Kyron Horman Missing: Kaine And Terri Horman Face Off In Family Court

Portland, Or– Following one of the largest organized search weekends on Sauvie Island since Kyron Horman, 8,was abducted from Skyline School on June 4, his step-mother and father squared off in family court. Kaine Horman, Kyron’s father, arrived with his attorney, Laura Rackner.

Kaine’s estranged wife Terri Horman, arrived with her criminal defense attorney; Stephen Houze and her family law attorney Peter Bunch.

Mr. Horman appeared in a crisp-white dress shirt and tie, and Ms. Moulton-Horman wore an eggplant hued suit with a long skirt.

Cameras were banned in the downtown Multnomah County courtroom; however, there were apparently several hidden “nests” as the tweets were flying real-time.

Peter Bunch, counsel to Terri Horman, is adamant his client is the subject of more than one criminal investigation:

“The state has the ability to obtain every single bit of information that is produced in this case and that is outside the bounds of what it could do were this proceeding not occurring,” Bunch said in court.

“It is fundamentally unfair for Kitty (Kiara) and for Miss Horman for me to be hamstrung in the divorce case for the information I have compared to what they have.” “The publicity that’s going on is not being driven by Ms. Horman, it’s being driven by Mr. Horman, when he tells national media there’s no doubt Ms. Horman is involved.” “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.” “We’ll concede, Mr. Horman can have the house, right now. Mrs. Horman is going to lose money…”

Terri Horman has not been declared a suspect in either Kyron Horman’s disappearance or the alleged murder for hire plot against Kaine Horman. She is however, seeking access to all of her 911 calls dating back to the DAY AFTER CHRISTMAS.

While this timeline coincides with accusations by Kaine Horman in his filings that Terri attempted to arrange to have him murdered, this is the first public revelation of that call. Bunch went on to say that Rackner and Kaine Horman, who are parties to case sensitive criminal investigation materials involving Terri, are at a supreme advantage to his client who should only be expected to plead her protections under the 5th amendment as a result.

After heated debate by those sides, we learned: Rudy Sanchez, the infamous landscaper/hitman for hire, has an alias, and has eluded service in the civil matter to date, although he appears to have cooperated. Bunch proclaims Sanchez is unlocatable as a result of MCSO unwillingness to share discovery of a witness in the civil case ( blink holds hands over eyes).

Michael Cook, a/k/a sexter king, waited all afternoon via subpoena by Rackner, but was only interviewed by the press. He states he cut ties with both Terri and Kaine days before he was outed for invasive scapular intrusions. No word on that healing process.

Terri Horman had her own personal black Friday this year.

She called 911 THE DAY AFTER CHRISTMAS. Regular contributors and readers of blinkoncrime.com doubt she had sale flyer questions.

Judge Keith Meisenheimer, was sensitive to Kaine and Kyron’s ‘round the clock nightmare, but feels some time may allow things to shake out. January 6, 2011 to be exact.

Following this afternoon’s legal melee, blinkoncrime.com Editor In Chief asked prominent Washington State Family Law Attorney, Lea Conner, to weigh in:

Although I preface my comments with the fact that I practice family law in Washington State and not in Oregon, I am an Oregon native that has followed this case closely.

I’m a bit perplexed by Peter Bunch’s reasoning that if the court were to abate the dissolution, he would respond by filing a motion to modify the restraining order so that Terri Horman could have visitation with the parties’ daughter. Essentially, Mr. Bunch is arguing that the abatement would prejudice his client’s ability to parent her child. My understanding of the Multnomah County local rules is that an abatement means that the entire case is halted. Neither party can bring a motion before the court, nor can the court hear argument or make any ruling on motions.

It was also interesting to hear Mr. Bunch argue that proceeding with the divorce would violate Ms. Horman’s right against self-incrimination in the disappearance of her stepson. This is the first time that Terri Horman has publicly acknowledged any self-incrimination issues. In her motion for abatement, Ms. Horman, through counsel, argued that the ongoing investigation into Kyron Horman’s disappearance had made it “virtually impossible…to proceed with divorce-related issues in an effective an[d] orderly fashion[.]” Were Mr. Bunch to bring a motion to allow visitation, Mr. Horman would no doubt argue that Ms. Horman’s actions demonstrate that Ms Horman or someone she knew was responsible for Kyron Horman’s disappearance, and that her behavior since Kyron’s disappearance shows that she is unstable and poses a threat to their daughter’s safety.

I do not believe Mr. Horman would raise Ms. Horman’s 2005 convictions for DUI and reckless endangerment, as not only later chose to have a child with Ms. Horman since that time, he also left both of his children in her care for extended periods while he was at work. Under those facts, it would be hard to conclude that Mr. Horman believed Ms. Horman posed a threat to their daughter. The judge’s comment that “[e]ventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings,” seems to indicate that the judge may not be willing to hold the action in abatement past the January 6, 2011, hearing.

I’m also interested in Mr. Bunch’s comment that “Rudy Sanchez” is an alias. If that’s true, then what is Rudy Sanchez’ real name, and how exactly did he first come in contact with Terri Horman?

It was also strange to learn that Michael Cook was subpoenaed to testify at the hearing. I’m curious if there were others scheduled to testify as well. I cannot speak to how the Oregon court operates in practice. However, I note that each party provided written affidavits in support of their respective motions.

Is there some reason that Mr. Cook’s statement could only be presented in oral testimony?

I’m not sure I understand Mr. Bunch’s logic in saying “If this is not abated we will not get reciprocal discovery.”

The state is not a party to a dissolution action. In a dissolution action, the parties can seek discovery from each other, and depending on the court rules, from third parties as well.

I’m not sure why Mr. Bunch would have the impression that there would be reciprocal discovery with a third party in a dissolution action, especially when that third party is law enforcement.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

    Blink … where did the photo of the one mystery guy above come from? Honestly this photo gave me chills and it’s the 1st time I’ve ever seen it. Does anyone else think this guy looks like the guy LE is still allegedly searching for in another Portland incident near a school in early October? He sure looks like one and the same to me!     PORTLAND – Police have released a sketch of a man who was spotted exposing himself near a Southeast Portland school last week.

    Authorities are hoping the sketch will help them identify and track down a suspect. Meantime, police and school officials have been warning people to beware of the lurking sex offender.

    At one point, the man got out of the car and walked after a student, police said.

    The suspect was described as a Hispanic man in his 20′s to late 30′s, about 5’2 and 150 pounds, with very short dark hair, wearing a light-colored shirt and dark pants or jeans. Police said his head was almost shaved and he had a mustache and a goatee.

    His vehicle was described as an older model, white 4-door smaller car, possibly a Pontiac, with a dent on one of the front fenders, possibly black wheels and black bumpers, with black scratches on the rear passenger side fender.

    Anyone with information about the suspect was urged to call 9-1-1.

    A letter was sent home to parents. It read in part:

    This morning, five of our female students and a staff member (three separate sightings) saw a man driving a white sedan lurking around school grounds on SE 26th Ave, SE Grant St. and SE 28th Pl. All describe him as being in his early 20’s to 40’s, dark skinned, possibly Hispanic. The first set of students describe him being sexually inappropriate as they walked by his car which was parked on 26th Ave. As they hurried past, he started his car and pulled along side them making inaudible remarks. Thankfully, they were able to run away and immediately report the incident to the school.

    Look at the nose, the shaved hair, the mustache, goatee, the physique of this guy …. they all match! The hair in front hanging down is slightly different, but police sketches are sometimes slightly off on hair features.

    Thanks for trying. Due to my computer’s defenses, I can’t download the katu link you gave me. It is not old news to me. Though I do recall some confusion about a commenter referencing how they felt about their own son, and readers thinking it meant Rudy (?) had a son the same age, but it wasn’t true. Is GOODNESSME someone you know and would believe as a source?

    As to Blink’s photo: the girl does look like Jaime Mejia to me, too. Annals, you said you think that’s Rudy’s daughter–why?

    I think this is the last time I am going to do this LOL. I thought I would break down what I said by section:

    The next sentence talks about POWERS. Who is powerful in this discussion?

    The final portion of the statement should be self explanatory too. It suggests that the Mayor commented on ONE SINGLE PERSON, Tweeted about it. In the scheme of the Mayor’s entire input on this case publically, I would say that is a BIG DEAL. That BIG DEAL, that MAN was eventually “DISMISSED” but what I said implies that the mail focused on someone “TO DISMISS”……of all the many potential people that were at the fair that day. Never another PEEP or TWEET.

    Okay, lyla, I will do my best to answer. Keep in mind that this is a theory based on all the info. we have gleaned, my notes and Blink quotes and is all subject to MOO!

    Are you saying TH had no clue Ky would go missing that day? Yes.

    she may have had cell phone calls that day from RS? This would account for cell pings on Sauvie Island? Yes, as in TH had cell pings that put her on Sauvie Island that day, and maybe RS and others did too. Whether they were calling one another is something only LE knows.

    RS himself conjured up the ransom scenario by note or cell? Yes

    TH couldn’t come up with the ransom so RS handed Ky over to someone else for the $$$? No – I don’t think RS and/or other parties involved had any intention of returning Ky, I think the ransom was a ploy to buy time and throw LE off track, and it worked.

    RS did all this to throw suspicion on TH for whatever? No, he did it for his own personal revenge or on behalf of others that wanted revenge and threatened him, causing him to act. TH did a great job of placing suspicion on her own stupid self.

    So TH is implicated by association only with RS? Yes, not only by her association with RS as in the MFH, but also her actions before and after June 4th, and any other activities she may have been involved in that we are not privy to, but LE knows about.

    After all this RS has disappeared? Not under the radar anymore? Yes, he has disappeared to the general public, media and apparently TH’s attorneys, but IMO LE knows exactly where he is.

    Idahogal, as I was re-reading your excellent post, I just had a terrible thought cross my mind. Getting ready to MOO here: What if it WAS RS who lured Kyron out of the school? Couldn’t he have met up with TMH outside a FM and handed Ky off to her? She does have that 90 minute period of time that is unaccounted for that morning. In this scenario RS would not necessarily know Kyron’s current whereabouts, so he would no be able to lead LE to Kyron’s location. I really don’t want this scenario to be true, because I do NOT want to believe she was capable of doing something like this.

    @graceinthehills – Excellent thinking, my dear. Yes, I suppose that is a possibility, although I really think TH was blindsided and IMO not capable of hurting Ky. At least I hope not, only time will tell.

    @Satori – With all due respect, yes, respect…just spit it out, for God’s sake. Yes, you are smart, this is not a contest so stop playing games here.     Thanks for the thoughtful post. I think I am on the same page. I do not think an actual suspect would be named in public, as such, so early on, so I discount the news articles that says this person was cleared by LE. That would be the only was to put someone in their comfort zone and stick around and not lawyer up.

    What I think is more telling is the people who have made their way into the public forum (ie AL, DDS, JW, etc.) and those that have not, TH, RS and this guy. I guess the question is whether this guy is RS. Now I realize many people have been asked by LE not to share information or details of that day, but still they manage when asked to at least acknowledge that they were there and offer support to the family.

    At the time your comments evolved, we were all kind of collectively trying to figure out who was at the school that day. By that picture, we may not know who, but now we know how LE, DY and KH know. If is was not someone already in LE’s sights, there would be a big fat BOLO. TY.

    I have considered the very same scenario that you wrote about. I think it is plausible for RS to have handed Ky back to TH. I think it would have been a very sophisticated move on her part though, as she would have a ransom note that she chose to hide for at least the better part of that day. I can’t reconcile that, but maybe you can, like I said she might be that sophisticated.

    Now all we need is for some Skyline parents to identify that man for us.

    But I think someone already said he’s a parent who didn’t want the media hounding him. And a parent, obviously, couldn’t be a suspect now could he? Could he?

    “I happen to know the poor landscaper that was thrown into the middle of this plot. He was not asked to do it for money, just for “protection”. Terri said the marriage wasn’t going well and that he had all the money and control, so she needed a way out. The landscaper suggested she get a job and move out and have state services help her in getting custody of her daughter. The next time she spoke to him, she told him she had filed for divorce. He did not work for her or speak to her again. At the time, he felt that she had been distraught, and didn’t know how to get out of an “ugly” marriage. He also was lead to believe that she had taken his advice. Now he feels horrible about what has taken place so many months later. On top of that, He and his family are being hounded by media and he is fearful of losing his business, all because this horrible woman approached him with a “favor” that he obviously refused. If you knew this guy, you would wonder why on earth she would even think that he would be the type to do such a thing. He is just a very nice guy.

    I understand Kaine’s logic of “if only he had done what she asked, my son would be here now.” But this further puts the poor man landscaper into the middle of a drama he never asked for or wanted to be in! This drama is taking it’s toll on everyone, and seeing the fatigue and stress in the landscaper (and finally asking him “what’s wrong?”) shows me the harmful ripple affect this is having on everyone involved. The media playing up aspects of the case to make it more dramatic (saying she offered him money to kill him, when she actually sobbed and tried to play on his sympathy, for instance) just makes this already confounding case more confusing and makes me lose the ability to trust anything that is supposedly based in “fact”.

    Side note- He did feel Terri was acting very suspicious during the first days that the family came into the spotlight. He had been investigated thoroughly, giving over his cell phones, his records, his computers, etc… he complied with everything and was given the official check off. He gave all information that he had and has been cooperative in the utmost. He does not understand for the life of him why Terri would not do the same.

    Finally, he said Kyron is a sweet, shy, cute kid and his heart breaks every day knowing that he is missing. He has a seven year old son, as well, and cannot even imagine the pain that the family is enduring at this moment. ”

The woman who posted about RS – first of all, if we believe some news reports, there are TWO DIFFERENT LANDSCAPERS involved. If we don’t believe the media – why would we believe an anonymous poster???

    It just seems irresponsible to take the word of an anonymous poster as FACT in this case – no matter how tempting it is.

    Hi Beejay. I think that the girl in the picture of Rudy Sanchez might be his daughter because she is so near to him and seems to be looking at him. The location looks to be a public place, as opposed to, say, his residence. In other words, while walking in public with small children, we keep them very close. If she were walking with someone else, say someone directly behind him, then she’s too far away from that hidden person for safety. And she resembles him enough for it to be believable. Just my opinion.
    And, yes she does resemble Jamie Mejia, but her hair is lighter brown. I think Jamie’s hair would appear black in the lighting in the photo. And for that matter, the girl with Rudy looks just like some old photos of me at age 4.

    The KATU article entitled; WW report: Kaine Wishes Plot Against Him Had Succeeded; dated July 29, 2010;
    In the comments to that article is this one by Goodnessme; 1st & last paragraphs only;

    I happen to know the poor landscaper that was thrown into the middle of this plot. He was not asked to do it for money, just for “protection”. Terri said the marriage wasn’t going well and that he had all the money and control, so she needed a way out. The landscaper suggested she get a job and move out and have state services help her in getting custody of her daughter. The next time she spoke to him, she told him she had filed for divorce. He did not work for her or speak to her again. At the time, he felt that she had been distraught, and didn’t know how to get out of an “ugly” marriage. He also was lead to believe that she had taken his advice. Now he feels horrible about what has taken place so many months later. On top of that, He and his family are being hounded by media and he is fearful of losing his business, all because this horrible woman approached him with a “favor” that he obviously refused. If you knew this guy, you would wonder why on earth she would even think that he would be the type to do such a thing. He is just a very nice guy.

    Finally, he said Kyron is a sweet, shy, cute kid and his heart breaks every day knowing that he is missing. He has a seven year old son, as well, and cannot even imagine the pain that the family is enduring at this moment.

    Goodnessme’s comments were linked here on BOC sometime in August and it’s the one where Blink wrote; that’s his wife, lol. In a response to a response in the same KATU comments section, Goodnessme said she is one of Rudy’s landscape customers. When this was brought up again a few weeks ago, Blink wrote, Let’s just say that Google translation isn’t perfect. (Blink’s comments paraphriased)

    No I do not know Goodnessme. I notice that this comment by her/him is the only one she/he has ever made over at KATU. As you know, reference to the landscapper/mfh is very scarce in the mainstream media. The article at KATU was printed when Kaine was quoted as saying something to the effect that had the mfh plot succeeded kyron might still be alive, etc.

    In the middle portion of Goodnessme’s comments she said, “I understand Kaine’s logic of “if only he had done what she asked, my son would be here now.” But this further puts the poor man landscaper into the middle of a drama he never asked for or wanted to be in!”

    I think Goodnessme was panicked that the media had brought it back up and felt the need to put out a good word for the poor man landscaper. Whoever Goodnessme is, I believe she knows Rudy. Again just my opinion.

    Thanks to everyone who posted back regarding my original questions on the predator on the loose that was recently caught in Portland. Didn’t know he was recently caught, but really glad to know. He really did look a lot like the guy in the photo Blink mentioned earlier, but now that I see the actual perpetrator, in real life he doesn’t look anything like the other guy. Amazing how police drawings can mimick innocent people I guess. My apologies for being so wrong on that one. Hmmm … maybe my husband’s right and I really DO need glasses? LOL

    The person that looks like a headless lumberjack in the back of the science fair photo might be a woman. It’s hard to identify details in a low-res photo but the stripes on the plaid shirt are clearly curving.

    It’s possible we are seeing the person’s backside and the person is bending over away from us to examine a display. This position would cause the plaid stripes to curve. There also appears to be hair hanging over the back collar of the shirt.

    It’s also possible we are seeing the person’s front side and the plaid stripes are curving over the person’s pregnant belly, or otherwise large belly.

    Bottom line: this could be a man OR a woman.

    Quick funny on this subject and feel free not to post since not related to Kyron.

    My first year in college a bunch of us girls went out to a LEAP DAY party at a club (aka meat market). We met up with a bunch of guys celebrating one’s birthday. It was obvious they were older, in particular, the birthday boy. He obviously wanted to be younger because when asked how old he was, after the joke he was only 5…he then said 19…and that he was born in 1969…more likely 1960 IMO but it was funny to see his face when my friend called him on it. Always think of him on leap day every four EVEN years. LOL

    And we though only “women” lied about their ages! :)

    Mom3.0; There are two different photos from the science fair which have men in the background. They appear to be two different men. In the photo with Kyron the man in the background is wearing a plaid shirt and his face is not showing.

    In the photo of Kyron’s project, in which Kyron does not appear, there is a man’s face, blurry and at the edge of the photo. (His face is circled in white in the Wweek article linked.) I say he’s a different man because he is wearing a dark crewneck sweater or sweatshirt over a white shirt. That is the one Mayor Sam Adams tweeted about and whom LE has said they have identified.

    IIRC The posts here went back ‘n forth about 3rd person when LE/DA had NEVER said who #1 & #2 were.
    LE/DA have kept a tight lid so to speak…

If its who I think it is, he had a kid in Mrs. P’s class last year and he is around a lot, so I don’t think its supicious at all that he would be there (and now that I think about it, I call BS on the idea there were no male chaperones). As for the other guy – I’m not sure I would recognize my own husband seeing that little of him. The little girl doesn’t look familar and looks too young to be in that class, but she could be a younger sibling.

    Is this an example of LE attempting to silence the media? IMHO, I don’t think LE is “making” anyone do anything. However, I do think there have been some carefully placed phone calls that have convinced editors to change headlines, remove online videos, and perhaps even hold stories.

    From my experience, the LE officer (usually the public information officer or higher) making the call asking for a major change to a story does so under the premise that running the story would harm the investigation. The LE officer then promises an exclusive or some other access in trade for holding the story.

    Hypothetically speaking, the “carrot” to get the editor to pull a story could be offering a trade, i.e. allowing a photographer and/or reporter access that others don’t have, say beyond the barricade where searches are taking place. The access comes with the condition that the reporter/photographer agrees to sit on the story until LE makes an arrest or otherwise gives that person the green light to use the material.

    On the other hand, you could have a case where a close friend or family member shares a tidbit of information that makes its way to the reporter, only to find out that the leak has jeopardized his or her job.

    IMHO, LE had a major break and at least one major discovery in the past ten days.

    Blink said she believed the October 2 and 3, 2010, search of Sauvie Island was prompted by “information gleaned on Wednesday [September 29, 2010].” Blink also acknowledged there were grand jury appearances the week of September 27, 2010 through October 1, 2010. Blink did not connect the grand jury appearances to the “information gleaned” that prompted the search.

    One person listening to the MCSO scanner heard an officer asked to be connected to Detective Weinstein, who is associated with the Portland Police Bureau missing person unit. This particular communication did not mention Kyron, however.

    MOO, there are very few reasons to have an all-night search. These reasons are as follows:
    1. LE cannot conduct the search during the day, i.e. to use Luminol in an outdoor area. (Not sure if Luminol would be of any assistance four months after a kidnapping.)
    2. LE does not want its search to be observed, i.e. if LE is recovering sensitive evidence (i.e. human remains); if LE has a witness that must remain confidential; or if LE is searching a sensitive area that it wants to remain confidential (possibly due to the land owner’s request).
    3. LE found something and must secure the site, collect evidence, and complete its investigation of that area.

    Given the high cost of conducting an overnight search (overtime costs would go through the roof), IMHO, the most likely scenario in play is LE found something and must continue the search overnight, and/or LE has a witness whose identity must remain confidential.

    Yes, he did the right thing from a legal perspective. Laura Rackner is on record saying she just wanted to assisst law enforcement. That is NOT her role, that is unless she wants to subject her client to having to turn over criminal case file evidence in an ongoing investigation. Houze really could have pushed harder in some areas.

    I suspect the only reason he did not is because he is saving it for any potential criminal matters.
