Caylee/Casey Anthony Case: AND THE FIRST BLINK DARWIN AWARD GOES TO…… JOSE BAEZ

I freely admit I have caught many a fly in my trache while my yap was left hanging open at some of the legal filings by Jose Baez et al, in this case.

The latest motion to suppress the recorded conversation between convicted felon and “lifer” Robin Lunceford and Jose Baez has insipred the first ever Blink Darwin Award, or, THE BLARWIN.

In his Motion for a protective order to keep the call out of discovery, Esteemed Blarwin recipient, Jose Baez, claims he did not know his conversation was being recorded, and apparently, what type of phone line was being used although he states the call was transferred to his cell phone.

Pun intended. It would be impossible for him to be unaware that Lunceford was not calling from the Lowell Annex. As Baez is aware, inmates at Lowell Annex MUST have the number they are calling on an approved list in advance AND they may only call collect. From Lowell Annex Rules:

Incoming telephone calls for offenders will not be accepted. In the event of family emergency (such as serious illness or death in the family) you may contact the chaplain’s office. The chaplain will notify the offender.

Offenders, except those in administrative confinement, disciplinary confinement, close management or on death row are allowed to make collect telephone calls. Offenders are allowed to place up to 10 telephone numbers on their authorized phone list. If the offender has not placed your number on the list, he or she cannot call you.

Offenders can change their phone list every six months. There are two exceptions to this policy: < ?xml:namespace prefix =”" o />

  1. If someone already on the list changes his or her phone number, the offender can have the new number placed on the list.
  2. If an offender gets married, he or she can have the spouse added to the list.

All telephone calls are limited to 10 minutes and are subject to monitoring (except legal counsel).


Of course we all know that correctional facilities cannot monitor calls between inmates and their counsel.  Ms. Lunceford is not represented by Mr. Baez, and if he were interviewing her as a prospective witness as he states, he knows full well he needs to pack the car and head on over to Ms. Lunceford’s pad after requesting the visitation officially.

If the first few meatless morsels of the motion don’t grab ya, I offer my personal fave. “It is a felony”. I have news for you Mr. Baez, the State has already listened to it. This would be how it is DISCOVERABLE, or subject to discovery in the first place.

Now, you know Jose copied and pasted some of the States own verbiage from the motion regarding Joe Jordan’s snafu. A surreptitious recording in a two way notification state is not even in the same zip code as a collect call from jail with NO EXPECTATION OF PRIVACY.

Is it me or does anyone else think this was an attempt at circumventing rules at the Pokey Mr. Baez is so famous for?

You know, the ole “Im willing to have her call me collect, bein’ that I’m on the list.. I will transfer the call to you-

-signed, unknown caller to unknown number sometime in early May.

HINT: If you want to claim something is work product you might not want to disclose portions of it in your motion. It just *Might* give the appearance you don’t want the recording out but want to make an accusation publicly that favors your client.

Bottom Line: An inmate placed a collect call, subject to the rules of the facility in which she is incarcerated. As dictated by protocol, the call was monitored and is therefore subject to public release. I for one, look forward to hearing it.

After all, it did earn a Blarwin, and I was saving that all year.

    Blink’s last comment about taking ownership of a mistake is spot on. Begrudgingly I can make some concessions for embellishments on a resume’, or some courtroom flubs but there’s never been any apolly that I can recall publicly for any mistake. It’s all bluster and blame, never any apparent hustle to do better.
    A man’s character is what it is. Seeking to destroy others to elevate your own standing or taking part in defying authority is a window into the soul, a piece of paper hanging on the wall means nothing if he doesn’t uphold the law in his own dealings. There are plenty of other professions that do not hold as high a standard, maybe he should seek his own water level.

    I’ve almost gotten to the point that I’m so sick of the bs that i feel like, hey..if Fl. doesn’t care that this guy is making a joke out of integrity and honesty and all that high ground stuff, then neither do I.

    The family is scum, the lawyers act like scum and we all keep asking questions, staying on top of developments, hoping that the tricks and lies don’t let the murder of the sweet lil girl slide right down the tubes. I guess that’s all we really want but I do take it personal for some reason. It grates on my senses, all this nonsense, that he could maybe escape sanctions because he “misremembered”. Say whaa??     I agree with Blink that there are some definite heroes in Caylee’s story… Those 3 are on my list too, but I would also include AH, because without her, Cindy may never have found Casey.

    I’ll leave the others off the list for now, as I am still hoping others will join in on the ranks.

    Just for the record, I know its gonna seem like Azz kissing but I am gonna say it anyway- I think you are also one of Caylee’s heroes Blink, and I don’t know if others will ever be able to know how you helped, but I know, and I hope you get a Momma doll for your office real soon. Peace

    Oh Bother blink- I just finished reading Judge’s Perry’s very well written denial of Baez’s motion to stop the release of the jail house phone call-

    When you get a chance you all should read it.

    Not only does Baez accept the terms of the call by pressing 1 after the recording informs him that it is from a correctional institute, and is subject to recording- But Robin herself, before telling him anything informs him who she is and that the call will be recorded.

    How are we are to believe that this inmate held such bombshell info, yet Baez can not recall getting warned over and over that the call was to be recorded?

    Yikes- this looks really bad- and I would think Baez has enough to worry about withoutadding on more…

    Now that is a shocking response isn’t it?

    I look forward to discussing the willful intent to mislead the court which will be established within this phone call when it is published.

    How in the Hell do you have not one, but TWO uttered warnings negating expectation of privacy AND acceptance to same when pressing the “1″.

    And this is only addressing the second call. Pure and simple, this member of the Florida Bar, sworn officer of the court, attempted to circumvent jail rules and got caught.

    Should be interesting when the next lawyer gets sanctioned and they bring this up.

    Holy Moly- what a mess Baez has made for himself.

    As to the release of info coming up- I think that Cindy’s interview is being re-released in it’s entirety, in answer toCindy’s testimony during the last hearing on the 911 calls- and the implication that her words and intent were changed in the papers that LDB showed her inorder to jog her memory…

    IMO The state is allowing no chance of people thinking Cindy’s words and meaning were being misconstrued….. I may be wrong, but I think that is why this info is being released again.

    One other thought….the other I day I rambled on about a person’s character, it’s not a big stretch to believe that if you are represented by an atty. that has consistently bucked authority, circumvented rules, and lied straight up to the judge, that the the client (and her family and the PI’s and the paid experts) will think very little of being less than honest. I really don’t think that Baez operates in a vacume, his direction is what’s firing the pistons, so if he advises the people who work for him to skirt the rules….?? Did he really tell Dom Casey to call him first if he found the body? If he did, how did either of them know where to look? So, he got caught this time,wonder how many other times did he skinny by?

    It still amazes me that JB admits knowledge of Inmates using contraband cell phones, yet has no concern about participating in phone calls in which this is a distinct possibility in his mind!!! And he KNEW that Inmate Lunceford was doing something she was not allowed to do, yet he willingly participated. He knew that the ex-inmate friend of Lunceford called him first, to set up the illegal call which happened next, within minutes. So, he was ever so willing to participate in shady (illegal) activities, he was just hoping they would not get caught at it. In my opinion.

    I think this is not the phone call that Baez got so huffy about. Maybe she had a contraband phone and that was the call he freaked over. If it was only the prisoner that was ranting and doing most of the talking, why was Baez in such a dander? Something is not right here. We all know how conniving this guy is.

    In my opinion, Baez knowingly and willingly participated in an illegal act that Inmate Robin L. committed. Baez knew the Inmate was calling from a prison, he knew that “Kathleen” was actually Inmate Robin L. illegally using another prisoner’s phone privileges, he knew that he had conspired with EX-inmate “Hallie” to let Inmate Robin L. make an UNauthorized 3-way/forwarded call to Baez, he knew the calls from Inmate Robin were recorded – he just did not know he would get caught up in the investigation of Inmate Robin L’s illegal phone usage. Then, in my opinion, Baez LIED to the Court in his Motions.

    The State says there were two calls from Inmate Robin L (recording says “Kathleen”).
    One call placed at 6:34pm and was answered by JB’s legal assistant Michelle N. In this call, it is apparent that Baez was expecting a call from an inmate. “Hallie” (ex-inmate?) told Baez’ legal assistant, Michelle, that Inmate Robin was going to call.

    Second call was placed at 7:01pm (after arrangements were made to contact Hallie and make sure calls are forwarded for another 15 minutes because the inmate will call again), and was answered by Baez. He heard the warning and pressed “1″ to continue the call.

    In Baez’s Response to the State’s Response …. Baez says in para 2. that he told LDBurdick and the Court that the “other witness names” that were obtained may also have NOT come from the call but from “other communications”. Meaning, Baez did have “other communications” with either Inmate Robin L. or had “other communications” with the EX-Inmate (“Hallie”) who set the 3-way/forwarded call up, which was not recorded as the EX-Inmate was not in a prison.

    Baez may have been temporarily confused (scrambling to save his butt) as to what statements he made on the phone calls, which were recorded by the prison, and what he said in his phone communication with the EX-inmate friend (“Hallie”?) of Inmate Robin L., which was not recorded.

    I believe the State would have to file a Motion specifically asking for Sanctions for the “untrue” statements in Baez’ Motions — and I doubt they care enough about this side issue, to do that.

    However, anyone in the public can file a complaint with the Florida Bar regarding this matter (and/or any other matter involving alleged misconduct by an attorney).

    At this point in the phone call extravaganza, I feel just like I do when listening to Cindy’s confusing spinning words and phrases, backwards and forwards or when kc is using TV lingo in order to make a lie sound more convincing. I always feel betrayed when I’ve been lied to and usually scrutinize every word out of the person’s mouth for a long time.
    Baez lies, so which part of his response is true, which part is covering his rear end? This is a prime example why officers of the court are held to a high standard, when trust erodes in a courtroom setting, what’s the point of having trials? To see who can find a lawyer who will do underhanded things without being caught to get you off? Lawyers with the best track record for sneak tactics can demand top dollar for their services? It’s a slippery slope.

    Judge Perry knows Baez doesn’t know law evidenced by two years of incompetence and extreme arrogance.
    He continues to file an Xtreme amount of motions for everything with so many wording errors. When will this man be stopped! He is doing his title an injustice.
    The man can’t control his money problems! His tongue! His arrogance. He makes appointments and doesn’t show up as he did to nejame and Tim miller and others. Somehow I don’t. Think he will be ready by may 2011

    IRT the Dominic Casey emails- if they contain more of the same ramblings and such that was in the first batch Oye- my aching head just thinking about skimming through them.

    I know Cindy liked having him play into her strange scenarios but I think that man is shameless to have kept playing games with her and allowed her to continue on in her delusions. IMO anyway. Wonder if there are going to be some more insights into Lee and his budding PI work in the new docs….

His many motions that lack substance. His love of media attention along with his anthony syndrome of half truths and crooked underhanded doings. Clearly he is not cut out for lawyering!!

    He is so incompetent !! Can you just see the look on judge perrys face as he listened to those tapes! Bet he had a good chuckle !! Now he will watch his moves in court and less tolerant! Baez is what Casey. Deserves!! He’ll arrest em all don’t forget cindy!! Yupp Baez fits in with the other liars but I don’t see mason tarnishing his rep. With baez!!

    When Baez answered by the correctional facility- the look on Judge Perry’s face was priceless- Anyone in the courtroom that day KNEW how Judge Perry was gonna rule on the phone calls right then and there.

    But ever the professional, Judge Perry took his time and crafted that well-thought out, witty order to Baez stating, Mr. Baez surely understands the workings of Florida Sunshine Law now..

    Let’s all hope so anyway. Smucks, huh, Blink? Hoping to see that movie soon. I heard it was quite funny.

    Speaking of funny…Dee, thank you so much for that post. It was hilarious. I actually DID LOL!! I am sure the author will have many more to add after this case is through.

    uh huh Baez keeps being annoying ! He doesn’t take constructive criticism and applies it to learn the law!! Polish his skills. Don’t think he cares that he is the butt of many haha’s in court corridors or elsewhere as they see him approaching or passing!! I love bill shaeffer the man is wise also Hornsby tells it like it is. Many of lawyers have built their law practices with integrity and professionalism.it took them years to build!! While some rookie like Baez is trying to do it all too fast like a maniac person!!
    How can he compare himself to men that have worked years to build. Now he is trully know for his unproffesionaly written stupid motions !!
    He loves the media !! Much like Casey!! He is doing her an injustice in his greed for money and fame.

    Sadly the death of this beautiful baby has turned into a HUGE joke and that is just not right, 2 years and counting…how sad this case will end in about the same time that our precious Caylee was alive, how sick has this world become????

    Dom says he thinks the divorce was filed because he sexually abused Casey and that Casey may have seen george look at Caylee in that way
    Fri sept 8 casey home on bound Dom can tell from her body language that casey wants Caylee home- says he is disillusioned with baez- may be time to think of going solo-

    Luke says if anthonys take the money from 2020 they will not work with them

    Sept 10 Dom says “Jp Chatt and Ricardo are the ones”

    Ginny says good work Luke you found the nanny- Tony gave Caylee to the neighbor he then named her xenada-??????

    All this happened because of Fusion and drugs these emails read like a very bad mystery novel

    Is DC a real PI ? This is far as a read.

    There is nothing physic about this Ginny person IMO If she were , She would have known her husband was only trying to help her avoid embarrassment- and he doesn’t give two hoots about what attention Ginny is receiving from this ‘work’

    By the way Ginny is wrong over and over and over again in these emails- All of them really- So why was Ginny finally so spot on in her last Caylee is next to a paver down the street from her home….in checking out all her other spot on leads did they videotape those? Just asking

    Wow Cindy is really working overtime to put reasonable doubt out into the public. Knowing that her letters to Casey will be made public she tries to blame kori marie, Jess for Caylee’s disappearance. And to state that she still doubts that the remains were those of Caylee. Is she Crazy or very smart about putting her theories in her letters for every one to read…….
