Kyron Horman Exclusive Report: New Suspect And Botched Investigation Rumors Abound- Terri Horman Prepares To Fight For Couples Daughter Following Seclusion

If you are reading this and have followed the Kyron Homan disappearance coverage since he vanished from Skyline School on June 4th 2010,  you know my coverage and commentary has focused on the macro analysis of the case details- both publicly available and via developed sources.   This report contains newly released information known to law enforcement.  It’s contents, to include reader commentary and moderation response,  may not be reproduced or copied without express written consent by it’s author  in accordance with applicable copyright law.

Last Week’s Meet And Greet

On Tuesday July 30th, the attorneys representing Terri Moulton Horman,  Kaine Horman and Desiree Young attended a series of case hearings.  Not held in chambers as announced, but public guests were barred.

On the docket- Desiree Young’s “stay” status of the $10 million dollar civil tort action brought against Terri Horman and the dissolution (divorce and custody) litigation brought by Kaine Horman, Terri’s estranged husband.  Until July 26th, there were additional hearings and status conferences scheduled for the recently renewed Freedom From Abuse and Protection Act  (FAPA) motion to contest and compel depositions in the restraining order prohibiting Terri Horman from contact with the couple’s daughter Kiara, now 5 years old.  Horman has not seen her daughter since June 2010 despite several attempts through counsel to arrange parenting time.    Engel, one of the attorneys representing Kaine Horman, argues that the FAPA case is consolidated with the divorce action, and therefore stayed.

Peter Bunch, counsel for Terri Horman, argues that there is no consolidation order.

Non attorney’s still do not understand how the initial proceeding to renew the FAPA order occurred when the plaintiff failed to file the required motion and accompanying affidavits in advance as required, or even serve the respondent’s attorneys until ordered to do so by Judge Henry Kantor once the hearing commenced.  Kantor ordered the renewal anyway.  I will let the goodly Oregon bar members weigh in on that anomaly.

That was then.  This is now.

As of July 31st, the FAPA restraining order was expired and a civil no contact order was put in its place.  The dissolution matter (divorce) stay has been lifted and Desiree Young announced she was instructing her attorney’s to withdraw the $10 million dollar suit financed by public donations.

On the same front steps where Atty Rosenthal announced that they were launching the suit to peel the onion that is to include law enforcement, and to “make Terri Horman talk” was withdrawn in similar fashion.

However, on this occasion,  Multnomah County District Attorney Rod Underhill was not spotted on the steps observing.   Rosenthal and Young indicated the recent appearance and testimony of former object of compulsion to testify, DeDe Spicher, as well as information that the investigative case file necessary (their words) to prove their claims would not be forthcoming.  In an article analyzing the suit appearing on BOC it was predicted that Ms. Young would face possible countersuit and associated fees should the suit continue as filed.

Attorneys for both Kaine and Terri appeared before Multnomah County Circuit Family law Judge Susan Svetkey on August 1, 2013.   Judge Svetkey is Houze’s wife.  The docket information for that hearing has not yet been entered into the file as of this publication.

The only comment about the withdrawal of the civil tort action by Stephen Houze:

“The lawsuit was unfounded and lacking in legal merit,” Houze said. “One can only hope that the dismissal of this meritless lawsuit receives the same degree of media scrutiny as was given to its filing.”

 In recent interviews, Kaine Horman has intimated that his wife has expressed her desire to help find Kyron, or at least contribute to excluding herself as a possible suspect.  He also admitted that he no longer has any communication with Desiree Young, Kyron’s mother.   He sometimes wonders what law enforcement is actually doing on his son’s case.   This is a firm departure from how Mr. Horman initially retained his six figure attorney Laura Rackner of Gearing, Rackner, and Engel & McGrath.   Ms. Rackner appears to have promulgated her duties of late to her partner, Brett Engel.

This all seemed to start when formidable and well known tort Attorney Mark Wagner came out of retirement to appear as counsel for Terri Horman.   Wagner and Rackner know each other, and Rackner is no stranger to LE –based dissolution entanglements.

In fact, Wagner represented her and her previous firm successfully.

Bagel Finagle

Kaine Horman’s attorney Laura Rackner is no stranger to law enforcement infused litigation.  She is a former prosecutor for Oregon’s department of Justice, The U.S. Department of Justice, and Office of Chief Counsel.  Ms. Rackner has specificity in Drug Enforcement Administration (DEA) casework.

Born in Minneapolis, Minnesota, Laura received her B.S. in 1979 and her J.D. in 1984, both from the University of Oregon.

Prior to entering private practice, Laura served as deputy district attorney in the Marion County District Attorney’s Office; assistant attorney general in the Oregon Department of Justice; and on the staff of the U.S. Department of Justice, Office of Chief Counsel, Drug Enforcement Administration.

Record Scratch.

Martin Rob Cagan, The bagel king and according to him, a supreme target of a police shakedown at the hands of his former spouse’s attorneys was the litigious sort.

In fact, this may be how Atty Wagner decides to come out of retirement and become part of Terri Horman’s defense team while the civil suit was active.

Wagner’s firm represented Ms. Rackner in a suit filed by  Rob Cagan in which he sued the Dueshete Police Department,    A partner in the firm representing Caroleen Vanhoomissen, the suit (or ramblings of a very angry divorcee) alleges that the firm and its lawyers facilitated the difficulties of Mr. Cagan utilizing law enforcement sources directly by the attorneys was dismissed.

Ms. Vanhoomissen, the sister of Judge Vanhoomissen is also the owner of a horse farm in Bend, Oregon.  Blinkoncrime was unable to verify if it was the Bend horse farm searched in the early days of the investigation for Kyron.

Attorney Rackner’s prior working relationship with the DEA, the very agency that supplied the undercover officer in the failed sting involving Horman landscaper Rudy Sanchez begs the question- Did Rackner use her contacts and/or credentials to facilitate a surreptitious ruse to gain favor for her client in anticipation of his wife’s potential arrest?

Kaine is on record that law enforcement informed him they had probable cause to arrest Terri.  What is not on record, is what came first- the referral to Rackner.

I just  want to do what I can to help law enforcement

Seems like an odd comment coming from a family attorney with a background as a prosecutor working with the DEA,  which agency subsequently becomes involved in the case- or initially led to her representation- the chicken or the egg facts remain unclear.

 

The ex parte and originally sealed restraining order did not exclude Terri Horman from the marital home.  Was this an oversight of a very seasoned family attorney or was the basis of the now defunct restraining order as provided to Kaine Horman and Laura Rackner by law enforcement effectively invalidated by Terri Horman calling 911?

Is the reason that Atty Engel seems to have taken over representation of Kaine Horman due to the fact that these actions could render Ms. Rackner a witness in her client’s case as opposed to his Attorney?

In the motions and subsequent hearing scheduled for July 30th, the only available arguments outside of the parties agreement is to contest the basis for the FAPA order- or, the allegation Kaine Horman has made within his affidavits more than once, that his wife tried to hire “our landscaper” to kill him, and that she is being investigated for “violent crimes.”

The outcome?

The order was converted to a civil no-contact order which has not yet been added to the file for public review.

Desiree and Kaine’s respective camps both claimed “protecting the integrity of the investigation” was their only interest although the ONLY 2 witnesses who were summoned for deposition by Terri Horman’s lawyers were- the lead investigator of Kyron’s investigation for 18 months- Bobby John O’Donnell and Kaine Horman.

 

 

Back To School

Skyline School, the International Baccalaureate candidate who announced the IB open house format weeks earlier via take home handouts to its students and also by displaying the event on its marquis has never been declared a crime scene.  Although in nearly every legal support brief or news coverage article Terri Horman was dubbed “the last person to be seen with Kyron Horman” or more recently by Desiree Young as “Kyron was last seen by someone who cared about him at 8:45 am” absolutely no witness account or Science Fair insider was known publicly to dispute such accounts.

Until now.

“Once I learned all that was going on that same day, in that same school, I did not understand why I was being told that Terri Horman was the suspect, and one other person… It never made sense to me that they knew Kyron was seen with someone else besides his stepmother after she left, that they seemed to not even consider another theory.”  (*Editor’s Note*- parts of the source’s quote have been redacted as they would reveal identity of witnesses in an ongoing criminal investigation)

Electric Slide?

Sometime after Terri Horman left the school with her daughter Kiara in tow, she was captured on store video prior to Kyron’s exit from Skyline School.   It is believed Kyron was last seen between 9:05 and 9:20 AM.

The following is a summation of multiple direct witness accounts, edited to protect witness identification only.

“…He must have been standing behind me because I only recall hearing him ask if the boy could help him bring some stuff in from his truck.  I thought it was (edited) until he looked up at him and then he looked at Ms. Matthews for approval and she nodded her head yes in response.  They walked out of the South entrance together and I do not recall seeing either of them again.

(Editor’s Note: It is believed that Desiree and Kaine’s comments about concern that instruction they gave him last year about listening to staff “came back to haunt them.”  They have never acknowledged they were told about this witness account but a source close to www.blinkoncrime.com has confirmed they were informed but not given a witness description.

Backstory OR Backdrop?

Among the peers of Kyron Horman in attendance on June 4th, were some children whose parents may have been granted access via the open house format, although documents filed with the school and LE would preclude the parents from removing them.

In fact, the mother of a chief witness in this case was arrested that very day for attempting to fill a script that did not belong to her, in a pharmacy that Terri Horman allegedly also visited that morning.

Another child whose parents lost custody due to very long histories with substance abuse and associated criminal behavior had the additional possible misfortune of closely resembling both Kaine and Terri Horman.

It is unknown whether either parent took the opportunity to visit the school that day, but they were not included on the published list.  While barred legally from removing their child from the school they could not be barred from a publicly announced invitational.  There was no ID checks or sign-in sheets for non-volunteer guests.

In an unrelated twist, the child’s Father was found deceased in front of a Portland residence in April 2012.   The name of the child and Kyron’s schoolmate, guardians and parents are being intentionally withheld for this article.

Sovereignty In lieu Of..

Among the many unanswered questions in Kyron’s disappearance:  Why hasn’t the school been held accountable?  He disappeared on their watch- with a concise standard of care duty and plan.

What really happened?

There is no dispute that Kyron had an exchange that resulted in a teacher nodding her approval that Kyron assist a man in his stated purpose- to bring things in from his truck.   There is no dispute that Kyron was last seen at Skyline School.  There is no dispute that both Kyron’s parents expressed concern that last year’s discipline involving instruction on being a better listener may have come back to haunt them.  They said so.

What may be in dispute, for sure, is how accurate the list of attendees at the Skyline School of June 4th, 2010 is.

As an example, one witness told Editor In Chief, S. Christina Stoy that a young male former student said hello to Susan Hall and when asked by a parent who the lad was a few days later, she said she was not sure.  He is NOT on the list.

When another parent subsequently asked Ms. Hall who the student was following Kyron’s disappearance to verify he was on the published list- she responded she could not remember.  Ms. Hall was the Skyline Administrative staff who contacted 911 upon speaking to Terri Horman and learning Kyron was not on the bus.  Hall subsequently contacted Desiree Young.  She did this while the Horman’s were on their way back to the school to see if Kyron might have thought he was being picked up that day as opposed to riding the bus or some other sort of snafu.

According to the MCSO, the school records that could assist the investigation were never requested to be preserved by investigators and as a result were deleted.

So why was the Skyline School never named as a defendant in the previously pending litigation filed by Kyron’s mother Desiree Young?

The reason may lie in the recreational designation utilized on June 4th, 2010.

According to the National Policy and Legal Analysis Network (napl) it may be a simple question of whether Kyron disappeared during the “recreational” portion of the program.

Napl’s guidance to lawyer’s advising Oregon schools can be read here.  Although the overall plan is relative to an obesity initiative, it would include research and advice on any school recreational or regularly scheduled event.  Please tell me Cogen does not factor into this.

The following are excerpts from the report:

…”Absent special liability protection, school districts and other providers of recreational facilities have the legal duty to take reasonable precautions to prevent injury. What is reasonable is very context specific and depends on many things: most important, the nature of the harm, the difficulty of preventing it, and generally accepted standards in the management of recreational facilities…”

 

…” The only immunity Oregon grants to public bodies, which include school districts,2 is discretionary government immunity.3 Discretionary government immunity applies to choices “among alternative public policies by persons to whom responsibility for such policies have been delegated.”4 To fall under the protection of this doctrine, Oregon courts have said, the choice must result from the exercise of judgment and involve a public policy or nonroutine day-to-day activity.

…” In summary, Oregon immunizes schools for policy choices its officials make, but it holds schools liable for breaches of duty that occur in carrying out those policy choices…”

…” The recreational user statute should therefore provide strong protection to Oregon schools seeking to avoid liability arising from after-hours outdoor recreational programs on school grounds. Applying this statute to indoor recreational activities, however, is much riskier, although the case law does not preclude such a strategy.

 

Regular School Day- Changes Things

 

…” In Oregon, schools owe students a duty to “supervise at all times the conduct of children on school grounds and to enforce those rules and regulations necessary to their protection. . . . The standard of care imposed upon school personnel in carrying out the duty to supervise the conduct of students is that degree of care which a person of ordinary prudence, charged with comparable duties, would exercise under the same circumstances.”37

 

Is the issue of liability to Skyline School relegated to what time Kyron was abducted, presuming he was abducted, as is believed?

Very possibly.

As we know, the school opened early the morning of June 4th, 2010, as was displayed on the school’s marquis at least 2 weeks prior.    Without particular knowledge of when the suspect responsible for Kyron’s disappearance entered the school, and under what auspice, one is left to the timeline of Kyron’s activities as juxtaposed with the start of the school day.   As a regular standard of care, one could argue that begins with a student getting on the bus, if a passenger, on their regular route.  What if a bus passenger is attending the “event” outside of the bus transportation?   Admittedly, it seems moot inasmuch as neither one of Kyron’s parents have filed suit against the school or named them as having any negligence or liability.  That said, it remains a possibility in the event Kyron is found.

There is no question Kyron was seen after 8:45AM- which is the time that a regularly scheduled bus arrives- which would ring the bell, so to speak, on the normal school day.

    How brazen can a person be to place himself in a crowd, speak to a teacher, then abduct a child knowing pictures are being taken? Something enabled that sense of confidence so my guess is he looks very average and is likely not from the area, perhaps from quite far away.

    I still can’t get away from a teacher at the school allowing Kyron to leave the building with a man who was not related to the child. What made this man seem so trustworthy?

    The biggie? How has he eluded LE and investigators all these years??

    @Ode and @ Rose, Great work on Solor4Schools and TH’s award tie in. Quite possible TH had a contact when she was working on the project that may have become familiar with Kyron and used the SF to act out some sort of sick fantasy.

    Having reviewed my posts on investigatory personnel, imo from the first the investigation was led by 3 LONG-time members of the County’s Child Abuse Unit (CAU) on which there was some overlap with East Major Crimes team. Look at overtime sheets for DA: Woods was on CAU 20 yrs & its DA head (as had been Meisenheimer); Moawad was fulltime on this case & on CAU when it occurred. ODonnell had been on CAU the preceding 5 years. From the first this case was conceptualized as a (step)parental abuse case. And if you’ve been on CAU 5 years, you see an evil parent in everyone psychologically.

    You are so right, and just imagine what you “see” after 20 years.

    It happens in many professions and often goes unrecognized, IMO. In fact, I would guess that (1) it negatively impacts your ability to see other options, (2) it gives you that “knight in shining armor” feeling, and (3) your reputation and extraordinary focus convinces others you must be right and influences outcomes.

    This could happen to Blink, but having read every word she has written on this case and observed how she steers others (us) through this process, I’m confident it has not and she knows it.

    I appreciated your last sentence as a reminder to hit the refresh button on my own thinking every so often.

    The following are teacher classroom assignments at Skyline for 104, 109, and 110 for the associated years. I assume these classrooms correspond to “basement” rooms CLR104, CLR109, and CLR110. In 2008-2009 Matthews was in 109 and Cole was in 110. I am going to assume this was the same in 2009-2010. I would love to confirm this with the 2009-2010 handbook, but I have yet to find a link. Someone somewhere must have this information.

    What is interesting is by 2010-2011 Mathews and Cole had switched classrooms according to the published handbook. Usually teachers are not all that happy about changing classrooms. If changes are made it is often to better group similar grade classrooms. Note McBeth stayed in 104 when he taught 4/5 in 2011-2012. Could it be the switch was done due to the incident described my Blink in this article, as a “comfort” to Ms. Mathews.

    Also of note. When Ms. Mathews left, retired?, Ms. Porter switched to K/1 and moved to Mathews’ 110.

    @Blink. I have never been to a Sci Fair in eled/middle (4 publics & 1 exclusive private) where Sci Fair had refreshments or a printed guide.

    I don’t know what happens now, but a few years ago I attended some PPS middle school science fairs and elementary fairs of different kinds. They had simple refreshments which were sold as fundraisers by PTA or similar groups and in one case, the 8th grade class for a project they were doing. Each also had a 1-page flyer which told how to find things and listed any sponsors and thank you’s. However, these were in the evening. I doubt that anyone would have thought to do that for an early morning event where people were only there for a short time and many were probably on the way to work.

    My understanding of the focus of the science fair in general was to work on and show they were able to meet the standards for being accepted as an IB school (which they were not at that time). The main effort toward this requirement (I don’t think it has to be science, but a way to show what you’ve learned in particular areas) was expected to be on the part of the upper grades, but they included all levels.

    They really were not set up the way you would for an evening community event such as the ones I’ve attended. Of course, they weren’t set up the way I would have expected for a daytime parent and community event either.

    Given the main purpose of this event, I cannot imagine there wasn’t someone assigned to do “official” photos and maybe video to document the event on both Thursday and Friday, rather than depending on snapshots from busy staff or parent volunteers. I assumed when LE asked for all pictures and videos that they would have included asking PPS what they had – but who knows. (The district administrator for IB programs was there that morning.) Not sure PPS or the school would have provided such pictures/videos if not asked. Maybe.

    If Kyron thought he was going outside to help the man carry in some things from his vehicle, and was willing (for whatever reason) to do that, at what point would he have changed his mind? Does our understanding of Kyron’s personality lead us to think he would have quietly gotten into a vehicle if ordered to, even though he knew he was supposed to be going back into the building? Or would he have been easily tricked by hearing that the truck needed to be moved to another door to unload? Or would he have been subdued in some way before he really knew what was happening?

    If no one saw him leave the grounds, it could mean he was not physically visible, but it could also mean there were tinted windows or no one looking in that direction at the right time or another adult blocked the view into the truck.

    It seems to me that if you stick with the simplest story, it omits TH telling him in advance a reason to go outside, someone trying to meet up with her at one of the stores she visited, someone trying to connect with her in any way about anything. IMO, the only way it seems least complicated and still includes her in a criminal way is if she hired a pro to get rid of him and then stayed out of it entirely – but that seems so farfetched to me given her circumstances, personality, and resources.

    Can you say what you think most likely happened between the exit door and the edge of the school property turning onto the street? Could Kyron’s glasses have been lost in a brief struggle? (Not something that would likely have happened if someone he knew told him they were leaving the school for a reason, but possibly once he discovered there was nothing to carry in and tried to turn around.)

    I don’t feel my speculation to your question would be responsible on my part, way too many possibilities even if we are working from a profile I can reasonably predict. I can say if the way Ky was ultimately removed from the scene is a source of pride to this offender, it would be equally inappropriate for me to comment if I was sure what it was.

    It is just this- a sick freak, removing an innocent to feed his lifelong sick and evil fantasy who when caught, will curl up like a pillbug with fear and fake shame.

    these are additional reports from various sources that I find interesting: . Carol Moulton said the kids were supposed to report to their classes and be divided into small groups of a few students each. Each group was supposed to tour the science fair with a chaperone. Afterward, when they returned to their classes for roll call, Kyron wasn’t there, she said. He apparently was not in any group and no one noticed.

    In another report Zimmerman said everyone went into their classroom for the science fair and broke into parent-led groups of four or five. She wasn’t sure what group Kyron was in, but she said the last time she saw him was at 8:45, when the groups began going from class to class. .

    Again, according to the sheriff’s office, the stepmother saw the boy walking toward his classroom at 8:45 as she left the building but officials with Portland Public Schools said Horman’s teacher never saw him in class which started at 10 a.m. The teacher marked him absent. . Kyron’s backpack and jacket were found in his classroom. The children pointed out to the teacher that Kyron was missing and she never called his parents. Kristina Porter, Kyron’s teacher has said that Terri Horman had previously told her that Kyron had an upcoming appointment but Porter didn’t remember the date. She said she assumed he was at that appointment, having seen him with his step-mom that morning. .

    When Kyron didn’t get off the bus in the afternoon, his parents called police. . Gates said Saturday that police received a 9-1-1 call at 3:45 Friday afternoon. . Portland Public Schools spokesman Matt Shelby said two teachers saw Kyron with his stepmother and thought the two left school together.

    Found this reading back at the beginning from various sources like Dateline and the Oregonian and had totally forgot that Gina Zimmerman saw Kyron and Kiara with Terri in the morning (which many people had questioned whether or not Kiara was with her). I had also forgotten that Mrs. Zimmerman was/is the PTA President and her daughter Maddy is one of Kyron’s friends.

    (snip) DESIREE YOUNG: We just made sure that we got along, and that we sacrificed things that needed to be sacrificed for the good of the kids, and just dedicated our emotional energy in that and not at each other. They got along as best they could. Around the age of two, Kyron began living with his father and stepmother full time in Portland. Friends say Terri was an attentive stepmom, active in Kyron’s school. KATE SNOW: Was she a good mother? DESIREE YOUNG: I wouldn’t say she would replace me, obviously, but she definitely gave him what he needed.

    I have two grown children, and have attended a multitude of science fairs, parent-invited assemblies, talent shows, sport’s events, etc. I do not remember ever needing to sign in for these events. Furthermore, I do remember most of these events being extremely crowded with tons of people of all ages walking around nilly-willy.

    One question and one thought.

    Question: Although Kaine and DY have decided not to hold the school culpable for their son’s disappearance, could Terri? Could Terri bring suit (if she is found 100% innocent of wrong-doing) against the school for pain and suffering or something like that?

    Thought: I am about 90% convinced that this was a stranger abduction. My 10% uncertainty is due to LE’s (although I do find them inept in this case, thus only 10%)continuance of certainty that Terri was involved. My 10% wonders if Terri could have said to Kyron, as she was leaving, “I have to leave because Kitty is sick, but you have a few minutes before you have to be in class, why don’t you quickly run down and check out that cool electric one everyone is talking about?” Doubtful, I know…

    The SZ was knowledgeable about the layout of the building and the lack of organized security for such an event. How did he acquire that knowledge? Since we don’t know who SZ is, we can’t answer that question.

    The other thing that bothers me and is indirectly pointed to by Blinks article is that LE and others associated with the criminal justice system has some people of questionable character and experience in doing a particular job. There appears to be some disdain for a crime against the bio mother and father. Why that would be may have been caused by prior acts. IMO if that is true, some people in the agencies need to have a job change.

    I would think that it is time for a state or federal investigation be made regarding the handling of this case.

    Thank you T. Ruth. PZ is on the list of attendees as well as Pony delivery.I thought we had discussed this before. One of the interesting things I thought was that the warehouse would deliver materials and science equipment. I am not saying that Pony delivery brought anything other than mail on June 4th, I just thought the science stuff was interesting. Then again you would suspect anything needed for the science fair would have been there before Kyron disappeared.
    On another note…some posters today think Ms. Matthews spoke to SZ. I thought the only exchange was a look from Kyron to Ms. Matthews and a nod back from her to Kyron. I also think that SZ was not seen either after Kyron disappeared.

    @texas grandfather: great point about alarms can be attatched to fire exit doors! shopping malls and stores have been using these for many many years to stop the theft of merchandise, why dont elementary schools have same concerne for deterring theft of children perplexes me. having lived in many small town areas i can say though it is still a common thought often: “that would never happen here” also where i presently live, (not an example related to skyline area) the schools in minority areas with mostly low income students have less funding. they are the schools with less lighting, no fences and less staff, no outside cameras, i would hope they dont also have less security inside. i wonder when america will care more about all of their children…

    i would add something to my last post about low income minority schools or just schools that are outside of wealthy neighborhoods, alot of schhols like that in seattle, (where i recently lived near) have made changes and gotten more funding. they did that because enough parents said enough! they got together and petitioned, met in community meetings, risked going against the popular tide of dont say anything! i wish that the skyline community and portland area would have as much opinion and ranting about student safety as they have about tmh. This should be the very last time some scum can take a child right out of a public school!

    I think PPS has operated for decades with the unspoken policy that since there is very little money beyond what they have to get through a school year (in their opinion), it is better not to look for more needs since they can’t pay for them anyway.

    I worked in the PPS high school which had the oldest building in continuous use as a high school in the northwest – it is now over 100 years old. In the 1960’s and early 1970’s a lot of bad things happened in particular places in the building and it was nearly impossible to supervise adequately. As a result of that and some decline in enrollment (which had been several thousand), some doors and stairs and an entire back hallway from one end of the building to another were blocked off by metal doors and chains. Around 1986 we had an arsonist (not a student according to the FBI, but never caught even with a composite picture) who set a number of fires. Of course, we had some copycat fires as well. Part of my job was to carry a radio and patrol some of the back halls watching for him – thank goodness I never met him.

    Because of the arsonist, the fire department told us we had to open up doors and hallways that had been closed for years. We also got our first sprinkler system and a partly updated fire alarm system that showed which alarm had been set off, but only in part of the building. The rest of the building still required that staff rapidly search 4 floors and some adjacent small buildings for the particular alarm and radio it in.

    We were not the only building in need, but we were the only building to get those kinds of changes because our need became so obvious and students were asking to transfer out to get an uninterrupted education.

    In the absence of money and a supportive district for an individual school’s security and safety needs, it falls to the principal and staff to make it a priority and to creatively make up the difference with good planning and procedures, good budgeting, and persistent requests to the district. IMO, that did not appear to happen at Skyline, and to be fair, at many other schools. It also falls to parents to be alert to those needs and keep bringing them up.

    about the layout of the school and if sz had access to it, several sluethers on a forum, without any particular training or skills posted the plans/layout for skyline in 2012 while looking into this case. why the pps school system thought it was wise or necessary to have the architectural plans for skyline online and accesible to anyone is beyond me. i hope they are not still in the practice of having any school plans online anymore. if they still do, i could look them up on my prepaid (in cash) cell phone with no contract identifying me thru the phone company, i just by refill cards, in cash. i do this because i am recently unable to work and poor on disability, i have phone service when i can afford it this wat. what about other people that do the same for other reasons!? no electronic footprint.

    even if sz didnt have acces to school layout, he could have walked into school and the greeter (not recognizing him personally) said, oh hello, volunteers meet in the basement….

    in reguards to ms mathews and because of the mob mentality in that area of oregon, i would say a few things. she apparently made a serious mistake in judgement. she could have thought it was one of the dads she had seen alot at the school previously. since the incident: she may have immedietly gone to staff and le, not even waiting until the sunday interviews. imo the pps and skyline have reason to not be particulary “transparent and forthcoming” in this case. it is convieniant imo that a suit may not be able to prove that the school did not call to notify kyrons abscense because there are no phone records! ms mathews probably was informed by le that she was not to speak about what she saw, as were all other witnessess in this case. ms mathews prob was advised same by pps. she peob does not have finances to retain a lawyer to ensure she would not lose her pension if she spoke out, or to ensure she was not blamed for total responsibility while pps covers themselves with their legion of legal counsel. she may feel the same as the witness that blink quoted in this article, i cant believe they are pointing at terri horman! we dont know her thoughts, only what we have seen publicly by the school and le in this case.

    not unusual in PPS. I feel Blink didnt communicated blame, but long overdue facts.
    And, we have to be clear on mob mentality in Oregon. I don’t see it. To the
    extent mob mentality exists specific to this case it has been founded in repeated statements
    & villifying by the bios, with whipping “anti” sentiment and physical activities into a frenzy online
    & in person in Roseberg. To the extent it exists, imo it is case specific and completely tied to MCSO/
    bio behaviors & statements. What Portland does have is a strata of connected cronyism
    intertwining the political, the clubs, the investments structures (whether green investments or
    commercial real estate etc ), the gov’t & legal institutions, and the media. I think Mathews & the rests of Skyline staff and their trauma are gnats to those cronys & will never be on their horizon.

    Have you indicated the time, yet? And I am still wrapping my head around this. PLEASE excuse me if i’ve missed it or am just not SEEing. Wouldn’t be the first time. But IIRC, even being a busy prof. mom the first years of activities such as Grandparent’s Day, Science Fairs, etc. I either tried to volunteer or had someone go in my stead. No matter what time of day or night. Our Elem. school was a lot like Skyline, as I knew many parents there while my son was in soccer and basketball. The volunteer cadre was plentiful. Moms and/or dads were all over the place on days like this.

    For Kyron to go missing and the perp to be in the area where Terri parked, and stayed there, after TMH left is beyond my comprehension. He must have moved his car. To take Kyron out those front doors is just astounding. So many parents would have been going in and out until 10am.

    Sz then, as you suspect, must have been so brazen as to have scoped out those going in, somehow zeroed in on Kyron from the get go, paced himself and Kyron so that leaving would have seemed natural to anyone observing.

    But Kyron was only in second grade. It’s possible that unless TMH knew didn’t know parents of the older grades, or K, that SZ might not be noticed in those hall by most parents that were there. Parents really only pay attention to other parents of their child’s class/grade during those fairs. Lots of competition to show that “your” kid has done well, esp. in a future IB school.

    I just wonder, IF Kyron did go out the main doors with the SZ, and IF someone DID notice…. could there have been reports to the FBI, etc. of sightings OUTSIDE the school, with TMH and her truck GONE, that were discarded?

    And who knows. Those “person or persons” near the white truck may have been the SZ looking in to find something to “chat” with Kyron about as they left, to distract him. I.E. “Oh, your sister’s carseat is blue, isn’t it?”

    Another thing. That “electric one”….it seems to me to be advanced for the Ms Matthew’s grade level. Why was it displayed there…any intel on that?

    For years many have been saying that trying to make the puzzle fit was akin to using a nail file to saw off jigsaw puzzle pieces, fit them in, and then…..when the whole puzzle was completed, realize that the picture was missing something. Completion.

    For me, it started with Stensen. He had a story about why tmh’s truck was NOT there on the access road. He come forward (was the groundskeeper) after the “white truck” presser. They’d never even investigated him. He came back the next week, to the press, and said that LE had convinced him his “times” were wrong. That the white truck could have been there.

    SZ has eluded LE all this time because they were never looking, seriously, for a single-minded SZ to have taken Kyron from this school. They were looking for an accomplice, not the mastermind. They already had her.

    The more I think about the exchange between SZ, Kyron, and Ms. Matthews, the more and more odd I find it that Ms. Matthews only nodded and did not say anything. I would think it would be automatic for a teacher of young students to have given some sort of verbal instruction, such as “come right back” to a student asking to leave the room (not that it would have changed the outcome). I find it even more odd that Kyron was not her student and, as Blink indicated, not Kyron’s group leader, but she never asked him “who is your teacher”, or “where are you supposed to be right now”, or “make sure you tell your group leader where you’re going”, etc. When tour groups are moving from one room to the next, you would think she would at least tell Kyron to tell his group leader he was leaving so he could reconnect with his group after coming back in, and so his group leader wouldnt potentially be looking for him during the time he was gone.

    Then, even if she said/asked none of those things, I would expect her to ask SZ what he needed help carrying so she could either a) determine if this was worth kyron losing time touring the science fair for, or b) just out of curiosity/making conversation.

    Yet, Ms. Matthews did none of those things. She gave permission for a child that she was not responsible for (in that she was not his teacher or group leader) to leave the school without telling his group leader, without giving any verbal instruction, or even questioning if helping SZ was worth missing part of the science fair for. She just nodded. Seems to be completely opposite of what a normal and probably automatic response would be for any other teacher to young children. I find it very disturbing.

    Is there a stairway from 109 to the floor above other than the one by the main entrance?

    If he did leave via that door would mean SZ did move his car if he’d been situated to observe TMH going in the school with Kyron.

    And he could have gone outside without anyone noticing as I believe the parking spaced behind the gym were for staff.

    Parked so close to that entrance, in the Handicapped Parking space, for example, he wouldn’t have had difficulty putting Kyron into a back door and closing it. Empty playground, etc was behind him.

    But he must have known the school, or layout.

    If he had seen Kyron walking in with mom, how would he have known where Kyron had gone to once mom left. Unless he had walked in around 8:30 and started following them.

    Otherwise…you are saying he just walked into that room, chose Kyron at random, walked out with him?

    So…you think…no PRIOR connection with “wanting” Kyron …. except in that one MOMENT in the classroom?

    Can’t say anything more than it is entirely possible, yes.

    Thanks for your information regarding rooms. I, too, have been searching since late 2010 for infomation that has become, increasingly, obsolete, in reference to the summer and fall of 2010. Not only from the school, but from local radio stations and Olive and even WW. For awhile a “cache” would pull them up, but no longer. I do believe some information and tapes (video) requested by LE at the time was never returned. I even recall a news reporter saying they would no longer have video’s of parent, etc. testimonials, as LE wanted them.

    I hope, whenever this is over, whoever documents and stories this case will have access to files via the 1976 foia.

    I think the public has a right to know what really happened, here, because if TMH had nothing to do with this abduction, the ability of LE here, in Oregon, to take and keep a baby from it’s mother until she confesses to a crime is paramount to the deliberate absolute destruction of the lives of the VICTIMS of a crime.

    Imagine that The Ramsy’s had been divided and her son taken away from Patty until she “confesses” what she knows?

    I am no where near as skilled as your other posters particularly with regards to technical details ie: floor plans, safety procedures at school etc. I have never been employed in a professional position.

    So this is from me as an average layperson. I read many posts by people trying to figure out how Kyron was allowed to leave as he did with SZ. Why Ms. Matthews didn’t follow a certain set of procedures and such.

    What happens to Kyron happens everyday but thankfully does not end in the same way. I get the impression this is a small school and I’m just thinking people are comfortable, relaxed and there is nothing sinister about it.

    I don’t mean this in a disrespectful manner. I am not good with words so if my statement comes across as hurtful or offensive I apologize in advance.

    I think this is being overthought with regards to wondering how she let him leave like that. It is as simple as she was comfortable with the folks around her, kids family members and the like, and she thought nothing of allowing Kyron to help someone out.

    Should she have thought about it, sure, but in that lax atmosphere where it was not noticed he was gone for so long, she was just doing like the others.

    And I do not mean this in a cruel way. I have been told I am blunt to a fault, but I do not no how else to say this. There are children who are not favored or not popular and the other kids don’t much gravitate towards them. It sometimes is the adults that pass this attitude along. It has been mentioned iirc that Kyron maybe was a bit more high maintenance and perhaps it was a relief of sorts for the adults not having him “bothering” them.

    I do not mean this in a cruel way, nor to I agree or condone such things but they are a reality.

    I hope I wasn’t offensive to anyone I was just trying to give you another perspective on events.

    If there is an emergency door in the hallway across from Room 109, imo there is, through that door, a flight of stairs going up which would lead to the door to the outside back lot. Also, the hallway across from/along Rooms 109/110 would not have any windows.

    QUESTION FOR BLINK,

    If the guy was seen going through the exit door across from Room 109, was he also seen coming out of the other door onto the back lot?

    Does the Mechanical Room also have access to this same emergency door?

    To maintain witness integrity ( I am not comfortable saying past the door they exited commenting on any further witness accounts as it would lead to the ID of the witness(s), imo)

    Not sure about the mechanical room access.

I was only commenting that not only was her decision to allow kyron to leave with sz outrageous, but the way in which she gave approval by only nodding seems equally outrageous when we are talking about the teacher to young students

    Mockingbirdsings’ post about the arsonist setting fires in the high school and never being caught and not thought to be a student sounds so much like the skill level of going undetected inside the school. It got me thinking about:
    1. what crimes would sz have likely committed before escalating to child abduction?
    2. Who were his victims?
    3. Are there any other child abduction cases with an abductor who fits the same profile as sz? (Stacey wilmoth jumps out, but I don’t think it would limited to avductions from a school)
    4. Does sz abduct from towns far from where he lives, or does he ensure he won’t (recognized by removing himself from the community?

    I think the answers to these questions would really help to narrow down the investigation, but who knows if Le can answer any of them.

Maybe that’s why TY has seemingly distanced himself during poor Desiree’s pressers. He came to terms with the reality of a SZ while Desiree and Kaine are still angry or whatever at Terri. What a stinking mess.

    I have a continuation of this piece to publish tomorrow, so in fairness, I don’t think I should comment on feedback from media and LE specifically except to repeat something that was advice from a LEA a few years ago. He said- if you choose to publish something, make 100% sure it is true, and verifiable as an investigator. You hide behind your journalist placard you will never be taken seriously again. If the intent is to progress the case, then how you do it should be clear and without blemish.

While I share your sentiments, What she did was exactly exactly what my son’s 2nd, 3rd & 4th grade teachers would’ve done in what was then the most rigorous academic el ed in the State (objective measures). And mine was the physical emotional & behavioral picture of Kyron and wouldve gone to help. Two teachers were lame (while good academically, let other detail slide) ; one was tough & controlling of detail.

    But SZ set it up for the “nod” most ELED teachers would give imo in a small trusting school. But, the school also had the toughest principal supervisor of teachers & policies & processes, including safety, of any in the State, outthinking others re detail and making sure of detail. So, SZ would never have gotten to CR109 under him to play on a trusting teacher. Signin, nametags, hall monitors, volunteers who enforce groups, no chaos.

    In fact that principal never would’ve mixed child tours with an adults visitor open house during school hours. That was the underlying problem. So I can believe it if Porter was a Fair planner.

    Your question about the use of the emergency doors. Most fire codes require emergency exits for every level of a building. This building was constructed during the late 1930′s (1938-1939) and probably occupied in the fall of 1939. Portland was a small city at that time.

    These doors were not set-up to have modern fire code equipment. Someone on staff probably opened the door to allow the children outside and propped it open with a wedge. A common practice. Some doors have a swing-up door stop to hold them open when needed.

    The school buildings where I attended were all built prior to 1930. Most of them are still in service. Our technical world was real simple until the end of WWII. These buildings have been upgraded over the years to keep them functional. Some more than others.

    We need to remember that the “Great Depression” was in progress from 1929 and extended to 1950. The country was not “poor”, it simply did not have jobs for everyone. This meant little or no money. Poor is a condition of the mind, not a condition of your purse. Communities building public schools at that time built only bare bones buildings.

But, my interp was they went out an emergency door immediately adjacent to 109 (see the drawing juts out there too) on what we’ll now agree is the West side of the school (inconformity with that arrow & quadrant, despite PPS labeling differently), and not thru the jutting out door drawing across from 109. Idk where flower planters are–on rear north or on west side out the adjacent door and on the exterior of 109/110? If Stenson saw the kids come outside to release butterflies, the west side is more likely. And if SZ turned left, he’d be at a truck on access rd whilst appearing to come out front “south” entrance.

    The door can be seen by folks inside CR109 and the term used in my interviews was “next to” CR109.

    Sorry, Kaine, parenting differences in terms of parental scrutiny & strictness, & attention to detail wrt to a kid’s needs and inputs required are the stuff of divorce, or blog disputes not of cpsd. I bet Kaine’s issue was inputs of any kind into a child’s development cost money, parental time & focus on the child as primary.
