Caylee/Casey Anthony Trial: Sidebar Silliness- Baez Concerned Casey Will Be Viewed As a Lesbian And Other Wishful Thinking

Orlando, FL-  I know, everyone was looking for my analysis for the week on some of the most influential forensics evidence and experts to date.  You will have to wait.  I could simply not let this go.  Jose Baez, defense counsel for accused Filicidial frequent fornicator Casey Anthony is concerned his client might be viewed as a lesbian by the jury based on some photos in evidence.

I can’t take it.  I thought I could, I thought I could keep it objective.  I admit it, he is a Barristerific  Baffoon Extroirdinaire.

This defendant, this woman, with multiple simultaneous male sexual partners, an unknown baby daddy, the prosecution bases it’s case on the fact that she has a new boyfriend she is willing to kill her child over, and this is HIS REACTION?

“I would just lay out for our argument that any photos that would implicate or insinuate in any way that my client is a lesbian through the dancing she is doing with this other woman…”

It is maddening what an oaf this guy is with respect to being charged with saving a defendant’s life.  Having a jury perceive Casey as a lesbian is like Christmas in June for his client.  Not a lot of cases of lesbian-motivated filicide out there, and what is, is likely to be a new suspect for this suspect generating camp.

At that point Perry cuts him off and asks, “Have you been to nightclubs in the last three or four years?”
Baez says he has been, but noted that the average age of the jurors is 50 and that some members “would be extremely offended” by the image.

This from the business owner turned attorney of the now defunct Brazillian Bikini online store.

Seriously.

Keep the faith everyone – I’m sure Mr Ashton,LDB and Mr George know what they are doing. Don’t forget the Defense have to put their case for drowning!! How are they going to do that and if I understand correctly, if something crops up during the Defense’s case that they can prove is incorrect, they can bring on witnesses to rebut this. Maybe the Prosecution are going to allow the Defense to hang themselves. What do you think Blink? Have they done enough thus far?

  2. SusanNH says:

Oh my, I am just heartsick over all I hear in this trial. I watch every day on my computer. Retired and home.

This girl is going to her doom. She has the very worst representation I have ever witnessed in my 65 years. I would be
jumping out of my seat begging the Judge to stop this clown from
representing me. Isn’t it registering in her brain what is happening to her?

Yes, she surely did make the greatest mistake anyone could have made as a parent. I do not envy the position Judge Perry is in.

  3. New says:

I think the SA has presented their case of the facts they have proven with scienticfic evidence. These facts will be believed or not believed by the jury. Just facts, no gossip juror #4.

I don’t know who this out of town wittness is but I bet it will be factual. I don’t see anything else they could have presented without harming the people involed that have already been harmed by their association with this case. SA job well done.

  4. New says:

The Grand Jury found her potentially guilty of murder without the body. This Jury has heard I am sure the same evidence and more since the body was found.

WE just know too much and want more. Guess those who want more will have to wait for the books.

New- respectfully, the GJ only found enough evidence to indict her of the charges. It is similar to a probable cause arrest warrant, for the sake of this conversation, and has a very low threshold.

Ya know Miss Blink..(lol) you gotta good point there with the plumbing? and I thought the tatto artist too, BUT we also have Mark Hawkins that was also wired and we have not seen his deposition and he lives out of state so who knows who it is? I just wish someone would tell me…. lol

I think it is good strategy to let the defense bring it on and then use the witnesses necessary to bring it home to the Jury, very good thinking.

I have a question for anyone that knows the answer, we heard testiony of Mr. Haskell about how long body in trunk, I would like to know that if the dogs hit in the backyard and nothing buried there only decoposition on top of soil, how long must little Caylee lay out there in the back yard for the dogs to pick up the scent?> does anyone know?

  6. Classygal says:

    Thanks for the explanation Blink.

  7. Charlotte says:

Blink: I know you are busy but I have asked this several times and am VERY curious and I would so appreciate if you could answer. If Casey wanted to see her parents now, would she be allowed visitors now that her trial has started?

She is at court all day, so the visitation hours are limited, but there is always Sunday…

    Hi all,

I feel you wrt to the sudden knowledge the State will be ending their CIC. It leaves you vulnerable to the DT whom most of us don’t side with.
But fortunately ‘we’ are up to bat last. RE: Riverpearl says:
June 13, 2011 at 2:21 pm, Bill S made me too feel secure in this plan.
I think depending on what avenue the DT takes in their defense, we will see much added testimony by the State to refute their idiocy.
I imagine the Botanist is one of the witnesses due to arrive tomorrow, who else do we think they will finish with?

  9. Charlotte says:

Okay, I am really worried. I have watched this entire trial and I must say that people who have not followed this case as we have (jury) only have the knowledge of what was presented. And so far I have NOT seen anything that links Casey to this murder. Why didn’t they use the video when Tony L was wired and Lee was saying how Casey lies just to be lying. Do they have a bombshell under their sleeve? Is Casey going to walk or get a huge lesser sentence?? Blink????

  10. Eloise says:

You know, it just dawned on me. Does anyone think the tattoo would be well used in the guilty phase of the trial, ( assuming we get that) as evidence of her state of mind or her cruelty? I cant think of the verbiage I want, but maybe someone will know what I mean-lol?

Brilliant question Eloise- I do not. I think it will be introduced in the next 2 days.

Blink, Two things are bothering me about the State wrapping up their case. What about the water? Of course the water would explain the absense of DNA & fingerprints, how the heck can they “wrap up” without bringing up the water she was submerged in? The other thing is the tattoo.. seems pretty important to me.

  12. Eloise says:

OMG- Wendy Murphy is on HLN right now, stating the State didnt prove their case b/c Caylee was not with Casey on the evening of the 16th or the 17th. Somehow, she says Casey didnt have her car at Blockbuster, so ‘who knows who had the car.’ She says Christopher Stutz testified to Casey driving a Jeep on the 17th. Vinnie P is having a stroke trying to tell her that B.Burner testified to the shovel, backing in thing- to no avail. She says there is no evidence Casey was the driver of the car or that she murdered her child.
I am at a loss for words with this gal. Are we sure she isn’t a covert defense strategist? lol

Lol, I think you mean covert opportunist, lol, and yikes.

What do y’all think, an open letter to Ms. Milano- or let it ride?
    B

  13. Eloise says:

Oh Blink you are funny. I just can’t see her point, and maybe it would be informative to understand what actual evidence she is basing these claims on. Maybe we all have missed an entire day or two of testimony.

E- I am not feeling like I want to commission a bust of anyone soon. Sigh.
    Gonna gather and write.

  14. Starsky says:

Perhaps a dumb question Blink, but what about the other charges against Casey? Can she serve jail time for misleading investigators and not reporting her child missing/child endangerment? She will most likely get SOME time, correct?

Not dumb at all, yes, she has already admitted through counsel she lied to LE, that is a given.
the rest, remains to be seen.

Excuse me if this has been discussed, but, what about Casey’s reaction to the ‘unidentified’ body (that turned out to be precious caylee) down the street from her home. If Casey didn’t know where caylee’s body was, why the ‘Omg, I’m in deep’ reaction? And, why hasn’t that been brought up at trial? Did I miss something? I believe it definitely points to guilt.

Blink, love your site. Been a fan of what you a sm do since natalee.

    Jessi -

The video of Casey in jail with her reaction was not allowed in by Judge Perry earlier this year so no … the state will not be mentioning it. I was hoping the jury would’ve seen it too, but the defense actually got their way on that one {:(

What is the likelihood in your opinion when (if?) Casey is convicted the jury will convict her on 1st degree pre-meditated murder with the evidence that has been presented in this case?

For me, the duct tape alone is enough to make me see visions of needles to arm in my head, but I’m not feeling very sympathetic these days. No idea what the jury might have been thinking/feeling the last several wks. Would love to hear your personal opinion on the matter.

I am going to address this later this afternoon, I am not sure how well received it is going to be.

Does Dominic Cssey’s testimony come in at all? We never did hear what he said in deposition. Seems it could be proven that he was part of the cover-up by the family for Casey – No?

  18. Dellastreet says:

HLN is the “defense team network.” This is not fair and balanced at all. Look who all they have on as contributing talking heads and now Linda Kenny Baden. Sheesh! These are all people paid for testifying at trials. Good grief it is enough to cause one to have a stroke. Add Wendy to the mix along with Geraldo and it is all stacked against the prosecution. What a mess. I sure hope the Prosecution knows what they are doing. I am very worried. I need a pep talk from Bill S. from channel 9 in Orlando.

[snipped] While this is being said, Casey appears to become very angry and mouths the words, “this is private”…which is an interesting statement in itself. Not sure about Florida law, but in my jurisdiction all of what is introduced into trial basically becomes public record. In other words, not private at all.

She seems to have no clue.
    ——————————————————

Hi Grace, yes, ever since Caylee’s remains were found the defense and the Anthonys have wanted Caylee’s death to become a private matter. This after blitzing the media berating everyone from LE to the public for not doing enough to find Caylee.

I am reminded of Cheney Mason’s question to Dr G; What if a child is found obviously dead, what then? (Concerning calling 911.)

Sheesh, as if what one does when their child is found dead is a private life style choice.

What happened to Dominick Casey? Did he just ride off into the Sunset?

Good question, but again, I want to point out that although the prosecution changed up their game when they learned about Casey’s “admission” , I am not sure I would put him on the stand either, his state deposition being sealed not-withstanding.

Thank you Blink. I just have so much to learn about the Legal System. One thing I know is that she is guilty and unless there is a hung jury she will be convicted.

Blink, if you’re thinking of an open letter to Ms Murphy Milano, I’ll second that. I didn’t understand why you didn’t point out her “what happened what month” mistakes three weeks ago when you followed her on the Pretzer show. (Actually, I assumed you didn’t want to embarass her publicly.)

annals, correct me if I am wrong, I thought I did point that out, if I did not, your correct, I assumed that she would update her information following the show, and certainly prior to the piece she ended up putting out after the fact.

I have a question for the MSM who keep putting her on, espousing incorrect facts-

Why does nobody correct her, or ask her for her source to support her statements?

I know that I did discuss it specifically on last week’s show, and I tried to trick Dana into thinking Wendy was right and I was wrong, lol- He did not buy it of course.

I am working on a piece for later this afternoon, and for discussion on tonights show, will post link when I publish.

Blink and All, i for one think the State “did us a solid” and the def.’s turn will be interesting, baez and his show will allow lots more in IMO, i’m guessing this is more like a game of chess – the State set the stage, and is more than ready for where ever the def. will go, i’m all in, she will receive guilty verdict, sorry baez don’t know anything you could say to change my mind about that, i’m just not sure if she’ll get to live out her natural life or not, i don’t really care, common sense has to prevail here!?

  24. c10 says:

Blink, will you try, after this trial is over, to fill in some gaps for us? i believe and will say again, you are someone who knows alot about a lot of things… please?

  25. connie says:

As I stated earlier, I believe Casey Anthony will be found guilty and sentenced to death. The circus that Jose Baez has made with this poor little girl’s death is unforgiveable. The opening statement was vile and as unattractive as his personality. He is making a mockery of our court system.

  26. Sammy says:

I’ve reached the point that when I see Wendy Murphy is on the panel of talking heads I immediately turn the channel.
There’s simply no excuse for her to continue to be so misinformed about the known facts of this case.
More than a few legal experts have pointed out to her the facts and corrected her misstatements – yet she continues to spout off her BS.

Well, there is one reason for her to continue spreading her mistruths … (the only one I can think of) which is $$$.

Suddenly Ms Murphy is being courted to appear on TV more than I’ve seen her before.
Why? Because she’s very vocal with her pro defense rants.
These entertainment shows that try to pass themselves off as “news programming” are all about the ratings, and Ms Murphy draws in the #’s with her half-baked claims.

And if I needed another reason not to tune into InSessions ever again …
it was announced that Linda Kenney Baden has been picked up as a regular for the duration of this trial.

If these TV shows were newspapers … I’d wrap fish in them.
    Scruples in reporting?
Not where these two are concerned.

Uh, she is a consultant for the defense, has that been disclosed? Journalistic integrity in a can, anyone?

So Linda Baden is going to be an on aire analyst during the defense’s case, which she is a paid member of?

I certainly hope the JAC is not getting a bill from her.

As far as Wendy is concerned, as a former prosecutor, and now in private practice- I dont get it.

  27. A Texas Grandfather says:

    Eloise

You need not worry about what Ms. Murphy is saying. Where she is getting her information is a mystery to me. But remember, it is the jurors who really count regarding the prosecution’s case.

The powerful testimony of Dr. G and Dr. Haskell are bound to make the jury realize that Casey really is the person who took Caylee’s life and deposited her like a bag of trash in the wet woods a half mile from home. It is true that no one can say with certainty that Casey did it. The State has already shown that the DT theory is full of holes. George didn’t do it and Caylee didn’t drown.

We can only conjecture what actual part the chloroform played and how Caylee may have been restrained with the duct tape.

My take on the whole thing is that:
Cindy and Casey got into an argument on the evening of the 16th.
The basis for the argument was the fact that Casey was taking
Caylee with her while partying with the guys when she aught to
have been at home seeing that she was cared for in a proper
    manner.

Being the type of person she is, Casey could not stand the
acusations of her being a bad mother from Cindy. In her warped mind
Casey decided to eliminate the problem. Did Caylee say something
about wanting to stay with Cindy rather than go with Casey that
pushed Casey over the edge? I know from experience that when
sociopaths are cornered, they become very angry and will take the
anger out on the nearest person. Casey was too small to attack
Cindy with success. There was a rumor that Cindy choked Casey
    during the argument.

Sometime on the evening of June 16th Casey made the decision to take
    Caylee’s life.

  28. WPG says:

We haven’t heard yet about the forensic results on the 4th piece of duct tape or the raised heart on a ripped piece of matte board that were entered into evidence on Saturday through CSI Jennifer Welch’s testimony (other ripped pieces of matte board were also found, btw).

Here’s hoping something was found on these items and that they weren’t as exposed to the elements like the other 3 pieces of duct tape were . . . maybe under a thick layer of leaf debris or something.

    Eloise and Blink,
Looking forward to testimony on that tattoo, for sure.

  29. Eloise says:

I thought I would share that I have just re-watched Baez’ opening statement. I thought it a good idea to refresh on the points they felt important to discuss and to have a potential preview of sorts on their defense. LOL. Sorry, being serious here- my husband missed this part, as he has gradually begun to be more interested as time goes on, news accounts etc. He was laughing out loud, and remarked on the same areas we have all had in contention. I have many comments I could make, but there is only one area that I think, depending upon whether it is revisited, will be an issue. The non-odor reported by Tony when he helped her refuel via the gas can. June 20th, on the neighborhood road. Then you have Geo taking the cans back on the 24th, no notable odor. I cant make sense of this, and I wonder what the jury may think. Could the cleaning attempt have brought the odors to the surface? I don’t know- but I hope this is explained in some way.

PS- Judge Judy just told Geraldo his review of the case is HOGWASH. lol.

    What I really think.. lol.

We have a situation where imo, George and Cindy were on board to lie for Casey’s protection, as they did not believe that she was involved initially, and moreover, it is my further opinion that they felt OCSO was “wasting time” on Casey and should be looking elsewhere, so we are aware of there efforts in that regard.

The problem is, in reference to George, his statements generally help both the prosecution and the defense at this point, and he is married to them.

I have also said, I do not believe that Casey ran into George on the 24th and I think the entire story was concocted to do accomplish exactly what you mention. I would like the State to present their evidence to support where Caylee was placed, and when, and when she was moved to Suburban.

I really think at this point we are asking jurors to connect too many dots, but again, we have 2 more days of the states case.

In Jose’s opening ridiculous statements he makes it sound as if the abuse was so bad on Casey that paternity test was done to see if he was Caylee’s father. That was checked only because of this case. So, he is trying to say that Lee was still raping Casey when she was 20ish. How stupid. It is obvious that Jose has gotten ideas from blogs media etc to build this case. That all started when it seemed like the whore did not know who the father was and speculation from outside view began surfacing, Not because his client told him that. After they got wind of that, they thought, hey what a great defense. Now we just need to tell Casey to start up some fantastic lies and get them on paper and pass them along so we can get the wheels on this bus turning, and they were on their way. Hey and why not make it even better and get my dad involved in raping me too. Let’s go ahead and start with 8 years old. That sounds like a good number. Jose is on a very bad path in his life right now representing this girl… He is all tangled in the black widow’s web. I wonder when his regrets will begin.

Blink, I’ve been so concerned about the Prosecution finishing up that I started thinking over the evidence. It occurred to me that Elizabeth (forgotten her name, FBI print lady) only mentioned 3 pieces of tape and she told Mr Ashton that no prints were found on any BUT what happened to the fourth piece? Did she get it, was it tested for finger prints, did she find any???? If the answer is yes, I don’t expect this to be posted, but would I be over the moon!!!!

I have to be honest Chelsea, I am not going to be able to discuss that specifically until such time it is either discussed in court, or the trial ends, I know you understand.

My opinion only, the “witness” landing this morning at 11:00AM in Orlando and will be in court by 1:00PM is the person with finger print evidence on the duct tape. I can’t think of anything else. The PT added the death penalty for a reason. KC’s fingerprint on tape is the slam dunk.

If not fingerprint, something huge to cement the PT’s argument. Ashton and team too smart not to have something to seal her fate.

  36. PaMom says:

I think Casey is guilty. I think she will be found guilty of second degree murder and she will walk in 10-15 years. I don’t think Caylee needs justice; it is already in the works. What goes around comes around. I really think the main concern is keeping Casey in prison through her child bearing years. If she gets away with this, she will repeat. She hasn’t spoken a word of truth yet. She is a future danger to any child in her care and also a danger to anyone that testified against her in this hearing. Hell hath no furry!

Oh boy. It doesn’t sound good. We promise not to shoot the messenger! I was sitting on the fence before Dr. G. took the stand. I thought if anyone ‘connected the dots’, it was her. Her testimony alone appeared to shoot a bow in the heart of the drowning theory.

If she isn’t charged with 1st degree, what is the most likely conviction? Surely the jury sees Casey was involved and that it was no accident. I would like to believe she will be found guilty on the other charges and most likely sentenced to the harshest punishment allowed. Combined that with a lesser charge in Caylee’s death, is it not conceivable she will spend the rest of her life in prison?

She has tried to remain out of sight and she is gonna take a chance and go into the home. George even says something to the effect that she jumped at the sight of him. FISHY!!!!

  40. Blessed Mama says:

I believe the state has done a good job so far, but I feel the same as you, Blink in wishing they connect the dots for the jurors. I keep reminding myself they have one or two more days to do just that and also closing arguments. I guess they also have rebuttal witnesses too if need be.

I think I was naive going into this trial. I thought that there would be answers forthcoming to explain how someone, a mother no less, could do this to her own child. It finally hit me last week that we will never really know why. No answer will make me understand it. I am not sure why I ever thought there is an answer to understand the murder of a child. Caylee and my first born daughter were born just a few months apart. I look at my girl now and think of poor Caylee and what she would be doing and it breaks my heart.

I look forward to your new piece and any further insight you can give us. One question, is there any way to introduce the alleged fight between Cindy and KC? I am guessing there is not since Cindy is not going there. It would be hearsay from Jesse, correct?

  43. Mom3.0 says:

    Hu guys-

Mommy commitments kept me from watching the past two court proceedings live- I caught them later though. Thanks to everyone for keeping us updated.

I am surprised that the prosecution will most likely wrap up their case by WED.- but my surprise is not due to any worry that they didnt prove that Casey killed Caylee.

They showed that Casey cared little for Caylee. They showed that Casey is a liar who lies to benefit herself in someway., and they showed that she wasnt living in the land of make-believe or in the land of denial over some accident- but that she infact makes up “better” lies when her previous lies are no longer working- or when she comes to an end of the hall.

The State has shown that Casey had opportunity after opportunity to claim accidentally drowning /cover-up but up until recently she & her defense thought she could go with either Zanny did it- Roy did it- Jesse Did it- Caylee’s alive outthere- ect ect.

Up until very recently Casey sat in jail claiming not to know what happened to her daughter-

Up until recently she NEVER accused George of any sexual abuse- not even in her letters to cookie-

Suddenly Casey not only claims she was abused sexually by George but she claims that it was long- time abuse -and that she was afraid of him and “did everything to protect her daughter from him and her lying family…

She claims that is why she lived a lie and made up a job and all the rest-

The State showed that Casey had NO PROBLEM leaving Caylee alone with not only George but with her mother as well.- She left Caylee alone not because she had to, but because she wanted to- There was no job- despite emails and lies- there was only ME time that Casey wanted.

The State showed that Caylee was dead in her car- they showed she lied about it all- Caylee had ducktape around her mouth and Dr. G did an amazing job of pointing out that there is never any reason why a child should have ducttape covering their mouth/nose. Dr. G pointed out that 100% of the accidental drownings are reported.

The State showed that there were searches on the computer for nefarious things one of them chloroform – on site on how to make it- hit 84 times- and there was chloroform in the trunk.

The State showed that the trash was not the source of the hair or the flies/bugs ect.

According to the defense Casey knew that Caylee was dead from June 16th on- she never cared. She claims it was an accident and that she allowed her molesting father- to do what he wanted to Caylee inorder to “help” Casey avoid Cindy- but she claims that he instead set her up as a fall guy- and she chose to remain silent for 3 years despite it being an accident and George, her molester, actively working to put her away for life- she stayed in jail and spoke lovingly to him in jail visits- and never mentioned abuse- and never cried foul- but instead had her lawyer go on show after show- claiming ZAnny and an alive Caylee- until the body was found -then she switched to RKronk-ect and now changed her story again…

    Totally unbelievable-
there was no accident- an innocent person shouts out the truth and does not offer up unbelievable lies – and remain in jail for years over the accidental death of her beloved daughter-

The State showed the truth Casey Anthony is a liar and a killer and will change her story on a dime if she thinks the previous one needs tweeking- and she has no qualms at damaging whomever she needs to inorder to float another lie- even if the person is her father her brother her mother or her innocent baby girl’s legacy.

    AJMO-

I hope the jury can see the simple truth behind the facade of Caseys lies.

  44. Tarheel says:

Well then if they would have to disclose the fingerprints before trial, then I guess the obviuous conclusion is that they do not have her finger prints on any piece of duct tape. Could there possibly be ONLY her fingerprints on the sheet of stickers from which the heart sticker was taken? They have to have SOMETHING or she is going to walk!

Blink I am looking forward to you next piece, I was so hoping that you would be able to share all of your back stories with us soon. I know you have so much to say.

For your enjoyment- it seems that Casey isnt the only one that has proven themselves a liar- Not to be trusted:

I just read this story about the side bar at the end of the day-

Mason tells JPerry that they may not put on a case and JP shouldnt have told the jury that the defense would be presenting evidence. JPerry says then you all lied to me-

    Very interesting exchange- IMO

Just an interesting view from a body language expert and jury consultant sitting in the courtroom.

    SURPRISE WITNESS?

But McRae said unless the defense has a surprise witness, Casey seems to be the one person who could explain her attorney’s claims about the drowning and sexual abuse.

“If Casey Anthony is the only hope that Casey Anthony has to get an acquittal, you have to look and see that the deck is heavily stacked in favor of the prosecution at this point,” McRae said.

Susan Constantine agrees. The body language expert and jury consultant has watched the trial in person, carefully studying facial expressions and body movements by Casey and jurors.

When prosecutors displayed a close-up photograph of Caylee’s skull, Constantine said Casey breathed high in her chest and balled her fist so tight her knuckles turned white.

==>”I saw fear and worry. She was having a panic attack,” Constantine told Reuters. Casey’s nose also crinkled up several times “which is recalling an odor, recalling something that was disgusting to her.”<==

Though there are likely weeks to go in the trial, Constantine thinks the verdict is already in.

"In my opinion, they've already decided guilt," Constantine said. "They've got her number. They're just tying up all the forensic details."

    Blink …

As I understand this, after the defense presents their case, the State is up again for rebuttal.

Question please – during the States rebuttal phase, are LDB and Mr Ashton limited to ONLY bringing up information and calling witnesses that are related to whatever/whoever the defense introduces during their stage?
During rebuttal – Is the State only allowed to call witnesses that specifically have to do with whatever story the defense introduces, or can the State also introduce evidence/witnesses that have not been previously brought into the trial? (and then the defense would of course be able to cross exam?)

    Hope that makes sense.
