Hold The Hubris Pass The Humility

The saga begins as follows:

Aging local *legend in his own mind* defense attorney gets “defendant envy” when he sees the dude he thought was the busboy at all The Florida Bar functions, making more on his first big case, with more media face time, than Or lawn do has ever seen. Seasoned barrister signs on for his professional *see alice*, if you will.

Wait, kidding, not the saga in question, my bad.

Yesterday, on behalf of Casey Anthony, lead counsel with Jose Baez, J. Cheney Mason put to “motion” what undoubtedly was screaming inside his head as Mr. Baez bumbled, err, argued, against the States motion for contempt and sanctions last week.  The reconsideration request drafted by Attorney Mason will undoubtedly come as a surprise to Judge Perry.  When his Honor asked Mason why the deadline was not met at the State’s hearing:

..”Was there any particular reason that was not complied with?..”

Mason replied, “The answer to that is I don’t know.” 

Mr. Baez was found in contempt and fined less than the cost of his ipad.

I am not an attorney, but I do know that you cannot introduce new and different bullsh*it you neglected to bore the court with previously AND when you had the opportunity to respond and argue with a new tie and pocketsquare ensemble.

Apparently Judge Perry was not swayed by Baez “.. They say they will call but they never do..” argument, insinuating all Jeff Ashton had to do was call him to work out what his other previous 4 email requests could not.

Makes sense to me now that he put it like that, right?

Everyone knows you can trust what a defense attorney says on the phone who will not commit same information to writing. Duh.

Damn this traffic jam how I hate to be late.. It hurts my motor to go so slow.. 

I have this vision of Atty Slabaugh driving down the 4 with the top down and the 300 pages he threw in the back “loose”, are flying all over the freeway behind him. So that’s the problem.. the dang clerk’s office refusing to tie up their fax, dedicate 2 folks to replace toner and paper in the middle of the 300 page and 5 hour late response, while jamming every other case and function, for Casey Anthony. Missed the memo as well, I presume.

How insensitive. First word folks.. flash-drive. Second word.. GARMIN. It does not take 5 hours to get from Kissimme to Orlando, and that’s assuming he left when the filing was already past deadline.

 

Moving on to the defense’s whine list:

My fave- Dr. Lee found 17 hairs in a car that is believed to have transported the victim in this instant capital murder case and therefore he should not be expected to testify about it.

BBBBBBBBAAAAAHHHHHHHAAAAAA. Seriously?

To date, this is absolutely the most laughable attempt to publicly excuse a witness who Mr. Baez apparently does not consider important enough to pay his dang expenses out of pocket for.

I hear this in my head:

Dr. Lee is not going to be called to testify OR be available for a deposition, cause, like, maybe the harsh weather will not produce that case of luscious oranges, but we are not sure yet, so please wait while we ask the plant lady, who will of course be testifying about plants, but you knew that already. Please tell me you knew that already.

Not to be confused with p-l-a-n-t-i-n-g, as we plan to move to strike or suppress any appearance of the words ” Dr. Henry Lee” and the word “planting” that appear on the same page of any document or media article, as well as within the silent thoughts of any of them-there bloggin’ types.

Lest we forget, Mr. Lee, who will not be testifying anyway if his expenses are not going to be paid, was denied access to an active homicide recovery scene while CST’s were still removing the tiny bones of Caylee Anthony from her swamp tomb.. the nerve of OCSO.

I mean, who knows what Dr. Lee could have come up with in that cornucopia of specimens.

Maybe even Kronk’s Oscar Meyer weenie whistle from the third grade perhaps.

Apparently the defense team , while discussing the virtues of Jose Hubris’s new “do”, missed the free lesson on the actual designation of the Crime Scene Technician, or CST, as mentioned by Jeff Ashton as opposed to the continued reference to “CSI” in defense motions.

Freeman is Freed

Dr. Michael Freeman, who up until last forever was working on his reports for the defense, will not be testifying, although he has not been removed from the defense witness list by presstime.

In an earlier blinkoncrime.com article, I opined about Dr. Freeman’s potential contribution to the case as it relates to a possible death by natural causes. In Judge Perry’s contempt order, it is clear that any expert witness whose opinions or conclusions are not part of discovery, will be excluded from the trial testimony by the defense.

Note- no reporting, no conclusions, no discovery from Dr. Freeman, an expert witness listed in a two year old case. Draw your own conclusions, or, maybe the incident in Washington where an individual with the same name and age helped himself to an Army cell phone that did not belong to him at a Federal facility is “of concern”.

A hearing is scheduled this Friday January 14 to hear the matter.

Late this morning a Judicial Assistant from Chief Judge Perry’s Chambers, speaking from a microphone at the defense table he turned on and off by himself, read aloud to Blink, Editor In Chief blinkoncrime.com, the order he is to prepare for Friday, as dictated to him by my Judge Perry daydream-thought-bubble this afternoon:

Mr. Mason, what you’ve just said is one of the most insanely idiotic things I have ever heard. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this room is now dumber for having listened to it. I award you no points, and may God have mercy on your soul*.

Full disclosure: Maybe without his reading glasses Cheney Mason thought he was penning a request for a vacation, not a request to vacate.. In which case, who could blame the man? I say grant it without prejudice or reservations.

    Casey can make any ‘ol plea she wants; just think of the many lame motions her council has made.

    But, by no stretch of my imagination can I think an Alford Plea would be accepted by the Court in this case; specificly because of the notoriety of the case and the long time lapse to trial.

    Caylee was missing and vigorously sought for 6 months during which Casey insisted that she’s still alive and blamed others of taking her. Since the discovery of Caylee’s scattered bones, Casey has continued to cast blame on others for murdering her child. The State has spent hundreds of thousands of dollars looking for Caylee, investigating her murder, prosecuting the crime and providing for Casey’s defense.

    If the court were to accept a plea from Casey now, without admitting guilt, imagine how badly it would undermine public confidence in the accuracy & fairness our judicial system. Would Judge Perry do that?

    Chica- Yeah, I read them. It wouldn’t surprise me to find out Casey is talking and answering herself. Being stir crazy is not a viable defense. Keep in mind, those vent talkers are way loud- for all we know, she is trying to have a conversation with someone, and she is being ignored.

    BTW, I do not think talking and answering yourself is crazy- any woman who hasn’t done this at one time or another would be an anomaly- especially if she is the mother of teens-or pre-teens or toddlers or dogs or……

    Heck Blink is accused of talking to herself and answering herself almost daily… and no one has ever called her crazy. He He-

    The defense appears inadequit in their handling of the forensic issues in this case. I actually sympathize with them a bit on this point. It is very hard slogging for those of us without strong scientific backgrounds. That said, why haven’t they sought help in the forensic area from an attorney who is up to speed on this stuff?

    Oh, sorry, they did seek that help and Dorothy Clay Simms accepted that position with some fanfare in a televised press conference; so where is she as they fumble the ball with the pretrial forensic motions?

    I’m not on the defense’s side in this battle, but I would prefer to see the forensic issues handled competantly on the defense side, thus insuring that the forensic evidence stand (or fall) on it’s intrinsic merits.

    She has been involved with her defense team and their strategy since day one.

    She has been in court and required to do so by the court.

    She knows what is going on and at anytime could fire her legal team..she has not done so.

    No grounds for appeal.

    No way will Casey win an appeal after her trail for any reason. 1. Because God has placed not 1 but 2 great judges on this case who have taken great pains in instructing the Defense and laying out step by step on how things need to be done…..I hope HHJP Slaps BJ with his color coded paper work that he seems to be so found of…….Just my opinion.

    Just my thoughts, but I think the State is way too professional to let their feelings get in the way of this case’s successful prosecution. I think if they thought it best, nothing would stop them from offering a plea. Personally, I think a plea has not even crossed their minds, for reasons that have nothing to do with their “relationship” w/Jose Baez.

    Baez’s latest “confusion” is just more of the same. Its a ploy, what he hopes to accomplish, IDK.

    Casey has said she is satisfied with her counsel. Casey at any time can choose to ask for other representation. I think she will only do this as a late attempt to start the trial all over, if she thinks it is going bad for her, not because she suddenly gets an ‘aha’ moment regarding Baez’s seeming ineptitude.

    Did Casey Anthony identify with Patrick Bateman, the main character in the film/book? Bateman was narcissistic and psychotic. Bateman had no idea how to portray real emotions. He obsessively watched how others interacted ect because he had no clue how to behave, how to show emotions ect. “Patrick Bateman” was just a role ‘American Psycho’ played in order to get on in society, he wasn’t “real” his whole persona was an act. After watching this movie was Casey relieved to finally find someone that was like her? Did she watch this movie, and think, hey he is kinda like me?

    When was the first time Casey saw this movie? Did she read the book? Regardless, she seems to have found a friend in Patrick Bateman.

    Could Casey Anthony have looked to ‘American Pyscho’ for ways to outsmart her parents and friends?

    Did art imitate life or did Casey try to imitate art?

    At the end of the movie, no one is quite sure if Patrick Bateman murdered anyone, or if anyone is missing. The truth is masked behind misunderstandings and mistaken identity and “maybe” sightings of the person/s who may have been murdered.
    You come away asking yourself was all this just some crazy pyschotic episode or did a murderer get away with his crimes because of people’s unwillingness to see the truth, which was hidden behind mistaken idenity, misunderstandings and aloofness?

    Did Patrick Bateman get away with murder? Was Casey hoping to follow in his footsteps?

    Was Casey hoping that her family and friends would react much the same way as those in Patrick Bateman’s life had? Was she hoping the lies and ambiguity would to be enough to dumbfound her family and friends into inaction? Did she think they would have been left to think Caylee was alive with “Zanny” somewhere…or living with Casey? Would they have ever tracked down Jeffery Michael Hopkins, Juliet Lewis ect? Would they have searched for Caylee?

    IMO they never thought Casey capable of murder. It is not a crime for a mother to keep her child away from her grandparents. Would they eventually have given up their search due to the mistaken identities, and Casey’s assurances that Caylee was okay?

    IMO, at least I believe Casey was counting on their continued inability to see the truth, and their continued confusion and inaction. I don’t know how long she may have thought it could go on, but then there was the problem with the car…

    Luckily IMO- Cindy did catch up to Casey and alerted LE, and they were having none of it. They did run down all of Casey’s thoughts, lies, mistaken identities, Caylee/Casey phone call/ cell pings, sightings ect ect- none of it is ambiguous now, in hindsight of course.

    American Psycho & Casey Anthony?

    There seems to be so many weird coincidences in this case, Can we add this one to the list?

    Mom3.0 ~ American Psycho and Casey Anthony fit the bill. There are so many weird coincidences of which any one could be true. Only Casey can answer many of our questions and she is not talking. It will be interesting to watch the trial and see if any of our theories come true.

I guess I am trying to figure out why they do they things they do, how a little kid can grow up to be a killer ect. I think it is my way of trying to prevent another little kid from making the same choices…IDK.

    Mom3.0 – Thanks for posting, you have whetted my appetite and I am going to try to find time to watch American Psycho although it doesn’t sound like my cup of tea. Like you, I constantly, mentally, try to place myself in the mind of such as Casey Anthony and wonder what sets them on the path they choose to follow. I believe there is a line that ‘normal’ people never cross, something always draws us back. Note I consider myself normal; yes I have lost my temper at times, yes I have wanted to lash out when truly angered, yes I have wanted to reek vengence and I have experienced jealousy, envy and any number of emotions but NEVER EVER have I come within a million miles of crossing the line. Casey’s crime is beyond comprehension and in my opinion deserves the DP.

Was the demise of Caylee an accident, premeditated, or done in a fit of rage? If we only knew why, accident…she panicked, premeditated…neck breaking who…family or child, fit of rage…no plan more than ten minutes ahead of time……..jealousy, freedom, lifestyle.     August 5, 2005, a child is born, a time to celebrate and rejoice, a bundle of joy, our little “miss sunshine”….. born into a “boomerang generation” with family dynamics bordering on the dysfunctional already at work. Parenting practices are the forces at work within a family that produce certain behaviors or symptoms. We love our children, especially those grandbabies (we can share quality time together and send them to their home and parents). We want our kids to have a better life than we experienced, so we do many things to help them get ahead. My parents bought my wife and I a washer and a dryer, so we could wash diapers (yes, before disposables) and we didn’t have to go to the laundry mat. Oh, how nice! We greatly appreciated that act of kindness. The “Great Society” progressed steadily for the future generation’s lifestyle. Hard work was the backbone of success but some generations clamber out a bed in the morning and as their “little feet hit the floor”, they say; “what does the world owe me today”? Entitlement!

    Well, tough love comes to mind. I’ll help you if you’ll help yourself. Continue to lavish the prodigal child and enter the realm of an unconscious defense mechanism by denying thoughts, feelings, or facts that are consciously intolerable. Denial! But wait, a parent with good intentions, may make excuses for an “entitlement child” to take care of the child experiencing difficulty. Repeated rescue attempts allow the needy individual to continue on a destructive course and to become even more dependent on the “unhealthy caretaking” of the benefactor. Caretaking can become compulsive; the benefactor feels helpless in the relationship, but is unable to break away from the cycle of behavior. Caretaker roles have some of the angriest people you will ever meet since they are trying to change someone. Caretaker/helpers are all about control………………… striving for the “power” position. Co-dependency! Denial, Entitlement, and Co-dependency are intertwined and mutually involved in the family dynamics. More later………………..

    Sir Walter Scott poems, Marmion (1808) quote “Oh what a tangled web we weave when first we practice to deceive”. The uncle gave us the first insight into the developing story of the “family dynamics”.

    The 7 mos. pregnancy was denied in June, 2005 by both parents. Since “no sex” transpired, it could have been the “immaculate conception”, no, hold the fort newt, even with the middle name Marie she was no Virgin Mary. How about the “immaculate reception”, well maybe, but she doesn’t play football for the Steelers. So, that only leaves the “immaculate deception”. Simple denial, a defense mechanism of the immature mind, it conflicts with the ability to learn from and cope with reality. Throw a baby shower for an illegitimate child since the father is deceased? Void of divine intervention, who initiated the denial? Who really wanted the pregnancy?

    The “TAKER”…..Steal from your parents, grandparents, piggy banks, and friends to cover your due expenses, place the parents in a financial quandary, quit your job, and lie to cover your life in the fast lane, separate the parties (friends and family) to salvage the lies, by all means pay that cell phone bill, be able to afford a “nanny”, expect it now, and the crux of the matter…………… extend your dependency on parental assistance, join the “Boomerang Generation” and lower your self esteem, while dealing with adversity with no character. Entitlement!

    Oh yes, The codependent “CARETAKER” , a few of the traits: (1) an unhealthy dependency on relationships. The co-dependent will do anything to hold onto a relationship; to avoid the feeling of abandonment (2) a compelling need to control others (3) chronic anger (4) lying/dishonesty do any of these fit the enabler? Complex relationships, the co-dependent person is overly involved with the other person and that person’s problematic behavior, and sometimes to other’s detriment. Sound familiar?

As in the game of chess…..Check! ……………………..The “Entitled Princess” withholds the smile, nod of approval, and avoids eye contact in recognition to the Caretaker, the pawn was sacrificed. To create a deception worthy of belief one must be able to create plausible details that help create the illusion of truth.     Mom, as always, 110% for details. Are we confident enough that Casey was planning Caylee’s murder? I think this was a ‘straw that broke the camel’s back’ moment and Casey, being who she is, needed to retaliate. Poor Caylee was her only ‘trophy’ to take away, for lack of a better term. She was going to punish the people who she felt back stabbed her the most….her family. I believe this is her motive. I don’t believe it was an accident but a decision, hastily made and followed through.

    Chelsea, I want the DP for Casey, my faith says no. What is the lesser of 2 evils? DP imho. I do believe it will be LWOP. You’d think that would be ‘hell’ for her, but Casey is a survivor and always finds ways to adapt to her conditions. LWOP won’t be a punishment for her. She’ll make her own kind of status in prison. It’s worked for all this time. Even in harsh conditions, she has proven to be effective with charm and manipulation.

    Dan, Casey’s plans, to me, seem to be snap decisions. In some instances, she’s proven to have ‘goals’, but how could they manifest if the circumstances were not even close to being condusive. Being given a house by her parents who are divorcing? Bullshevik! Her plans were more like intrically woven lies she knew how to sell, even to herself. I don’t think she thought so far in advance but rather moment to moment and situation from situation. It depended on what she was faced with at that point in her life.

    Mom, I need to re read your American Psycho analysis. Brilliant analogy and comparison. We need to consider all scenarios. Was she living her life based on movies, songs, movie stars (quote by Casey…I’ve been told I look like Alyssa Milano. I take that as a compliment). I am dying for someone to do a complete psychological analysis on her. Won’t happen but what those results would reveal.

What I found to be profound and bothersome though,isn’t that, it was the realization that Patrick Bateman was not bothered by any of his “murderous acts” they seemed to be just another part of his day and he went merrily along with his regular self/life, blissfully unphased- devoid of compassion or remorse or guilt.

    Dan, thank you for your thoughts, very interesting post, I read it, and will have to reread it again.,as it contains alot of good information. To me, everyone can be seen at different times in their life as a caretaker, a co-dependent or even a pawn.

    Here’s what I believe, if Casey was made to play a role, it is one she cast herself in, happily, it was not forced upon her by her mother or her father or Lee. I think Casey was calling the shots in that house for a very long time, perhaps from early childhood. I think everyone walked around on eggshells trying to please Casey and ensure she did not have a meltdown. As seen in the jailhouse videos, Casey was quick to smart off and overreact, with noone igniting a flame. Yet, after, we quickly saw Cindy and George try to calm her and pacify her. I think this happened often. Remember what Cindy said when George wanted to confront Casey on her lies about Sports Authority? She said (pp) No George, don’t! Casey is going to be mad that you checked up on her…

    As for little Caylee being a “pawn” I agree with you, sadly she probably was, but I do not think this was Cindy’s doing, I believe Casey used her daughter as leverage often,with malice a forethought, inorder to ensure that her parents did what Casey wanted. I think Cindy was hoping that Casey was going to have a moment of clarity where everything would click and she would suddenly realize that she needed to take responsibility for her daughter and stop partying and going out, she kept hoping the day would come when Casey would want to make something of herself- and stop telling lies and stealing ect- that day still hasn’t come.

    Hi Chica- good to see you, it is not “hopping” around Caylee’s threads, I know. I wasn’t around in the beginning, but I think Caylee’s threads are more somber and serious now, as we get more information, and get closer to trial time. Its hard to change gears and have fun, at least for me, when waited down by the seriousness and sadness of the facts. Even Baez and his hubris doesn’t hold the same ha ha factor as they once did… But Blink still throws us her snarkiness from time to time- and that is always good for a laugh.     Well all I have to say to that is… NO- any reasonable jury will come to the conclusion that if the death was accidental, Casy would have alerted 911- she certainly would not have went merrily about with her daughters duct-taped, decomposing remains in her trunk, alerting noone. Nor would this innocent mother choose to dispose of her baby daughters remains in a trash site, filled with hungry critters, instead of telling the truth of an “accidental” death.

    Besides the fact that LE gave Casey chance after chance to claim accident, proving herself to be a mother that made a mistake, and not a cold blooded monster, she steadfastly chose to stick with the story of the evil Zanny the nanny, prolonging the torture of her family, LE and countless other compassionate members of the public who wanted nothing more than to help bring Caylee home alive and well and out of the hands of the evil kidnappers…

    As I watched tonights segment, I thought back to Cindy’s jail visit where she tells Casey “the latest” rumor..Caylee drowned in the pool- to which Casey answers deadpan, “surprise surprise”…
    A mother that accidentally kills her child, either by neglect or other, is overwhelmed by feelings of regret, remorse, and guilt- She crys, she immediately calls for help, she wants to face justice to right her wrong- She does not behave as Casey did/does.

    A mother whose child accidentally drowns does not entertain herself in jail, by singing a song which is about happily removing the past and moving on, which includes the imagery of water, and screaming and hate being the last emotion felt, and escape and erasing the past… She does not come home on bond to joyfully share this song with her newfound friend while making bracelets, a song BTW, that when heard makes Cindy cry and Tracy think WTF, and to which Casey is blissfully unphased…and answers her mothers tears with..Well I guess you don’t want to hear it again then…

    The song that Casey was so taken by that she claimed (pp)encapsulated her life during that time, and helped get her through:

    Its a beautiful song, and if heard by anyone not dealing with the “accidental” drowning of her child, would not give anyone pause, however- this is Casey- Surprise Surprise, a mother of a “missing toddler” who knows damn well what happened to her baby, and at the very least knows that if Caylee didn’t drown, accidental or otherwise, she was at that moment laying down the street dead, beneath dirty scummy water….

    I’m not buying accidental drowning, and I don’t think 12 reasonable people will either..

    First I wish to apologize for my limited availability this week. As you know a recovery effort for Chris George has just been completed this week and to say that it has been consuming is an understatement.

    Some day, when I write about it, I will talk about our sweet little Caylee’s in that regard.

    In general terms, the duct tape, which imo is not without a forensic link to Casey Anthony, is a critical factor in more than one way.

    There is a very specific window of explanation for how a 34 month old baby got a facefull of duct tape prior to decomposition and avoiding disarticulation for a full 6 months in a bog, and how it was affixed by the last face this blessed little sweetie saw. Her Mother.

    That window closed with the Zanny story, and there is not a prayer if this goes to trial that 12 people will not agree that Casey Anthony murdered her child and the rest of what is going on is a bunch of hooey disguised as pompous jackwads in love with their own ability to fool no one.

    Hi Ragdoll, I don’t think that the Court nor the prosecution is trying to get Jose Baez removed from this case. I think they are bending over backward to force him up to speed in order for the trial to go forward on time with the defense intact.

    Judge Perry extended Baez’s expert witness discovery deadlines 3 times! Judge is doing whatever it takes to keep this defense intact.

    As for Jeff Ashton’s motion to have Baez found in contempt for missing another deadline; he wants the defense to be more specific in their arguments as to why they want forensic issues (other than the Oakridge Lab air testing) included in the Frye hearings. He saw the Court’s order that the defense represent those issues in detail, by Feb 17, as a means to move this forward. So when Baez missed that deadline, then expressed confusion, Ashton used the most powerful language in the motion he could. The Frye hearings are four weeks from now.

    Ashton wants to prepare to be concise for the Frye hearings, because that’s his strength. Baez wants to keep his options open, because, uh… gosh, I don’t know why. Hoping for a miracle?

Whilst typing this, I am watching Tony Petone (channel 6) report on the possible stance the defence might take ie. Caylee’s jaw was in some way manipulated when Roy Kronk picked up the skull using a stick through the eye socket. Sorry this is so graphic but I believe the trial is likely to be extremely so; we had better get used to it. I really have never got to grips with why/how Roy Kronk knew where to search for Caylee. Must have missed that period of postings as I was in the UK where, to date, the story hasn’t been reported (to my knowledge)?. Any thoughts chica/Mom3.0/Ragdoll/Annals etc. No doubt it will be reported across the pond once the trial starts and the DP is mentioned along with Casey’s pics showing an attractive young woman. Evil comes in all guises, I hope and pray the Jury reaches the right decision.

Before the hearing started, I think I heard LDB actually make a reference to the frozen caveman lawyer- I don’t know if I was imagining it…Ms. Medina, actually was the one to address the court through much of yesterday’s proceedings. She did okay, but supplied more of the same excuses we have heard before, but with far less hubris….Baez made some accusations that almost had LDB up in arms, Ashton had to school Baez on a number of the motions ect. JPerry has had enough…He is determined to get this thing done in the allotted time, thank goodness.

    Blink, I never considered the duct tape being so tremendously crucial until I read your overwhelming statement. I'm verklempt and all I can say is wow. I hope the jury sees it just as you do.

    Going in another direction, Dr. G claimed death by homicide. I'm trying to grasp, besides desperation, why the defense feels Dr. G is an irrelevant or unsound witness to this case? To me, it's indisputable that Caylee died by homicide when the 'medical examiner' (who happens to have an astounding reputation) has processed Caylee's remains. The defense are running with 'we don't know how she died'. Ah yeah ya do! What am I missing? They need to create doubt, not descredit Dr. G, who by the way, does not practice junk science.

    Also, watching the status hearing, did I hear correctly that there will be a psychological anlaysis done on Casey? Not sure if that's a good thing. If it were the state performing the analysis, I'd be doing my happy dance. I don't believe we're going to get the real story. Just lies of abuse of an extraordinarily dysfuctional 'unit'. I can't call them a family. Sorry.
