Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

    some issues about what Kaine says and how he says it.
    First, he told of how Terri complained to a girlfriend that she flunked her lie detector test. This was not intended for public broadcast yet he did just that. What guilty person would say she flunked? He apparently didn’t think about that when he spread it around.

    The other weirdness is how he talks. Like a robot. LIke he is speaking to a conference, a seminar, a business meeting. He tells us how he is grieving, misses Kyron, etc, but he does not EXPRESS emotion. Look at some of his interviews. Utterly controlled. and controlling. When he threw those reporters out of that press conference he made it clear that to get access to HIM, you needed to follow his rules. Ask only approved questions. What’s the deal with that? What dad takes time to shave his head and eyebrows before he appears in public to talk about his missing son? we all talked about it at the time, and tried to understand. He strives to present a blank slate and convince only with carefully controlled words, not body language.

    KH denies knowing the landscaper, yet he is reported by BOC to have set the wheels in motion for TH to fire him the May prior to Kyron’s disappearance, which was mere weeks. What is so terrible in saying I told my wife to fire the landscaper? Could KH’s knowledge of RS be an explanation of his overall odd behaviors and contradictions? I think we need to add KH’s denial of knowledge of RS with the odd occurrence of the DEA injecting themselves in to what should have been Portland Police or MSCO jurisdiction, and see where that leads.

    Rudy is the owner of RS Landscape Maintenance and the alleged former landscaper/ love interest of Terri Horman. He is also the man who says Terri Horman asked him to murder her husband Kaine late last year. Investigators clearly believed his story as it was the basis for an attempted sting on June 26th by MCSO including an undercover

    It’s wise to remind Blink thinks a DEA Repr at the doorstep posing as tge assassin to be or compatriot of Rudy is significant.

    On the other hand, I’ve suggested
    1) DEA personnel were likely the only reliable
    source of HISPANIC LE investigators in the likely whitery- tighty world
    of mcso gresham et al.
    2) DEA personnel were likely the only experienced “sting” LE accessible to mcso other than PPB with whom Staton seemed to have an iffy relationship–likely not gonna ask Reese for a “Sting-er” as Reese would opine on the operation.
    3) the very involved hands-on-in-front of the cameras relatively new FBI local office’ Dir background was deugs & DEA related.

    So I don’t read much in to recruiting an Hispanic Sting prop from the local DEA. Probably the lical Secret Service has more Hispanics than mcso.

    Maybe Rudy is a DEA snitch and the DEA wanted to make sure no harm came to him in the sting. For all they knew TH could have answered the door with an implement of singular destruction(ISD) and used it on Rudy.

    Good question. The Feds descended on Portland after Ky disappeared, Kaine did go silent for a time, and there was an explosion of drug and child pornography busts. I also think there is a Tax Evasion/IRS component to this.

    And I think any of it could apply to either Horman, RS or even DS. Or maybe it has nothing to do with Ky, but there does seem to be a connection. Remember Desiree saying something along the lines of Kyron saw it all, or was a part of it all. Something like that.

    there is no such 911 call in the court file. I’m sure Houze would have requested it if it existed.

    That information would be work product. Why would he intend to verify something that might implicate his client? How do you know he has not? There is no burden on his part to share that information.

    I know reporters don’t give out their sources, but I would just love to know who these “multiple sources” are here. It wasn’t Kaine, nor Desiree and Tony, because according to them, they knew nothing about a doctor appointment (at least at the time). So who are these multiple sources? Hmmmm, who, other than someone from Kyron’s family or his own teacher would be aware of any doctor appointment in the first place? Katu is quoting “multiple sources” saying Terri told these “multiple sources”, days before June 4, that Kyron had an appointment June 4.

    Who could *they* be? If one was Kyron’s teacher, who was the other? If neither of these sources were Kyron’s teacher, then who in the heck was it?

    I’m not a reporter, but I know I wouldn’t report anything like that unless I had seen something in Terri’s own writing that said Kyron had an appointment on June 4. I wonder sometimes just how much of this *reporting* was based on hearsay and just who was out spewing it.

    LE/DEA knew TH had a gun in the house. She had already called 911 to say she was physically harassed by RS in May of that year.
    If TH had been the murdering schemer that LE thought she was, then shooting RS and claiming self defense would be the perfect way to shut him up forever. I believe she had already reported him as an intruder on the property that day.
    I’ll bet RS was wearing a bullet proof vest when he went up tho the Horman’s door that day. The DEA agent may have gone along to make sure nothing happened to their snitch RS.

    Canby’s son Traverso was a major informant to save his own bacon informing on multiple PD customers, so imo all PDs would itch to arrest him as a snitch on police for anything (& imo an addict will reoffend, & this addict especially will fear, resist arrest. After all, if he’s accidently tased to death, or perishes mysteriously in jail, he can’t testify.) My reading memory is Prosecutor waited 23 mos to charge 1 meth count, with 5 mo lag unexplained, & Judge found dismissal as a matter of law due to prosecutor’s time lag. (made me think potential Horman charges, unless there’s been GJ efforts.

    Maybe I am overthinking, but when that article I quoted said they were looking for someone in the white truck and then the next paragraph said LE tracked down the landscaper, I have to wonder if that was the first time they spoke with them.

    Stands to reason that the Hormans would have been investigated immediately, and the prior 911 call wrt RS would have come up in any preliminary report. That seems like the time TH would have pointed her finger at RS.

    Maybe RS was someone that required more than one interview. Just speculation.

    Why else would it take so long to prosecute. If the guy has knowledge of LE being on the take, whether drugs or money laundering or whatever, how would his attorneys handle this? One case at a time? One snitch at a time? “My client may have more information……” IDK, just asking.

    So here’s my question in regard to the above, I think the report said there were like 19 other schools who chose not use it. Why? Firstly, it should never have been a choice, but being as Shelby tells us it is, can anyone here (maybe MbS) tell us who would be the one to decide for each individual school that is in charge of making that decision? Is the school board or is it the Principal, or who? Second question is, would doing so, using the automated call system, cost any school more money….or less, or maybe neither. I would love to know these answers, just so we can know why a school would decide not to contact parents when a child was absent and/or wait until late afternoon to do so. Sorry, if someone has already gone over these questions….it’s been almost three years, but I don’t recall ever seeing this info.

    Oh my goodness, how did I miss that…….”fire and rescue personnel”? And DAD hurt his arm in around the same time this report came out, as well as Kyron goes missing. So has anyone been able to find the “spin-off” investigations?

    I’m now seeing possible credence to the story the person posted about DAD witnessing a cop doing something on SI and being afraid of police retribution. Wow.

    @TRuth. If every school had the technology, imo it was a human resource issue to implement.
    since the office clerks implement it, and are responsible to contact homes, Imo in
    a school like Skyline the principal probably left it to his attendance lady as to which method
    she chose. We know in Skyline’s case the job fell to one person who’d been there a
    couple decades & was/is much loved. I imagine that very longevity, doing things a certain way,
    made her unlikely to implement a new available technology, both skills-wise & attitudinally.
    And I don’t think a first time young male principal, whose kid was in the school, so you
    wouldn’t want to ruffle a longtime friend of his teachers, would require her to get those new skills
    & use it.

    Wasn’t that houseboat owned by a guy who was fine, upstanding, without blemish and a former LE officer, or something to do with LE.

    Wasn’t he connected to the Hormans in some way — child a friend of Kyrons, or something? Would he have known T and K, since that little neighborhood bar is right close to where he lives, and where they lived – Hwy 30?

    Was that the same houseboat where there were rumors about cadaver dogs catching a scent.

    Did I read something about something bumping up under the houseboat? (not all that unusual on a river, I suppose)

    DAD’s brother lives on S.I.

    Blink said the guy in the houseboat was a decorated officer, or something that made me stop asking, since he seemed to be above any kind of suspicion.

    Google pictures show the houseboat, also him with a couple of young ladies (probably relatives), also houseboat was sold, didn’t he move to CA or somewhere?

    Makes one wonder how or if DAD is the key to everything, especially since LE would usually make a first priority of catching someone who shot a LE officer. –unless someone in LE doesn’t want him to say anything and took care of that situation, thereby causing DAD to drop off the face o’ the earth.

    Everybody is fair game for suspicion, in my opinion, until Kyron is found.

    Speak English to (some of) us. LOL. What does guidestar mean and has anyone made any connections or followed that case? Why is Kaine’s name on it?

    Here’s another “conundrom”. There was an overturn of an appeal by this perp recently and Maxine covered the appeal hearing. If you haven’t read it it is fairly current:

    I don’t think Maxine was out of college then, but she notes similarities in both cases:

    “The Hanset case shares some similarities to the current mystery surrounding the June 2010 disappearance of 7-year-old Kyron Horman, which touched off one of the biggest searches in state history when he vanished from Skyline School. Kyron is still missing and police have made no arrests.
    Michael Hanset’s disappearance also gripped the community, with neighbors and family members going door to door for days looking for the boy, a first-grader at Buckman Elementary School.
    “I feel for Kyron’s dad because I know what he’s going through,” Sandra Hanset said after the hearing. “At least, I have some answers.”

    Now…I searched the Oregonian for the original coverage of the case, but could not find it. On Google Search I found this True Crimes article. I am not familiar with the integrity of True Crimes writers, but found this article straightforward and interesting. I do wonder if Maxine even researched the original case.

    Yep. Maxine doesn’t mention that in her extended analogy. And reading the script, if it is accurate, I can see why Houze would do everything possible to not allow a “confession” to be taken down in the Horman case, let alone coerced ala Kafve in “Swimming with the Sharks”.

    That said, I think they got the right guy years ago. But you never know. The “confession” is even suspect, according to this articel. And the way that the physical evidence was discounted makes you wonder even more.

    IF…and it’s a BIG IF,..LE is waiting still for any kind of physical evidence and they have NOT shamed TMH into a confession….what is their case consisting of? More heresay? And Houze has had a multitude of private and public trials since this one.

    If anyone has already researched this early murder case, i’d love to read some live accounts.

    Thanks for bringing that one up again. It just astounds me that Shelby said that about “containing students vs containing visitors” and he should have been reprimanded for such a stupid comment.
    And the cameras…..even after Kyron went missing he’s worried about “cost”?

    Yes, they could before Kyron “choose not to use it”. But is that and the “containment” choice even an issue to be debated? THEY LOST KYRON. So much for “containing” when NOONE saw him leave…even with his mother.

    And then there’s the little issue of their Super, Carole, coming to the Mikes on Sunday and, oh so firmly, stating that attendance WILL BE called into parents at ALL schools. The cart before the cart? Other districts had been manually or via computer calling parents for years. My high school has had cameras for decades. All doors have been secured after the bell rings for years.

    SKYLINE had security negligence…not choices that were willy-nelly. By the SUPERINTENDENT immediately closing the door after the horse bounded she was admitting negligence. PPS, and all schools, are RESPONSIBLE for student safety from the minute (*8:35) that they walk in the door until the minute (2:45) that they leave. That’s why safeguards MUST BE in place to assure that children don’t leave without a parent.

    I know….but how can a school protect against a parent taking a child…and doing the “unimaginable”??

    That’s why the little “sign out” sheet is in place at all schools. TMH was a volunteer. Wouldn’t she have signed out?

    I think that Skyline school was more than just LUCKY that heads turned toward TMH rather than the backpack and coat still left in Porter’s room.

    hi everyone. I have read all the comments of all the oregonlive articles from june 4-through june 7 (a lot lol) and have found no reference to any kids facebooks talking about a creepy guy or any reference to any kids facebooking. I will keep going a few days more when I get the chance. so far though the only reference I can find at all is the original post on web sleuth by “neighbor” about it, and the reference to that in scared monkeys. I don’t know how reliable neighbor is and I am questioning that a bit.

    I can only speak to my conversations with neighbor, I can’t confirm any other sites or posting under that name, but here, neighbor is legit and verified by me personally.

I was thinking yesterday, what if in the most charitable light to J Kantor, “a witness” from last Nov was a DEA or DOJ attorney or investigator representing 9 months were needed to roll up a broad criminal enterprise involving drugs or laundering, thus depos of Kh & DY could not go forward as local LE had confided too much to them. That is, that it was a matter of public good higher than a grand jury is working on indicting Terri. In tge divorce of course, parental & marital rights are entirely taken without adjudication.

    It seems to me that even that public good in the investigation & prosecution of crime would not be enough for J Kantor to set aside State statutes & case law in the divorce. The more important good, to me, is the public’s confidence in their State judicial system. That the State’s statutes are administered evenhandedly and the public can trust the judicial process. In Oregon imo the judicial process seems bankrupt & without accountability. Most of it seems good ol boy appointments are arranged after early resignations & retirements. I have no doubt political donations play a role. I just look to the last AG race where in the primary, between Dems, despite the electee claiming pro-med mj as her turf, argubly he was the stronger more experienced candidate with broader public & LE support. But he hadn’t worked for Goldschmidt, didnt attend his synagogue, and didn’t have that donor base. O have less confidence in tge Mult County bench than I do in MCSO.

    The article refers to the Zidell property. This was a superfund site but has become hugely valuable. I believe this is owner. don’t know about connections. this area is site of a couple of OHSU building and the famous tram. I’ll try to find out more. In general, Nike means goldschmidt. Can’t help but wonder if Intel and Nike compete to be Big Dog in portland.
