Caylee/Casey Anthony Case: Will Judge Rulings Today Be Defense Doomsday?

Chief Judge Belvin Perry promised to rule on 2 outstanding motions by her defense team today.

Update #1 4:45PM.. Motion to exclude trunk stain… D E N I E D

Rulings on Critical Motions regarding a hair with a "deathband" that could only belong to a deceased individual and either Casey or Caylee Anthony, and the air samples tested by Dr. Arpad Vass and found to contain chloroform levels he has never seen, in his 22 year career.

The air samples themselves are not in contention as the "hardware" and methodology in their extraction are used widely in the scientific community, and the defense team, through a stipulation agreement to withdraw contempt proceedings against him, could not argue about anything else.  The defense argument was largely about the interpretation of the data that was yielded from the samples as they relate to a decompositional event in the trunk of Casey's car.

Both motions were a combination of a Frye/exclusion attempt by the defense that took several days in court to conclude, in which many observers felt were disorganized and poorly argued in contrast to the deft responses by the prosecution.

Yesterday, for the second time, Jose Baez on behalf of Casey Anthony filed a response to the State's motion to let his already withdrawn "experts" Dr. Danzinger and Dr. Weis be permitted to testify as to what Casey told them during their interviews with her.

You may recall, during the State's deposition attempt of Dr. Danzinger,  Judge Perry put the kibosh to it after receiving a call from Jose Baez, and both depositions have since been sealed.  Judge Perry referenced testimony about Post Traumatic Stress Disorder, or PTSD, but legal experts agree that in itself would not be grounds for suspending a deposition and immediately sealing it.

It is this editors opinion that during the deposition,  Dr. Danzinger recounted parts of his interview with Casey Anthony that may have been incriminating to her.

It was abundantly clear that the defense strategy is/was to attempt to have these witnesses speak about parts of their interviews with Casey Anthony as a way to repeat her "defense" without ever taking the stand, subjecting her to cross-examination by the state.

It is also abundantly clear that Jose Baez et al did not understand the Judge's comments about these depositions the first time around.

The only way these "Docs" will be permitted to testify to anything Casey Anthony told them, is if Jose Baez presents an exception argument to the hearsay rule, and since the "declarant" or Casey Anthony, will never take the stand, 'not gonna happen.

Yesterday afternoon, the defense depositions of Tony Lazzarro and Amy Huizenga were filed with the court.

While there was largely previously known information contained in both depositions, there was one noteworthy tidbit in Ms. Huizenga's which the defense glossed over in a hurry.

Reported exclusively by www.blinkoncrime.com,  the Anthony's withheld a major plumbing emergency at their home that sent someone from Hopespring Drive in a panic to locate Caylee.

For the first time, it is confirmed that Casey knew about it, and told Amy it was one of the reasons they could not move in:

    I agree as well ATG, in recovering what happened to an innocent 2 yr old, everyones cooperation is welcomed, and needed. It is very heart warming to know that some of the people that Caylee touched were like us, alarmed at her ‘disappearance’ and shocked at the lack of cooperation by her family, realizing without a doubt that she is an important member of much larger family, the human race. At least the parents of some of Casey’s friends obviously instilled in their kids the respect and love of life.

    Just a thought but….
    It seems to me that just a ring or just a piece of clothing stuck in a pipe is not necessarily going to make Cindy panic. Even a pair of gloves with the ring could be “Cindy excused” away.
    But a piece of Caylee’s clothing covered in blood and trapped in a pipe would make a grandma panic. (Cindy was still a Grandma then)

    What if Casey beat Caylee and made her bleed real bad and it made the precious babies face swell up or have severe bruising that would not be able to be “excused away” by Casey to her parents?
    Caylee would have been asked what happened, she was old enough to communicate that much.
    We don’t know Caylees manner of death, there could have been bleeding involved without major blood evidence in the house. Caylee was little. :(
    The duct tape could have been after the fact to help Casey counteract the “O” effect that would have set in post mortum. Or Casey could have duct taped Caylee later realizing that she was going to be able to communicate how she was so badly hurt.
    When you don’t want someone to say something you tell them to “shut their mouth”
    Something to ponder….

    There is no evidence Caylee was beaten in the face or anywhere else, and there was no evidence of blood in the home, or anywhere else for that matter.

    I do believe what was found belonged to Caylee.

    You would be amazed at how some people plot and plan to get what they want or to hide their activities. The only way to discover the plot is for a group of people just like Amy and the guys to sit down together and be willing to spend hours discussing events they know about and then assembling a time line with anotations on the line developed.

    If I were the prosecution, I would assign someone to go over everything these young people presented. Then, try to help them remember events by asking quality questions when they testify.

    Angela_nw- Hi. Casey also mentioned landscaping which we now know that several trips were made during June and July to the Home- Improvement center……and ewe know Cindy and George DID relanscape their yard…So Casey was at least aware of these happenings.

    About the mention of the air-conditioning.

    There is absolutely no evidence of this in the case, but the first thought that came to my mind when I heard that Casey mentioned air-conditioning is Freon- – I have read about people abusing freon to get a cheap high.
    Could Casey have thought she could get high, and tried to figure out how, and somehow broke the unit?

    Blink is correct there is no evidence that Caylee was beaten nor was there any evidence of blood in the home, or anywhere else. We know the autopsy showed no signs of broken bones ect-

    I just wanted to point out, a person can be bruised up badly and not bleed. Also, it is my experience that with some abrasions and with rather deep cuts…there is not alot of blood loss, and there still may not be broken bones…. Also Caylee could have been hurt internally- but this evidence was lost because her remains were found so long after death.

    TGF youre right that is the way good people try to help LE…but it can also be a way for not so truthful people to try and mess up the investigation, supplying wrong information accidentally on purpose or deliberately…. Lots of timelines in this case…

    BTW, I have been wondering, since Casey’s own team member, LDK came out and admitted that the Zanny the nanny kidnapper story was a lie…I wonder if Cindy did the right thing, and called up her brother Rick and offered her apologies for her behavior and hateful emails? I hope she said she was sorry for trying to turn his Mom against him…

    So sad how many people were hurt by all of this. Casey should be ashamed of herself.

    The heart sticker..it’s a bullseye for me..it really tugs at my heart and mind and reminds me that no one else other then Casey could have done the deed. It’s such a female thing to do..and although she has emasculated this crime on so many levels..the heart sticker is a tell tale sign to me. It was perhaps the only sign that someone who once loved this child, or should have loved this child, did this..and it almost shows she loved her body in death more then in life. Circumstantial I know..but still a heart breaker none the less.

    Momof3..Love the analogy with Veronica wiping Jesus face and the stain remains on her cloth and poor little Caylee’s body fluids remain leaving a stain in the trunk liner. The Stations of the Cross are very poignant reminders to me of the suffering and compassion of of our Lord and his family and friends.

    What is hidden in Darkness will be brought forth for all to see by the Light. Too bad Casey didn’t know that little phrase.

    Casey certainly has complicated many lives in the wake she has left behind her. Every action we take good or bad leaves a ripple that travels out to touch all humankind. Hard to fathom but so true..every lie, every kiss has an impact..just happy to be in the company of people who know and understand that concept and try to live it everyday.

    No memoirs yet Blink..got too much living yet to do, people to see, grandchildren to attend to, a loving mother whom I adore, a son and a husband who still, bless their hearts, tolerate me at worst and love me at best and heck..I’ll be 60 this year..I’m thinking about re-inventing myself.

    As far as those comparing Casey to the Crucifixion of Jesus, I will try to be a lady, and state there has only been one Perfect Person that was crucified and it isn’t Casey Anthony.

    Reflecting back on Laci and Connor Peterson’s case, I believe her cause of death is listed as “undetermined” and manner of death is a “homicide” = death by lethal injection for Scott Peterson.

    It is my belief that the Prosecution has a very strong case against Casey.

    I BELIEVE….Justice for Caylee.

    You are correct as usual. Bad people could furnish information that would create a problem for LE. An organized gang might try this, but everyday people like Amy and the guys would not likely do it.

    There are many different types of freon. Most of it has been declared a hazardous material by my favorite (sarc.)government agency, the EPA. The only way an unlicensed person could get it would be by theft.

    Unless one understands how to handle pressurized containers and has access to proper valving equipment, freon is not likely anything our young “get-highs” could use. The house air conditioning unit would have freon 22 and that cannot be accessed unless an actual valve (not a schraeder type like on your car tire) is available. At 350 to 400 psi it would create a lot of noise and vapor in the air.

    We are dealing with IMO a sociopath with Casey and possibly another less out of control one with Cindy. They don’t have feelings like normal people.

    Just wanted to weigh in on the heart sticker. IMO, it wasn’t a sign of one time affection for Caylee. IMO, pardon my French, Casey was saying to Cindy “Kiss off! You loved her more than you loved me! Well, how do you like it now? Everyone lies, everyone dies.”. Casey was playing her family with her jail visit clues to Lee (Zenaida Gonzales, she’s close, between 9 and 1, etc.). She was enjoying her little game of CLUE…just more passive aggressive center-stage behavior on her part. Given what we know of her life thus far, she clearly enjoys toying with people. In reality, she needed them to find Caylee first and move her/dispose of her. Her pride and hatred for Cindy though, wouldn’t allow her to simply confess what she’d done and where to find Caylee. Whether you’re a Roy Cronk fan or not, thank God (seriously) for him. I doubt Casey ever had a moment of affection, much less love, for Caylee. I doubt she ever had an ounce of love for anyone but herself.

    Cindy , the Plesea princess, just fed that and reinforced her belief that the world revolved around her. Confronting her and holding her accountable meant Cindy’s princess was less than perfect- a concept unacceptable to Cindy. It was easier to cover for her than to parent her. George, under fire from Cindy, simply abdicated parenting. He learned early that confronting Casey threatened Cindy’s illusion of control and perfection, threatened his marriage, and therefore threatened his lifestyle. Lee, the firstborn (the “responsible one”), had the joy of being the family mediator/peace maker…walking a tightrope between three explosive and self-centered personality types. He also somehow ended up being responsible for Casey.

    JMO, and I could be wrong, but I think Lee had to figure out early how to appease everyone. I think he’s got little respect for George as a man or a father. He loves Cindy, but he’s conflicted there- knowing how manipulative and controlling she is, but she relies heavily on him emotionally(as a substitute for George). He loves his sister and there’s been some “us against the parents”. At the same time, he’s not dumb and knows Casey like a book. Having been a cohort in some “adventures”, he’s been loyal to a fault. Being that Casey was being Casey (unplanned pregnancy, lie and denial until the obvious conclusion, unemployed, leeching off the parents, life is one big party, etc.), Lee probably had no real emotional bond with Caylee. It wasn’t like his favorite sister met Mr. Right, got married, settled down, and had Caylee (not disparaging sweet Caylee one bit here). Hence, Lee’s seemingly emotional detachment when it came to Caylee. However, he’s no fool. He knows there’s a huge difference between covering for Casey and pulling one over on the parents versus covering for Casey murdering Caylee.

    In all honesty, Lee’s probably getting a little tired of the Casey show and cleaning up her messes, smoothing things over. Lee may be loyal, but he’s not stupid enough to allow Casey to destroy all of them, just to save her. The reality is that Lee knows what Casey is really like. As much as he’d like to think otherwise, a part of him knows it’s going to come down to her or them, no holds barred.

    He can change the status quo though. The best defense is a good offense. Casey is not going down without a fight. She’s never really loved any of them- the cold had fact is, she feels completely comfortable destroying them. That’s hard for Lee, I’m sure. He’s clearly thought of himself as her: defender; mediator; confidant; supporter; and hero. No doubt, Casey’s encouraged this mentality, manipulating/playing him to run interference for her. She’s invested some time into making him feel important, stroking his ego. I feel sorry for Lee- the truth must feel like being hit with a ton of bricks. It’s got to be rough to find out what you thought was the truth all this time has been a lie. His best and only defense is to beat her to the punch and tell everything he knows to LE. Cindy isn’t going to like it, but the Lee will be saving Cindy, George, and himself. Casey was bent on destroying Cindy and she began with Caylee. She will always choose herself over anyone else (unless she has a real come-to-Jesus moment, seriously). Then Lee will finally be free of the drama, the family fighting, the constant walking on eggs, being expected play substitute husband/family mediator, having to carry his family all the time, and be “the responsible one” expected to solve everybody’s problem. Lee deserves a life of his own. For his sake and Mallory’s, as well as their future, he needs to stand and say “Enough is enough.”.

    Nancy Grace showed a portion of Dr. Kenny-Baden’s interview from “48 Hours” wherein she acknowledges that Casey totally made up the name Zenaida Gonzalez, and all that went along with it. Of course, it’s acknowledged that Attorney Baden certainly could not make this statement without Casey’s consent as it would violate attorney-client privilege. Therefore, the thought is the defense will admit, right from the start, that Casey lied. And if Casey lied and Z. Gonzalez never existed, why wasn’t Caylee reported missing for 31 days?

    What I think will be more interesting is how this statement by Attorney Baden will be used to impeach the credibility of Cindy Anthony, and possibly George, altho I don’t recall his statements about Z. Gonzalez as well. Cindy Anthony, once she started back-pedaling big time, and when she gave her depositions, and testified in court, basically said, oh, yes, she was aware the nanny’s name was Zanny, but had never met her. I believe George said he never heard the name. Cindy Anthony is in for one major cross. However, I believe the one thing most people will remember about Cindy is her desperation on the phone about Caylee and the fact that “it smells like a dead body in the damned car!” The rest of her testimony isn’t credible.

    While I don’t believe Casey will likely plead guilty the day of the trial, how likely is it she’ll make a deal at some point in the trial? All inmates want to spend as much time out of the cell as possible, but will she wait too long to make a deal for HER life?

    ISpy – I have felt and posted for some time that I believe Lee will be the one to bring Casey down. I agree with your reasoning regarding his relationship with his family and I have much sympathy with him; just wish he had come forward long ago and not waited until information has to be dragged from him at trial. His loyalty has to be to Caylee, himself, Mallory and his parents. Whilst I feel Cindy has brought the hatred and scorn of people on herself because of her behaviour throughout this whole sorry mess, I do believe she loved and cared for Caylee. She will have to live with her betrayal of her beautiful baby grandaugher for the rest of her days. Not an enviable life.

    Tony’s deposition IMO makes him come across as rather disconnected from reality. This may be on purpose, but he just rambles around and makes little sense.

    Amy comes across much better. She too has some memory problems,but they are both young and very inexperienced in life.

    I don’t think the defense got much from either deposition that wasn’t already known.

    Your sharp eye AMAZES me!!!!!! I didn’t even catch the part about the pipes when I read the Amy’s depositions. I just took it as more of Casey’s lies and excuses, forgetting that she weaves a little bit of truth in all of her lies. I have ALOT to learn about being observant, aware and putting 2 and 2 together!!!! I am confident that more information regarding the plumber, etc., will come out at trial.

    After reading the defense’s depositions of Amy and Tony, I find myself walking away with much the same reaction as everyone else here…Tony seemed somewhat forgetful and separated from the events that took place almost 3 years ago. Amy was strong and forthright in her testimony, especially when Baez basically accused her of filing charges against Ms. Anthony out of revenge, or by implying that she had been coerced by the state, so that Ms. Anthony would head into this case as a convicted felon. Just like the rest of you, I loved her response “Justice is Justice”.

    The part that got to me the most regarding Amy’s deposition has got to be when she described her and “the gang” recreating the timeline and making the “calendar” at Barnes and Noble. It’s been haunting me for days, and I can’t get the image out of my head…it makes me smile and tear up at the same time….I will try to describe it as best as I can (I wish I could send my thoughts to Mom3.0 because I KNOW she would put it into the perfect words)….anyway, Amy stated that when they went to Barnes and Nobles, at first they planned on sitting in the Starbucks/coffee section, but it seemed too loud and they didn’t want anyone to hear what they were discussing. They then decided to go to the children’s section, and were sitting in those little chairs, at the little table, recreating the calendar. I just can’t help but think that it wasn’t a coincidence that they ended up in the children’s section. I have an image in my head of little Caylee, summoning them to come and “play” with her in the children’s section, and help her right the wrong that had been done to her. While they are working on their calendar, she is reading the same book to them that she had read to her Great Grandfather…”Mama, Papa”. It’s as though Caylee’s spirit was there with them, guiding them, encouraging them, to put the pieces of this puzzle together.

    I was just reading back and saw Gypsy’s post. It sparked a thought that I had earlier. On almost every item at the remains scene, as well as the gas can, there were blue cotton fibers. Did casey wear gardening gloves when disposing of Caylee? Could that have been what was flushed down the toilet?

    Amazing how they found a heart sticker/residue after the floods, rain, and hot sun close to the body, yet they didnt find any DNA on the duct tape of CAylee’s. I dont buy it , and either will a decent jury, IMOO. Some of that so called evidence was planted AFTERTHEFACT….MOO Again, with 3 grown adults living in that home, none of them calling authorities within that month, and GA admitting seeing KC several times during that time frame well, it points to a hung jury or KC will walk. There’s more evidence of a coverup or someone else within that home than anything else. There should be DNA all over that duct tape as well as that car trunk…..HEllo, anyone should know that! That means duct tape was placed on her wayyyyy after the fact as well as many other things found from the A home~ MOO

    Sure it was, except it was attached to Caylee’s hair, at the time, and because of the decomposition, her hair ended up in a ball at the base of her skull keeping it in place.

So then…there is still no DNA on the duct tape! Not the murderers nor precious Caylee’s. Deductive reasoning tells me…the DNA was destroyed by the elements!

    Casey is the only one that can not be distanced from each and every piece of the evidence…sure George may have “admitted” to seeing her…but what does that tend to prove?

    Many people saw Casey during that time period, and “admitted” it… Heck we have tape of her during that time…and it all shows Casey merrily going on with her life…carefree, and the jail tapes certainly do not show Casey as a person who would risk her freedom to protect any member of her family most importantly Caylee.

    She certainly did not seem to be frightened by her family either… and as close as she was/is to JB you would think if any other Anthony had did it, LE certainly would have been notified- or at least Geraldo would have been… and Casey could have been out of jail and one of the Anthonys would have taken her place. End of story.

    As for the heart sticker, does not matter in the big picture…dont worry so much about it…it is only one piece of evidence… there are others…be patient the trial is fast approaching.

    I never have been one to comment too much on George or Cindy with the exception of saying that if we don’t know which person in the anthony family is telling the truth. Then the “last” one to see Caylee witnessed by someone elses eyes…is cindy on the 15th.

    AND the verbal abuse that Cindy spewed on Casey was not normal. Who calls there child a sociopath one minute and then there best friend the next.

    After two years on BOC and vals I still have not convicted Casey. To me her behavior was that of a mother who thought she knew who her child was with.

    IMO Geraldo lives in La La land of his own making. He is the stupid one who sat on his heels in the desert to draw a map ,in the sand, of where the troops he was imbedded with were located during the First Gulf War.

    He is lucky that he didn’t wind up in Levenworth federal prison. The only thing that saved him was the military thought it was ignorance and stupidity rather than a deliberate heads up to Iraq’s troops.

    As you all can see, I really like this guy. NOT!

    Hi regarding geraldo! he will be coverint the trial also! he said he would be there to support baez. I am hispanic and none of my family members or community like him! he is arrogant a loud mouth!. the only reason that he is with fox is because he has bought shares there. I think he is a has been!

    I just read at the hinky that insessions will be doing a two hour interview with baez on thursday! what can he possibly say in two hours! we all know he lacks intelligence! I can just imagine it to be like the hearings repetetive!! he is way in over his head and not qualified or intelligent enough to play with the big boys!! (my moms words) lol
    I have no plans on listening to his two hour rant! I can bearly handle him during the hearings! the team of baez/mason! is the worst I have ever seen. I would have thought mason would have been a positive mentor! but instead it has turned into a circus! I am not impressed with mason and his long career! I think he is a mean, arrogant man!! and thats being kind!! I watched his youtube video! he represented nelson serrano whom is now sitting on death row!!
    he blew alot of smoke!! like he does now!! I just cannot wait for both of them to be shot down with the guilty verdict for their client.

    gerlado will be there to make himself known but !!! that ship has long sailed and it didnt even said part ways!! he is using the excuse that he wants to support his friend!!

    I think geraldos comment on his show recently that the no life bloggers were a lynch mob!! but than went on to say that maybe casey was a whore and maybe casey partied and left casey alone! to party and she should be found guilty! correct me if I am wrong! not verbatim! I do not want to lisen to his voice again!!! my gut cannot take much of any of their voices!!
