Kyron Horman Missing: New Years Eve Settlement Ends Horman Marriage

Portland, OR- In a surprise court hearing,  Judge Henry Kantor signed off on the agreement between Kaine Horman and Terri Moulton Horman to end their marriage this afternoon.

Details of the agreement have not been released publicly, but according to KGW,  a financial settlement to include child support and a lump payment to Terri Horman has been reached.

In what can only be described as a bitter family court feud-  the divorce matter was last in court on December 16th to decide if the Horman landscaper,  Rodolfo Sanchez Estrada -who alleges Terri Horman tried to hire him to murder Kaine Horman at a lunch meeting – would testify.

Judge Kantor has not yet filed an order from that hearing but Attorneys for Terri Horman were granted a continuance from the pending temporary custody motion scheduled for December 19th and 20th.

The game was in your ‘hood? How’s traffic. Congrats to the Hawks.

Qui, madam. Not sure ’bout that either. Odd reference to and unusually harsh metaphor.

The stadium itself is quite spectacular. If your traffic question was pointed at Christy- fair enough, but the GW is not in play, lol. I spent many years on the route 3 corridor and I can tell you it is a congested 2 lane mess. The Hawks are one of the best coached teams I have seen in forever. They are going to dominate this league for a while.

First thought. Engel’s …. and the purpose of the “perpetuity” threat? That happened in the interim between finding Rudy and finding a lawyer for him. Second thought: Who would benefit by Rudy having a lawyer?
And a lawyer that could be molded…i.e. was not a defense lawyer by preference. Would have to be “briefed” it would seem on the intricacies of the case. Was that happening while Houze was fighting the alledged “perpetuity depo”?

Just for the record regarding my feelings regarding TH. To date she has not been charged with any crime. She therefore is not guilty. However, IMO she has been unduly punished by LE and the courts because I believe they want her to be guilty. I also believe that she stirred a hornets nest when she accused KH of having illegal steroids. The police and sheriff’s officers in the area are likely involved in the pending federal case and they are playing tough to hide involvement. We will see in the coming months if that is true or false.

  12. Jae Joi says:

Re: Desiree Young’s response to the People magazine article, as published on the gofundme site.

Desiree Young writes that her husband, Tony Young, told her, “I liken this article (meaning the People article) to writing about a pedophile that can’t be with the child that they perpetrated a crime against.” If he’s referring to Terri Horman as the pedophile, that statement makes absolutely no sense. Terri and her friends are grieving about her inability to be with her daughter, not about her inability to be with Kyron. No one has ever accused Terri of committing a crime against her daughter. There is no evidence that even suggests such a thing. Could this be a subtle jibe against Kaine? Could Tony have been referring to Kaine as the pedophile, and saying that Kaine whining about not being able to be with Kyron is the equivalent of a pedophile whining about not being able to be with the child he molested? That might make sense given what DeDe Spicher revealed. It might also make sense given that Desiree previously hinted that her husband wanted her to stop holding press conferences with Kaine and that she couldn’t support the decisions he made. Still, it doesn’t make much sense for Tony to characterize the People magazine article as being about Kaine whining either.

  13. Jae Joi says:

Oh, I get it now. After reading my own post, I realized how slow I am on the uptake.
Desiree Young is trying to hint that Terri did something perverse to Kiara. And she’s trying to give her slander an authoritative source–her police officer husband. But she wants to do this in such a way that she can’t be held liable for defaming Terri, so she doesn’t name her. And she also wants to avoid being held liable by Tony, because he probably never said anything like this. So she is being deliberately vague as to who the pedophile is.
I remember how Desiree said that “they’ve” been very careful to say things in ways that didn’t make them vulnerable to lawsuits. This appears to be an example of defamation-avoidance. Her practice of couching statements in question form (both in her post on gofundme and in her whole “Where’s Kyron, Terri?” campaign) is another example. If Desiree believes in the truth of her statements, why is she worried?

I am now a permanent fan of People Magazine. They managed to get past the BS and incomplete/inaccurate information spouted by the hater crater groups. As a national magazine they are able to thwart the get TH campaign led by DY and KR.

DY sure seems to be unhappy when someone tells the truth about the case and not her clouded view of the facts.

So its OK by her to stretch the truth when vilifying Th and Dede which I have seen her do on Facebook on more then one occasion. But DY is offended by any unbiased media article which presents any story but the one she tells.

And how does any of this go to finding Kyron.

I also think that DY is learning use words to inflame. When she says “I liken this article to writing about a pedophile that can’t be with the child ” she is just throwing in those word to create in impression of evil to the reader ( being a pedophile does not have anything to do with TH). IMO very manipulative on DY’s part.

I don’t even understand the statement. I have had the unfortunate task of studying pedophilic motivations in crime for almost 3 years directly under the FBI protocol and I do not get the reference of comparison at all.

Has anyone else come across aforementioned issue? I have not found any references to it online which would seem odd.

    The WW way.

  17. Rose says:

imo Based on recent online writings (ie “devil” appellation”) , and activities at her home, a criminal attorney needs to file for an RO on TH’s behalf against the Roseburg Supports leader & OR resident leadership. Contact with Kiara & Moultons shoukd also be barred. In DY’s case, that should include barring access to any sort of gun in her home (Keep weaponry at the office Tony.) Someone who has been suicidal can be homicidal, as can a rage-filled personality disorder. There’s more than one of the latter amongst the stalkers imo.

This has been my concern for a long time, as you know. I re-read the post from GFM. There are several forensic linguistic cues I am not going to highlight because I can’t verify who wrote it “officially” and I won’t be interviewing her to contrast the differences in verbal v written expressions.

If she feels there are factual errors in an article that indirectly or directly is the product of her missing child, why not contact the editor and/or the contact and request correction and retraction? Why would one respond on a site asking for donations?

I can also tell you that I am familiar with some of the editors and writers at People. I would be very shocked that if she had contributed interviews, which as you know would be subject to quotation, and in constant contact with an editor or researcher how did she not get an advance copy and found out about it from friends once on the shelf?

That is just not how it is done- as she tells it.

When I was on the GJ down here, a murder case was brought before us and we, as the GJ, issued nothing, no true bill, no not a true bill. (Our stint was IIRC, for two months, sometimes twice a week.) While we went on to hear many other cases, the murder case was simply not brought to us again with any more evidence, this was after listening to days and days of evidence as well as us requesting more information. We were simply informed by the DA at the time that we may be called back to revisit this case, but they were done with us/it for now. We never were called back. I don’t know if the case was at some later time presented to another new GJ, or whether it is still out there in limbo as an unsolved crime. Anywho, it is obvious to me now, that we were being used as an investigative GJ, DA testing the waters so to speak, and at the time never intended for us to reach a decision and issue a bill.

    Hope this helps.

I appreciate the comments Rose. It doesn’t matter in the long run. You and the vast majority of posters here are, without fail, respectful and though I don’t always agree I always read everyone’s posts with interest.

I do see an investigation that, barring really good evidence against Terri, could potentially be highly flawed to put in mildly. I am thankful for the information provided to support that and look forward to my dad’s view on it should he have the time to check it out.

  22. Amys Sister says:

Wow @ Desiree. If she is going to accuse Terri of all those lies she should give examples or it looks like a lot of hot air. There is a duty when making public accusations to furnish reasoning and after accusing Terri all these years with only a few examples her position is weakened to where even her supporters are likely moving away from the story she wants everyone to believe, whether true or not.

She obviously thought People was going to portray the story much differently than they did and she is angry and lashing out. Can she not see that the general public isn’t going to remain sympathetic for countless years without evidence, a good argument, or an arrest?

I read the People magazine and didn’t think there was anything wrong with it. Why shouldn’t Terri’s position also be reported on? I hope that the air can clear a bit with this investigation and with the bios so Kyron can be found.

Desiree might benefit from a week alone at the beach to get clear and refocus.

  23. Amys Sister says:

Completely unfair to publicly use the term ‘pedophile’ and ‘Terri’ in the same statement unless there is evidence to support a connection. This is developing into a civil case that Terri could eventually win which is tragic if she really is responsible for harming Kyron.

Desiree is going off the rails in a big way. I hope LE or someone reels her in before she hurts herself (not physically but with repercussions) and this case.

I read the piece. Her depiction of it is entirely “off” and in many instances, simply untrue.

I bought a people mag to read the story. It is a short article that talks about the investigation going on for 3 1/2 years with no charges being filed against T, DY’s stalking behaviors and a neighbors comment about how the other neighbors do not appreciate the chalk and stalkers. The fact that T has never been charged in the MFH is also mentioned along with some comments about how T is trapped in her parents home separated from Kiara and mostly watches TV all day.

I did not read anything about DY that sounded like any kind of of insult. I think they interviewed DY over the phone fact checked what she was saying and found her version of events to not be exactly true. So not wanting to print mistruths or pick out only things DY said that they could verify they left her input out of the article. Which was probably a good idea. Thank goodness for a media reporter that could not be manipulated by DY and the hater crater.

They also had a nice picture of T with Kaine Kyron and Kiara.

At first I thought DY didn’t mention Tony by name because TY was still out of the picture … as she wanted to keep it vague. But if Tony is around still, perhaps a “slander” issue is being protected.

I think, however, that if you take the sentence literally People Magazine’s ARTICLE = writing about a pediphile. Very strange for a major Medford Detective to say this. Either DY is misquoting or, as in other instances is trying to tie the article to a cover-up of an accused pediphile to re-access the victim. She puts it in quotes, too, as if it is verbatim….. just brings more mis-conceptions than eloquence.

BLINK….could you answer a couple questions, please? Why did they not call this a kidnapping from the get go on Friday evening…let alone a week later when “endangered/missing” gave lesser importance.? We know, now, that LE knew, as did KH, DY, and TMH…that a man took Kyron out of the room after 9am. We know that he was near a truck outside. Now, i’m thinking about the presser of August 11, 2010. Could it be that the “witness” or “witnesses” they sought from the public was really LE’s veiled attempt to find the real Perp? Not a witness at all? And no known connection to TMH?

Epic fail, if that was the case.

    1. I don’t know exactly when they learned about witness accounts as to SZ.
    2. To my knowledge, there is no evidence or eyewitness as to Kyron leaving the grounds to make the allegation it was an abduction.
    3. Imo, they were operating under the assumption that Ky left with TMH- his parent and primary caregiver so that would not qualify as an abduction either.

True: Just because you waive your rights and agree to be questioned doesn’t mean you must answer all questions. At any time you may change your mind and choose to remain silent. In that case, the police must stop questioning you.

Likewise, if at first you talk to police without an attorney and then change your mind, police must stop questioning you until your attorney arrives. Once she arrives, you have to be given the chance to talk with her before questioning begins.

Also, under a 2010 US Supreme Court case, police may begin questioning a suspect again 14 days after the first interrogation ends, even if he asserted his rights to remain silent and to have an attorney present for the first interrogation.

False: If you say nothing at all after being Mirandized, police can’t question you because you’ve asserted your right to remain silent.
True: In 2010, the US Supreme Court ruled that a criminal defendant must clearly and unambiguously assert his right to remain silent. Saying nothing for hours while police question you may not be enough. If you say something damaging it may be used against you.

Okay, I read the article. No big deal. No interview with TMH. Nothing new from LE. No nothin’. Some comments from friends and neighbors, that’s it. IMO, after reading it, it makes Desiree’s letter and quoted comment from her husband even more weird.

It was written by an Elaine Aradillas who writes that before the summer of 2010, Terri was a soccer mom who tucked little heart notes into Kyron’s lunches. Where did she get that information from, if Terri would not comment, which she states? (Is she the same reporter who sat down in their kitchen years ago, when KH wouldn’t let Terri be interviewed?) (I’ve forgotten who that was.)

For cryin’ out loud, KH himself said that *before this* Terri was all about the children. So, what’s new and why did this article pizz off Desiree and her husband so much that they lost sleep over it?

I guess my biggest question is, why was this article written in the first place? Who on the national level decided this was news? Or….is it possible that this article was written to ferret out some sort of response from someone else? I don’t get it, no news here, but if my child was missing, I’d just be happy my missing child’s face was put out there nationally once again.

As did I. I would say for Elaine’s level – the amount of un-named sources called “friends” or other, is a lot for her, but there was nothing inflammatory- in fact she stated that “LE believes that TMH was the last person to be with Ky, so technically that may be true.

With much respect, not putting words in your mouth, but I am also more confused after reading it as to her response. The Pedo remark is quasi-actionable, imo. Maybe that was the intention.

Digging a little deeper I found the following January 8, 2014 comment. I think this statement relates to the Moulton’s reaction to the recent chalker/stalker incident, ie. calling police and subsequently posting a no trespassing sign on their property.

Desiree Davidson Young I love it…their true feelings about what they will not do for Kyron. You’re are right…perfect strangers have done more for Kyron than they will ever. They don’t even want to be inconvenienced with the people looking for Kyron and looking for answers. Terri you are welcome to come stand on my property anytime you want. Let’s have a chat!

    Elaine Aradillas
    Age: 34
Place of residence: Los Angeles (locally, Hillsboro)

Every major national and local news outlet has dumped resources into the Kyron story—The Oregonian has seven reporters working the Kyron beat. But some of the best reporting has come from Elaine Aradillas, a 2004 Columbia Journalism School grad working for People magazine. Aradillas quoted Terri’s dad June 28 saying publicly for the first time that his daughter was at the center of the criminal investigation. Aradillas was the first reporter given access inside the Horman house, interviewing Kaine at his kitchen table. There were several aspects to Aradillas’ approach that set her apart. Instead of staying in downtown Portland hotels with other reporters, she bunked for a month in Hillsboro to be closer to places the Hormans worked, exercised and socialized in Washington County.

    ***********
Answered my own question, re the reporter.
So she may have gotten the little note information from Mr. Horman.

Think I’ll go back and read the other articles she wrote again.

@sam h- very interesting. I see David Gill is related to a Deborah Gill. Is this the same Deborah Gill who is on the science fair list? (sorry I’m way behind in reading and am just catching up :) )

With much respect, not putting words in your mouth, but I am also more confused after reading it as to her response. The Pedo remark is quasi-actionable, imo. Maybe that was the intention.

    ————————

Do you mean DY might be thinking she could bait TH to file a suit against her and that TH would have to speak and be questioned to do so? (I can see that “logic” would fit with other actions.)

yes, possibly. I think she learned that from her own withdrawn action.

Not really relevant to the present discussion, but the “family portrait” struck me this time. No James? Kaine, Terri, Kyron and infant Kiara. But no James. Strange for a family portrait, isn’t it, to leave another child in the household out of the photo?

    https://www.facebook.com/photo.php?fbid=717575051608252&set=a.601068579925567.1073741825.194353597263736&type=1&permPage=1

I had not noticed this before, although I’d seen the photo. Reminds me there is value in looking at old info with fresh eyes.

  35. Rose says:

wrt the gofundmekyron article’s in part intent to bait a tort suit based on the metaphor TH is a pedophile & therefore estranged from daughter deservedly. I do not, in my opinion, see DY as either that planful or intelligent. And, that online pedophile slur would not rise to a tort claim imo.

What TH needs judicially against DY and Associates is an RO. Why?
psychotic label like “devil.” Stating (repeatedly) a feeling of distress that
TH is walking around participating in activities of daily living while K cannot,
    attributing that vengefully to TH.

    Can anyone summarize “People”?
    Having failed at the Grocery,
I’m not into a Library effort.

In my lay opinion, the “17 • January 8 at 5:23pm” DDY comment you posted
is a product of an unfortunate unrealistic fixation on Moultons and TH both.

  37. T. Ruth says:

Kaine has taken custody of the couple’s 18-month-old daughter Kiara and moved out of the house they shared in Skyline Ridge, a home they opened up to a PEOPLE reporter just days before the divorce filing. Even then, the tension between Kaine and Terri was clear. On the day of the interview in their home-where a 3-in. stack of Kyron flyers sits on a kitchen table and boxes of green rubber bracelets etched with the tip-line number rest on the floor-Terri drove off with Kiara as Kaine sat down to talk. When she returned 90 minutes later, she and Kaine barely spoke before she went off to another part of the house while Kaine gave a tour of Kyron’s bedroom.

    http://www.people.com/people/archive/article/0,,20399962,00.html

Was there a report done by Elaine for People “just days before the divorce filing”? Divorce filing was what, the 26th or 27th of June? So something around the 23 or 24th of June? Still looking.

  38. Miss Bri says:

Georgia Dad bringing up Desiree’s comment that Kyron was seen by a white truck and “he saw it all” gave me a thought. That comment never made sense to me, like, what would Kyron have witnessed and how would that relate to his abduction? So, what if she wasn’t referring to Kyron as having seen “it all”, and was referring to a witness to the abduction who saw it all. I wish the reporter had asked some (even one, for gods sake) follow-up questions to clarify.

Yes, that’s where I found it Quiz, thanks. (Don’t like going there.) I did notice as did you, that the site firstly seemed to welcome the article until the DY letter. Never had seen that other comment from Desiree though, so thanks again.

    *******

Is it normally okay with a media outlet such as People Magazine to have their copy photoed publicly and posted on the internet without so much as a link? Just askin’. When I was looking around, DY’s letter is also posted (perhaps, firstly) on the MKH page, and there are over 300 comments by people who say things like, *I will never buy People Magazine again*.

What magazine puts itself out on a potential limb to report non-news? This is all very weird. I keep wondering if the media actually knows more than they are telling.

  41. T. Ruth says:

‘Though separated before Kyron’s birth, Kaine and Desiree are a united front when it comes to finding their son. For a while the core team numbered four: Kyron’s biological parents, as well as Desiree’s husband, Tony, a policeman, and Kaine’s wife, Terri. “The bond between all of us has strengthened,” Young explained. But a June 28 statement released by Kyron’s family was signed only “Desiree, Tony and Kaine.” Then came the divorce filing and Kaine’s departure from his home (he and Kiara are staying in an undisclosed location). Terri told a friend that she was called to speak to investigators; when she came back home, Kaine and their daughter Kiara were already gone. “She didn’t understand it,” says the friend. “They’ve taken the last thing she has left that’s important.” ‘

    http://www.people.com/people/article/0,,20399962,00.html

Okay, I don’t know which “Young” they are referring to that makes this statement, but it sounds like it was DY:

“The bond between all of us has strengthened,” Young explained.

    So what happened?

Crap, maybe it’s just freakin’ lousy reporting in this case, but this report says Terri came home and Kaine & Kaira were gone, but…….in the email that was referenced (I think by KATU, not gonna’ go looking again) Terri clearly says you were mad at me when you left.

Was she there when he left the house or wasn’t she? Pretty darn simple to say one way or the other. Does anyone remember if Kaine Horman was ever asked this question? I don’t recall it.

I read the People article and after reading DY’s rant on gofundme where she talks about her multiple phone interviews with the People reporter that her anger is more about what was NOT included in the People magazine then what information was in the piece.

Considering DY’s comment about what she had in store for T I think she expected the People story to include a lot of her accusations against T as well as her speculations on what happened to Kyron.

  44. RedRose says:

How would anybody know if Kyron had seen anything?
Isn’t it true that nobody knew what happened to Kyron? (except SZ)
How would anybody have the knowledge that Kyron “saw it all”.

I feel kind of bad for DY acting out so painfully in her grief over her lost son, but she should be directing ALL of her anger toward KH who is the REAL creep in this whole situation. Regardless of whether or not TMH was trolling for a husband at the time.

O/T – Heya Blink! Not sure if you were joking about Richard Sherman & karma – I agree with being a good sport and not being obnoxious on the field, but I feel like what he does off the field is so important, and wanted to add this quick little list b/c the causes deserve attention (as do the causes on this site, obviously!).

He’s a huge supporter of our troops and organized a giant benefit to help build a home for an injured soldier through Helping a Hero.

His foundation, called ‘Blanket Coverage’, provides school supplies & clothes for kids at Schools and Community Centers. They also recently donated socks, blankets, shoes, board games, and books to 160 homeless families at a rescue shelter.

In Oct., he spoke at a High School in WA to about bullying and the importance of education (he graduated with a 4.2 GPA!) and then surprised them with school supplies and he bought the football team new cleats.

Ok, sorry for the O/T post hahaha, I can see how his boasting can seem annoying, but I just love what he does behind the scenes.

O/T: He is by far the best cornerback in the NFL and his backstory is a true triumph. As a little girl my Poppa always used to remind me after a success or anything that made him proud of me that a person’s integrity and humility are the only things that live on when you don’t. Just my personal opinion that God’s gifts come with certain obligations for legacy. I think he gets that, indeed.

i never saw that but i bet it is. carrie and david james had a child and i think he was actually interviewed in the case. other posters would know who’s who in the gill family. if i remember right there was some similar names like david james and david something else his dad so i dont want to guess and get it wrong but it seems that you maybe found grandma who would likely go see the science fair. i never noticed her on the sci fair list before, thanks for pointing it out

  48. NelMel says:

I read the People article. I read DY’s reaction. IMO:

    1. DY is stunned that an article published ANYWHERE is not a routine recital of only her version of the case.

    2. Resorting to using the word “pedophile” via claiming “my husband” used that word in an analogy is dangerous for the Young’s, not because TMH might sue them, but because it suggests what their real beliefs are, as a couple, concerning this case. LE, I feel, specifically MCSO, is not on that page concerning showing their cards. Making such a statement this late in the game — years after Kyron. Is abducted — strikes me as proof that DY is now off the tracks 100% and that TMH and the Moultin’s need protection.

    3. The People story was bland filler and I have read the magazine enough to say with confidence that such update stories

    Agreed on both.
    B

  49. NelMel says:

(Edit to continue…hit send too soon)

…such update stories are utterly routine and not meant for controversy.

    4. However…the way the hater craters have reacted, DY is being fed a now daily dose of pure rage.

LE is not seeing this turning into Vigilanteville?

  50. Rose says:

It makes sense “he” would be a witness.
The question is if “he” saw Kyron by a generic white truck
with a man, or if “he” saw Terri present in her own
truck at the moment SZ delivered Kyron to her.
DY did not sound as if Terri herself were seen, or she’d blurt
    that out imo.
