Caylee/Casey Anthony Case: Will Judge Rulings Today Be Defense Doomsday?

Chief Judge Belvin Perry promised to rule on 2 outstanding motions by her defense team today.

Update #1 4:45PM.. Motion to exclude trunk stain… D E N I E D

Rulings on Critical Motions regarding a hair with a "deathband" that could only belong to a deceased individual and either Casey or Caylee Anthony, and the air samples tested by Dr. Arpad Vass and found to contain chloroform levels he has never seen, in his 22 year career.

The air samples themselves are not in contention as the "hardware" and methodology in their extraction are used widely in the scientific community, and the defense team, through a stipulation agreement to withdraw contempt proceedings against him, could not argue about anything else.  The defense argument was largely about the interpretation of the data that was yielded from the samples as they relate to a decompositional event in the trunk of Casey's car.

Both motions were a combination of a Frye/exclusion attempt by the defense that took several days in court to conclude, in which many observers felt were disorganized and poorly argued in contrast to the deft responses by the prosecution.

Yesterday, for the second time, Jose Baez on behalf of Casey Anthony filed a response to the State's motion to let his already withdrawn "experts" Dr. Danzinger and Dr. Weis be permitted to testify as to what Casey told them during their interviews with her.

You may recall, during the State's deposition attempt of Dr. Danzinger,  Judge Perry put the kibosh to it after receiving a call from Jose Baez, and both depositions have since been sealed.  Judge Perry referenced testimony about Post Traumatic Stress Disorder, or PTSD, but legal experts agree that in itself would not be grounds for suspending a deposition and immediately sealing it.

It is this editors opinion that during the deposition,  Dr. Danzinger recounted parts of his interview with Casey Anthony that may have been incriminating to her.

It was abundantly clear that the defense strategy is/was to attempt to have these witnesses speak about parts of their interviews with Casey Anthony as a way to repeat her "defense" without ever taking the stand, subjecting her to cross-examination by the state.

It is also abundantly clear that Jose Baez et al did not understand the Judge's comments about these depositions the first time around.

The only way these "Docs" will be permitted to testify to anything Casey Anthony told them, is if Jose Baez presents an exception argument to the hearsay rule, and since the "declarant" or Casey Anthony, will never take the stand, 'not gonna happen.

Yesterday afternoon, the defense depositions of Tony Lazzarro and Amy Huizenga were filed with the court.

While there was largely previously known information contained in both depositions, there was one noteworthy tidbit in Ms. Huizenga's which the defense glossed over in a hurry.

Reported exclusively by www.blinkoncrime.com,  the Anthony's withheld a major plumbing emergency at their home that sent someone from Hopespring Drive in a panic to locate Caylee.

For the first time, it is confirmed that Casey knew about it, and told Amy it was one of the reasons they could not move in:

    Yes! The defense withdrew Dr. D and Dr. W on April 18th, and within two days, the lawyers for Zenaida Gonzalez filed their own ‘EXPERT WITNESS’ witness list with the OC clerk’s office.

    No coinkidink there, eh?!?!

    My bet, certainly it’s Dr. Danzieger, and probably Dr. Weitz just for good measure while they’re at it, and to cover all the PTSD bases.

    I think right now, a priority for Morgan, would be to depose Dr. Danzieger, even if this stayed under seal until the capital case is over, Danzieger said something during the depo with the state that would be a problem for Casey.

    Judge Perry has ruled that the jury can see and hear the evidence and decide for themselves if it is indicative of Casey’s guilt or innocence or even if it is worthy of contemplation at all…

    I dont know if the Defense and Casey could hear the faint sound of Taps being played, as they lay their heads down to rest last night…but I wonder if they awoke to the sound of bells and thought: “Ask not for whom the bell tolls… it tolls for thee”

    pS Wow about the Docs- I guess we know why Casey and team seemed so downtrodden after emerging from the in camera session in chambers.

    Be careful of opening doors….someone else may choose to walk right in, sit right down and make themselves at home.

    Archie- Hi, I understand your frustration of wanting to separate the facts from the mere speculation. I agree it is needed.

    But FYI, Val also does her fair share of speculating, rather brilliantly too. She has lent her thoughts and feelings, based on known facts, ect, toward brilliant speculation that may prove out to be true. ( Im sure you have read her early thoughts on Zanny, her thoughts on the Zanny/Dora Myspace, her thoughts on Caylee IRT, premature synostosis…her thoughts on Caseys Diary…ect ect)

    Val nor Blink, nor any of us, know the whole truth- we all speculate- we all post our opinions- They, Val and Blink, read the docs, they do their research, they interview people ect,they add in their thoughts,and feelings- some based on facts/ based on their hypotheses, and their own interpretations ect. They do it brilliantly, and with the hopes of helping Caylee.

    So I am not sure what the problem is Archie, surely you understand that everything that has been written (here and elsewhere)in relation to this case, is not only “fact” but speculation based on facts and some just humorous others just rants ect…

    My Momma always told me:

    ‘You must not take everything to be true that is told to you.’
    Question everything- question what you hear, what you read, and what you see. To do anything less would surely lead to disaster.

    anyway I am kind of confused on these two doctors and what they can do for the defense, can anyone enlighten me?
    I am fighting that aftermath of lots of rain ( southwest Missouri)and leaks and such but trying to keep up as hopefully I won’t be lost when this is being discussed…

    and Kleat, how does the state keep certain depositions and other evidence from us? still, there is quite a bit that has not been released? I am confused a little on Florida laws.

    There has been mention of an appointment for Casey to get a second tattoo. Has there been any info as to what the tattoo was to be? If it was to be an intricate or very specilized one, Casey and the artist may have discussed it.
    Also, I found it interesting that Tony stated in his depo that Casey did a great job of ‘keeping house’ on a budget. Surprise! She had tons of her mom’s money to work with.

    Blink- So glad Archie brought up the “snip” of your comment about Casey blaming George. Even if it weren’t for good reason on his/her part I can use it as so. I finally gathered up enough strength to watch the 48 hours episode…….it was actually not as bad as I expected.
    During the video Jose Baez once again mentions the reason Casey didn’t report Caylee missing is compelling and it will come out in court- I have a feeling this is the “Insert George Here” moment for the defense. I just feel as though the only way to make the “31 days” acceptable is to say George did this and Casey was running from him.
    Any thoughts on this?

    BTW- Blink, FYI may not be an insider, but in instances where she has interviewed/talked with “players” in this case, she has never betrayed a confidence and she never will.

    Archie, I can tell you are passionate about this case. We all are. Blinks style differs somewhat from Vals but they have agreed far more than they have disagreed. If you feel more comfortable at the HM thats okay. If you decide to stick around here thats great, or if you dont thats okay too.

    What should matter most is justice for the victims, and both Blink and val are all about that, not all of this BS behind the scenes posturing,you know?

    When this case is over, I have committed to sharing a lot of things I cannot discuss prior to that time. That will not include betraying a source without their permission, but this case is very personal to me, and I think that inspiring advocacy in others is one of my objectives.

    As far as archie is concerned, I have had my share of haters as you would be surprised how many people would rather see someone fail; I know I was. I simply do not have the time or inclination to make that my problem, so I don’t, lol.

    So…….. I watched part of the interview on “In Session” this morning with Baez. Did ya’ll know he dropped out of school in the 9th grade and became a parent at the age of 17. After receiving his GED he went on to college without a clue as to what he wanted to do with his life. His then girlfriend convinced him to become a lawyer and decided to give it a try. lolol Seems as though he is STILL “trying”.

    I also found out this morning that Cindy and George have moved out of their residence and are renting a home in a nearby subdivision.

    Chloroform evidence allowed at trial. Evidence now places Caylee’s body inside the trunk of the car.

    Search on the internet shows “Neck breaking” and “How to make Chloroform” excuses away an “accident” as the defense will try to claim.

I will be so angry when Baez comes out explaining how Casey was running from her Mother because she couldn’t bring herself to explain how George accidently allowed Caylee to drowned in the pool (the ladder). She couldn’t hurt her mother like that. Casey moved Caylee to protect George. She did this out of love.

    When the dust settles Casey can not say that her lawyers did not try their darnest, through repetitive motioning, to get key evidence tossed.

    It appears that the good judge has been doing his homework, his rejection of said motions are well written and backed by solid case law…therefore his rejection of the motion against his rejection is so sweet, clear and to the point. IE tossing the tell tale stain in the trunk.

    Classyhgal- Hi I did not watch the whole interview but did catch where Baez mentioned Cindy being one of the reasons this case has gotten the kind of attention it has…I have been thinking- I think we are gonna be hearing alot more about the CMA club and how it was a ” cult”… and how its all Cindys fault… But before it comes to that- I just want to be on record calling BS- Casey was a big girl and could have at any point walked away from her mom and her dad…leaving them all in the dust…but that would have meant no free ride.

    Blink I await the time when you can speak about things more freely. I know you must have alot to say, and I know how much of yourself is wrapped up in Caylees case.

    I can only imagine how hard it must be to keep everything under your hat, including your feelings.
    Just wanted to let you know I will be here when the time comes for you to be more outspoken.

    PS- You were right again- all of the defenses motions have been denied…waiting on Dr. Vass’s decomp. air test analysis.

    has always been a matter of heresay(?); the Grunds told LE that Lee told Jesse about it. I’ve read rumors that the fight was also reported by “a neighbor” & Mark Fuhrman to LE, but I never saw it in any LE report or deposition.

    I was reminded about it browsing rusty b shackleford’s timeline calander over at the Hinky Meter. On his entry for August 6, 2008 is;

    “Mark Fuhrman advises OCSO that Cindy told him that she and Casey had big fight on 6/15. She had withheld this information form OCSO”

    I thought about you as Kate and William came out on the balcony for the public appearance and kiss. Kate is a beautiful young woman. Just looking at the TV images and the sparkle in Kate’s eyes gives me hope that she will contribute much to the quality of the Royal family.

    Did you catch the fly-over? An old Wellington four-engined bomber from WWII escorted by what appeared to be two spitfires. Brought back a lot of memories for me.

    Blink – apologies for using this site for off topic comments but I would just like to say to ATG – The fly past was my hubbies favourite bit of the day, he is a World War 11 buff. Even met and dined with Bob Morgan of Memphis Belle fame! But guess what, the minute I had watched the happy couple on the balcony, I was logging in to this site to check out any news as I am desperate to hear that JBP allowed Dr Vass evidence in.
