The saga begins as follows:

Aging local *legend in his own mind* defense attorney gets “defendant envy” when he sees the dude he thought was the busboy at all The Florida Bar functions, making more on his first big case, with more media face time, than Or lawn do has ever seen. Seasoned barrister signs on for his professional *see alice*, if you will.

Wait, kidding, not the saga in question, my bad.

Yesterday, on behalf of Casey Anthony, lead counsel with Jose Baez, J. Cheney Mason put to “motion” what undoubtedly was screaming inside his head as Mr. Baez bumbled, err, argued, against the States motion for contempt and sanctions last week.  The reconsideration request drafted by Attorney Mason will undoubtedly come as a surprise to Judge Perry.  When his Honor asked Mason why the deadline was not met at the State’s hearing:

..”Was there any particular reason that was not complied with?..”

Mason replied, “The answer to that is I don’t know.” 

Mr. Baez was found in contempt and fined less than the cost of his ipad.

I am not an attorney, but I do know that you cannot introduce new and different bullsh*it you neglected to bore the court with previously AND when you had the opportunity to respond and argue with a new tie and pocketsquare ensemble.

Apparently Judge Perry was not swayed by Baez “.. They say they will call but they never do..” argument, insinuating all Jeff Ashton had to do was call him to work out what his other previous 4 email requests could not.

Makes sense to me now that he put it like that, right?

Everyone knows you can trust what a defense attorney says on the phone who will not commit same information to writing. Duh.

Damn this traffic jam how I hate to be late.. It hurts my motor to go so slow.. 

I have this vision of Atty Slabaugh driving down the 4 with the top down and the 300 pages he threw in the back “loose”, are flying all over the freeway behind him. So that’s the problem.. the dang clerk’s office refusing to tie up their fax, dedicate 2 folks to replace toner and paper in the middle of the 300 page and 5 hour late response, while jamming every other case and function, for Casey Anthony. Missed the memo as well, I presume.

How insensitive. First word folks.. flash-drive. Second word.. GARMIN. It does not take 5 hours to get from Kissimme to Orlando, and that’s assuming he left when the filing was already past deadline.

 

Moving on to the defense’s whine list:

My fave- Dr. Lee found 17 hairs in a car that is believed to have transported the victim in this instant capital murder case and therefore he should not be expected to testify about it.

BBBBBBBBAAAAAHHHHHHHAAAAAA. Seriously?

To date, this is absolutely the most laughable attempt to publicly excuse a witness who Mr. Baez apparently does not consider important enough to pay his dang expenses out of pocket for.

I hear this in my head:

Dr. Lee is not going to be called to testify OR be available for a deposition, cause, like, maybe the harsh weather will not produce that case of luscious oranges, but we are not sure yet, so please wait while we ask the plant lady, who will of course be testifying about plants, but you knew that already. Please tell me you knew that already.

Not to be confused with p-l-a-n-t-i-n-g, as we plan to move to strike or suppress any appearance of the words ” Dr. Henry Lee” and the word “planting” that appear on the same page of any document or media article, as well as within the silent thoughts of any of them-there bloggin’ types.

Lest we forget, Mr. Lee, who will not be testifying anyway if his expenses are not going to be paid, was denied access to an active homicide recovery scene while CST’s were still removing the tiny bones of Caylee Anthony from her swamp tomb.. the nerve of OCSO.

I mean, who knows what Dr. Lee could have come up with in that cornucopia of specimens.

Maybe even Kronk’s Oscar Meyer weenie whistle from the third grade perhaps.

Apparently the defense team , while discussing the virtues of Jose Hubris’s new “do”, missed the free lesson on the actual designation of the Crime Scene Technician, or CST, as mentioned by Jeff Ashton as opposed to the continued reference to “CSI” in defense motions.

Freeman is Freed

Dr. Michael Freeman, who up until last forever was working on his reports for the defense, will not be testifying, although he has not been removed from the defense witness list by presstime.

In an earlier blinkoncrime.com article, I opined about Dr. Freeman’s potential contribution to the case as it relates to a possible death by natural causes. In Judge Perry’s contempt order, it is clear that any expert witness whose opinions or conclusions are not part of discovery, will be excluded from the trial testimony by the defense.

Note- no reporting, no conclusions, no discovery from Dr. Freeman, an expert witness listed in a two year old case. Draw your own conclusions, or, maybe the incident in Washington where an individual with the same name and age helped himself to an Army cell phone that did not belong to him at a Federal facility is “of concern”.

A hearing is scheduled this Friday January 14 to hear the matter.

Late this morning a Judicial Assistant from Chief Judge Perry’s Chambers, speaking from a microphone at the defense table he turned on and off by himself, read aloud to Blink, Editor In Chief blinkoncrime.com, the order he is to prepare for Friday, as dictated to him by my Judge Perry daydream-thought-bubble this afternoon:

Mr. Mason, what you’ve just said is one of the most insanely idiotic things I have ever heard. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this room is now dumber for having listened to it. I award you no points, and may God have mercy on your soul*.

Full disclosure: Maybe without his reading glasses Cheney Mason thought he was penning a request for a vacation, not a request to vacate.. In which case, who could blame the man? I say grant it without prejudice or reservations.

WESH reports today (1-31-11) on a deposition transcript not yet available on their site (or any other I can find) wherein Buchanan states that she altered a TX Equusearch document? The 1st deposition on Aug 16, 2010 ended rather abruptly and Buchanan had not yet been questioned by the defense attorneys. There’s only a video on this, no printed story;

    Annals, I agree with you about the experts. Of course there will be some disagreement as experts are made that way. Gravy train, even ABlack, the attorney for KS, and our dear Linda couldn’t agree on interrupation of what was a felony in the repeating of conversations (if I repeat a conversation illegally recorded, I can be convicted of a felon; it’s a felon to even read it). In Conway’s interview, I almost, not quite, felt sorry for him.

    Thanks for looking at the clips. Thank you for letting me now that both were identical. I guess no one saw the unedited version of the “Cindy jigsaw plea?” Too Bad, as I am still left with wondering whether or not Cindy asked for just thoughts or Casey’s writings also.

    I agree with you that it was very strange that Cindy was asking everyone to bring her the clues she needed to piece everything together. IMO She sadly, already had all the clues she needed to understand Casey’s mindset. It is MOO that Casey went out of her way to leave Cindy little, heartless clues of what happened to Caylee. (the hung teddy bear clip art ect, the diary of days, the fact that Casey was in Orlando the whole time, and was avoiding Cindy. The Fact that her MS page said she was now watching “American Psycho” the fact that Casey never took any clothes, pull- ups ect for Caylee from the home)

    It seems as if the more “clues” Cindy had, or that LE uncovered, all the more determined Cindy became to disregard them. In a way, I can understand this, JB, DC ect seemed to try their best to validate the family’s doubts, however unbelievable they were. IMO. And what human being hasn’t at least one time in their life, chosen to go on believing a lie, instead of facing up to the cold, hard, ugly truth? What could be more cold and ugly then believing that your own daughter merrily went on with her life, after disposing of your granddaughter?

    cindeefromwisconsin- Hi. I don’t think Robyn told the whole story either. She walked around some answers, she stammered through others. She seemed reluctant to give any info. (who wants to be known as a snitch?)But she did give LE information. And because of her, we have Casey’s writings from jail- and we can read for ourselves just how much Casey has been “humbled” & we have another person who will describe the different reactions Casey had to remains being found.

    IRT “Eric” I can’t remember if there ever was a ‘real’ guy named Eric Baker. But he is the person who Casey said was Caylee’s dad (after JG ect)- She supplied an obituary(fake IMO to Cindy) with his name ect and oddly enough, it included a quote from Jesus Ortiz- the person Blink & others believe to be the real father,. As for the military guy in Cali, that was Mark Hawkins-, one time boyfriend of Casey, and one time husband of Lee’s ex-girlfriend Terri…. Hope this helps.

    I finally read through the shurtape info just released…and wanted to point out that the company stated that the duct tape was not manufactured after Sept 2006. I think this info was already out there, but thought I’d underscore LE’s findings.

    Basket case indeed! Thanks for the laugh. Mom 3.0; I assume you read the interview of Brad Conway by John Allen & Eric Edwards. Baez was being so skanky trying to get Conway to fish the Tx Equusearch docs for anything relating to Laura Buchanan.

    The evidence tampering investigation is ongoing. Why am I feeling like Baez won’t get in trouble for that too? Guess I’m a sceptic.

    I believe that crazy Laura Buchannan will face charges (as well she should) but she’s not an officer of the court. Good thing for her she’s NOT a police officer. Did you see how she introduced herself in her emails as; CPA & law? She’s bat guano crazy.

You would think that an innocent woman would be more concerned about clearing her name, asking how her case is coming along, any new leads, not enjoying the process itself, show hell bent emotion for her dead daugther, FOCUSED!!!!!!, etc, etc. But no. She compliments her attorney’s hair.

    I’m gonna roll with the ‘nothing she does surprises me anymore’ state of mind. Oh…and how blatantly pathetic her behaviour is. :S

Cluing the public into Casey being a ‘writer’ (journals, texts, instant messages, myspace, etc), she should have encouraged the ‘missing pieces’ be sent to LE. Duh, right? What gets me is the fact that many people have been alone with Casey, Annie, Cindee, Traci, Robyn ect- yet all of them claim not to have asked her any real questions regarding Caylee, the nanny ect- I call BS- I just think Casey either refuses to answer or says something so off the wall that they dare not repeat it, for fear it would put them in a worse light…JMO

    Hi annnals- Yes, I read the Docs and you may be a skeptic, but you may be right- Each time someone has brought up issues/concerns to the bar, it never seems to go any further.

    IRT the latest complaint with the Bar-(not sure if this has to do with LB and Conway) a spokeswoman was quoted as saying:

    So my guess is that your skepticism is well-founded.

    What would happen to the court case if Baez is reprimanded by the bar?- Would it automatically begin again/ Or would it start in May with mason at the helm? Does anyone know?

    Tampering is listed on the ‘property form’ (not official complaint filed by Conway….sorry!!!!) and docs seized from BC. I suspect this is why Baez is being investigated.

    I was told and I infer that it had nothing to do with conway but than the FB is aware of that too. There’s so much that baez had done that raised a red flag with the FB and so thus the investigation. But than what do I know I am just speculating and guesstimating.

    The controversy swirls around Laura Buchanan, who had searched for Caylee’s body with the volunteer group EquuSearch. Conway said Baez kept pressing him to get EquuSearch documents from Buchanan, which Baez said proved Caylee’s body was not there in late summer, and Conway kept refusing.

    Here Kathy Belich claims that she was told that Brad Conway was not who reported the aledged ethical violation (lying to the court). She was not told who reported it, but it could have been anyone, since Brad Conway’s interview with LE (in the witness tampering investigation) was released last Friday.

    Is Baez toast? If you go by legal analyst Bill Schaeffer’s commment, he’s up crap creek without a paddle. However, I got the impression from some of these links that the reason for the FB investigating Baez hasn’t been revealed.

    I believe it’s speculation for now that it involves Laura Buchanan’s tampered docs and Baez’s statement to the court that Brad Conway knew about them. Baez also claimed BC was aware of evidence that would prove Caylee’s body was not where it was found while Casey was out of jail. BC denies this claim made by Baez. Baez also contacted BC to contact LB for these documents. Why would he do that? BC was never a part of Casey’s defense team. After reading BC’s statement, it made me wonder if Baez wasn’t setting him up. This seems very articulated on Baez’s part. He either viewed BC as a no brainer lawyer who wouldn’t question Baez’s requests OR felt BC would back him up on these claims. Kinda scary if this is true. It certainly proves Baez has no regard for proper retrieval of evidence, not to mention complete disregard for who he answers to as an attorney (FB for example, the courts, his clients, etc). BC could have been hit with the same investigation from the FB if he followed through on Baez’s requests to contact Laura Buchanan for the ‘tampered’ docs she possessed. Did Baez admit to reviewing the docs LB was in possession of? If not, it’s quite possible BC would be the one FB is investigating, not Baez. If Baez was a fraction of the success he claims to be, he’d be one of Florida’s top defense attorneys. Instead his inflated ego makes him look more like a bubble head.

    Re reading BC’s statement…I think Baez’s intent was to determine if BC knew anything that would contradict so called crucial information acquired by the defense. BC never followed through with Baez’s request from April 2009. Baez knew this, so, could he pull off the misrepresentation? Sadly, this info was offered in court while BC was in session. Why would Baez make such a claim? Blatant misrepresentation!!!! Did he think BC was going to back him up?????

    Hi Ragdoll. Actually the documents contained in the link weren’t seized from Brad Conway. They were taken to Mr Conway by John Allen & Eric Edwards for Conway to read and comment on as they conducted their interview on the witness tampering case. This isn’t made clear in the link. You’ve read the interview. The link has the documents they’re discussing; the ones they asked Conway to initial.

    Annals, thank you! I must clarify how I came to the conclusion it was info retrieved from BC. I read the property form and it states on record that docs were seized from the home of Brad Conway. Perhaps the docs were BC’s own documentation of Baez’s attempts to get him to contact Laura Buchanan????? Any clarification on this form would be greatly appreciated!

    I kinda giggled when I saw how we flooded Blink with our rather in sync postings. I didn’t think much of it when I found it but as I read on, it seems this could the big un. We can hope!

    I feel bad for BC being put in this position but it seems no one is immune to Baez’s corrupt handling of this case. Clearly this man is grasping, even to his fabricated lies. If that isn’t a reflection of inexperience and incompentency, then slap my @$$ and call me Billy.

    Chica, what an inspiration his Honour Belvin Perry is! Not only did he overcome adversity, but he is DAYUM GREAT at what he does. My thoughts since HBP Jr. became involved was his astounding ability to retain detailed information, keep the course and ensure a fair trail is established (sorry for my fragmented sentences and dangling particples, etc etc). Brilliant, to me, is how he reminded the defense about a potential witness (sorry, I cannot recall his name….the inmate who claimed he had relative information that would prove Casey’s innocence) that could help their case. He has his hands all over every aspect of this case!

    Like many on Blink’s site, I adore and utterly respect Mr. Perry Jr., Ninth Judicial Circuit Chief Judge.

    I was just saying that although the form says, impounded; it gives the misleading impression that they were taken from Conway. All the handwritten items say that they were shown to Brad Conway. E Edwards & J Allen took the documents to Conway. Once presented in an interview and initialed, the documents became evidence property, thus technically, impounded.

    In the interview E Edwards said I got these off the internet…Sunshine Laws.
