Caylee/Casey Anthony Case: AND THE FIRST BLINK DARWIN AWARD GOES TO…… JOSE BAEZ

I freely admit I have caught many a fly in my trache while my yap was left hanging open at some of the legal filings by Jose Baez et al, in this case.
The latest motion to suppress the recorded conversation between convicted felon and “lifer” Robin Lunceford and Jose Baez has insipred the first ever Blink Darwin Award, or, THE BLARWIN.
In his Motion for a protective order to keep the call out of discovery, Esteemed Blarwin recipient, Jose Baez, claims he did not know his conversation was being recorded, and apparently, what type of phone line was being used although he states the call was transferred to his cell phone.
HOLD THE PHONE
Pun intended. It would be impossible for him to be unaware that Lunceford was not calling from the Lowell Annex. As Baez is aware, inmates at Lowell Annex MUST have the number they are calling on an approved list in advance AND they may only call collect. From Lowell Annex Rules:
Incoming telephone calls for offenders will not be accepted. In the event of family emergency (such as serious illness or death in the family) you may contact the chaplain’s office. The chaplain will notify the offender.
Offenders, except those in administrative confinement, disciplinary confinement, close management or on death row are allowed to make collect telephone calls. Offenders are allowed to place up to 10 telephone numbers on their authorized phone list. If the offender has not placed your number on the list, he or she cannot call you.
Offenders can change their phone list every six months. There are two exceptions to this policy: < ?xml:namespace prefix =”" o />
- If someone already on the list changes his or her phone number, the offender can have the new number placed on the list.
- If an offender gets married, he or she can have the spouse added to the list.
All telephone calls are limited to 10 minutes and are subject to monitoring (except legal counsel).
Of course we all know that correctional facilities cannot monitor calls between inmates and their counsel. Ms. Lunceford is not represented by Mr. Baez, and if he were interviewing her as a prospective witness as he states, he knows full well he needs to pack the car and head on over to Ms. Lunceford’s pad after requesting the visitation officially.
If the first few meatless morsels of the motion don’t grab ya, I offer my personal fave. “It is a felony”. I have news for you Mr. Baez, the State has already listened to it. This would be how it is DISCOVERABLE, or subject to discovery in the first place.
Now, you know Jose copied and pasted some of the States own verbiage from the motion regarding Joe Jordan’s snafu. A surreptitious recording in a two way notification state is not even in the same zip code as a collect call from jail with NO EXPECTATION OF PRIVACY.
Is it me or does anyone else think this was an attempt at circumventing rules at the Pokey Mr. Baez is so famous for?
You know, the ole “Im willing to have her call me collect, bein’ that I’m on the list.. I will transfer the call to you-
-signed, unknown caller to unknown number sometime in early May.
HINT: If you want to claim something is work product you might not want to disclose portions of it in your motion. It just *Might* give the appearance you don’t want the recording out but want to make an accusation publicly that favors your client.
Bottom Line: An inmate placed a collect call, subject to the rules of the facility in which she is incarcerated. As dictated by protocol, the call was monitored and is therefore subject to public release. I for one, look forward to hearing it.
After all, it did earn a Blarwin, and I was saving that all year.

Blink~ It shows your great insight and generosity to award the BLARWIN to the ever humble but oh so deserving Jose Baez. Thank you from all of us who day after day want to give him the credit he is due.
I so hope that one day, he will be able to sit his DISBlarwin right next to his Blarwin. That way he can fondly reminiscence about his short gig as a lawyer.

I dont understand….why would he care if the call is released if the caller says she lied about kc? wouldnt that help the defense…am I missing something here?….or could there be something baez said during the call that he doesnt want john q public to hear?

I think by the look on the judge’s face he may have been thinking of a similar award. So Jose wasn’t informed it was being recorded… wouldn’t that have been his secretary’s (or whoever transferred the call) responsibility since that person most likely heard the recording? I’d be embarrassed to say I didn’t know it was recorded. He’s not.
I would like to know where you found that original photo. It’s actually a pretty good one. He looks like a fun guy. On the other hand, as to the story:

Even if he succeeded in getting the judge to rule for him, the penal institution has to release the recording under Florida’s FOIA.The judge’s ruling would not apply to them. What a dork………..

I am thinking he has something in that conversation which will incriminate him. Nothing she said would help or hurt KC as it is out who he was talking to on the call. I am betting he has again done something unethical.

I thought that phone calls made from inmates in our Florida jail facilities to individuals on the ‘outside’ could not be placed to cell phones only to landlines or is there an exception when you call an attorney ?

Thank you for posting the rules for inmates telephone privileges. There is no way an inmate in any state can make a call to anyone with out the permission of the recipient agreeing to accept the COLLECT call. You have the option to accept, deny or block the calls. Bozo surely does not think we’re that stupid. If an inmaate buys a phone card and yes they can call cell phones with it but you STILL have to accept the call.

What is odd to me, is that Miss Lunceford is listed as “close management”, which would actually deny her phone access. However, I would assume that was probably due to these malfeasons.

The contents of that call just may be the fall of the House of Jose.
The single biggest thing that gavone has going for him is that there is not a soul in the legal community, or law enforcement, that wants to reset the clock on this case.
What exactly is the legal remedy for disbarring the dude you never wanted to join in the first place?
As long as the FLA bar is allergic to egg on their face, short of video of Baez knocking down a 7-11 with Lunceford, you will not see a change of counsel.
That is a foolish position that has backfired tenfold already.
Hell, Macaloose-o is making reality TV. There is no downside to this for some.

She was allegedly murdered by her Mother, and tossed in a bog to rot, but not before being scavenged piece by piece by the indigenous.
Her duct taped skull was found by a man urinating next to it.

It galls me to no end, that this little girl has NOBODY in her family that puts her first.
It is maddening to me, this cross-section of human condition via fishbowl.
She was a sweetie-baby. She was innocent, and strangers care more for her legacy than her own family.

O.k., wouldn’t the state simply be able to file a motion requesting Jose Baez’ cell phone records for May 2010? Or how about the Lowell Annex filing a motion to determine if it’s procedures were violated by either the inmate in question or the recipient in question? Wouldn’t those records show all of Baez’ incoming calls and the number which the call came from? Wouldn’t the number then be traceable, as to whether or not it came from the Correctional Facility’s telephone system, a rogue attorney’s phone, or a contraband cell phone (as Mr. Baez so handily suggests)? Hello?! Am I missing some important fact here or does this motion seem superfluous (extra, unnecessary)? It reminds me of a certain motion filed to force a judge to recuse himself from a certain murder trial wherein a certain client is accused of killing a certain little girl (eyes rolling). Once again, be careful what you motion for Baez…this one will come back to bite you too! I’m alarmed that anyone with a law degree could be so ignorant. Yowza is right, Blink! Guess Robin Lunceford will be finding herself in a hot mess either way this goes with an illegal phone call-not too smart. Wonder who her attorney is and her visitors can thank Jose Baez for the added attention. Just my 2cents.

I have really tried hard in this case to seperate client from attorney but after witnessing Baez continue to push the envelope ethically, I just can not stand the dude.

I would love to hear your thoughts on Kenney-Baden’s noticeable absence lately. It is my understanding that LKB is the forensic expert on the case and her main role is to challenge the procedures and protocols that the labs used to analyze the forensics…. could it be that there is nothing challengeable in this area?
And while I am asking…. CA claimed that Caylee is alive again…. Do you think that CA is desperate to cover up for all the tips that she generated and for purposely perpetuating the Caylee is missing myth, so she could pocket donations? I suspect that Dominic has some info that is not favorable to the Anthony’s…. but it may just be wishful thinking on my part as everyone seemed to pick sides very early in this case.

I see where wftv.com is reporting that the defense is investigating George. Well Blink you always said that George and Cindy would be under that bus. Lets hope after George’s last appearance that he has wised up to the reality of the situation and realizes that he wont get any help from Cindy if the defense wants to offer him up as a sacrifice to the alter of Casey. Everyone is grist for their mill.
Cheney Mason needs to move on – he might have been a good lawyer when he was younger, but he certainly has lost his touch – and definitely his hearing!

Quick question for you: How can Baez use his Blackberry or IPod or whatever he’s sharing with Casey,during court? How does the court know he’s not communicating with Cindy (3 rows back) collaborating on her upcoming testimony? Or Lee, out in the hallway with his lawyer? How does Judge Perry know (or do we know) he’s not passing messages from Cindy to Casey and vice-versa, thereby skirting the OCSO inmate communication rules? I think the electronics should be mandatorily checked at the door and retrieved when you exit. I don’t trust Baez- he’s already proven himself untrustworthy (“Your Honor we have proof that the body was not in the woods…” “We have proof that TES searched that are and did not find the body because it wasn’t there.”, etc.). ITA-he does seem to have some knowledge of contraband cell phones and lawyers who will allow “illegal” calls. Then again, from what we’ve read from Cindy, he wasn’t exactly been legally ferrying the A’s letters into jail to Casey either. Then there’s that business of having to be warned by the jail not to physically touch/hug his client. Straight up-I don’t trust Baez…I don’t Judge Perry or the Bailiff should either. My own opinion. I think the Bailiff should sit directly behind Baez from now on.

Except in the case where Baez knew, which he admits, he was speaking to Robin Lunceford in jail.
He is a criminal defense attorney, if he is not aware their would be no expectation of privacy on that call, I would be very concerned if he were my counsel.
Secondly, I submit the whole call earlier in the day was to circumvent the rules in the first place.

OMG! Just read the article in the Sentinel stating KC’s team is investigating George. Blink said this a long time ago but I just did not see how the defense could ever put that big of a twist on this case, but they are and will.

Why did the Anthonys fight so hard to keep the autopsy pictures hidden if it was not Caylee? Everything they did points to them knowing that Caylee is deceased.
