McStay Family Murdered: Will Desert Graves Yield Their Killers?

Deserted in the Desert

Gianni Martelli McStay had rock star hair at only 4years old.  His little brother Joseph, affectionately nicknamed Chubba- did as well.  They both rocked a beanie like no other little dudes.

Chubba Family Photo

Gianni and Chubba were as inseparable in life as they were in death when they were recovered in a shallow grave in the Mojave Desert on November 11.

Their parents, Joseph, 40 and Summer McStay, 43, were located in a separate grave nearby.

A 3rd gravesite was found-but empty.  A protected source not authorized to speak to the media has confirmed that at least one of the parent’s remains was bound by an electrical cord.

While formal DNA comparisons and autopsy protocols are pending, the manner of death in all four victims have been declared homicides.

Just about 50 yards off the intersection of Route 15 and Quarry Rd the family that San Diego County Sheriff’s Department (SDCSD) believed was “likely” voluntarily missing on their own and living in Mexico, was recovered in a 30 hour excavation process.   An off road motorcycle enthusiast called the San Bernardino County Sheriff when he came across what he suspected was human remains.

Last April SDCSD forwarded the McStay case to the FBI based on their conclusions that the McStay’s had McGone to Mexico, following a lengthy complaint of their handling of the case by Patrick McStay, Joseph’s Father.   Troy Dugal, previous lead investigator of the McStay case, appeared on several news and cable television programs over the last three years explaining there was “overwhelming” circumstantial evidence the family of four that was pictured crossing the border into Tijuana, Mexico the evening of February 8th, 2010 was in fact, the McStays.

Following the recovery, San Bernardino County Sheriff’s Office will maintain jurisdiction of the investigation.

Frenemies..  Frenethieves.. Friends.. Family or Cartel?

Who brutally murders innocent children and dumps them in a hole they dug in the desert?

Logically- someone who is very familiar with the area.  Of course it is just as shocking and horrific to murder anyone,  but it takes a specific brand of evil to murder a baby.  Make that two.

There is absolutely no evidence whatsoever that either Joseph or Summer McStay had any ties to drugs, associates with ties to drugs or cartel, at any time.   None.

Contrary to a top selling book on the case, “No Goodbyes” by Rick Baker, there has never been any evidence whatsoever that Summer McStay was some sort of closeted psychotic and homicidal type.  The book goes on to malign members of both Joseph and Summer’s families and in some cases outright accuses same of extortion or stealing.   Baker’s subsequent public theory is that Summer murdered Joseph and everyone should be looking for her and the boys in Mexico.

Not surprisingly , Baker has requested Amazon pull his book from available stock and has offered refunds to prior purchases.   Popular online sleuth sites previously promoting “No Goodbye’s” have since either deleted it’s hundreds of posts endorsing Baker, or moved them to a member’s only private viewing area.

Albeit obtusely, Baker does touch on a troubling and serious abuse allegation concerning Joseph McStay’s oldest son from his first marriage, Jonah, and his step-father, Michael McFadden.  He writes summer filed a complaint with Child Protective Services after she and Joseph recorded a conversation with Jonah and placed a copy of same with a private party for safekeeping.  Blinkoncrime.com has been able to independently verify that is accurate, but that the investigation was not known to be completed until shortly after the McStay’s disappearance.  Under California probate law, Jonah would be an heir to the McStay estate or as otherwise provisioned in the instance of an existing will.

Interviewed by Laura Ling for E! Investigation, Joseph McStay’s web administrator Dan Kavanaugh claims he was the first to become concerned.  In Baker’s book, he refers to him as a suspect and details how he alleges he was funneling cash from McStay’s business account before he or anyone else knew the family was missing.  Kavanaugh has an unrelated open criminal matter in San Diego County according to court records.

Chase Merritt- Joseph McStay’s business partner in his water fountain design and installation business was the last number ever dialed from his phone at 8:28PM on February 4th.  Merritt joined McStay in a lunch meeting earlier that afternoon where they discussed a proposal for a very large car wash chain to feature custom fountains in each facility.   According to family friend MacCargar McGyver, McStay was very excited about the opportunity.  Merritt claims he passed a voluntary lie detector test, and that he was adamant that Joseph McStay would never have taken his family to Mexico and has always believed they met with foul play.

McGYver spent several days leading up to February 4th at the McStay home due to a painter Summer hired not returning to complete the job.  McGyver introduced Summer and Joseph and by all accounts was a close confidant of the couple.

Patrick McStay, Joseph’s Father living in Texas has had some harsh words for the investigation into the disappearance of his son, daughter in law and grandsons.

“…most botched, inept investigation I’ve ever seen in my entire life.”

He also believes very strongly that the list of suspects with motive to kill his family members is very short.  Three, to be exact.

He said the department didn’t even bother to contact him to tell him his son’s remains had been found.

“I got a message from someone [on Thursday] on Facebook telling me to go and read an article,” McStay said. “The minute I read the article, I knew it was him.”

“I have exhausted and have so much information on three possible persons of interest. All have a motive.”

The three individuals are not connected to each other, but all of them seem like likely candidates. Patrick says one of them seems to be a particularly likely suspect: he’s a wealthy man with a long rap sheet that includes charges of attempted murder, assault with a deadly weapon and burglary. McStay says he, too, has a motive for killing his son.

Although Mr. McStay did not reference him by name, he may be referring to Michael James McFadden, who was arrested in July 1998 and charged with attempted murder and a litany of other felonies including great bodily harm to a child:

459/460(a) PC – Burglary 07/16/1998 02/25/2000 Dismissed
422 PC – Assault 07/16/1998 02/25/2000 Dismissed
273.5(a) PC – Domestic Violence 07/16/1998 02/25/2000 Dismissed
12022.7(d) PC – Infliction of great bodily injury on a child under the age of five … 07/16/1998 02/25/2000 Dismissed
422 PC – Assault 07/16/1999 02/25/2000 Dismissed
240 PC – Attempt to inflict violent force on another person. 07/16/1999 02/25/2000 Dismissed
245(a)(1) PC – Assault with a deadly weapon other than a firearm 07/16/1998 01/18/2000 Pled Guilty
12022.7(d) PC – Infliction of great bodily injury on a child under the age of five… 07/16/1998 02/25/2000 Dismissed
422 PC – Criminal Terrorist Threat 07/16/1999 01/18/2000 Pled Guilty
664-187 PC – Attempted Murder 07/16/1998 02/25/2000 Dismissed

You will note some of the charges are from 1998, others 1999 on the anniversary date, McFadden successfully negotiated a plea agreement and only pled to criminal terroristic threats and assault with a deadly weapon other than a firearm.  Both felonies.

In the complaint he lodged against the detectives in SDCSD, Patrick McStay specifically references failure to interview key suspects he provided to LE directly.

Given the location of the bodies, it would seem that whoever is responsible would at least want investigators to think McFadden was involved.  As a self-proclaimed mountain bike “racer”, McFadden has participated in several bike events in various locations all along the Route 15 Mojave corridor.  SBCSO says they will be re-interviewing everyone in the case and have no suspects.

There have been no named suspects to date and the investigation is ongoing.  Memorial or Funeral arrangements for the McStay’s have not yet been announced .  LATE EDIT: The family and friends of the McStay family will gather at the grave site in Victorville,  on Joseph’s McStay’s birthday.

To be continued in Part 2:  Analysis of the last day of their lives points to involvement by someone they knew.

Blink–your comment about the dirty diaper upstairs where the dogs could have gotten it has me thinking.

Do you believe that SM may have encountered the perp right after changing the diaper?

My first thought was that she encountered the perp in the house, but i suppose it could be that if she left the house with the kids because of the ruse, she figured it was ok to leave the diaper there since the dogs were outside. Uggg….more questions than answers.

I personally do not believe there is evidence in the home that includes Summer “encountering a perp” . She certainly may have, but there was nothing overt for me.

That area is a riverbed and it floods drains to the ocean, when MM was asked why it was not searched he said he attempted to get searches together but seems at the later date folks felt if the phones had been there they would not any longer, would have been washed out.

I wish you would elaborate Blink, the only other idea I have is the phones were in a car and car hidden in this area

IF Summer did not leave with Joey and she can’t see two feet in front of her like her sister said wo her glasses, then who was driving I wonder.

    Thanks in advance!!

I suspect and speculate this case involves a love triangle, that SM may have been unhappy and planning to leave JM and was thinking of running off to Mexico, that her ‘friend’ was volatile and used a ruse to unexpectedly kill JM in Bonsall, that SM rushed from the house with boys upon learning of this, dumped phone at murder site, JM was buried by the friend, that SM and friend and boys then left Isuzu and were caught on video entering Mexico, that SM became unstable due to stress and freaked,, that her friend then was compelled to kill her and the boys to cover his crime, and then buried them near JM, which explains the separate set of tracks leading to each grave, tracks still visible in Google Map imagery today. The friend may have started digging a second grave for the boys but instead panicked and buried the boys with their mother. If there is anything to this speculation, LE must know the identity of ‘friend’ through phone/email records of SM. Hope very much that this case is solved.

Respectfully- why would you think this is a suitable post here? BTW, your info is wrong.

The phone logs further up the page are not complete. I wish I would have printed off the entire list I found a few days ago. JM was literally on the phone the entire day calling all over in the states and calls to Alberta & Quebec Canada.
I also have seen a court transcript from a few years back where MM and another guy defrauded a financial institution of over almost 200K by making false statements about their monthly incomes and businesses they said they owned. In the documents MM listed JM’s business as being his own. I cant recall exact amount MM was required to pay back but I’m thinking it was approx 60K and other guy was over 100K.
Items shown in the families 2009 Xmas photos in their new home are clearly missing in video conducted by Tim Miller of Texas Equusearch MM was also in the house that day asking neighbours to call him rather than police about any info they may have. At one point in an earlier TV interview MM was constantly bringing up the reno’s being done saying the kitchen cabinets were all over the floor ready to be installed and kitchen needed to be painted. When there are photos taken at Xmas’09 clearly showing SM at the kitchen sink JM and boys at kitchen island. All beautiful cream colored cabinets installed, SS Dishwasher/stove top/separate built in oven/fridge all visible. Beautiful new granite counter tops. You could tell they had all been in place for awhile by items placed around the kitchen. A couple months later a photo included in an interview with MM shows all the appliances missing except stove top/oven. Counters bare. Only thing remaining was the blind on the window. Tim Miller wonders during video he took why all the beds were stripped when it clearly shows a nice quilt in family photos. I could name other stuff but it was like MM didn’t expect them to be coming back after less than a few months.
Also MM predicting that he had dreamt J&SM would be found in ‘shallow’ grave and he could see white crosses for the two little boys. Made my skin crawl.

St Kitts is really sketchy when it comes to allowing drug trafficking and money laundering: Here is the U.S. Dept of Treasury’s notice on St Kitts:

United States Department of the Treasury
    Financial Crimes Enforcement Network

Subject: Transactions Involving St. Kitts & Nevis

    Date: July 2000

    Advisory: Issue 26

    FinCEN Advisory

Banks and other financial institutions operating in the United States are advised to give enhanced scrutiny to all financial transactions originating in or routed to or through the Federation of St. Kitts and Nevis, or involving entities organized or domiciled, or persons maintaining accounts, in St. Kitts and Nevis. The need for such enhanced scrutiny is discussed in the remainder of this Advisory.

St. Kitts and Nevis is a federation composed of two islands located in the Caribbean Sea. The population of the islands is approximately 40,000.

Most of the financial activity in the Federation is concentrated in Nevis, whose economy has become increasingly dependent upon the fees generated by the registration of offshore banks. More than 9,000 offshore companies are registered in Nevis alone; there appears to be no bar under St. Kitts and Nevis law to these companies conducting a banking business outside of the Federation.

The counter-money laundering regime embodied in the legal, supervisory, and regulatory systems of St. Kitts and Nevis suffers from serious systemic problems.

    • Money laundering is criminalized only to the extent that it involves the proceeds of narcotics trafficking. Moreover, drug money laundering is punishable only by the imposition of fines.
    • Individuals with criminal records are not prohibited from holding management positions in offshore banks registered in Nevis.
    • Offshore companies (including those that operate as financial institutions) registered in Nevis are not effectively supervised.
    • Offshore companies (including those that operate as financial institutions) are not required to verify the identity of their customers or to maintain records relating to the identity of their customers.
    • Financial institutions operating in St. Kitts and Nevis are not required to report suspicious transactions.
    • The bank secrecy laws of St. Kitts and Nevis effectively prohibit governmental authorities from obtaining any financial information that is collected and maintained by financial institutions about their customers. identities and transactions.

These deficiencies, among others, have caused St. Kitts and Nevis to be identified by the Financial Action Task Force on Money Laundering (the .FATF.) as non-cooperative .in the fight against money laundering.. The FATF, created at the 1989 G-7 Economic Summit, is a 29 member international group that works to combat money laundering.

St. Kitts and Nevis has indicated an awareness of these deficiencies. The Federation.s Prime Minister has indicated his government.s intention to take corrective action and to embark upon a legislative program to address and resolve the problems noted by the FATF. St. Kitts and Nevis has also signed a mutual legal assistance treaty with the United States.

Nonetheless, the legal, supervisory, and regulatory systems of St. Kitts and Nevis at present create significant opportunities and tools for the laundering and protection of the proceeds of crime, and allow criminals who make use of those systems to increase significantly their chances to evade effective investigation or punishment. St. Kitts and Nevis. commitment to bank secrecy and the absence of sufficient supervisory and enforcement mechanisms aimed at preventing and detecting money laundering increase the possibility that transactions involving St. Kitts and Nevis offshore entities and accounts will be used for illegal purposes.

Thus, banks and other financial institutions operating in the United States should give enhanced scrutiny to any transaction originating in or routed to or through St. Kitts and Nevis, or involving entities organized or domiciled, or persons maintaining accounts, in St. Kitts and Nevis. A financial institution subject to the suspicious transaction reporting rules contained in 31 C.F.R 103.18 (formerly 31 C.F.R 103.21) (effective April 1, 1996), and in corresponding rules of the federal financial institution supervisory agencies, should carefully examine the available facts relating to any such transaction to determine if such transaction (of $5,000 or more, U.S. dollar equivalent) requires reporting in accordance with those rules. Institutions subject to the Bank Secrecy Act but not yet subject to specific suspicious transaction reporting rules should consider such a transaction with relation to their reporting obligations under other applicable law.

It should be emphasized that the issuance of this Advisory and the need for enhanced scrutiny does not mean that U.S. financial institutions should curtail legitimate business with St. Kitts and Nevis.

To dispel any doubt about application of the .safe harbor. to transactions within the ambit of this Advisory, the Treasury Department will consider any report relating to a transaction described in this Advisory to constitute a report of a suspicious transaction relevant to a possible violation of law or regulation, for purposes of the prohibitions against disclosure and the protection from liability for reporting of suspicious transactions contained in 31 U.S.C. 5318(g)(2) and (g)(3).

United States officials stand ready to provide appropriate technical assistance to St. Kitts and Nevis officials as they work to remedy the deficiencies in St. Kitts and Nevis.s counter-money laundering systems that are the subject of this Advisory.

I was just wondering if you had any idea if the investigation that is going on NOW has in fact yielded something that, for purposes of making an arrest , is not being put out there for the public.
Maybe I am mistaken but I thought I read a comment by you about your hope that info being withheld would provide vital clues.
Maybe it is too early, but I thought that perhaps analysis of the gravesides would means of death, date of death, proof of if the McStays had been murdered elsewhere and then taken to the graves and maybe even provide some evidence of who buried them and how. When the bodies were found, there was mention that one of the adults was bound, but I haven’t seen any expansion on that info. So again, just wondering if you knew, it seems like sometimes you have access to info that the general public does not
    Thanks in advance

I do, and have in other cases we cover as you know.

This investigation has yielded information that cannot be made public currently- you are correct, and I can confirm that.

Sorry, didn’t mean to put any misinformation out there-delete if you please. I was just going off of what Patrick McStay has said. He said Summer made no calls to Joey’s cell from their landline. As far as other calls she made from the landline I don’t know.

I read last call made from home phone or landline was 4pm

  30. Janessa says:

I am finding it odd/unusual/uncharacteristic that Mike M now contends of being so close to JM and family when initially he would not even bother to drive to their house to check on them. To me; that has a great deal of significance. Mike M later made many incorrect statements due to the fact he obviously was not in constant contact with JM/family. He refers to Summer as ‘she’ even when talking to her brother. Mike has never hidden the fact he did not like her. He is not the closet relative legally and yet from Day One when he refused when asked by his father Patrick to check on Joey and family has acted as the family spokesperson publicly embarrassing his father’s authority and wishes.
Back to Mike M refusing to check on family; he waits a full two weeks and then actually goes through a reportedly ‘window’ left open. In other words all of a sudden can’t wait for a locksmith. During that time it seemed the media was constantly being directed to the ‘Mexico’ theory when the vast majority of people today feel that was a ruse to avoid looking way closer to home.
There are too many whys. Why do you ask neighbours to give any info to him (MM) directly rather than law enforcement? Why sell off your brother’s personal large household items so soon after. Why didn’t anyone not look into keeping up mortgage on the house in the initial months they were missing? Why did Mike M make false statements in the media regarding the current progress of renos in the house? He obviously had not been in the house for a few months visiting or he would have known how advanced renos were. Why did Mike M state his brother’s company was his own to obtain money under false pretense a couple of years before? In which case he was prosecuted in court. Why did JM have to lend Mike M 10K within the last year before their disappearance?
As of today why is Mike M still accepting money/donations on his website? The donations were to be for costs associated with trying to find the family. He has never even attempted to explain where the donated money is going. He is not next of kin; JM’s eldest son and then his father are.
I believe MM was associated with their disappearance and that it revolved around money. I believe it started out that no one was to get hurt but spiralled out of control combined with fear of getting caught.

    Producing a movie????????

I never saw the post about him writing a book. No surprise there I guess. Ugh

The post is on the McStay Family Website and is titled inside the caution tape (not sure if that is the title he is\was planning to use. I know I was surprised producing a movie is expensive. However he could recruit other producers.

  32. Lanni says:

If your question is how does my own personal intuition factor in a case, I can tell you that in analysis, I work very hard to ignore it to the extent it influences direction of premature theory. That said, it is one of my most valuable and accurate tools overall.
    B

That is why I asked because it sure seems to me you are able to go from A to Z and sometimes your posts puzzle me. It seems clear now that is what you are doing, working hard to ignore it.

  33. Janessa says:

@Mom 3.0 Hi- your question regarding the purchase of the house. It was a foreclosure. JM & SM both had a realtor’s licence. Whether their licences were active; I have no idea. The house was supposedly 15 years old when purchased by J/SM in late 2009.

There is also some question recently as well to the validity that there was a carton of eggs left on the counter. There are sites that had some credible info that have been ‘deleted’ within the past 5 days. I wish now I would have copied a lot of it. I believe MM was asked in an interview about the ‘eggs’ or Tim Miller made a comment of not being positive with regards to what was actually seen in the kitchen when MM came through the window. His recollections actually changed somewhat over time. Which in fairness would be normal unless someone came in immediately to take photos/video. Which we now all wish would have happened.
I agree with a recent comment here about what most family members would do in a suspected disappearance.

Janessa- need links please, and I would respectfully request we do not make subjective accusations.

  34. Janessa says:

@lanni thanks for your info re-MM doing filming all through the disappearance.
I even watched that news video and didn’t catch that.
I have always had the feeling with MM all the interviews website with ‘donate’ button and now the filming; it’s all about the $$.

  35. Janessa says:

With regards to phone calls made on February 02 2010 to:
Quebec City, Quebec 418-571-3956. I know this number belonged to Dr. Denis Gagnon as far back as 2011 probably longer. He is a Periodontist. I am assuming this is a cell phone number as Dr Gagnon also uses this number when listing a luxury condo rental in Levis( which is a suburb of Quebec City) in 2011.
FYI- a Periodontist is a specialist that treats gum diseases and also is authorized to do implants and other cosmetic dental procedures.

  36. Mel says:

What about this? This really made me lean towards Dan K. I think Mike McFadden and Dan K should be seriously investigated. They both have motives. Dan K is also a hacker. He got a hold of the family computers with Mike Mcstay and may have hacked that Mexico stuff in. The detectives were real dumb to allow Mike Mcstay or anyone else tamper with their belongings. Then again, this info can be a coincidence.

Mel- not a verified source link.

Yesterday, I posted complete copies of Joseph McStay’s phone record and contacts that were on the RB website. Is there a problem with them since they are holding pending moderation? Not sure of the process, so just asking. Thanks.

It is up, but I would ask that you provide a source link if you are referencing it from a post please.
    B

  39. Larry says:

Looking at the extensive call list posted by Sierra and considering how busy Joseph McStay was on a day to day basis I find it incredulous that everyone that knew the family sat on their hands when they vanished.
The man was running a business for goodness sakes. He was busy and so was Summer and then there were the little children.

What were all the business associates thinking?
What were all the relations thinking?
What were all the friends thinking?

Fair go, a family vanished. All those phone calls and SMS messages stopped. Just stopped!

I cannot think of a reasonable excuse for a raft of people doing nothing.

Was there a common denominator at work?
    Was it fear?

Whatever, LE’s investigation was hindered from the get go. Talk about being slow out of the blocks.

Was a serial killer at work here or is it going to be something even uglier?

Meanwhile LE is operating from a ‘cone of silence.’

    Three things solve crimes:

    Physical evidence
    Witnesses
    Confessions

I haven’t heard of any witnesses. Nearly four years and no confession.
If there isn’t physical evidence where does that leave the investigation?
    What say you Blink?

    Happy New Year to all.

Larry- I don’t think it is a fair statement to say that the family sat on their hands- I know that in the beginning both Patrick and Michael were very active in searching for them and for any information as to their whereabouts. I believe Patrick called in Texas Equasearch and iirc, Michael and Susan called in IR3 and hired a private investigator.

I do think that once the “border” video came into play that the family was split as to the identity possibility. I have seen mixed interviews about that but I do know that Patrick never believed that it was Joey, Summer and the kids in the video and he has worked tirelessly ( against the tide unfortunately) to get LE to investigate what he considered “properly” and went so far as to file a complaint with internal affairs. I have read it and he was correct to do so, imo.

I can honestly say I have no idea why Susan and Michael felt it was ok to sell off belongings, remove funds from the business account or accounts. I do know that will all come out in probate and I would not preclude criminal charges if the bank or other credit companies have a dog in the fight. It bothers me that if Michael and Susan felt it was their “mission” to run Joey’s business in his absence, why not pay his mortgage so he did not lose the home?

I have recently seen an interview with Dan K where he stated he was working WITH Susan and Michael when he was using Joey’s paypal account or withdrawing funds to pay others so it appears he will have more to say about that.

The bottom line here is that SDSD did not believe there was a crime, they did not secure things they should have as a result, and unfortunately several folks helped themselves to things that did not belong to them. I really have to believe that when this family was recovered there has got to be a great deal of guilt over that.

There is now physical evidence in this case due to the recovery, but will it point to suspects? I continue to believe that this crime was at least in part, financially motivated.

If the graves were dug already then it was planned. If there were 2 graves then they were expecting 2 .if they were expecting. 2 adults and 2 children wouldnt there have been either bigger graves or more graves? I also find it odd that with the daily phone calls with cm why was it not any concern for days that cm didnt or couldnt reach jm. Especially since cm knew jm wanted to talk to him the night before? Another question is how does someone buy a house with 10% down if he had bad credit.. was he flipping the house for profit. Did he owe money for that and a large payment was due?

  42. Sierra says:

I would have provided the source link, however RB removed all from his website. Sorry that I didn’t mention that.

I deleted it for that reason, which I almost never do, but I do think it is unfair to any of Joey’s personal non-business contacts.

  43. Sierra says:

In the meanwhile, you are welcome as I was glad to have saved it, in order to be able to provide it now.

  44. TRinCA says:

Ianni, I cannot “see” two feet in front of me either, but in a pinch I can drive without glasses. Plus, I wear contact more often than glasses. Perhaps she did the same.

And Mel, without sounding like a know it all I don’t believe it’s possible to “hack information in.” I know more than most people about computer security and hacking is tough stuff and popular culture has turned it into something almost alive and capable of much more than is realistic. If the computer was tampered with even the most basic computer forensic study would have revealed that long ago, provided it was examined. Furthermore, nobody with access to the machine could have covered that tampering up.

agreed. There are many ways to track account activity outside of the individual computer, but the allocated and unallocated clusters cannot accept overwritten data as “old”. The forensic product we use most is encase. That said, it has it’s own issues and the best product out there for hard drive analysis is a Secret Service home-built variety.

I repeat that I do not trust LE’s version of interpretation of navigation/search data until I see it myself. Dare I remind everyone of the Anthony case?
    B

  45. TRinCA says:

Larry, I agree it makes little sense that people just thought nothing of JM sudden absence. His phone records reveal a VERY busy man by my estimation. Earlier in this discussion, if you go to the first few days you can find a link to CMs interview with MailOnline.com that paints a very different picture of what was during those first days, even weeks when JM suddenly dropped off the technology radar map. CM says he went to JM’s home the first day because he was alarmed by his failure to return calls. I wont paraphrase the article but it will give you a very different picture if you read it. In a nutshell, he said the McStays drug their feet on sounding the alarm and he had to almost force them to call LE.

Me thinks we need a verified timeline of actual calls and wellness checks- lots of discrepency.

This log entry is interesting because the three places it mentions: Cattaraugus, Chautauqua, Niagara Falls are 3 counties in Western New York State. North and South of the area. The phone number is actually from Akron NY which is a little town in Erie County about 25 miles east of Buffalo. One call covers a lot of area lol.

Sorry if I’ve offended. No worries, as I won’t bother with your venue again.

You did not offend at all. Just have to keep to the guidelines here.

That made me laugh and I couldn’t agree more. This is such a horrific case but it’s also so very strange and the added dimension of some very loud voices coming from different directions and perspectives can give one vertigo if you’re not careful.

I feel that law enforcement is on the right track in this case but are withholding quite a lot of information at this time which is necessary. There are some basic questions that must be answered before forming any accurate explanation or theories in regards to the McStay family murders. 1) forensic accounting of Joseph’s bank records. Which would explain whether the $40,000 and any other monies were accumulated slowly over time or suddenly before they bought their home. 2) Forensic accounting and cooperation with all vendors or anyone whom Dan Kavanaugh and Michael McStay claimed they paid from the business account shortly after the family went missing. 3) Airline records verifying Dan Kavanaugh’s return dates from Hawaii. 4) Whether Dan Kavanaugh actually worked for the company after his falling out with Joseph over asking to be bought out in return for continued access to the website. 5) Chase Merrit verifying exactly which vehicle Joseph was using that day of their lunch meeting. 6) Verification of whether Joseph returned to his office or his exact whereabouts shortly after lunch. 7) GPS records of Summer’s phone and whether they show a direct route to the grave site or another route and or primary destination. 8) Same for Joseph 9) Whether any form of fraud was used during the mortgage application process. 10) Summer’s phone records within 15 minutes of her departure from the home that early evening. Some notes: Are Joseph’s phone records which have been floating around really accurate or is some information from them being kept away from the public. If Joseph never made it home then either his phone was used to lure the family from the home or another persons phone was used which would show up on Summer’s phone records. Or the possibility that Joseph might have been killed before hand and the murderer used Joseph’s vehicle to drive to his home to confront summer and the kids. If Joseph did make it home and neither cell phone records show an incoming call about the time of their departure then they obviously knew the murderer who came to their home. Yet, that would leave the question of exactly how did the murderer get to their home? car, bus, walked etc…I don’t believe Summer would be lured out of the home with the kids with just a phone call of any type. Example: “Joseph’s having a heart attack or needs his meds” etc…b/c that would leave the possibility of Summer calling someone she knew while she was in route and telling whomever what was going on and that she received a phone call from whichever individual.
The police have narrowed down their suspects to two strong people of interest I suspect but even with an arrest it would be extremely difficult to get a conviction without leaving any sort of reasonable doubt without a confession due to so many different possible motives by at least 3 to 4 individuals.

I continue to believe that this crime was at least in part, financially motivated.

I agree, the finical aspects must be involved in some way. Yet, since the McStay disappearance, have we seen anyone profiting $$ wise to the extent that such a murders would be justified?
    To me the question is:
If The McStay’s deaths did not result in immediate and sizable financial gain for those left behind, did the elimination of the MCstays protect something that was already in place before death, a situation that would have been jeopardized if any of the McStays remained alive?

What was the origin of EIP? How did that company come about? In all the things I have read, I can’t recall how it started in the first place. Could there be any clues in knowing how the on line business originated? Was it an out growth of a existing business that McStay had, a business that was then ” transferred” and expanded to an online business, through the engagement of Kavanaugh?

EIP was born from an earlier venture ( Naturally DP) that ended up being sued for patent/trademark issues. Iirc, Joey, Michael and Patrick McStay were all parties to that effort.

The fallout of this caused a family discord for a while as Patrick felt he was not consulted in the stipulation to dissolve the action.

To my knowledge, Joey was working 3 jobs to make ends meet through 2005 so I do not believe I have seen any evidence that the financial motivations go that far back.

I could be wrong here, but I think the instant projections of the business in Feb 2010 far surpassed any earlier potential. That said, I have had the unfortunate experience of working a case where a young adult with mild autism was murdered for his XBOX. Anything is possible.
