Nittany Nightmare Continues Past Sandusky: Former President Spanier Charged- NEW Charges for Curley and Schultz Filed

Happy Valley- PA On the heels of convicted child molester Jerry Sandusky’s transfer to his new home,  what most predicted would follow- has.

 

 

 

Former Penn State President Graham Spanier,  fired by the Penn State Board of Trust the same day as legendary late-Nittany Lions Coach Joe Paterno, is facing serious charges today filed by Sandusky’s prosecutors.

Spanier is facing counts of obstruction of justice,  perjury, conspiracy, endangering the welfare of children and failure to report allegations of child abuse.

Tim Curley and Gary Schultz,  who were facing perjury and charges based on “non-reporting”,  are now facing all five similar charges as Spanier-  additional filings occurred simultaneously.

Linda L. Kelly stated the men “used their positions to conceal and cover up for years the activities of a known child predator,” on Thursday following the announcement.

    One problem with the Shutt story from the start is that any DA who agreed to a reduction of bail could easily get it. It didn’t make too much sense from the start. Going into the GJ with that was weak.

    It could have damaged SPM. both politically and professionally. The Commissioners compounded that by constants bringing it up constantly.

    It seems to me Cantorna and Masorti defend drug dealors. Exarchos’ son had a problem along those lines.
    Just like that drug arrestee Ray had announced had his roots in the NE, it seems to me a regional ins co (ny, nj, ct, pa) could be owned by or a money laundering asset for a crime family. and could chose to sell umbrella policies to local govts. and would have deep pockets to indemnify individually, and as employees, the whole sorry lot. and wouldn’t care about repr conflicts. this cavalier deep pocket ins co, and inattention to repr conflicts. has aroused Castor’s suspicions imo. So maybe after a back door for Ray, hard on crime SPM is being shown another door.

    Personally, I believe Lunsford, but he’s taking the right way out for himself to settlethis prior to elections. It will allow for another tough successor.

    The double tragedy, besides his loss, is Ruest is in line to be Pres Judge acter Kistler goes to the great Bench Beyond (some temp placeholder Supr Ct seat).

    quite the irony Dem judges & candidates are hard on crime and Repubs are pro short or waived sentences, ARDs, low or no bails. As I understand the Repub Commissioners & Kistler’s policies, it has come in recent years down to beds in use at the County prison in a mission to reduce County prison budget expenditures, moreover earning income from other Counties for housing their inmates in the beds created by lenient bail & sentences. And SPM is very opposed to fiscal budget driving bail and sentence proscriptions by Repub Kistler.

    I respectfully disagree that Lunsford is a fine judge. I believe he is retiring to end a probe re the yanking of public files and rampant texting and while I truly have never heard of this kind of ex parte behavior nor the defense community’s reaction- I keep in mind Madeira essentially did the same thing and Lee’s case postponed. Those hens may have squawked loud enough to shine the light- but Keep in mind Kistler lost his potential also.

    Interesting Lunsford didn’t inform his Pres Judge directly, but his colleague was hardly supportive or a standup Pres.
    In fact, iirc Kistler did explain why he removed Kunsford from Criminal Court: too many complaints from defense attorneys. (meaning appropriate ARDs, bails, & sentences)

    Respectable defense attorneys, and one Bellefonte PD member have commented here & there on his history as an able judge. As to what he stands accused of (texting does not equal texting about cases with DA) and removal of spurious accusations not to be deemed part of record but their preservation handled improperly, Judges thruput this country do that sort of thing continuously. at least in TX and VA.

    The remedy is not removal. It is education by Court Administrator & Senior Judge as to document handling. (The real issue is the Court Admin jacket maintainance was apparently sloppy as heck across the Board (and thus retired).
    And as to texting, ordinarily a Pres Judge would privately counsel and publically issue rules such as no texting during bench hours and no texting with anyone from DA’s office or whatever. Imo Kistler originally collaborated in starting this scandal with Lunsford, rather than solving it with private counsel & public rules, in order to ensure Lunsford would not have another 10 yrs so Republican Ruest coukd succeed Kustler as Pres Judge.

    I do not believe the Disciplinary Office was able to find any ex parte case communication on Lunsford’s part or
    that would have been announced and acted on with new trials recommended.

    CIOC boils down to why be litigious SPM? It’s just billing records, not content, no harm.
    The problem is certain criminal defense attorneys are using those records in jury trials to raise doubt in juror’s minds about the ethics of prosecutor and judge, and on appeals from conviction/sentencing to argue a criminal trial was fundamentally unfair–all without content or context.

A commenter on the SPM FB page, under the dog thrown from car conviction, Paula Revere (get that?) set up a facebook page under Paula Revere just after Shutt was sued, for the specific purpose it states of cleaning up the DA Office. A resident of Bellefonte, she claims firsthand knowledge of SPM’s own dog’s antics in the office at work, and of the Disciplinary investigation of SPM. Further accuses her of cocaine use, saying a purchase is on tape, and of sleeping with various men, particularly Boob. I hope SPM finds out who in Bellefonte, who appears to have been employed in the DA Office, created Paula’s harassing FB page.

    It was shorthanded before Gricar’s disappearance.
    Oxycontin use would have been at its peak after the Sloane back injury at the time Gricar disappeared. We have seen in Sloane postings in various forums (allegedly) mood swings and great rage, and a specific target focus for the rage. What if Gricar had gotten emails which appeared to be under the influence of oxy, had exchanged emails about job performance and job resumption, and was trying to help Sloane while clean house for the successor DA. Had indicated by email concern for Sloan, and intended during a joint drive to a rural pastoral lunch site to counsel him out. Triggered a rage reaction. In the days before computer forensic reconstruction of emails, tossing the laptop was deriguer. Gricar didn’t worry about office coverage because in a sense he was doing the office’s work. Could it be SPM’s resurrection of the Gricar investigation, now empaneling a GJ, has triggered all this rage against her? Just one theory, “allegedly”.

    btw Blink. My guess is CIOC’s SPM google+ photos is a spoof containing a few real pics. Who knows?
    SPM and her forensics lab will.

Interesting to know the content of emails Sloane to Gricar in the year before the disappearance. Maybe there was drug usage before the accident affecting job performance.
