Caylee/Casey Anthony Case: Judge Strickland Steps Down

Orlando, FL–  The Honorable Stan Strickland has recused himself at the request of the defense team, anchored by THE BAEZ LAW FIRM and recent roster addition, J Cheney Mason.

The original request contained a notarization by Mr. Mason which was found to be expired and a corrected motion with a current seal was subsequently submitted. (insert Pavlov giggle)

In a motion filed  last Friday at the usual witching hour the defense seems to prefer; Strickland was asked to disqualify himself due to his well wishes for a recently hospitalized blogger covering the Casey Anthony case.

Marinade Dave agreed to meet with the defense Private Investigator, Jeremiah Lyon, voluntarily on Sunday April 11, 2010.

During Mr. Marinade’s interview, he revealed that Judge Strickland called him following a recent health issue to check on his well being.

His reply of “ Well if I were any better I would be cruising down the Hudson with a shirtless Geraldo..” raised a flag apparently. 

(editors note: That is what we call a dramatic license/ensuing mini-vomit combo. Sorry. Shirtless Geraldo deserves that. Dave said no such thing)

RumpleBaezCaseyMr. Baez can pass verbal/handwritten shanks back and forth for Casey Anthony and her family and think he can operate outside of the regulations of the Florida Bar; that’s fine.

In defense of the FBA, they tried to wash their hands of him in the eight years preceding his admission.

Mr. Baez can task his client, Casey Anthony, with attempting to spin her duct tape into gold for endless days and nights until he runs out of Vitalis.

It will change nothing.

What he has never understood from the beginning of this case is that everyone already knows his name starts with Rump.

Personally, I would like a poll from the ENTIRE defense team, as to who thinks a *do-over* is a good idea in this case.

If ever there were a be-careful-what-you-wish-for scenario, this is it.

Let’s start with Ms. Lyon, who is curiously absent from the motion.

Never mind.

In recalling her comments to the lunch crowd at the seedy soiree she refers to all judges as “ugly in the room, “ I think that her exclusion was tactical. 

That sentiment might be particularly offensive to Belvin Perry, Sr.

Mr. Perry is the high-school educated Father of the recently appointed judge to replace Strickland, The Honorable Belvin Perry, Jr.

Mr. Perry, Sr, retired from the Orlando Police Department after 25 years of decorated service.

Mr and  Mrs. Belvin raised 4 children who grew up to be a school principal, business owner, surgeon, and now, a judge that will preside over one of the most famous murder cases in recent history.

The Honorable Belvin Perry, Jr will preside over this case to it’s conclusion.  

 

 

I am feeling comfortable it is unlikely His Honor will be open to any attempts at police pulverizations that are undoubtedly part of the defense strategy; should this case every actually be scheduled for trial.  

I am feeling if Judge Strickland wants to try his hand in the blogesphere, I am in full support.

His response motion was snarktastic.

    I am lazy, and need to get busy with other stuff today, so I am pasting part of my comment from Hinky here. Glad to see up up and running again Blink.

    I’m sure there was some congratulatory puffing and good ol’ boy back slapping over at the defense camp yesterday.

    They won, but now EVERY judge knows the underhanded manner in which they accomplished this goal. Not supplying this judge with a courtesy copy of the motion, filing it at the end of the day on a Friday and passing it along to select “pet” media, first, before the judge saw it.
    (Baez will highlight that further if he proceeds with a complaint)

    Classy.

    If there was any way to herald in an announcement of your disrespect for the court, this was the way to accomplish it. Any judge who is seated is going to watch his/her back. I don’t think that there is any way possible that a new judge will be “laid back” in this court room again.

    And at the end of the day, Casey Anthony still didn’t report her child missing, and Caylee is dead. And Casey Anthony isn’t particularly bothered by that and even said so. A new judge can’t change that.

    I am sorry to see Judge Strickland go..he always bent over backwards to be fair to the defense. What a class act Stan is and I love the way he got his final dig in to Baez.

    Now we will see some new court room rules set…no gum chewing, no playing with the Blackberry, no water bottles, and no storming out George because you don’t like what is being said. The A’s will have to mind their P’s & Q’s.

    Judge Perry presided over the Grand Jury hearing that put Casey in the position she is in now. Judge Perry assigned judges to both the criminal case and civil case in Anthony’s name. Yes folks he is up to speed on both cases.

    He also is not shy about doling out the DP in court..and is not shy about letting the defendant know that they have crossed the line in our society when they murder someone.

    Baez and friends…you just made a huge error..you got what you wished for..only it is going to bite you in the butt.

    It would be a complaint filed against a Judge, to be heard by them, and has no attachment to the Supreme Court or Federal judges.

    No one on the defense missed the comment, remember they had those students along too, weren’t there two of them sitting in the gallery that day behind the defense table? How could they miss that audio at the end on replay if nothing else.

    One of the Orlando media sources, however, played into Baez’s tactic by stating that the defense only learned about it in their PI’s interview with Dave!!! Imagine– like they sent the PI to gather info on John Allen and etc! They sent the PI for the specific purpose and knew about this long ago, certainly didn’t learn about it in the PI’s report.

    (think that was a WESH comment, but needs a double check– it’s just a plain lie by the defense to tell it that way)

    I have the highest respect for Dave. He was highjacked by the defense with his posts taken out of context and thrown under the bus. I have been reading at Marinades for a while and he has ALWAYS tried to post both sides and has always tried to be fair and balanced to the Anthony’s. He is not an Anthony lover but an Anthony reporter and blogger. I will continue to participate in his site.

    Blink, there was someone on Dave’s sight that had a negative post about you and gave your real? name etc.

    As far a I am concerned, you and Dave tell it like it is to the best of your abilities, and I am proud of you both. That Caylee and other victims have a voice. THIS WILL BACKFIRE ON THE DEFENSE.

    Dave’s site is moderated, why would he let that through? I certainly would not.

    I have not read it nor will I, I am aware of the cyberstalker as are others monitoring their activity.

    I see Baez as one desperate SOB….He has NOW got rid of JUDGE Strickland. Could ne the biggest mistake he has made to date……Time will tell. How many times can Baez try to get a new judge? This trial has dragged out long enough. No clue why. What ever happened to a speedy trial? If Casey is oh so innoncent, they why drag this on. The forensic proof is all in. Should have been poured over and over. What exactly is the hold up? Caylee is NOT gonna walk out of woods screaming “here I am”….Why are they really waiting until next year? And all the while the State of Flordia picking up the tab….Yeah call this justice? I am sure Baez wavied the speedy trial thing. what is the real reason they are waiting until next year? Hoping is all the media attention dies down? How much is it costing taxpayers of Flordia to keep her in JAIL? This whole thing is a joke! Maybe Baez figures the longer he drags this out the better chance Casey will found NOT GUILTY?

    Infighting amongst bloggers is just what the defense wants– distraction from the real issues. I also think there can be a withholding of personal attack, it serves no purpose now, if it ever did.

    Oh, and all those new motions ‘filed’ by the defense as reported by the MSM and that are fully published by cfnews13?? None of those motions has yet shown up in the OS clerk’s site and none will be in the form as supplied to the news stations, who only got incomplete, unsigned, uncertified as delivered anywhere, undated. Well, to be fair, Andrea Lyon has signed them, but the signature lines for Mason and Baez are empty although the motions are said to be brought forth by all three named lawyers.

    Who’s to say that Cheney won’t take a read of those and find something to change, delete, add, in the body of the motion, and also, the motions will have to be redone addressed to Judge Perry. Andrea Lyon had apparently expected Judge Strickland to stay on board as she had prepared and signed the motions written to his court.

    So it does appear that Ms. Lyon intends to stay on the case through all of these motions, she is the ONLY one who has signed them to date (although that may change as the documents are edited to reflect the recent changes in the court– once this happens and the docs are actually filed, the question remains, will Ms. Lyon’s name still be on the motion and will her team ask for her signature as undersigned counsel for Ms. Anthony?

    That will tell whether Ms. Lyon is still an attorney for Casey Anthony, as surely, if she re-signs these four motions if needed to update them with change of judge and division, she will want to be in court to argue for each, especially one would think, for the penalty phase issues.

    Will she or won’t she? I’m betting that Andrea Lyon will remain in the wings as an advisor and to reaappear for the DP motions and to participate in the penalty phase. (who else holds Casey’s arm so well– not to diminish the need of this role, it’s probably critical to maintain the client’s composure and Ms. Lyon has the ability to do that more than Baez or Mr. Cheney Sanders.

    I also read those comments. I think maybe one of MD’s bloggers was moderating the site and felt compelled to post the comment in retaliation for perceived insults. There are two commenters on his site who are known to everyone because their emails to Dom Casey have been released. This was one of the two.

    I think the defense tactics are despicable but they are getting their intended results, for now. They are delaying the trial. They are inundating the court with motions. They are destroying anyone who can prevent an appaeal or acquittal.

    Blink, I truly believe that the 5 or 6 posters for KC that go from site to site are trying to close you, MD and others down. On the unmoderated sites, they are constantly belittling any site that doesn’t support their numerous BS theories or can refute them. Please don’t let them discourage or dissuade you. You are doing a great job that needs to be done. It is the very least that Caylee deserves.

    It never ceases to amaze me how some, even as adults, do not understand the difference between good and bad attention. I am personally asking Santa to bring their weenie whistle this year.

    Blink, today Robin Sax has an article on CBS CRIMESIDER, maybe you can pass along the information that there is some misinformation about the chloroform reference in the ‘letters’ as Ms. Sax reports that this is big for the prosectution. And we know that there was NO reference to chloroform in those letters, nor even the chemical name recounted by the jail friends conversations in their discussions with investigators. (vs the overview stated in the report by Yuri Melich which seems to have caused the confusion.)

    Robin Sax quote from the article:

    Some of the disclosures are terrific for the prosecution; for instance, the claim that she would sometimes use drugs including chloroform to get her daughter to sleep. Chloroform could be a key piece of the prosecution’s case.”

    Oops… NOT in the letters, it’s NOT! Maybe Ms. Sax wrote this article from the sherriff’s report only and didn’t review the article before today’s publication once the mistake was known and reported in the media soon after that doc dump occurred. Instead, won’t the defense have a hay day with the ‘Yuri Melich lied or made a mistake about chloroform’ in his report???

    Can any one answer if Strickland’s departure means that we have to start over completely? Or just that it sets up things for appeals?

    I am just trying to understand what this means- other than Jose and company have a screw loose- I thought the judge was very fair in rulings.

    I know at the very least Casey will be sitting in jail much longer waiting for her day in court- Poor innocent young mother that she is…

    As always, I stand firmly for the redemption of Caylee Anthony’s murder and never want to obfuscate that with rash verbiage.

    Those who work quietly and steadfastly, without any desire for fame or popularity, are secure in their abilities and are passionate about prosecuting the person responsible for the death of an “innocent.”
    Blink, I count you among that worthy group.

    I’m very sorry that MD was so flattered by his association with the Honorable Stan Strickland. It is truly Dave’s fault and he will be at the source of appeal after appeal. However, the justice wheels will grind surely and steadily to reveal the ultimate culpability. I am confident in this.

    Judge Strickland, you are a fair judge and it has been a pleasure watching you in your courtroom. The way you gave each motion the defense came up with more than the attention it deserved is nothing I have ever seen before. I will retain good thoughts of you and you will be in my prayers, you are a blessing to our judicial system and a model of fairness.

    Caylee, God is putting your case in Judge Perry’s hands. God does not make mistakes. You will get the justice you so truly deserve. Run and play with the angels, you are finally free.

    To all that love Caylee and want to see justice, the defense is trying to use a divide and conquer strategy. I would like to see Strategy: Fail. They are trying to break up the multitude of Caylee supporters and have them fighting each other. We need to stay focused on this little child and make sure there is justice for her and the brutal way she was murdered. Do not let the defense knock you off course. Unite and stay on the path and stay strong for the only one who matters in this case and that is Caylee.

    Please realize that nothing has changed. Baez is a buffoon and will remain a buffoon. He is for all intents and purposes the lead buffoon for the defense. The judge will continue to be fair and impartial and will have the defense and the Anthony family hopping to his tune in no time. KC will remain self-centered and will continue to be her own worst enemy in this case. That last statement was hard considering that her Mom came in as a close second for worst enemy. The Anthony family will continue to hang themselves with everything they say and do.

    Justice will prevail, Caylee has the ears of the angels now. Her voice has united with theirs and ours in a cry to heaven for justice.

    Rest in God’s arms and frolic with the angels, Caylee, your play on earth was cut way too short.

    I think the defense is starting to pull out all the stops now for 2 reasons.

    The first reason is that the Prosecution hit their bullseye over the last couple of weeks with the River/George saga, the penpal letters of Robyns, the LE interview of Robyn, the phone calls of Robyn, the interview of Maya and all the other a$$clown things Casey and her family have done. They needed to launch a counter attack..this time on the judge.

    Secondly, being a DP case, they will file motions until there are no more to file..no matter how poorly written they are or not. That happens in most DP cases. Now that Stan has recused himself..they are left with the ability to refile every motion he did not grant o the defense. Don’t think that will work because I think Perry knows all about this case frrom start to finish.

    What the defense needs to be working on is the civil trial..a lot of damage can be done there..and will be done. Morgan is gonna take ole Mason, Lyons and Baez on the roller coaster of law. Fasten your seat belts..May is just around the corner..and it’s gonna be turbulant.

    What I meant was they didnt say anything about it in the 10 days time, from when it happened . So my thought was they wouldnt be able to bring it up months later —- had dave not given the interview to the PI and then have that be within 10 days – they would have missed the opportunity to bring a complaint forward from 6 months ago

    Blink, While I do Love this article, I think it’s time we all do what the defense does not want us to do. Let’s let Dave and Judge Strickland “rest in peace” and let’s annoy the hell out of the defense by talking about the murder, the letters, the “friends” who gave interviews, the remarks Cheney made in the beginning of this case, and anything else anyone can think of. If they (the defense)did indeed start this BS with Judge Strickland, just to keep us from talking about the other, then we need to talk about the other. Let’s let every bit of this backfire in their faces.

    A 1969 study by Dr. Phillip Resnick, the “father” of maternal filicide (the murder of a child by a parent), found that while mothers convicted of murdering their children were hospitalized 68 percent of the time and imprisoned 27 percent of the time, fathers convicted of killing their children were sentenced to prison or executed 72 percent of the time and hospitalized only 14 percent of the time.

    The motion did not specify what “different” meant. I guess it means women are treated more lenient because they get medical help and men get LWOP or death.

    These latest motions appear to be a last ditch effort by Lyon to see if any of it sticks with an incoming judge. Presumptively these motions were already drafted and ready with the anticipation Strickland would recuse. I say more noise.

    Why do I have a feeling that Mason may be dancing alone if this ever goes to trial?

    Susan2 #41: I’m with you. I’m carrying over what I posted last evening; it was in the last Casey thread and I had posted it just before Blink wrote her new article. But it seems germane to the conversation here.

I am a big fan of Judge Strickland. But I believe these are more circus antics from the defense to divert our attention from Casey Anthony. More and more I’m feeling shades of the OJ Simpson trial and I want to see all of us not allow them to turn it into such a spectacle.

    A baby was murdered, and regardless of who presides over this case, Ms. Anthony remains the accused.”

    As for fresh discussion, I’m very curious about what the SA office is up to now with respect to the revelations in Casey’s jailhouse letters. I think those letters are going to be so damaging when a jury gets to read them as they affirm Casey’s lack of remorse and concern for her daughter, even in the ensuing months following Caylee’s “disappearance”. Her immediate forgiveness of “Zany” (I noted she spelled it with one “n”) and her continued apparent lack of concern about where Caylee might is startling. Remember, some of those letters were in her early days of incarceration and before Caylee’s body had been found. It will be interesting how the SA uses this information and frames it for the trial.

    I am not positive those letters will make the trial cut..

    I am so sorry for your loss. Nothing I can say will help and wish I could be there to clean house, do laundry, cook your family a meal, whatever is needed but I’m all the way in FL. Will keep you in my prayers.

    I have to be naughty and do what was told not to do…but why would a ‘friend’ go to another sight not favoring us and say not horrible things about Blink but not very favorable things either? It just upset my small mind and I’m moving on. Just don’t like anything negative bout my Blink. I guess I’m just a ride or die friend!

    Does the new judge have any history with Baez? Kleat I know you can answer that for me. TIA Won’t it be wonderful if cutting Strickland loose was the worst thing Bozo ever did?! I hope the one appointed now racks his balls every time he tries to speak or object in court.
