Caylee/Casey Anthony Trial: Sidebar Silliness- Baez Concerned Casey Will Be Viewed As a Lesbian And Other Wishful Thinking

Orlando, FL-  I know, everyone was looking for my analysis for the week on some of the most influential forensics evidence and experts to date.  You will have to wait.  I could simply not let this go.  Jose Baez, defense counsel for accused Filicidial frequent fornicator Casey Anthony is concerned his client might be viewed as a lesbian by the jury based on some photos in evidence.

I can’t take it.  I thought I could, I thought I could keep it objective.  I admit it, he is a Barristerific  Baffoon Extroirdinaire.

This defendant, this woman, with multiple simultaneous male sexual partners, an unknown baby daddy, the prosecution bases it’s case on the fact that she has a new boyfriend she is willing to kill her child over, and this is HIS REACTION?

“I would just lay out for our argument that any photos that would implicate or insinuate in any way that my client is a lesbian through the dancing she is doing with this other woman…”

It is maddening what an oaf this guy is with respect to being charged with saving a defendant’s life.  Having a jury perceive Casey as a lesbian is like Christmas in June for his client.  Not a lot of cases of lesbian-motivated filicide out there, and what is, is likely to be a new suspect for this suspect generating camp.

At that point Perry cuts him off and asks, “Have you been to nightclubs in the last three or four years?”
Baez says he has been, but noted that the average age of the jurors is 50 and that some members “would be extremely offended” by the image.

    A transcript from the Casey Anthony trial shows defense attorney Jose Baez at a sidebar conference expressing concerns that photos prosecutors wanted to introduce as evidence would make his client appear to be “a lesbian” in jurors’ eyes.

    The sidebar is included in a printed transcript of Roy “Clint” House’s testimony early on in the trial. The transcript was placed this week in Casey Anthony’s case file with the Clerk of Courts office. It provides a rare view of one of the many sidebars consuming much of the time at a trial expected to run several more weeks. The House testimony occurred on May 25, and the sidebar involves an argument between the prosecution and defense over allowing in certain photos of Anthony dancing at Club Fusion.

    “It is not our intent to beat the jury over the head with these pictures or make a big deal about them,” Assistant State Attorney Frank George told Orange-Osceola Chief Judge Belvin Perry during the sidebar.

    Perry tells George, “I thought you wanted to show that she was not distraught. You can have three of them, but to introduce all of these, particularly the one that does not show her is overkill. So pick your best three…”

    But Baez objected and said, “As far as the pictures of her dancing, there are certain members of the jury that may find this offensive, (two) women dancing very, very close up against one another. I think that that is more prejudicial than it is probative.”

    Perry again noted there is an issue with allowing too many photos in. He said, “You all sometimes get reckless and you all don’t mind retrying cases. I do. I care about convictions. I don’t care to do them twice.”

    Thanks for the Dr Haskall preview and Vass review. Ah, Dr Vass, so smart yet so himble. Did you see him gesture in thanks to the blond lady court deputy as he left the stand yesterday (after the evidence mistake examination)? His warmth to those around him is visible in his gestures, even moments after exposure of a rather humiliating mistake.

    She sits there hour after hour, sometimes with a large binder notebook, the dimensions that of a little kid with an encyclopedia. She turns the pages on occasion, taking notes now and then, looking up to watch testimony about the stench given off by her toddler's decaying body with the same emotion she might give to a discussion about the weather.

    She is a Bratz doll in the hot-body party pictures with her friends, a chilling and lying sociopath in the jailhouse videos with her parents, and a blank stare in the courtroom.

    She is hot and she is cold.

    And that is the quickest summation of why we are here.

    During tense exchanges, the jurors' heads turn back and forth from attorney to witness, like watching a tennis match.

    Most take notes. They scribble at what seem to be the worst times for Casey. I never see any of them look at her.

    I wonder whether what they are hearing sounds as bad to them as what I am hearing. To get an indication, I ask a dozen people in trial with me that day whether they thought Casey was innocent. There wasn't one.

    "Honest, before the trial, I didn't think she did it," says Maria Hodges, who arrived before dawn to secure one of the general-public seats. "But being here changes my perspective. I could see the coldness in her face. Her eyes looked really dark. You don't see that on television."

    I never really paid attention to the entomology of the case, so it was fascinating to hear what you had to say, including the “trio of decomposition” experts. Looking forward now to Dr. Haskell’s testimony.

    The topic of JB’s ethical obligations – - – what did he know, when did he know it – - – definitely interesting.

    Funny . . . but I don’t at all remember Dr. Vass’s words of “excited neurons. That was cute to hear, Blink. :)

    I may have a correction on the atomic charge or element on this one, I do recall Boss Vass saying the L.I.B.S. turning the “specimen” to a plasma or excited state, as opposed to it’s previous grounded.

    I don’t want to get it wrong, lest the labcoat is reading, lol.

    Don’t our coastal states of the USA tend to be more socially liberal in what they see going on around them? Not that people approve, but they do understand it for what it is. (Please, no offense meant to midwestmom or others from the center of the country.)
    Reality cancels out wishful thinking, I’m sure.

    My goodness, my eyes were opened (from the liberal west coast) when I visited Miami and the Florida Keys. (I love the tiny little hot pants skirt I bought there!) No one seemed to bat an eye at the clothing and pda among all sorts of genders. It was more extreme than we see at home.

    The Jurors understand this: we choose our friends, our lifestyle, our values, true. Yet, nothing we say or do can ever excuse taking the life of another human being, especially not one of a small, innocent child.

    had the knowledge.

    Sadly, this guy is going for the TV movie,
    the interviews on Nancy G. Entertainment Show, Greta, etc. Even his own show after he is disbarred. Boy, Casey picked the wrong guy.

    Inept does not even come close to describing this suit. Baez is painful to watch. How many defense attorneys are cautioned AND schooled in the law by an amazing judge with the brain the size of Pluto?
    Hopefully Perry will preside over Baez’s trial.

    In your reply to WPG about the L.I.B.S. test it was my understanding that the laser heated the molecules and made the individual atom’s electrons move away from the nuecleus which would reduce the ground charge affecting them.

    I’ll be watching for your answer.

    I will be asking someone qualified and get back to you, lol.

    I think it actually becomes plasma once “excited” and is “atomized”, so technically you would be correct.

    PS- The lesbian thing – its just another WTF moment in a long line. Honestly I do not understand the timing or the reasoning behind much of his doings- the things he seems to latch on to as important to dispute or challenge are mind boggling to me-especially since he seems to let other facts and info slip right on by him.

    lol, it is due to be up early afternoon. Gerus locating the drowning victim, who was still submerged means he was trained to detect decomposition in water. As we know, neither Gerus or Bones hit by the pool, or the pool filter. Sgt Forgey also went on to say that when training , he uses the “synthetic” scent aid for decomposition in water practice, because a “real” training aid would and will contaminate the water.

    Now, can the chemicals used in the Anthony pool, which were NOT chlorine, eradicate any trace of decomp fluids? That would be a valid question. If she was in the yard and both Gerus and Bones gave final alerts within 6-8 ft of each other, I have to assume she was at a stage of decomposition enough to contaminate the pool, had she drowned in it, which I do not believe.

    The lesbian thing, not that there is anything wrong with that, lol, what can I say, wtf covers it aptly.

    Who cares that Casey might appear to be a lesbian – is that really such a social taboo anymore? Baez has singlehandedly got to be the worst attorney I’ve seen in a LONG, LONG time. Every time he stands up and goes to the podium to cross-examine a witness, I cringe, because he simply is clueless when it comes to asking an intelligent, well put-together sentence.

    I still worry about Juror #4, the “I can’t judge anyone” juror. A program tonight said that when the prosecution was doing their opening statement and they showed the picture of Caylee’s skull, Juror #4 just rolled her eyes. I just do NOT want a hung jury and in my humble opinion, she is going to be a thorn in the side of the jury.

    I got to listen for the first time last night. I’m a big follower (lurker!) of your site (and SM, even though I can’t get approved), so it’s nice to put faces…er, voices…to the names!

    I can’t wait for this trial to be over – to bring justice for Caylee. I truly can’t even remember what I must have done with my life before becoming ‘obsessed’ with the trial, watching and reading about it.

    Sometimes I look at my 3-year-old and get a lump in my throat – I just cannot believe I’m so fortunate to be her mother. The love is something bigger than I could even describe. I can’t fathom how a mother could hurt her own baby. Blame it on sickness, blame it on personality problems, blame it on whatever you want, but really…it’s just evil, pure and simple. :-(

    I don’t want to give Baez any points for this nonsense but could he possibly be slimy enough to feign this obsurb notion of lesbian offensiveness to plant it in the jury’s mind that Casey may be a lesbian or at least bisexual in order to diffuse the prosecutions’ motive that Casey wanted so desperately to build a life with Tony (or Riccardo who I believe she really wanted) that she would kill Caylee for it.

    George said that he never saw that Big Trouble shirt and so did Cindy. Kind of strange that she would have had to have that shirt and shorts on the night of June 15th, because she drowned in the pool on the 16th of June. Wouldn’t George and Cindy have seen what she was wearing the night of the 15th of June?? I think that George would have remembered that shirt and shorts especially if she drowned in them!!!

    I know nothing on this subject, but if Baez continues through the whole trial being as stupid as he is now, could that be a basis of appeal on Casey’s behalf claiming inadequate representation? I certainly hope not – he was not appointed to her, she chose him I do believe.

    I think the state has a slam dunk. I really can’t see how any juror, even juror #4, can be presented all of this evidence, and look into her stone cold eyes, and not see she is as guilty and heartless as they come.

    ragdoll … I am with you completely. She is all fudging and faking while the jury is in the room, but the second they are out, she is laughing, smiling and whooping it up with her attorneys. How I wish there were TV’s out in the lobby the jury could see!

    Speaking of this … juror #4 scares me. The one that allegedly said she couldn’t judge and who some in the courtroom are saying appears hostile to the prosecution and only takes notes when the defense speaks. Does anyone else believe she will throw the entire trial by remaining sympathetic to Casey and refusing to judge her accordingly?

    How can anyone have sympathy is right! Especially after hearing some of this testimony and seeing those heartbreaking photos of Caylee thrown away like trash and her remains scattered all over the woods by animals? The duct tape would absolutely have cemented it for me if I knew nothing beforehand. How can anyone ignore that???

    Rosalie Bolin must still be “directing” Casey from behind the scenes. Today she wore her “virginal” white for this segment of the trial (showing her murdered daughter at her dumping site.) Then the defense so cleverly blocked the screen so Casey could not see what was being shown and removed the HUGE binder that has been in front of her to make her look small (in addition to lowering her seat) and block her from jurors view throughout most of the trial. She did manage to do her “close-up acting cry” on cue also. This trial tends to make one very synical.

    I would sure like to know what is up with Lee. I can not decide whose side he is on or if he is just scared to death up on the stand and afraid to quote anything he has said in the past.

    It is amazing the Casey threw her daughter out like trash and kept the trash in the trunk.

She is really scaring me from what I am reading/hearing about her from HLN and some other bloggers in the courtroom commenting (the one that supposedly couldn’t judge and prosecution wanted to have removed).

    Is it really possible this one juror is the defense’s ace in the hole? Please, please say that ain’t so!

    It is impossible to read a juror or jury, imo.

    So how will ICA’s latest antics affect the defense’s allegations? After all, I thought we were supposed to believe that she “zoned out” or “showed no emotional response” in the face of all sorts of situations due to the horrendous sexual abuse by her father.

    On the bright side, the jurors probably needed the early break after what they saw in the courtroom today…and we don’t want them becoming desensitized, if that’s even a possibility at this point, to the visual evidence.

    I do not believe little Caylee drowned in the pool either- certainly not by accident.

    I have been thinking alot about a drowning victim…IME the rescuer especially a mommy or granddad- besides calling 911 would attempt cpr- and if IRC in a child as young as Caylee this action would cause her little rib cage to be fractured or broken- there were no signs of this…just another pondering moment brought to you by M3

    Could it be that Casey Anthony either hid or attempted to hide Caylee in the backyard or she brought Caylee to the back yard to either bag her or rebag her?

    I am open to all theories proven by the evidence being presented. I am certainly NOT going to take Casey’s word for what happened -not even when being voiced thru her attorney’s OS.

    Ok, I know this is considered unverified etc. But watching HLN, there were several callers responding to the question of ‘how do you think Caylee’s remains got to the woods.’ Let’s say out of 5- 4 felt Roy Kronk was involved and the other felt the whole Anthony clan was involved. I am stunned. Primarily, that people can believe or surmise such different info. Not to mention nothing re RK has been mentioned in the negative other than Baez opening- not evidence.
    I know, I need to shut the TV, I rarely watch this channel normally, but I can’t help myself.
    I need to pray harder.
