It is unclear how Mr. Scheaffer attained the recorded audio which has since been removed from the WFTV site, but what is clear is Ms. Lyon knew her segment was being recorded.
..My Client is human, it’s the jury I’m worried about..” ..Sometimes ugly is presiding… or do you have really great judges in Florida?.. “I have a case right now where both the crime and my clients confession are on on videotape.. I just think that’s unfair.. I mean, one or the other, but both?..
I wonder if anyone has asked Alton Logan what he thinks about it?

I agree wholeheartedly with this statement. To not address the issue, simply permits the perpetuation of a negative stereotype of ALL defense attorneys. I believe that it is not fair to regard all defense attorneys the same because of statements made by one. However, since she is an instructor, there needs to be no excuses made for the disparaging remarks about judges, jurors, or prosecutors. To not condemn, or address, these attitudes exhibited at a sponsored teaching seminar takes on the appearance of an ENDORSEMENT of them.
I listened to the first part when WFTV broke the story, and was aptly disgusted. That said, my disgust was not limited to Ms. Lyons’ attempt at rationalizing her role as a death penalty attorney. I was also disgusted that WFTV aired the lecture.
Don’t misunderstand. I was throwing up in my own mouth listening to its content–in fact, could not get past the first tape. But then I started thinking of the unethical and disgusting motive behind airing the lecture, I felt the lecturer and WFTV were equally despicable.
I wondered how the tapes were obtained, but it doesn’t matter. WVTF, in my opinion, had stooped to the level of the defense team. These tapes are as inflammatory as those of Roy Kronk’s loving family, with equal parts of BS.
We laughed when the defense filed a change of venue motion since we all knew it was their own big mouths that were responsible for “tainting” the jury pool. Has WFTV now insured a favorable ruling on this motion? How unnecessary!
WFTV did the right thing (finally) by removing them from their site. My opinion only, of course.

Poor Mr. Alton spent 26 years in jail for a crime he did not commit, and Andrea Lyon knew he was innocent…..and worse yet, she knew who the guilty man was…I don’t know how that woman sleeps. She is morally reprehensible!

Although I have been pro Death Penalty, Andrea Lyons has made a good argument for the abolition of such an act, and Alton Logan is prime example of why I am starting to change my mind.
I now understand why Andrea Lyons is against the DP, better to have an innocent person spend the rest of their lives in Hell then to Die on her conscience.

The motive of a news station is always to create sensation to get viewers to watch.
The alleged method of acquiring the tape, and the motive behind that, appears more unscrupulous than the station’s airing of it. As an aside, other news stations went with the story as well. It is a part of the larger picture, I suppose, and quite dispiriting as well as eye opening.
As to the change of venue, Silver indicated a long time ago, on Blink’s, that the judge would approve it. He doesn’t want to risk issues for appeal, at least with something basic like that. So in that sense, I don’t think that the airing will have altered the decision to be made by Strickland, it may simply have cemented it.
I concur, they will get the change of venue should it go to trial, which I still doubt.

I dont have any expertise in law or anything like that but I hope I know right from wrong—although Ms Lyons would say she had to shape that theory. She was introduced as one of the most prominent defense lawyers in the nation. In my opinion, that is scary. From what I got listening, she is just wanting to promote her death penalty agenda with Casey and has already gone past guilt or inocence—do or say whatever it takes to get to LWOP because everyone but her is really STUPID!!! Maybe what she and the Baez team do and say is legal but is it moral?????????????? Shouldnt there be some standard for that too????
Alton Logan was not on death row, so I feel A. Lyon could care less. Abolishing the DP is all that matters to her. But I’d bet everything I own that Mr. Logan felt he was serving a death penalty. There is no excuse for A. Lyon’s actions in that case, none. JMO
If this goes to trial, there will be an automatic appeal — incompetent counsel. automatic — maybe this is what they’re hoping for — nay, that would take a brain. Too bad there is not a remedy before trial for incompetent attorneys, change of venue, change of attorneys.

My simplistic and observational opinion of Ms.Lyons is one of a perplexed career path. Using false, and occassional forced emotions to manipulate a person, or a group of persons, such as a jury, instead of with truth and evidence being the catalyst which determines your defense strategy is geared more towards Hollywood, and not that of a judicial setting

I usually pick up anything I see that pertains to the case. I just came back from the grocery store and picked up a National Enquirer. They had some interesting info. They said that the prosecution has a secret eyewitness.
” Sources say investigators initially found evidence that Casey tried to drown Caylee in the small Above=ground swimming pool in the backyard- but she apparently got cold feet and stopped.
Now the secret eyewitness has filled in missing pieces of the puzzle and helped police pinpoint the time of Caylee’s murder- sometime between just before 3 pm to a little after 4 pm. During that time, a white car matching the description of Casey’s was seen parked off the road in a wooded area five miles from the Anthony home. After not going through with the killing Caylee in the backyard, Casey took to driving aimlessly around in what police believe was her attempt to look for a secluded wooded area to murder the child”
The article goes on to say “The motorist saw a woman he later identified as Casey Anthony leaving a white car parked alongside the road. She was carrying a bundle, possibly a trash bag the size of a small child, in her arm he said. The witness told police he parked his car several hundred yards ahead of Casey’s. He was about to turn around when the woman returned to her car a short while later. She put the bundle inside the trunk, closed the lid and drove off. Police theorize that Caylee was in the bundle and was dying at that point.”
They continue ” Investigators now believe they can show Casey knocked out her daughter with an injection of cholorform solution- and thensealed her nose and mouth with duct tape….. The eyewitness remembers seeing Casey holding a Gatorade bottle along the roadside before she picked up the bundle and went into the woods.”
Dr. Jake Deutsch, a New York based emergency medicine expert said there had to be a “pretty substantial amount” of chloroform inside the bottle and the syringe, or it all would have evaporated. “So this was something that was drawn up with the purpose of administering it for illegal purposes,” concluded Dr. Deutsch.
Blink, do you still think that this Wont go to trial, and if so why? The way I am understanding is that the defense cannot ask for a plea, and if she got a plea doesnt she have to say she is guilty of murdering Caylee?
Blink, WHERE can we get the rest?? Someone, who posted to YouTube, probably has the remaining audio, breaking down the audio into shorter clips for YouTube. But one of these people posted that they removed Schaeffer’s recording, did they also remove Pt2 (wftv pt 2) or not put it up before they got worried about the situation?
Definitely NOT complete– I remember seeing the first audio, listing to part of it at that time. Then the next time, played the pt 2, which is not all all covered in these available audios. I posted (after some concern was allayed) the scant notes I had made from some of the second half of the lecture on the prev. thread.
Sure be good to find the second half of Lyon’s talk– you know, the one with the nasty woman prosecutor comments, etc.

The defense has people (who don’t read discovery well), believing that Kronk was a bad person who did something wrong with Caylee’s body, like moved it somewhere waiting for the reward to climb higher (as if there was ever a reward for finding a dead child), and that these TES searchers walked over the body and that the ‘whole truth’ is contained in their statements, not defense versions that actually disguise the ‘truth’ (some might suggest stronger language, like the defense is avoiding a lie on a technicality). The second belief is ‘the body was not there because of Buchanan, Jordan, oh yes, and there’s Wray too, she’s serving a purpose in this, and all those other TES searchers who will prove that Tim Miller is lying.
It’s not going to wash, but they can make use of this deceiving of the public, until trial, so the jury is primed with beliefs before they even get chosen.

We are probably in agreement.
I am against the death penalty, but these feelings were not influenced by Lyon. I am all for doing what it takes to keep someone off of death row, but an innocent sitting in jail is no less of an atrocity to me. People are raped, beaten, lose their freedom, families and mental health at times. For me, personally, if I had LWOP vs DP, I might want the DP. Would you sacrifice everything to sit in jail, so that one person isn’t put to death; particularly one who may not be innocent? Would you confess to killing Caylee so that Casey doesn’t go on death row? (rhetorical)
The motion filed regarding Kronk, may well be within the law and a good action to represent Casey in court. However, the media stunts that completely destroyed his character were abhorrent. He is not the prosecution or opposition. He is a witness. So even though he won’t be spending life in jail, who knows what will happen to him. Richard Jewel didn’t live very long after the accusations made against him. Stress is a killer too. The same can be said for innocents that go to jail. And let us not forget that if Casey had even considered a plea deal, Ms. Lyon would not be involved in this case, and Casey might have gotten time with the possibility of parole.
I can’t speak for others, but what was most offensive for me, was the utter disdain that Lyon had for jurors, the system and even victims. She didn’t come across as an “angel” concerned for all humanity. She seemed egomaniacal and one who wanted to win more than anything: more than she gave a sh*t about the plight of anyone in society.

This mess is insane. We are expected daily to sit with our mouths tightly shut while the scummy defense team slimes their way on every available media, tainting future jurors, ruining lives, destroying evidence, ~ you name it, they’re doing it.
BUT if any one DARES to comment on their possibly illegal behavior they are viciously attacked!!!! What am I missing? Does this make ANY sense to ANYbody? What the hell is going on? Are there no laws in place to prevent this legal shamble? If not, why?
After listening to Ms Lyon discuss her procedure in achieving LWOP vs the DP for her clients I think we have a very clear idea of exactly how the defense will be proceeding in this case. We already have the tearing the evidence apart as junk science, we already have them ripping into witnesses creating a hostile environment, since day one they have been throwing everyone under the bus as possible murders to raise doubt..all that is left is convincing her client to make a plea agreement.
She has a formula for defending these cases and obviously uses it every time. Just as they have used form motions, insert name here..
Although it was an interesting lecture from the standpoint of learning what her strategy is..and how it never changes…I personally find her odious. Someone needs to knock her down a peg or two. But she certainly made it clear that her normal agenda is to plea out her clients. Here’s hoping Casey won’t go for that…just so we can see Lyon defeated in court.
I believe this MUST be addressed now. There are still months to go before trial ~ can you even imagine how much more damage they can do in that time? How long before they start confiscating bloggers computers and implicating us?
i had just been telling myself that i was nt going to address any defense theories cuz i wouldnt want to be provider of feedback data,thanks blink for the heads up ,thats what lyon says in this -she needs to answer/address the questions the jurors have on their mind-(and to test out theories i’m sure)im not givin,ON a different note the case seems to fall in line with what she says ,first you offer resonable doubt (as to could they have been there , check,could there have been someone else,check,)just to get it to penalty phase so you can fight for their life.this reminded of the angry crowds at hopespring,so,i get that their saying that their not saying kronk, is quilty,just that le shouldve considered him a suspect,and then its his ex that brings in the reasonable doubt ,pure hogwash,putting duct on someones hands does not equate,thats as much as i am saying,but i see this falling right in line with lyons lecture,agenda shes out to save casey’s life from the prodeathers on the jury once she’s found quilty .
I really don’t understand…..how can Florida Defense Lawyers Assoc kick Bill out of the association but Baez seems to be able to fly under the radar on everything with the bar association? Lyons made a speech seems to me reproduction of that speech shouldn’t be any worse than defense lawyers selling a story and making money off of a dead child just to keep the killer from the same fate as the child.

Lyon was talking about her very own Ms. Casey Anthony, she didn’t say she had two such cases, now did she!
Offer of proof that investigators have Casey talking about those stolen cheques on video: July 25th afternoon, Casey talks to Cindy and to George on jail video.
Casey to her mother: “I don’t care what I have to do… when I told them I would lie, I would steal, I would do whatever by any means to get her back, that’s exactly how I feel, it’s the truth.”
and shortly thereafter, Casey talks to her father when George asked Casey if she had borrowed or taken anything from anyone and could that be the reason Caylee was taken (George has his Baez questions to ask Casey, list!).
Casey answers: “…. mom knows the stuff that I’d taken from her, we’d discussed that on numerous occassions… and with Amy, you know I… I feel guilty about that, I feel extremely guilty, but I was under… a time of desperation.”
George responds: “Well, what do you mean a time of desperation? What do you mean by that… a time of deseperation… I don’t understand?”
Casey does not answer– she says Lee advised her, and this was very smart, that written contact would be better than anything that’s going to be recorded… since we can’t speak openly, freely, in person.
George is satisfied and says: “I won’t take time going into anything else then…”
(no wonder George’s big fat binder with all his notes disappeared!!! Baez would not want George caught with his ‘questions list to ask Casey when it’s being recorded and will go public’– now wouldn’t that be interesting— this whole jail chat thing was Baez directed and produced– remembering how he fought to have the August 14th tape released). Baez wanted Casey to answer George’s question– this is the reason I stole Amy’s cheques– I was DESPERATE to get my daughter back!!! And I made big mistakes, went off on an ‘ugly’ copying adventure instead of thinking straight– I am only guilty of trying to help my daugher, to save her’ defense.)
Blink– would using ‘I was desperate because… daugher kidnapped’ be a viable response in the check fraud case? Or would it be a trap– bringing in the capital case and opening up a can of nasties for Casey by admission of related evidence? They will have to hold that defense off until the capital trial, and explain the check fraud at that time?

Casey Anthony will spend another holiday behind bars Thursday.
Anthony, 23, will spend her second Thanksgiving at the Orange County Jail, and it appears as though she’ll celebrate the holiday without family.
Jail officials said none of Anthony’s relatives have scheduled to visit her.
It’s unclear if defense attorney Jose Baez will visit Anthony, as attorney visits do not have to be pre-scheduled.
Anthony is accused of killing her 2-year-old daughter Caylee.
It will be a typical day at the jail Thursday, a jail spokesman said.
The holiday menu includes oven-roasted turkey, seasoned potatoes, mixed vegetables, cranberry sauce, pumpkin spice cake, bread and juice.

I’d ask Tony Pipitone if he knew that just a few months prior, Andrea Lyon did have someone on death row, and he got off!!! He forgot that– or did he know that the convicted multiple murderer of his father, mother, aunt, brother, and almost killing of his sister-in-law, was the subject of an MSNBC special about death row inmates, and that this was before Andrea’s client was executed for his crimes?
Yes– sneaky Mr. Pipitone, either didn’t do his homework, or he twisted his facts to make one thing seem another.
Ms. Lyon does not have anyone on death row because they executed him recently. (Eric Wrinkles– he also, was on Oprah talking to his estranged surviving family members before he left the row).

Was Ms. Lyon’s claim to fame with Pipitones ‘she can safely claim no one on death row’ as Lyon came onto the Casey case last spring, because her client, Mattew. Eric Wrinkles, as featured on MSNBC’s ‘LOCKUP’, was executed on December 11th, 2008?
Is Lyon telling Casey a ‘half truth’ with “I have no one on death row… so don’t worry about a thing, little darlin’ … I am legendary and old too… trust me”.
This is the ‘execution order’ that helps prove Ms. Lyon’s claim about ‘no inmate on death row’ via her little mouthpiece Pipitone (darn, they do a good job hiding those little strings!):
Execution order: Interesting coincidence, as one of Lyon’s clients leaves the prison grounds before sunrise, Mr. Kronk is set to re-discover the murdered child’s remains in the now water-receded area off Suburban Drive so authorities could ‘bring her home’.
Moreover– this coming December 11th, both Casey and Ms. Lyon, will be in Judge Strickland’s courtroom. Will Ms. Lyon tell Casey, that when she is showering and dressing so early before sunrise, that this was the hour that Ms. Lyon’s last inmate on deathrow, was preparing to walk to the death chamber?

But, as Ms. Lyons so clearly points out to her collegues, that she wins about “ONE MOTION PER DECADE”… so she is really looking forward to ‘next year’ (that’s the year of Casey’s trials, of course!!– now, if you were Ms. Lyon’s or anyone’s client, facing death, would you want your lawyer to be betting on statistics for winning motions???? Would you put all your faith in the lawyer who has lost every motion in past 10 years (it’s Lyon’s own words– one per decade and she’s overdue now) because she’s ‘due’ to win one in the next decade, and that maybe it will happen in the first year of that decade (ie: 2010???)
What does this say about Ms. Lyon’s ability to win her motions? Not much– if we add in the way her motions are actually written… and have been rejected time and time again by this very same Judge Strickland court.
Now, following Ms. Lyon’s (albeit maybe probably giving-benefit-of-doubt) logic, should one of the motions being considered at this time, be accepted, what does that do to Ms. Lyon’s theory that she will need to wait, statistically speaking, another decade to win the next!!!
Pay attention Casey– do the math!!

This comment was taken out of context so it doesn’t make any sense, but within the lecture it makes total sense. She’s passionately against the death penalty. So am I. Her humor may seem inappropriate, but as a law student it seems par for the course. I just don’t see the big deal here.

YES YES AND YES! That is the biggest problem with our legal system in this country as it seems much of what is actually “law” today has absolutely nothing to do with what is truly genuine, right and moral. And for too many defense attorneys (not all but many) it does in fact seem as if it’s win at all costs … no matter the collateral damage one may do in the process. How do two wrongs ever equal a right by any means???? THAT is why the general public has so much disdain for this profession IMO.
I did listen to both audios. I can see she is already using her ‘key words’ on national television. The exposure is enlightening to say the least. I am wondering how Judge Strickland is going to handle this last nationally televised stunt from the defense on Roy Kronk. The video of Casey’s reaction to the finding of the remains was sealed from the public for being too ‘inflammatory’ The defense goes ahead and releases ‘very inflammatory’ video from Roy Kronks ex-wives, family members and it’s okay? He’s not even a suspect in this case. The tactics of the defense is ‘unconscionable’. I hope Judge Strickland puts a stop to this outlandish behavior and quick. How many lives will this defense ruin? They don’t deserve a venue change even though I’m sure they will get one. They have continuously gone on national television in attempts to taint any potential juror. This is the most vile group of attorneys I’ve ever seen. As for Richard H. on Bill S., Is it jealousy or what? Very immature. I’m afraid he is the one going down from this not Bill S. Sometimes words and thoughts are better left unsaid. Blink what do you think Judge Strickland is going to do in regards to the damage the defense is/has been doing to Roy Kronk? I’m so disenchanted by the legal system right now.

Didn’t Strickland already deny this motion before???? Blink, what’s the likelihood that the defense will ever be able to win this motion? I would think that because EqquSearch isn’t even IN Florida, is not really a witness for the state and because I would imagine (correct me if I’m wrong here), there is some kind of statute protecting volunteers participation in something as serious as a missing/deceased child case that the defense even trying to get this information is some sort of legal violation, let alone not completely ridiculous. Am I way off base here?
Seriously … isn’t there some form of privacy laws or something that protect good natured volunteers when they volunteer for searches such as Caylee’s? If not, there should be as something like this could completely change the state of missing person’s cases forever if Baez actually gets this ridiculous motion granted somehow.
Andrea Lyon’s glib and callous gallows humor seems to fly with this group of Defense lawyers.
In an intimate, less-public setting say, in her living room, this might be appropriate for the type of work that they do. I would think that even the most raunchy professionals (?) would know when to “Zip It.”
She makes some good points about the power of language, however. It’s too bad that she chooses to use that power for manipulation.

seemeatthebeach!!!! Thank you!! And Veilanna too!! What great work!! — I remember the ’3′s’ bit, and before I play that part 4 and 3 etc, I’m going to put them on audio in Garageband. I never use this software, but it comes with the computer and it’s making the audio copying SO easy.
Blink, let me know if you want sections of the audio– I’m going to learn this software well now. I’m sure editing will be a snap now that I’ve got a start.
(I do have a comment about Ms. Lyon’s ‘DON’T'S’ that I think is worth noting– she says ‘don’t’ go after the prosecutor or police unless they’ve done something really bad. The lesson in this, for prosecutors or police, is, that if you haven’t done anything bad, don’t figure you are scott free because anyone who ‘tries to kill’ Ms. Lyon’s client, is by definition, already doing something VERY BAD).
