Kyron Horman Missing and Endangered: Grand Jury Meets, Indictment Imminent

Portland, OR- In the case of missing 7-year-old Portland child Kyron Horman, developments today continue to unfold at lightening speed.

During a poorly-kept secret convening of a special grand jury that is in session today, sources inside the investigation believe it’s triers of fact will return an indictment against Terri Horman and possibly one other individual.

It is however, unclear as to whether or not the grand jury is hearing evidence in the alleged murder for hire plot MCSO informed Kaine Horman his wife had master-minded, OR evidence surrounding the disappearance of Kaine and Desiree Young’s son Kyron.

KOIN caught Terri Horman’s friend DeDe Spicher, who was subpoenaed to appear in the proceedings this morning, on video with her attorney, entering the courthouse. Spicher was the subject of a public plea asking her to cooperate with investigators by Kaine Horman and Desiree Young last week.  A neighbor of Spicher’s has confirmed the FBI has been seen removing boxes and unknown bagged material from her residence.

According to several sources, DeDe Spicher, Terri’s roommate  post Kaine’s restraining order,  was working in a garden near the Horman home the day of Kyron’s disappearance when she received a call at approximately 11:15 am. She left abruptly, returning at approximately 1:00 pm. DeDe was unreachable on her cell phone during that time and the property owner became concerned. Spicher is a long time friend and workout companion of Horman’s.

Earlier today, Laura Rackner, Kaine Horman’s Family Law attorney filed a motion to find out where the funds are coming from to foot the bill for Terri Horman’s high profile criminal defense attorney, Stephen Houze.

In Horman’s motion, he is seeking the disclosure of the payments made to Houze, and whether or not it came from marital funds. If it has, Kaine Horman wants half the cash to pay his own legal bills. Kaine Horman alleges that Terri Horman disclosed to a third party that she paid a whopping $350,000 retainer to Houze, however, provided no proof of same in the papers filed today.

In what appears to be a media timing coup, tonight’s episode of Dateline NBC will feature Kaine Horman, Desiree and Tony Young, with interviews and coverage of Kyron’s disappearance.

Multnomah County Sheriff’s Office Public Information Officer, Mary Lindstrand, has announced a press conference tomorrow at the MCSO Training Facility, beginning at 2:00 pm PST.

    DeDe testifies at grand jury – does that necessarily mean she didn’t make a deal? Couldn’t she have made a deal in exchange for her testimony?

    Technically she has a form of immunity for whatever she testified to. That would have been crafted by the state accordingly, and is my belief is the reason she was not asked any questions last week.

    I have a difficult time buying the story of the farmer with the tip on June 9, if only that I can’t imagine how he could have seen all that he claimed to have seen, while driving down a highway. It seems to me that if he really saw all that he says he saw, he would have had to stop his car or at least slow way down in order to see all of the people and the shovel and everything.
    It must be an enormous undertaking that the LE is having to go through, to take the time to check all of those tips.

    Lyla,
    Thanks for posting that article. It answered quite a few questions that I had, such as what Desiree did for a living and how she and Tony met. And I must say, that is certainly the most in depth – BEHIND the scenes reporting that I have read so far. Oh my…

    Ex:
    “Davis, meanwhile, has a pile of human feces on her property where the cameramen who staked out the Hormans relieved themselves under her tree. Next to the turds and used toilet paper sits a pile of rotting grapefruit in a discarded plastic bag. But during the search for Kyron, some of her neighbors freaked out for a different reason. Many are growing marijuana on their isolated, densely wooded properties, and were spooked when search teams arrived. Deputies assured the nervous neighbors they didn’t care about the pot.”

  13. Kleat says:

    zinnia, yes takes time, but for this tip, there’s a date and time, location for the white truck/woman sighting and by this time, Kyron was known to be missing and parents initially interviewed. By that point, investigators could likely confirm where the family members were and where the white truck was or wasn’t, if known, then the truck wouldn’t have been out being driven by TH with or without Kyron that day.

    Pitkin’s WW story is okay, but I have a few liguistic issues.

    He says “there is nothing puerile about the desire to comprehend this crime and solve the mystery of what happened to this child. The attempt to do so leads us into some very dark places.”

    Leading us into dark places would be “pruient.”

    In the section on Dede Spicher, “The drama around Kyron’s disappearance became almost operatic” when she was introduced to followers of Kyron’s story. His word should be “theatric.”

    I object strongly to his CoatTailer designation of Bruce McCain, a former MCSO captain and attorney, who was brought down by Bernie Giusto’s ethics problems. McCain has provided reasonable and helpful explanations of many aspects of the case. I don’t give a rat’s tail about his politics. Obviously, Pitkin does.

    “Awkward social skills”? Kaine Horman is grieving and highly stressed.
    Give a human shake, huh, Pitkin?

    Some attribution would help substantiate this claim “He also may have found ways of blowing off steam—neighbors report they’ve heard gunfire coming from the property for hours on end.”

    Blink left them all in the dirt with the landscaper information, but Pitkin has the gall to say that blinkoncrime is “a website with no indication of its authorship.” C’mon. Google much? Why not call her for a comment?

    A strong question lies in the following, provided by Willamette Week.
    I don’t know it’s out anywhere else, as this is a vast, information-intensive case:
    Desiree was taking non-FDA approved medication that caused her kidneys to fail? Was it kidney medicine? Doubtful…the kidney is the most fragile organ in the body. Whatever toxins aren’t degraded hepatically
    could take those kidneys down in no time.
    I can’t even imagine she was using intravenous illegal drugs. No.

    One blogger noted that the WW story didn’t show one photo of Kyron.
    I agree. We cannot lose focus of that little boy–ever.

And when that didn’t work, she decided to get rid of Kyron and save some money there for the lipo? Sorry, TH, it’s going to take more than liposuction to suck the bad out of you, mho.

    I’m not a gun person at all. I don’t even eat meat. But I grew up in a place where guns were normal, I now live in a place where I have friends who shoot for fun (they don’t shoot anything, just target practice), and I don’t think that makes them bad or good people. I think it is just something they enjoy, so I don’t think I have the right to judge it either way, I just see it as a difference in what they enjoy and I enjoy. Now if they start shooting people, or neighborhood pets, then that’s an approve or disapprove area. JMO. And keep in mind, this is “from the neighbors” and we don’t know that it’s KH doing it or that it’s true.

Well, immediately my heart and mind went to precious little Kyron and I was so glad when Elijah chose the jaguar. It was a very emotional moment. 35. beejay says:

    I didn’t research far enough to see if what Multnomah County’s laws are, but OR state law does, acc. to the link below (as of March, 2007) prohibit the county from denying the rights listed below.

    “Oregon counties also have authority to adopt ordinances that regulate, restrict or prohibit the discharge of firearms within their boundaries, provided the ordinances do not apply to or affect a person discharging a firearm:

    *

    In the lawful defense of person or property;
    *

    In the course of lawful hunting;
    *

    As a landowner or guest of a landowner, when the discharge will not endanger adjacent persons or property;
    *

    On a public or private shooting range, shooting gallery or other area designed and built for the purpose of target shooting; or
    *

    In the course of target shooting on public land that is not inside an urban growth boundary or the boundary of a city, if the discharge will not endanger persons or property.”

    It worries me that people release stress that way. I’m more inclined to think they’re redirecting their anger, rather than reducing stress. It just puts anger and the habit of firing a weapon too close together for my comfort level.

    And I’ve had a concealed carry permit most of my life. I regularly target practice at a range. Often with family members who are LE. And every time I fire a weapon I have an overwhelming sense of how frighteningly powerful it is. And I pray that I never have to defend myself by using it. (But I would). It definitely does NOT reduce stress for me or for anyone I know who uses a weapon in their profession.

    That stress-reduction thing was the reporter’s embellishment, right?

    RE WW article: As far as no photo of Kyron, the title of the article was about “The 14 most important people and things to emerge from the Kyron Horman Investigation.” That as the focus of the article. That was all. It wasn’t about Kyron but of the “growing list of players” in this story. For people who haven’t been able to stay caught up on the complicated story, it is a pretty decent summary. A motive re TY I just thought of that I haven’t seen yet: Just my opinion, yeah yeah yeah…

    TY is a detective. It is very possible that TH is harboring resentment towards DY for a thousand reasons or another. She sees DY as a competitor (as any wife may or may not feel about their husband’s ex; don’t know, i just got married for the first time, hopefully:), but I have a few friends that are not too happy about dealing with ex-wives).

    Not only is DY a “competitor,” but TH hasn’t been feeling very good about herself or her marriage. She wants to lash out at ALL involved. This includes TY. He is the detective and she wants to show ALL involved that she can do this and get off. Its like a one-up.

    In TH’s head to DY: “You think you have it all? Well even your husband can’t do better than me!”

    Another victim in this awful ordeal that I can’t stop thinking about is DY’s other son QM. I found his fb page and there is a sweet pic of him and Kyron. From what I have gathered from a work thread, I believe they live in the area surrounding Portland. I’m not able to find out exactly where they live. So many victims in this tragedy, breaks my heart.

    Re Kaine practicing shooting on his property — IF it is true, it occurs to me that this is a man who is wracked by guilt and grief over failing to protect one of his children. Now I have never had any interest in owning a gun, or firing a gun, but if I were in his situation, I might be so determined to protect my other child that I would do a 180 in order to leave no stone unturned when it came to keeping my family safe. And remember, he did have reason to believe his estranged wife tried to hire someone to murder him.

    I’ve read all the comments here on BOC. There are some really smart people on this sight. Of all the things that make me suspicious of TH, I think the most incriminating piece of evidence is not picking up the project from Kyron’s school. This was the whole reason for borrowing the truck and Terri’s complete alibi. In her planning, she forgot about the project. She couldn’t go back to the school to pick it up; because, they would look for Kyron, question her or atleast notice her. She probably realized this when she was finally at home putting photo’s of Kyron on the computer and doing whatever else she thought would further cover her tracks. I hope this turns out different that what it seems. I pray for this child and those who love him. This is just aweful and sad!

  48. Rich M says:

    It seems to me that Kaine could be having some male bonding moments with Tony Young out in the back yard, firing off a few rounds. I wouldnt blame Kaine at all if he already had a gun permit and is just practicing/keeping up on it, or just went out to get one out of concern over his family.

    I say, GOOD, let TMH be scared shitless to try the kidnapping shit AGAIN. (Kiara and probably Kyron.) And if TMH killed Kyron, I wouldnt blame him for taking her out as she leaves the courtroom. (Sure it would be irresponsible for Kiaras sake but I still wouldnt blame him.)

    My guess is the neighbors are more worried about tending and harvesting their weed. Its kinda funny the cops said they dont give a hoot. (The smart homeowner would have promptly removed them.)

    I hope I can catch the radio show in a few. I am sure we wont see any comments posted til blink gets back. :)

    James Pitkin states: Oregon and certain other states have what’s called a “Son of Sam Law.” Any profits made as the result of a crime (from book rights, movie deals, etc.) must go to the crime victims. Criminal defense lawyers say the law also prohibits such profits being used to pay for attorney fees.

    Question: Doesn’t the Son of Sam law pertain to convicted criminals?

    James Pitkin: I called Doug Harcleroad, retired Lane County District Attorney and senior policy adviser for the Oregon Anti-Crime Alliance. Here’s an edited transcript of his remarks:

    “Until a person is convicted of a crime, they’re entitled to enter into whatever kinds of contracts, so long as they’re not illegal. The law allows for freedom of contracts. There’s nothing wrong with that.
    “If a person is making money perfectly legally by selling a story that they have, and then they’re convicted of a crime, the law as a general principle does not allow for the taking of that money that was made perfectly legally.

    “The law does allow for large fines as well as penitentiary sentences in cases. There may well be a way to access money if someone has it in a bank account. They could be penalized for that. But in terms of going back and saying, you have these illegal gains (and we’re taking them away) … our law generally does not work that way.”

  50. Mermaid14 says:

    @MadameClouseau,
    In the WW article today they mentioned this master’s degree again and said that TH had a master’s degree from Pacific University. Isn’t that one of those mail order diploma mills? The name rings a bell. There are quite a number of “universities” offering degrees now, but the problem is alot of them are not accredited and are worthless if you try to use them to obtain professional employment. TH also stated on linkedin that she was a reading specialist. This requires a master’s degree in my state which is a minimum of 36 hours and a thesis or comp exam. The diploma mills do not have these requirements.
