The saga begins as follows:

Aging local *legend in his own mind* defense attorney gets “defendant envy” when he sees the dude he thought was the busboy at all The Florida Bar functions, making more on his first big case, with more media face time, than Or lawn do has ever seen. Seasoned barrister signs on for his professional *see alice*, if you will.

Wait, kidding, not the saga in question, my bad.

Yesterday, on behalf of Casey Anthony, lead counsel with Jose Baez, J. Cheney Mason put to “motion” what undoubtedly was screaming inside his head as Mr. Baez bumbled, err, argued, against the States motion for contempt and sanctions last week.  The reconsideration request drafted by Attorney Mason will undoubtedly come as a surprise to Judge Perry.  When his Honor asked Mason why the deadline was not met at the State’s hearing:

..”Was there any particular reason that was not complied with?..”

Mason replied, “The answer to that is I don’t know.” 

Mr. Baez was found in contempt and fined less than the cost of his ipad.

I am not an attorney, but I do know that you cannot introduce new and different bullsh*it you neglected to bore the court with previously AND when you had the opportunity to respond and argue with a new tie and pocketsquare ensemble.

Apparently Judge Perry was not swayed by Baez “.. They say they will call but they never do..” argument, insinuating all Jeff Ashton had to do was call him to work out what his other previous 4 email requests could not.

Makes sense to me now that he put it like that, right?

Everyone knows you can trust what a defense attorney says on the phone who will not commit same information to writing. Duh.

Damn this traffic jam how I hate to be late.. It hurts my motor to go so slow.. 

I have this vision of Atty Slabaugh driving down the 4 with the top down and the 300 pages he threw in the back “loose”, are flying all over the freeway behind him. So that’s the problem.. the dang clerk’s office refusing to tie up their fax, dedicate 2 folks to replace toner and paper in the middle of the 300 page and 5 hour late response, while jamming every other case and function, for Casey Anthony. Missed the memo as well, I presume.

How insensitive. First word folks.. flash-drive. Second word.. GARMIN. It does not take 5 hours to get from Kissimme to Orlando, and that’s assuming he left when the filing was already past deadline.

 

Moving on to the defense’s whine list:

My fave- Dr. Lee found 17 hairs in a car that is believed to have transported the victim in this instant capital murder case and therefore he should not be expected to testify about it.

BBBBBBBBAAAAAHHHHHHHAAAAAA. Seriously?

To date, this is absolutely the most laughable attempt to publicly excuse a witness who Mr. Baez apparently does not consider important enough to pay his dang expenses out of pocket for.

I hear this in my head:

Dr. Lee is not going to be called to testify OR be available for a deposition, cause, like, maybe the harsh weather will not produce that case of luscious oranges, but we are not sure yet, so please wait while we ask the plant lady, who will of course be testifying about plants, but you knew that already. Please tell me you knew that already.

Not to be confused with p-l-a-n-t-i-n-g, as we plan to move to strike or suppress any appearance of the words ” Dr. Henry Lee” and the word “planting” that appear on the same page of any document or media article, as well as within the silent thoughts of any of them-there bloggin’ types.

Lest we forget, Mr. Lee, who will not be testifying anyway if his expenses are not going to be paid, was denied access to an active homicide recovery scene while CST’s were still removing the tiny bones of Caylee Anthony from her swamp tomb.. the nerve of OCSO.

I mean, who knows what Dr. Lee could have come up with in that cornucopia of specimens.

Maybe even Kronk’s Oscar Meyer weenie whistle from the third grade perhaps.

Apparently the defense team , while discussing the virtues of Jose Hubris’s new “do”, missed the free lesson on the actual designation of the Crime Scene Technician, or CST, as mentioned by Jeff Ashton as opposed to the continued reference to “CSI” in defense motions.

Freeman is Freed

Dr. Michael Freeman, who up until last forever was working on his reports for the defense, will not be testifying, although he has not been removed from the defense witness list by presstime.

In an earlier blinkoncrime.com article, I opined about Dr. Freeman’s potential contribution to the case as it relates to a possible death by natural causes. In Judge Perry’s contempt order, it is clear that any expert witness whose opinions or conclusions are not part of discovery, will be excluded from the trial testimony by the defense.

Note- no reporting, no conclusions, no discovery from Dr. Freeman, an expert witness listed in a two year old case. Draw your own conclusions, or, maybe the incident in Washington where an individual with the same name and age helped himself to an Army cell phone that did not belong to him at a Federal facility is “of concern”.

A hearing is scheduled this Friday January 14 to hear the matter.

Late this morning a Judicial Assistant from Chief Judge Perry’s Chambers, speaking from a microphone at the defense table he turned on and off by himself, read aloud to Blink, Editor In Chief blinkoncrime.com, the order he is to prepare for Friday, as dictated to him by my Judge Perry daydream-thought-bubble this afternoon:

Mr. Mason, what you’ve just said is one of the most insanely idiotic things I have ever heard. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this room is now dumber for having listened to it. I award you no points, and may God have mercy on your soul*.

Full disclosure: Maybe without his reading glasses Cheney Mason thought he was penning a request for a vacation, not a request to vacate.. In which case, who could blame the man? I say grant it without prejudice or reservations.

    I look at the status hearing viedo last night. And I must say I love HHJBP he is so awesome When Linda objected to the K-9 rebuttle and Jose was going on about his rebuttle and JP said I have copies of the depos and if its not in depos on both sides its not comming in…..And he also made a statement when Jeff & Jose were talking about striking the motion on plant growth and other motions and Jose was trying to get them heard at the same time JBP made the comment about finding someone to back up your motion. I saw how bright this man was he was letting Jose know he knew why he blew off his orders I loved it ….

I haven’t always succeeded, (not in Blink’s house)…so I have since redoubled my efforts to make up for any not so nice thoughts/words-

    Who knew how valuable Blinks moderating was? Sadly not I, until I visited someplace else, where people were allowed to say whatever they wanted with no thought to hurting someone.

    Have you ever seen the movie, You’ve Got Mail? Well, theres a scene when Meg Ryan’s character finally says what she (thinks) she wants to say at the moment she wants to say it…it wasn’t so nice- so she spends the rest of her time regretting the time she went with the flow and may have hurt someone… Well thats how I feel about some of the words that may have flowed from my computer or that I read and didn’t do enough to correct… so I try hard to make amends, and prevent anyone else from letting negativity get the best of them.     Thanks MOm3.0, For the links the part of the hearing I was refering to in my comment starts at 16:48 and then the sencond one is comes right after both statements are between marker 16:48 – 25:42. JB tries to be sly and get an expert allowed in to plea his arugement without listing case and law into is incomplete motions.

    Mom, I get where you’re coming from, but I don’t think I’ve ever heard you say anything that didn’t come from the heart or wasn’t the truth. This is one time I have to disagree with you and say….you’re being hard on yourself dear friend. Everyone here has their moments. I consider the source of those reasons and it starts with a little girl who’s name her family may have forgotten, but Caylee is our muse. I remember the first time I came to blinkoncrime. I’d been to many sites….posters slinging hate and venom at each other. I was learning nothing about how the case was proceeding. Like all of you, I was asking ‘how is this supporting justice for Caylee when everyone is acting like the Anthony family?’ I found this site b/c another poster suggested it. I couldn’t believe the tact and profound sense of courtesy and respect this site invoked/s. We have the odd troll and snapperhead, but we move right back to the cause.

    I personally think my friends @ Blink are A list people. Finest in the blogusphere! Kudos to Blink for running a tight, honest ship.

    Ditto, I have never witnessed a single un-kind word from Mom 3.0, and I suspect if I ever do, I would not question it in the least. I have taken my cues on patience more than once from her, you, and many contributors here.

    Ragdoll, I totally agree with you regarding BOC- with Blinks help we do move right back to the cause.

    It is strange but I find not all cases bring out the worst in people, via commenting ect but for some reason others sadly seem to be plagued by it.
    Is it because of the ugliness of the crime? Is it because of the media attention? Is it because certain cases evoke overwhelming emotions? IDK

    It is hard to believe that we are only 2 mnths away from jury selection. I am sure in the coming months, and especially during the trial,and its aftermath, there will be an upsurge in overwhelming emotions.

    I am glad that I will be here amongst all of you that Ive come to know and respect here at BOC. I look forward to Blink’s commentary and everyones thoughts. Its nice to know I won’t have to bear witness to the trial alone, & I won’t have to burden my family and friends with my incessant jabbering recaps…I will instead be amongst you guys- who most likely will be bothered by my incessant jabbering recaps LOL

    It seems OE has finally came to the conclusion that Casey Anthony did have a direct part in little Caylee’s death…after many times stating Caylee somehow wondered off, during Casey’s nap, then suddenly met up with a 100 mileanhour duct tape killer- only to be discovered by her mother who placed her lifeless body in the trunk & drove around with her until she finally came to the realization she was dead, then put her back in the very spot she had found her, instead of mourning her death, and shouting bloody murder to LE or her parents…

    The following (below) is one possible scenario (out of many scenarios) that was never considered. Please have the decency to read ALL THREE parts before posting obnoxious comments.

    Casey and Caylee had been joyously swimming in the family pool. The pool ladder was accidently left down after they exited the pool to dry out in the warm Florida sun. Casey fell asleep on her chaise lounge whilst Caylee climbed back into the pool unescorted. Caylee drowned whilst Casey was asleep.

    Casey awoke and discovered that Caylee was missing and panicked. Casey began a frantic search and discovered Caylee floating in the pool. Casey retrieved Caylee from the pool and began mouth-to-mouth resuscitation pronto. Casey had trouble keeping Caylee’s mouth open during resuscitation, so she used duct tape to aid the process (i.e. the duct tape was used to help keep Caylee’s mouth open).

    Part 2 of 4
    Casey was hysterical after all attempts to breathe life back into Caylee failed. The sense of loss was so great that Casey lost control of her mental faculties – She began to behave irrationally.

    Casey drove around town with Caylee in a zombie like state. She was confused and did not know what to do: Should she take Caylee home? Should she take Caylee to the hospital? Should she take Caylee to Blanchard Park? Should she take Caylee to Universal Studios? Should she bury Caylee?

    Casey frantically visited places that were familiar to her, e.g. Blanchard Park, Sawgrass Apartments, Target, Blockbusters, Fusian. The chaotic travel orgy lasted for days, during which time Casey became even more irrational. Casey was now at the point of a mental break-down. She still believed that she could revive Caylee herself. Always the optimist, Casey even got a “Bella Vita” tattoo.

    Part 4 of 4
    Casey had to borrow a few dollars from friends in order to fund her investigation. As far as the babysitter – “Zenaida” was a generic name for a Nanny or babysitter- i.e. derived from “Zanny the Nanny.” Zenaida was created as a protective figure – a Guardian watching over Caylee. As long as Zenaida exists– Caylee is safe.

    Casey had a conniption after she discovered that Caylee accidently drowned. Rather than accept this painful reality, she continued to believe that Caylee could be safe with “Zenaida.” She did not want to face the possibility that Caylee had died or jeopardize Caylee’s safety with “Zenaida.” Not all of her decisions were made with a sound mind… e.g. the decision to conduct her own independent rescue effort or being confused about her current employment status at Universal.

    Notice no mention of a deranged meter man
    no mention of junk science
    or air tests
    no mention of photos, or video tape or confessions
    no mention of missing finger prints ect ect

    Then sadly being unsuccessful in this heroic attempt, she didn’t call 911, but instead went off the deep end- denying the death, keeping it from herself and her family inorder to -keep Caylee safe with the imaginary nanny in her mind-(or gut if you are Casey) until the body was no longer manageable, then of course, she placed little Caylee in 2 trashbags, a discarded toy bag…and decided that the best thing to do to keep Caylee safe, and allow her to rest in peace, was to place her lovingly and without fanfare into that critter infested, trash site down the street … to be torn apart, moved around, until Casey could answer ‘truthfully’…I don’t know where my daughter is….or she forgot she did it…

    She Never tolda soul what happened unless you take into account her diary of days, ‘”What is given can be taken away. Everyone Lies. Everyone Dies.” The hanging teddy bear next to a possible likeness of Caylee, “why do people kill people, who kill people, to show people that to kill people – is bad.” Hmmm doesn’t seem like the actions of a young mother who has lied to herself about the truth inorder to go on believing her baby is alive with the zanny the nanny person…..

    There are several glaring reasons why this scenario won’t stick-
    Casey knew what she did, she knew it was wrong and she tried to cover up all of the evidence… She lied to her family, her friends, the investigators.

    She cleaned up the scene, she cleaned out her car trunk, she placed a trash bag of garbage in the trunk to help hide the truth- someone- – placed those dryer sheets throughout the car, after it had been parked in the garage, (according to Cindy’s depo she did not do it) and someone placed Casey’s cd case that had been behind the sunvisor, over the stain in the trunk…along with moving the boots in the back seat…ect ect

    Casey lived la bella vita for 31 days, while she outsmarted her family ect… -She once said “I don’t want to be one of those thousands of parents that has to deal with the possibility … of knowing that their child`s alive and that they’re with someone else. The thought of that every day makes me sick.” Hmmm, kinda contradicts the whole I made up Zanny the Nanny in my conniption of grief, inorder to believe Caylee was safe and …alive…. does it not?!

    She gleefully sold the kidnapping story and stuck to it-to LE and the public, to her family-never telling the truth of this “accident” not inorder to bring her little girl home, not to stop the pain of her family, not even after Caylee’s remains were found, not even after the DP was reinstated…she never stopped and came forth with the ‘truth’.

    She stuck to her lies just as strongly as those the 3 STRIPS of duct tape that held little Caylee’s mandible in place. The Duct Tape which Blink says can not be dismissed.

    “The duct tape will save the day”

    OE, JJ, whomever you are, you are not helping Casey in any way, by trying to put out these BS scenarios.

    Casey deserves a fair trial. Caylee deserves to have the truth told through the evidence… no matter your opinions or mine the evidence will be presented.

    Then and only then will we know the truth, we certainly can not hope to get it from Casey Anthony, a convicted liar.

    If I were the Defense I would be worried, there are so many things that the State doesn’t even plan to use to help aid them in their stance to prosecute Casey Anthony. I would think their case must be sound enough with out all of these things, otherwise they would fight to keep them in…right?

    The Caylee Daily (was down for maintenance work the other day) actually used a link referencing WFTV. I think they’re all saying the same thing. WESH and WFTV seem to keep similar accounts in the articles.

    Mom, maybe you can provide your take on this issue I have….your comment, once again, shoots holes in the defense’s attemtps to even create an edge of doubt for Casey’s involvement. What I’m not understanding, is how they can use ‘staging’ and ‘death by drowning (the most logical course of action being to duct tape the victim :S ) when they locked their story of the nanny from the get go? How can they divert from Casey’s statement to all this ridiculous non sense as you so effectively put it?

    Are they not shooting themselves in the foot with all these non related theories to the nanny?

I just dealt with this issue myself and learned some viruses can creep in even with the best firewalls (clicking on links as much as we do will certainly make it easier to pick them up)…and they’re darn sticky too.     Sending my prayers to that little one-

    My God, what is wrong with people? I feel horrible. Riding a ride can take a long time, the lines the length of the ride, ect ect… Poor innocent baby. Can this happen and there be no bodily injuries that a parent would recognize? So very sad.

    Who let a 2 year old out of their site at any second? Sweet Baby, my God.

    ok, now, I’m not sure if I will be able to put this into words properly to convey what makes sense in my own head, but I’ll try….Instead of reading it as a reference to Zenaida, but just as a statement, it struck me so hard that this is basically a confession and/or goes directly to motive. Go back and read it as though she is refering to Cindy….i.e, Rather than allow her parents to take custody of Caylee, Casey decided to take Caylee’s life.

    oh, and I was reading some of the motions filed by the defense to throw out evidence, etc. , and in the one that is in regard to chloroform, where it refers to the Pontiac, it states “the Pontiac that Casey allegedy drove”. I’m not sure that I ever recall the defense using the word ‘allegedly’ when refering to Casey and the car, but I thought it was an interesting.

I am glad I went searching because it turns out that was not the full quote- I apologize for snipping it, but I didn’t realize I was…I guess it has been quoted and requoted so many times in so many different places…again my apologies, and thanks for giving me the opportunity to fix my mistake.

    The full quote is:

    “I don`t want to be one of those thousands of parents that has to deal with the possibility of never seeing their child again, the potential of knowing that their child is alive and with someone else. The thought of that every day makes me sick.”

    Still, with the full quote, it does not diminish your thoughts…IMO

    It certainly can be viewed as a confession of sorts, although we could be just misconstruing her words…(sorry I couldn’t resist)

    The thing is, according to Casey, Caylee was safe with the nanny, so her whole quote does not fit…but if you believe Caylee was dead at this point, by her mothers hands and there was no Zanny…then certainly your thoughts/Casey’s words are quite disconcerting.


    I noticed that too Scott “alleged”…Thanks for bringing it up. You have to give the Defense credit, after all this time, they are finally trying to distance Casey from the car. What else can they do at this point?

    They can try but IMO it will not fly- Too many people to testify to Casey and the car. JMO

    Blink, yeah I’m with you. Too much can happen to our little ones when they are out of our sight, or out of the sight of a proven reliable trustworthy care-giver. Shoot even then, horrible things can still happen. Where the heck did this guy go to hide inorder to do this? My goodness, aren’t there cameras around and lots of people? JMO

    She can’t even look her parents in the eye OR listen to the truth. Anyone else think this is a coping mechanism to look involved but to really be tuned out on Casey’s part? She has no control over what they’re going to say. She must be touching cloth (sharting for lack of a better word).

Casey did not give her father so much as a cursory glance, she still appears cocky as hell – how I despise her!!!!! Has just broken for recess, hopefully I will calm down for continuation.

    It is infuriating, isn’t it. I wasn’t expecting my emotional buttons to be pushed for the status hearing. A sign of things to come for May! I’ll need to take an ativan for sure.

    I noticed Casey’s ‘stern’ expression too while George was being questioned. Her eyes were sincerely throwing daggers!

    Hello all- I only got to watch the first part of todays hearing until George left the stand…Well- they certainly are trying to rewrite history IMO
    LDB is sooo good at redirect. Cheney Mason did well with trying to make a mountain out of a mole hill…But then wham! LDB came back strong..

    I swear I wrestle with my feelings over George and Cindy each time they talk. Part of me is sympathetic, but then the part that doesn’t like BS steps forward and screams are you kidding me?

    Does anyone really believe Cindy or George would have remained silent about LE arresting Casey, this whole time period?…because no one asked them that question? Seriously? Today in court the Judge had to step in several times to instruct them to answer only the questions asked of them…Cindy resorted to this is hard for me ..Linda…and George was defiant …you opened the door…. you opened the door…

    Honestly, what cant these two loving grandparents not understand about the lack of an amber alert? 31 days had passed, and Casey was assuring them that Caylee was fine with the nanny…

    I thought it was great when LDB announced to Cindy that Det Melich’s questioning of Casey in her bedroom was recorded…I also took note of how much their testimony differed from one anothers, timestamps, call-ins,logs- HELLO…LE knows what time things were done….and what officer did what…

    Chelsea, I’m sure you can just to go wftv and watch from there. I don’t know what the time difference is but I suspect you’d be tuning in for the live event about 3 or 4 hours ahead. As for the purpose of a status hearing, I’m afraid I can’t explain that one. Mom is the expert on these things. Mom, can you enlighten us?

    Mom, you and I are on the same wave length. Like they’ve both done throughout this whole tragedy, they’ve made it about Casey or themselve. HHBP kept them in line which I’m sure was very new to them. They’re lying!!!! They do it well and they know why there was no amber alert. Figures that they both attempted to appear victimized and bullied by LE from the start. Not long after, I am certain they knew why there was no amber alert. I HATE that about them!!!!

    Prosecution was awesome and they were ‘psychologically’ prepared for the mind games Cindy and George would play on the stand. They were so stinking prepared for it. Talk about a slap of reality for these 2. They’ve studied these 2 and talk about being SERVED!!!! The wind in their sails was syphoned. The look of defeat was on both of their faces. I feel extremely encouraged today.

    I didn’t get to hear the 2nd half….on my way now. I did NOT KNOW the conversation between Det. Melich and Casey was recorded (in Casey’s room). I guess that just makes sense…but I’m sure George and Cindy weren’t feeling so ‘cocky’ when this revealed by Pros.

    I felt Baez looked scared, inexperienced and nervous. As for HHBP’s comments about the black widow, very interesting. When all of this is complete, I wonder if he’ll share his feelings about this case, publicly. I’d be EXTREMELY interested.

    If anyone read the link I left, Baez is blaming HHBP (et al, except himself) for the recent complaints against him. This is proof the man does not have opposable thumbs. RIGHT BEFORE TRIAL? REALLY JOSE?
