Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS
Portland, OR- As many of you have been following since June 2010, there is a new development today in the disappearance of Kyron Horman.
As predicted at BOC, the civil suit brought by Deisree Young, Kyron’s Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.
In a sealed filing, motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted, delaying the suit . The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.
The decision presents an ironic twist .
Terri Horman’s lawyers originally fought vehemently to abate the action, but were unsuccessful. As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.
In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman, the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.
It is not known if that order prompted the request to delay the suit .
Sheriff Stanton, Eldin Rosenthal, Norm Frink and Stephen Houze declined comment at press time.
On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.
A hearing had been scheduled for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher, an alleged witness in the case. Today’s ruling is likely to render a postponement of that proceeding.
Sheriff Dan Staton, told Oregon Live, it is based on early leads that are now panning out:
“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”
He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

Looking back at Terri’s FB photos and her own comments on those snaps around April 6, 2010, (there aren’t any posted that are dated that particular day, that she allegedly wrote the email above). April 4, 2010 is when she posted all the Easter pictures (which was Easter Sunday), sharing some of Kyron’s with Desiree btw, April 7, she posted the photo of Kyron and Kiara, happy as little clams, on the big floor pillow that was on Blink’s site for so long.
On April 9, a couple of pictures of the baby. April 13 (Tues) looks like James & Gramma Moulton came up and they all took a shopping trip with Terri & Kiara. No Kyron, so guessing he went down south, while James came up north. (No Kaine either, though, so he & Ky could have had their own outing somewhere.) So probably taken on the 10th or 11th Sat, Sun.
There is nothing indicating any displeasure on her part that I can see at all. Kaine coloring eggs with the kids, while Terri is snapping photos, nice clear, sharp photos, well centered photos, nothing blurry btw, like an intoxicated person might take. (Or like I end up taking sober, LOL)
I suppose it’s possible that TMH has some sort of Jeckyl & Hyde personality disorder, because there is no clue as to any problemas during this period in her FB photos or her comments, nor any comments from anyone else to her. IDK, pictures really are worth a 1000 words sometimes and all I see is happy kids, and what appears to be an equally happy husband.
Approaching another Easter Sunday soon, these just make me sooo sad.

FWIW, I haven’t forgotten Kaine’s “our landscaper” comment. Which, I personally think was a slip-up on his part, and I was amazed his attorney let that fly. However, like MbS says, it really doesn’t mean he knew they had a landscaper at the time the landscaper was hired and did the work. It could be just another example of the way the man talks. Our, we, us…..and so on. He seldom uses the word I or mine. (Which drives me nuts btw.)
But, jmo, like I said upthread, I find it almost impossible that he did not know, unless his other statements are lies. (i.e., always home, knowing where all the money is going, etc.)
Makes one wonder approximately how many people are running around with ankle bracelets on. This article may make a few more of them try to take them off since it explains how this guy took his off at home and was able to leave and commit this horrible crime.

Just now, 3 pm central, there’s a program on HLN about a murdered woman.
She had an affair with her home yardman/landscaper who called
her Dr husband to extort $100,000 or he’d tell husband’s workplace. Husband blew him off.
She was killed. Maybe extortion was why RS visited the Horman home Sunday
mothers day when Kaine was present. Tho Kaine would want to protect his reputation at Intel, I can’t see he’d pay

@wpg. lay understanding here. Civil cases are tried in both Federal & State Court depending on the statute & cause of action. The DA is the criminal arm
of the State. imo he can intervene in a civil case according to the OR rules of civil procedure statute.
That means his case has to have some association to the heart of the civil cause of action (for
details I linked that statute, I think 33C was the right part), There is no way he’s gonna find that link in a
divorce, much less in a criminal case he hasn’t charged.
The DA seems to feel strongly that Kaine not be deposed. The civil suit was put on hold and now DA and sheriff are asking the divorce be put on hold, both in time to prevent Kaine from being deposed. Rees specifically said in the hearing that Kaine should not be deposed because he has information that could compromise the investigation. I have always assumed that this information was stuff Kaine was told by law enforcement but now I wonder if Kaine knows something about Law Enforcement itself that they don’t want revealed. Portland has quite a stinky history of corruption in law enforcement. Just a thought.
I still sit in wonderment of this whole kerfuffle. I ask myself constantly if I believe my view would be the same if I were convinced of TMH guilt of at least something.
Yes, yes indeed I would still be adamant that the State has no basis for standing in either case to date.
If they engaged Kaine Horman as an agent of the state, and they end up being completely wrong, good luck with that LE immunity garble.
At a minimum I can see Kantor ordering hearing exparte in camera what Kaine knows if he were not the judge in both actions.

It appears to me that DA does not want this case resolved. They probably would like to find Kyron, but the case has become so much more. LE apparently divulged confidential investigative info to one party in a divorce case, to use against the other, seemingly to pressure a confession from her in a criminal case. DA and sheriff then submit opinions in the divorce case to back up the husband whom they have all but declared innocent. A mother is not allowed to see her young daughter for years due to an RO obtained on hearsay without any court ordered supervised parenting time because husband objects. We haven’t received an update on what has been spent to date but a few months in it was well over one million dollars so must be much more now, and it appears to have been spent primarily on making a case against Terri, based on the statements being made by DA begging for just a little more time. If Terri isn’t their focus, why delay the divorce. I don’t understand how all this is legal. Surely LE is supposed to take an objective view. This has been a case of assisting one side and against another, people at the school told not to speak, not so much as a statement from Kyron’s teacher or anybody else on how this boy disappeared from the school’s hallway without anybody even noticing ALL DAY. Is this due to union protection?
Is this the way modern law is practiced? It sounds like an old west town run by thugs who do what they want and bully residents. LE and DA appear to act without accountability. No one can question them or object. “integrity of the investigation” is the new “national security”. Is there anybody with the authority to wade in and cut through the fog?

whatever it is, I don’t think it has anything to do with Kyron missing, since BLink seems to think it was a SZ who took Kyron. Everything else would be incidental, but Kaine still doesn’t want to lose his job.
Does anyone here think there is the slightest chance of KH having second thoughts about kicking Terri out, and might consider asking her back? Or has he gone on his own merry way, looking for a new and improved, and thinner, ‘new mom’ for Kiara?
Trying to not take sides here (it isn’t working very well), but it seems everyone knows A Whole Lot More about TMH than they do about KH.

thinking Kaine directing the 18 searchers away fromSkyline & over to Banks, and that they took him seriously & would cooperate, must be something more significant than the speculated Terri had taken James & Kyron riding there before. After all, Terri wasn’t a “suspect” on Day 2, and it’s a bit much to think Kyron could independently find his way there.
So googling Banks last nite, what I saw, repetitively, in every home ad for example, the script touted its proximity to the Intel campus. 20 min away. all property ads marketed to Intel employees. So my speculation is on Sat Day 1 (when they’d make the Day 2 search decision) Kaine was concerned an Intel employee with an adequate motive living at a specific Banks location was behind the abduction. What else would be strong enough to move the search from Skyline that Sunday? Not the fact James & Kyron once went riding because they had many activities all over the area. An adequate grudge could be a former supervisee or a former entanglement of another kind.

Good points, Rose. But unless KH is talking, nobody will know. Even if he/KH was suspicious of someone, he could always hire a really good PI who should be able to track Kyron, especially if he/KH pulled the wool over the eyes of LE.
But would someone have such a huge grudge that they would hurt Kyron? …or would they know someone they could ‘give’ him to?
And if KH was worried, why didn’t he let the guy with the cadaver dogs do more (if he’s reliable), even in Banks. How can a parent NOT turn over every single stone when their child is missing? I don’t get it.

Funny thing – the horse farm. I know there’s probably no connection, but it recalls the arrests in Washington State and the horse farm porn that was discussed here a while back.
IOW, James was old enough that he could have heard “stuff” or seen “stuff” and maybe TMH got wind of it, maybe KH got angry (or both) and that might be why TMH “rescued” her son and sent him out of the area. Too bad she didn’t ‘rescue’ Kyron at the same time, but she probably would have never gotten him away from his dad. All MOO. MOO….

Why would LE unquestioningly take his word anyway? I always thought LE looked at the family with suspicion first when a child is missing — wonder why they would give KH more credence than TMH? Wonder if DY’s hubby would have any opinions about that. Wonder what HE thought about KH?
I personally think the whole MFH story is a big red herring, also the KH/TMH relationship-cesspool – another big red herring. If a SZ took Kyron, it could have been totally random (which I doubt, because there are a lot of other schools in the area with sci fairs or unguarded moments where a child could be grabbed) or as suggested – maybe someone had a grudge against KH, or a relationship soured (with the ‘hell hath no fury like a scorned’…term coming to mind..)
Well, IDK anything and there’s a lot of speculating. The only fact is that a little boy is missing and he needs to come home. Still hoping, I am, that he is alive. We are all here because we aren’t giving up hope – either for Kyron’s return, or for Justice.

I wish someone would have asked what that was all about, but in hindsight I think it was Kaine hoping against hope that Terri had hidden Kyron somewhere. Desiree says Terri was “very angry” that morning. How would she know that unless at least one of those several emails Terri sent her came across that way? I think at this point in time, both Desiree & Kaine thought and maybe still do think, that Terri hid Kyron to get back at them for their lack of performance in their parental duties regarding Kyron, whether they were or not. So, Kaine thought maybe one of those places Terri might have taken Kyron was that place. This is the only thing that makes any sense to me. (now anyway)

KS: It’s unclear exactly who, if anyone, saw Kyron after that point, or where. But Ms Porter started class at 10 a.m., time for the kids to return to their home room and take their seats. It’s at this point that Carson Lopez remembers noticing that something wasn’t right.
CL: I went to sit in my seat, and looked back. He wasn’t there. And then a couple more minutes, I looked back, and then after lunch….and I kept on looking back to see if he came back, but he never came back.

Want to double-check something. The kids had their projects set up on each other’s individual desks, correct? If so, when CL comes back and sits at his desk at 10:00 a.m., if all the projects are still up on the desks, how can he see Kyron? Was it someone’s responsibility to remove all the
projects and store them somewhere else? Did each child take down their own project? I’m just curious as to if that task was assigned to someone other thant he children. CL’s account makes it sound as though the projects were already down when he returned to his classroom. ??
if the kids were supposed to take down their own projects, then if Kyron disappeared before that was done, his would still be sitting there, marking a time when he was already gone. If the project was gone then he was there through that specific time. I can’t imagine who else would take down all those projects. also the coat and lunch being left behind is worrisome. he expected to be there all day. It was raining on and off that day and not that warm. You would leave without a jacket.
I remember back in the very early days, reports that the horse pasture and Sauvies Island were being searched because they were favorite places of Kyron’s, and I thought: what kidnapper asks the victim what his favorite places are and takes him there?!
One day back in that first year I decided to make the run from Skyline School to Sauvies Island myself. I was dubious it could be done in the time available in the timeline. (don’t remember the actual numbers now). I started at the school, drove down Newberry Rd (I think that’s its name, the one Terri was thought to use). It comes down the hill with many curves, not suitable for speeding, then onto HY 30 and a fairly short distance to bridge onto SI. The bridge, for those of you not local, is the only way onto the island, is very much in the open and descent curves down to a store before giving a choice of I think 2 roads. This area is completely open. If a person wanted to go unnoticed, it was a poor place to do it. I chose one, drove down to where it was at least somewhat secluded, not very far into the island. Discovered that yes, you can make that drive if you knew your destination exactly and didn’t spend more than 2 minutes at the scene and headed back. My drive was in the afternoon, no rush traffic to deal with on Hy and no unexpected road work or bicyclists to avoid or pedestrians walking dogs. Speculation at that time was that Terri murdered Kyron and dumped his body on SI. It was not a very practical theory. Given that situation, it is unbelievable that so many hours were spent searching there, dragging the river and beating the bushes. Another thing that was odd was that they would not allow volunteers to join the search, either near the school or on the island. The explanation was that if an ordinary person came upon a crime scene it could be quite traumatic. Only the specially trained team were allowed to search. Why would they assume a crime scene within a day of him going missing? I believe volunteers usually conduct these searches for missing children and adults, don’t they? and it’s kids or dogs or hunters who usually come upon human remains in woods and along roads.
Another thing, within a few days Kyron’s picture and description appeared on FBI 10 Most Wanted List. He came in ahead of Osama Bin Laden that week. The others were adult fugitives. at the time I didn’t know how to take screen shots or I would have. A newspaper referred to Kyron being on there with Osama. By the next week he was moved to the “endangered children” list. Why on earth was initially on the Big list?

Having been a member of that same union for many years and having people I knew well in leadership roles, I don’t think I would blame the union. I thought Blink said Mrs. Porter has an attorney – it would be pretty amazing if she didn’t. I know the kind of advice the union gives people. First would be to hire an attorney and see what your professional liability policy will pay for – IF she was a member rather than a “fair share” person who paid same amount as dues but did not claim membership or benefits. They would advise you that you had a right not to talk, but they are not attorneys and would not give you actual legal advice, and of course, could not force you to stay silent if you chose to make a statement. As I recall, Mrs. Porter did make one statement, but (without looking at it) I think it was about how the kids felt about missing Kyron and nothing of a personal nature or specific to events on June 4th.
I have always thought her silence was due to LE, but it also means that if anyone thinks or knows she is wrong about what she testified to, she won’t be challenged (at this time) because we don’t know what she said – neither does TH, Houze, etc.

As far as distinguishing characteristics, the H’s truck did have a red decal and a yellow decal on the outside left of the rear window that stood out quite well against the dark tint of the window.
The red decal was an “L” with a Red Cardinal bird for Lincoln High School.
The yellow one was the outline of a football representing Aloha Youth Football with J’s first name and player# beside it.
The football decal could stand out to a boy in 7th grade.
Just a thought.

To expand on your thought, and SZ aside for a moment, there is ample suggestion that TH was doing a classic abused woman preparing to move scenario. A) She moved her son while KH was out of town. B) She reached out to DY about moving Kyron. (In this context that is pretty huge.) Had she accomplished getting both boys out safely, the only thing left to do was make her way out with Kiara. I am not saying she was abused, and I am not saying a SZ did not inject himself into this scenario. What I am saying is these are signs of a woman planning to leave. Now, it has to be asked what a man might do if he learned of these plans.

This says a horse pasture, but does not say a stable or horse property.
The residential real estate ads are full of horse pasture as a selling point,
but it doesn’t mean sellors have horses.
LE in the link above throws in “custody.” paraphrase: kids disappear from schools in custody disputes but not for this long.
imo that’s a hint with divorced parents a custody controversy had to be ruled out. imo, TY knowing that, that’s some reason for TY & DY to have suggested Terri the first night so LE didn’t waste time on the custody red herring.

You are right about it being relatively easy, but since we were told (accurate or not?) the emails went to an extended family member, and there was more than one email, I think there would have been some replies to them. It seems to me a recipient who knows the sender well would be harder to fool with emails like this, than with the sexting emails. Minus the pictures and adding some disgust, even I could have written the sexting text part. The hateful emails were an unusual topic for her apparently (previous complaints were about Kaine), although she may have verbally or in emails complained to this person before.
Bottom line for me – even without the phone being connected to Kaine, I’m not sure MC’s testimony would be enough to verify the sexting came from TH, at least not without verification from DS. I would be more inclined to believe verification from the recipient of the hateful emails, assuming appropriate questions about the timeline and details were answered.
Unless of course, the recipient of the hateful emails was also the one who created them.

“Oregon Rules of Civil Procedure do not authorize an entity or person who is not a party, to serve or file memoranda and other documents in a civil lawsuit. In fact, the Oregon Rules of Civil Procedure make it evident that, except for a motion to intervene or motions related to discovery impacting a non-party, only a party to a case has standing to serve and file documents with the court.”
So what exactly does “A Motion to Intervene” involve and if the DA wants to step in the middle of this divorce so badly, why didn’t they just file one? Probably a goofy question, but could Kyron himself be considered a non-party who could be impacted?
I wish I knew what was taking Kantor so long in making his decision. It has now been over 6 weeks, when he himself *thought* it could be made in two. Is it possible it’s already been done and everything is proceeding under seal? There seems to be nothing filed since he made his statement February 4:

Almost a week after media organizations reported that fugitive Logan Storm was arrested in Mexico, his attorneys have not been able to get confirmation from the government of his whereabouts.

Media organizations, including The Oregonian, cited unnamed sources in reporting Storm’s arrest last Monday in Mexico. The U.S. Marshals Service, which has been in charge of the manhunt for Storm, initially said it would have additional information on the arrest the following morning. But it has since refused to respond to emails or phone calls and issued a statement last Tuesday saying it would release “significant developments” about Storm’s case “as soon as permissible.”

1. Another thing, within a few days Kyron’s picture and description appeared on FBI 10 Most Wanted List. He came in ahead of Osama Bin Laden that week. The others were adult fugitives. at the time I didn’t know how to take screen shots or I would have. A newspaper referred to Kyron being on there with Osama. By the next week he was moved to the “endangered children” list. Why on earth was initially on the Big list?

I don’t know. I also have seen Kyron featured, when I went to the FBI site Osama had been replaced with Eric Justin Toth as #1 most wanted. At that time it was Toths picture on the left and Kyons picture on the right. It was like that for awhile and then Kyron was moved back to the “endangered child” list. Toth does make me wonder. He is a teacher, computer expert, blends well, prefers young males, etc.

Toth is “well educated, charismatic and likable,” an FBI spokesperson told Huff Post. He’s a computer expert and may have advertised his services as a nanny or tutor. It’s possible he used his deceptive personality to trick parents and get close to children again, the spokesperson said.

interesting that Mrs Porter lawyered up immediately after Kyron went missing while Terri waited to a few days after the sting attempt and being accused of murder for hire and after many interviews with LE, and yet Mrs Porter was never put on the hot seat by media or LE and Terri was total focus of LE and media to this day. Kaine and Desiree have never publicly so much as questioned school’s role in this and Kaine even spoke to parents in the fall, reassuring them that their children were safe at Skyline. Seems inconsistent to me.

Toth was a trip. Moms at B were either eagle mom lawyers at home who were parenting A++, or the kid has multiple nannies & both parents 100 hr week workers & often out of town. Toth no doubt selected the latter. Lots of vulnerable kids there too, esp vilnerable boys. . Like Kyron with no LD dx, nut if a kid couldn’t teach themself the 3-Rs, a substantial group, mostly boys, were referred out by early grade 3. Of my my dau’s nursery grade peers at B, about 1/3 stuck to 4th. (Disclosure: she was waitlisted; went to another of the Big 3, and it was the same story there–teach yrself) Her Big 3 had another SO teacher revealed last year.

So do we all think TH wrote *hateful* emails? I go back and forth on that. There does seem to be a component of electronic manipulation in this case. MBS makes a good point about reciprocity, however, no one has stood up and made that claim. After almost 3 years I just wish someone would break ranks and speak up.
I have no doubt DY read them, and determined them to be hateful. So either TH wrote them, or someone else did.
