Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS
Portland, OR- As many of you have been following since June 2010, there is a new development today in the disappearance of Kyron Horman.
As predicted at BOC, the civil suit brought by Deisree Young, Kyron’s Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.
In a sealed filing, motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted, delaying the suit . The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.
The decision presents an ironic twist .
Terri Horman’s lawyers originally fought vehemently to abate the action, but were unsuccessful. As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.
In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman, the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.
It is not known if that order prompted the request to delay the suit .
Sheriff Stanton, Eldin Rosenthal, Norm Frink and Stephen Houze declined comment at press time.
On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.
A hearing had been scheduled for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher, an alleged witness in the case. Today’s ruling is likely to render a postponement of that proceeding.
Sheriff Dan Staton, told Oregon Live, it is based on early leads that are now panning out:
“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”
He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

Found it, that information came from Kaine Horman in his Intel letter:
“We did not know he was not at school until we went to get him off of the bus at 3:30 and he was nowhere to be found. The bus driver immediately called the school which responded that his teacher had not seen him all day in class, at which point we notified police in partnership with the school.”
He also says that Kyron was dropped off at the school at 8:45. Why would he say that two days later? Everyone, lots of people had already said they saw Kyron earlier at the sci-fair, why in the heck would Kaine Horman be saying this on June 6 in his memo?
I still don’t know what “in partnership with the school” means.
It was a memo not a statement so I am sure it was written with that in mind.

What if this initially really was a kidnapping, with a ransom note. It would explain a lot of things. And what if, somehow the ransom was even attempted to be paid, but something worse happened to a little boy in the mean time, as in he tried to escape his captors and was inadvertently killed, so the captors never showed. Perhaps they were to show on Jim Kelly’s road.
All parents would have been asked, who…..just who…do you think might have sent this ransom note. Terri pointed at the landscaper for some riff they had. Which…..when confronted, said landscaper, whether he was kidnapper or not, had something to hide, and said well “oh yeah, did she tell you about asking me to off her hubby”……? This could have sent LE down the TMH path, when perhaps the kidnapper had nothing to do with Terri at all, but someone else. Perhaps someone that Tony Young pizzed off in his duties, or perhaps someone who Kaine had been involved with, business or otherwise, or even someone who had some axe to grind against Desiree.
This would explain just about everything in this case.
The parents not speaking for a week.
LE saying this is an isolated case.
The weird/conflicting information (stories being told) in case Kyron is alive.
Hush hush from LE for the same reason.
The threesome ganging up against Terri, because they insist this kidnapping has to do with her. (after the MFH information shows up).
The absolute stance that there IS someone else involved in Ky’s disappearance.
Media also being more than quiet. (Could even explain why Pitkin lost his job, if in fact he was told by LE not to divulge certain things and he did. Heck, if he was informed afterwards that he just may have compromised a little boy’s life, he may have quit, deciding to use his investigative instincts in a different,less public way.)
So I’m sitting here asking myself, why wouldn’t this make sense and trying to shoot holes in my theory.
If there was a kidnapping and ransom note, and it wasn’t because of anything to do with Terri…..then who? My first guess (especially in light of what’s been going on lately in *payback* hits on LE) is someone who had a grudge against Tony Young. Second, would be a scorned lover of Kaine’s. Third, would be the same for Desiree.
OTOH, maybe it was just *made* to look like a kidnapping and failed miserably. I’m rambling, sorry.
I had heard about some of Terri’s alleged comments on line after Kyron went missing, but this is one I hadn’t seen, on Olive. So I’m just putting it out there in case any of you hadn’t seen it either. (click on more, it’s the last one)

What a sick POS. More digging is definitely needed as he was in position of trust and close to vulnerable. Bet this is was not an isolated incident involving this perp. It is great of how he got arrogant and share his plans with another patient.

Where did we get the idea that Terri made the 911 call at the bus stop?
It’s my understanding from various early articles that the call was made at the bus, using the bus drivers phone to speak to the secretary and asked the secretary to call 911 since neither Terri or Kaine had their phones with them

Kyron was supposed to take the bus home Friday, so Terri went to the bus stop at 3:30 p.m. to pick him up.
But the bus driver told her he wasn’t there.
Panicked, she ran home and called the school to discover that he had been marked absent for the day.
She called 9-1-1, setting off a search that’s drawn in a swarm of officers and several law enforcement agencies, including the FBI.

3:30 to 3:35 according to Kaine Horman:
Kaine states he and Kiara walked to the bus stop with Terri following slightly behind. Some reports state Kaine or Terri or both had the bus driver phone back to the school at which point the bus driver informs them the school had Kyron marked absent all day. Other reports have Terri phoning the school secretary at which time Terri is informed Kyron was marked absent all day. Note: It is assumed that Kaine, Terri and Kiara all head to the school at this point based on statements made later by Desiree. Desiree states she was phoned by the school secretary and informed that Kyron had been missing all day. She states Terri was standing there with the school secretary during this phone call. Desiree states she hung up from the conversation with the secretary and immediately called Terri on her cell phone.
3:46 p.m. reported to be from Skyline elementary staff, law enforcement records and Desiree:
School secretary Susan Hall places 911 call and reports Kyron missing to authorities. Susan then calls Desiree and informs her of Kyron’s missing status. Desiree speaks with Terri immediately afterward on Terri’s cell phone. Desiree states she was immediately concerned because statements Terri made during that phone call didn’t make sense.

If Terri didn’t have her phone at the bus stop, then she got it before they left home because Desiree said the secretary called her and she hung up and called Terri right back on her cell phone while she was still at the school.
I don’t recall anyone reporting that neither of them had a cell phone with them – I’d be surprised if they ever went anywhere without one. In any case, Terri had one at the school.
You know, I was reading this link and now, almost 3 years later, I have one general impression — Kyron’s family is just not all that worried about the little guy being gone. I think the people here care a lot more. I don’t think his family cares. And I don’t think they, especially KH much wanted anybody nosing into his business, Kyron or no Kyron. KH was more important to KH.
Terri seems only interested in covering her behind, more than her own little daughter.
I think the only one really feeling the pain of losing Kyron is his mother. And I think KH considers her like “collateral damage”, and probably knows exactly why Kyron isn’t here any more. Of course, she won’t ever find out from KH or TMH because they only care about not being arrested for whatever it is that they are involved in.

As I recall, Terri had a receipt from FM #1, a conversation with AL at FM #2, and Blink said she was on video from the Albertson’s on Shattuck Road. Not sure if she was seen inside or in the parking lot or both, but that’s why I was so interested in the Mexican (fast food) Restaurant and the DIY car wash directly across the street.
@TRuth, Hard to separate assumptions with facts, but this scenario is how I always pictured things. (Feel free to correct me, this could be totally wrong.)
No one has publically disputed that TH, KH and Kiara all went to the bus stop. We never heard whether or not the stop was shared by other children (ie. Tanner), but if not, apparently the driver stopped when he saw the Hormans. The driver knew Kyron was not on the bus, so after the initial questions and confusion, the driver calls the school.
The secretary would probably check the attendance records, note Kyron was marked absent (if he was) and, or look for or call Ms. Porter, and the math teacher (if there was one) and anyone else she thought may have come into contact with Kyron and know his whereabouts. Meanwhile, the Hormans drive to the school. KH said he was on his way to the school thinking there was some mix up (on Oprah I think). I would think by then Keefer is alerted and possibly on the phone with PPS district office. Once at the school with the new information the secretary assembled, they all decided to call 911. Just My Media Skewed Opinion. (JMMSO)

Now a weird part of that to me is the school calling DY, instead of letting KH or TH call her, unless the secretary did so prior to the Hormans arriving at school. DY was listed as an emergency contact, but so were the Hormans and they were on their way or already there. Those initial minutes did not scream emergency, at least until it was discovered that no one had seen Kyron since about 9 am. Once that time frame was established, the severity of the situation should have resonated with everyone. Wonder how long it took the school to put their finger on that, and then how long it took to call 911? (IIRC the response time was slow.)
So who decided that a relative stranger should call a mother and inform her that her son was missing? Would seem more compassionate and natural for KH or TH to call DY. Maybe they were being interviewed by the police by then, and couldn’t, but then I think a component of the investigation would be to find out if DY had heard from Kyron that day, and the police would want to talk to her directly.
Hard to say how the events unfolded, but IMO, KH and TH owed DY that phone call. The way DY explained TH’s reaction to DY’s plan was that TH was surprised DY was heading up to Portland. Now if TH had something to do with Kyron’s disappearance wouldn’t TH say, yes, hurry up, get here, he’s missing, knowing he would not return? Instead, it’s almost as if TH is in shock or thought DY’s actions premature, like TH thought Kyron would be found. Again, JMO.
Can anyone answer the question about Kyron not performing in the school talent show that day as planned? School responsibility? Teacher responsibility? Why were the Horman’s not called at that point in time?

To me that Talent Show is one of the most critical pieces of info that has not been revealed. If Kyron was NOT scheduled to appear, then why doesn’t LE just say so. wouldn’t change anything. However if he was scheduled to appear, this is even more damning for the school, not to have enquired into it, especially since he had been there earlier and his jacket and was it lunch? was still in the classroom. This would part of the LE cover of school carelessness.
@Cindy, Sad and scary that there is not public accountability for the school. My guess is their story is that they thought TH took Kyron to a doctor’s appointment. Whether TH had something to do with his disappearance is questioned by most all here, but what is not being released is that he was seen after she left the school. Not releasing that information furthers KH and DY’s theory and lets the school off the hook, but it does nothing towards the efforts for finding what happened to Kyron.
@MbS, It really bugs me that it seems the Albertson’s information is being suppressed.
I wish LE would release some freakin’ accurate information about this case. Their limited released timeline says one 911 call made at 3:56 from the school secretary.
In one interview, Kaine Horman states he thought Kyron was probably still at the school, so they took off to find him.
In another interview it says the bus driver called the school and Susan Hall told them (via Terri) Kyron had been marked absent.
Why would he think Kyron would still be at the school if he was marked absent that day?
If that is what Susan Hall told them, then I would have called 911 at 3:35, and so should have Susan Hall, not 20 minutes later.
And why did Kaine Horman say that Kyron had been dropped off at school at 8:45? WTH, there were reports already out of people seeing him there earlier that morning.
None of this makes any sense to me. Erose, I agree that’s the scenario that would have made the most sense, but NOT if Susan Hall told Terri or the bus driver that Kyron had been marked absent at the time they were at the bus stop.
100% agree with you all about the call to DY, unless LE wanted the school to call her for some reason and not Kaine or Terri.
Can it be possible that the very people we trust with our children every day will “not pony up” that a mistake was made with this little boy’s life?
Specific, detailed information including times marked absent, phone call times, are “simple” tracking for most daily activities. Most corporations do a better job of tracking their employees activities than this school and perhaps many others do while caring and teaching our children. I am fed up with the evasiveness of the school and if they do not know then admit it.
I was re-reading some of the old site where it was reported about the Sauvie Island car chases went on that morning. The original poster did not say, that I could find anyway, there was a truck involved. In fact she/he goes on to correct another poster’s statement and says that they know for sure Terri was on the island because she was driving the mustang. She says there were two *vehicles*, and one of them went off the road (not the mustang) because they were driving so fast. She says that more than one neighbor got license plate numbers.

Its not on a report. This is a small island. Most of the people have lived out here for years. We have a small knit community on the island. People out here try to pay attention to vehicles and people. We are a tourist trap at this time of year. We have issues with theft on the farms and all sorts on nonsense. We all try to watch out for each other. In other words, people pay attention when anything is not normal. We have our own neighborhood watch as one could say. It has been reported to the proper agency. This is why we feel they have spent so much time out here. There were eye witnesses who wrote down license plate numbers.
We also hope you are right and Kyron is NOT found on the island. We had another tradgedy on the same day Kyron dissapeared. A lot of the people out here are dealing with the loss of a very good friend. If the sherriffs dept. looked somewhere else, it would possibly let our hearts heal for our neighbor and friend.

I am going to beg anyone on the island that seen the red mustang out here that morning to please go directly to the sherriffs department. I know of 2 seperate people who seen it the morning Kyron dissapeared. If the sherriff’s department has already contacted you GREAT! If not, please go to them with what you eye witnessed yourself….Not hear say. I am with Jaquie that if they make an arrest, I believe with all my heart the person is going to break. I gave the sherriff the information he needed to talk to 1 of the people who witnessed what happened that morning. His eyes got HUGE! I am thinking now about what Staton recently said about going back to old leads in the beginning and also him saying it has nothing to do with cell phone pings or emails.
Are they going back to these sightings and realizing it maybe wasn’t Terri driving the mustang that day? Has new information opened up that perhaps it WAS Terri’s mustang, but not Terri, perhaps someone Kaine Horman knew and handed his keys to?
Assuming the neighbor did get a license plate number, and it was RDSQRL. Who was driving the vehicle? IMO, these sightings are what led LE to searching SI.
Is it possible also that Terri Horman’s phone was in her car that day and she had Kaine’s in the truck? We ours in our vehicles, because we can’t get out well in the house with them. If I take my husband’s car, I would have his and not mine. (Sounds like the Horman’s may have had the same issues where they live.)
I am thinking that maybe LE DID find Kyron’s glasses on SI and in good shape or maybe since LE says they have no evidence of Kyron being deceased, maybe they found the glasses in the mustang, which was reported to be on SI. Crud, IDK. I just can’t see LE making all the efforts they did in searching that area for a cell ping. Eyewitness accounts, now yes, I can, but then I ask why no flier distributed around SI with a red mustang on it?
Something soooo does not make sense here. Fliers sent over here, searches done over there. Whomever took Kyron away from that school can’t have been everywhere in all places. I was reading something the other day that said Kyron was probably handed off to many different people in many different places. Could this be the explanation for this? Was Kyron maybe passed to someone at Albertsons then someone on SI then someone on one on Rocky Point or other points in order to leave no trail.
The only time I’ve heard of something being done like this is when it has to do with spousal or child abuse and the victim(s) going into hiding. Or maybe a witness protection program. This case is so darn weird. I hope something breaks somewhere.

I used think that the ransom note was put n TH’s truck at Albertsons and that was the reason why no one talked about TH’s trip to Albertsons.
I now think that maybe TH went to Albertsons at some point to get a refill of Kyrons allergy medication. (On the gofundme page one of Kelley’s memoirs mentioned Kyron was allergic to bee stings.)
Anyway maybe when LE ask TH to show them the medication she bought at Albertsons she could not produce it. Thus the theory that TH had stashed Kyron somewhere. As well as casting TH in a suspicious light.
@TRuth, Taken from your post. This implies they actually saw TH, not just the car. So in the hour and a half, TH went to Intel and got the car, and left the truck for KH to drive. Maybe that was the plan all along, and it has never been brought up. Wonder what she was driving when she got to the gym. Wonder what they drove on their way to pick up Kyron at the school.

Quoting amarareign above again. Anyone notice anyone in particular at MCSO who may have been visible suddenly disappear from the case? May mean nothing, but may mean something. In any case, if true, then around June 18, for one reason or another something changed.

erose, I’m thinking the person who was posting that the knew it was Terri was implying that they knew so, because it was HER car. But IDK.
Maybe it was her, but how could she be in two places at one time in two different vehicles. We know for a fact Terri was at FM, where AL saw her. What about the first FM, receipt right? Heck we even know where she was parked at one of the FM’s because LE left that info on the poster, was that the first FM or the second?

We never have heard when/where/if Kaine Horman left the Intel premises that day. Maybe he said he left for lunch and instead went to the school and picked up his son and then went from there to SI and handed Kyron off to someone else. The poster did say they were driving really fast, so someone was in a hurry. IIRC they were saying it was around 11:00 a.m. And why did Kaine Horman go into work early that day? Funny, he’s never mentioned it, but he did say he usually walked Ky to the bus stop in the morning. Maybe he traded his car with someone before he even got to work. IDK, I guess that would show up on Intel cameras as well.
Then again, maybe this is all BS, but whomever was posting did sound like they lived on SI. I don’t know what to think anymore, I was just going back to the early leads as Staton said they were. This would have been one of them.

@TRuth, In my far fetched mind, I wondered if TH used the truck in the am, then she and KH planned for her to swap vehicles at the Intel lot, as in maybe they only planned to swap long enough for her to pick up the project after the SF.
When ransom was speculated on, I wondered if TH called KH for help, and he was the one driving the mustang on SI. Lately, I’ve been thinking KH and TH were both involved in something that could have put a target on Kyron’s back.
There is no guarantee that either timeline is correct, nor can we believe either or both parties have revealed everything they did that day to LE, and especially not us. I feel your frustration.
Is there any proof that the red mustang was on S.I. or just hearsay. It’s sighting just seems “off” to me. I guess I am having trouble fitting this piece of info into the puzzle.

Is it possible the vehicles were seen on Sauvie Island the day before? Maybe someone remembered the wrong day. Weren’t they asking for footage from June 3rd as well as June 4th? What if something transpired the day before, leading to Kyron’s disappearance.

Agreed, suggested that early, I have the name of a retired FBI agent in CA I would pass on in a second if asked. I worked with this individual on one of my early cases to a successful conclusion (unfortunately the mp was deceased, but we were able to locate him and his murderers are adjudicated).
I would probably go into some sort of shock to find out that nobody has hired a PI in this case. KH has the funds and it certainly would be proactive.

Very busy…but this caught my eye! Has anyone researched this? I’ve been wondering for a LONG time. I’m thinking, still about DAD. I once suggested a scenario to TRue. He obviously thought it viable as it turned out to be his one and only “theories”. Someone very bright suggested what seems to me to be a very plausible theory in regard to DAD.
But there would have to be a link with DAD to Kaine. At the bottom’s up strip bar in Linton, i think? Where were those pics taken with Kaine cupping his wife’s breast? Just a tad bit away from sheltered lane, I believe.
We know that DAD was involved with a prostitute or ??? Not looking for a traffiking connection, here. Just a link between DAD and Kaine and women. Something that would put the two together.

I still wonder if DAD was the landscaper at the Horman home and/or worked for said landscaper. Kaine Horman says he never met RS. Someone, somewhere on one of the boards mentioned that the landscaper was recommended by one of Kaine’s friends. I have no idea whether or or not that is true, but if so, perhaps the connection is through Intel acquaintances who used the same landscaper. I’ve looked around a bit at this angle and came up empty.

Fugitive Logan Storm returned to Portland
PORTLAND, Ore. (KOIN) — A former Beaverton middle school teacher who fled after being convicted of child pornography is back in Oregon after being captured in Mexico last month.
Thirty-seven-year-old Long Storm was flown back to Portland from Houston Thursday and booked into the Multnomah County Jail, according to U.S. Marshals Supervisory Deputy Eric Wahlstrom.
On Jan. 29, Storm was convicted in U.S. District Court in Portland on one count of possession of child pornography. However, the following day, he removed his court-ordered monitoring bracelet and failed to appear for a detention hearing. The bracelet was found that same day at Lewis and Clark State Park near Troutdale. He had been staying with his parents in Southeast Portland.
In February, a silver-colored Volkswagen Jetta believed to have been driven by Storm was discovered in Los Angeles.
On March 11, the Federal Ministerial Police, a Mexican federal law enforcement agency, arrested Storm in Mexico City based on information provided by U.S. Marshals. Storm was flown from Mexico City to Houston, where he was lodged in the Harris County Jail. He remained lodged there until being extradited to Portland today.

following the Boston case from the MIT computer bldg
last nite, I saw the tremendous power of reddit & twitter &
other social media to track & investigate crime when the public is
given some info (an image) by fbi. (Then the public finds even more
than the fbi wants probably.) Sunil was id’d as #2 & the
missing Brown guy by a reddit user before LE
released the names. Not only that he was being searched for by
fbi for the last month & had done ied trials (Hanover) and was
known to probably be in Boston. (see reddit)
The best images of the 2 were on FB as farback as last
Monday by marathoners.. Bloggers who accumulated relevant
info from twitter in a stream kept the public informed. Who needed
the local police briefings (not meaning fbi) or mainstream media.
Boston TV was entertaining, but behind on the news as were the rest.
So, anyway, I wonder why if Portland’s so high tech, Skyline Neighbors
(meaning the impacted Portland community) did not use social media to
communicate? Did Kaine send his do not go public memo to the entire co?
Saying LE prematurely shut down speculation with it’s family/Terri is no explanation.
We’ve seen in Boston the public continuously contributing details & information.
It seems to me if all attendees at the Sci Fair had put their images & video on line, it would have led
to a member of the public further contributing & so on just like
Boston. And if LE had divulged a snip or two of their business/residential video ditto.
And if a description of the stranger anomaly had
been added in. I think for a “liberal” Town Portland is in fact very conservative.
I do not understand why reddit & twitter & blogs other than here didn’t pursue Kyron’s kidnapper
on the same kinds of social media as Boston’s Martin has had. Instead we have grandmother type

PORTLAND, Ore. (KOIN) — A man faces federal charges for alleged sex trafficking after being indicted by the US Attorney in the District Court of Oregon Wednesday.
Diallo Gaston was arrested in Salem after a 16-year-old girl identified him as the man who kidnapped her and forced her into prostitution. The girl, who was listed as a runaway from Portland, told police she met him on Tagged.com.
Court documents revealed Gaston was interviewed by both an FBI agent and a Portland police detective. He allegedly admitted he knew the girl was a minor, had sex with her, took pictures of her and posted an ad for her.
He also allegedly told the agents he helped other escorts and strippers because he was a good money manager.
He’s being held without bond and faces a minimum 10-year prison term if convicted.
