Caylee/Casey Anthony Case: Will Judge Rulings Today Be Defense Doomsday?

Chief Judge Belvin Perry promised to rule on 2 outstanding motions by her defense team today.

Update #1 4:45PM.. Motion to exclude trunk stain… D E N I E D

Rulings on Critical Motions regarding a hair with a "deathband" that could only belong to a deceased individual and either Casey or Caylee Anthony, and the air samples tested by Dr. Arpad Vass and found to contain chloroform levels he has never seen, in his 22 year career.

The air samples themselves are not in contention as the "hardware" and methodology in their extraction are used widely in the scientific community, and the defense team, through a stipulation agreement to withdraw contempt proceedings against him, could not argue about anything else.  The defense argument was largely about the interpretation of the data that was yielded from the samples as they relate to a decompositional event in the trunk of Casey's car.

Both motions were a combination of a Frye/exclusion attempt by the defense that took several days in court to conclude, in which many observers felt were disorganized and poorly argued in contrast to the deft responses by the prosecution.

Yesterday, for the second time, Jose Baez on behalf of Casey Anthony filed a response to the State's motion to let his already withdrawn "experts" Dr. Danzinger and Dr. Weis be permitted to testify as to what Casey told them during their interviews with her.

You may recall, during the State's deposition attempt of Dr. Danzinger,  Judge Perry put the kibosh to it after receiving a call from Jose Baez, and both depositions have since been sealed.  Judge Perry referenced testimony about Post Traumatic Stress Disorder, or PTSD, but legal experts agree that in itself would not be grounds for suspending a deposition and immediately sealing it.

It is this editors opinion that during the deposition,  Dr. Danzinger recounted parts of his interview with Casey Anthony that may have been incriminating to her.

It was abundantly clear that the defense strategy is/was to attempt to have these witnesses speak about parts of their interviews with Casey Anthony as a way to repeat her "defense" without ever taking the stand, subjecting her to cross-examination by the state.

It is also abundantly clear that Jose Baez et al did not understand the Judge's comments about these depositions the first time around.

The only way these "Docs" will be permitted to testify to anything Casey Anthony told them, is if Jose Baez presents an exception argument to the hearsay rule, and since the "declarant" or Casey Anthony, will never take the stand, 'not gonna happen.

Yesterday afternoon, the defense depositions of Tony Lazzarro and Amy Huizenga were filed with the court.

While there was largely previously known information contained in both depositions, there was one noteworthy tidbit in Ms. Huizenga's which the defense glossed over in a hurry.

Reported exclusively by www.blinkoncrime.com,  the Anthony's withheld a major plumbing emergency at their home that sent someone from Hopespring Drive in a panic to locate Caylee.

    My layman’s understanding of the possibility of the DT filing a continuance as per HHJP’s words at Monday’s hearing “might” occur under the following examples given by HHJP:

    1. If, through the voir dire process, they cannot find an impartial jury because of pretrial publicity issues (understanding here that jury selection will begin on May 9 as scheduled)

    2. If the 5thDC does not uphold HHJP’s decision and requests he hold an Evidentiary hearing.

    Like to think that HHJP is steps ahead of the DT in anticipating their moves whenever he makes his rulings.
    His verbal response for denying the media motion was good and fairly encompassing and I believe he already had a more extensive and comprehensive written response ready to be completed and submitted to the 5thDC if needed (and as it turned out to be).

    Just an optimistic opinion, but I do believe that HHJP’s discretion in this particular case regarding the media will be agreed with and his order upheld by the 5thDC. Jury selection will begin as scheduled this coming Monday, and there will be success in seating a fair and impartial jury.

    However, a delay to the trial proceedings May 17 in Orange Country may be incurred should the jury selection process require a longer period than 5 or 6 days at the upcoming currently undisclosed location (HHJP already indicated he may extend).

    Here’s hoping the sun shines for Caylee Marie on May 9.

    Do we know the media outlet(s) represented by this attorney? Is it the Fox network? Is this the ‘hell’ Geraldo said that he was going to raise?
    I’m trying to make some sense of this. Why would the defense want to delay when they would be under a gag order under trial? Can you imagine Baez & Mason wanting to stay quiet?

    Also, how in the world could the defense think that they could create reasonable doubt by implying that George could have murdered Caylee? Do they not know that the prosecutors have the ‘mother load’ on Casey?

    Or, what if the defense team decides to go with an ‘accident’ that Casey was too afraid to tell her mean ole parents? Good grief, what person wouldn’t dread telling their parents, or admit to anyone, that they were responsible for the death of their child??? Besides, why sit in jail for 3 yrs if an ‘accident’ story might fly? They could have used Blink’s ‘O’ theory way back…you know, they needed something to explain that pesky duct tape.

    Sammy, do you think these stations are willing to give it up that easy? Perhaps another reason behind the motion. Regardless, it is comical that these kinds of people wouldn’t ‘think’ about asking around in the first place. Wouldn’t that be second nature? Call around…call your connections?

    Chelsea, that’s what I thought too (Rosie…lol). She looked completely over her element. He was asking her direct questions, to which if she had the answers, she’d know what to do. She may have thought he was being facetious or she just wasn’t grasping what he meant at all. She looked lost.

    Mom3.0, I’m in agreeance with ‘something different in the air’. I still believe the defence had somethin to do with this. I still have hope this trial will start on time but if not, I will never give up on Caylee. I cannot believe how this defense has made a complete joke of the Florida judicial system. Is there not someone, St. Florida who can step in and make the wheels spin again? I can’t believe it can all stop because of a confidentiality agreement? This is why I feel like they’ve been approached by Baez. They’re acting just a ignorant.

    Oh by the way, The Orlando Sentinel is quoting Baez as saying he will not let this case define him. Who wants to tell him it’s a dollar short and day late.

I do not take the defenses stance/motions at face value…its a game of poker and I am sure they are holding some cards close to their chest…what they dont realize is that everyoneelse is waiting and ready for them to try to pull that Ace from their sleeve… its hard to pull a fast one when all the players are clearly known and the cards have already been dealt… -

    Hi Leslee- yes a gag order would apply to them as well…I agree that will not work IMO it is not reasonable to believe that George and or Cindy or any one besides Casey killed her daughter…I dont necessarily think the defense will be going with any 1 scenario, I think they are gonna throw as many theories out there as possible.

    Sammy, I heard that horn all the way over here…do you suppose the Anthony’s heard it too, and that is why Lippman is so eager to get them inside to see Casey?…so they can try to talk some sense into her? I thought it was very telling that Lippman said that they have not received a reply, and that they are unsure if this is Casey’s doing or her defense pulling the strings… Of course they could just want to see her because it may be the last time they can, being that they may be barred from the courtroom….

    Your comments about Baez’s interview with the Sentinal are so on the mark. Is this guy trying to convince himself or use the paper to make local people believe him?

    I hope the court can get a jury in a single group. It may take several days depending on how verbose the defense decides to be. I once sat through a jury selection of five days for three accused drug dealers. All because one attorney on the defense decided he would teach a law class about jury responsibility. I knew the judge and during one of the breaks I asked how long he was going to let that guy continue. He said that he could not interviene, but did speak to him.

    Leslee S….hello my friend! I think, after reading the article, it’s more about telling a story of the ‘alleged’ abuse w/o the Anthony’s presence. This theory has been completely fabricated by the defense imo. I could be wrong, but if they’re playing the abuse card, having the Anthony’s in the court room would make is messy. From what I read it appears it’s Casey’s request to not have them in the court room. Why wouldn’t she want them in the courtroom? Big hmmmmmmmmmmm. Again, I’m running thoughts that could be completely far fetched, but this could be what the opening argument will be about. 31 days…because Casey felt her life would be in danger if her parents found out Caylee’s death was an accident. They’d tell her she was negligent and as Cindy has said in the past, Casey is an unfit mother. Casey left, feeling her and Caylee’s life was in danger (after Cindy lunged at Casey, hands around her throat). Regardless of what their opening statement will be, how will they explain away the duct tape? I think that hurts Casey’s defense more than the 31 days, imho. I was encouraged when I watched 48 hours cover the investigation of Colonel Russell Williams. It was revealed Williams used duct tape on one of his victims to cover her nose and mouth AFTER trying to suffocate her himself.

    I think the duct tape is why Casey will get the death penalty. It was cold, calculated and showed intent to kill, imo. Suffocation was how Casey choose Caylee to die. AMHO!!!!!!!

    It has been said by one of her lawyers that Zaniada is a lie. If so, then when was the last time she saw Caylee. What is her answer to that question? A very imprtant question to this case still goes without an answer. When was the true moment of time that she last seen her daughter? Why does the media not ask Jose that question?

    Ragdoll – no matter what the defence puts forward, and maybe they will use your theory that they may say Casey was too frightened to tell her parents that Caylee died due to an accident, why would Casey party away the 31 days? Why wouldn’t she be in hiding with her boyfriend of the day; Cindy didn’t even know where he lived until Amy took her there. I believe that the evidence is so overwhelming that whether it is this year, next year, whenever, Casey will be found guilty. Whether she gets the DP or not I don’t care as long as Caylee has her Justice. I still think Lee might throw a spanner in the works of the defense.

    WFTV has learned that Casey Anthony’s defense team has lost its jury selection consultant, Richard Gabriel. This is a huge blow to the defense.

    A jury selection consultant is a person who helps trial attorneys choose their jury. Casey’s defense team is now scrambling for a new consultant just three days before jury selection is scheduled to start.

    Casey Anthony is accused of murdering her daughter Caylee, putting the body in her trunk, and then discarding it near their house. Jury selection is set to begin Monday, May 9 and the trial is scheduled to get underway Tuesday, May 17

    I want to scream at the esteemed Baez Law Firm (fancy gold embossed crest on business cards/golf shirts doncha know) … IT’S CAYLEE’S TIME NOW.

    They have filed stupid motions galore and done so much BS to delay this trial for almost 3 years now.
    Caylee should be an almost 6y/o little girl all excited to start kindergarten soon, but b/c of their antics we’re not even at jury selection yet.
    It’s time, waaay past time – for Caylee’s murderess to face the music.

    The following is based on my best recollection: all JMO all paraphrased unless otherwise noted.

    Todays hearing-

    Jury venue motion was heard in camera-

    George and Cindy are next of kin

    State did not object to them being allowed at trial- suggested that they sit in the balcony

    Defense argued that The Anthony’s could be seen as biased or the jury could determine their testimony was less valuable if they saw them day in and day out…If they saw them supporting Casey it may color the jury’s view of their testimony… & they could change their testimony.

    Judge Perry ruled that the Defense did not show sufficient cause to sequester them…ruled that they will be allowed in the gallery- but that WILL change without warning if they violate any of the courtroom rules of behavior.

    Defense brought up “discovery” about Vass said they now may want to use some of it if they choose to…State- said I guess we will deal with it if/when it comes up…but it is not simply info having to do with articles of Vass ect…but some of the 5000+ papers involved a scientist from Oakridge labs and a previous court case…

    Also the Defense subpoenaed witness’ to appear Mon. morning including the Anthony’s …JP said all witnesses should call the # and write down who it is they talk to…and then they can not be held in contempt if they do not show up.

    So, our household is taking bets on how long Cindy/George will be allowed to stay in the courtroom or how long it will take to get them thrown out of the courtroom for their facial expressions/head shaking, etc…. My husband is stating he feels they won’t last 10 minutes; I’m willing to give them a day or two. Any thoughts?

    Are cameras going to be in the courtroom for jury selection on Monday? I’m assuming that if they are, jurors’ names/faces will not be shown?

    It’s been said that they will use the ugly coping theory to explain the 31 days. That, or her behaviour during that time does not make her guilty of murder. Whatever they use, imo, it won’t work. It makes more sense for the state to say she partied on like Wayne and Garth b/c she knew her daughter was dead. She did not have to go out looking for her.

    Let’s not forget her shopping sprees. thanks to Amy’s generosity (snarkity snark). Not one thing for Caylee.

    Whatever the defense uses, it will be laughable at best. Just looking at Casey, the jurors will ‘sense’ something not right about her. She is so unlikable and the jurors will be watching her self indulgent grooming, giggles and horse smiles. She cannot contain herself regardless of all the coaching in the world. She is who she is.

    Again, jmho, Chelsea. I almost think had Casey not used the duct tape, she could have gotten away will murder after all.

    Someone asked if the nanny is lie, just where was Casey between 9 am and 1 pm? She stated it was a normal day, dropping Caylee off between the close minutes of 9 am and 1 pm (that is just a stupid stupid statement in itself).

    The state will be on the ball. I feel assured that Casey has given them LOTS in that statement to work against her. JMHO

    So if I’m reading this article correctly … Judge Perry has told 1 attorney from each side, but the confidentiality agreement is null so he doesn’t have to tell ANY media until Monday morning @ 8am.

    The child further inquired, ” But tell me, here in heaven I don’t have to do anything but sing and smile to be happy.”

    God said, “your angel will sing for you and will also smile for you. And you will feel your angel’s love and be very happy.”

    Again the child asked, ” And how am I going to be able to understand when people talk to me if i don’t know the language”?

    God said, “your angel will tell you the most beautiful and sweet words you will ever hear, and with much patience and care, your angel will teach you how to speak”

    “And what am I going to do when I want to talk to you?”

    God said, “your angel will place your hands together and will teach you how to pray.”

    “Who will protect me?”

    God said, “your angel will defend you even if it means risking its life.”

    ” But I’ll be sad because I will not see you any more.”

    God said, ” your angel will always talk to you about Me, even though I will always be next to you.

    At the moment there was much peace in Heaven, but voices from Earth could be heard and the child hurriedly asked, ” God, if I am to leave now, please tell me my angel’s name.”

    God said, ” You will simply call her, “Mommy”.

    I seem to remember during the interview, with ? Yuri or detective Allen, at Universal KC brought up her mother several times. “My Mom told me yesterday she will never forgive me” “If this would ever happen to me again, I wouldn’t be afraid to go to my parents” She also spoke about her Mom being “hard” on her about being a bad mother.

    The detective ask why 31days, KC said “I was afraid” “Afraid of what” she was asked, “my Mom’s reaction, like it was yesterday”

    KC has had almost three years to finely hone “I was in fear of my parents” The defence, it appears, thinks this is a viable road to hoe.

    So, the Ant’s go on to file to be present at entire trial . . . DT files a motion to deny their presence . . . Ant’s fight and get their motion granted.
