Caylee/Casey Anthony Case: Will Judge Rulings Today Be Defense Doomsday?

Chief Judge Belvin Perry promised to rule on 2 outstanding motions by her defense team today.

Update #1 4:45PM.. Motion to exclude trunk stain… D E N I E D

Rulings on Critical Motions regarding a hair with a "deathband" that could only belong to a deceased individual and either Casey or Caylee Anthony, and the air samples tested by Dr. Arpad Vass and found to contain chloroform levels he has never seen, in his 22 year career.

The air samples themselves are not in contention as the "hardware" and methodology in their extraction are used widely in the scientific community, and the defense team, through a stipulation agreement to withdraw contempt proceedings against him, could not argue about anything else.  The defense argument was largely about the interpretation of the data that was yielded from the samples as they relate to a decompositional event in the trunk of Casey's car.

Both motions were a combination of a Frye/exclusion attempt by the defense that took several days in court to conclude, in which many observers felt were disorganized and poorly argued in contrast to the deft responses by the prosecution.

Yesterday, for the second time, Jose Baez on behalf of Casey Anthony filed a response to the State's motion to let his already withdrawn "experts" Dr. Danzinger and Dr. Weis be permitted to testify as to what Casey told them during their interviews with her.

You may recall, during the State's deposition attempt of Dr. Danzinger,  Judge Perry put the kibosh to it after receiving a call from Jose Baez, and both depositions have since been sealed.  Judge Perry referenced testimony about Post Traumatic Stress Disorder, or PTSD, but legal experts agree that in itself would not be grounds for suspending a deposition and immediately sealing it.

It is this editors opinion that during the deposition,  Dr. Danzinger recounted parts of his interview with Casey Anthony that may have been incriminating to her.

It was abundantly clear that the defense strategy is/was to attempt to have these witnesses speak about parts of their interviews with Casey Anthony as a way to repeat her "defense" without ever taking the stand, subjecting her to cross-examination by the state.

It is also abundantly clear that Jose Baez et al did not understand the Judge's comments about these depositions the first time around.

The only way these "Docs" will be permitted to testify to anything Casey Anthony told them, is if Jose Baez presents an exception argument to the hearsay rule, and since the "declarant" or Casey Anthony, will never take the stand, 'not gonna happen.

Yesterday afternoon, the defense depositions of Tony Lazzarro and Amy Huizenga were filed with the court.

While there was largely previously known information contained in both depositions, there was one noteworthy tidbit in Ms. Huizenga's which the defense glossed over in a hurry.

Reported exclusively by www.blinkoncrime.com,  the Anthony's withheld a major plumbing emergency at their home that sent someone from Hopespring Drive in a panic to locate Caylee.

For the first time, it is confirmed that Casey knew about it, and told Amy it was one of the reasons they could not move in:

    I found one thing kind of interesting that I didn’t think of before.
    I listened to Casey’s interview with the detectives and she says something to the effect of her mom never forgiving her and then she says I will never forgive myself and quickly says I may never see my daughter again. WHY WOULD SHE HAVE TO FORGIVE HERSELF FOR GIVING CAYLEE TO HER NANNY??? I thought that was telling. I can’t remember which interview, at her home or universal with police, but the way that she says it, it is like she catches herself and tries to cover what she just said.

    WPG- I do remember that…and I dont know if anything is up but considering the defense just recently changed their tune and the State for that matter IRT The Anthony’s being present it does give me pause….

    I dont trust liars and sadly from watching several high profile cases I dont trust defense lawyers either… JMO

    I am rewatching todays hearing and noticed something interesting IMO

    lots of times I miss things especially when the attorneys do not stand at the mic and talk…
    anyway- I have heard reports that Casey looked as if she had been crying when she entered the courtroom today…

    well I dont think so-JMO in fact she was fine, head held high- her walk reminiscent of her blue hoody shake it like a Polaroid pic walk…that is until she catches the eye of the brunette woman sitting behind the defense table- (dont know her name)

    This woman makes eye contact then makes a boo boo face-sticks her lip out as if she is sad…and drops her head down..as if she is coaching Casey’s actions and demeanor next Casey looks sorta sad and lowers her eyes and head… just thought id share my observations FWIW

    Mom3.0, which/whose replay are you watching? I’ve watched the raw video from WFTV of her coming back in from the meeting room, but it only shows the brunette from the back – - can’t see her face.

    Did think the accused might have had some tearing-up back in that meeting room, but IMO she looked mad. I felt sorry for the bottle of water . . .

    Keep your eyes on the lady – very quickly between 1:03 and 1:04 you will see her look up towards Casey she swiftly sticks out her lip and moves her head downward while casting her eyes down..

    Hey I could be wrong and maybe she is showing a sign of sympathy for Casey but JMO I dont think so…

    ps yes I think she was angry while at the defense table drinking the water…poor water bottle is right she isnt gonna stop there…after the hearing she motions to the water bottle and talks with the guard as if to say hey thats mine can you bring it to me later….LOL-

    It must be hard for her knowing she has to pay for bottle water now from the commissary…every cent counts especially when you dont know where your next money is coming from- mommy and daddy might not want to top up her account since she seems to be gunning that engine of the bus

    Mom3.0, great catch! The inmate has been eternally spoiled, so she is used to displaying her approval or non-approval. IMO she would have to be monitored, as for all of her years she has been enabled to act-out in anyway she sees fit, so changing that, even for a short time, would be hard for the inmate. I think what was perceived as anger following the lesson is adjustments she has never had to make, so its obvious. It may look like anger, but it seems to me the battle to change who and what she is.

    Mom3.0, Wow! GREAT catch on the emotion/demeanor coach!!! I did not notice that during the hearing, so I went back and watched it after reading your post. It’s so quick, but you can see that Casey subtly acknowledges the coaches physical cues, and then follows suit, as Casey’s head drops downward immediately following.

    And what’s with the water bottle? (I don’t recall her ever having one in court before, but I’m also not that observant). Is it possibly filled with some other clear liquid (vodka?)that she really wanted to take back to her cell with her to relax before jury selection on Monday?!?!

    I’m a bit miffed about the defense wanting the Anthony’s sequestered during the hearing. The only two reasons that my simple brain can come up with are pretty much what everyone else thinks:

    1. That the defense is planning on using a reasonable doubt theory by implicating George/Cindy in the death of Caylee and the defense does not want them to hear/react to the scenarios that will be presented. (btw, It’s odd to me that Lee is not mentioned in this at all. I realize that he probably has his own representation, but why hasn’t he sought to be exempt from sequestration. He will be testifying, no?).

    2. Casey herself is using the same M.O. that has gotten her this far in life, and that is “Divide and Conquer”. (you know what I mean….telling one person one lie, telling another person a different lie, etc. and then NEVER letting these people meet to share/compare stories) She has to know that there will be many undisputed TRUTHS that will be presented during this trial and she will NOT be able to spin her story to mom and dad and “make it all better”. I don’t believe that her biggest fear is that her parents won’t love her anymore once they are faced with the truth, I believe that she is most afraid of the fact that she can’t control them or their thoughts or PERCEPTION of her any longer with her finely tuned manipulation skills. They have been HER puppets throughout her entire life and I believe she takes some twisted pleasure in that. She’d rather have them absent so that, in the event that they do speak/write, she can tell a different story of what happened during the trial than what actually happened.

    This is all just my opinion, of course.

    The young woman sitting behind Cheney Mason is a newly hired attorney in his firm. Her name is Elizabeth. She may very well have been sending Casey a signal at the hearing. Casey needs all the help she can get in court room decorum. Cheney Mason walked out of the jury room directly to Elizabeth and whispered something to her. My guess, the bad news, about withdrawing the motion. Elizabeth could have made “frownie” face to Casey showing she felt bad about motion. Who knows for sure, certainly not me. :-)

    A news station in St. Petersburg, Florida is reporting there is a lot of activity around the court house there. Hummmm very interesting. This area is not as liberal as West Palm Beach. It has been reported that Hillsboro County (Tampa), Sarasota and Clearwater are high conviction rate areas. St. Pete. is right in the middle of those areas. It is also 1 1/2 hours from Orlando approximately. There are a lot of older people there. Justice for Caylee!

    CM came out and looked like he was filling in (his?) young lawyer perhaps about what had just occurred in the room or at least what the accused’s “state of mind” was. To me, the plan was for the accused to focus on this woman as she walked towards the defense table and NOT to look at her parents and the nods were acknowledgments to “keep it together, stay strong, you can do this”. CM was the next focus as the accused made the turn going behind the table to be seated. JMO.

    Still cannot get over the laughing and smiling by the parents. However, what they will see and hear at the trial, IMO, will be the horrendous reality and could finally bring them foremost to be the grieving, supporting and loving grandparents of Caylee Marie. This could be what the accused doesn’t want – - her parents loving Caylee more and crying for Caylee more than her.

    “Nobody in my own family is on my side. They just want Caylee back. That is all they are worried about right now is getting Caylee back.”

    She can’t do another outburst of “But I’m still here”. On second thought maybe she will.

    I for one, am thrilled that the Anthony’s will be able to attend the trial. I want them there every minute of every day it is in session. I want every juror to see every nuance of this family dynamic.

    They helped her to lie, they can help her die.

    You witnessed it this week folks, the divide between Casey, her legal team, and her parents going into this trial is the New Great Gorge of Orlando.

    O and Richard Gabriel, the Jo-Ellan Dimitrius of the Casey Anthony trial is out before the most critical phase of his engagement.

    Interestingly, on his website, he claims he worked with CBS/48 Hours although he clearly is referred to as the consultant for the defense.

    I wonder how Mr. Baez’s bar woes are progressing?

    Mom3.0…again…you are wickedly observant!!!!!! I noticed in the the past 2 hearings, Casey’s usually behaviour seemed dramatically toned down. I thought…ok….but it won’t last. She is who she is.

    My question is…will this ‘tactic’ be allowed during the trial? Isn’t in sync with facial expressions, gestures, body language/movement. CJBP must have noticed. The fact that she needs this kind of coaching is so damning. Perhaps the jury will have a Mom3.0 prototype that pick up on these cues. God willing!

    Also, I personally think Mason lied about the “Analysts” wanting to be on the team. I know for a fact that he trid to recruit Judge Eaton to work on the team for “free” but the judge declined. As for Scheaffer and other analysts, I have no knowledge, but personally I doubt any respected attorney approached Baez or Mason about being involved, as Baez has had a radioactive reputation from day one.

    As for Mason’s altruistic claims about working on Casey’s case pro bono because he believes in her cause; any respected attorney who was interested in doing pro bono work would do it for a person who actually deserved it, not for a person who already had a $200K slush fund and numerous “high profile” attorneys working for free.

    Bottom line, Mason most likely lied through his teeth.

    The rumors of jury selection possibly being done here in Pinellas County are rampant.
    Lots of activity around the courthouse – roping off parking lots, a reported large # of people called for jury pool starting this Monday, etc.
    I’m here presently, but luckily I keep my drivers license from my actual home state in the great frozen north – so no jury duty for me! (my jury duty/registration to vote are all attached with my home state)
    They’d never pick me anyway – but no way I could be locked up in an Orlando hotel room for 3-4 months. Sorry.

    This area makes sense for jury though. Either Hillsborough County (Tampa) or Pinellas (Clearwater/St. Pete/etc) are more representative of more metro area (like Orlando) than some of the other smaller/rural counties that I’ve seen being discussed.
    Mix of many retired folks – but also lots of younger professionals and famililies have moved south in the past 10 years or so.

    Was thinking of getting a protective screen of sorts for my computer monitor – - that family has put it in jeopardy countless times over the past few years – - but justice for Caylee is now FULL ON.

    I’ve never forgotten that day in court when Jeff Ashton gave a powerful account of Caylee’s fate. Can still hear his words with his progressing voice, and the accused grabbing at her own wrists. He had transported us to the final moments of Caylee’s life and transported the accused BACK to what she had done (IMO).

    Jeff Ashton, Linda Drane Burdick, Frank George, LE, and Dr. G. are going to be an insurmountable force.

    I have always been a people watcher. I agree with everyone when they say it may be for other reasons that “Elizabeth” (thanks for the info) frowned(sympathy ect) and I agree it may be a tactic to help Casey deal with avoiding her parents and giving her something to focus on…thanks to all for letting us know about visitation denial & the top up of the commissary account.

    See that is what I cant understand, I mean I get that they still love their daughter, she is after all their daughter, but- loving her and doing the right thing are completely different things.

    Casey does not NEED the money in her account it is simply a luxury.
    The Anthony’s have to know that Casey killed Caylee- my goodness the defense themselves are hinting at accident this, and accident that.

    How can they willingly stand behind their daughter now? They have to understand that EVERYTHING she did and told them for 31 days and beyond, even now, was/is for her own benefit and to torment them & is nothing more than hateful lies…. and they have to understand that her whole kidnapping story was a lie…. and they have to understand that she willfully lied to police and to the searchers and to them… about little Caylee being somewhere alive and well and the Anthony’s being in danger and Casey fearing for them and herself …they have to realize that the Diary of Days was a confession of sorts and a horrible FU message to Caylee’s family…what is given can be taken away..everyone lies everyone dies…- they have to realize the stain is more than a banana & more than trash..and the smell is more than garbage & gas…and they have to realize that Casey cleaned up and the PT’s are full of gravewax…and they have to know now, that Casey threw their granddaughter in trashbags and a laundry bag and left her to like trash and be torn apart by wild animals -because she is a “spiteful bitch” and hell I think JMO that is the reason Casey did everything…just because she is a spiteful bitch. Nothing Casey has ever done is her fault always some one to blame…”NOT MY FAULT”

    I know the latest rumors of accident and most are thinking that Casey is gonna claim that her parents and bother abused her physically mentally and sexually- and she was afraid to tell them the truth and afraid to go home and suffered a breakdown of somesort- well I say BS she was fine the night of July 16th and she was fine the times she came home from jail she was fine in every visitation video- and she was fine throughout every court hearing and every motion to get the visitations sealed…

    Caylee is dead- she has been dead longer than she was alive and I think it is about time the Anthony’s start realizing Casey is never gonna wake up and say Im sorry and it was my fault… all my fault

    No she is gonna sit in court and let her team claim Caylee’s grandparents are the reason she is dead and if anyone is to blame it is them and their son and their family because Casey was abused, & was just doing what they taught her to do- keep secrets- use em’ as ammo when necessary -Live without consequence-blame everybody else-never take responsibility- lie and lie some more- never let them break you – clean up your mess and deny everything while holding your head high no matter what.

    The Anthonys lied to try and protect their daughter from prosecution- and they happily promoted scenarios in which innocent people were thrown under the bus…it seems only befitting that Casey will go down with them looking on.

    My husband made that very comment the other day. He asked me why I was so attached to this case when there are children in our community who die at the hands of an abuser.

    I have not forgotten abou them. I pray for their precious souls. I think it’s the unique set of circumstances combined with the family dynamics of Satan that made it was it is now. Who knew this would go from looking for a missing baby girl, to finding her remains, to a family’s dirty laundry completely exposed for all of the world to see.

    Nobody could write this stuff up.

    If it weren’t for my faith, believing that these sweet babes are in the precious arms of the Lord, I’d be broken on every level.

    Well said. I recall shedding a lot of tears hearing Mr. Ashton’s account of what took place in front of Caylee’s eyes. It’s that EXACT ability that will give the jurors an opportunity to ‘sympathize’ with the horror Caylee endured at the hands of her mother.

    Well, Blink, here we are less than 24 hours from the start of trial. Been quite a ride.

    There’s jury selection articles, they seem to contradict one another (and bet they don’t all agree on what Mason said about wanting old people on the jury– he wants maybe something else? Who knows, but he says what he says with about as much believability as Casey).

    LeviPage had a guest on last evening for the case against CA, Holly Hughes, defense attny (was prosecutor previously) who talked about the jury selection, again another different opinion of what each side would want– no young mothers. But this guest doesn’t seem to be speaking for ‘this defense’, as she thinks if the defense goes ‘accident’ (another Mason lie clue for In Session?), it doesn’t have a chance in he11. All of that Mason shtick, his nice easy going voice, his claims to like this client because she’s a nice human being, and he likes her a lot more than his other murderers. ;)

    Holly Hughes says their client “has already put her defense in the soup”, she also says the defense throwing George under bus, as the killer, there has to be some indiction of liability, some good faith basis, for putting that before the jury– she doesn’t think it’s going to get past the judge into trial.

    There is a good faith basis if he goes along with it. Yes Kleat, off we go.

    Kleat – thank you so much for the link!! Not one second was wasted and I felt it put many of my thoughts and questions in perspective. I would recommend that everyone listens in preparation for the Trial. I agree with Holly, Lee Anthony has always been the wild card to my mind. It will be interesting to see how he behaves. I loved her contention that all the media needed to do was to go to the Jail, wait for Casey to be picked up and to follow the van!!! Bingo, they have found where the jury would be selected from. There was no need to go before Judge Perry, just to use their reporting instincts. Really interesting listening, thanks again Kleat.

    ATG, thank you for the Mother’s day greeting. I’ve had a fun but tiring weekend–chaperoning middle-schoolers on a 17-hour field trip, a school fun fair, a used book sale, church, the usual housework/laundry/grocery shopping, a little work for the office, some friend chauffering, a walk through tulips, an attempt at kite flying (the sun came out and the wind died), gifts hand-made with love (a popsicle stick candy dish and a quilled lizard), a card on my pillow, flowers cut from our garden, curried shrimp and Italian ice, and hopefully a snuggled-up movie yet to come.

    And, YET, Caylee’s fate is on my mind, and I logged in to be sure there were no last-minute stays on jury selection. JBP may not be perfect, but I’m counting on him to hold the course through this trial.

    Happy Mother’s Day to the rest of you moms; may life bring you as much love as that with which I’m blessed. I miss my own Mom so much, but find little bits of mother-love in so many.
