Caylee/Casey Anthony Case: Baez Blasts Team Padilla

Orlando, Fl– Late last week the latest motions in the defense of Tot mom Casey Anthony for allegedly murdering her 34 month old daughter Caylee were filed. Talk about your average ingrate. The very team Jose Baez called on for help to bail out his client is the latest target in Baez defense teams attempt to restart the bilge pump in Casey’s sinking ship.

Baez latest attempt to un-ring the Padilla bell may as well have arrived at the clerks office on a cocktail napkin; it will be taken exactly that seriously.

There is no expectation of privilege where there is no attorney/client relationship in Florida. The question is, did Jose Baez sufficiently disclose that information to his client, Casey Anthony? Is this motion really designed to stave off the current Florida Bar complaints under investigative review?

BaezPadilla82908

Sources inside the investigation have confirmed to blinkoncrime.com that Baez is attempting to head the testimony of Padilla et al “off at the pass” for multiple reasons. It is expected that the backyard babblings of Casey Anthony to Tracy Mclaughlin will corroborate some of the evidence at the scene where Caylee Anthony’s remains were found. That’s not all. Baez is indirectly looking to block Leonard, Tracy, Rob and Tony from the civil case against his Client filed by Zenaida Gonzalez by blocking them from allowing their testimony as witnesses for the state in the criminal trial.

So What Would They Say?

Leonard Padilla, and occasionally Rob Dick have appeared on camera and spoken publicly about this case for the better part of a year.

Tony Padilla agreed to appear once on Nancy Grace to clear up some inconsistencies about the Surety process at the request of his surety firm early on, but prefers not to speak about the case publicly. Tracy has never given an interview publicly, but all of them have given statements to the FBI. What possible grounds will he claim to assert privilege when they did not work for Baez, nor did Baez ever pay any of them for anything?

None, because there aren’t any.

As far as revelations in their testimony, don’t expect any bombshells that have not been floating about already with the possibility of an exception or 50. They are:

Casey openly admitted to Rob Dick that she was forced to be following a script. He is also expected to provide some insight as to what Casey was doing in Baez’s office for 7 hours a day under the auspice of preparing for her defense.

The defense team revealed openly they would be pointing the finger at Jesse Grund. They are in possession of a first birthday card Jesse wrote to Caylee that they plan to use as the foundation of such an allegation.

Casey made Tony Padilla dinner the evening he got there to post her bond in George and Cindy’s presence in the Anthony home. He found her demeanor to be completely inconsistent with that of a mother whose child was missing, and she never once mentioned Caylee. Outside of Casey’s presence Tony asked Cindy who Caylees’ father was. Cindy presented him an article from the May 7, 2007 fatal crash that claimed the life of Jesus Ortiz. Tony initiated meeting Casey because one of his concerns when posting bond for her, was that she might commit suicide. Following that meeting, he felt confident there was a zero percent chance that was a possibility.

Remember this line, you will hear it again, “When are you going to stop acting like a cop and start acting like a Dad!!!”.

George Anthony purchased the handgun minutes following the rumor that Casey was about to be arrested on the economic charges and her bond would be revoked. Baez told the Anthonys’ that he alerted the OCSO that if that were the case, he would agree to turn her in, and they were under the impression they would agree to that arrangement.

What Baez did not know, is that OCSO was aware of the building potential for violence between George and Casey in the Anthony home and there was a genuine concern for Tracy’s safety on behalf of Team Padilla in the Anthony home. George Anthonys’ friend from Trumball County Ohio, we will call him Trumball Jim, told George everything he needed to know about Caylee’s whereabouts was in her room down the hall, (indicating Casey in her bedroom). George had it out with Casey demanding she tell him what she knew, and Jim had to pull George and Casey apart. Tim Miller, founder of Texas Equusearch, arrived shortly thereafter and was met at the door by Jim, with that episode being recounted to him as the first interface he had with anyone in the Anthony camp in that home.

This prompted Leonard’s comments on Nancy Grace that they could revoke her bond for any reason at any time and they were considering it. The photo on the front page of this article comes from the press conference following the meeting between Leonard and Baez that ensued after Baez had previously refused to discuss the issue with Leonard until he threatened to pull out.

Casey Anthony was scheduled to be interviewed by ABC at the Anthony home the day after she was rearrested and her bond was revoked. This was the reason that the Padillas received countless calls from Cindy and Lee begging Tony Padilla not to revoke her bond. Had they not, she could have been released within the hour as Baez stated at the time.

Lastly, the agreement Baez presented in his motion is not the only agreement between the parties in this motion. There is at least one more variation in which Tony Padilla requested language changes specifically that he did not include in the motion.

Thank you Blink, for another excellent article. Thing that make you go hmmmm. So, Trumbull Jim was witness to the interchange with George and Casey. Why has he not been put on the witness list?

Great, as always, Blink, but I think you need to change the name in some of the places? I think Tony is a non relative of Lenny that is a LE there in Orlando

    ak-
Not sure what your talking about. Tony Padilla is Leonard’s nephew and the Bail Bondsmen that posted Casey’s bond. I am quite sure he is Leonard’s nephew. I know them both well.

Whoa! Did not know that George had purchased a gun. I had heard that he confronted Casey, but Cindy told him she’d take care of it. I guess thats what he meant, when on one of the early morning shows, he said that he did not get a chance to talk to Casey as much as he would have liked to. I think he really believes that Casey did it, but I wonder what Cindy could have over him that would change him so much. Cindy is such a good liar and he’s terrible at it. This must be eating him up alive. I wonder how he can explain his about face to Tunbull Jim. Again, I wonder why Jim is not on the witness list.

  15. skeptic says:

Thank you Blink. No surprises but nice to have it detailed. I read the agreement between Baez and Padilla and I don’t see how baez CAN BELIEVE that confidentiality exists between him and Padilla – particularly when it states clearly that Padilla is not being paid or worknig for Bqez.

I always assumed geo got himself a gun for protection from the vigilantes that were harassing them at Hopespring. Do folks think he got it in order to do harm to kc or one of the Padillas (Padillae? lol), or was there just a palpable fear that since he had gotten the gun, he might just lose his temper and use it? Hey does anyone else think that silverspnr’s accessments of this case is the reason baez is squirming and has been filing these motions all week?

  21. Norm says:

So they are going to be bringing down the hammer on poor Jesse, who has shown more emotion and heartache at the loss of Caylee than her own mother. Amazing!! didn’t he pass a lie detector test as well! Didn’t he fully sooperate with L.E. and F.B.I? what is the significants of this Birthday card that the defense has? just one more very big question…During that 31 days when did Jesse have Casey’s car!?!?! why would casey ask for a shovel from her neighbor while having the trunk of her car backed up into the garage…why would casey lie to investigators in her first interview and tell them Zenaida did it instead of Jesse? Why lie period of she knew who did it the whole script thing yup i forgot Jesse was Zenaida!!!

  22. boz says:

For the record, the Scamathony’s have named four young men as the father of little Caylee. 1) Jesus Ortiz, died 5/8/2007 in a car accident. 2) Brandon Roghelic, died in a car accident 2/15/2005. 3) Eric James Baker, died 8/11/2007. Also Jesse Grund who didn’t meet KC until she was months pregnant. Blink, I have posted before this case is so overwhelming easy to prove, why are they going to trial? How can we, as average citizens, be sure the defense is not capable of tampering with a juror?

  23. mdg says:

I’m having trouble with Baez thinking that setting Jesse Grund up as the bad guy is gonna work. Jesse and his dad have managed to come off as some of the really decent people in this whole mess, which is more than I can say for damn near anyone else. What in the name of heaven written on a birthday card would make Jesse look like the guilty party ?” Hey baby girl, I’ve got some duct tape, trash bags and a heart sticker just for you!”??
I just don’t buy it. I can’t imagine that anyone would.

  25. Steadychick says:

Does any privilege really exist between Dominic Casey and Baez, since it appears that Baez never paid him?
    It may.
His contracts have not been made public. His licensure on it’s own may bind him, however, it will never extend beyond the boundaries of criminal law.
    B

  26. Steadychick says:

“Casey openly admitted to Rob Dick that she was forced to be following a script.” If she was truly following some sort of script, this sounds like Cindy’s involvement to me. Cindy is the one who tells those around her what to say and what not to say. Remember during the jail visit when Casey told her mom not to worry, that she hadn’t said anything.

  27. suz says:

    A friend wrote:

That must have been one hell of a card. What did it say? “Happy Birthday, Caylee, I plan to kill you and stash you in Casey’s car for a few days and then triple bag you LIKE YOU’RE TRASH and toss you into a patch of weeds where Casey used to bury her pets! Many Happy Returns! Love, Jesse………”

  28. nickel says:

Any further details you can give as to what is in the birthday card from Jesse?? Would like to know how the defense can (or wants to) “spin” the words written in a first birthday card to Caylee??
As far as Tracy being in harms way at the Anthony home, was this due to a member inside the Anthony household or the angry public outside the Anthony home??
Was George protecting his family with that gun or possibly thinking of commiting his own crime (against Casey)?? Two wrongs making a right so to speak??…

  29. Gypsy DD says:

So I remember George purchased the gun. I also remember it being removed from the trunk of his car by OCSO. I thought he might have bought it to protect his family against the poster wavers in the front yard…….baaaaaaaaaaaah! But it appears he bought to either persuade Casey to speak the truth and/or for protection from his darling Mother of the Year…once they found out from Amy that Casey was going to be taking over the house upon their divorce..and George’s stroke. Can’t say I blame George..no way I would have been in that house with the Crazy Family without a gun and a wire. But that also means George knew that Casey had murdered Caylee, was capable of murder again and feared for his and the rest of the family’s safety.

    Great work Blink.

  30. Kleat says:

Joan, George, ex-cop, ex-USED car salesman, one has to wonder if he really does know how to sit back and create an impression that he can’t lie very well, because he’s so obvious when he does– at least when he wants us to know about it. I think he lays low, and does know how to ‘sell used cars’– with a straight face to people who may be trusting.

Padilla was on the witness list– besides, remember the defense made a big fuss with the state’s witness list, after just copying the whole state’s list and sort of saying ‘ditto’ to it. The state made the point that the witness list will change anyway. Suppose the witness list is not set in stone quite yet.

  32. Kleat says:

So do we take it, that ABC would have interviewed Casey and then what would Baez have done? How would he erase that from public memory? Did Larry Garrison arrange this, and how much was he ‘watching his pockets’ for that time? Cindy must have felt so powerful with all of the media at her beck and cellphone call. She had several in her address book on the phone, probably some on speed dial!!

  33. Kleat says:

Blink mentions Tim Miller coming to the home. This short clip is Tim Miller’s own comments on Casey’s demeanor in the home as he personally observed during his four days– note how many times Tim Miller heard Casey mention the word ‘CAYLEE’. (Baez is going after Tim too, with whatever he can use from JW and Cindy creations, to ‘try’ to discredit and implicate, which will NEVER HAPPEN, but I fear they can do as much irreparable emotional harm to the innocent as they please).

    http://vids.myspace.com/index.cfm?fuseaction=vids.individual&videoid=48245810

  34. Kleat says:

Just Me, how much would ABC have paid? Well, we know that Larry Garrison, who was spokesperson for George and Cindy, arranged their NYC interview (NBC IIRC?) for $6,000.00. For Casey, how many times more would this be worth– if they got that interview, how many times would it be run over and over and over again in this past year. It would be worth multi-times and Garrison/Anthony’s would have been smart to add royalties to their fixed fees for Casey’s interview. (of course, the Anthony’s have denied taking any money for interviews, claiming to have been the scam-ee’s at that point.

  35. silverspnr says:

    A) BAEZ IS IN A WHOLE HEAP OF MALPRACTICE TROUBLE IF HE FAILED TO PROPERLY ADVISE CASEY ABOUT THE BOUNDARIES OF THE ATTORNEY-CLIENT PRIVILEGE. A WHOLE HEAP OF IT.

    B) If a SCRIPT truly existed, is Cindy the obvious author??
    Not THAT would “MAKE SENSE”.

Cindy, who has a reputation, even among her own siblings, for being as tight-lipped as they come when it came to airing ANY Anthony family “dirty laundry”, all of a sudden starts blabbing non-stop to co-workers (with whom she has seemingly no personal relationships) about Casey in a negative manner.

The same Cindy who wouldn’t admit to the obvious fact that Casey was pregnant with Caylee, starts sharing fairly embarrassing information with co-workers last JUNE/JULY???

Talk about “FISHY” (i love that Marylou used that term to describe Casey’s tales) (almost as much as I love when she writes, “Shadow is out.” She is my kinda girl;)

    Back to SPINdy-
Don’t you find it ODD how she had so many details to go along with her time line statements for her interview with LE??
I can barely remember what I did last tuesday/wednesday/thursday, just off the cuff!
I mean– she sat there and went into very specific details, not only about where Casey said she was, but about things that one would normally forget (like what Interstate Casey said–or supposedly said–she was on at the time of the fake-nanny-car accident).

Who would be able to keep track of all of that nonsense, and yet screw up the DATE they last saw/held/kissed their grandchild ALIVE??

BTW-yes, people can mix up dates, but people tend to relate the last time they saw a missing child with an EVENT (particularly when the event is something significant, such as a DAY LONG VISIT TO HER STROKE-VICTIM FATHER, and then back to her MOTHER’S PLACE on FATHER’S DAY, FOLLOWED BY A MAJOR FIGHT WITH HER LYING/THIEVING DAUGHTER), and not a specific/erroneous date. It’s not as if she visits Shirley with such a degree of frequency that it could be explained as just one of the many days she drives all the way to Mt.Dora to pay a visit.

And now I have greater suspicion to believe that George was duped in the beginning. In that event, he was UNTRUTHFUL about the last time he saw Caylee, but not INTENTIONALLY.
REMEMBER–they went with the date of JUNE 9th on the night 911 was called, so it is very possible that on JUNE 10th, George did see Casey AND Caylee leaving the house early afternoon while he was “busy” watching TV.

If you think about it, part of the “script” would require Caylee to be alive on a MONDAY/”WORK” DAY, so that they could make that story about Casey dropping Caylee off with the phantom nanny on her way to “work” as part of her normal routine more believable.

And how about LEE, who was at the house with Cindy and Casey for quite a bit of time on the evening of July 15th BEFORE 911 was called??

I think he was being truthful when he said he tried to stop his mother from getting the police involved. I think he made a very interesting/illuminating SLIP during his LE interview when he described himself playing devil’s advocate with Casey about what she was going to say when the police arrived. The slip? When relaying himself in the role of a detective, he referred to his SISTER as “MRS. Anthony”. NOT MISS, but MRS. That has always stuck with me.

And something keeps gnawing at me about ANNIE DOWNING.

Does it make sense that she was furtively taken to the house to see Casey –who was between jail “visits”– simply because she was upset that she couldn’t talk to Casey?? HUH???
Their daughter is out of jail, but clearly suspected of doing something HORRIBLE to their grandchild, and they are concerned about “poor ANNIE” wanting her friend?? Her friend, btw, that she seemed to INTENTIONALLY distance herself from during that interview with LE at the State’s Attorney office (or wherever that took place- Maura will correct me if I’m off!)

And her description of Caylee is bothersome to me as well.
While other friends of Casey say that Caylee was highly social/interactive/friendly/TRUSTING/alone in a room full of near-strangers, answering the door at Tony’s apartment/welcoming every new person with a “What Up, DUDE!”/hanging out happily on the balcony with Maria Kissch (sp?)…
Notice how Annie describes Caylee as a different child altogether?

Why was Annie LEFT ALONE WITH CASEY IN HER BEDROOM? (particularly when they were paranoid about the house being bugged)
Why did Cindy sleep in Casey’s bedroom with Casey and Annie that night???
Why is she the ONLY friend who refused to voluntarily give LE a statement/forcing the State to subpoena her to appear?
Why is she the ONLY friend who was represented by counsel while giving her statement?????
Why did she say there was no one else with her when she got that ticket for failure to wear seat beltS (why lie about someone else being in the car with her on that date??)
Why did she go out of her way to make it seem as though she and Casey were no longer “tight” in the year leading up to Caylee’s disappearance??
WHY DOES SHE ALSO TOW THE “I DON’T TRUST JESSE” LINE?????

    Fishy, Fishy, Fishy.

  36. silverspnr says:

They were screwed the second that car was TOWED by Johnson’s. SCREWED.
Not sure what another poster was saying on the last article about some household product that can get rid of DECOMP.
DECOMP is NOT BLOOD. DECOMP is NOT DNA.

I stand by my focus on Cindy’s last txt message to Casey on the afternoon of JULY 15th:
    “call me asap. major prob”

    MAJOR PROB, INDEED.

Blink- if they (are able to)take this train wreck off the tracks before it goes to trial, will we learn what Casey was actually spending her time doing while at Baez’s office for “7 hours a day under the auspice of preparing for her defense”???
(sounds as though it adds a whole new level of HEAP to the pile facing Baez, and am wondering if that kind of testimony could be subject to seal in the event this results in a disciplinary action, of which I am happy to say, I have NO PERSONAL EXPERIENCE;)

  37. silverspnr says:

    Just to illustrate-

    http://science.howstuffworks.com/crime-scene-clean-up.htm/printable

    http://csiclean.org/decomposition__death.html

No household product would have worked/removed that smell from the car.

    SCREWED.

  38. Kleat says:

Silverspnr, with Cindy directing George to go back to work that afternoon, someone did try to clean up. How is it that Cindy could stay in the garage while Lee was interrogating Casey. Was she still busy with cleaning products? That makes more sense than just standing out there to try to vent off steam– that is the very last place someone would willingly be. Backyard, maybe– fresh air at least. Front yard, even better as you await LE to arrive from ‘the front’. (the front also away from whatever may have been in the back yard too)

Makes no sense, unless there was a reason for Cindy to be in the garage with the car and the things ‘inside’ the car, which were removed. Cindy would want to look at any notes or information contained in that car for clues ASAP.

Also, since Cindy was into ‘taking things back’, such as the money, JCP cards etc from the wallet returned from Tony’s place, she may have ‘taken back’ the large black work bag (aka what Lee called the large black purse belonging to ‘mom’) that was in the car. At least taken it to search inside it. (Lee spoke of this in the car video with Tony– telling Tony it was ‘mom’s laptop, mom’s digital camera, mom’s big black purse that was in the car…’ (paraphrasing but close– near the end of that video).

Silverspnr, if you have a chance to watch that video, Lee talks about Casey’s laptop, finds out from Tony that Casey had used the laptop JUST that morning (15th) and that it was not a work laptop, but ‘mom’s…. Tony seemed shocked that it was not Casey’s work computer. It’s what Lee says and his actions after asking Tony about when the laptop was used last by Casey. He seems to go way overboard on explaining how it was all of a sudden, later that night, ‘not working’ and goes into a long story about a virus he got on his own computer, had to go to Best Buy to get them to fix it but all data lost…

Makes me wonder, from his reaction and over the top explaining, that something was done to the computer so it didn’t work– was it Casey? She didn’t have much of a chance– was it Lee?

What do you see in Lee’s reaction and talk about this?? Suspicious to me.

(it’s near the very end of the 4 part video, just before they talk about all mom’s stuff that Casey had with her as ‘hers’)

  40. Joan (Canada) says:

Kleat, you’re probably right and wishful thinking on my part that someone in that family truly cared for Caylee. I was hoping that at least he would have tried to use it to scare Casey into telling him the truth. “When are you going to stop acting like a cop and start acting like a Dad!!!”. I guess Cindy shut him up fast.
I cannot believe the lies and subterfuge and finger pointing that they are doing and getting away with. Even today when they had to be summoned to court in order for them to give paperwork that the prosecution asked for weeks ago.
My only hope is that they will pay for this and that justice for Caylee will prevail.

  41. Kleat says:

Clearly Mark NeJame had to step away from his clients when he did– the timing was no co-incidence, even if he had reason soley on the terms of his relationship with his clients and what was expected in the way of lack of control over them and their public statements/appearances, and his role not to work on behalf of Casey.

Silverspnr, maybe a legal point of view from client/lawyer relationship. Mr. NeJame resigned within a couple of days of the now-notorious ‘woods walking’ adventure in which NeJame’s clients later advised LE, that they had arranged (Cindy told LE after body was found but not yet id’d). If a lawyer learns that their clients have knowledge of the whereabouts of the body, knowledge of information that links back to the person who put the body there, what are the ethical obligations in this case? Mark NeJame specifically was not going to assist in Casey’s defense, only assist the parents in their need to deal with the public etc.

Was this just coincidental timing for NeJame to resign, or could there be a reason that he HAD to resign if his clients were now acting to cover up the location of the baby or the knowledge that hte baby was no longer alive? They were still keeping up appearances of a live baby after that November Woods Walk adventure, so NeJame would have had to support this lie in order to continue as their counsel, seems to me.

(I think at first, the Anthony’s may have hoped to replace Baez with NeJame… in their dreams!!)

  46. Sylvia says:

So do you think George is going with his first statement that he knew what the smell in the car was, or do you think he is back pedaling to keep the peace at home? I always thought that he would do the right thing and be honest, but it seems as though he is non-committal in all of his subsequent interviews and his statements could go either way because they are so vague.

  47. Gypsy DD says:

Despite the car evidence there was a reason they removed drywall from the home/ garage.

I am thinking that is the sealing of the deal..after the fact of finding latent prints of Casey’s on the duct tape. So much cleaning up to do..so little time..once she decided to remove Caylee from the backyard to the car..then to Suburban Drive.

Paper towels from the trunk with grave wax..hmm..I am thinking they left grave wax on Casey too..and on the drywall as she was prancing about trying to relieve herself of Caylee’s corpse to another location. She didn’t figure OCSO would be back for drywall that she touched during the transfer from backyard to trunk to Suburban. Remember..this girl is not book smart..she is life and street smart. She had been winging her existence off of lies and stolen money.

As much as Cindy wants us to believe that Casey graduated from high school and was enrolled in college..we know it ain’t so. Casey was very smart..but she wasn’t what Cindy tells us she was. No doubt she could have been in a very good career if she hadn’t tried so hard to be more then she was with her friends..ie event planner, working from home, having a nanny. Funny thing is..I think if she would have pursued her dreams, stuff GA and Ca, she could have had that life. But she was an instant gratification and retaliation type..so she let her emotions get in the way of her life.

Can anyone tell me what they think of the strange conversation between Cindy and Casey at the jail where Cindy says she forgives Casey for whatevery she said, and Casey laughing says ‘don’t worry I didn’t say anthing”. That has been bothering me for a long time.

Thanks guys for all your help. I’m just trying to keep up. You guys are smarter than whips as my grandmother used to say.
And do you really think that Baez and company read these blogs?

  49. FairWitness says:

Why is Jose Baez still the lead attorney on this case? The motions he files are inept. It’s as though he doesn’t have a clue about the law. He’s wasting the court’s time with these briefs. The judges & prosecutors in this case must be so beyond fed up with his nincompoopery!

Kleat, that’s what I meant when I said ‘how much would ABC be willing to pay’

If they had a deal to interview Casey before she went back to jail, when she hadn’t said a word to any media during all her trips while being hounded for any comment at all, she would have gotten a lot of money for an exclusive interview.

Now I wonder if we will see at some point even a jailhouse interview. If they are her source of funds, she owes them an interview.

That could also explain why they scooped Cindy & George up after they found Caylee’s remains and put them up at the Ritz.
