Caylee/Casey Anthony Case: Baez Motionfest in Court This Morning

Orlando, FL– If yesterday’s antics at the press conference of attorney for the search group Texas Equusearch, Mark Nejame, were a precursor to this mornings motions hearing, it should prove to be a long day.

Exactly what pending motions are slated to be heard as there are several before the court at this time, remains to be seen, however, all have been initiated on behalf of the defense team Jose Baez and Andrea D. Lyon.

It is presumed the court will hear: Motion to delay the economic charges against Casey Anthony, motion response on behalf of TES Founder Tim Miller to be certified as a witness in the criminal case, Motion of 90 pages regarding evidence tested by the FBI (insert yawn). Motion regarding Anthony Lazzaro phone records, motion regarding Dominic Casey records and motion to preclude Leonard Padilla, Tony Padilla, Tracy Mclaughlin and Rob Dick from testifying as prosecution witnesses. Motion for anything I forgot.

White shoes. Repeat. White shoes in court. Got the petty out of the way, thanks for indulging me.

Mark presents to his Honor, Stan Strickland, the vast problematic issues with a broad request, which could encompass 4000 different individuals.

Andrea Lyon argued this is not a fishing expedition, it is the equivalent of the defense relying on the “Trust Me”  argument on behalf of the state. They are not looking to expose people’s personal information. Ms. Lyon went on say the defense is willing to hang out at Mark’s office until they get what they need.

Judge Strickland in recent receipt of the answer, deferring ruling upon review in short order. 

Jose Baez Argues Tony Lazzarro phone records 

Baez argues Lazzarro was served, and that the motion has been narrowed and only received response yesterday at 4PM.

AttorneyJay, for Tony Lazzarro, argues he was not served either, was notified by a third party as to ammended motion. Jay agrees to requesting the 6 week period of records from AT &T, but is not optimistic he will be able to. Furthermore, the materiality of the defense request post July 15, 2008, has not been shown. All communication had ceased by then.

Judge Strickland grants a portion of the defense request, June 1 through September 2008, within 30 days.

Jose Baez Argues Motion to Preclude Leonard, Tony, Tracy and Rob

 Baez calls George Anthony. Casey begins weeping openly. George discusses his interaction with the team.

Linda points out Mr. Padilla puts up $50k  bond, so how is it he was unaware that his intention was to find his grandaughter. George is doubletalking that they volunteered to provide security only once she was out. Jim Campbell, was the retired LE officer was staying at the home at the time. Mr. Baez had to be present when any person spoke to Casey or was around her, if he were not, a family member had to be present at all times.

George states he knew nothing about the privacy arrangements they agreed to. Linda pointed out there were several people that could have transported Casey back and forth, and that they requested this service. 

Ms. Drane Burdick presented the audio interviews of Leonard, Rob, and Tracy, about 3 hours worth which the Judge will review. She requested an original copy of the signed agreements for all parties.

*Secret*.. What Baez presented as the true and correct copies of the executed agreements by all parties is NOT.. Ms. Burdick is aware of this

Judge Strickland points out that Baez has had well over a year to file a temporary restraining order as Padilla as he has been “breaking that agreement” all over TV under this argument.

Ms. Drane Burdick argued Baez motion is essentially a gag order, and their has been no agency established, they posess the burden to establish privlege in the first place.

Oral agreement was hatched upfront between all parties, and prior to the written agreement. The agreement to provide security was a condition of posting the bond in the first place.

BAM… What I eluded to, Tony Padilla did not SIGN that agreement in the motion.  Hello, Florida Bar, please hold… 

I am intentionally shortening this segment, The State ate his lunch, and I have no clue why, but ruling deferred.

Motion to Determine a Trial Date Check Fraud

The state argues the check issues are relegated to specific dates and feels although witnesses may overlap, there is not an issue as to hearing testimony in the murder case. Baez is the only attorney on the docket of the case. The victim, Amy Huizenga, is asserting her right as a victim for the matter to be concluded. As an alternative, the State advises they are willing to go the bench trial route, which would allay the concerns altogether.

Ms. Lyon argues it is not their position it should never be tried and it is the states fault for seeking the death penalty in the murder case. Ms. Lyon sugested the state postpone the check fraud charges 60–90 days behind the murder charge.

Judge Strickland is considering this ruling as well

    Reading Tony and Casey chat, maybe things were in the works for her to get the house. I know Cindy says that it wasn’t true, but who knows?? Then Cindy finds out about the money being stolen from Shirley and all h*ll breaks loose. Cindy changes her plan about Casey getting the house. At that point, Casey has already made all of these plans to move Amy in and told Tony to just wait a few more days. What is she to do now??? This is already on top of the fact that she is tied down to Caylee. What better way to get back at her mother and give her free time, then to kill her daughter.

    Also, in the chats, she says that she still has some respect for her parents. After the confrontation on June 15th, all respect is off the table. She probobaly figured, and to think that I wouldn’t let Tony over here out of respect for them, and look how they treat me.

    The other thing I pick up on from reading these chats, is that Casey appears to be whipped over Tony and she seems that she would do or say anything for him. You can tell that she just couldn’t come out and tell him no, without pussyfooting around.

    This will not be a popular opinion but I believe the Anthony’s knew the remains were not in this area when searched because they had posession of them. I re-read the autopsy and am not convinced by it that those remains were at this spot since late June. Vegitation and bugs are the same throughout central Florida.

    I still say it’s unbelievable that these remains were found the one and only day George and Cindy Anthony were out of the state of Florida, in California, Nice alibi! I’ll bet anything that Kronk searched or pee’d here regularly and if they wanted to have the remains found on any particular day, it could have been arranged. Kronk is just a pawn in this whole sad story.

    The good part of this theory is since G+C were out of town and KC was in jail, there’s a third party involved. Does Lee come to mind? Or maybe even that other good family friend cop who was hanging around.

    Blink, or anyone else, how sure are you that those remains were at this spot from June to December?

    For me, I am 1000% positive they were there since June 23rd/24th.

    I know everyone has been contemplating Casey’s appearance and tearful episode, so I thought that I might throw in my two cents. I think that at least one of the attorneys told her that the suppression motion ( with the contract, real or altered) was a long shot, and that it would likely be denied. Probably when George began to testify, all the emotions from that realization bubbled to the surface; the very strong possibility of Tracy, Leonard, etal. testifying about her behavior, her statements, and her disinterest in locating Caylee might become a stark reality. Perhaps, she even felt that George was unconvincing. In essence, she thought she was screwed.

    I hope we get some rulings today.

    I don’t think the defense will use Joy’s testimony either, she’s a total ditz, but I do believe it opened a door for them to consider how many other searchers have a “questionable past” that could raise a reasonable doubt in the minds of the jurors.

    It is going to be interesting to learn, if we ever do, if there was a grain of truth to Casey’s “Mom and Dad are giving me the house” story or if it was just something she made up and completely backed herself into a corner over. Too bad Larry King didn’t ask the Anthony’s about that on his show! But as far as her having too much respect for her parents to let TonE come over, well, let’s just say that I put that comment in the same category as the “I dropped my daughter off at Zanny’s apartment on my way to work” statement. I think a good gauge of just how much respect she really had/has for her parents is clearly demonstrated in her phone calls to them from jail and her jailhouse conversations with them. I only hope the jury will get to see them. They “absolutely” shed light on the situation!

    Even if Casey were to get aquitted (which we all know she wont), where will she go to live? – Baez’s house?
    …She wont even make eye contact with her parents! – She knows she is stuck in there. haha!
    Her demenour has completely changed. She (Casey) is very serious, very little smiling and laughing…As apposed to the beginning of this case and the interviews with detectives…laughing, giggling, joking.
    I just cant see how someone like her can live. How can you live after seeing what you did to your baby, and the state Caylee was in when Casey just dumped her like a bag of trash. Caylee had to have been in one of the worst states at that point. Its very humid in FL. and the decomp process from being in the trunk owuld have sped up significantly.
    I cant wait until January for the trial anymore…
    And like others have said, if the defense has this so called ‘case’ of theirs, well then…lets get the trial going!
    Honestly I think what happened, is beyond anyones comprehension. And none of the A’s will ever fess up to what they know. For a while there…I thought the grandparents would. But they’re as sick as Casey.

    I just don’t see any way for the Anthony’s to have had anything to do with ‘lil Caylee’s body. The ME has a pretty good idea of time of death (June 15/16. The experts feel as though she was there (Suburban site) since late June. The lab believes that the decomposition shows the body was in the trunk of Casey’s car for 2-2 1/2 days IIRC. So the basics IMO are – Caylee was harmed on the 16th, hidden somewhere in/around the house or a temporary burial site for 4-5 days – put in the car for 2 to 2 1/2 days and then placed at the Suburban Drive location on the 23 or 24. Most of this is supported by forensic evidence and will be disclosed at trial via expert testimony.

    How – with all of the publicity and the constant attention and the bug’d phones, etc. could the Anthonys have had anything to do with hiding and disposing of their granddaughter’s body?

    I don’t think the Anthony’s went into ‘denial & cover-up & cash-in’ mode until early July when all of the little things added up into one horrible revelation. Finally they just couldn’t wait take one more minute of denial about the fact that something was very wrong with their granddaughter on July 15th. If they could take back that evening and do it all over differently – they certainly would.

    You wanted to know why Baez called GA to testify on Friday.
    He was trying to establish, through GA, that Tony P et al were at the home as an extension of his (Baez) office/legal services, such that Casey could make a “derivative” claim of attorney-client privilege to protect from discovery any statements she made about the case in their presence.

    Absurd to the Nth degree.
    Plus–
    The attorney-client privilege does not protect ALL statements made by a represented party. It protects “communications” which are made for the PURPOSE of REQUESTING/OBTAINING LEGAL ADVICE.

    We all know WHY Tony P etc were there, and that was to protect his $50,000.00 “investment”.

    Even taking Baez’ argument, if Tony P et al were acting as “security guards”– then their purpose of being there was not to render LEGAL advice.

    Finally-
    Even if you accept Baez’ absurd argument–as Judge Strickland pointed out:
    ISN’T THE HORSE OUT OF THE BARN ALREADY? (YES–because, as the channel-surfing-man-in-the-black-robe-with-the-gavel pointed out: LP has been on numerous, nationally broadcast media programs discussing things he learned while there, and since NO OBJECTION was previously made- in the form of a Motion for a Protective Order- the privilege, if it even existed (it does not), has been WAIVED.

    LP has certainly described Casey’s behavior/demeanor/etc. There is caselaw interpreting a client’s “conduct” as a “communiction” for the purposes of the attorney-client privilege.

    boz, I think the entomologists and botanists would disagree about everything the same in Florida. Same could be said for any region. They are not looking at the broad average picture, they are dealing with specifics of one area, of all the conditions that affect plant growth at any given time, including root growth, flowering, spore formation, leaf mould, bugs that only live in certain conditions, reproduce in those conditions, and then there’s the soil conditions, the chemistry of the particular site. It’s not like saying we found a sawgrass leaf under the bag, therefore we found the body in Florida.

    Boz, if your theory is right, then the body would have to have decomposed in ground (or where else possible/practical in that humid hot region?) because Casey was not just killed in December and put there while the Anthony’s were away to Larry King. That does not seem practical at all, and the scatter of the bones and plant growth– those roots would come out of the ground, from ‘that’ site. Imagine transferring a skeleton with roots into the fragile tiny bones, picking each one up, snipping off any and all roots, bone after bone, and then, what would the botanists find? ‘Snipped’ roots– cut, sawn, whatever, but not ‘natural’. And the growth rate of the roots, what if no root damage until after the skeleton was placed there? The rainfall in Oct, Nov, December is the lowest, typically– storm season over. So no way those roots would be growing at the same rate to give what was found (according to the reports and what the botanists will say).

    It doesn’t make sense that the body was placed there, UNLESS the body was fresh (which is was not), or the body had been somehow preserved, which it was not.

    Everything about this defys common sense. If Casey was caught in the scenario she proposes, as a victim of a kidnapper who took her child, she was still ONLY thinking of saving herself, because the only way to help the child in June, July, August, September, October, November December, was to get help, even if it only ended up in helping find the child’s body by finding those who did it.

    The defense, IMHO, never tossed out a hint at their defense plans on Friday. Yes, they are asking for stuff and that might relate to whatever they do (or don’t do), to see what pops up they can make use of somehow. But Todd Macs saying ‘we have proof’, is rediculous. They are going to march that proof right down to the OSCO and say find the real perps and show the state, so the charges can be dropped and the focus on the right people.

    Rembering that ToddyMacs said the SAME THING months ago when he did his whirlwind interview set for the media– so why didn’t he bring this to the state and get his client out back then? Only one reason, they are defending the guilty and don’t look for the truth.

    boz, but kronk tried like heck to get someone to find the remains in August (3 days in a row!) and only lame deputy Cain stood in the way of justice by being too skeered to go in and look at them, even arguing with kronk that the remains would not be skeletonized so a skull was impossible, and essentially saying he was wasting the county’s time and resources. So I don’t know how much of a kronk could be. Now if you want to put Cain in the consipiracy, by all means!

Could there be a ZG avatar out there who was involved in getting her own house, getting things for her house, having a roomie move in, maybe doing a bit of poker playing and gambling online, straightening her curly hair, etc.

    And if this were out there, could traces of it be wiped out simply by clearing a HD or dumping files? Unlikely– credit card usage for paying for ZG’s virtual lifestyle perhaps?

There are other venues where that *is* acceptable, but one of things I treasure about Blinkoncrime is that type of base and non-construcive name-calling is frowned on here. Those pics aren’t “funny” — they’re mean hearted and bring nothing of value to the investigation, except to reduce both the Anthonys, the creator, and the viewer back to a playground mentality.

    Yes, we all have good reasons to dislike the actions of the Anthony family. But that kind of juvenile humor just devalues this site, and the high-quality sleuthing that goes on here.

    Information about private chatting in Second Life

    Some of us had a wonderful chat with Angela in Second Life last night and we were all fasinated. You can either type in the group chat box or if you have a microphone you can talk during the chat. Some of us had mike’s some did not. Those that did not could hear us and interact by typing in the box.

    You all have to sign up for the VR hacks forum. In the private sector Angela has posted some things in my opinion I prefer to keep away from some eyes (like Anthony’s and Baez’s) here in an open forum. Angela has posted some links and information in private under group chat.

    Sue #267, I kind of think just the opposite. Mothers who kill their kids dump them exactly where casey did—in the woods close to home. I think it’s a sin that the body was not found sooner. Seems like Kronk had the sense to figure that she might hide the body in a swampy area that already stunk, and I guess he lucked out when he answered nature’s call at the right spot (ok, you can call it divine intervention, it could very well be). But he was also purposely looking. For crying out loud, it was only 19 feet off the road—yes, in thick kudzu, yes, in water, but spottable at times? Evidently, my dear Watson.

    The fact that Caylee’s body was not just dumped, but was “shrouded”, if you will, from the elements, not to mention the heart-shaped sticker (residue), points to the identity of the killer as well.

    And then there’s those pesky FINGERPRINTS, which do not get washed away by water. (Former FBI profiler, Candace DeLong, spoke of this when she was interviewed about the Sandra Cantu case).

    SECOND LIFE

    When you download and sign into Second Life you will go to one of the random worlds. You can keep Second Life open and minimized on your tool bar. IM Angela or me or any one who is on from the Blinker group and they can transport you to the site. From there in your top command section you can set that to HOME and always automatically be there when you sign in.

    When we are at the site we can move freely between the three area’s. Angela is off working setting up the realistic area’s to transpose to where we are when she is finished. She is going to try to set a chat time so we can meet her there. Or we can set up our own chat times to all meet sit around a table, or stand around in Cindy’s living room and have a group chat.

    The ones Angela has already signed up show as “online” and she is hoping volunteers will help get others set up to know how to get there. Believe me, if I can figure this out so can YOU!

    Angela has a lot of tutorials set up, I just had to go there and after some guide steps from her I was off and going. Keep an eye on the vrHack site to see messages from Angela as she busily works getting all the “pack rat Anthony stuff” in place, as well as the crime scene and the forensic lab set up.

    Is this just a co-incidence, like other ads last year, a dark-haired young woman in BIG white sunglasses, wearing a white snug tee… (that ad disappeared later).

    Is this using this case to talk about Manic Depression/Bi-Polar, whatever, and in the ‘rollover section’ at the bottom, talking about symptoms that might have been indications of Casey’s situation in the 911 ‘epilepsy’ call related to her depression somehow etc?

    Can the defense go dig up advertisers like this, to parallel their case stories? Hey, why not?

    suz, absolutely NO KUDOS… I thought I put a disclaimer in that to say he had his ‘reasons’ for doing that report– to his benefit as he saw it at that time.

    But it emphasizes just how rediculous not reporting Caylee missing to her parents, to FBI, because those people would NEED to keep things underwraps if necessary to PROTECT CAYLEE. That could have been done, those FBI agents know a thing or two about handling missing baby cases especially with regards to kidnap.

I still find it hard to believe he saw something and did not get to it to pick it up. If I thought I saw a childs skull and their was a child missing in my neighborhood, I would fight off alligators and rattlesnakes to get to it. NOTHING ABOUT THIS CASE MAKES ANY SENSE!

    I am actually under the impression that sometimes Casey was not home at all when she was texting these guys and making up excuses why she couldn’t see them that night. “I respect my parents”…”I want to come over, but my ‘nanny’s’ not back yet, she’s still on the road —I just called her and she has to go pick up her dog”…etc.

    I’m thinking that at least on some of these occasions, she was actually with one of the other guys, or out partying somewhere. Just like she was lying about being at work..”my co-worker sitting next to me is making fun of me because she says I’m in love. We’ve been working together for 4 straight years now. I get out early today, after a 12:00 meeting”. Everything she said to everyone was total BS.

    Her parents were moving out and giving her the house… just like she was at the hospital because her father had a mini stroke.

    So, is the thinking that Caylee was buried for 2-3 days after she died, then carted around in the car for 2.5 days, then thrown in the woods? Would that be why the dogs hit on the spot in their yard? But I don’t see skanky taking the time and energy to bury her. I’m confused. Also would like to know if we’ve ever been told definitively that the stain in the trunk of the car was human decomp. I know that the one hair had the death band on it. I know that the air was found to contain human decomp. But what about that stain?

    Also just saw a couple of old videos over on the Fox blog. In one of her conversations with Lee, skank tells him that she talked to Caylee on the day Cindy found her (July 15). The call came in around noon but it was from a private number.

    In skank’s statement to the dispatcher during Cindy’s third 911 call, she says that she spoke with Caylee earlier that day but the number tha the call came from was no longer in service. Two completely different stories about the same event.

    WOW I forgot about that IM chat between Casey & Tony Thanks Slvr!! Made me want to share, after re reading a few times the most telling fact to me is the *DATES*
    You can see through all their communications the consistent theme of Casey wanting to please Tony. They become closer and more exclusive, you can see the lengths and lies Casey is willing to go to to obtain the “girlfriend status”. I believe in one of their earlier chats the topic of being his exclusive girlfriend was discussed and Tony is letting her know she could be possible girlfriend material but not unless he can see her on a regular basis (without Caylee, Tony also makes it clear he prefers Male children). He also makes comments about her continuous flaking on their plans.

    Jump ahead to the TUESDAY JUNE 10 section on this chat Casey has obviously been teasing the boy online so he wants to come n get “some”. When she figures out he is really planning to come over her EXCUSE is oh no I respect my parents too much (HA) but she continues to placate him telling him only a few more days, just give me a little more time and we can do as we please (bump uglies uninterrupted). They are also dropping the I love you’s by this point.

    THURSDAY JUNE 12 As usual Casey’s lies are running out of time. Motive. In my opinion Tony was the one thing she was not prepared to lose obviously no matter what. Here we see the set up begin for her Caylee free Tony filled life. La bella vita. She provides him with all kinds of “extra” info he doesn’t seem to care less about. “jules is a funny girl. She’s one of my friends that I’ve hung out with, at my nanny’s place.” (premeditation) “It’s her daughter that plays with caylee all the time.” (premeditation)

    Plan in motion. JUNE 15 last time Caylee is seen alive.

    Update on the Jenkins story, news conference by police to be held on the upcoming hour. Ryan’s mother did apparently now comment, that her son is innocent, and when all the evidence comes in, that will be proven. (she must have been out buying her rose coloured glasses when reporters couldn’t reach her before)

    I want to defend my posting of the link to those pics. I have no intention of offending anyone here but I cannot stand George, Cindy, Lee and Casey Anthony. One of them threw little Caylee’s body in the woods like trash. She was out there with alligators, armadillos, squirrels, snakes, rats, wild dogs, wild hogs, spiders, cockroaches, ants and was being picked apart by these creatures. The Anthony’s deserve to be treated like garbage. I think some of the bloggers truely wish they’re reading these blogs and maybe one day one comment or picture will hit a nerve and they will finally accept what has happened and try to make it right.

    Also, humor is some people’s way of dealing with tragedy and there is nothing wrong with that. Remember, when the space shuttle blew up? The jokes started “flying” around like crazy. What does NASA stand for? Need Another Seven Astronauts.

    Boz, respectfully, if we treat them like garbage, what seperates us? I can tell you as an absolute fact they read here. I stand for Caylee, and I only know she loved them, and out of respect for her I stick to the facts as best I can with a fit or 2 here and there, but that is my choice, and how I prefer to keep my house.

    I think that what has captured so many people about this case is that it is SO OBVIOUS that KC and no one else is entirely responsible for her daughter’s death! Her family, without question, has flipped sumersaults to help her but all they’ve really done is communicate the web from which she (KC) was spun! I am more and more disgusted by this family and the monster they have created as the days go by. Where once I had compassion, I now have disdain! When will these people have to reckon with the reality of what they have created, aided and abbeted???

    there is always a time and a place for dark humor. Dark humor helps us cope and helps us get through stressful situations. But, again — there’s an appropriate time and place for it. Yet like all things we use to help us cope, we can over-saturate ourselves in it, and lose the healthy boundaries that we need to help keep the communities we choose to engage in civil and constructive.

    I think it’s obvious that *nothing* you, I, or anyone ever write here (or anywhere else) will reach Cindy & George Anthony and make them change. They’ve made it very clear that they choose not to live in a fact-based reality. Insulting language directed at the Anthony family will most certainly NEVER spark in them a conversion toward truth and justice. If anything, it just hardens their hearts into the “righteousness” of their ways and reinforces their “Us vs. the rest of the world” mentality.

    Blink says it best — “if we treat them like garbage, what separates us?” I’d challenge folks here to similarly moderate their own posts regarding when it comes toward name-calling directed at Casey. The girl is a murderer. I have no doubt about that. But regularly calling Casey “skank”, “ho” and other gender-based sexualized terms only devalues *all* of us as a whole, and paints the writers of this forum as juvenile. We shouldn’t be moralizing on how any of the Anthonys SHOULD be behaving, when at the same time we’re willing to use language and show behaviors that we wouldn’t accept of our own kids on the school yard (or rather, I HOPE we wouldn’t accept of our kids!)

    Sorry to be a stick-in-the-mud about this, especially in today’s society when we have multiple media empires based on name-calling and devolving the conversation down to the lowest common denominator of your chosen echo chamber. I just prefer to think that each of us, as individuals, can (and SHOULD) be better than that.

    RCMP News conference, they do know who woman is who helped Jenkins, suggested ‘they knew each other’ but no details how. No opinion yet on her ‘role’, but if there were to be charges after the fact, it would not relate to the US charges against Jenkins, but potentially would be only to the Canadian criminal code to offenses ‘in Canada’, offenses under the Canada Customs Act etc. He can’t comment for US authorities as to what they might wish to do. They are not appealing for her to turn herself in, just advising they know who she is, that they can locate her, the main thing the RCMP want to get out, is that they are convinced that she is no danger to the public. They will not identify her at this time. Two investigations– 1. how he got into Canada and how he got to the motel in Hope, 2nd is how he died.
