Caylee/Casey Anthony Trial: Perry Plan In Effect Prosecution Takes A Hit-”Not Race Neutral” Defense Strikes Dwindle

Clearwater, FL- This Morning, the 8th day of jury selection Linda Drane Burdick, prosecuting attorney for the State v. Casey Anthony, renewed her argument to use their peremptory challenge to strike a female African American for cause, that she could not “judge others” for religious reasons.

Chief Judge Perry required Burdick to read back the transcript of the Vior Dire exchange, and held the state to task for the “brief questioning” of this juror as compared to the first juror, of over 3 hours. What he neglected to remember, was that immediately after that juror, the judge rebuked both sides that if this was going to take this long, he was going to speed them up whether they liked it or not.

Again, limited the vior dire questioning time for either the prosecution or defense is a reversible error.  While the judge did not limit either side, the message was clear.

Attorney for the defense, Jose Baez,  objected both procedurally and on the grounds he would wish to receive transcripts of other jurors questionings to respond.  Translation: Rule my way or the cans of worms this is going to open will be gushing out the doors of this cavernous courtroom.

It did not even get that far.

Judge Perry decided to let his earlier ruling stand: The State did NOT provide the court with a “Race Neutral” reason for cause, and therefore would not be permitted to utilize it’s peremptory challenge, as to do so would be “discriminatory” and against the Florida Supreme Court .

Here is the problem-  Can we say that under Melbourne- a true inquiry or finding as to the reasonableness and GENUINENESS  of the State’s motive for wanting to strike the juror for race neutral reasons occurred?

No way.  A window to how this does not stack up, was Jeff Ashton’s  last comment on the matter immediately following Judge Perry’s original ruling.

This juror was not the only African American on the panel, not the only woman, and at no time did Judge Perry say why the court did not believe the reasonable basis for the challenge was not racially neutral.

This is in contradiction to Melbourne, Murray, and Tillman v.  State of Florida.

According to Judge Perry, he believed this juror’s original comments about an inability to be judging were “rehabilitated” during further exploration during the Vior Dire and said he will not be hearing any further objections as to cause.  Mark my words, if there is a conviction in this case, we have just potentially seen the first reversible error.

By the afternoon, after calling back the 11 that have been retained, Judge Perry announced that he will be swearing them in as soon as they hit the magic dozen, and no further backstrikes will be permitted.

Jose Baez offered an objection to the way the Judge was conducting the Vior Dire in the first place, citing his crystal ball cannot see whether or not he may want to strike any of the ” nearly empaneled” jurors  without getting through all the potentials and does not want them “selected”.

Judge Perry followed what I will call the lenta spicula rule advising him they have had ample time to raise the issue,  DENIED.

After some accidental “hot” microphone activity, Judge Perry leaves the courtroom to speak to the “first 11″, presumably sending them home,  “Perry Style.”  They are due to report tomorrow at 1 PM.

Another straight day of jury selection, the count of retained jurors that have not been stricken, but MAY be subject to backstrikes from either side tomorrow, is 11.  I can actually now smell the 8th coat of virtual beige paint I have been watching dry. (blink ignores twitch in her right eye)

On the day originally slated to begin opening arguments in the trial,  Casey’s parents had a “beginning” of their own.

Mark Lippman, attorney for George and Cindy Anthony, announced they are going to file to trademark Caylee’s name, and the phrase “Justice for Caylee”.  The above image was captured after Casey read a note written to her by Ann Finell, one of Casey Anthony’s  defense counsel, potentially giving her the news, and occurred moments after appearing on The Orlando Sentinel.

Over and Under says the opening arguments begin Monday May 23rd.

    Make no mistake about it, the defense would not have asked for the PJ on the stand during the outburst to be excused had it been a juror that they wanted. She had spoken of how very sad she was about the death of this child, and the DT did not even question her on media exposure. They would have used a strike on her eventually if they couldn’t have challenged for cause. (I still am unclear on the number of backstrikes JP is allowing for alternates. One per number of alternates??? If so, four alternates would equal 8 strikes allowed, would equal we are still a long way from seating a jury plus alternates.)

    That said, I think Perry could have kept that PJ, but he is the judge and probably did the most prudent thing. Surely an unstable woman’s opinion shouted out in court would not affect the PJ’s ability to hear the case and make a decision based on the facts.

When I read they wanted an account of the profits made from Caylee’s name, I couldn’t help but think these 2 are still finding ways to cash in. They are as lazy as Casey and after 3 years, they have no reason to be productive members of society.

    I don’t think Judge Perry’s pronounciation is a speech impediment. I think it’s a dialect. Too many of the “colored kids” I grew up with in school had similar pronounciation for it to have been an imperfection. This does not, of course take away from the sentiment that the sound of it is attractive.

    In addition I find the timbres of his speech musical. What a gift to us all; his exposure in the media.

    I adore this guy. I think even more because he says “pacific” for specific. He is beyond charming for me.
    I cannot wait to hear him and Dr. Vass kibbitz.

    JMO, I believe the her mother has been and still is actively and willingly involved in the defense.

    At 4:14pm Court Time it looked like the accused did a “knock on wood” on the table while talking with the young lawyer EF.

    I dont know how to help in restoring caylee’s legacy. If you lead I will follow. I am praying that the State will be able to speak for her, as I wholeheartedly believe she has been trying to be heard-
    I hope the jury will be listening. I too want a fair and honest trial/conviction. And I do believe in mercy and want to make sure that Casey and other parents do understand that we care and there are other options.

    Indeed, in the three years since little Caylee’s death, folks have named their new babies Caylee in her honor.

    I am all for the cease and desist letters, but trying to trademark the baby’s name is just as shameful as the other folks trying to profit. Two wrongs have never made a right, and that rule does not change just for Anthonyonics. It is THIS kind of crap that makes people have such an utter disdain for them. It does nothing to help their daughter. I liken it to the time Cindy announced to the media she was donating Caylee’s little shoes and the charity said no thank you, ma’am, we are appauled by you trying to make a photo op. We don’t want your shoes and we don’t want YOU here with us. Or the time Ron Cummings told mom and pop to take a hike, he opined that he felt they were there to get attention from the cameras and it made him sick to his stomach. If low life , trailer trash, dope dealer Ron Cummings throws you out…you really just don’t get it.

    If they think the protesters were hard on them back then, wait until THEY try to profit off of Caylee’s name. Is nothing sacred to these people? That baby never had a chance in that house. All I can say, is Lee, grab your girl and get the hell outta Dodge before you have a baby!

    I have such mixed emotions as we approach this final stage of Justice For Caylee. Part me me is mixed with dread at hearing all the evidence, how unloved this baby was and how so few people who actually knew this child have stepped up in her honor.

    The other part of me is anxious to see justice served, so Caylee’s spirit can rest and be free.

    Although…if my beliefs are correct – Caylee is already free and unburdened – and is loved more now than she ever was in this life. So, no matter the outcome, I can take rest and refuge in that knowledge.

    May Justice prevail and all truth come to light.

I can’t wait to see them make complete & total morons out of themselves (as if they haven’t already) trying to spin her garbage to this jury. As Judge Strickland so eloquently said “Miss Anthony & the truth are strangers”. Does anybody else think as I do that Casey – as narcissistic as she is – didn’t tell her defense team everything she should have, and it’s going to come back & bite them all in their collective azzes?

    For so long!! casey has been the center of attention and in her sick mind!! she viewed it as stardom.
    I am so happy that finaly! caylee will be the popular one! caylee’s name will be mentioned all day longgggggggg she will be the star of this show!! until justice is served. It will no longer be about casey it will be about caylee marie anthony the real CMA.

    I am so happy that finaly we will see/hear all the state has against the inmate!! there is just too much overwhelming proof that casey acted alone to end the life of this precious baby. Casey stole the right for this little girl to ever again sing you are my sunshine to her grandfather !!! out of jealousy. she didnt want the burden of raising caylee it interfered with her traveling mattress business.

    we have seen how narissistic and sociopathic she is.

    we have seen the same from cindy… george… lee…. but most has been from the inmate and her mother.

    I dont think baez will pull this off not even with the help of mason. I am just praying that she gets DP but if not LWOP will do nothing less would be an injustice to caylee..

    I wanted to revisit Caylee singing and saying…papa are you tired… it seems like forever ago when I first heard it. I came across this link and thought it a beautiful tribute which I’m sure chica, ragdoll and many other Blinksters will appreciate. It reinforced my determination to support Justice for Caylee for as long as necessary.

    Teri, I can relate to your post. It is my belief Caylee is playing among the angels. All of this is behind her and her sweet spirit is rejoicing in Heaven.

I must admit that when I first read about the trademarking I thought “why are they trademarking ‘justice for Caylee’ because it seems all they are after is ‘justice for Casey’ “. After reading your post, I must admit that you softened my heart with your words and I am hopeful that they will finally show up for Caylee.

    I was able to watch a small portion of jury selection from Friday and got a little chuckle watching Linda Drane Burdick and Jeff Ashton in what appeared to be a little “work wife/work husband marital spat”. Mr. Ashton was attempting to give Judge Perry a potential juror’s jury number. He took a few seconds to look through his paperwork in an attempt to find it when LDB seemed to get a tad annoyed and said “I’ll do it”. Please don’t misinterpret what I’m saying…I admire them both greatly…it was quite endearing actually.

    Btw Blink, quick question about Jeff Ashton…Is he an exceptionally tall man, or is everyone else very short?

    I am so very proud today of the line we have towed for this baby. Any reader or contributor here or anywhere else that has committed their time and empathy in this case needs to stop reading this, and give themselves a pat on the back.

    It matters. It SSSSOOOOOO matters.

    I had to giggle at the work wife/work hubby line, it is so true, but I can also tell you, they have a deep respect for each other in that prosecutors office.

    Jeff is about 6’2. But yes, in contrast, Baez is about 5’4″, Linda is 5’2″ .

    Do you all realize that NO ONE in this family came close to pleading for Caylees life, NO ONE! Casey could have went in her front yard while on house arrest when Leonard Padilla bailed her out and pleaded to help find her daughter, she could have had Greta or Mark Fuhrman inside her house where it was safe to plead for her innocence or for her child, NEVER ONCE did we hear or see any tears for Caylee from Mizz Casey Anthony or any of the other Anthonys, not even from friends or her family? what the hell?

    I sure hope the state brings this up in opening statements.

    I pray to God that Casey has to plead to this jury for her life.

    I have never felt this way before about any mother. How can she even dream about being free? How?
