Orlando, FL-  Judge Perry calls the defense team Liars- Not a good sign. Yesterday, during Chief Judge Perry’s announcement to the jury about the tentative schedule for the remainder of the murder trial against Casey Anthony, defense counsel Cheney Mason objected and asked for a sidebar.

Mason: We don’t have any obligation to put on any evidence at all. and you just told the jurors you expect us to be putting on evidence, and we may or we may not.

Mason went on to request that the Judge instruct the jury that they are not obligated to put on a defense, and claimed Jeff Ashton agreed with him.

       Chief Judge Perry: Then Y’all lied to me.

       Mason:NO. Chief Judge Perry: “Yes the Hell you did…”  If you don’t put on any   evidence, then I will do that.

       Mason: Well, we are, so don’t worry about it.

      Chief Judge Perry: ..” I will take I cannot trust one thing your side says, anymore.

 

Heh?  I would like to give the benefit of the doubt to his honor, as I did not believe a word this defense had to say going into this trial, let alone 3 weeks later. The State, after establishing what they believe is the origin of the disappearing heart residue on the duct tape came from stickers in the drawer with Caylee’s birth announcements, and re-calling Cindy Anthony for a little light impeachment is headed to the finish line tomorrow.

*Insert defense’s motion for mistrial late today*  Denied.

To those of you, and there are many, screaming from the hilltops.. “Is that all you got?”  “OMG, is this girl gonna walk?”  “What about Dr. Hall?”  “How the Hell is Dominick Casey getting out of testifying?” I say chillax.  This prosecution team is simply resurrecting the F U M B L E R O O S K I.

The State of Florida, has ALWAYS known this case is going to verdict on THE LAST WORD from the prosecution, or the rebuttal portion of the trial. 

 Given the defense’s opening statement, there is no question in my mind, nor should there be in yours, that the ludicrous allegations made on the first day, cannot possibly be brought to bear, and while the prosecutions case in chief was meticulous, it is not the “barn burner” for a reason.

Linda Drane Burdick is going to leave that ball on the field for a spell.  Ashton will surreptitiously pick it up and head to the end zone unchallenged. 

 After all, that play did originate at the Orange Bowl.

    I watched the video of Dr. Ablow’s interpretation of Cindy’s mouthed-out words of endearment. (thanks for the link Angellica!)

    Ablow makes two strong points although I only agree with the first:

    1) A mother’s love can survive an incredible amount, including an act of murder.

    2) Cindy Anthony K N O W S what it is that caused her daughter to become the “mess” that she is as an adult. Whether it was sexual abuse at the hands of her father, or emotional neglect while Casey was growing up,

    Ablow insists that Casey’s shrug in response to her mother’s “I love you” was a way of saying “Where were you when I was developing into an adult?”

    To say that Cindy KNOWS what went wrong with Casey implies there is someone else to blame (like George) or herself. Why do we need to find someone else to blame for Casey’s behavior?

    Cheney Mason: There was inquiry by the jury about wanting to view…item 313.

    Judge Perry: They saw it.

    CM: Yes. Our concern was how the jury reached that consensus to make that inquiry, unless they were discussing the case; and they’re not supposed to be. Now if you just make inquiries; whatever you think is appropriate on that, then we can move ahead.

    JP: State?

    Jeff Ashton: I don’t think it’s inappropriate for juries to request to view an item, or as they have in the past, to notify the Court that they can’t see their monitors or any other matter. I don’t believe there’s an instruction…uh, whatever instruction council is suggesting; I’d be happy to look at. I’m hard pressed to imagine an instruction that would be appropriate.

    JP: Mr Mason?

    CM: [indistinct, but perhaps he said, I have nothing further.]

    JA: There being no requested instruction, Judge, then I’d submit there’s nothing for you to instruct them in.

    JP: Anything else from the Defense?

    CM: No.

    JP: OK, then, let’s return the jury. [Then the Judge made one of his trademark facial expressions; a tilt-twist of his head then pursed out his lips.]

    The jury entered and Judge made his usual greeting: Good morning ladies and gentlemen of the jury. Did you heed my previous admonitions?
    Yes, Sir.
    Including, but not limited to, discussing the case among yourselves or the other things I’ve admonished you about?

    I’ve no legal training, but it seems that this exchange does not qualify as any sort of official pleading by the defense.

    Love your comments Blink!This defence is really pi$$ing me off. Then
    you have LKB showing up on every show, running down the judge and
    everyone else but the defence. She doesn’t tell anyone she is working
    with the defence. I know that Lynda and Ashton are great and must be
    just laughing at them and waiting.Blink instead of waiting to open
    the cans of air why don’t they get the OK to take the jury to the car
    for the smell test. Is that allowed. By the way, the item that plugged
    up the toilet and the plummer had to come, was it the blue dress that
    Caylee was wearing. Is this going to come out.I still believe Cindy’s

    About this surprise new defense wtiness, Vasco somebody. What possible point would there be to even try and connect GA to this man the day before Caylee accidentally drowns? Is George a psychic and knew what was to take place on Monday, June 16, 2008? If anything, this points to premeditation.     Anyways – the case:

    I hope the chloroform traced syringe and gatorade bottle found near the remains are part of state’s rebut. The duct tape alone is a weak murder weapon. its not too hard to peel off skin if a live child was crying and thrashing about…and even if the hands were bound, wet tears and a tongue could eventually loosen the tape enough to breath. But if we have the search for the chloroform (84 of them) and we have traces of its remnants staining the car, then having that “in between” carrier of chloroform being administered to Caylee – would give the case what it needs.

    Now for the defense’s shoddy case – Its obviously going to be the George Anthony Trial with whatever sideshow characters they can asassinate in between. Remember all those little sketchy suggestions about the Anthony’s covering for Casey during the investigation? Dominick Casey, the mystery caller helping him locate the body, the psychics, the emails re: any other direction than Casey,the Anthony’s many changing stories? That could all be thrown back in their face now with a spin to implicate George. thankless bitch.

    Then of course there will likely be George’s mistress to twist his words and actions into the most evil possible thing other than just a man needing an escape and some booty, George’s ex wife to say whatever the defense’s bribing can get out of her and maybe even a total stranger out of nowhere pretending they know George or something about George – like the defendant, the defense can just make someone up.

    If they bring in those jail pen pals, its pretty obvious those “Christian Casey” letters were about as authentic as they sounded – nothing more than little seeds being planted for the ‘sex abuse excuse’ now being used in full bloom.

    And of course there will be the questioning and requestioning of ‘junk science’ until witnesses lose their minds.

    How is it that this sidebar became ‘leaked’ to the public? I first heard about it a few hours after the trial ended for that day, and will not say how I did, but then suddenly it was all over the news the next day… this is very bad for the privacy aspects of jurisprudence, I think…

    Please forgive me if this has been already addressed here already. I have skimmed through the posts here and haven’t read anything similar. What occurred to me just now is not just the unlikelihood of a father holding his dead grandchild and yelling at his daughter, “Look what you did!”, but also the whole ridiculousness of what would have had to have taken place after that moment.
    The state has laid out very carefully, the steps Casey took in the many days after the murder of her daughter and her apparent state of mind. So would someone please explain to me how George acted in any way like he was part of a huge cover-up? Was there one single clue of him showing any sign of him playing any part in this whatsoever?!
    I am trying to put myself in the mindset of a juror who is asked to imagine this scenario and I find myself utterly confused. If George would have participated in such a cover-up, wouldn’t he have had to consider when everyone would have started asking about Caylee after a time of not seeing her? Wouldn’t he have had to have made up some sort of cover-up story to tell to Cindy and everyone else wondering about where Caylee was?!! Maybe Caylee did drown, who knows, but what would have had to transpire after the drowning if indeed George was involved? George would have had to schemed with his daughter in the days and weeks after the death in order to cover up their tracks.
    I know that the defense only needs to present a shadow of of doubt in the minds of the jurors, but instead, they have spun an impossible tale that looks almost laughable if it were not so tragic. I know that it isn’t supposed to be the burden of the accused to explain anything, but by laying out the story Casey, via Mr. Baez told and promised to explain, they have put themselves at an absurd disadvantage. COME ON! There is no way Mr. Baez can explain this.
    The whole drowning story is so completely unlikely and absurd, that I have to wonder what in the hell they were thinking!

    As far as I can tell, the defense only has three witnesses. Two forensics people that will dispute what the Prosecution witnesses have said already, and the felon guy who says he talked with GA on the phone.

    Im certain the defense can call past, State witnesses also. Im certain George and Cindy will take the stand.

    The circus is coming to an end.

    I honestly think that by listening to the evidence presented by the State, even though cause of death cannot be certain 100%, drowning doesnt seem likely given the other circumstances (not reporting it, partying, dead body in the car for 3-5 days, hiding the body, lying to police at every turn, staying in jail 3 years and waiting for a murder trial)…for an accidental drowing? No way! I can use the forensic science and my common sense to figure out that this was not an accident.

    I think the shovel that she borrowed was to break the shed door lock to get gas so she could go a further distance to drop Caylee off. She surely did not want to run out of gas with Caylee in the car. She could not break the lock, so she went around the corner and dumped her because she could not take the smell any longer.

    Why would she intentionally ask, during questioning of blood evidence on the shovel, bring up should we discuss the DNA testing on the shovel before we go off this report? When she was not even asked?

    Unusual for an FBI expert to feel the need to direct the questioning and testimony?

    For me, this “yappyness” is a turn off and not “professional”.

Why is it that the expert witnesses never have their required info out & ready to refer to rather than having everyone wait while they go thru their attache’ cases or in this case her luggage..

    Guess this witness is Jose Baez’s way of getting the incest accusation in without putting Casey on the stand ..

Is he intentionally throwing in the towel or does he really think he has ANTHING to offer? AT this point I would be seriously annoyed with him as an attorney and that would be taken out on his client by most jurors.

    If this is convoluted plan of attack continues by the Defense, the jurors are going to be confused or could it be they will just get mad and ignore everything the Defense is putting on?

    If Mr. Baez did his homework as a competent attorney should do, most of the evidence sequencing would not become a problem. It also appears that the DT cannot keep straight whether or not somethings have actually been admitted into evidence.

    Todays proceedings-

    W h a t a l o n g d r a w n o u t m o r n i n g all to get to the facts that this FBI expert’s testing on clothing and trunk and duct tape ect resulted in negative results for the presence of blood and semen- and DNA, in most cases.

    The duct tape was contaminated by another FBI agent JB tried to get the expert (sorry cant recall her name, Seaager?) to say that this contamination resulted in masking any other viable DNA- No if that was the case she would have expected to see mixed DNA- there wasnt any- the shorts and the pooh blanket and the laundry bag was positive for the possibility of blood- but was not big enough to type or get DNA-
    The shovel contained a marker for DNA but was too small even to tell if it was make or female…OOOkaay- What does that prove, that Casey my have washed it/ that she missed a spot? That she decided not to bury Caylee and just brought it back? That she didnt need it for the bamboo shoot? What, that BB didnt handle it that very long, once it was returned…whats the big deal?

    This is going to be a very long day- even if they decide not to continue after the luch break it has still been a very long day.
    JB annd his writing board… let me ask you this…strike that…Itll tie in if I am allowed to further question…objection… sidebar…

    For cripes sake- Baez had the FBI witness testify to the findings on a piece of evidence(a blanket) that is not in evidence in this trial.

    Then JB asked about a test regarding Caylees paternity suggesting that LE asked for a specific test to test LEee Anthony as the father-
    Ashton objected- JB said he is asking in good faith- Ashton called BS and pointed out that the tests already taken were to compare known markers- none were found.

    JPerry said dont ask these questions not good faith – read the 2 cases I referred you to, told Baez to call NS if he wants to ask these questions… Ashton asked for question to be stricken and the jury told to disregard- J Perry said he;d look at it … and the jury has all lunch to think about the inference and let their minds wander….

    What the heck Blink? I realize JP is working hard to get this case tried only once- but why not agree to strike the question and instruct the jury- as JP implied the question was not asked on a good faith basis- and now as it stands, as Ashton said, the jury thinks there is some kindof secret evidence out there that Lee raped Casey and LE knew this and wanted to rule out his paternity.

    Ashton has to remember to keep his cool and just do his thing on cross- to clear up all JB’s confusion tactics

    Jeff needs to chillax, yes, but this was not in front of the jury.

    I believe he wanted to have the question read from the record, did he eventually strike?

    If you can picture this, I am spending the day on pre-wedding chores (sis) with the phone in my ear, annoying glances to spare, lol.

    If you are recieving posts on your “4g” phone and they are appearing as last in-first out. It is an operating system stack problem. Sometimes there is a way to make the stack operate as first in-first out by making a change on one of the menues.

    If you have already fixed this, then ignore my suggestion.

    PS I put the 4g in quotes above because there is not one carrier that has an IEEE certified 4g system at the present time. What we have are maybe 4g capable phones and 3.2g delivery systems.

    Absence of presence of blood on the shorts says to me the possibilities, among others, that little Caylee was not dressed in those shorts or those shorts may have been placed at the scene at a later date intentionally to throw off the disposal date (and NOT by the meter reader).

    It is impossible for her to have been wearing those shorts when she was placed there. No way.

    However, as you see, Blink knows her football. She may have actually watched the 1980 Orange Bowl game and saw the play as it was happening. She could have been watching with her Poppa who played college ball.

    What a memory, except it was 1984, and YES I was watching it with my Poppa, for a while, until Nebraska lost by a point and he pulled the plug out of the set. He used to call all the College Teams, what we now refer to mostly as the The Big 10, as those “cornfed” boys.

    He would practice calligraphy during the commercials, I would know his handwriting anywhere.

    Lol, just love that man. When I was at school I used to call him at 6:58PM, right before ESPN wrap up show, years ago, until he caught on I was just harassing him from afar.

    My family has a very important event tomorrow, my sister’s wedding, and thank you for reminding me to think lovingly of some of my family that has passed on and will only be there in spirit.

    Obfuscation is the concealment of intended meaning in communication, making communication confusing, intentionally ambiguous, and more difficult to interpret.

    This concerns me big time! How can the jury make an informed decision based on inadequate preparation by the defense’s part? It looks like they literally pulled people off the street and threw them on the stand. The judge should NEVER have to step in and question.

    I’m not finding this amusing. Their defendent is fighting for her life. Whatever they have to defend her is not being utilized effectively. This was never about Casey (I am NOT defending…but then again, it’s not my job). This was about egos. One thinking he can slay Goliath because his alter ego is Juannie Cochrane. The other thinking…eh…I’ll step in like the southern hero I am. My presence alone will save her. Lastly, we have a babysitter…er….nanny mothering the snothead.

    The jury isn’t stupid. I’m sure they know this isn’t how an effective, well prepared trial runs. Despite JP’s best attempts, the defense is killing their own client before the verdict is made. How can this be a good thing?

    I’m glad you think you know that his height “explains everything”. Now maybe you can tell us what inborn physical characteristic you have that explains everything about your stupid comment.

    My brother is 5’5″ and hispanic like Baez. He is a brigadier general and one of the most highly decorated soldiers from the Vietnam War. He was a White House Fellow and a former Assistant Secretary of the Interior under President Gerald Ford. He played rugby, football, baseball and tennis in school and was president of his class. He is a highly accomplished and well-regarded businessman and a wonderful husband, son, brother, father and grandfather. Most importantly, he is not a “poor thing”.

    I am frankly stunned that someone in this day and age would put into writing a comment such as yours. We can’t say such things about women, gays, minorities, the handicapped, etc. but I guess short people are still fair game…you should be ashamed.

    Dee- relative to the radio interview, you have taken this out of context.

    I mentioned Baez ego being bigger than his height of 5’4″, as told to me by my dear friend Mark Nejame.

    The comment was about Baez, and not anyone else, I am sorry if you were offended.

    What’s w/ ALL the crap JB was pulling — introducing “evidence”, talking about it, getting her response about it & low & behold it is not in evidence.

    Of course back to his big notepad & having her write on it for the jury — as a computer example would not of work. It just seemed the whole “drawing” was “to confuse” the jury.

    No wonder JB never connected w/FBI for “hair” results & study results …they would not be up on his big notepad…

    Today … screaming @ computer screen while slapping hand to forehead… asking “can he [jb] really be that scattered & ill prepared?”

    I think Mr Baez has had a good day today, if he attacks the integrity of the duct tape vigorously he will raise reasonable doubt regarding it, also the lack of DNA or blood found in the trunk of the car was suprising, if he can prove DNA can be obtained from a similar environment after a month, he has blown the case wide open.

    There may not enough for a conviction in this case.
    Can George Anthony plead the 5th?

    On another note, kudos to LDB asking CSI Welch if she would classify the site as a trash dump and she said yes.

    There’s a thought pattern belonging to the accused that is emerging, IMO, that may also link the accused to Suburban Drive:

    Disposal of her daughter at open-air “trash dump” … place and leave in her car trunk a “trash bag” with opening at top … park her car right next to open-air commercial size “trash receptacle …

    Dear Blink…I did not hear your radio interview and, while you may have mentioned his height only as a measuring stick for his ego, Vidda certainly went further. She referred to him as “poor thing” due to his height alone…not his ego and stated that his height, not his ego, explained everything.

    If Baez had been 6’5″ and you had used that as a measurement of his ego, do you think Vidda would have called him a “poor thing” for being 6’5″?

    If he was 6’5″ I would not have used the analogy. It was on my lead, my bad, I have apologized for offending you or anyone else. Was not malicious, and again, was a comment based on the radio program so out of context.
