Caylee/Casey Anthony Case: Casey Anthony’s Defense Has Gone To The Dogs

As previously reported on blinkoncrime.com, the hearing last week ordering Jose Baez and his defense team to submit specific information regarding their expert witnesses, has gone to the dogs.

Woof!

Dr. Fairgrieve, a forensic anthropologist and expert witness listed for the defense, intends to testify that Casey Anthony should have the right to confront her accuser.

Novel, appropriate, good news.

In this instance, one of her accusers with fur, according to her defense attorney, is named Gerus. The other, Bones.

For starters, if the summary of Dr. Fairgrieve’s findings is accurate as presented in this filing, I recommend as a practical matter, he identify exactly what “alerts” he is seeking to debunk.

There are several, all of which are well documented.


Orange County sheriff’s investigator Carlos Padilla told reporters, “We had two different dogs from two different counties that hit on the same exact spot.”

Evidence Bay with a closed car:

Casey Anthony’s Car: Detectives reported a different dog alerted to the same strong smell in the trunk after the white Pontiac had been abandoned in a parking lot.

“They have a hypothesis that the child may have somehow passed away,” Dr. Richard Weinblatt told Eyewitness News.

It is undoubtedly the recent work of Dr. Fairgrieves in a case involving a murdered man, Robert Wone, that got the attention of Jose Baez and his Scheme-Team.

In a successful inlimine motion, Fairgrieves offered testimony in the supporting affidavit that suppressed canine evidence in the Robert Wone murder.

The three male house mates of Mr. Wone were acquitted of the charges they faced as a result, which were not for his murder. The prosecutor himself could not prove his actual cause of death. The trio are currently facing a wrongful death action by the desceadent’s family. 

“My role in the case is basically peer review,” Fairgrieve told the Orlando Sentinel. “I will be reviewing reports on the evidence. So far everything I’ve done has been remotely.”  Scott Fairgrieve, MD

The ole probative vs. prejudicial argument is not unexpected in this case, I get it.

However, two different cadaver dogs, from two different counties, hit in the same area under or near Caylee’s playhouse. This was AFTER the alerts in the evidence bay on the car trunk, and both searches were conducted with permission from the Anthonys.

That would be the car trunk that produced one latent lift from the accused in this case, Casey Anthony.

Under Dr. Fairgrieve’s theory of “necessary corroboration”, we, in fact, have exactly that.

The hairs that were found in the trunk, including the hair with the “signs of decomposition” corroborate the canine’s alert as well as the report from Oak Ridge Labs.

Let us not forget, that a statement from the car’s owner and material witness in this case, concurs with the presence of decomposition in the damn car.

    Found it. Off-topic, but shows the risks of allowing any manipulative person into the crime scenes and searches, she even had her police friends fooled. But how did a K9 handler or evaluator not clue in to this dog’s training and responses– he obviously didn’t need to be reliable and maintained to a high level to find planted evidence where his handler knew it was.

    KRT) – A Midland, Mich., woman who has received international acclaim using a cadaver-sniffing dog to crack homicide cases was charged in federal court Monday with planting evidence at crime scenes.

    The government said Sandra Anderson, 43, planted human bones at crime scenes in Oscoda, Bay City and Oakland County, Mich., between October 2000 and April 2002.

    The charges were filed by lawyers for the U.S. Justice Department’s Civil Rights Division in Washington. They wouldn’t discuss the case. Anderson was charged on criminal information, the route prosecutors often use when suspects are considering pleading guilty.

    “All I can tell you is that nothing has been firmly resolved on any of those issues yet – discussions are ongoing,” Anderson said. She referred reporters to her lawyers, who said they couldn’t comment.

    The government charged Anderson with lying to investigators and witness tampering. The maximum penalty for making false statements is five years in prison and a $250,000 fine. The maximum penalty for witness tampering is 10 years in prison and a $250,000 fine. Under federal sentencing guidelines, suspects usually face considerably less time.

    The government said Anderson and her dog, Eagle, searched Michigan’s Huron National Forest in June 2001 and April 2002 for a 20-year-old Oscoda woman who vanished in 1980.

    The government accused Anderson of planting and pretending to discover human bones and carpet fiber at the site.

    Oscoda Township Police Chief Robert LaVack said investigators, several of whom were suspicious of Anderson after she and her dog found some two dozen human bones in the national forest. Tests showed the bones came from other humans, not the missing woman.

    “This one hurt,” he said.

    The government said Anderson lied to the FBI and Justice Department about planting human bones in Oscoda and at the Proud Lake Recreational Center in Oakland County in January 2002 and at a business in Bay City in October 2000.

    It’s unclear what police were investigating at the other sites. Also unclear is whether anyone was convicted on the basis of her searches.

    The government also said she tampered with witnesses in the federal court.

    Maybe none of this happened in the Caylee search, but funny things were going on with Laura Buchanan and her attempts to manipulate witnesses. Jordan might have been one of the early targets to get on board, and he responded by recording the evidence now sealed.

    One of the things I will say, is that the search regulations via TES for the November search for Caylee took the possibility of something like this, sadly, into consideration. I hate to say this, but this woman deserves to do time if she interfered in an investigation, and moreover, wth did she get human bones from?

    These good people “searchers” were trying to help to find Caylee, and why in the world would they just hide important photos from LE and defense? JJ got into this mess because of LB, IIRC and also because JS allowed the 32 searchers to be interviewed.
    It’s so sad that people now will be afraid to volunteer to help to search for missing children, KC’s attorneys have turned this into such a mess, I just can’t believe it.
    Are they going to subpoena every single one of us bloggers? I guess that this is KC’s defense next step.

    Thank you for your answer, as I posted the other day I hang my hat on your answers, and trust them with my being. I know that’s alot of trust, but to me so far you have proven to be well knowledged, in the know, and I love your work. I pray you are right! Wont the prosecution have to release this in the docs at some point, do you think they are saving the best for last.

    Blink, are you thinking the judge in the gallery, has signed on to the defense team? Or was he there for a consultation slash second-opinion, possibly on the high-tech courtroom and the cameras?

    The reason it was simple to know what Casey was reading in that Red Huber photo, was not that the text could be recognized, but simply because of watching the hearing, knowing that Jeff Ashton and Baez made comments about the ‘stipulation’ being signed and that was probably in reference to the DNA being sent off to the Pennsylvania lab. Casey was looking over the document, and on video, can be seen adding her signature to those legal length papers. 2 + 2 = the stipulation agreed upon by both sides, nothing private, confidential about that. If the defense didn’t want this big document showing up, then they could have arranged to have their client sign it before entering the courtroom, or in jail, or attorneys could have stood between her and the camera at the end of the hearing.

    Kleat I am not clear on the issue of his honor leaving the court room at all.

    The whole image thing was silly. While the attorney client privilege is, and should remain sacrisaint, there should be no expectation of privacy outside of controlling one’s own audio and communication with the knowledge that they are on damn camera, hello? Public funds, public courtroom, period.

    If the state allows a plea if Casey wants one, then the defense will be able to say that’s the reason, and the only reason the state put the dp on the table to begin with.

    If the defense offers a plea and states the reason they are doing so is because they cannot win an aquittal in their opinion, in MY opinion, CJ Perry will not accept it and the case will be tried.

    Nothing short of an admission of guilt and full disclosure of this crime will be accepted as a proffer for plea purposes imo, or there would be no deal- proceeds to trial.

    Let’s all remember, the prosecution represents CAYLEE ANTHONY, the victim in this case, and they are duty bound.

    I personally dont see her pleaing out because she would have to give a full confession, and in Casey’s twisted mind, she has not done anything wrong. I dont think, IMO she will EVER confess. PLus, I think the state is ready to see this one through. They have given her way to many chances to take a plea and confess. If I were prosecution, NO plea deal. Too Late! Prob a good thing for Casey I am not prosecution huh? LOL

    Knowing I am among friends, I will offer this far-fetched notion about Judge Eaton in the court room. I am (almost) convinced the duhfense will do anything at this point to get a mistrial or releaved of duty. What if mason jar is acting . . . “what did you say?” or “that was before I got here” or “I know I wasn’t here at 5″ etc etc. Then we have bozo who is not acting, but is acting dumber than usual. mason jar said he had another case in the same court house . . . maybe before Judge Eaton and he doesn’t act the same as when he is before Judge Perry.
    Anyway, I know Judge Perry will not be snookered by anybody in a court room! His Honor and Mr. Morgan, Esquire I would love to have dinner and have great conversations.

    In my opinion, Mr. Hubris has not only bragged to the media, but he bragged to the experts and other lawyers he wanted to bring on board. His obsession with Laura Buchanan and JJ and the so-called “evidence” that Caylee’s little body was not in that place until after Casey was in jail makes me think that he exaggerated those claims to anyone who would listen and stating to his colleagues that he had “proof” of her innocence. Now, it is one thing to stand up in front of the media and put on a show. But professional colleagues probably expected that he would be straight with them. This is why I think so many jumped on board with such enthusiasm – He HAD Proof! But as each one realized that he had never investigated any of these claims and as these “proofs” have fallen apart, so have the colleagues fallen away.
    I think that Mr. Hubris is lying to Casey and tells her whatever he thinks she wants to hear. She is happy to have him interpret the law to her and if he tells her that what happened in the courtroom on Monday is just more evidence that she is being persecuted and that the state is punishing him because of his vigourous defense of her, she is all too happy to believe him.

    When JP was asking JB if during JJ desposition if they asked him if he had any photos or took any photos JB said NO…we did not know about it until after the deposition.
    At the tail end of JP asking JB about this JP again asked JB if they asked JJ if he had photos or took photos and JB said yes…isn’t that what he said? Why am I thinking he contradicted himself just to get that subpeona?

    With the hearing this week, and the smack down of Jose, I have to ask myself what if this were my adult child behind this eight ball.

    If it were my child, yes if they say you are guilty then I am here for the state until you prove otherwise. (I love you but I don’t have to like you).

    As this childs parent, I am helping the state, and also helping my child by making sure his/her attorney is doing the best possible job, with the infromation that you have given to him.

    As this childs parent, I am visiting you weekly, and I will continue to try and visit each and everyday that you turn me down.

    As this childs parent, I want to know what happened to my grandchild, and I want the words straight out of the horses mouth!

    As this childs parent, who I know full well is of legal age. I want answers as to why you continue to use this gentlemen for your attorney, and let him/her know what a laughing stock he has made of you and the courts.

    I know she has taken this little Angels life however I have to wonderful why her family will not put up a fight to see her. So Help Me God Blink I just don’t get it! Casey is not someone to be told what to do, when to do it, or how to do it…… Why is she being kept from her family. Does she know that Jose is not able to win this case for her, and she is going to be the next hankie stuffed into his suit pocket forever!

    Because they are focused on her impossible aquittal, period.
    Keep in mind, Baez is calling all the shots here. Does anyone really think he wants the Anthony Police Agents soliciting information that could get him fired?

    JC Mason was very telling, imo, when he responded to the judge that he “WOULD NOT” be held in contempt after 30+ years of practicing criminal law-

    Translation: I will jump ship before I am associated with further shenanigans.

    I can only pray Mason is developing his own relationship with Casey, and she wises up and fires him.

    If she does, I predict, as I always have, Mason will negotiate a plea.

One must have a good memory and obviously he forgot to send Dr. Lee the crate of oranges, he forgot to re-kronk Mr. Kronk, he forgot to ask pertenient questions of JJ at the depo, he forgot to ask the ex-co-counsel who is no longer practicing law because of forgetfulness (yeah! right!) the names and addresses of the 100 people who could free his client, and he forgot that possibly someone else may have read all the documents and discovery and watched all the tapes from the get-go.     I so thoroughly enjoy Bill Shaffer’s comments but his most recent one leaves me scratching my head a bit. I understand all that he said about Jose Baez’s handling of defense discovery. But Mr Shaffer seems to have given Cheny Mason a complete pass on this one. In Monday’s hearing on the motion for sanctions, it was Mr Mason who rebutted.

    It was Cheney Mason who began his remarks with, “I take substantial unbridge at the representation just made by council.” He ended his remarks with this:

    (starting @ 31:30 minutes into part 1 of the 1-3-11 hearing):
    “One last thing I want to remind you about. Mr Baez filed a pleading (I’ve seen it, it’s on your file over on your conputer there) with respect to expert witnesses, telling who they are, where they are, what their field of expertise is, the subject matter they are going to testify to; but they have not provided a script, nor are they required to provide a script under any rule. How would we know what they’re going to testify to until the time comes to see what the State puts on.
    And what IS the State’s problem with taking depostions? How difficult is it to take the deopsition of someone; one, they’ve already Googled; two, they know about professionally anyway and ask that person what they have done in this case, when they have done it and so forth; just as I’ve had to do with 130 witnesses. We don’t have reports, we can’t create reports. We have given what we have.”

    P.S. Jose Baez asserted the same thing in the Dec 10th hearing (before Judge Perry issued the order clarifying discovery rules and the revised deadline). Baez stated;
    “Short of a script of what they’re [experts] going to testify to, I’d be more than happy to tell Mr Ashton whatever he needs to know.”

    The only difference; Mason made his statements AFTER the clarifcation order.

    I agree with you in theory, but I really think the legal community is praying Mason pulls this debacle out of the alley scrap it is right now. I have to say, I do not know what the agreement between Mason and Baez, but does everyone realize because this is a capital case, technically Mason is the lead counsel in this case?

    Hope May gets here quick & Caylee finally gets the justice she deserves. I pray 2011 will be Caylee’s year, and that she will finally get to rest in peace. I don’t know about the rest of you – but I’m real tired of this 3 ring circus…..

Blink, do you really think these kids knew they were on this list? She literally screwed each and everyone of them. WTH would they have to say that could possibly save her life? Aren’t they all state witnesses also?

    Yes. I doubt highly this was the list they wanted to seal, originally.

    I agree with Blink, that the names we have seen are not the ones that Finell wished to be held back.

    My thought on her friend Amy and her x- boyfriends- is not one of shock however. First, Amy seemed like a genuinely caring person. I think she would not want Casey to die., and I am sure she can share some good things about her one-time friend.

    Jesse Grund, regardless of what Casey believed, seemed to genuinely love her, along with Caylee of course. He is also very religious, so I would think that his beliefs go against the death penalty. But I too think he would not wish to see Casey put to death for other reasons as well. He can share stories of the Casey he knew and loved, the one that he did not recognize in the Casey of this case.

    I am sure that AR and Tl also can share some good thoughts about Casey. I don’t think it is a stretch to think they would want her life spared.

    Having said all this, even if these thoughts regarding her friends are true, I think perhaps the reason they are on this list is for other reasons also- I would think that all of these men, from Casey’s past may have knowledge of Casey’s accusal of George or Lee of sexual abuse. We know that TL and JG did have conversations with Casey about her purported sexual abuse. Does Amy and Anthony R also have memories of such conversations to share?

    Also I would think that this group of friends could also remember a thing or to regarding Casey’s interactions/feelings about/with her mother,Cindy- perhaps giving some insight to how Casey felt trapped by her over-bearing mother ect.

    Perhaps I am reaching, and these instances/conversations have nothing to do with why they are on the penalty phase witness list. IDK- but I would think that could be a reason…

    LOOK! I didnt know perry was judge when grand jury indighted kc. heres video I am sure all you guys have seen it but incase their is someone like me who still is catching up on everything in this case I like to share
