Blink: Is this chop-shoppable?

CS: Absolutely. There is some after factory devices, similar to lo jack, but the engine and parts are expensive and could easily be sold that way.

Blink: He was wearing a PFD I. In your opinion is that keeping him afloat until he is located if he was left in the water?

CS: Absolutely, unless it was removed, or he and the vest were removed from the water, he would be floating, yes.

As announced this morning on Dana Pretzer commentary, Blink, Editor In Chief of blinkoncrime.com will be discussing the Hartley case this evening live at 9PM EST on Scared Monkeys The Dana Pretzer Show.

    I wanted to comment on the “doesn’t make sense to go all that way for 5 minutes and a picture” ideas.

    ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
    I do not think there is anything whatsoever strange at all about taking this trip. People that are concerned about a few gallons of gas are NOT the ones who spend $13,000 on a PWC…And it “appears” that they were making a day trip of it -absolutely nothing odd about that, imo. Many times I have driven several hours OW in an SUV loaded down with Hi-Tech windsurfing gear, only to get to the beach, rig up (takes a long time -much, much longer than scooting a jet ski into the water from a boat ramp, which is very –quick) -and often, just when ready to sail,…the wind dies:-( Arrrrghhhh! But it’s the love and passion for day trips and the sport -the adventure and being out on the water. Never thought twice about the cost of gas. Many people drive to the coast for the day just to look out at the ocean…no biggie. Heck, I have driven with friends on a whim from Boston to Elizabeth, NJ (4 hrs OW) just for an IKEA run…lol. That’s a long trip for a few meatballs and knäckebröd! But it was fun!!
    Aside from the cost, the topic brings me to a probability question for Blink. Perhaps the Sea Doo rep could explain how many gallons the RXT model holds (15 or so?) How many miles per gallon it gets at what speeds… i.e. 2 mpg at 75 mph, and 25mpg at 15 mph? If that makes sense…. Will the ski go as fast a quickly if heavier/fully gassed up? Is a ~ 16 mile RT anything unusual for a jet ski in terms of having no ability to gas up on the other side…seems that skis typically stay pretty close to shore, so to me venturing 8 miles away from launch seems a bit scary…Cost aside, is it all within normal range for the RXT…? This Blinker wants to know!
    Do we have any psychologists on our board? I’m wondering about the Five Stages of Grief and how TYH may be experiencing these stages if in fact her husband is dead.
    She seems very ready to get on with her life. Where does this fall in the stages of grief…is she in Denial (stage 1)? Or has she already fast-forwarded to stage 5, which is Acceptance? Stage 2 is Anger -I would expect a woman that loses the love of her life to spend some time here, angry about her future, angry about the injustice, angry that his body hasn’t been found.
    I know that grief can be masked and some people are very good at hiding what’s going on inside. Still, by observing her behavior (which she has been very willing to share) it appears that she’s either in denial or she’s already accepted his death. Another possibility is that grief is not necessary because a) her husband is still alive or b) she wanted him dead.
    My question for a psych expert: How unusual is it to reach the Acceptance stage within a few weeks in grieving for a spouse who was murdered?
    ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

    I can understand your brother being a history/photo bug & going 45 minutes out of his way to get some great pics etc, but from what I can tell the Hartleys didn’t just go 45 minutes out of their way to take pics of this church..

    They gassed up 2 jet ski’s & the truck (not cheap) & loaded the 2 jet ski’s on the truck & drove quite a distance from what I’ve read to get to Falcon Lake.. I thought I had read a 2 hr trip but I’m getting old so I could be off on that (senior moment)..

    Then its unload the jet ski’s time, park the truck, get ready & away we go another 6 miles to the church to spend 5 minutes to get a couple of pics & turn around to go home.. What no plans for a picnic lunch at that beautiful lake ? Hmm I don’t know about that one..

    I don’t own a jet ski can’t even swim but I’ll take a stab & say that jet ski’s are not easy to load & unload even for the young water loving couple.. That 5 minutes puzzles me..

    I would have planned to make a day out of it especially since they were moving back to Colorado & who knows when they would get to be back there again.. But no talk about what had been planned for the rest of the day at Falcon when they came back from the church.. Or at least I didn’t hear of any plans..

    ====================

    Nana2 – I’m not disagreeing with your comments or ideas…all very valid points when thinking is based on most of the population’s reasoning.

    In my previous post, I only stated my brother’s most recent escapade (only just this LAST wkend he made this side trip to the closed Louisville Slugger facility). His dearly patient wife could ‘tell’ :) you of the many more elaborate trips (taking the reeeaaaalllly LOOOOOONG way home more times than she’d care to remember) involving brief moments at other historical places for mere pics as well.

    So…I’m just sayin’ – true/die-hard history buffs are made a lil’ different than the rest of us. Seriously, I’ve tried for years to reconcile my brother’s and (I have an uncle the exact same way) behaviors in grabbing the pictorial holy grails of places that would be omitted by most as tourist “hotspots”. LOL…no disrespect intended…but most don’t see the attraction to many of the places they ‘jump through hoops’ and ‘go the many extra miles’ to see for a few moments (I have to assume it’s just to say they did).

    I think DH’s parents knew this quirk about their son and is standing beside TH at this time because this part of the story seems legit. MOO

    Prayers for the Hartley family.

  7. SouthernMom says:

    I am of the belief that TH is not telling the story as it happened (not sure if it’s because she’s ditzy and loopy by nature or if she is hiding the fact she fled the scene to save herself rather than stick around to help her husband), but for now…I have suspicions about her obvious double-talk and inconsitencies, but I don’t think she participated in any foul play to cause his death. I’m stating that so you know where I stand and why I’m expressing my opinions slanted towards “not so hinky” IMO.

    Regarding TH’s “obsession” with recovering DH’s body…as opposed to seeking justice:

    If TH is innocent of her husband’s death AND she truly believes really “bad guys” aka drug cartel are responsible for the murder and disappearance of her husband…and especially after the beheading of the lead investigator, she would not “HARP” on justice and finding the trigger pullers in this murder. I think it’s pretty obvious if this did happen as she has suggested, it will NEVER be solved “for certain”. However, I can TOTALLY relate to wanting to recover his body/remains to give him a proper ending.

    In the case of Kyron Horman…and many many other children, daughters, sons, wifes, and loved ones who’ve ‘gone missing’…family wants them back – no matter their fate ~~ ALWAYS! Whether it is skeletal bones, partial remains, quite frankly ANYTHING…they want them back. It helps the grieving process to have some part of them to give that final respect and ritual to.

    I used to be of the philosophy that when you die…the body NO LONGER matters at all…because that’s not you. I believed YOU…the spirit YOU was no longer there…so the body was not needed. When my father died…I changed. It meant everything to me that his body was handled gently, lovingly, and respectfully. I was very closely related (through marriage) to his funeral director…and I can’t even describe into words what it meant to me (personally) to call him first to come get my dad. I had so much peace knowing he was caring (extra special caring) for my father’s body.

    That being said…I can understand why they want DH’s body/remains. I assume TH & DH family have been told “not to expect true justice” and likely warned of the dangers of campaigning for the arrest/capture of the perps who did this. So…if you can’t have justice…I understand the plea for his body/remains. I just can’t believe it’s ONLY for “life insurance” or other reasons. DH’s mother pleads for his body because she wants to give her son a respectful final ending, of her choosing…not at the hands of men who killed him.

    I read the article where it states she prayed about it and felt “God told her to go home”…could it also be she fears for her own safety in light of the immense media spotlight on her and such close proximity to the perps who did this? Wondering if anyone else has thought of this?

  9. Christy says:

    There’s no way those Mexican pirate’s would of ever let her get away after she had waved to them and then witnessed her husband being shot and don’t forget she also said she tried to get him on her jet ski which would of also taken some time at which point she would of been killed as well!
    Nope, I’m not buying this story! Beside’s there is no plausible motive! When I saw her being interviewed about going home she didn’t even tear up talking about her dead husband! I cry over some commercial’s and I strongly feel as if this was a murder for hire and when the investigator got to close they did him in as well! Why people do this instead of getting a divorce or for the insurance money is beyond me but this happen’s all the time and for some reason by the wife more often!
    Blink I’m not sure about statisic’s on murder for hire by the wife vs. Husband but it seem’s like we hear about more and more all the time :(

    As always the insightful E-

    If this investigation is truly being run by the Mexican consulate, we have the whole “international issue” to consider as far as diplomacy.

    It is my opinion if they do not believe her story, without tangible physical evidence I do not think they would breathe a word about not believing her to a member of the family. In fact, I do not believe they would tip their hat at all to anyone prior to escalation of the investigation.

Also of note, you can see the driver’s intensity at higher speeds, and get a feel for the wake and the driver’s potential ability to be observing “2 bullets” next to them…and finally at the end, it shows the simplicity of driving it up onto the trailer and driving away. Let’s face it. They had enough information to do a re-enactment weeks ago. They had enough to take her out and place a wreath allegedly where David was killed.

    If I am understanding this correctly, she was asked to sign a statement and she refused, claiming it needs to be interpreted.

    Madilu that first link for the reenactment I guess must be bad because it comes up as : ABC JETSKI WITH BARBIE

    My guess on the lanyard being attached to the life vest is just in case the rider falls overboard he will have the key to the craft with him for a re-start.. Boaters that have out boards on their boats do that when they anchor out in the middle of the ocean they will wear the boat key on an arm ring as a safety/rescue precaution..

    My wife loves photography and history…and I can tell you that she would not have settled for a few snaps of the church. We would have dismounted, and she would have taken about 20(lol) photos of each building/town artifact….inside & out. The 5 minute remark TH made, so contradicts the very reason they made the decision to illegally cross the border.

    j, it’s not illegal for either US or Mexican citizens to travel on either side of the border markers in the middle of the lake. Here’s the relevant text from the Treaty of Guadelupe Hidalgo which was signed in 1848 (the Rio Bravo del Norte is known in the US as the Rio Grande):

    “Article VII

    The river Gila, and the part of the Rio Bravo del Norte lying below the southern boundary of New Mexico, being, agreeably to the fifth article, divided in the middle between the two republics, the navigation of the Gila and of the Bravo below said boundary shall be free and common to the vessels and citizens of both countries; and neither shall, without the consent of the other, construct any work that may impede or interrupt, in whole or in part, the exercise of this right; not even for the purpose of favoring new methods of navigation. Nor shall any tax or contribution, under any denomination or title, be levied upon vessels or persons navigating the same or upon merchandise or effects transported thereon, except in the case of landing upon one of their shores.”

    This just in from the Estes Park Trail Gazette:

    “On Saturday, Tancredo spoke to about 200 Tea Party and Loveland 9/12 activists at the Loveland Church of David and Tiffany Hartley. It was a dramatic setting for questions about illegal immigration and the corruption and violence that surround the drug trade. Tancredo stated that the war on the marijuana trade is lost and we must consider legalization.”

    Could this have been some kind of political stunt considering it happened so close to elections?

    Yep, she liked warm weather, she just was not going to leave
    with DH for Colorado. It Snows in Colorado all year long, just about.

    It was the HOUSE! She wasn’t leaving that house, the warm weather or
    what knows what else? Tiff’s, mom, said “it is hard on her leaving
    her home”, OK, how about her husband being zapped? Was that hard on her too? It is the house, IMO, she did not want to move.

    She has no husband, no house and will not the Insurance money,IMO.
    I doubt if she will ever see any Insurance money, after the investigators are finished. This was not a well thought-out crime. IMO

  34. Mom3.0 says:

    Thank you for posting the podcast Blink- EXCELLENT interview-

    Important points IMO:

    quotes from Blink-

    “no physical evidence to confirm the widow’s account”

    “We need to find out like we would in any other investigation, and bring the perpetrators to justice.”

    Were Major mistakes made in the case?-

    Again important points- quotes from Blink-

    (PP)-Chain of evidence- nothing was taken into evidence the way… …how we process a crime scene… that would include the vest, that would include the jet ski, the clothes she was wearing..

    “She was NOT checked for gun powder residue”

    (PP)-She was not asked to attend an interview -given clothing in order to take her clothing .

    “Not that she in any way should be considered a suspect”-

    (pp) but in a missing persons- shes alleged a homicide- she’s an eye witness to a homicide, she says she touched a murder victim.

    “Shes a walking piece of physical evidence and none of that was done”

    It seems to me that Tiffany’s most staunchest LE supporter, Siggy, did the most to harm her.

    Quotes from Blink-

    “The Mexican government is taking it a little more seriously, than we did at first”-

    -Missing person file not filed with Mexico for the first 8 days-

    Crime scene not processed- Whose jurisdiction was it? Who needed to be called in from the very beginning??

    The appropriate agency was not called in immediately-

    “The appropriate agency needed to be brought in to process the crime scene”

    Other important quotes from the interview IMO, attributed to Blink:

    “The border patrol has very little to do with this case on the US side -this is ATF and DEA issue and they are on full alert- there’s more going on.”

    “Our research on the cartel, it is not their MO to bring attention to themselves in this way to kill an American tourist.”

    “Nobody’s asking the obvious questions.”

    “Look at the totality of the improbabilities -it needs further scrutiny”

    “I can’t say what she says happened didnt happen- but I can say with a reasonable degree of certainty that, what she’s saying happened did not happen in that way”

    ____
    EXCELLENT show, Blink- and for the record, I don’t think investigative journalism is dead- I just think that it has found a new home- on the internet. Afterall, you and your team ARE asking the hard questions- Good work- Blink & CO-

    BTW, please tell your editor,that she, and her husband are in my prayers and thank her for her insights into the border issues- dangers/problems.

    Thank You dear friend.

    If TH want’s everyone to believe she truly is telling the truth and everything she know’s, why wouldn’t she take a Polly and prove it once and for all! She keep’s saying she’ll think about it……whaaaat! When you tell lies facts change, but the truth always stays the same!

  37. Tori says:

    My ex-husband and I rode jet ski’s for years. Although I never knew the term ‘lanyard’ we did attach the ‘key’ to our vest so when we fell off (a frequent occurence for moi) you had the key on you and the jet ski would cut off immediately. They were hand operated and once the gas handle was released you could come to a stop very quickly. If you don’t have to manuveur your vehicle between docks or anything they’re very easy to get into and out of the water. If, for some reason, you didn’t attach the key to your vest and fell off without it, I do believe the jet ski would still come to a stop just because the gas handle was released. We knew many people who didn’t fall alot and therefore would just leave the key on the jet ski while riding.

    Puzzling to me is TH’s statements of “let’s get those borders secured”. That would be THE last thing on my mind if I had lost my husband! Somehow, I picture myself in a corner, in the fetal position with a box of wine by my side. Someone mentioned denial but IMO, denial would be a refusal to accept that he’s dead. TH has very readily stated, several times, that she is positive he didn’t survive.

    I wonder if she believes that since it happened in Mexico it’ll get brushed under the rug. Recently a woman here in So Cal was murdered and her house was burned down, just weeks before her wedding. The suspect was apprehended in Mexicali by Mexican LE, they cooperated with American LE fully and he was promptly sent back to the US even though he may face the death penalty. Maybe, in TH’s case, Mexican Le is doing a more thorough investigation than she was expecting???

    (Oct. 21) — Nearly a month after Paige Johnson vanished, baffled friends and family members are trying to remain hopeful that the teenage mother will be found safe.

    “Paige is and will always be my best friend,” Greer Locatell told AOL News. “She’s like my little sister. We have been through it all. This girl is a fighter, and it kills me to see this happen, … [but] I have faith [that] Paige is alive.”

    Handout
    Paige Johnson, 17, was last heard from in the early-morning hours of Sept. 23, when she sent a Facebook message to her sister.Johnson, a 17-year-old from Florence, Ky., with a 2-year-old daughter, was last heard from in the early-morning hours of Sept. 23. As true/die-hard history buffs, my wife and I still STAND by my previous comments on 10/12:

    My wife loves photography and history…and I can tell you that she would not have settled for a few snaps of the church. We would have dismounted, and she would have taken about 20(lol) photos of each building/town artifact….inside & out. The 5 minute remark TH made, so contradicts the very reason they made the decision to illegally cross the border.

    Would have taken tons of pics, if this was going to be the last possible opportunity to do so…before moving out of state. MOO. Will respect the fact that maybe other history/photography buffs maybe aren’t so OCD as we are though.

    —————-

    Crimesolver – I agree…everyone’s hobbies and their personal approach in their endeavors differ greatly. I posted about this because there were many blinksters on here questioning that aspect of her story. “Why go all that way, spend so much time traveling and take risks for 5 mins and a coupla pics?” I also agree it does sound ‘hinky’…but, in fairness, I wanted to say there are “those” ;) out there (and I’m related to 2 of them) that this would not be considered abnormal behavior for ‘them’.

    @Eloise – So Tiffany moves home in a flash and gets on Facebook immediately to alleviate her grief. Or is she even home yet? A laptop? I am also very puzzled by Tiffany’s FB pic with the new “friend” named Arcy Bernal-Duran, which is a pic of a smiling coconut. What the heck, her husband was just (supposedly) murdered 3 weeks ago and in her time of grieving, why would anyone send her a pic such as this? Could this be David? Somewhere tropical? A signal to Tiffany? I would like to know where this photo was taken. Also I note that this Arcy person has no friends and no other info on his/her own page (unless I missed it). It sure would be interesting if LE tracked that FB person. MOO

    IRT- SouthernMom’s & Crimesolver thoughts about history buffs and what they would or would not do- inorder to snap a couple of pics…

    Seeing how David was such a history buff, and it was rather important for him to get these pics of the church, according to Tiffany- Why didn’t they make the trip to Old Guerrero when they were living in Mexico? Or before they moved to McAllen?

    I have to say that Southernmom’s and crimesolver’s thoughts only lead me to ask MORE questions about this trip to Old Guerrero.

    It made me wonder exactly what other historical sites David and Tiffany visited and took pictures of during their eight year marriage.
    Most importantly, IMO- exactly what historical sights and pics did David & Tiffany visit and document during their time in Mexico?
