Sandra Cantu Case: Charges of Rape and Child Molestation Added for Huckaby

Tracy, CA- The San Joaquin County District Attorney, Robert Himmleblau has announced to the AP that it is considering adding rape and child molestation charges to the criminal indictment against Melissa Huckaby. Huckaby was arrested on suspicion of murder and kidnapping charges in the death of 8 year old Tracy girl, Sandra Cantu. A source inside the investigation has confirmed to Blink on Crime that the public announcement of the additional charges prior to Huckaby’s arraignment tomorrow comes on the heels of her request and retention of an attorney. The specific charges would be considered special circumstances to the murder charge and qualify Melissa Huckaby for capital indictment and therefore eligible for the death penalty in the state of California.
Himmalbrau refused any further comments from reporters regarding the possible updated indictment charges against Huckaby, on the eve of her arraignment scheduled for tomorrow morning in San Joaquin County.

Casey Anthony case: State to seek death penalty, WESH reports

The state has changed its mind and will seek the death penalty in the Casey Anthony case, WESH-Channel 2′s Bob Kealing reported this afternoon.
“Big development,” WESH anchor Jim Payne said.
Kealing, citing a source was in the clerk’s office, said the state’s position was that “sufficient aggravating circumstances now exist” for the death penalty.
Anthony’s defense team has filed a motion to subpoena cell phone records from George, Cindy and Lee Anthony, Kealing also reported. Defense attorney Jose Baez also wants the phone records of meter reader Roy Kronk, who found Caylee’s remains.
WESH’s legal analyst Richard Hornsby, a criminal defense attorney, said the motion signals that Baez’s defense strategy will be to raise reasonable doubt.

I knew their had to be a motivation like this. I never believed that it couldn’t have had some sexual involvement. Now I am wondering if her Daughter needs to be checked out. She has probably had the same thing done to her and that is why she is so sick. The poor girl may not even know it happened if they gave her GHB. This woman had to have exposed herself to Sandra and used a foreign object according to the charges. Disgusting. I am sad that Melissa’s ugly face is the last face poor Sandra saw while she was living. She looks evil and nasty.
This isn’t the act of a church. It’s the act of a person.
I was hoping and praying that maybe at least Sandra had been spared from such disgusting actions. My heart goes out to her family. I got chills just reading the article. I can only imagine what they must be feeling. RIP Little Sandra…at least you’re safe now in Heaven.

Prosecutors said today they may include rape and molestation allegations in their murder charge against the woman suspected of killing an 8-year-old Northern California girl and putting her body in a suitcase.
Melissa Huckaby, 28, was arrested Friday on suspicion of kidnapping and murdering Sandra Cantu.
San Joaquin County Deputy District Attorney Robert Himmelblau told The Associated Press today that a homicide charge against Huckaby could also include the special circumstances of rape with a foreign object, lewd and lascivious conduct with a child and murder in the course of a kidnapping.
A conviction on any of the special circumstances would make Huckaby eligible for the death penalty or life in prison without parole, Himmelblau said. The district attorney has not determined whether his office will seek the death penalty in the case, he said.
Sandra disappeared March 27. She was last seen on surveillance video skipping near her home at the Orchard Estates Mobile Home Park in Tracy. A 10-day search ended April 6, when farmworkers draining a nearby irrigation pond found a suitcase that contained her remains.
Himmelblau wouldn’t provide additional details on any evidence leading prosecutors to consider the sexual assault allegations. Police have not released any details on how, where or why Sandra was killed.
“I was hoping that wasn’t the case,” said Sandra’s aunt, Angie Chavez, regarding the possibility of rape and molestation allegations. “I’m in shock,” she said through tears. The whole thing is unimaginable.”
Formal charges have not yet been filed against Huckaby. A final decision on which special circumstances to include has not been made, Himmelblau said. Huckaby is scheduled to be arraigned Tuesday in Stockton.
Himmelblau was not aware if Huckaby had an attorney.
Himmelblau said prosecutors were considering filing other charges against Huckaby but declined to specify what the additional charges may be.
She remained in custody without bail in San Joaquin County jail today where jail staff have been monitoring her mental health. She’s not been allowed visitors.
Tracy police did not immediately return messages seeking comment. San Joaquin County Sheriff’s Deputy Les Garcia said autopsy results were still pending.
Matthew (FOX40.com): FOX40 News reported about an hour ago that Melissa Huckaby could be tried for molestation and rape in addition to her homicide charges. San Joaquin County Deputy District Attorney Robert Himmelblau said charges against Huckaby could also include charges stemming from “special circumstances of rape with a foreign object, lewd and lacivious conduct with a child and murder in the course of a kidnapping.”

just terrible! Sickening is right. I should not be surprised/shocked by this considering everything that has been floating around. But this story keeps getting more and more twisted each day. I hope they do get them all. Can’t imagine what Sandra’s family is going through.
I wonder if they caught Mellisa driving by the camera about 15 minutes after Sandra walked by it? Her shortest route to the exit was right by that camera.

I know many of you are speculating more than MH was involved. I really don’t think the cops would say no other arrests will be made if this was true.
Cops only make this kind of statement after responsible person has broken down and told them complete story of how it happened and are convinced no one else really was involved. It will come out that she told them everything and closed off any possibilities of the involvement of others.
Blink; some comments on your Huckabee arrest article alluded to appearant sickliness of Malissa’s daughter Madison. Do you know whether that info was through news sources or is it from neighbors? I ask this wondering about other possible child victims.

I would bet Melissa has been suicidal, she has two trips by ambulance. I doubt the bleeding ucler explanation. Perhaps that is what she told her family. Over all, it looks as though this women led two lives.

Another question; I have read that much of the legitimate porn (an oxymoron) industry is located in the valley east of LA. A comment was made in a previous post that implies that Tracy is another center of that industry. Do you know whether this is correct as per “above ground” porn production? Is it a suspected/known center (according to LE) for underground porn production?

I’m wondering about the 60 people with child porn in Tracy that were mentioned earlier….do you all think she was basically trying to make money off of creating sick child porn? They said she had no money and couldn’t keep a job. It’s scary to think she did it before….poor baby girl she was so beautiful and full of life. What an evil person this MH must be….
Well, I didn’t realize Madison was a sickly child. So, the poster was right on the other thread, (MY BAD!!) she could have the M. Proxy disorder. Lots of unpaid hospital bills. I am sure the State is investigating the safety of her daughter, Madison. I get the literal creeps when I look at Melissa’s picture. Ugh.
I bet when it’s all said and done they’ll find out that Melissa has Multiple Personality Syndrome. Listening to the police say how she first was calm, then agitated, then calm, then reserved when being questioned…I heard a similar story tonight on Nancy Grace. Also, not holding a job, stealing, etc. If it’s not a sex crime ring then that’s my guess.

Not that I am for pinning everyone else’s crime on one person, but maybe people will start realizing how many child molesters are really women. There are about as many women as there are men molesting children! Stand up people! make the rules apply to eveyone equally! Why are they only CONSIDERING adding these charges against her?!? Madison was not only sickly, but also supposedly isolated by MH — not allowed to leave home to play, etc. This is typically how abused children are treated: kept away from social settings where they might be apt to share private family details. On the other hand, it can also be the response of a fearful, protective mother who knows first hand that real and unspeakable danger/evil is very, very close to their doorstep.
In the article Annal’s is referring to, it says she lives with her grandparents because she “suffers from severe allergies and needed help with her daughter”. She must be allergic to having a job, because (speaking as a person suffering from severe allergies myself and handling my family of 5 sufficiently) that is the only thing that I could imagine would give her an excuse to be such a lowlife.
It also states that she wouldn’t allow her daughter to go out and play, but insisted all her friends come to her house. The neighbor’s found that a little odd. YA THINK???

Blink, I have been looking over this site and scared monkeys site.I just wanted you to know I was reading the rumors about the church having a basement.I hate rumors in a situation like this.I live in N.C.and have no Idea of things going on in Tracy CA.just what I see on TV and these sites.How can there be a basement and a crawl space?
There is a definate basement. I believe the crawlspace refers to under the foundation, like a porch if you will.

Most buildings in Tracy, Ca do not have a basement. A crawl space is only present if the building is on a raised foundation and most buildings here are cement slab, so no basement or crawl space.

In California, there are two basic types of foundations (in the past 80 years). Slab on grade (concrete on dirt), and crawl space. There are other variants, but these are the most common. With a slab on grade foundation, it is unlikely that a property would have a basement. Most homes built in the San Joaquin Valley in the past 20 years are slab on grade, but older residential, churches, and commercial typically have crawl spaces. A crawl space means that there is a space between the dirt and the floor. It is usually referred to when the foundation is supported by a concrete perimeter. Sometimes these properties have basements. Not typical in newer, but not uncommon in older. Very common in pre-depression era properties.
Whoops, hit enter too soon. In summary, it would be unusual to have a property with a slab on grade foundation and a basement. It is not unusual to have an older property with a crawl space and basement. Many older properties in Tracy have basements. Also, crawl space is a term used to indicate that there is enough space between the floor and the dirt for a person to crawl (eg. in order to service plumbing).

yes, women are also sexual preditors on children. When I lived in Tampa, there was an old lady in the news how had been abducting young girls for oral sex (nasty, I know). One of my aquaintences was an FBI officer who worked in INternet crimes against children and showed me a picture of this woman and told me the officers had nicknamed her the “Sea Hag” as she prowled the beach for these little girls while they played just out of sight of their vacationing families.
I feel it is possible MH stashed little Sandra’s body under the church in that crawlspace for a time until she was able to dump her in that retention pond. Would explain why the dogs hit there in the church yard….also sort of emulates Casey Anthony in that both probably hid the body while waiting for the “perfect” time to get rid of the evidence! (JMO)
Oh…and by the way…I realize Sandra could only have been placed in the crawlspace (if indeed she was) a short period of time with the police and media there after 8pm. Probably only placed there long enough for MH to retrive the soon to be declared “stolen” luggage from her own home, or car, and disgard it with Sandra’s remains soon thereafter.
Blink, just watched last nights FOX40 news and found it interesting Tracy LE are stating that MH is the only suspect and no other arrests are expected. But immediately following during the news briefing with DA Himelblau “he would not comment on whether MH acted alone”.
I believe they are distinguishing between what they can prove in the actual kidnapping/murder charge, and well, what is to come. I have spent 3 days calling and emailing every resource and checking every database I have access to. I could NOT come up with a single case of this kind, where a male is not involved in some capacity without being graphic.

There’s never been any video of Huckaby, just of the little girl skipping along. Did she shoot a video of herself with the little girl???? I think this is sounding more and more like a kiddie porn ring.

Blink, I just read something about a text message from MH to Sandra’s mother. This is the first I’ve heard about it, but it wasn’t necessarily a credible source. Can you confirm or deny anything about it?

As far as the daughter he saw on film comment, I think its the footage taken while she was being interrogated, where she presumably admitted to all this. That is usually released to the public(at least where I live).
The Lawless family has said how shocked they were, blah, blah, blah. I think LE allowed the family to see some of the footage before they released it to the public to buffer some of the shock we will all feel once we see and hear all the details.
DA had “no comment” to all further questions as they limited it to their prepared stmt so I wouldn’t place too much weight on no comment to whether she acted alone.
I know I differ from Blink on this, who I acknowledge has more access and contacts, but I just don’t think the cops would say no other suspects or other arrests will be made unless they knew the full story of what happened and were convinced b/c of what MH told them, that no one else was involved.
Maybe she was part of the sex ring but just acted alone with regard to Sandra?
speaking of buffering, I know others have questioned why DA is saying it is “likely” she will be charged with the sex acts. I think they were just preparing us for what the formal charges are going to be today. Agreed, the DA announced this yesterday as he is seeking a gag order following or during the arraignment today. The equivalent of cracking your sister in the back of the head and then having her chase you. But I think the sister in this case is a dude with a law degree. And I think his name starts with T.

Im thinking Momma Lawless knows more, and that is why Madison and Miss Judy are in Bellflower, away from all this. Has been since 3/28, the day after Sandra went missing. Anyone notice how Lane Lawless skulks in the back, and walked seperately from Connie yesterday. I have seen him speak before, so we know it’s not an infirmity of some kind.
Lastly, I have conducted an experiment. A Blinkerment if you will, Without being specific, I think Huckaby had help putting the suitcase into that pond. More on that later.
