Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

    Interesting statement. “…no arrests were ever made.” Since it’s an “ongoing investigation” I would think “no arrests have been made” would be the correct way to phrase this. I guess we’re getting picky, but “no arrests were ever made” sounds like case closed to me.

    I know Kaine always talks in the “we” person, but after listening to the podcast, I got the distinct feeling that Kaine now has a new (possibly live-in) partner. JMO, but that’s just the feeling I got. If that were the case, one would think he’d be anxious to get the dissolution over with.

    I recall him saying specifically that it was just he and Kiara in the home and I doubt very highly he would be co-habitating prior to equitable distribution in the abated dissolution case.

    I was referring to the background, narrative, the supporting data to the complaint. It is the good faith basis for it’s filing in the first place.

    Okay, dumb question, remember the truck driver who said he saw a child who looked like Kyron in a truck turn on Salmonberry rd heading to the coast off Hwy 26 on Saturday. His name was David Vaughn. Is it possible he is related to this family? Or is this just another coincidence? The video seems to be gone, can’t remember if it ever showed him.

    David Vaughan said he was driving toward Portland when a pickup truck turned in front of him onto Salmon Berry Road in western Washington County. Vaughan said he slammed his brakes to avoid a collision with the gray or black truck.

    THIS Salmonberry Road* is off of Hwy. 26 in the Tillamook Forest of the Coast Range Mountains. It is not far from the coast, and leads up to the Salmonberry River that was featured in MD’s video. It is a long drive on dirt roads into the mountains. I’m NOT trying to tie this sighting to MD or DAD, just asking if this is the other sighting that is getting confused with the Chas sighting.

    *I state this because there is also a Salmonberry Road in Mt. Hood Village which is East of Portland off of Hwy. 26.

    There were 3 reported sightings that are being confused, imo:
    1) Chas -saw woman in white truck turning onto Hwy 30 north of NW Logie Trail, he later realized was TH
    2) David Vaughan -west of PDX (NOT Mt. Hood area) -saw truck and boy resembling Ky
    3) Mr. Mark DeWitt -1.5 hrs south of PDX on June 9th truck, car, boy, women carrying shovels, heard a sound like a gunshot coming from the directions of the woods

    it’s an assumption since DA was against K being deposed in divorce so logical he would feel the same about civil, and Kantor is taking instruction from the DA, that’s why the timing of abatement IMO. IIRC K was served with papers in civil but never scheduled even though D and T were, but the day before they were to be deposed, abatement magically came and that also took K off the hook. It’s MOO opinion that kantor acquiesced to DA in preventing those depositions to be taken with an abatement though the timing might have been sheer coincidence (and that pigs can fly!)

    Since LE does not seem able to prove in a court of law that TH was involved in a MFH against Kaine I don’t understand why they will not grant her MFH immunity so the case can move forward based on what TH knows or does not know about what happened to Kyron.

    Could it be this case will be forever deadlocked over an MFH which not only cannot be proven but never actually happened anyway.

    I got the impression from listening to the podcast that “projects” are created by LE to investigate and eliminate suspects and avenues of possible connections. I wonder if LE stating that they wanted to go back to the beginning to investigate information they didn’t have early on (the reason they were granted an abatement) was a “project” at the time. Did that project not yield the results they were hoping for? The judge gave them until August to complete this project. If LE came up dry on that particular hunch, does the judge know? Will another “project” be in the works as we approach August? If so, will LE try to justify another abatement? Although the podcast was interesting, especially during the last few minutes, I wish we, as a group here, could compile a list of questions for a reporter. I also wish that the reporters could, in a diplomatic way, interrupt Kaine while he goes on and on about things that mean nothing, and direct the interview back to questions that really need answered. If Kaine were asked something too “touchy” he could simply say “WE don’t know.” I thought it was abundantly clear that he and Desiree are not on speaking terms, that was a pretty direct and nervy question by the reporter that I respected.

    I just read the go fund me message from Desiree again. I really think she is just substituting “anyone” for “those”.

    Both she and Kaine are kinda roundabout with their “messages”. And no doubt, off the fly, they are not articulating well any real facts, or other information. To give them credit they probably have been told a multitude of truths and half-truths and barely-truths by LE and are having trouble at this point internalizing what is fact and/or fiction.

    BTW. I did come across an early report by KPTV in which they state LE had told them the last “confirmed” sighting of Kyron was at 9am. I’ll get it up.

    Because folks like me that have never been avidly disecting a case before this one would like to know. I just have a “feel” that ALL of the parents have something to hide. As well as all the major LE/Judiciary/Attorney persons in this case. Although it’s more than a feel sometimes…as I do research and know the case in general.

    To what degree am I reading too much into these “deceptions” as compared to other cases. If you please.

    Well, without having interviewed them personally, I believe KH and DY are believing what LE tells them. Part of that is going to be until they have evidence that Ky is deceased he is not in their minds. I know for a fact that witnesses that were interviewed were expressly told the LE theory that TH was involved with “one other person.”

    I do understand the willingness of a parent to favor that outcome over the other, but I find the strict belief absent evidence of being deceased un-natural in itself with a child missing this long, with NO ties between a SZ and TH having been found.

    Desiree blames Kaine for the reasons that TH is not talking and has not in three years since the whole sting debacle, let’s be honest, and she is right to. To her credit, without locking me up to prevent it, after I learned what Kaine is alleging was going on in that home if true, his head would be on a spit in front of my house and I would spend the rest of my days in some catatonic chant. I am speaking emotionally, not professionally, obviously.

    Bottom line here. These parents, separately or united need to confront LE about where they are, what the immediate actions are, and as I suspect they will be equally as passive, demand escalation until they get in front of Underhill where they formally request the DA consider immunity for TMH and request confirmation on the investigative avenue of an opportunistic stranger abduction.

    If LE cannot positively exclude that scenario, these parents are not doing right by Kyron, imo. I say with compassion and respect, and I say that because I work for the wee man.

    1. If Terri gets immunity for the MFH Kaines the RO falls apart because it is mostly based on the alleged MFH. Terri could even possibly get a custody arrangement where she has partial custody of kiara.

    2. I don’t think Kaine believes that Terri knows where Kyron is anyway. So why put Kaines’ sole custody of Kiara with no visitation by Terri at risk.

    I would only add that the RO is due to renew or expire prior to the abatement issue. I would watch the docket unless they have a court date consolidated for all. Kaine made no mention of a June court appearance so it is also possible they will seek to renew under the abatement. Given the words of Bunch re the objections to abate, unless something has changed we are not aware of, I would expect him to fight it or request a GAL. This stuff occurring in a vaccum needs to end.

    Given what Kaine’s said about what was going on in the house, all DY has to do is take that in with a change of custody petition. Why that’s not a priority for her idk whether it’s who he comes home to or who makes the burial choices someday. The only possible reason is to selay to benefit Kaine’s current custody dispute. So rather than laying into him, imo her behavior is supportive. Maybe her Terri antipathy overrides.

    I don’t think you can file a change of custody petition with a missing minor. It is impossible to prove best interest standard. The court however, has latitude to appoint a GAL as discussed earlier. DY was not successful in attempts to change Quinn’s visitations or primary residential parentage a few years back- without going into specifics that don’t apply to Ky’s case.

    If this is the case, why is DA so opposed to Kaine being deposed? They were adamant that he “knows too much”. Do you suppose that what he knows if unflattering things about LE rather any investigative info related to Kyron’s disappearance?

    They never said he knows too much- they said he knows things TMH does not. And I strongly believe that was then and this is now.

It is whatever went on that had you declaring the severe punishment for Kaine would be a crime on your part. (head on spit)

    1.Staton routinely spends nearly twice the money he budgets for overtime, and he’s on pace to shatter his record $7.9 million in overtime last year. Multnomah County commissioners have accused him of mismanaging his budget—and a huge spike in the number of inmates released early from jail because of overcrowding is the result, they say.

    The board historically has struggled to control spending by the sheriff, who is independently elected. The county will hand over $124 million to the sheriff this year, but once it does, it can’t tell him what to do with it.
    But some deputies have used overtime to double their pay, and Staton claims he is so short-staffed he must pay overtime to cover shifts in a department that runs 24/7 (“Overtime Busts,”WW, Jan. 9, 2013).

    Documents show commissioners plan to limit overtime for the first quarter of the new budget year to $748,014—a sum his department often blows through in just one month.

    The commissioners are tired of waiting for Staton to fix his budget, and they’re worried that his millions in overspending is linked to the jail’s rash of emergency releases.

    Staton has said he must use overtime because he’s scrambling to fill job vacancies, particularly in the jail. But commissioners say Staton has more control of his overtime spending than he lets on.
    A breakdown of the numbers shows that at the end of the year, when the budget is tight, the sheriff’s office spends an average of $518,000 a month on overtime. But when a new budget year starts—as if it were payday—the monthly overtime jumps by an average of 43 percent.

    County Chairman Jeff Cogen notes the county gave Staton’s office $888,000 last year to ramp up hiring. “I’m frustrated that the hiring process that we’ve amped up hasn’t gotten us there,” Cogen says.
    But Staton told commissioners his department has hired 24 new deputies and now has 15 vacancies, the lowest in years. But 76 deputies and sergeants are now eligible to retire, and the department estimates they’ll all be gone within five years.

    (My question….how many of the 76 deputies eligible to retire worked “overtime” on the Kyron case?)

    I don’t believe this Commissioners posture & press is a concern for overtime but an early push to dissuade Staton from 2014 run. I deduce a Deputy waiting in the wings is a friend of a CC who has informal power with his peer CCs. It is easy to rail against spending as an election issue. They are giving ammo tohis replacement candidate. I suspect what got a CC riled up is his policy to release ICE holds who’ve not committed a felony.

    Kaine Horman’s pleadings of October 25, 2010, unleashed a tempest of charges against his wife, claiming she was a raging drunk whose inability to control her anger and her drinking had already caused her to give up custody of one child prior to the disappearance of her stepson on June 4, 2010. Unlike his prior, more tersely-written court filings, Mr. Horman’s words are more personal and angry. They are also contradicted by his prior statements to the court and to the media, and the very documentation he provided as part of his October 25 court papers.

    I think his online access and gamer groups ( if applicable) should be a priority for investigators. The Bishop should be interviewed as an exigent witness. At 5’8″ tall, he is not going to be easy to miss, and he may even appear older than 13.

    My Blink Jr. is 14 1/2 and 5’10 1/2″- people rarely peg him under 17. If marshall had ongoing issues that led his parents to initially believe he ran away, I am guessing it had to do with some boundary issues common in that age group.

    Why do I already feel sick over this one? It is not the parents job if a child is missing to determine the genesis as they are not LE. He is 13, whether he ran away or did not, how is he not considered high risk?

    OK, Rose – here’s my effort via email to Erica Nochlin, katu.com. Not perfect but all I had time for today. She encourages people to email to say hi or give story ideas, so I did.

    Dear Erica – A friend of mine was saying how much she appreciated an article you did, so I checked it out on the katu website. When I looked at the list of stories below your bio, I realized that a great many of the stories I choose to read are yours. So, hi, and thank you. I can see that you are well-trained and a very good writer.

    I realize you may not have control over this, but if I could think of one request, it would be for katu to allow you to use your energy and investigative skills to take a fresh look at the story of Kyron Horman. I have followed this story since the beginning, reading or watching everything that has been said. Although the most important thing is to find out what happened to this little boy, there are a number of other concerns that ought to have the public calling for answers every day!

    Some examples:
    1 – Given that Skyline School did not follow PPS district security policies for signing visitors in and out on that morning, and did not call a parent when Kyron was not in class all day, why is there no accountability on the part of the school and the district? I am a retired PPS employee and I do not believe there is any valid excuse for how, according to reports, things were handled. We are talking about the life of a little boy here, not losing one’s cell phone or lunchbox.

    2 – Given that Kyron did NOT leave the school with his stepmom, someone else had to be involved, whether connected to Terri Horman or acting on their own. How can law enforcement continue to allow people to think their children are in no danger just because they are in a school? The focus lately has been on shootings in schools, but abducting a child from inside a school seems much easier than people realize, particularly when a special event is occurring. There is nothing we have heard or seen from law enforcement that allows us to confidently state this was a one-time event and rule out a stranger abduction.

    3 – I am struck by the lack of investigative journalism in this case since the very beginning. Little snippets appear from time to time but nothing like I have seen for other stories and would expect from a few of my favorite reporters. Most often, we get repetition of bits of past stories and interview questions that don’t really lead anywhere. I realize some information must be withheld for purposes of prosecution later, and that news agencies probably can’t afford the time and money to support much investigating, but after 3 years with as little as the public has been told about this case, somebody ought to take the leap, particularly with a public school involved.

    The examples above are from my own humble opinions, of course. In addition, I am afraid the divorce, criminal, and civil cases muddy the waters even more for the public’s perception of this case. How sad it will be if the lack of information given the public and the lukewarm reporting in this case result in no justice for Kyron and the disappearance of another child from a school.

    The disappearance of 13 yo King en route to school highlights to me the propensity (& Federal legislative incentive it seems) of Portland regional LE Depts to put missing boy reports into an absconding/runaway category first. Seems to be a wait & see approach, not an “alert the public” approach. King was found fast enough when a public bulletin issued. Whatever the home/boy background, it was the right thing to do. I gather Portland has a top heavy child runaway, as well as a child prostitution, problem.

    Since Kyron in the “opening search” (Fri nite, Sat) seemed treated as a runaway as much as anything else, I am wondering why the general lacksadasical attitude displayed by local LE to King did not apply to Kyron but it was all hands on deck with the FBI & other Fed resources Friday night. When comparing to King’s LE mgmt, I do not think Kyron’s tender age or the school site alone explains the Fri/Sat resources brought to bear on Kyron.

    I also do not think either Staton (or Tony as family coach) were smart or proactive enough to come up with call in the fbi profile team on Friday night. It is clear this is far out of the Portland area policing norm. And the Feds don’t seem buddy buddy with PPB either (from the latter’s mgmt perspective).

    So where did that Friday nite FBI enlistment/profiler approach come from? A parallel preexisting investigation of one of the parties known to Staton Friday nite? A call from “Intel Legal” to Sam & Sam to the Sheriff? I do not think age 7 plus school (after all the “real” school day hadn ‘t begun–it was like the “getting there” phase as King) adequately explains local LE response Fri nite in terms of the gung ho search and the immediate fbi involvement given what appears to be a “go slow & let them resurface” approach to other missing boys with a homelife affording motive to walk away when they are old enough to impulsively do so.
    My guess it was Adams’ idea to call in the fbi.
