Caylee/Casey Anthony Case: Will Judge Rulings Today Be Defense Doomsday?

Chief Judge Belvin Perry promised to rule on 2 outstanding motions by her defense team today.

Update #1 4:45PM.. Motion to exclude trunk stain… D E N I E D

Rulings on Critical Motions regarding a hair with a "deathband" that could only belong to a deceased individual and either Casey or Caylee Anthony, and the air samples tested by Dr. Arpad Vass and found to contain chloroform levels he has never seen, in his 22 year career.

The air samples themselves are not in contention as the "hardware" and methodology in their extraction are used widely in the scientific community, and the defense team, through a stipulation agreement to withdraw contempt proceedings against him, could not argue about anything else.  The defense argument was largely about the interpretation of the data that was yielded from the samples as they relate to a decompositional event in the trunk of Casey's car.

Both motions were a combination of a Frye/exclusion attempt by the defense that took several days in court to conclude, in which many observers felt were disorganized and poorly argued in contrast to the deft responses by the prosecution.

Yesterday, for the second time, Jose Baez on behalf of Casey Anthony filed a response to the State's motion to let his already withdrawn "experts" Dr. Danzinger and Dr. Weis be permitted to testify as to what Casey told them during their interviews with her.

You may recall, during the State's deposition attempt of Dr. Danzinger,  Judge Perry put the kibosh to it after receiving a call from Jose Baez, and both depositions have since been sealed.  Judge Perry referenced testimony about Post Traumatic Stress Disorder, or PTSD, but legal experts agree that in itself would not be grounds for suspending a deposition and immediately sealing it.

It is this editors opinion that during the deposition,  Dr. Danzinger recounted parts of his interview with Casey Anthony that may have been incriminating to her.

It was abundantly clear that the defense strategy is/was to attempt to have these witnesses speak about parts of their interviews with Casey Anthony as a way to repeat her "defense" without ever taking the stand, subjecting her to cross-examination by the state.

It is also abundantly clear that Jose Baez et al did not understand the Judge's comments about these depositions the first time around.

The only way these "Docs" will be permitted to testify to anything Casey Anthony told them, is if Jose Baez presents an exception argument to the hearsay rule, and since the "declarant" or Casey Anthony, will never take the stand, 'not gonna happen.

Yesterday afternoon, the defense depositions of Tony Lazzarro and Amy Huizenga were filed with the court.

While there was largely previously known information contained in both depositions, there was one noteworthy tidbit in Ms. Huizenga's which the defense glossed over in a hurry.

Reported exclusively by www.blinkoncrime.com,  the Anthony's withheld a major plumbing emergency at their home that sent someone from Hopespring Drive in a panic to locate Caylee.

For the first time, it is confirmed that Casey knew about it, and told Amy it was one of the reasons they could not move in:

    Blink I hope when this case is finished you will follow the Julie Schenecker case in Hillsboro County Florida. That is the mother that shot her two children to death in the head for talking back to her. That case hit me as hard as the Caylee Anthony murder. I hope we learn more about Caylee’s murder at trial. Like you this case has haunted me. My family thinks I am obsessed with it and I guess I am. No child asks to be born and should be loved and protected by their mother. I pray there is no way that Casey will be aquitted or serve less than life in prison. I would be shocked if she got the death penalty as I think that would be a hard decision for a jury considering her age. Perhaps not.

    Unfortunately, I do not think I could add a thing to that case. It is heartbreaking, and I think Mrs. Schenecker had a drug problem she hid fairly well, as well as some obvious psychological issues.

    People need to understand that they need to act on signs of same, ask Rusty Yates.

    I have known Rusty Yates’ family from the time Rusty was four years old. His father loved children. Rusty was the last child in a family with four boys.

    His mother was the family stabilizer. I think Rusty’s dependence on the stability of his mother prevented him from taking the steps to get Andrea the type of care she needed. She was under the care of a physician, but she should have been placed in a full time care facility and not been responsible for the children.

    There have been many cases over the years that have what I call a “deep impact” on my work.

    Few of them have stayed with me like the Yates children. As a Mother, although I had difficult pregnancies, I never suffered from PPD or countless other things some women go through that hamper their abilities for a time, to enjoy such a magical and once in a lifetime experience. I am forever thankful for that and I of course applaud those Mom’s that may not have been so lucky, who have sought treatment, and let the storm pass if you will.

    Make no mistake, I am not a psychiatrist, and my education in such issues has more to do with criminal profiling than the concentration of Mrs. Yates issues, but I mention this case because it is absolutely haunting.

    This was preventable. Rusty sought the help of a Dr. that did not take him seriously, imo. I don’t think he knew the full spectrum of what his wife was experiencing.

    I will NEVER forget the court documents I reviewed, and what it felt like to stop in the middle and just need to sob.

    One of the hardest things to deal with in this work is to understand what we are “supposed to”, to prevent a tragedy like this to happen again. I think Andrea Yates was never properly diagnosed, and yes, as you astutely observe, Rusty did not have the tools he needed to prevent the murder of his babies.

    You will almost never find me agreeing with a mental defense of any kind. This would be one I agree with.

    I had no idea you were so close to that case ATG, and sigh, I understand a bit better where your advocacy comes from, and I thank you.

    TGF, I am sorry to hear of your sorrow and that of your longtime neighbor.

    I did not follow that case, it was beyond my threshold of pain, if that makes sense.

    Some stories just rip your heart out from the beginning and this was one. I am sorry that Andrea did not get the help she so needed, and I am sorry Rusty tried his best but didnt succeed. I am so sorry for the children and the loss of their lives…

    It is clear to me that they were all victims and there was no clear bad guy to blame- I wish it turned out differently for all of them…
    My heart goes out to you and them and your community.

    I think she will plea, I mean what is the defense? Maybe they will go with the accident theory, but there has to be something said in chambers recently, with the Psych Doctors, that changed someting. IMO

    I am also interested to see J.P Chatts’ defense deposition when it is released. As you know, there was a notice filed last week.

    Im regard to the above, many have speculated that he could be Caylee’s father. ( Please don’t request a link, just google it). If you do so you may also find references alluding to statements such as he did not like/could not stand ICA and did not want her in his home his house. ~FYI~ and MOO

    Thanks for your concern about the Yates case. We were not neighbors, but I worked with Rusty’s father on several projects over the years and got to know the family. I can still see the defeat in the faces of the grandparents of the children. Not a pretty sight.

    The only thing that makes something like that tollerable is the fact that I believe that GOD has a special place for children who suffer an early death.

    A point in fact: JP Chatt is not Caylee’s father. Simply reading the articles and postings here will show you that has long (long ago)
    been dispensed with. Yes, he made statements, but you must grasp the totality of the case to understand his words in context.

    Early on in the case, here and on other boards, I made quite a fool and nuisance of myself with my pompous comments. I’ve been forgiven and now try to help where I can, but generally, I let the brighter bulbs illumine my understanding of what it means to bring justice to bear on the case of State of Florida (Plaintiff) vs. Casey Marie Anthony (Defendant).

    Of course, I do get lured in when wordplay is in the works.
    But then it’s back to work!

    What’s your take on Leonard Padilla pushing the ‘fact’ that Casey is certifiably crazy, insane, he says so, he quotes Tracy McL as saying so, and he used the statements of a NG guest last night, to add that what she said fits Casey to a T as insane. The doctor was not given a chance to speak to this, she did not say Casey was crazy or insane for her narcissistic, detached from her baby, partying 31 days behaviour.

    Grace did not allow this psych guest to comment on Padilla’s ‘conclusion’ and let her show spin things this way.

    I think the defense wants the potential jurors to believe something IS wrong with Casey, for their deliberations. Those exact comments were heard on the CBS 48 HRS mock jury/panel when they commented about their decision to acquit– theme, Casey has some mental issues to mitigate.

    Is Padilla helping Baez again?

    Self Promotion first. He wants Tracy’s time with Casey to be marketable, and he wants them on the stand so they can can increase the presstime, period.

    To my knowledge, Tracy, nor Leonard are in any position to diagnose mental conditions of any person.

    Tracy is an admin of Leonard’s turned babysitter for a time, and she was also very deceptive to Casey and Cindy of you listen to her interview. No credibility.

    So happy to see your recent post. I agree with you that we might see an attempt for a plea by the defense. It will be interesting to see how this all unfolds.

    I pray for justice for Caylee and others everyday.

    Eventually it will rest in the hands of 12 jurors. If they find Casey Anthony guilty it will be bittersweet. A precious child has been taken way too soon, but there is a sadness knowing that a mother could allegedly do this to her child. I can’t honestly say that a conviction would be a joyful event for me, but there must be accountability.

    It appears (IMO) the prosecution has a strong case, but for now we will wait.

    So happy you decided to join in as your opinion/theories matter.

    My prayer is that God will bring darkness to light and let the truth be revealed so Caylee receives the justice she so deserves.

    All just my humble opinion.

    Kleat and Blink- I did not see LP on Nancy Grace, but I did hear Tracys tape- I dont know how credible she is…or isnt. But if I were LP I would refrain from calling Casey crazy because Tracy sounded so much like her in her interviews that I can understand why Casey would have befriended her…all that giggling and inappropriate emotional responses IMO. and didnt Tracy want her son to come down and hang out with Casey and family inside the home? -Thats crazy LOL

    I can’t help but think of the state of panic the defense must be in.

    This is not a David and Golliath type of ending. It’s the freaking titanic and why people jump aboard this ill fated journey is beyond me. Better yet, the fact that it hasn’t sunk yet, is a great mystery. Two words: 8 days. Ah heck…two more….no dingies!

    I bet Casey still thinks she’s walking out of this. I’m not entirely certain they’ve ever explained to Casey the grave truth about what is likely going to happen to her. I think Casey see’s this as a most inconvenient bump in the road to La Bella Vita (I swear, I NEVER wanna hear those words again). Who’s choice was it to not plea….Casey’s or the defense? If it was Casey’s, then we know she doesn’t deal with reality if it doesn’t suit her purpose. If it was the defense’s decision, same answer. It’s just like scripture….Judas betraying Jesus. He denied knowing him 3 times. It was God’s will that Judas lie. It was part of the written word. Perhaps, this case is not much different. It was devine will that Casey, in all her arrogant glory, take this lie and betrayl to the max! She is incapable of the truth, even in the presence of great authority. Just like Judas.

    Watching todays Hearing- The Judge is a very wise man-

    (all paraphrased)

    Media motion is denied – Judge says it is now a matter for the appeals-

    Talks extensively about the defendants right to a fair trial being in jeopardy.

    Says he would not be surprised if defense files a motion to postpone trial for a “cooling off” period- talks about memories not getting better with time…talks about the possibility of key witnesses dieing and their testimony being lost forever.

    All this over the media rights to know -prior to the day of, IRT area for jury selection. Judge very upset over having to take time out of very important matters to deal with other issues…It is a balancing act defendants rights over 6th amendments rights ect. Compares this trial to other cases and media coverage…compares it to the OJ trial. – talks about 24 hr news availability – in this new age…talks about tv, newspapers, radio and internet blogs

    Casey looked scared and weary she was crying…Cindy was shaking in agreement with the judge.

    Talks about having to make his decision on the death smell and Vass’s motion, holds up stack of papers, drops it loudly…he and his staff read through ot all…IRT this media motion most of it defining “media” says he has to read and understand and decide very complicated matters- shakes head…

    The Judge is very animated and concerned.

    I sure hope the trial is not postponed- The Judge is correct- Casey is innocent until proven guilty- 3 media outlets have signed confidentiality agreements- isnt that enough to ensure the publics right to know?

    2nd part of Hearing after they (The Judge both sides including Casey Anthony)return from Judges chambers was sealed. Judge Perry asked Cindy if her lawyer was present she said no- Judge Perry said he may want to get with him sooner rather than later…
    Casey returned to the court room in better spirits. JMO

    I had the TV on and no sound. When I walked by it I noticed a very red nose on Casey and she appeared to be wiping away tears. Anyone know or guess why the crying? I am going to guess that she finally is realizing that her day of justic is just around the corner.

    I think the judge is very wise in denying the media motion regarding the location of the jury selection. The media will have to do some work to find it. I can imagine the jury pool will be as large as they can legally get at the time of selection.

    My take on Casey crying was this: the HHJP thinks I’m important! He cares! Me me me me! She does not understand that the judge cares for her rights the same as he would any other defendant. All she hears is I’m special! He understands me! Yeah Casey, dream on.

    Casey cries because she is just a few short moves from being put in “check”- as in a chess game. That was real…real tension, stress, feeling sorry for herself. Her defense has had very little success with their motions and her giddy days as the smirking defendant are coming to an end- 6 days now. Maybe it was triggered by the pats on the back, or knowing that Baez is counting the days until he can move on to something else right now. A combination of a lot of things… but probably IMO, excluding any thought of her dead little girl. Caylee doesn’t care… she is happy in another place, if you believe the soul is immortal and innocents reside with God. She, being in a place of perfect happiness does not even remember or consider the things she knew on earth with any of the sense of pain or revenge that accompanies our existence on earth. Certain other people, well, they are in a hellish place- and I remind myself to be careful what I say when I comment about things such as these. I look at them and see walking, talking dead people. Death resides in the spirit- not the body.

    ATG – I watched the hearing and noticed that Casey didn’t have her usual legal pad and pen to ‘doodle’ with and for once she was virtually made to listen to what, for me, was a very serious Judge. I believe it eventually hit home that once the Trial started there was no turning back, JBP making it clear that he was doing everything in his power and to the letter of the law to see that the defendant had a fair trial. Closing every avenue for cause for appeal. Baez hardly gave her a glance whilst Mason stroked and patted her back as you would a distressed baby. Here in the UK I am used to seeing very formal bewigged Judges sat on high above their Court. Very intimidating. The US system is perceived by many in the UK as being very informal, My Cousin Vinny-ish, that the Judge is more friendly somehow, approachable, but the JBP I saw yesterday was all about business, all about THE LAW, all about doing things properly, legally, above reproach. I was impressed and if I had been in Casey’s shoes, I would have been scared witless. I believe it was the first time Casey has been truly scared, no smiling Baez to reassure her, to whisper in her ear, just bumbling old Mason to pat her back to prevent her hyperventalating. Of course I may have it all wrong, perhaps she felt he was actually on her side and that he was chastising the evil media for their unprecedented interest, commenting that it was bigger even than the OJ case and that the defendant was deserving of a fair trial and that he would see she got one. At the end of the day, the evidence will speak for itself. After yesterday I would not be surprised to hear that she was seeking a Plea. JMO

    Dave S. – I have read many of Dr Glass’s articles, she is very observant and astute but I am sticking with my own thoughts on this one. I have watched hours of Casey Anthony in Court and whilst I believe she is a pretty good actress, I personally believe she was frightened by yesterday’s Hearing. JMO

    Is it just me, but didn’t the attorney for the media appear, to say the least, a bit unprepared to be heard by Judge Perry? She didn’t even appear to understand Judge Perry’s confidentiality agreement, as the agreement states that if the media outlet can find an outside source that will tell them where the jury will be selected, that is different than the information coming from the court’s office.

    As far as Casey’s tears….I’m not convinced that her tears were in regards to the court proceedings of the day; maybe she had had a disagreement with Baez or someone else before coming into court, which made her be able to turn on the tears. When I think of her in jail in solitary basically for these past few years, it must be incredibly frustrating to her not to be able to have people surrounding her that she can lie to and convince how wonderful she is and what a great person she is, nor can she go out and party and have men chasing after her (or for her to chase guys). I believe that Casey believes she is going to be set free at trial because I think she thinks she is “that good” to lie her way out of anything, including Caylee’s death. She has no empathy whatsoever for her murdered daughter nor her parents, brothers or the friends she stole from and lied to – the only person she cares about is Casey and she believes that Casey is so much more intelligent and convincing than anyone who will testify against her in court. Just my opinion.

    Chelsea I too think those were real tears from Casey. She is so starved for attention and support. The only true tears coming from Casey will be when it is about feeling sorry for Casey. IMO

    When the attorney for the “media organizations” mentioned one of the clients being Fox, a red flag waved in my face. My mistrust of the Defense team has me looking for conspiracy in every move. The thought that the defense and possibly an infamous vault opener were behind this motion became a viable option for this circus like ploy.

    In all seriousness, I do think Baez set this up, hoping for that ‘six months’. Like he cares about spending the tax payers money. We all know his britches are biting at his @$$ to delay this trial. 6 months is enough time to slander, lie, falsify, fabricate, taint, and tantrum. Another classic Baez stall tactic.

    I think kc was sweatin’ it out yesterday. Her blouse showed it. I think the tears were probably real because she tries so hard not to cry. I thought JP laid it out pretty well and KC knows it’s coming down to a close.

    If the Media appeals JP’s ruling won’t they have hearings next instead of jury selection, therefore delaying the trial. When will we know if they appeal.

    If I remember correctly, JP said that if the trial is delayed, he would issue a gag order on everyone, and that no documents (evidence) would be released so interest in this case would cool down. In my opinion Baez and company would never want a gag order because they wouldn’t be able to make their TV appearances and taint the jury pool. They’d actually have to do some work.

    IMO, following the pattern of the defense team’s MO, Friday around five o’clock a motion for an appeal will be filed. Hopefully, the ones who filed the original motion will realize the damage an appeal would cause. Indeed, if my suspicions are true and the defense or defense friendly entities are behind all of this then an appeal will be filed. IMO

    So very sad, all this gamesmanship, exorbitant costs to the tax payers has nothing or little to do with justice for a baby girl. IMO
