Casey/Caylee Anthony Case: Baez Ex Parte Motion Denied

Orlando, Fl- Judge Stan Strickland denied the ex parte motion brought byJose Baez, lead defense attorney for tot mom Casey Anthony.

Baez claimed through the motion,  they did not want to tip off the prosecution as to their defense strategy and his team would not be able to secure the records that will lead to admissable evidence, through normal discovery, under Florida law.

In essence, what Baez is really saying:

..”Judge Strickland, when we look through the keyhole with the squint of our right eye, we kinda -sorta think we see the outline of something. We would very much appreciate it if you could unlock the door for us, close it behind you and we will lock up when we leave…”

Although the motion indicates a good faith basis warrants the ex parte request in the first place, it is noticably absent of one. Baez does  not cite any case law supporting his unusual request; although he is a subscriber and former employee of LexisNexus. Judge Strickland schools Mr. Baez that there is no such provision for exparte under the Florida criminal code and the in camera request applies only to deposing a Category B witness.

    By let down, I would like the smoking gun, the one piece of evidence to put Casey away & put an end to this 3 ring circus, that’s all. Fingerprints, some type of solid proof, better than circumstantial. It has nothing to do with ratings. I see I’m misunderstood here, I’ll just watch the news & keep my opinions to myself.

    I know they are doing their best, detectives, FBI have enough to convict with the trunk, 31 days, ect. But it would have been great if her fingerprints would have been on the duct tape. I’m sure the detectives want it a lot worse than myself or public do. Evidence isn’t being released for my entertainment, it’s a child’s murder case. I just get frustrated with the defense’s constant finger pointing, intentional distractions. I’d like to fast forward the trial to the point where they put the baby killer away forever. Now I’m done.

    Interesting find when I googled DC today looking for the FL Bar complaint reports. Looks like after Baez and Conway, ol’ Hoover boy is next on the chopping block….

    I was forwarded your/FAPI March 27, 2009 Statement/Press Release. In this Press Release you state that you are refraining from speculation regarding the Caylee Anthony murder case, and the Florida Association of Private Investigators, Inc. (FAPI) “is speaking out”.
    You begin by stating: “The Private Investigators who involved themselves in the Anthony case appear to have acted in violation of the regulatory provisions governing the investigative profession . . .” You further state that in Hoovers Deposition, he testified “ . . . “he performed investigative work for both Agencies and unless D&A was subcontracting work to Class Action, or unless Hoover was an employee (not subcontractor) of Class Action and subsequently D&A, Hoover and both agencies allegedly violated the law”.

    Also you state “ . . . it is a shame to have this type of embarrassing activity on a high-profile tragedy such as the Caylee Anthony case . . .” Then you abruptly state “The credibility of the private investigator and, indeed, the actual investigation he conducted, may be called into question . . . leading to disastrous results for the client”

    Below I have provided extracts of James Hoovers December 18, 2008 Interview with OCSO and FBI, also extracts of James Hoovers March 25, 2009 Deposition. You will note that James Hoover secretly videotaped the Anthony family while at church and without their knowledge, James Hoover states that he was not working for anybody and he intended making money from the photographs or video.

    In his deposition, James Hoover stated that he did not become involved in the investigation of the case and that he offered the Family help.

I wasn’t the only person that did that, by the way, certainly.

    For your information, D&A Investigations, Inc. have worked this Case since July 2008 and continue to do so under a Retainer Agreement with the Anthony Family. James Hoover is not affiliated, employed nor subcontracted by D&A nor has ever been. Furthermore, he never performed any investigations in connection with this Case for D&A or the Anthony Family. James Hoover “offered” to help the Family with security then engaged in unforgivable acts such as, secretly videotaping the Family and myself in an attempt make money. For the record, your allegations directed toward me and my Agency are false, baseless and have injected uninformed opinion’s to the public arena.

    I just viewed the Video and briefed the comments here…does anyone know what Bozo Baez did for 8 years?? (If it’s here already, I apologize!!). He is such a joke, IMHO!! There are attorneys, and then, there are ATTORNEYS!! he isn’t even the former, IMO…

    From what Hoover said, Mr. Casey asked him to go with him why? Mr. casey told him thing’s why? Sound’s like he needed someone along for the ride! They all new Mr. Hoover was there and used him! Mr. Hoover also said Mr.Casey knew he was video- taping. Mr. Casey make’s his own self look bad because he did not report to the police what he was doing nor did he tell them he was working for the anthony’s! He did not tell police officer’s he was at the crime sean, and no one would have never knew anything if Hoover had not come forward! I say Casey is trying to get his self out of this mess, it’s not happening Mr. Casey!

    I read it & PI DC is a liar, it makes absolutely no sense. Explain what condition PI Dom Casey expected to find a ‘live Caylee’ in if he’d found her on Suburban Dr.? Did he think she’s be running & playing, frolicking by herself in the swampy woods among the garbage bags?

    That’s as ridiculous as PI DC saying the psychic was his tipster. I’m still waiting for one, any of these liars that belong to the Anthony’s inner circle to finally be charged with obstruction, tampering, something & put in jail.

    Is it my imagination or do the Anthony’s get by with more than you or I would? What makes these despicable protectors of a child killer so damn special. Their behavior during ZG’s deposition confirmed what loathsome, nasty, pathological liars these jerks truly are.

    Blink- do you believe there’s any validity to the story from the National Enquirer that soil on Casey’s shoes may match the soil from
    Suburban Dr. where Caylee’s remains were found? After the fingerprints didn’t pan out it’s hard to trust rumors, but NG mentioned it too.
    Gina- I am not aware the fingerprints did not pan out.. That is not my understanding but If there has been a release on that, please link..

    I dont think the soil matching that on her shoes is a bombshell. I would suggest that soil samples from the Anthony home, containing evidence of decomp would be. I am familiar woith 2 Floridian cases that have resulted in convictions without remains because of it.

    OK, about the fingerprints I think it was the document dump right before this last one. I thought FBI forensics concluded there was no latent fingerprints on the duct tape. It excluded Cindy, George & Lee. I don’t think it specified Casey was excluded but I assumed if they were on the tape it would have been released.

    I’m far from an expert on any of this, but hope it’s yet to be discovered that Casey’s prints were on the tape or somewhere incriminating. Is that still possible it just wasn’t yet released?

    You must think I’m a real nerd, sorry for all the questions but I admire that you seem to be a step ahead of other blog sites about the Casey Anthony case.

    I anxiously await your updates, so thanks & Happy Easter. I’ll quit asking questions untiil your next update.

    Gina, it excluded Cindy George and Lee, but did not state that there were no latents. We wil see how reliable my source is, but I have been told there are 2 partials of Casey’s prints on the ductape.

    Wow, that would be a potential bombshell. With the Death Penalty back on the table things are looking up. My faith in the judicial system may be restored yet! Great info, like you said we’ll see but it gives me hope, thanks Blink!

    Here is what I think Baez might have been up to when he wanted to meet in private to discuss his new defense theory. There have been a few clues sprinkled about that he has some surprising explanation for WHY Casey never reported her child missing.
    I predict that he will admit that Casey made up the nanny story. But he will say she only did so to protect her family from [ fill in the blank=Mexican Drug Cartel or whatever they decide to use] because she owed them money/drugs and they took the baby out of revenge. So poor Casey had no choice but to make up something so she could save her family from the evil gangsters.
