Caylee/Casey Anthony Case: AND THE FIRST BLINK DARWIN AWARD GOES TO…… JOSE BAEZ

I freely admit I have caught many a fly in my trache while my yap was left hanging open at some of the legal filings by Jose Baez et al, in this case.

The latest motion to suppress the recorded conversation between convicted felon and “lifer” Robin Lunceford and Jose Baez has insipred the first ever Blink Darwin Award, or, THE BLARWIN.

In his Motion for a protective order to keep the call out of discovery, Esteemed Blarwin recipient, Jose Baez, claims he did not know his conversation was being recorded, and apparently, what type of phone line was being used although he states the call was transferred to his cell phone.

Pun intended. It would be impossible for him to be unaware that Lunceford was not calling from the Lowell Annex. As Baez is aware, inmates at Lowell Annex MUST have the number they are calling on an approved list in advance AND they may only call collect. From Lowell Annex Rules:

Incoming telephone calls for offenders will not be accepted. In the event of family emergency (such as serious illness or death in the family) you may contact the chaplain’s office. The chaplain will notify the offender.

Offenders, except those in administrative confinement, disciplinary confinement, close management or on death row are allowed to make collect telephone calls. Offenders are allowed to place up to 10 telephone numbers on their authorized phone list. If the offender has not placed your number on the list, he or she cannot call you.

Offenders can change their phone list every six months. There are two exceptions to this policy: < ?xml:namespace prefix =”" o />

  1. If someone already on the list changes his or her phone number, the offender can have the new number placed on the list.
  2. If an offender gets married, he or she can have the spouse added to the list.

All telephone calls are limited to 10 minutes and are subject to monitoring (except legal counsel).


Of course we all know that correctional facilities cannot monitor calls between inmates and their counsel.  Ms. Lunceford is not represented by Mr. Baez, and if he were interviewing her as a prospective witness as he states, he knows full well he needs to pack the car and head on over to Ms. Lunceford’s pad after requesting the visitation officially.

If the first few meatless morsels of the motion don’t grab ya, I offer my personal fave. “It is a felony”. I have news for you Mr. Baez, the State has already listened to it. This would be how it is DISCOVERABLE, or subject to discovery in the first place.

Now, you know Jose copied and pasted some of the States own verbiage from the motion regarding Joe Jordan’s snafu. A surreptitious recording in a two way notification state is not even in the same zip code as a collect call from jail with NO EXPECTATION OF PRIVACY.

Is it me or does anyone else think this was an attempt at circumventing rules at the Pokey Mr. Baez is so famous for?

You know, the ole “Im willing to have her call me collect, bein’ that I’m on the list.. I will transfer the call to you-

-signed, unknown caller to unknown number sometime in early May.

HINT: If you want to claim something is work product you might not want to disclose portions of it in your motion. It just *Might* give the appearance you don’t want the recording out but want to make an accusation publicly that favors your client.

Bottom Line: An inmate placed a collect call, subject to the rules of the facility in which she is incarcerated. As dictated by protocol, the call was monitored and is therefore subject to public release. I for one, look forward to hearing it.

After all, it did earn a Blarwin, and I was saving that all year.

    The way things are going I do not see how this can go to trial. Baez,imo, doesn’t have the skill to do it. Mason, so far, has been useless ( at least in court) . Popular opinion is blowing up over the revelation that it’s no longer just last ditch theory, they really Do plan to throw George under the bus.

    It’s funny, one of the biggest criticism of the A’s was that they never held Casey accountable, I say the same for Baez. Singlehandedly almost, he has set a disrespectful tone, asks for special favors, seems to not care about anything but himself,etc. It’s not really for us to demand accountability but the justice system should and the many folks including, GA should counter these veiled accusations and innuendo with a demand for proof, a demand of why a PI has turned over every stone. Those who don’t follow this like us, they only see the headlines and article, immediately think where theres smoke theres fire, Baez needs a dose of his own medicine.

    Caylee deserves justice and I know she will get it.

    how can a grandparents possible suicide attempt stop a jury from deciding death for her – sorry but wouldn’t we all find it hard to keep on living without our ray of sunshine- Caylee’s life should trump caseys, right? i’m sure alot of families of death sentenced people could likely consider suicide as a way out of the madness, but we can’t say everytime at sentencing, oh i think i will kill myself if you give them the sent. of death can we? i think i can understand the feelings but i believe with endless therapy they can comes to terms and salvage some kind of existence, maybe? gosh Margie…i’m working with you

    I would think Baez has alot to worry about with this phone call being released.
    I, too, hope that we will not have to restart everything.

    It sure does seem that everyone wants off this case- Lyon left, Now possibly LKB- talk of Mason wanting to leave…on and on

    Perhaps this was Baez’s subconscious wish, to be free from defending Casey and that is why he seems to not know anything about anything- Geez Louise PLEASE!

    Unless GA attempts suicide again, honestly I don’t see how the last episode will help. For all outward appearances, that was yet another PR ploy. Beer& pizza, no long term therapy afterwards, walked out on his own, no way in he!! do I believe that was a suicide attempt. It was show business.
    If anything, these folks have super human strength. It’s one chest beating session after the next. Never any accounts of long stints in a bar drowning out the memories, no sobbing in public (maybe they’re like kc, when she said she didn’t have time to cry, she had to focus on interviews). Even the molestation talk was met with a weak response thru the lawyer, yawn. Nope, one big supportive family with ice water running thru their veins.

    I like that especially as ad nauseam leads us to the old Argumentum ad Nauseam–which I don’t trust myself to explain since Logic classes were many years past–so I offer a dictionary definition:

    “Argumentum ad nauseam or argument from repetition or argumentum ad infinitum is an argument made repeatedly (possibly by different people) until nobody cares to discuss it any more. This may sometimes, but not always, be a form of proof by assertion”

    Baez will continue to add nauseam, infinitum, to this case because he believes he is very clever. His goal is to arouse reasonable doubt, to deflect blame and its consequences, and to come out of it with clean shoes.

    Yet, his guilt *radiates* in that worthless motion. He doesn’t specific the day in May he received the phone calls; he alludes to a co-conspirator in the call transfer process; he attempts to establish that offenders obtain contrabanded cell phones, which he may or may not have been speaking on; and finally contends that there was a criminal act (felony wiretap) taking place–not his own!

    I agree with Blink that he won’t be replaced during this trial, but ya better believe that someone is working up all of his unethical acts for a future investigation and probable disbarment.

    What’s your take on Casey’s verdict? Do you think the jury will decide on the DP? I’m still thinking Caylee’s case is case law in the making & have a few minor doubts that it will be the end result. Considering all of the evidence, & from an intelligent legal perspective, what’s your take? Do you personally think the jury will lay the smackdown & award the DP? While I personally believe Casey deserves the DP & is guilty as hell, I’m not as confident that it will be the end result. In Kyron’s case, we can all see how he was failed on so many levels from the beginning of his disappearance. It’s blatantly obvious to me that Caylee is STILL BEING FAILED on so many levels by the way her frickin extended family act. It absolutely unequivocally makes me sudder to think that her family & mother’s dream team mar her legacy by bending the truth in justice. It pisses me off. I’m so sick of this & really think our justice system needs an overhaul. While it’s the best in the world, imo, it is being bent in all different directions…so much so that it literally makes jurors forget what the law is all about. Blink, it’s my personal opinion that LKB got involved to not prove Casey to innocent, but rather to save her life by going for a “Diminished Capacity” conviction…therefore saving her life & getting her mental help at the same time. I am one of those people that believes the Diminished Capacity statutes should be thrown out & not be allowed to use again bc I believe it’s much easier to plea down using this (many prosecutors utilize this bc it’s easier to get a conviction & have the defendant agree to a plea) rather than using an Insanity Plea for conviction. Although Casey is charged with murder, and even though I personally believe alot of the State’s evidence is concrete, I also contend that alot of it is compulsory circumstantial evidence. I believe the preponderance of evidence is there, circumstantial being still concrete that link Casey to the crime, therefore the State should not plea down… However, it sort of freaks me out that there were sooo many leaks with regards to Casey’s relationship to her mother, the fact that they haven’t brought suit to the many online comments regarding paternity & the supposition of 2 male family members related to that issue (those of us that know about alleles know that a member of her family cannot be Caylee’s bio father bc of the forensic release of her dna chart), the fact that George attempted suicide yet when looking at the evidence & the type of pill he was on we then learn that it wasn’t even possible, anyway – the list goes on… I sooo believe that they are making her appear mentally incapacitated and/or incompetent somewhat & are attempting to coerce the Prosecution into some sort of Diminished Capacity plea down. It’s easier to try a Diminished Capacity case as opposed to Manslaughter by Reason of Insanity. LKB is one tough cookie but I got her number! It’s my personal belief that this is what she was bringing to the table & teaching Baez. Even though it’s something mostly used by the Prosecution, Defense Attorneys also love it bc it saves their client from the DP. It’s under much MUCH much scrutiny in NY…so much so that many people wish for the statute to change as it’s broadened so much & has so many loopholes that it’s constantly being utilized in a court of law – all the while benefitting the Defense and the State at the same time. Check it out & tell me what you think about it. Hmmm…sorta makes ya think about what’s going on, huh? Lemme also say this: I hope Casey Anthony rots in hedoubletoothpicks for all of eternity. I personally think the way to get to the jury is to play over & over all the cards that relate to Caylee’s carcass (if her remains can even be classified that way in regards to being torn apart & such) and Casey’s lifestyle during Caylee’s life and after her death. My GOD!

    Let me tell you about the prettiest little 34 month old. Her name is Caylee Marie. She was allegedly murdered by her Mother, and tossed in a bog to rot, but not before being scavenged piece by piece by the indigenous. Her duct taped skull was found by a man urinating next to it. You have got to be kidding me that these effs continue to behave like this. It galls me to no end, that this little girl has NOBODY in her family that puts her first. It is maddening to me, this cross-section of human condition via fishbowl. She was a sweetie-baby. She was innocent, and strangers care more for her legacy than her own family. I guess I am learning the anger never really leaves me, and I do not have her teensy crocs in my closet. O wait- neither do the A’s. They are in an evidence locker. Sick.

    I have to be honest- It makes me sick to my stomach to think of what Caylee witnessed in her last minutes of life. For so long I wanted to believe it was an accident and Casey panicked and did the wrong thing, but with each path her defense team takes I am convinced more and more that this precious baby girl looked into the rage filled eyes of her mother while she fearfully took her last breath.

    I too am mad as hell Blink. I don’t understand for one second why this baby girl who has managed to grab our hearts from beyond the grave can’t even get a little bit of respect from those who had the priviledge of watching her take her first breath, speak her first word, and take her first step. They had a duty to protect her and instead they are protecting the one who murdered her. How dare Cindy and George.

    I want to know this Cindy and George- if your daughter didn’t murder Caylee then while in the hell is her defense team looking into George?

    The only bit of good advice that Baez is giving her is to tell her to grow her hair out until the trial. She has definitely lost that party girl trendy look she sported two years ago. Not to mention the long sleeves buttoned at the cuff….What a contrast to the photos that the jury will see! Blink, there must be something that snaps in a parent’s mind that makes you want to discount evidence against your own child. Look at Scott Peterson’s mom. I really believe that these people believe in Casey. I think they cannot comprehend that what they have raised is capable of such horror. To admit something like this would be too devastating. It would mean you would be admitting that you failed as a parent and had raised a monster. It must be easier to look the other way

    Blink, so much of what the defense has done from ‘day one’ has been to spin things to the potential jury pool. What better way, as we’ve seen them do countless times, than to make a big public fuss about things. If Baez knows the caller was trying to get something and it was obvious, then why not make the best of it, but fussing about the call, discrediting the state’s jailhouse witnesses as ‘set ups’ with something to gain, as we’ve already heard in the press releases.

    Maybe he is trying to spin his foolishness into a gain for the jury pool now that he knows he’s stepped in it big time. (how many flies can Baez catch in his gaping mouth over this one??)

    JMO, I think that Baez stays on the case because he is a walking mistrial, an anti-ace up the sleeve. He may even realize it. And I think that George might either be the backup for a plea of “it was an accident” or he’ll be implicated and in a prison infirmary somewhere, being treated for bus-tire tracks up and down his mediocre spine. KC would certainly be her mother’s daughter if she can and does blame anyone else (any REAL person, that is), even her father, on whom she’s already pasted a sex-abuse tag.

    to EliGrandma: “Fargo” is one of the Coen Brothers’ best films, with Frances McDormand as Marge, the straight-up, go-girl, pregnant Chief of Police hot on the case of a badly bungled kidnap-for-hire. If she were a dog, she’d be a German shepherd, she’s so on-task, yet she’s home folk, as well. It’s a classic, with almost more quotable quotes than all the Dirty Harry movies combined. Others in the cast include William Macy and Steve Buscemi. Really, it’s a must see, slightly gory (can I hear a “Chipper-Shredder”? YO!), with perfectly wonderful north MN accents.

    Hi,I thought for a long time that Casey’s death was an accident too. But then I think- if it was an accident, how could Casey have kept her in the trunk? Why didn’t she call 911 and ask police for help- or EMT’s for help, someone, anyone?

    Why did Casey throw her baby away like she did, in trash bags and in a swamp? How could she have let her family go on believing that there was even a chance that Caylee was alive? How could she have joyfully meet Cindy’s questioning with lies about the beach and Universal and accidents and playmates? How could she not have broken down sobbing each time Caylee’s name was mentioned? How could she have watched those movies and how could she have slept eat or function let alone, party, shop, hangout and visit the tattoo parlor?

    If Casey was innocent of cold blooded murder, how could shehave sat through that interview with the detectives at Universal and continue to lie to them, even after they said, They knew that Caylee was gone and wanted to know what happened…

    How could Casey have not broken down when they mentioned little Caylee not looking the way her family remembered her? Why did she not break down sobbing and tell the truth, when the detective said its one of two scenarios….(PP) either you are a mother who loved her child, and something horrible happened, possibly by accident, and you were scared to come forward and you would change it if you could….. or you are a heartless murdering mother who doesn’t care that her baby is dead and you are torturing her grandparents and everyone with tales of kidnapping and all the rest.

    What remorseful young mother, who accidentally killed her daughter would behave in this way? I ask myself this over and over, still, each time I see Casey smiling or laughing or giving high fives.

    Thanks for synopsis on Fargo. I’m not a fan of movies…can’t sit through and focus that long so, when a reference is made, I’m at a real loss. It was most difficult when my kids were young and I had to do the obligatory Disney films. Guess Fargo applies more to the Kyron case.

    Sometimes I feel it is futile to try and figure out why the A’s do anything. Casey seems devoid of natural emotion. The parents seem to have no morals or respect. Lee seems unable to put the proper emotion with an event.
    They all seem very damaged but not from Caylee’s murder. It’s as if that one event galvanized them into a machine. Like some weirdo sci-fi movie where a robot loses a part (kc) and it goes into overdrive to repair itself.
    Their version of love is light years away from mine and I’ll never understand them.

    B- I remember you saying way back that sadly George will be thrown under the bus by Casey and her defense. It is happening now. Just read it on WFTV and Orlando Sentinel. The defense is targeting George to discredit him,he gave damming testimony early on. The defense may even possibly to point blame at George or even Lee down the road. What a disgrace that Casey is allowing this. Sadly The Anthony’s will allow this too…they lost all they have to live for-Caylee Marie and I believe Cindy is asking George Lee to take whatever comes their way to try and save Casey…The family may be heartbroken and devastated but Casey just wants to walk out of there without a thought about Caylee and live her beautiful life. How tragic for Caylee. :(

I hadnt been here because of a back injury and aside from that things were kinda slow here at in the sm forum. yeah I even looked for everyone at the kyron forum didnt see too many familiar faces. I think were all here till justice is served for caylee. I love to go to the forums alot of smart moneys there with alot of humor to keep us sane!

    Me: Just wanted to say thank you. I was kinda hoping a plea wouldn;t take place bc that means she lives. I despise the circumstances surrounding Caylee’s death…it truly sickens me. I stopped following any & all cases related to Caylee bc it was overtaking me, completely filling me with sadness & anger at the same time… I then needed to tuen away & fill myself with happy thought, focussing on my family, etc. I just can;t stand what happened to this dear sweet child & her family that was supposed to love her so much keep failing her by protecting her killer. It really makes me ill. So, the plea…I wonder if this will be the route that is taken – “Diminished Capacity”?

    MJ: I co-sign on your comment about the As. It must be very lonely to be in that family.
    c10: on JVM tonight, the panel discussed that George’s suicide attempt might serve as reasonable doubt that Casey is the killer. Remember that Casey accused George and Lee of molesting her. Maybe the defense will accuse George of doing the same to Caylee and then killing her. So the suicide attempt is from guilt instead of grief. Pretty crappy.

    I think as everyone over and over about what casey did to Caylee.
    I am sure Caylee was aggravating the living hell out of her. She did not look at her as a daughter, but as an annoying sister. That day she had had it. I think Caylee may have began to defend herself after her mom had been yelling at her. Casey then grabs the tape and binded her little arms. She then tapes her mouth shut forever. Now she would not have taped her mouth with three pieces of tape intending to take it off later for Caylee to tell everyone what mom had done. Even to set up a kidnapping, Casey would not have used three pieces of tapped. No, the three was to smother her. This was done in a short amount of time and with every intention. It had to happen fast and she had to get out of that house before anyone came home. I think the blanket helped to get her in the trash bag easier. The heart was placed later after a night of thought or a bad dream. No possible way that girl was home on the night of the 15th with a dead baby girl in her truck. I would love to know where she went that night?

    I also wonder about questions that will be asked of Cindy:
    #1: When Caylee is home, do you tuck her in at night?

    #2: Did Casey and Caylee sleep at home on June 15th and did you tuck her in or tell her goodnight?

    #3:What were Casey’s hours of work?

    #4: How would you explain calling Casey at 7:30 in the morning on June 16 if you say Casey was home?

    And to the George under bus ‘news’, Baez has given a couple stories to explain, well more than a couple because he’s voiced something to HLN too, saying WFTV’s story is quote ‘rediculous’. But in his clickorlando comments about using George’s suicide to mitigate– oops, mitigation, according to Mr. Brad Conway, who should be in the know, is about ‘events affecting the death of Caylee’, and George’s suicide took place after Caylee died and her body recovered.

    So Baez is either putting foot in mouth again, or just plain reaching, after WFTV’s story. Baez hasn’t mentioned the abuse allegations as relate to George as per Casey’s letters as being helpful to his client as a mitigator (abuse allegedly would have happened in the home before Caylee’s death), as would putting the blame for the murder of the baby, on George himself (if Baez would be that stupid).

    I think the spin is happening now for effect on the jury pool ‘now’, so when trial comes along, the jury will connect the dots between ‘sod’ and the names they’ve heard so far, Grund, Kronk, Papa Jo. That way the defense won’t have to point to a specific person, just let the jury connect the name with what they’ve already heard. Then of course, we’ve got the TES personel records to come, and we’ll hear allegations of those selected volunteers too, by name ahead of trial.

    Seems what Baez really wants, is to find some shady person in those TES volunteers to investigate to find someone to set up for Kronkifying. And Mark NeJame doesn’t want this, but seems that eventually, it will happen, just maybe more selectively because of the restricted budget.

    That is exactly what he wants. I do not think the master is going to put up with his crap though.

    Kleat, Blink, a lot of what Baez wants is pre-trial speculations and inuendo that will be recalled as familiar, by trial time. Once the TES records reveal some ‘stuff’, no matter how rediculous, he’ll go public with it once again, maybe not with the intensity of a Kronk style attack with dying witnesses who can’t be interviewed under oath (to date) so their ranting accusations not under oath on video are still the only thing potential jurors know about. Tactics to use human memory and tricks of the mind, making sure the jury hears about certain ‘suspicious’ people ahead of time.

    Not sure the judge can stop that before trial, can he? There’s no gag order in place, will the TES issue make that any different?

    I had a thought about Baez. He’s been busy for 2 years trying to argue, plead and whine about certain Florida laws. He doesn’t want cameras in the jail when he’s meeting with his client; he doesn’t want his client’s telephone conversations recorded; he wants his client to be able to visit with her family without being videotaped. He also doesn’t want his client to have to wear leg shackles in the courtroom ‘cuz they hurt too much (wah, wah, wah).

    I think he’s trying to make a name for himself as possibly the first Hispanic attorney in Florida history to actually get some of the laws changed to give defendants more privacy. That would be a great big bee in his egotistical bonnet and would certainly help him and his practice in the future. Too far-fetched?

    Thanks & yes I agree with you. I know Caylee is in heaven but it won’t make me feel good if her mother doesn’t get a harsh sentence. I simply don’t understand how Baez gets away with all this stuff. Also, how could he be appointed to teach a class/seminar when he makes such erroneous errors?

    When I used to post at WS all the time, there was a reporter that used to post named Amir. Amir, if you happen to read here, you used to follow my posts…looked into leads, the hidden entrance to Universal, the Universal Escort Service, the OCSO stuff & the rooms used near Universal, Orange Blossom Trail & the amateur underbelly related to the easiest way to make money — I ask you: How did Baez get that teaching gig? Did one of his famous acquaintances refer him to the U? Is he cashing in on media ties that are Anti-DP? Seems to me that the major establishments promoting Anti-DP innuendo are aiding & abetting the erroneous rumors surrounding this case. Is this something to look into?

    I read that the judge has asked for the prosecution to turn over the jailhouse recording to him. Do you think the judge will make it public and another question do you think that the judge is begining to see how inept inexperienced and plain stupid baez is. in other wards is the green behind the ears visible to the judge.
