Caylee/Casey Anthony Case: AND THE FIRST BLINK DARWIN AWARD GOES TO…… JOSE BAEZ

I freely admit I have caught many a fly in my trache while my yap was left hanging open at some of the legal filings by Jose Baez et al, in this case.
The latest motion to suppress the recorded conversation between convicted felon and “lifer” Robin Lunceford and Jose Baez has insipred the first ever Blink Darwin Award, or, THE BLARWIN.
In his Motion for a protective order to keep the call out of discovery, Esteemed Blarwin recipient, Jose Baez, claims he did not know his conversation was being recorded, and apparently, what type of phone line was being used although he states the call was transferred to his cell phone.

Pun intended. It would be impossible for him to be unaware that Lunceford was not calling from the Lowell Annex. As Baez is aware, inmates at Lowell Annex MUST have the number they are calling on an approved list in advance AND they may only call collect. From Lowell Annex Rules:
Incoming telephone calls for offenders will not be accepted. In the event of family emergency (such as serious illness or death in the family) you may contact the chaplain’s office. The chaplain will notify the offender.
Offenders, except those in administrative confinement, disciplinary confinement, close management or on death row are allowed to make collect telephone calls. Offenders are allowed to place up to 10 telephone numbers on their authorized phone list. If the offender has not placed your number on the list, he or she cannot call you.
Offenders can change their phone list every six months. There are two exceptions to this policy: < ?xml:namespace prefix =”" o />
- If someone already on the list changes his or her phone number, the offender can have the new number placed on the list.
- If an offender gets married, he or she can have the spouse added to the list.
All telephone calls are limited to 10 minutes and are subject to monitoring (except legal counsel).
Of course we all know that correctional facilities cannot monitor calls between inmates and their counsel. Ms. Lunceford is not represented by Mr. Baez, and if he were interviewing her as a prospective witness as he states, he knows full well he needs to pack the car and head on over to Ms. Lunceford’s pad after requesting the visitation officially.
If the first few meatless morsels of the motion don’t grab ya, I offer my personal fave. “It is a felony”. I have news for you Mr. Baez, the State has already listened to it. This would be how it is DISCOVERABLE, or subject to discovery in the first place.
Now, you know Jose copied and pasted some of the States own verbiage from the motion regarding Joe Jordan’s snafu. A surreptitious recording in a two way notification state is not even in the same zip code as a collect call from jail with NO EXPECTATION OF PRIVACY.
Is it me or does anyone else think this was an attempt at circumventing rules at the Pokey Mr. Baez is so famous for?
You know, the ole “Im willing to have her call me collect, bein’ that I’m on the list.. I will transfer the call to you-
-signed, unknown caller to unknown number sometime in early May.
HINT: If you want to claim something is work product you might not want to disclose portions of it in your motion. It just *Might* give the appearance you don’t want the recording out but want to make an accusation publicly that favors your client.
Bottom Line: An inmate placed a collect call, subject to the rules of the facility in which she is incarcerated. As dictated by protocol, the call was monitored and is therefore subject to public release. I for one, look forward to hearing it.
After all, it did earn a Blarwin, and I was saving that all year.

I would guess that if they are going to use ‘sex abuse’ as any part of the defense that they would want to make sure casey can pull the “story” off. She wasn’t a very good liar in any other area, so what makes them think she could develop this “story”. Sticking to a sex abuse claim in cross would be very difficult if the entire thing is made up. Especially since casey can’t seem to foster any real emotions. Just the (stick my finger in my eye and wipe and wipe until a tear produces) crap that she’s been pulling. I also think Mason has been a complete disappointment. Me thinks that no one is very happy with Mason’s showing thus far. He is a bumbling fool in court and seems to be a liability in front of the media. Baez must want a re-do for his sidekick, since he obviously can’t control Mason’s mouth. I can’t imagine another DP qualified lawyer going into the case at this point, PRO BONO, if that new attorney doesn’t feel that he will take the “lead” in the case.
By the way, let’s start a new trend. I am purposefully spelling casey’s name in lower case. I won’t start name calling, but I feel that she doesn’t deserve the respect of a proper name and should start feeling the impact of being an inmate. Not the ‘celebrity’ status she feels she has garnered. May be a silly little thing, but I want to denounce her existance as a human being. She has already done this with her actions anyway.
Also, I’m not an attorney, but I did stay at a Holiday Inn Express last nite. LOL
But – for any plea deal that I’ve heard of… and I would think especially in a high profile murder trial, casey would have to allocute. Complete and full disclosure of what she did, why she did it AND it would have to be accurate to the forensic evidence.
I just don’t see casey doing this. She is too much of a social chameleon that craves approval and attention from those around her. She conforms to their hobbies, their beliefs. She becomes what they want in a friend/companion to get their approval, affection and to use them for whatever she can get. She knows that in general population (which is where I think she’d go on a LWOP sentance) she wouldn’t fair well if she openly admits to killing her child and discarding poor Caylee’s body in such a vicious manner. casey would get her A@# kicked weekly. If casey is convicted she can always play the “appellate” card, “I was framed just like you guys”.
I just think she is too narcissistic to ever plea.
But for our beleaguered State, I hate to see this circus go to trial.

Blink I am interested in what you think about the defense pinning this on George, I noticed that Dr. Gold a doctor that specializies in sexual abuse cases visited Casey in jail, the writing is on the wall don’t you think. How low will they sink, I don’t think Casey would hesitate for a second to let one of her family members go to jail for her, if you are capable of committing murder to a toddler then something like trying to blame your father for a crime he didn’t commit is really nothing.

AOL News (July 26) — The attorney representing Casey Anthony, the Florida mother accused of killing her 2-year-old daughter, Caylee, is lashing out at a group of unidentified bloggers for allegedly lifting and republishing his Facebook photos.
“I had to take all of my copyrighted photos down from my FB,” attorney Jose Baez wrote on his Facebook page, “because it has come to my attention that certain bloggers were taking these photos without authorization and posting them on their websites.”
Baez did not respond to a request from AOL News seeking comment. However, some in the blogosphere have speculated that his action may be related to a recent photo parody on the website BLINK ON CRIME.

Humble shared it with me earlier. I’m thinking of sending him a pacifier for Christmas. Who copyrights their photos on facebook? Who doesn’t set it to private if they don’t want to share their photos? Why in God’s name would he be crying foul now, after all of the hundreds and thousands of parodies that have been done with his photos over the last 2 years? I’m beginning to think time will stop if he ever decides to just do his job and defend his client. LOL!!! What a piece of work!

I really don’t see how Baez keeps getting to stay on this case. Even Mason’s departure smacks of discontent within the defense, which at this point is him and JB. JB is NOT DP qualified yet all the lawyers who are eligible appear to have had to take a backseat to his musical chair game. Is it what the law had in mind, that you’re prevented from trying a case because you’re not equipped, but when you have more seasoned co counsel, ignore them and proceed as if they’re not there????

Chica, I’m sorry. I didn’t see your questions until today as I’ve been away for a couple days. I’ve read all your comments for more than a year now and I know that we share the same love for Caylee and the same frustration and anger towards her family and Casey’s defense. I know. It’s the first time I’ve felt emotionally attached to a horror like this one, too. We’ll have some satisfaction once the murderer has been dealt with but nothing will ever make it even. Not even close. The best we can hope for is she (Casey) never have another opportunity to bring another innocent baby into the world. And we will have to be satisfied with that even though it really is not enough.

Anyone know where I can read a synopsis of the Caylee Anthony Case (note I didn’t use the ‘casey anthony’ term)! My daughter is intrigued as to why I am forever lurking on Blinkoncrime and having given her the gist of the case, she would like to continue following it. However, without some background reading, this could be difficult so would appreciate any link that would enable her to play catch-up quickly and I will direct her to Blinks input. We are in the UK and don’t get any media coverage but as I spend months at a time in Florida, I have been on the case since the beginning but I’m sure someone has precis’d the history to date. Thanks.

I am as guilty as Jose et al, and the Anthony’s, at attempting to control events.
It is my vehicle to do so by using verifiable facts and research to support same, and I do not get paid for it, but I openly admit my intention.
This bambinas little voice- so loving and trusting, I heard in my office 2 years ago, on FNC, stopped me in my tracks.
It continues to gnaw at my soul that this child has not meant enough to anyone in her family to do right by her.
I fear I will never understand it. More than that, I fear her case, excuse me, her murder, will be a benchmark defense to others. That’s how this works people.

Looks like in his quest to be a celebrity, he proudly showcased his outings and pics of himself hobnobbing with his pals, to prove his ascent up the social ladder. His dream, his insatiable desire for status, is his Achilles heel every time. He wants public attention he got it.
Unfortunately, as usual, he doesn’t know the law, he shoots off his crybaby mouth and ends up looking like a fool. Singlehandedly, he has destroyed respect for attys across the US. He really is a hack in nice suits, coincidently purchased with dirty money. He may have slithered out of outright of an ill gotten gain charge but he was the conduit for the sale of Caylee’s pictures by his accused client. Dirty, in my book.
He has already made his mark, and it’s not for being “the first Hispanic blah,blah,yadda,yadda”. He is the star in hundreds of parodies on YouTube and the subject of countless spoofs in print, which give a humorous accounting of his infinite blunders and his grating personality.
Seems like we’ve said it before but it’s still true. Be careful what you wish for, Mr. Baez.
Even in his motions and media blitzes Baez can’t get it right.

Like the deaths of Pres. Kennedy, Elvis, Princess Diana, I know exactly where I was when hearing the news. Like you, Blink, I was stopped in my tracks by the voice of beautiful little Caylee singing whilst turning a book round and round; right there on my television screen 2 years ago. I was heartbroken, first at her disappearance and later when my worst fears were realised and the remains of her poor little body were discovered. I thank you from the bottom of my heart for your hard work Blink, although sometimes I must admit, I don’t always ‘get it’ when you use certain expressions – I guess it’s the differences in language from across the pond.
