Caylee/Casey Anthony Case: Baez Motionfest in Court This Morning

Orlando, FL– If yesterday’s antics at the press conference of attorney for the search group Texas Equusearch, Mark Nejame, were a precursor to this mornings motions hearing, it should prove to be a long day.

Exactly what pending motions are slated to be heard as there are several before the court at this time, remains to be seen, however, all have been initiated on behalf of the defense team Jose Baez and Andrea D. Lyon.

It is presumed the court will hear: Motion to delay the economic charges against Casey Anthony, motion response on behalf of TES Founder Tim Miller to be certified as a witness in the criminal case, Motion of 90 pages regarding evidence tested by the FBI (insert yawn). Motion regarding Anthony Lazzaro phone records, motion regarding Dominic Casey records and motion to preclude Leonard Padilla, Tony Padilla, Tracy Mclaughlin and Rob Dick from testifying as prosecution witnesses. Motion for anything I forgot.

White shoes. Repeat. White shoes in court. Got the petty out of the way, thanks for indulging me.

Mark presents to his Honor, Stan Strickland, the vast problematic issues with a broad request, which could encompass 4000 different individuals.

Andrea Lyon argued this is not a fishing expedition, it is the equivalent of the defense relying on the “Trust Me”  argument on behalf of the state. They are not looking to expose people’s personal information. Ms. Lyon went on say the defense is willing to hang out at Mark’s office until they get what they need.

Judge Strickland in recent receipt of the answer, deferring ruling upon review in short order. 

Jose Baez Argues Tony Lazzarro phone records 

Baez argues Lazzarro was served, and that the motion has been narrowed and only received response yesterday at 4PM.

AttorneyJay, for Tony Lazzarro, argues he was not served either, was notified by a third party as to ammended motion. Jay agrees to requesting the 6 week period of records from AT &T, but is not optimistic he will be able to. Furthermore, the materiality of the defense request post July 15, 2008, has not been shown. All communication had ceased by then.

Judge Strickland grants a portion of the defense request, June 1 through September 2008, within 30 days.

Jose Baez Argues Motion to Preclude Leonard, Tony, Tracy and Rob

 Baez calls George Anthony. Casey begins weeping openly. George discusses his interaction with the team.

Linda points out Mr. Padilla puts up $50k  bond, so how is it he was unaware that his intention was to find his grandaughter. George is doubletalking that they volunteered to provide security only once she was out. Jim Campbell, was the retired LE officer was staying at the home at the time. Mr. Baez had to be present when any person spoke to Casey or was around her, if he were not, a family member had to be present at all times.

George states he knew nothing about the privacy arrangements they agreed to. Linda pointed out there were several people that could have transported Casey back and forth, and that they requested this service. 

Ms. Drane Burdick presented the audio interviews of Leonard, Rob, and Tracy, about 3 hours worth which the Judge will review. She requested an original copy of the signed agreements for all parties.

*Secret*.. What Baez presented as the true and correct copies of the executed agreements by all parties is NOT.. Ms. Burdick is aware of this

Judge Strickland points out that Baez has had well over a year to file a temporary restraining order as Padilla as he has been “breaking that agreement” all over TV under this argument.

Ms. Drane Burdick argued Baez motion is essentially a gag order, and their has been no agency established, they posess the burden to establish privlege in the first place.

Oral agreement was hatched upfront between all parties, and prior to the written agreement. The agreement to provide security was a condition of posting the bond in the first place.

BAM… What I eluded to, Tony Padilla did not SIGN that agreement in the motion.  Hello, Florida Bar, please hold… 

I am intentionally shortening this segment, The State ate his lunch, and I have no clue why, but ruling deferred.

Motion to Determine a Trial Date Check Fraud

The state argues the check issues are relegated to specific dates and feels although witnesses may overlap, there is not an issue as to hearing testimony in the murder case. Baez is the only attorney on the docket of the case. The victim, Amy Huizenga, is asserting her right as a victim for the matter to be concluded. As an alternative, the State advises they are willing to go the bench trial route, which would allay the concerns altogether.

Ms. Lyon argues it is not their position it should never be tried and it is the states fault for seeking the death penalty in the murder case. Ms. Lyon sugested the state postpone the check fraud charges 60–90 days behind the murder charge.

Judge Strickland is considering this ruling as well

    #280 — Karen657 — I’m saying lying, especially on the order the Anthonys do it, speaks to a person’s character. Do I think every liar is a murderer? No. But I’ll wager you won’t find too many murderers who aren’t liars. And I’ll wager they were lying long before they committed murder.

    It’s a fact Casey is a liar, and it appears she’s also a murderer. A child should never be allowed to lie without consequence, much less be encouraged to lie, or have lying role modeled for her as acceptable behavior.

    Lying as a character trait can lead to much more serious, dangerous character deficits. Lying is a sign of a lack of a moral compass. When a person has no moral compass, she is not guided by the rightness or wrongness of her actions.

    Again — my guess is you won’t find too many murderers who didn’t start off in life as liars.

    Hey Fair W…give GA a break at least he wasn’t in his Tiki shirt, shorts and flip flops like the last time I saw him headed into court…all I know is in UT where I am from you have to wear sleeves to court, nothing like the summer BBQ party dress Cindy was sporting…maybe it is MoMO thing, I have seen ladies escorted out of chambers because their skirts were to short and their shoulder straps weren’t 4 inches wide…

    todd macaluso agrued for the equu-searchers records ,his statement in that agrument is being quoted as a headline :’defense reveals itself” “the defense claims: casey could not have killed her because remains were left in woods while she was in jail”his exact quote is “there is substantial evidence that weve discovered ,that the body or remains of caylee were placed there after casey was locked up in oc cf,there is substantial evidence and that proves your honor her innocence”. didnt i see a headline that stated ,”defense claims defy logic” some of the headlines i am assuming are aware of and are snarkily printing this fallacy.i also assume the judge granted the motion based on other reasons than the poor reasoning and conclusion of the argument(that casey is innoc.),yes watch out for the todd,fork tongue.

    Silverspnr – I just read those IM chats you linked to in post #278. I had seen that particular bit of conversation between Casey and TonE a long time ago, but when I reread it just now something really jumped out at me that I hadn’t noticed before. In one of the very last things he says to her, he calls her “Bella Mia”. It’s not too much of a stretch to think that this is where the “Bella Vita” idea/tattoo had its roots.

    What I wouldn’t give for us all to have a big meeting around a table full of good food and wine while the jury is out on this one. After all of the evidence and arguments have been presented, we each have a big binder full of our notes and our own discovery and just stay there until a verdict is heard. Maybe it will take several days – so we’d need rooms and some time by the pool!

    I would love to meet so many of you and hear your thoughts without the filters we have to have in forums (Not complaining about forums or filters and all! I know why they’re needed!) It would be fascinating to say the least.

    I am so impressed and in awe of the many twists and turns your brains can come up with! And Blink – every one of your blogs is written in such a compelling way that I too am addicted to quest for justice for Caylee. Thank you – and thank you all.

    I commented on my opinion on why Cindy would have not classified her daughter as a 10 in court yesterday (Since Cindy, evidently from her M&M depo is an expert on what a 10 is).

    I think Lyons, (and this is not a joke, I am serious)….deliberately had a makeup free, gringy haired, dressed like a frumpy new look for Casey. She is getting Casey away from the party hearty while your dead baby is in your trunk look.

    Silver, I can relate to Lyons and her cause. I could never sit on a death penalty case. I do not cringe when I read it happens, I just could never be the one to say someone should be put to death. I do have an issue with Lyons & Company using innocent people to ruin their lives to cast doubt on her clients involvement.

    Kleats already asked you all my questions lol. Thanks for the link. I immediately thought WOW here’s proof the prosecution needs. Can you imagine here she is with her lover wanting to just drop by to say goodnight on the curb, and her knowing all hell would break loose with Cindy and George. And proof again the net is tightening with her having already lost the cop boyfriend who wouldn’t take the 3 weeks of them being unable to get together….and deju vu….it’s about to happen again with her not having a baby sitter for Caylee.

    AND, Tony was not as loose with as her previous BF’s who would have sex with her with Caylee in the bed….AND, Tony was not taking the “no, dont drop by”…..Casey’s noose was tightening….

    You bet the defense will point this out, saying ‘the wooded area WAS searched’, just listen to that video report.

    WHEW,thanks Blink! Mr. Google had already told me about that toothless dirtbag woman and I was worried Stipp might be a part of the Padilla group. Google told me a lot more. I was worried she was connected with the search. I was concerned that Tony P. is over at a site like that posting, and her record along with other stuff google told me, made me shudder. Tell Mr. Tony it doesn’t look good to people who know nothing about blogs to google and find scarey crap like that! Stick to the media outlets.

    Remember I am the one who said I was so upset at them bailing Casey out, then was won over by watching and seeing that Leonard & Co. was not after the reward money, but he was seriously concerned about Caylee and finding her. That flamboyent (sp?) cowboy won me over :)

    Silverspnr – I had not read the chat discovery between Casey and Tony that you linked to above. I know that sometimes I called my kids different things as they were growing up – all out of love (buckethead for the one who has a big head, anklebiter for the one who threw himself on the floor during tantrums, goofball, eddie munster for the one who has a pronounced widow’s peak, I could go on) but I never just referred to them as ‘the kid’. It seems so detached and impersonal.

    That chat also goes to show you that Casey was leading both Amy and Tony down this path of having the house to herself. It also shows how desperate Tony was to spend intimate time with Casey – willing to risk her parents being there. Not to mention how much pressure he kept putting on her over and over.

    Casey was not going to be able to hang on to Tony with constraints of a toddler at least not without a place of her own – and she knew it. I get a very uneasy feeling about her telling both Amy and Tony that soon, VERY soon, she was going to be free of the binds of her parents all together and that somehow they were just going to give her the house and both move out and move on. Seriously, Casey?

    Something was going to reach the point of no return one way or another. She had backed herself into the proverbial corner. What better way to make all of that turn around than to have her daughter go missing? She gets sympathy – and her parents of course, stay together and in the house to support her and one another. The whole thing slowly dies down over the course of a year or more. She can move about as she wants to – stay with Tony. Nobody can fault her for anything.

    Then what happened? She didn’t follow through and for 31 days she flits about as if it never happened. Covering only what she needs to in order to get through the next day, hour, minute. Did she realize – too late – that it wasn’t going to EVER just magically go away? Decided to live her ‘beautiful life’ for as long as she possibly could before it all caught up with her? Sure, she had hope when there were those willing to believe her and post huge amounts of money for bail. And since no body had been found – maybe it never would? She starts thinking – and her attorney is sure helping her with this – maybe, just maybe I have gotten away with this.

    Now, after spending a year in jail and at least another one coming up is the only thing that has shaken that false sense of entitlement and specialness. I certainly hope so. I want to believe that’s what I saw on her face Friday.

I think he was expecting a fight from Nejame which of course he would have used to his advantage but Mark seemed just fine with giving him the ‘relevant’ (sorry George) searchers names. So now what? Now Baez will have a few dozen more people testifying the area was under water. What a maroon!!!! Don’t you love it? He shames himself with every move and I just love him for it!!!!

    And don’t you nearly die when he says things like, “We have said all along that we are going to try our case in the courtroom?” HA HA HA!!! I die!!!! Ahhhhh . . . Baez. You kill me!

    #319 Mariann – BUT Todd M did say that they had discovered evidence that will PROVE CASEY’S INNOCENCE and that ‘proof’ was that someone else left ‘lil Caylee in the woods. I think it is pretty strongly implied by that statement that they are saying Casey did not kill Caylee.

    Blink HAS given us a place to gather and discuss! SECOND LIFE. We can group chat with EXPERTS and each other. Angela has a masters degree in psychology (criminal IIRC). The other lady RIVAL is an expert (I forgot her expertise).

    What Angela wants us to do is have group chats where she can post our chats on VRhack. All 3 of us stood around the crime lab and discussed our thoughts and as I said earlier I went and bought earphones and a mike because I couldn’t type fast enough I was so excited!

She is innocent presumably of the crimes she is charged with in the capital case. Who knows, maybe TMacs will take the cheque fraud case on himself– afterall, he’s got personal experience!!!

    #317 – lily – You hit the nail on the head! That is what I saw in her too. Yet her mother Cindy thought she looked great. I wish for just once she could take off those rose-colored glasses she wears and see what everyone else sees. If she did take off the glasses, she would see how low her daughters spirits are – notably the worst since last July 15th when the SHTF. The drive to keep up pretenses is maddening. To be in denial 24/7?

    I’m not feeling the “vibe” between Casey and Baez anymore either. Maybe it’s me, but it seems the honeymoon is over between the two….

    I think that Friday was a media event as much as anything to do with the legal aspects. Macaluso knew the hearing was not for arguing the capital case but he did it for the public/jury pool. It’s probably more important that they influence the jury with their spin on things and to risk scrutiny for what they present– it’s probably a bigger gain to repeat those words out there, by a lawyer who is rarely ‘in town’ so it’s not Baez talking. Big TMacs will take that op every time he has a camera in front of him– repeating the ‘I’ word, and spinning a tale. They don’t know what their fishing expeditions will turn up. Whatever it is, they will make full use of it but you can bet, there will be no identities of those they use, because to do that, will allow those people to give alibi’s, or otherwise discredit the defense theory, just like happened with the real ZG at Sawgrass. Once they had a real person, that game was over– has to be a ‘theory’ only– a possibility that can be sold to the jury.

    Thanks for the link to the Casey/Tone IM’s. I’d never seen that. One little think I noticed was Casey called Caylee, ‘Cays’ at one point.

    Now I understand from some home videos, that Cindy may not have been calling Caylee ‘Casey’, but may have been saying ‘Cays’ come here… etc. If Casey felt her identity was being infringed upon and she was jealous of her mother’s attention to Caylee, what does it say when Cindy called her girls ‘Cays’ and Casey’. Almost identical names, confusion. Casey could also have been called Cayz, same sounding name as a pet name for herself.

    Very strange, like all the women in that household are a single unit.

    Bees Knees, I don’t think he did that, shoot himself in the foot. I think they need to push their chances of finding a ‘rusty nail’ in the searchers, or maybe another JW. Thing is, they are searching for someone willing to say they actually did a little search on their own of that specific area, didn’t listen to the TES organizers, went off on their own. Even if someone changed search areas, the safety of searchers meant that searchers had to be accounted for at the end of the day. So to go somewhere else after registering to be another place, is irresponsible. TES doesn’t need to spend the next days searching for a TES volunteer who dropped out of sight because they went elsewhere, didn’t ‘sign out’, then went on a holiday.

    Off topic Blink, but evening news RCMP confirm credible info that Ryan Jenkins is in Canada– momentarily news conference. Will let you know, just fyi, if anything of note. If this person gets away, other women would be at serious risk, he’s beaten his women before. (his mother is not reachable at her Vancouver BC condo, and his father in Calgary won’t ask his son to turn himself in, and his lawyer advises not to comment)

    When George is on the stand (at trial) they can ask him what Baez told him, if he asked him questions, or prepped him, etc. There is no attorney client privilege. Hell, in that case they could actually call Baez to the stand, and ask him under oath whether he spoke with George before the court hearing on those motions, if they wanted to; they won’t. ….anything shared with George isn’t attorney client privilege, so calling George to run to NeJame’s presser was a mistake, in my opinion. Baez showed how he was running the show with the Anthonys. Part 2 was the episode in court.

    I think everyone involved knows what’s going on.

    I’m confused a little about Tony Padilla. On WS, he (paraphrased) said that he wasn’t aware that the contract was going to be used in the motion.
    So how did the SA bring up all this info about the contract being altered?

    Did she get in touch with him right before court? How did this come to her attention, and when?

    Dee, it may be no joke. If that person resided in FL., had a lot of knowledge about the case, and so forth, she may be in the cross hairs of the defense’s shotgun. I don’t know what kind of convicted sex offender she is, if true, but most women that are offenders don’t attack adult men, so either she was convicted of acts perpetrated on another woman, or worse, a child. If the latter is the case, they will look at her closely if they get access to all records (if she signed up as a volunteer for TES)

    Blink, you can take these posts out– just fyi, police didn’t say much more than Jenkins was found dead in a motel room. (the small town on the Trans Canada east of Vancouver) Police did not give details, but CTV News reporters say their sources suggest that he hanged himself. He was probably facing capture if he continued on the Trans Canada, the only viable route for someone who would be recognized and he couldn’t take alternate routes off that for quite some hours.

    @Shelly #321 – I’m so glad you brought this up because I have been one of the biggest proponents of Second Life and the virtual juror community. I haven’t had much of a chance to log in lately because of work (plus it drains my MacBook battery and I travel a lot) but I will this week.

    You’re absolutely right. It will be a great place to get together and discuss the case with the ‘experts’ that have studied these fields for those of us (me) wanna be criminal investigators. I have to say I have lurked at a lot of crimes websites and only posted at one other site (which wasn’t my thing) and this is the only place for me. I can’t wait to chat with everyone real-time there. My nym is ‘lily paquot’ – I will look for you (blinker pedalo).

    I cannot believe I missed that chat discovery that Silverspnr reminded us of above. Sometimes when I read something and think I have absorbed it and know all about it – going back and reading again after more time to absorb it and more discover makes all the difference. So now in my spare time (limited these days with 4 boys and a traveling job!) I spend it here or reading back on discovery I either missed or need to read again. Plus reading Silverspnr, Maura, WSH and so many others is invaluable.

    Its not by accident that I’m not a criminal investigator. Apparently my brain doesn’t work that way compared to the others that I read here.

    I do wonder what draws so many of us to want to know what makes Casey who she is and made her do what she did. More and more I think she is a copy of her Dad – the narcissism and the selfishness are just not something I can relate to.

    Okay I will share a couple of personal thoughts that I have on this case……
    I think from the conversations with “friends” and Tony, KC was going to get rid of Cindy as I don’t think George was living at the house at the time of this tragedy…
    The computer searches etc all point to that and I do believe that KC chloroformed Amy and stold her money before she left on her trip….
    I think some people are confusing Tony L and Tony R as I think Tony R is the one that did not want Caylee around when KC was IMing with him.
    I think originally the day Caylee was killed that it was because of rage for Cindy (to really get back at her now)
    I also believe that KC was even going to leave Caylee at that house for cindy to find her but then she freaked out from fear.
    I just wish this would get to court already and I do wish that KC had a good attorney so we wouldn’t have to put up with all of this bull that is preventing from gettin on with it…

    I also think that Rob D is hot!

    These people are all running around and NO ONE has a PLAN!
    Maybe too many chiefs? too many movie stars? who knows?

    Just how did we miss that Tony Casey chat log? Simple– it’s not in docstoc under ‘Casey Anthony’, nor does it contain Casey Anthony in its title “IM History with L7Tone”, or “IM History with buddy L7 Tone”. One had to know that L7Tone was related to the case, as it wouldn’t show up in the C.A. search.

    So thanks!! That is one key piece to have– I didn’t even know they released a full chat transcript with Casey and Tone.

    The brutality of Jenkins in the violent manner of Fiore’s death, then transporting her out of the hotel, planning to disfigure her in a way that would give him much time, to get out of there, and maybe escape offshore, all that, and this man STILL called authorities to say his wife was missing! Not that this is a sign of ‘good’ in the man, he had his reasons I suppose to do that, in case he were caught, he could say he was out looking for her.

    But, all those violent and horrid events, yet with Casey Anthony, she went partying and sleeping around, and NEVER reported her baby missing– ever!! We can only hope the baby did not suffer long in Casey’s rage or ill will towards the child.

    Nancy – do a quick search on your computer for the comments the Caylee article before this one for ‘angela talamasca’ and there are numerous posts from angela about Second Life and the link to the website where all of the instructions that she has sent us. It takes a few minutes to download the program and register but it will be worth it! Can’t wait to see you there. Once your registration is verified you will have a nym (user name) on Second Life – it gives us a whole new 3D view into the major crime scenes and the lab. They will add future sites as it develops. I sound like a commercial for this – but it is so exciting!

    I have to zsk if anyone else here finds Janie Weintraub the most annoying talking head on HLN. She consistently gets her facts backwards and doesn’t know what she is talking about. I saw a rerun tonight where she claims that Leonard Padilla was an EMPLOYEE of Baez’s and therefore anything he did would be considered “work product.” Maybe I am crazy, but don’t employees HAVE to be paid? I would like to see Baez’s cancelled check to his “employee”

    Maura, I really appreciated your posts, esp on the judicial system. Your perspective is very illuminating, so often it just doesn’t seem to make sense to me!

    I just hope this case doesn’t end up to be one of those incomprehensible miscarriages of justice Dominick Dunne covers; the way the defense team is going at it, I keep imagining him narrating the story in that bittersweet tone. The strange thing I cannot for the life of me understand is how this penniless defendent inspired all of this.

    #327 – Kleat – I wonder if the defense is basing their assertions that the body was moved on the pictures by Joy W., one of C & G Anthony’s “supporters”. She claims she was at the Suburban Drive site many times searching on her own. She claims that she had signed up to search with TES and that one of the times she was at the Suburban Dr. location, it was with TES.

    I find it all a bit suspicious. She was an Anthony protester, turned supporter, carried a “Caylee is Alive” poster to the Blanchard Park search, and just happened to have pictures of the exact area the body was found. I think this woman involved herself in this case, and now may get more than she bargained for.

    From what I’ve read, she comes off as more than a little whacky and both she and her husband have rather “checkered” pasts (his involves child abuse and “anger issues”) making me wonder if they may be next on the “Who can we throw under the bus” list.

    Yep. With ledes like “Substantial evidence that Casey Anthony is innocent”, you couldn’t buy better press if you spent millions on a commercial during Super Bowl. People listening with half an ear say, hmm…so she’s innocent.

    In court, though, the jurors must concentrate on evidence, and so by then, the defense has got to bring the ‘goods’.

    It’s interesting how some forms of media appear not to research much before discussions take place. For example, I watched the re-run of “Issues; JVM”, yesterday, and it was clear that no one read the purported contract. Everyone accepted, at face value, what was reportedly in the contract. No one seemed to have heard that there was controversy surrounding it. Or conversely, they didn’t want to delve into anything that may make them appear biased toward one side or the other. My exception to that rule is one panelist, Jane Weintraub, who, regardless of the accused, always ‘toes the line’ of a defense perspective and thus lacks any credibility in terms of objectivity or a complete perspective of how the case is going. Mark Iglarsh (sp?), on the other hand, has the best ability to step outside the box, and play both Defense attorney and Prosecutor, analyzing what is working and not. My point, though, is that many people get their info from shows like this. And, of course, some would-be jurors watch these shows.

    All my opinion, of course.

    I think that Cindy was so desperate to see Casey, that regardless of Casey’s appearance, she would think that Casey looked great. Yes, she did add some spin. But in this circumstance, I feel that it is pathetically sad that she anticipates catching glimpses of her offspring and doesn’t have any real face time with her.
    It has become increasingly apparent, in my opinion, that Baez is also running the Anthony show, and won’t permit Cindy to visit Casey in jail. At this point, Brad Conway is coming across as mere window dressing.

    Yes they are. But they have got to find someone that doesn’t come across as a complete crackpot. Remember all of the ‘sightings’? What’s to stop the defense from pulling ANYONE out of the air, not even associated with TES who insists that they searched the area? Whoever this person may be, they have to have credibility that trumps a specialized searcher, like Tim Miller, and countless others who will state that the area was under water, including an expert weather witness who might attest to conditions in the area during the search time.

    They are throwing this out there now, but who knows if this is the direction that they will go in the future?

    In the end, they may still use Mac to develop an accidental death scenario, and they may not want to tip their hand, at this point; but want to fish, and toss out extraordinary press, as you articulated.
