Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

    FWIW, but I don’t think it’s worth much, the Dr. Pickle posting on Olive & quoted on Alternate Theories, was allegedly Rachanda Pickle’s father. I tend to believe it was. Not sure why he would post there, but anyway, I seem to recall I found a connection to Kyron’s family via the Tarver family, but don’t quote me on that, because I truly can’t remember and am not sure if I kept the details.

    This is just all becoming so much more sad as time goes by and less and less is mentioned about Kyron.

    That’s my impression too. This case has ceased to be about Kyron. We know no more than the first day. The successes of this case has been total isolation of Terri Horman, disregard of her rights in divorce. Kaine has become something of a celebrity as spokesman of LE and his own Foundation with money coming in. Intel has never confirmed his presence on campus but never mind. Intel owns the city. Skyline school is in the clear because they lawyered up early. DA has shaped it all, though none of it involves Kyron.

    Skyline school is sacrosanct because of union. DA is sacrosanct because everybody believes they “know something”. Intel is sacrosanct because they donate tons of money to PPS, PSU and all sorts of other htings. Poor Kyron. He is lost in all this.

    Can’t help but wonder if Terri knows something uncomplimentary to K and D and Intel and PPS, and that’s why their one and only success is to ISOLATE HER. make it so she has no communication, no credibility. Think about that.

    ALOHA – A 7-year-old boy told adults that a man wearing a mask tried to grab him at an Aloha park yesterday afternoon, Washington County Sheriff’s deputies reported.

    Washington County authorities said the attempted kidnapping was witnessed by another child at Melilah Park, where it happened.

    The boy, who wasn’t hurt, told authorities the man also tried to take a golden bracelet he was wearing, said Sgt. David Thompson, a sheriff’s spokesman. The boy managed to run away and was safe.

    The boy was at the park at 2900 S.W. 182nd Ave. with a number of other children and a woman, who was supervising them. Thompson said the group was playing hide and seek at about 5:41 p.m. when the woman realized the boy hadn’t found the other children. She began looking for him and found him crying and running toward her.

    The boy said a man ran toward him and said, “Come here!” then tried to grab his wrists. The boy said the man had a black mask that covered his face and head, a black T-shirt, black pants, and a black watch. He said the man had a high-pitched voice.

    Thompson said an 8-year-old boy in the park said he witnessed the incident and added that the man was wearing a ski mask.

    Thompson said deputies searched for the man, but didn’t find him.

    Anyone with information about the incident is asked to call the Sheriff’s Office at 503-846-2700.

    BEAVERTON, Ore. – Ridgewood Elementary in the Beaverton School District sent home a letter with students Wednesday, warning them about a strange man who offered candy to a fifth-grade boy walking to school.

    The boy said “no” but the man didn’t stop there. As the boy kept walking, the man followed him in his red pickup with yellow markings and dark tinted windows into the school parking lot. That’s when the boy went to school administrators to report the incident.

    The district contacted the Washington County Sheriff’s Office, which investigated. But deputies said it’s not illegal to offer candy to a child in Oregon even though parents may view the incident as an attempt at child enticement. Deputies said they don’t consider the morning incident an attempted abduction and even following behind as a child walks to school doesn’t change that.
    The boy did not give a description of the stranger but deputies will pull the man’s vehicle over if they see it and ask the man why he offered the boy candy. But legally he doesn’t have to say a word.

    PORTLAND, Ore. – Two girls told police a masked man tried to grab them off the street near a NE Portland elementary school, but officers later said they believe the incident never actually happened.

    A Portland Police spokesman said officers received a call around 3:15 that a man tried to abduct two girls near Jason Lee Elementary School.

    Around 4 p.m., KATU.com posted a story about the attempted abduction quoting police spokesman Lt. Robert King.

    Officers searched the neighborhood and didn’t find the suspect. They also couldn’t find any other witnesses.

    Around 4:30, King confirmed that they thought there was no attempted abduction. He said parents have no reason to be concerned about a potential kidnapper on the loose.

    BEAVERTON, Ore.

    Another incident that happened on Nov. 30 is still being investigated as an attempted abduction. According to police, two white males in a car approached a 6-year-old boy who was walking home in the parking lot of the Monte Vista Apartments in the 14900 block of Southwest Scholls Ferry Road. Police said a passenger got out of the car and offered the boy some candy in an attempt to lure him inside the vehicle. The boy ran home and reported what happened to his father, who then contacted police.

    Police are still trying to track down the two men, who are described as being between 30 and 40 years old. They were driving a newer, white two-door sedan with dark-colored horizontal stripes down the side. The car was possibly a Nissan.

    The passenger who spoke to the 6-year-old child was described has having unshaven, scruffy facial hair. He was wearing a white hoodie sweatshirt along with a black coat or sweatshirt.

    The press conference was not really early in the investigation but I would think the information was gathered early on. Someone said they saw a second person in TH’s truck. Now, if that is not true, who the heck started this wild goose chase? Someone from the school. Maybe in their zeal to gather incriminating information against TH, LE accepted witness statements on face value.

    Several sources in the Skyline community, including people who have spoken with investigators, told KGW about this sighting of an unknown adult but they have not said whether the person was a man or woman.

    Police are investigating reports that two men in a van tried to abduct an eight-year-old boy Friday afternoon in Southeast Portland.

    Officers were sent to Southeast Gladstone Street and Gladstone Drive near the north foot of Powell Butte on reports of an abduction about 12:50 p.m., said Sgt. Pete Simpson, a Portland Police Bureau spokesman.

    The boy, who was not identified, told investigators that he had been walking to a friend’s house when a van pulled up beside him. A man in the van pulled open a sliding door and asked the boy if he wanted to get inside. The boy refused, and the man tried to grab him.

    The boy ran to his friend’s house then went home, where his mother called 9-1-1.

    The boy, who was not identified, described the suspects and their van as follows:

    The driver, a man, wore a dark ski mask, dark clothes, and possibly had hazel eyes.

    The man who tried to grab the boy was in his 30s or 40s, had a medium build, light-colored hair, a 2-inch or longer goatee, dark clothing, and also possibly had hazel eyes.

    The suspect vehicle was a dark green, full-size “work” van with a sliding door on the driver’s side.

    Officers searched the neighborhood but could not find any vans matching the description.

    Anyone with information about this incident or this vehicle is urged to call Portland Police at 503-823-3333.

    sorry to hog the board tonight. Blink got my mind off of conspiracy theories involving th and thinking about a “sz” and she recently said somehting about a profiling class and i started thinking: if it was a sz who would likely offend again, it would maybe be one that had before, or attempted before. i started seeing all these previous attempts to lure young boys in the area. the three most interesting are the one from aloha in 2009 and the two a year apart with two males. it would be obvious that the area had one single or two sz’s attempting to snatch a young boy 5-8yrs old for quite some time. again sorry for so many posts.

    It is possible a very planned abduction of a boy from Skyline was both sexually motivated, and motivated by place to taunt & put in turmoil LE, rather than motivated by a particular family or child.

    –a PPS mostly like to have a white demographic
    –the only PPS set in rugged wilderness proximity making SAR recovery virtually impossible
    –the PPS in MCSO jurisdiction (suspect unlikely to know of compact giving PPB jur over crime scene) lacking seasoned homicide detectives

    the political backdrop: new internally promoted Sheriff who could 1) carry forward old corruption or 2) clean house. Kidnapping ensured a lack of human & financial capital for both.
    A newly appointed internal promotion to PPB Chief who vowed with Adams/Leonard to straighten up Dept. Kidnapping distracted human & financial capital.

    Under the above constraints, perp could have planned a crime against a boy inside school property (a very unusual abduction) in part to taunt & sidetrack LE from other clean-up priorities.

    Certainly ended up well from the perp’s standpoint, with a long time river patrol deputy now in charge of mcso’s investigation. Maybe it was a river drug runner motivated to distract river patrol because at that time there was heightened river patrol supervision under Lt Brett Elliott.

    your posts are an excellent reminder of the fact that the botched up investigation of Kyron’s disappearance leaves the perpetrator on the loose, and it’s sounding more and more like it could well be one of these operators described in the articles. Or at least someone other than Terri, whom they have scrutinized this whole time with no apparent results.

Cuz IMO, they were at the time, trying to figure out if anyone else there was driving a white truck, F250 or F150, in order to narrow down whether or not it could have been a different vehicle that the witness(s) saw a person in.

    If the truck on the access road was indeed Dave Stensen’s and not the Horman truck, and some witness had the two trucks confused, I wonder if that is one of the places that a witness said they saw another person in the truck. Was Stensen alone that day? Did he have a landscaper helper maybe? Just somethin’ I’d never thought about. Would be interesting to know if that is where one of the witnesses said they’d saw a second person.

    It continues to baffle and astound me how one person (KH) has the absolute and amazing power to banish another human being (wifey dear) to the far corners of The Kingdom, take away her beautiful baby, and another baby that she has cared for since he was born and whom I’m sure she loves a LOT, and her pretty little Mustang and leave her with nothing (not even any money to buy potato chips if she wants them).
    Her best revenge would be to suck in her stomach, lose weight, get beautiful again, and then make him eat worms.

    I think I’ve wondered a time or two if the Stenson, the groundskeeper, was totally cleared. It would be interesting to know when he left the school in his truck, and if Kyron might have been in there. I doubt Stenson would have entered the school (people would have said), but maybe if he had someone else in the truck, they could have gone in.

    It is my sincere believe that there has been an absolute 2 year old hissy fit tantrum asking to do just that.

    Unlike Rackner/Engle, Bunch has asked for visitation since the beginning as he stated in his last document which supports the fact that things are going on behind the scenes unlike what the haters have stated. They think that unless it’s in the biased media that nothing has been going on and Terri isn’t fighting for her daughter. Not suggesting that RedRose is stating that at all. Kaine is using the baby as a weapon against Terri knowing full well her KIDS are the most important thing to her evidenced by statements from her friends which have now been tucked away in the media pockets.

    Look what is happening in the case now, Bunch calls Kaine’s bluff and we are in stall mode. No depos taken for Desiree or Tony, avoiding it like the plague for Kaine too. I don’t buy the “Kaine knows stuff” by DA Rees. Keeping a parent aware of the search for their son versus giving them inside information which in itself compromises the case is not Terri’s fault and most certainly not Kiara’s but they have apparently done just that. Why are we in April? So much for the 2 week response from the judge who is biased and IMO shouldn’t be on both civil and divorce cases.

    Repeat: why should Terri and Kiara pay the price of separation for DA sharing info they should not have done.

    don’t see how they can have cleared Stenson since nobody realized he was there until he came forward a couple of weeks later and told them! besides he’s also a union member so would have lawyered up too.

    Somehow it never penetrated my thick skull what you all have been saying about MCSD and PPD. If the school had been designated the crime scene, PPD would have been in charge of the investigation (and the overtime) but since they turned it into SAR, MCSD was in charge (of all the overtime).

    Did either of them care about finding Kyron? or just milking it. or do they know the school held clues but didn’t like what that meant so looked elsewhere. It gets more confusing and more disheartening the more we look at this picture.

    I am suggesting reasons why perhaps this school, alone of all schools in this District,
    would be targeted by a sexually motivated offender. The school being targeted, not kid per se.
    The Offender may have had more than one ball in the air.
    Corrupt officer in any of several local forces; drug distribution (heroin, meth, mj); porn investigation to distract from, etc.

    –Skyline notable for challenging wilderness surrounds (disposability)
    SAR impenetrable
    –911 (& investigatory responder in Chief) was Not PPB but the hapless mcso
    (with weakest investigatory capability vis a vis Gresham, Portland, etc)
    –diffuse, noncohesive parent body (run by a few pta captns imo)
    –high proportion of new probationary teachers, including Kyron’s class, per PPS site
    –multiple entry /exit points viewable online

    other issues:
    –abduction= a compleate barrier (human & financial capital wise) to clean up of MCSO even were Staton so inclined.
    –also a compleate distraction from any river patrol scrutiny of drug trade or other criminal activity on the River for a period of time

    In 2008, the former head of the Portland FBI became the new Milwaukie police chief. Robert Jordan, who spent 27 years with the Bureau, maintains that position today. Milwaukie police helped with the tip line early on, but were not asked to be involved in any way after that even though making it clear they would help if asked.

    Once a month since 2008, I have met with the Chief as part of a citizen’s advisory group. The most remarkable things about him (to me) are his expectation of the highest ethical standards, his connections with the community, and his willingness to “be ordinary and accessible”, which of course really isn’t ordinary at all.

    I’ve wondered why Milwaukie was not asked to be involved to a greater extent. We have highly trained officers and are an accredited police dept. We may be less experienced because our crime rate is low, but I guarantee you we’d have done a better job than what I’ve seen so far. (One of our city councilors retired from a long career with Scotland Yard. Small world, I guess.)

    I’m beginning to wonder if it was because our Chief, who also has a law degree, would (I’m confident) have asked a lot of questions about the investigation itself. I know he respects “chain of command” (so not publicly), but I also know he holds ethical behavior in the highest regard, and I have no doubt he knows a lot about the functioning of the people and departments we have discussed from his experience with the FBI and as a Chief. JMO

    I used to think the most important thing to consider when buying a home was the success of the local school district, which I think is important whether you have kids or not. Now, I’m more inclined to believe the integrity of law enforcement is a more powerful factor in determining livability, although harder to examine.

    Kaine & Desiree’s overarching post abduction management has not been collaborative but highly competitive as parents imo.
    He cornered the artifacts, website, control of $ raised. Did he put the initially co-fundraising Desiree on the BKH Board & give her a voice in distribution? No, his Mom was Board secretary; his Dad ran the website. So, her Dad did a little complaining, & she went to Billboards for her voice.
    He had a suit. She filed a suit.
    He raises $. She raises $.
    He talks to OLive & gets stories printed.
    She holds pressors.
    So just maybe this “LE told me” stuff they share is motivated
    by a naturally competitive relationship rather than
    any proactive LE intent.

    I believe it’s gone way farther than that with Kaine, particularly with DA harping about how damaging it would be to the case to have Kaine deposed. Also throughout the almost 3 years, Kaine was the one who did video interviews, held pressers. LE stopped talking a long time ago. All news comes through Kaine, particularly since he and Desiree went separate ways with fundraising. Not that he really tells us anything, just the same thing over and over, but that’s all we know. LE has released virtually nothing.

    Ahhh…There it is. RS was the unknown person in *a* white truck at Skyline School on 06-04-10.

    Says a lot that they had to track him down. Hard to believe they found him credible enough to stage the sting with the DEA. There is a drug element, a kidnapping and a more than likely bogus MFH element that was introduced to divert the drug and kidnapping elements. Now if RS would have stepped up day one and said he had an affair with TH and she tried to hire him to kill KH, then maybe I would believe him.

    On June 18, they began circulating fliers with her photo and a picture of the white truck she drove to and from the school on the day Kyron vanished.

    About that time, investigators tracked down a landscaper who told authorities that Terri Horman had tried to pay him to kill her husband. Then on June 26, detectives sent the landscaper back to the Horman home to get taped corroboration of the alleged murder-for-hire plot.
