Caylee/Casey Anthony Case: Padilla Interviews Released Today

Orlando, FL– In the latest blow to the defense team dealt this week, The interview recordings of Leonard Padilla, Tracy Mclaughlin, Rob Dick  and bail bondsman Tony Padilla are set to be released today.

Padilla and his team met with Agent Nick Savage of the FBI and a member of the Orange County Sheriffs Office in their home town of Sacramento, California last Fall.

Lead Investigator Corporal Detective Yuri Melich was slated to make the trip to interview the bondsquad personally, but was injured the morning of his flight in a motorcycle accident.

Jose Baez and the defense team for Casey Anthony argued to keep the Padillas et al out of the witness box alleging their was an “agency” established between he and the group, which would render their testimony work product and privileged. Not only did Judge Stan Strickland say in open court that he had never seen such a motion; he denied it entirely.

Tony Padilla, through Prosecutor Linda Drane Burdick, alleges that the agreement contained in the defense motion was not even the agreement signed by him in the first place. Ms. Burdick requested the originals of the agreement in question; it is unknown at this time if they have been turned over.

    To explain her actions, or lack thereof, Casey has stated “everyone grieves differently”. Well Casey, once you show me the parent of a deceased child that seems more interested in the nature of their own welfare and not of the child, and have a psychologist sign off on that, then you might be 1 percent truth in a 99 percent sea of lies. Until then, leave that to the experts to document and present history of an actual diagnosis of the severity of grieving differently, even to the extreme you are taking it

    I am wondering why the trial date for the murder charge is set so far out? Is that standard procedure in a capital case? Or is it because either the prosectution or the defense requested it…ie (they need more time)?

    Blink in previous posts your opinion is that her fingerprints are on the duct tape and eventually Casey will try and get a plea deal. When do you think the fingerprint proof will be released and will the State even entertain a plea from her with such solid evidence?

    Also wondering…how far in advance of the trial date, does the State have to give ALL of the discovery to the Defense? I have heard it said the Prosecution will hold the crucial evidence until just before trial. But that doesn’t seem fair to the defense? I must be missing something.

    While I found a great deal of the information provided in the interviews to be interesting, the part of me that wants to see more meaningful evidence that can be used to resolve this case and find some level of justice for poor little Caylee is dissatisfied. Yes, behaviors described in these statements make most of us even more furious with Casey and the Anthony family. But how much of it is meaningful evidence?

    - I was troubled by the unprofessional atmosphere in the TM interview. A tremulous, sometimes vague, and laughing witness (TM) does not help establish credibility. Couple this with a deposition atmosphere that sounds at times more like pals clowning around and talking smack about somebody than a serious legal interview, and I believe the result is an interview that is mostly trivial from an evidentiary perspective. TMs statement does confirm my suspicions regarding the demeanor of the Anthony family members, but we need admissible evidence about the death of little Caylee, not more soap opera-like talk show fodder.

    - Much of the “bombshell information” is hearsay: Blanchard Park and other key aspects are not provided as direct evidence. The direct refutation of LP’s version of events by TP (that he did not hear it directly) can probably be used to impeach LPs statements altogether. I am afraid a case could be made that much of the information in these statements is irrelevant and inflammatory.

    - Yes Casey seems to be a real headcase, but describing her annoying and self-centered idiosyncrasies does not a murder case make.
    Blink, I really hope you are correct and that the key evidence which will slam the door on Casey and this case is still in the hands of LE, and has not yet been released in public.

    My second hope is that while these statements do not make a case on their own, that they do:
    - Provide information that may lead to other evidence through investigation and interview (LE interview Cindy A. on the stand regarding Blanchard park statements, etc.)
    - Help build the case with regards to CA behavior and demeanor. Not direct evidence, but helps the prosecution paint the complete picture.

    Gypsy, my guess is Tracy was so nervous because often I’d hear a deep sigh/exhale from her after she told the investigators something. Yes the laughing was annoying, but I do feel it was nerves hand in hand with fact Casey is a MASTER manipulator. notice Tracy mentioned Casey “was a nice girl, easy to like if it weren’t for the fact she was…” then Tracy stopped talking. Coming short of saying a murderer I’m sure.

    Think about it. Charles Manson apparently has something about him that people couldn’t help but follow once he hooked them. Casey’s not a lot different. She makes folks feel guilty for thinking anything about her other than “how wonderful”.

    The only thing I can figure with Tracy’s laughing is her mind is still trying to wrap around Casey. Like us all we are drawn to this because we as normal people can not understand how a mother can act like Casey did. At the time this interview was done Tracy knows Caylee is dead, she’s going back to the time she spent with Casey and Caylee is just missing and Casey doesn’t have a care in the world. Tracy like us all can’t understand this so as she’s telling what she witnessed it doesn’t make sense in her mind so the laughing is Tracy’s way of coping. I do not cope this way but can understand it. IMO

    i was kind of grossed out at first but im trying to keep an open mind because she did do a tell all.

    my brother when he was much younger (actually sometimes he stills does it) – he would laugh when we got into trouble, or when someone yelled at him, or he was asked a serious question…everyone thought he was a jerk for doing so but come to find out – he laughs/smirks when he is really nervous..

    im not sure if its the case with tracy but it kind of sounds like her laugh is relieving her rather than laughing because what is going on is actually funny. JMO, remember! lolz.

    I agree sage…and also we need to remember Tracy was well aware this was national and even international news already. Additionally it’s clear she started to believe Casey was involved and certainly knew 100% when the air-test results from the trunk came back. So most likely she was well aware anything she was saying to these investigators would become public knowledge. That would make me a bit on edge.

    I felt that when Tracy laughed, it was usually when she was recounting something incredible or derogatory. As if to say, “you’re not going to believe this” or “I don’t want to say anything bad about Casey but…” I also think she was probably nervous. These are bounty hunters not psychologists. Can you imagine being in that home? I cannot find any cause to criticize Tracy. I appreciate hearing her ‘take’ on the Anthony family and Casey in particular.

    I think casey is less of a master manipulator than she is a junior con artist. Perhaps she aspired to be Manson like, but she had a long way to go. Manson would have charmed/conned Amy H into ‘freely’ giving him all the money in her bank account; casey just took it behind her back

    From listening to the tapes I came away with thoughts that Tracey was nervous during the interview realizing that it would be scrutinized by not only national, but, international attention. The fact that we have not heard a word out of Tracy until this…., is telling in itself. I came away from listening with a feeling that psychologically Casey does not live in the same world we do.

    I came away from all 3 interviews with feelings that we have more pieces to the puzzle to add to our strange puzzle we are putting together. And the fact that 3 people can testify to the same reactions by the whole family is very important to add to the prosecutions case.

    Clint, I will let Maura and Silver point out the “evidence” provided from these very revealing tapes. I bet they are out enjoying the holiday weekend. I am awaiting their view points on the tapes.:)

    To me the biggest bombshell this week has been the duct tape. I think the new revelations have a lot of Blinker’s still jumping up and down shouting. JMO

    I love the part that LP comment on the change of the A’s after decomp results came out ..flat and agressive denial and really started pushing for searches and Caylee-is-alive and “my-gut-telling-me” tales she was close..We all remember that .Poor little angel!
    I do need you help,please..trying to figure HOW the legal picture changes afer Cindy and George became whitnesses for the State. Have they been forgiven all the sharade and expencess ( Tim Miller TES)? How does State benefit from that particular fact? Can you just imagine them stop lying?

    Anyone make it through the Cindy/Matt Irwin tape? All I got out of it is:

    - it starts with Cindy getting in a car and complaining that LE took her computer zip drive (she loaned it to Yuri to give him Caylee pics for the amber alert that never happened) and how she can’t afford to replace it, and that she didn’t like the way Yuri questioned Casey, and that, yes, Casey did lie a bit, but that’s meaningless

    - then it sounds like they are walking in snowshoes across the tundra, with the mic in yuri’s pocket

    - then for an hour it sounds like they are standing around a noisy lobby at intermission, with the mic in Irwin’s sock

    - then more snowshoes

    - then it ends with Cindy getting in a car and saying she wants her zip drive back.

    Was there anything good in the middle?

    Why is Cindy going on and on… never mentions Caylee as she goes on and on and on. Until Matt brings up Caylee– then she goes on and on and on about ‘it’s only about Caylee’. So what the heck about Casey– why worry about ‘her fair shake’ at that point, if it’s all about Caylee.

    She doesn’t stop talking.

    Then she goes back to blame blame blame John and Uri. Why isn’t George having this conversation on behalf of his wife, taking pressure off her as he’s been a cop, he knows what and why.

    Suz #122 – very interesting, Cindy talks non-stop for longest time, making accusations and complaints, and when she finally lets Matt Irwin get a word in edgewise, he says something like: “…well… I’m here for Caylee…”. Very telling moment. Yes, duh, they were supposed to be looking for a missing child.

    I think the real agenda: finding Caylee, versus this family’s agenda, their day-to-day concerns, especially Casey’s (her looks, popularity) as revealed in these tapes, must have been stunningly shocking to all who were within earshot. I attribute this also to Tracy’s laughing on tape – it was only 2 months since baby had gone missing, surely what she was experiencing there was unbelievable, even to her, even though she experienced it first-hand.

    I was thinking about the pic of the law office and it said in previous post they cover real estate and lots to do with land type law and issues my thought is possible g & c could have used them to inquire about the legal aspects of the land where remains were found they were looking into buying and possibly looking at what they could do to keep people from looking there or having the memorial crosses and stuffed animals there cause we know they didn’t like that also maybe legal issues with sending PI’s out to that land with video cameras does anyone know if there is a date associated with the pic?

    I wish they would have let George at her! It sounded like someone was fnally going to confront Casey and make her say where Caylee was…its just too bad that he left and didn’t continue to act like her “dad”. It just seems like most people use kid gloves with Casey and I’m not sure why.

    The thing I got out of these tapes is that by time LP and buddies bailed Casey out, nobody in the family was really wanting to look for Caylee. They knew by then. I think Blink is on to something about July 3. Only George wanted to know what happened to her, not where she was or who had her.

    These people just astound me. If they were really trying to make a good story for Casey, why didn’t they use that money they collected to LOOK FOR CAYLEE??? Why didn’t they use it to look for the Nanny? When LP bailed out Casey, nobody in the Defense team, or her loving grandparents or Uncle Lee even tried to get Casey to help find her baby?

    Now that is the telling testimony that LE will get out of the Padilla bunch. This bunch of slacker liars were not concerned at all to find their baby. By then, they were into this for the money.

    Blink or anybody: is there anyway at all that Casey’s chloroform statements can come into the trial? Please tell me there is a way.

    That missing laynard is missing for a reason (or was until immunity kicked in, possibly, perhaps).
    I’ve thought for awhile that perhaps the lanyard was either found by
    Mr. Middle-Finger at his rental home/property after he returned from working mid to end of June out of town, or around the Suburban area and kept out of the “hands” of LE not to implicate his Tiffany-Ring-Finger sister.
    Or perhaps Mrs. A. discovered it on July 3, maybe in the backyard while preparing for the delivery of new pavers, which might have been the trigger for that days flurry of events.
    (Although IMO it is possible she uncovered her little grandaughter’s shoes or sandals – - I’m remembering the phantom phone call from Zanny where supposedly the baby “talked about her new shoes”.)
    IMO if the lanyard was discovered by a family member it was in such a manner or under certain conditions to have been extremely disturbing.

    All these, of course, are hypothetical opinions only.

    Hearsay (per the Federal Rules of Evidence) “statement, other than one made by the declarant while testifying at the trial or hearing, offered in evidence to prove the truth of the matter asserted.”

    Florida *pretty much* follows the Federal Evidence Code with a few exceptions — none of which, off the top of my head, would render what I’ve read of Tracy’s testimony inadmissible. (I have not taken an hour to listen to it… but if I can’t sleep later, I just might.) If it’s helpful, I can try to locate a comprehensive list of the distinctions later.

    Interesting chat over lunch Cindy and Matt had, I heard later on the tape, it was OCSO and this was probably their ‘Cindy make nice’ attempt to try to get everyone working together for Caylee. It was a hard sell to Cindy for sure. Hard to listen to with all the background noise.

It takes some paying attention to. Will work on the rest later. She is definitely being as difficult as she can, to a live Caylee’s detriment. She had to know or she would shut up and help and not care if Casey was in a high bond, or if Yuri was doing his job by wanting to come to the house to talk. What the heck– make him have a warrant to talk to Cindy, unless he meets Cindy’s timetable and demands that she dictate where they meet??

    Why couldn’t Cindy accept that when LE came to the door unannounced, she was not in control– she needed to invite them in and ask her daughter to stay in her room or go into the sun room. Not say go get a warrant if you want to come in. Then complain about being outside for the visit. Anything to complain about anyone not buying their wares.

    Oh, kleat reminded me of the couple of interesting things i did manage to hear on the cindy/matt irwin tape-from-Hades:

    1) cindy volunteered to that they have been keeping casey off the computer since she has been home from her initial jail stint (but doesn’t this contradict what Tracy said?)

    2) cindy said kc was never left alone in the garage, where the missing lanyard was. Well, technically I guess she was right, cuz IIRC casey was in there with LEE while the cops talked to geo and cin on july 15. Hmmm…

    I am watching the Shawn Hornbeck 48 hour mystery show and I am so outraged. How is this young man ever going to be alright? What can we do as parents to protect our kids?
    I live in Omaha, Ne and have worked with Mrs. Gosch, Johnny’s mother, to help people understand what happened. I just wish I could do more.

    Okay I just read the story on the lanyard….
    also the diary pages that I had forgotten about and people think George is Caylees father?

    I keep wondering if the LE did their hands on the diary pages and how was this brought up if it didnt exist as the photos of the diary did show where pages were ripped out of it.

    I just wonder and wonder what we will NEVER see if this does not go to trial… dang it.
    Do any of you Florida legal eagles know that if this doesn’t go to trial, will the rest of this stuff be released anyway?
    Isn’t it the publics right to know the whole story?

    Clearly Cindy Anthony knew full well that her daughter Casey was lying to her. She knew Casey was lying to her-remember Cindy had been trying to track Casey down for weeks, at the least since the 4th july weekend. She knew that Casey was in downtown Orlando when Casey was claiming to be out of town.
    I personally dont know how LE managed to cntain themselves in the face of all of Cindy’s bullchit.
    There is no doubt what so ever that the Anthonys knew that Caylee was no longer alive. God knows what Casey has told them-but guaranteed it has no basis in the truth.
    I found it rather hilarious the way Cindy complained about the detectves already knowing the answers to the questions they posed to Casey. And this was unfair, how? I think it may be time that someone acquaint Cindy with the work that detectives actually do??!!
