Who thought this was a good idea on behalf of THE BAEZ LAW FIRM?

Who raised their hand at the weekly status update and said:

“I’m sick of this crapp-ass coffee, I make $300 bucks an hour.

That is nothing compared to the caught-on-camera cluster that took place during yesterdays  hearing to declare accused murderer Casey Anthony indigent for costs.

 Andrea Lyon, lead counsel and chronic look-of-woehaver, feels approximately $70Geeze of her “charity’s” money has been spent on this case. (Edited to add, methinks she is subtracting $22Geeze, read on)

The Center For Justice In Capital Cases 

SHUT THE DOOR. This is no charity, except perhaps to Lyon as she is a paid staff member, serving as it’s director.

It is a certification study class at DePaul, run by Lyon and paid by the defense PI Morty. 

Furthermore, as the work product developed in this case supports the curriculum and subsequent GPA of it’s tuitionable students, why the hell would the expenses be allocated to the defense of the case against Casey Anthony instead of DePaul? 

There is no charity attributable to Andrea Lyon although she testifies to fund raising efforts through various charities and corporations, and that those charities are now, “in the hole.” $70Geeze, to be exact.

Is this the part where we here her use of the word charity was a charitable way to say she imposed on her budget as a professor? 

I will say, given her penchant for hardass reporting from her students, how is it possible she has no clue what her books and billable hour are?

There are 14 students working on a death penalty case that are not attorneys, and client attorney privilege would not extend to them as their is no established agency. If I were the National Enquirer I would be finding out which of those undergrads have fat student loans and what kind of access to information they have. Catch My drift?

Todd Macaluso, apparently so sure of Casey’s innocence he gassed up the whirlybird, packed his lucky smoking jacket and signed on to the case.  

Jose Baez testified that Todd Macaluso gifted $70 Geeze to the trust account of Casey Anthony. Operating pro hac vice (visitors pass) as representation with his own retainer agreement with Miss Anthony, Mac has violated the rules of the Florida Bar:

RULE 4-1.8 CONFLICT OF INTEREST; PROHIBITED AND OTHER TRANSACTIONS

(e) Financial Assistance to Client. A lawyer shall not provide financial assistance to a client in connection with pending or contemplated litigation, except that:

(1) a lawyer may advance court costs and expenses of litigation, the repayment of which may be contingent on the outcome of the matter; and

(2) a lawyer representing an indigent client may pay court costs and expenses of litigation on behalf of the client.

 As Casey had access to $275K and was not indigent 10 months ago when Todd Macaluso signed on and paid his apparent entry fee, it would be impossible to defend this “contribution” as legal under Florida law.

The Approving Bogs for Children company has paid out $200 Geeze.

“In August 2008, we licensed exclusive rights to an extensive library of photos and home videos for use by our broadcast platforms, affiliates and international partners. No use of the material was tied to any interview.”

..”The deal was done with an attorney representing several owners of copyrighted content,  ABC News spokeswoman Cathie Levine said. That attorney is Baez, she added..”

Really, not tied to any interview? When did those images and videos debut on GMA exactly? Who was on that program when they were shown?

I am quite certain I heard Jose Baez say in sworn testimony that he retained Tim Chinaris, former head of Florida Bar ethical committee to field such inquiries and all were turned down. He added that such agreements would not be ethical.  Maybe he thinks ethical is transposable with visible.

Several owners of content means multiple people were paid for this “extensive library”. If ABC is claiming that Baez brokered this transaction for all then we have an even bigger problem as he was simultaneously representing the interests of all parties at the time. The agreement that was reached between the parties is critical to understanding the income status of Casey Anthony and her attorneys. Judge Strickland may very well just deny the indigency application and alls well that ends well that these barristers will have to buck up on their own.

That is, until John Morgan gets wind. We will see a copy of the ABC contract in the civil case against Casey Anthony on behalf of Zenaida Gonzalez, fo shcizz.  He danced 2 jigs yesterday. There were witnesses.

Without question, Mr. Baez should be REQUIRED to produce this agreement in response to proof their is no recurring revenue or subsequent earnings to his client based on the structure of the agreement. It is not uncommon for such agreements to include royalty clauses, which would mean that someone is getting paid every time a photo or image from that collection is used. 

ABC newsroom laid off 1/3 of it’s news staff earlier this month. Nice.

Billable Hours

Perhaps the *thud* moment for me yesterday was when Mr. Baez admitted in open court that he does not track his billable hours on this case.

Apparently, the reaction is sticking with me.

Under the rules of the Florida Bar, there is a very stringent set of requirements when determining reasonable fees for clients.

Short Version:

RULE 4-1.5 FEES AND COSTS FOR LEGAL SERVICES

(b) Factors to Be Considered in Determining Reasonable Fees and Costs.

(1) Factors to be considered as guides in determining a reasonable fee include:

(A) the time and labor required, the novelty, complexity, and difficulty of the questions involved, and the skill requisite to perform the legal service properly.

How can you bill someone $90Geeze, and have no idea how you got there, or whether or not such activities are reasonable to the client and or case?

Judge Strickland ruled that by end of business today the defense team needed to provide a full accounting of requested trust account disbursements.

I am thinking they will take the rejection of her indigency status before another trip to the dunk tank, but that’s just me. 

 Can you imagine the car ride home with Cheney Mason?

    So, all this nonsense regarding Bozo et al reveals that all is unethical with the defense. WTH else is new??????? I get that and so does everyone else who reads here. I’m also understanding this has no impact on the verdict, which is really what it’s all about……Caylee’s revenge. The defense will be the defense and continue to make a mockery of the justice system. They’ve refined it to an art, even. I, like many others want Caylee’s death vindicated to the fullest extent of the law. I want her killer brought to justice and I want her to be found QUILTY AS CHARGED. I don’t care if it’s LWOP or death. I really don’t. I do not want Casey to go free….EVER! I want her scary @$$ clown perma smirk rubbed off her arrogant, self serving face! Personally, this last court session has tested me to the last nerve in my body and to say I am enraged is an understatement!!!!!!!! The rest of this mess and recent discoveries don’t give any advantages for the prosecution and it doesn’t do baby Caylee any justice.     Will this new defense attorney for Casey have a chance to get Casey acquitted? Is that why she looked like she just hitched her wagon to a star????? That’s the only question I have and care about. Will she walk free & live a life she pined for herself, and not for her daughter? Cuuuuuuuz, that’s what a real mother does. Life is no longer about her anymore, it’s about her babies and helping them realize they can be whatever they set out to be with hard work and perseverance. And LOVED….unconditionally loved by a wild cat mother who would ‘kill’ anyone who’d even dare consider her family any harm.

    My faith that Caylee will get her rightful revenge is dwindling fast. I’ve never wanted to hold that precious baby in my arms more than I do right now. I know she’s with our King….but I just want her to know she was loved, so deeply loved here on earth by another kind of family. I want for her to rest in peace, with complete dignity and for all those involved in her death (I include Bozo in that equation) face their highest consequences for treating this case like they’re defending a beautiful woman who just doesn’t deserve all this hardship.

    I simply cannot bare Caylee’s death being treated like a fictional novel. Worst, I HATE seeing Casey being surrounded by all these mindless eating machines treating her like fragile china doll. Do they know she had a daughter and her named is Caylee Marie Anthony?

    Blink or any other smart one~ has it ever been documented by cell records when Casey first called Baez. Had she called him prior to the call from lockup?
    There’s something bugging me. He seems so firmly in the middle of every deal. Casey comes from a line of blatant liars, she’s a fearless liar. She appears to have blind trust in Baez. Is it because she’s fantasizing about his skills or that he loves her? Could she have contacted him prior to the 911 call and given him some version of events and asked if and when she needed his services could she count on him? I just can’t shake the thought that he knew Caylee was gone and participated in the ruse that she was kidnapped in order to profit. This latest confirmation about his role in the ABC deal makes me very suspicious. He’s a lot like Casey, he seems to think he’s smarter than everyone else and that he will not get caught.
    guess I’m rambling but I sort of feel like BeesKnees today, very discouraged about the way things are going.

  3. I believe Jose Baez lied in court about the book/movie deals. I do believe he has something in the works and his BFF Geraldo is somehow involved. I might be wrong but that’s JMO. in the beginning of this case, Geraldo believed that Casey was GUILTY, and now since his HOMME Baez is her attorney and he happens to be HISPANIC, he is singing a different tune. I really do believe the SCUM BAG lied under oath.

    Today I was at a Bazaar located on our military base, I was standing in line to get some good German eats and in front of me was a lady with a toddler strapped to her back in one of the earthy type carriers, the lil girl was smiling, she had lovely eyes and a cute lil crooked grin, she was playing with a bright green ruler and was trying to hit me and my oldest daughter (20) she kept tapping at us and tossing her ruler, sad her mother paid no attention to her playing with the 2 ladies behind her, maybe 5 or 6 times this lil darling lost grip of her ruler and reached like her lil arms could pick it up, over and over I picked the ruler up and handed it to her and she just giggled, again no response from the mother who’s back she was strapped to, then all at once it hit me like a ton of bricks, Caylee…is this how she was ignored strapped in that car seat drivin all over the Magic Kingdom….tears filled my eyes, I had to look away from my own daughter for fear of having to explain my tears to her…

    Like a wise old woman once told me “God don’t like ugly” all is good Caylee will have her justice, she already has it, we just can’t see it yet…

  6. #25bluewillow, you are absolutely right, WHY ARE ALL OF THESE ATTORNEY’S WANTING TO BE A PART OF THIS DRAMA? the azz hole that just joined the team has made statements of her guilt to the press, and now he is defending her. this is one more disaster if you ask me. and I agree with others about the taxpayers paying for her defense.the right thing in this situation would have been for the court to appoint her a public defender. I mean how can she hire the attorneys that she has now after being appointed a public defender in the beginning, and then come up as being indigent now and being allowed to keep these attorney’s on the taxpayers dime? also, I wonder what kind of list of lies did they come up with and give to the judge that would say, yes she is indigent? this is nothing but a bunch of BS.

    Thanks Blink for acknowledging my qustion on D Casey & getting paid.. I watched the hearing again this a.m. and when asked if investigators had been paid, Baez waffled (nothing new) and didn’t really give a straight answer. I am furious that this Cheney waltzes into JS’ courtoom like he owns the place and tries to take over.. he is trying to use his old age and southern charm to take control of the situation.. I understand KC needs a capable defense attorney so that this case doesn’t get overturned on appeal and that JS is accommodating for the same reason but when will the circus end and the real lawyering start? Do you think that the accounting statement that the defense turned over in camera will get the attention of the bar if it is not documented properly? How will we know if they are even paying attention to this? It seems so obvious to me that they are playing games when they don’t show up to an indegency hearing with proper documentation on spending when that is the whole reason for the hearing! If I showed up to friend of the court on custody issues and didn’t bring my backup, they would reem me a new one! So why is it they are allowed to basically waste time in the courtroom? I’m sorry for rambling, I just get so frustrated sometimes at this.

    I was taken to task for the statement Lyons has contributed $70,000 to Casey’s defense. I even acquiesced and re-wrote it to make sure NO ONE could misunderstand my words.

    She said it herself, she said it herself, and then she said it herself – under oath, in court, sworn, and an officer of the court.

    IT DOES NOT MAKE A STINKING BIT OF DIFFERENCE if she was REIMBURSED for $22,500. She stated herself that $70,000 “WENT OUT THE DOOR”.

    I say that like I have not researched the charity angles out the wazoo from day one, and we have always known the answers lie there.

    Then I thought, BRING IT- you elitist, self-absorbed nitwits.

    Your defense is going to bring in the fact that your client was paid $275K.

    The Hell you say? Yes, I do.

    Tell me how they will present Caylee was alive post July 17th. Tell me how someone else placed this baby’s remains in the swill on Suburban and it could not possibly be Casey.

    Ragdoll and Bees knees thank you for your response ,(I am an avid reader of your posts ) I too feel he will spin some bloody claptrap to deflect his earlier statements , and I think somebody mentioned up thread it could not be used in court , I had a tough time watching all of them in court , he is a bully and I can not stand to see CMA smirk and giggle much more , it seemed chaotic in that courtroom mason talking over everybody , the attorneys jumping up and standing all over the place , the JAC guy that nobody could understand , that is O.K. they can do what they want , it is all excess smoke and mirrors . noise and distraction , the state has an excellent case and they are just biding their time , I am confident she will never be free again , but it seems very hard to watch the Cirque de Casey in the Maison de luny for the next year , ahhh but victory will be soooo sweet !

    Dee & NancyS & all BOC friends thank you for the kind words. In my heart I KNOW justice will come for Caylee, there is just too much evidence, circumstantial or not. I know it, but every time the jackals dodge another bullet it makes me so mad and I forget to look at the big picture. They may be slipping under the radar but Casey is in the States scope, she is the target and she won’t get a pass.

    Guess until the prosecution has the floor and can begin showing each agonizing detail of Casey’s actions there will be plenty more grandstanding, diversions and direct blog distractions. Now that even their new spokesperson referenced blogs, we can expect trolls spouting wild theories and “insider info” for the sloe purpose of causing division and confusion.

    I’ve been around the block a couple of times but I have never seen so many greedy, immoral people all using a child’s brutal murder to get ahead. It’s insane, like animals in the wild, all trying to grab a piece and then some more.

    I’ve just visited Richard Hornsby’s blog and I’ve got to admit, that Richard is right on task with what I noticed, and he’s right on task with Blink’s ideas about ABC.

    Last week I was frustrated with what I saw WFTV doing and other outlets following suit, re: the ‘Mistress’ story. I know Blink saw the missing ‘real’ story, the indigency status hearing, no one was covering that, everyone seemed to be turning into little versions of Orlando’s own Nat. Enq. or the Globe.

    I noticed that one WFTV video had a tidbit attached, ‘watch at 11′ type thing, where there were two little enticements of the ‘other shoe’, that included two points. One, we would see photos of the mistress and George and two, we would hear all about the violent confrontation that Cindy and Casey had, from George via the mistress.

    Those points are still in text in WFTV’s video, but we never heard any such things. But next nights on NG, there was the Nat. Enquirer showing the same thing– the one photo that NG showed and with a story that NG noted had lots of juicy stuff, that had to be fabricated, unless it came from the twins. I’m wondering if WFTV dropped the ‘fight and photos’ subject like a hot potato if they got wind that the Enquirer was running the story with even more sensationalism.

    Something caused WFTV to drop the idea of the other shoe dropping. Hornsby thinks that WFTV was diverting attention purposefully, I didn’t think of that so much as just playing the sensational story, maybe there was more to the ABC protecting their own image. Hornsby also noted what seemed pretty obvious to me, in the Pipitone’s coverage as pro-defense, they are now the only ones keeping up with the mistress story, so makes me wonder if there is a defense spin.

    Hornsby’s going to have to admit that he agrees with Blink on this take!! I visited tonight just to see what his take was on this past week.

    I’ve kept an eye on WFTV, but after last week’s behaviour of that station, and the reveal of how unethical this payment was as seen by the press industry themselves, I’m ready to file Disney and it’s corporations into my old Disneyland lunch box and shelve it (figuratively speaking, the lunchbox was long since lost but from nostalgia).

    The ABC issue is not over by a long shot for me. The problem is, to really sink that ship so to speak, you would need the other networks to take a strength position and from time to time, they have all done similar deals.

    That said, I DO think it matters if it was young master Golden or a mother accused of murdering her child.
    Furthermore, as I said in the piece, the structure of the agreement should be disclosed to the public, AND their advertisers. Baez is not a publishing or rights to same attorney, he would need to have consulted someone else, these agreements are very complex and can take weeks to “gel”.

    You may recall me saying that Casey was arrested on the economics charges the evening before she was to tape the abc 20/20 interview. That was the first scheduled date, and she was in fact interviewed while she was out on bond the second time, at the Anthony residence.

    I can’t wait till they try to air that little gem and announce again that they did not pay for an interview.

    I wonder if Casey filed her tax return from 2008?

    “At issue is a statement Mason made about the state’s theory of how Nelson Ivan Serrano was able to kill his former business partner, a prosecutor and two others at a Polk County manufacturing plant in 1997.”

    The prosecution stated that Serrano’s murder plot involved buying airline tickets under three names from Orlando and Tampa airports so he could appear to be in Atlanta the afternoon of the slayings. The route involved Serrano flying from Atlanta to Orlando, driving to Bartow, where the murders occurred, and then catching a flight back to Atlanta.

    The Sentinel said that Mason was confident his client couldn’t have gunned down four people in the time prosecutors said he did, and told Dateline NBC he’d pay $1 million to anyone who could show otherwise.

    Kolodziej took the challenge literally and videotaped himself following Serrano’s route and doing so in the time Mason said couldn’t be done.

    Now, he wants to collect, a move that Mason says is “ridiculous”. That is what I say Mr Mason ridiculous just ridiculous !

    Can you imagine J. Cheney Mason putting off his retirement through this trial, an appeal by one side or another, dedicating years to Ms. Casey? Will he be playing with her life at trial for his ‘fun’? Doubt that, he will like the challenge, but is he going to dedicate years to this girl for free when he’s not defending an innocent woman and knows it?

    (note he did NOT say ‘she is innocent’ in his presser, he chose his words better and predicted an aquittal, but never did he commit to ‘innocent’.)

    According to Hal Boedeker, JCM does NOT believe in the death penalty. Makes sense why he stepped in on behalf of Casey’s defense. I don’t believe, imo, he would take back previous comments he made about Casey’s alleged guilt. As Blink pointed out, those comments cannot be used against him. Soooooooooooo…….

    He wants to save Casey from the DP. Like her or not, he feels he’s her only hope. I can almost understand how his belief system would influence his choice to join the defense. At this point, she has no hope UNLESS she pleas. Casey won’t plea. Bozo has lead her down the garden path, leaving her to believe she doesn’t need to plea. For JCM, I believe his convictions drove him to Bozo’s office to repair the irrepairable. Bozo’s made a laughing stock of defense and the fact that so many have have to step in to save his fat @$$ is testimony to his inability to do his job effectively. Inexperienced and way over his head.

    I’m feeling better already imagining kc having to be cuddled and petted throughout the entire trial just to keep her from imploding. She’s been lulled into thinking that she’s part of the team. All the times she’s been to court lately have been fairly obtuse in relation to what it will be really like during her trial for murder. Day after long day of hearing the hideous facts. i’m pretty sure she has no idea of the range of knowledge that the prosecution will bring to the table.
    The day will come that her lawyers will actually be busy defending her life and not have so much time on their hands to babysit her while the State tells how she callously killed her little girl, how many men she was sleeping with during that period, and much more. And if by a hard slap from lady justice and Baez needs to step down, her fantasy role of co-counsel/girlfriend will vanish into thin air and she may finally understand her true position. C Mason doesn’t strike me as the type of masculine variety that kc would try to offer her wares to. Now that Baez apparently has the keys to the treasure chest, he doesn;t need her anymore anyway. She’s probably given him complete control of whatever material content that has yet to be sold.

    The pit of rattlesnakes may start biting each other before all of this is done. Yeppers, I’m back in the saddle again, casey’s going down.

    Jose Baez, the attorney for the mother of missing toddler Caylee Anthony, has been associated with some high profile cases.

    Three big name cases of his were covered on WESH 2 News.

    The most recent was in April of this year when Baez represented Nilton Diaz — the Lake County man arrested in the death of a popular boxer’s granddaughter.

    Investigators said Diaz killed Wilfredo Vazquez’s granddaughter.

    A jury found Diaz guilty on murder charges.

    Then, Baez represented Kissimmee Mayor George Gant at trial in 2007.

    Gant got booted from office and was forced to resign as a doctor when two patients accused him of touching them in a sexual way during gynecology exams.

    The prosecution’s main witness refused to testify against Gant and the former mayor was cleared of sex charges.

    In 2006, Baez took on Elvira Garcia as a client.

    Garcia was accused of kidnapping her roommate’s 6-week-old baby.

    Police found the infant safe in Kissimmee.

    Garcia claimed the baby was hers, authorities said.

    In watching the latest court proceedings to declare Casey indigent I must admit I was somewhat appalled by both Baez, and this new lawyer Mason. Mason seemed to think that it was their God given right to this money to defend Casey and acted arrogant and insulted that the court would like an accounting of money already spent from the defense, their billable hours and the cap that would be in place for expert witnesses. Baez answered some questions but DID HE broker this deal in any way between ABC and Casey? Also when Mr. Mason said, ” What amount of money has the state spent trying this case ” I almost came unglued. How bloody stupid! The state would not have had to spend a dime had not an innocent child been murdered.
