Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

    although all reports described this event as Kyron disappearing from the hallway of the school, MCSD did not treat the school as a crime scene. It was not sealed off and examined for evidence before being overrun by students and teachers in the following days. This baffling decision might have influenced Keefer’s behavior to also pretend it was all business as usual or possibly LE instructed him to handle it that way. I’m not entirely convinced that it was mere incompetence. Add to it the immediate focus on the “stepmother”, the reassurance from LE that it was not a stranger abduction so other children were not in danger, and what to you have: a school building filled with staff that is excluded from scrutiny. I know it sounds paranoid but it gives the appearance that something or someone was in that school that was not meant to be revealed, and both LE and keeper knew it. I doubt if K spent much time at the school so don’t know if he would have known what the others wanted to hide. On the other hand he quickly blamed terri and also assured other parents their children were not in danger. IOW disregarding the school as crime scene was not incompetence but intentional and self-serving. it just occurred to me that usually when something traumatic happens to one student, counselors are provided to assist other children in dealing with the distressing event. Does anybody remember mention of this upon Kyron’s disappearance? also goes back to who took Kyron and where did they take him?

He’d gone to masage school (not a perp. lol) Now wants to cook and cook Thai food. Short story….Cheap, great food and cheap beaches, etc. if you want to live like the natives. Just like parts of the other Indonesian countries and islands.

    This article just reminds me that even though there is very little to describe the “creepy guy”, people (especially kids) seem to instinctively know one when they see him. (Thinking of the rumor that kids said there was a creepy guy at Skyline.)

    PORTLAND – A “creepy guy” reportedly approached an 11-year-old girl in Southeast Portland Tuesday afternoon.

    Just after 4 p.m., a caller reported to police that a “creepy” man was driving a silver 4-door sedan in the area of Southeast 18th Avenue and Southeast Rex Street, said Sgt. Pete Simpson with Portland police.

    Police could not locate the car but the caller reported that his daughter was playing in the area when the stranger approached her. Police spoke with the girl who said she was playing outside when the man parked his car and got out.

    He then walked over to her and asked her name and how old she was. She ran away and told her dad what happened.

    He was described as a white man in his 30s with short brown hair. He was wearing jeans and a t-shirt and had no facial hair or glasses.

    Anyone with information was asked to call police.

    Counselors were there, and help was available for staff also. I was part of the PPS crisis team, but could not go due to caring for a grandchild. It’s just as well, I guess, in relation to posting here. If I had gone, I would not have felt I could ethically (publicly) discuss later whatever I saw or heard while volunteering.

    Counselors were available the following week. I think I heard that a few were there on the weekend during interviews, but I’m not sure about that.

    I am not sure if there was just incompetence, but I can only justify it at the preliminary level, meaning the accountability for Kyron once he entered the school. Was his teacher to busy to notice he was absent, or did she really think there was a doctor’s appointment, or did she realize that he went missing on her watch and used the doctor’s appointment as an excuse? All of those scenarios are a form of incompetence and the last coupled with some deception. Beyond them, we have to considered if the teacher was involved or had some knowledge of what happened.

    Here is where we have to examine incompetence on the part of the principal, for the reasons Rose stated; handling of crime scene, lost records, etc. Now, I believe they are in to full on CYA mode, not incompetent but a clear agenda to move past Kyron’s disappearance ASAP. Trouble for me is determining if the principal is covering for the incompetence on the part of the teacher, or if he is covering for the district who knew of an employee who was known to molest children and was still hired, or if he is somehow involved, and at whose (if any) direction is he performing.

    Penn State gave Jerry Sandusky the keys to the locker room, and he was seen over and over and over again with young boys. Sandusky had a cover story, and the best case is he fooled an entire community, or he fooled most of them while the rest turned their backs, and in the worst case others were involved. Either way, I wonder who the Skyline community has considered above reproach? Blink said the profile of this person is highly organized. I picture someone that either had some control after the fallout, or someone that knew exactly how people would react. This might be one of those guys that has molested hundreds of kids and never been caught and still has access to kids and will do this again.

    Sandusky is an excellent example of someone who was highly respected, even had that very worthwhile Foundation, but the head coach (forget his name) and some others must have known and determinedly kept it quiet and LET HIM CONTINUE. Same for the molester priests that were moved from parish to parish for decades rather than sully the reputation of the Church. Both sets meet Blink’s profile, both were known for what they were to some people. Both considered the reputation of the institution more important than the welfare of innocent children. The problem is, it’s almost impossible to get the real info from either of these groups until someone blows the whistle and there is an arrest, or LE catch the perv themselves. A detective friend once said that while molesters used to be more likely to let children go afterwards, now the danger the child will tell is too great so kill them rather than risk arrest. We still don’t know if Kyron was molested or what happened at all. Does MCSD really have no more idea than we do?

    about the doctor’s appt, Terri was herself a teacher, a conscientious mom who knew how things were done at the school. My guess is that she would not only inform the teacher of the time and day of the appt but also the school secretary or whoever tracks attendance in the office, in the case teacher did get confused or forget and mark child absent. Had that appt been scheduled for the day Kyron went missing, LE would undoubtedly have leaked it to the press (Maxine) to further incriminate Terri or even simply arrested her on basis of that. Far better excuse for arrest than hearsay MFH. The fact that they have kept quiet about this, leaving it to speculation, suggests to me that they, through the secretary, know perfectly well that the apt was for the following friday. speculation has been one of their main weapons of pressure in this case.

Blink said the profile of this person is highly organized. ” A well-liked PPS staff member; a successful businessman, particularly service industry (keeping in mind money laundering is done thru service businesses like hair & nail salons, restaurants & gyms); LE; a civic volunteer (ie, firefighter); minister or church leaders; software enterpreneurs, etc. Blink profile said he was single, maybe dated someone in area. Idk this person was even known to Skyline community. Probably not as he was not recognized. Probably he wouldn’t have gone there if he knew anyone likely to be at the eled (this includes a landscaper wouldn’t go where a customer might recognize him).

I cannot call anything that happened after that as incompetent at all. After the school realized Kyron was missing, they looked at it, IMO, as they had a legal problem, unfortunately. Individually, I am sure the people had compassion for the situation, but as an institution, no so much. MOO.

    There were several grand juries convened wrt Sandusky over a period of years, and yet everyone was in a state of shock when he was finally indicted. Lot’s of kids that were involved in his charitable programs, whose CEO was a licensed psychiatrist, considered Sandusky a perv. Bottom line – People knew. Nobody talked. It is suggested the motivation was not to put a smear on the beloved Coach Paterno’s football program. It was their bread and butter.

    Skyline seems a very close knit community, not to mention what having an active SO would do to property values or one’s peace of mind. Maybe the community is in some form of denial, as was Happy Valley in the case of Sandusky. Everyone (except Kiara and the Moulton’s) are better off if TH did this. And, maybe she did, but if she did, she did not act alone.

    So….what is with this community? Do they know more than we? I would think so, but is what they know something that would not stand up to outside scrutiny? IOW, have they been duped into a false sense of security by PPS and MSCO?

    Your excellent questions will, i would gather, be the kind of questions Houze would ask were there an indictment. As well as the other, more basic questions regarding whether or not Skyline/MCSO had identiified the local RSO’s unaccounted for, like Adams. Or had rendered negligible all of the other cast, such as Stenson, who worked, on the boundaries, regularly, for PPS as contracted or free agents.

    PORTLAND — A Gresham police officer fired for driving drunk in an unmarked police car has filed a $6 million lawsuit against the city, the police chief and others, alleging his rights were violated under the Americans with Disabilities Act.

    The lawsuit filed in Portland says Jason Servo was suffering from alcoholism, a recognized disability under the act, and shouldn’t have been fired.

    The suit also alleges Servo was denied due process, and the police union failed to represent him adequately. Servo was arrested in January 2011 after he crashed into a ditch while off duty. The lawsuit says he had spent the day at firearms training and then went out to eat and drink with fellow officers.

    OREGON CITY, Ore. — A Clackamas County deputy was arrested Thursday for menacing and unlawful use of a weapon, police said.

    Corrections deputy Shawn Heikkila was accused of domestic violence in November 2012, said spokesman Sgt. Robert Wurpes. Heikkila was immediately placed on administrative leave while the sheriff’s office and Clackamas County District Attorney’s Office investigated the allegations.

    Thursday he was jailed for unlawful use of a weapon and menacing charges related to the domestic violence incident, Wurpes said.

    Is this *delay* typical of district response? I wouldn’t necessarily blame the teacher…yet, but is this policy? These institutions should not be doing their own investigating. But then, what are the alternatives, turning the case over to DUI and DV cops? What a mess.

    The school district did not comment on specifics of the investigation, but did release the following statement:

    A complaint regarding a teacher was received at Oregon City High School and the district office. The issue was referred to Oregon City police for further investigation. The teacher was placed on leave pending the outcome of that investigation.

    Band said the school district received the complaints Monday and did not report them to the police department Wednesday. The district would not comment on the delay.

    You’ve got to give Jason Servo credit for his creative approach to alcoholism. Calling it a disability makes him immune to any action and even provides opportunity to sue for an attempt to rid the dept of an active alcoholic. No telling how many “officers” might be affected by “disabilities”. And there is probably no way to find out except for situations like this that are enacted in public. Since police and public schools investigate their own, same there. only cases we residents hear about is when a teacher actually runs off with a student and a search is initiated. Otherwise all is kept confidential.

    @erose. The principal having a 2day delay in police report (and as she was under 18 a CPSD report) probably allowed the teacher union time to find legal repr. The principal should be disciplined. But likely the only accountability would come via a parent suit against the school district.

    My Q is why would a teacher have/know about this teen-use appl?
    My inference is girls or students cued him.

    I had never seen this post before, it was apparently posted on the MKH website on June 29, 2010. Really a weird thing to do, if it isn’t true. Of course, it could be a mistake, that someone thought Kyron had been found, but to post that it came form the son of BK? Very weird.

    I haven’t seen that particular post, but there was a day where the Facebook page of an individual who claimed to be a Search and Rescue volunteer claimed that kyron’s body was found on sauces but that the information was being withheld from the public for some specific reason that I don’t remember. The story then appeared briefly on a local tv news website, I think KOIN but then disappeared. Given the way the case was going, nobody was surprised that info was withheld or suspicious that it was a hoax though we all (facebook discussion posters) tried to learn more about the individual and if he was really SAR. It appeared that he was not qualified. IIRC the profile was of a musician. no telling if he himself did the page or it was a hack. After a few days the facebook page disappeared and the “news” was never released. I can’t remember if there was an official announcement that it was disinformation or not. But whoever did that could have put out other such nuggets under the names of real people, or real people read these and passed them on.
