Caylee/Casey Anthony Case: Funding For The Defense Hearing Today

While the web and blogosphere is clogged with the latest scandal to feature Tot Pop George Anthony and his nature walks of rivers and skies-

I would like to refocus efforts on a more pressing matter; the hearing on behalf of Casey Anthony regarding the indingency petition that has recently been approved through Orange County Clerk of Courts.

Justice Administrative Commission. The organization that is funded by Florida tax dollars has the biggest dog in this fight. While they do not pay for private attorney fees, they do cover investigative, administrative, travel, and expert witness costs for the defense. It is not unheard of for the JAC to fund such expenses for a murder trial, but I could not find a single comparable case where a defendant plays the indigent card 18 months into a case where they have received outside funds directly.

Note: this is an ammended petition, meaning the first petition which was filed the day of her arrest July 17th, 2008 where she stated she had an income of $1400 per month, $600 per month in expenses and $1200 in savings, is up for grabs.

My suggested aptly framed inquiry:

Miss Anthony– were you aware when you filled out your application for a handout that stealing cash from your Mother, embezzeling from the hospitalized-ederly and scamming cash from friends is not actually considered earning capacity or earned income? 

NO WAY JOSE

Are you like me?

Are we all thinking that Judge Strickland has done a fantastic job in this case so far?

Yes, he bends over backward and has endless patience for Mr. Baez et al and on occasion I grind my molars while remembering it is essential to avoid appellate issues.

I would like to implore him to stay that course. There is tremendous pressure on him to progress the due process of this case.

That said, I do NOT think the burden of this trial, and undoubtedly the second trial should be paid for by the good citizens of Florida while the defense team jets the globe on book tours or Geraldo.

 

NO OTHER COMPENSATION OR THINGS OF VALUE HAVE BEEN PAID OR ARE  ANTICIPATED TO BE PAID TO THE ATTORNEY IN THE FUTURE IN THIS CASE

According to Ms. Anthony, she was able to work her three hots and a cot fund to eek out enough cash to pay a combined $110,000 to Baez and Lyon.

Yes folks, the girl who has not been employed since 2006 has developed a penchant for earning a living.

EXCEPT:

You have got to be half crikey to believe this girl has only paid out $110K in fees. If that is accurate, then someone else is bankrolling an accused baby murderer and that will need to be disclosed. Mr. Baez got “by” by allegedly disclosing the source of his fee payments during the in camera portion of the States Motion regarding a potential conflict of interest on his behalf last March. 

Since then, one of Casey’s lawyers, Todd Macaluso, who had a seperate retainer agreement with her according to his own pro hac vice, has had to leave the team due to his issues of comingling client trust accounts.

Jose Baez is now asking for help with “costs” from the State.

I say, if you want the state to pay you, you need to disclose the amount of cash BOTH you and your client received from ALL sources of income, a review of your Quicken outlining specific expense allocations and billable hours and then answers to the following: 

If Casey, through affidavit, is stating she paid only two lawyers, in total, on this case in the last 18 months, how were the following legal resources outside of The Baez Law Firm compensated for their work to date?

“I would venture to believe that they are going to require Jose to disclose what monies he’s received because that becomes an issue at hand,” Lenamon said.

“[Baez's] got a responsibility going into this case of making sure that he maximizes his money that’s being spent. If he didn’t do that, then the judge is going to hold him accountable to that.”

 

Mike Walsh

Michael Walsh, one of Anthony’s attorneys, told FOX News on Tuesday that she initially had not been forthcoming with the timeline of Caylee’s disappearance because the babysitter had made threats and Anthony feared for her daughter’s safety.

KASEN: We had filed a motion probably two months ago, a motion to either stay or defer the civil matter until the resolution of the criminal case. Judge Gonzalez, for whatever the reason, or it should be Judge Rodriguez I apologize — for whatever the reason denied the request and allowed the lawyers for Zenaida Gonzales to submit written questions in lieu of a deposition.

“The person who seemed to be so guilty — it turns out he was innocent,” Linda Kenney Baden told NBC News in a report that aired Friday on TODAY.

“There is substantial evidence … that the body or the remains of Caylee Anthony were placed there after Casey Anthony was locked up in the Orange County correctional facility. … And that proves her innocence.”

Let`s go to Dr. Lawrence Kobilinsky, famed forensic scientist out of the John Jay College of Criminal Justice. He is a consultant on the Casey Anthony defense team. You heard what Lee had to say about Oak Ridge Laboratories, the Body Farm. Do you agree or disagree?

 

Dr. Kathy Reichs

“Given that there’s no evidence as to the cause of death, … you could have an accidental death and a mother that panics,” she told King. “There are alternative explanations.”

 

Marti Mackenzie

“I am happy I could be of help in the months I worked as the media representative,” she said. “The most important thing is that we made a clean transition so that the coverage on this will have a point person on the defense team.”

 

On a lighter note, You will be glad to know The BAEZ LAW FIRM cut Casey a break on the fraud charge by not biling her.  Although, that makes no sense in itself because Mr. Baez paid $664.25  full restitution on Casey’s behalf via money order to Bank of America on July 15, 2009.. From what account?

I swear I think she thinks she is one of the Attorneys. For example; did you see her pushing the button so no one could hear the conversation going on at the defense table. I’m now concerened she might have a chance with this new attorney. I really believe that if she gets out and has another kid, she will do this again.

    No chance of aquittal. Plea, possible.

    If a note was passed to Casey, I would imagine it had birthday “thoughts” since tomorrow is her birthday…at least I imagine her parents would try to get such a sentiment to her since they do not visit her in jail.

    I know I’m in the minority, but I’m glad Mr. Cheney didn’t let Casey answer the question. Blink has expressed her confidence in him, so I believe. I don’t think Mr. Cheney is going to let Casey screw up. I think he is tired of this case being fiddle-farted around just like the rest of us. Casey doesn’t know what money she has. She only knows she has enough money to buy her little snackies from the snack bar. Casey only knows what the Dip-sheets tell her. Mr. Cheney is very good at what he does. Casey needs someone very good because with what she had I think we were looking at a mistrial for sure. Baez doesn’t know doodoo, or as our good friend Chica so elegantly put it “full of caca alias poop chit.”

    I see a real problem with the justice system in FL and in other states as well, including my own here in IL. As far as being declared indigent, there needs to be a law that IF you’ve paid any money towards a defense atty then one cannot claim indigency later or make it law that to be declared indigent it must be claimed within a certain amt of time after arrest. This case is setting the stage for a lot of appeals from other convicted criminals who will possibly claim that the have not received the same amt out money for their defense which may have resulted in a not guilty conviction. I was and I’m still livid after watching the court hearing today. Everyone on the defense side smiling and giggling like little school yard bullies. What gets me is they bring on this high profile atty, but yet she’s claiming to be indigent…BS. How does she keep getting these atty’s??

    TIA. Judge Strickland has to have foremost in his mind the fact that he doesn’t want to have a reversal on appeal because Casey successfully argues that she didn’t have effective representation because she couldn’t afford the attorneys or the expertise that could have exonerated her. But he also has to be mindful of the defense’s propensity for obfuscation, not being aware of what was required and half answers. He should declare her indigent but should also impose a lien in favor of the state on the proceeds of any book, video, web or photo deal received by Casey, her family or any member of the defense team for 10 years after the conclusion of the trial

    The part that upset me the most was outside the courthouse where Mr. Mason was talking to reporters… He told reporters he joined this defense and didn’t retire “because it is fun”. I was sick to my stomach, it shows why he is here, it’s a game to him, high profile case, fun! He can back track or choose different wording in the future but he let out why he joined.. Well there is nothing Fun about defending someone who is accused of murdering an innocent 2 yr. old Caylee Marie Anthony. Very sad….what a circus atmosphere, soo soo sad for Caylee…

    I knew we were in for a ride when all the defense attorneys had to find a place to huddle, mid hearing, to get their lie, er, stories straight. Im mean, Blink, WHO DOES THAT? I was wishing Strickland would order Baez to get his rear back to his office and reappear with all paperwork in 1 hour or be held in contempt. How much more leeway is the Judge going to give these idiots?     I assure you that after going through multiple murder trials – my son was murdered – I do understand the nonchalance I see here – but what saddens me is that there is no one behind the prosecutors – in my son’s case there was always two of us for every hearing (30 hearings at least over 4 years with 3 different trials) – but usually at least 10 of us at the minimum – I am sending special prayers up to my own angel to look over this special Caylee angel

    Dunno why a guard would do that but many things happen in jails and prisons at the hands of guards. I mean we see women in prison get pregnant(isolated incidents?)
    We know it was no imaculate conception( and you dont get pregnant from kissing) and for sure you dont get pregnant if you sleep with lesbians so therefore there are good guards/bad guards. But I can betcha it wont be happening anymore no more notes going back and forth. I dont like caseys attitude in court she was about to bust a huge giggle like someone dying to pass gas and couldnt hold it thats how she acted grrrr.

    What is the point of having them state there is no current deal in the works? All that means to me is there is no paperwork proving it is so at this time. What is to stop there from being a deal right after the trial concludes? What is to stop them raking in cash from this in the future, after they have used the state’s funds for the trial? There is no way any of these people would be doing this if they did not see a payout at some point.

    And how do you show up for a hearing about finances without any exact numbers or documentation?

    So strange how Casey was gleefully rubbing her hands together. At first she looked scared and jumpy but at a certain point she began to grin like the cat that had the canary, when the lawyers went up to talk with the judge.

    If she were to get a public defender – the state would have to pay for attorney fees AND costs.

    What galls me about all this is that these lawyers are in this for ONE thing only – and that is the EXPOSURE they get – which will afford them future business.

    What seems to have been lost here is that we have a precious, innocent, beautiful little girl who has lost her life and whose life was taken by the person they are defending. What INNOCENT mother wouldn’t take a polygraph in order to advance the investigation UNLESS there is something to HIDE???

    And, the thought of making oneself FAMOUS with this knowledge in mind makes my blood boil and angers me at the INJUSTICE of this justice system.

    IMO they should have NEVER give her any money!! Especially since it has not yet been proven that she is innocent, and until they actually saw the snowball in hell, they should have not offered her anything.
    You kill your kid (maybe…for those still in lala land) and someone gives you 200.000, yeah that seems morally correct.
    I have to tell you I saw the movie “zeitgeist” which is huge here in Europe for obvious reasons, and this just brings to me the sad truth that TV rules our life with absolutely no ethics and morals. They feed us any crap they want and they will collect that crap with no reservations. Sad…

    I wonder what it is that Baez says to these high-profile lawyers and experts that makes them want to be on this case. These people are well known in their fields, most likely have nice bank accounts. What is it about this particular case that makes them agree to work with Baez?

    I also find it interesting that if you look on the state side of the courtroom, there are 3 attorneys sitting at the table. Then you look at poor indigent Casey’s side of the room, she’s got a fleet of back-up from the defense table to the row behind them to the row even behind that one! She’s totally surrounded by her “peeps”. She certainly seems to love that attention, doesn’t she? Unless I missed something yesterday, she didn’t even bother to look for her parents in the gallery. She doesn’t need them anymore, she’s used them up and has moved on to her own people who’s sole purpose it is is to get her out of this problem. She’s in her glory right now. The look on her face yesterday said it all. Look at me everybody. I’m as giddy as a school girl with my first crush. I can barely contain myself — even here in a courtroom because some people think I killed that “little girl”. I’m famous, and I have no problem sitting here smiling, laughing and just being important. ugh

    Sometimes I just want to scream, this is so outrageous, if it wasn’t for the tragic death of this innocent beautiful baby, this would be a comedy, and that is what outrages so many people, I know why I am outraged, it is because if and when Ms. Anthony is found guilty and it is time for sentencing, who is going to give the Victim Impact Statement, not one FAMDAMLY Member I can tell you that…. so WHO????? That above and beyond anything else, other than this child’s murder, makes me sick.

    I made another observation yesterday while watching Mason doing his “I’m an old deaf country boy” routine. He was calling everyone — especially the state — by their first names. It was a little off-putting to me, and something that hasn’t been done in this case at all. When the attorneys were all up at the bench talking with the Judge, and Mason had called LDB “Linda”, she stated to the Judge that they all had last names. The Judge told her that it was OK to use their first names right now, but that they would use last names during the actual trial.

    As much as I like Judge STrickland, I’m not crazy about him letting Mason get away with that on his first day out of the box. If he’s going to be that lenient and allow Mason to call everyone by their first names (when it’s obvious that LDB didn’t like it), how much more is he going to give because Mason is an old-timer? I would have had more respect for the Judge if he would have told Mason right then and there that in his courtroom people are called by their professional names. i.e, Ms. Drane-Burdick — NOT Linda.
