Caylee/Casey Anthony Case: Mock Trial On CBS- They Got The Mock Part Right- CBS Footing Bill For Richard Gabriel Defense Jury Consultant

Orlando, FL-

On Saturday evening, Central Broadcasting Service, the second major affiliate to pay  Anthony family members for “licensing”, $20,000  for the 48 hours segments, aired what was labeled as a pseudo mock trial with a pseudo mock jury.

CBS 48 Hours also  STATES THEY COMMISSIONED the focus group.  Are we clear on that?  CBS has outright admitted to contributing to the costs of the defense expenditures of Casey Anthony.  That is a source of income to this defendant, period.

It was not until one tuned into the program that we learn what was billed as a mock trial of sorts, whereby previews show jurors would acquit Casey Anthony based on the evidence to date, of 1st degree murder, that this is actually a "focus group" where the moderator, Richard Gabriel, President of Decision Analysis, actually works for the Anthony defense team.

Bio Excerpt:

Richard Gabriel: President

Richard Gabriel is the President of Decision Analysis. Since 1985, Mr. Gabriel has been a leader in the field of jury research, jury selection, and litigation communication in nearly a thousand trials in both the civil and criminal arenas across the country.  Mr. Gabriel has assisted counsel in the O.J. Simpson, Heidi Fleiss, Phillip Spector, Enron Broadband, and Whitewater trials, and is currently working with attorneys in the Casey Anthony matter. Three cases he has participated in have resulted in United States Supreme Court rulings.

Judge Perry denied Jose Baez's request for payment to Richard Gabriel as a jury consultant to the defense.  In some fashion, we must assume he is paid.

I say that facetiously- this man is the Jack Welch of jury consulting and influence.  During the broadcast, host Troy Roberts discloses that CBS is footing the bill, as a thinly veiled disclosure of sorts.

Say what you want about Gabriel, he is pioneer in his field, and he is being paid to do what he was hired for.

In a pre-trial engagement, the focus group is the pre-cursor to an actual mock trial, should the defense engage the further services of Decision Analysis.

Forgive my oversimplification for a moment, but in layman's terms, this is a straight up product development strategy, exactly the same in process as any major consumer brand attempts to develop or re-brand something they want YOU the consumer to purchase in abundance.

The "re-brand" in this offering: THE INNOCENCE OF CASEY ANTHONY FOR THE MURDER OF HER DAUGHTER CAYLEE.

HEH?

As a former Advertising Professional, this epiphany gave me my first chuckle for the hour.

Allow me to present a hypothetical scenario, I say hypothetical because hypothetically my former client would have requested a confidentiality agreement with my firm of course.

Scope: Recruitment Initiative, Conduct, Moderate and Quantify Result of Focus Group.

Account Supervisor: Deena Whitman  Draper

Project Code: Condiment Verdi

Let's start with the recruitment.  It is mission critical for any part of the focus group to even matter, to secure the right market analysis which personifies the optimum "buyer" for which the product analysis is being conducted.

In Law: We replace the "buyer" with the juror, or the trier of facts.

In last nights episode, we were never told how this group was recruited.  We do not know if everyone of those folks are paid actors.  We do not know if they are members of any one's family affiliated with this case.  We do not know if any of them thinks Casey Anthony dancing on a table with her bewbs popping out of  her dress, paid for with stolen funds, which resulted in her felony conviction.

You get the gist.

Focus group participants ARE PAID. Focus groups appearing on CBS 48 hours are PAID WELL. Focus group moderators are PAID.  Jury Consultants posing as focus group moderators make a freaking fortune.

WHO IS PAYING ALL OF THESE PEOPLE WHEN THE CLIENT IS INDIGENT???

I digress.  Please allow the following example in demonstration.

Project Summary Excerpt:

The focus group for Project Condiment Verdi indicated an overwhelming negative reaction to the proposed product offering. This data is further supported by the market trend analysis presented in Exhibit A.  Ms. Draper, Account Supervisor to BEINZ, outlines some additional launch concerns in the forward thinking section of the recommendation outline, including, but not limited to, a child's association with similar substances of similar hue and viscosity may be mistaken for said product and be harmful.

The recommendation of this project director is that BEINZ abandon exploring additional R&D and launch options for this product.  Moreover, in the event that BEINZ elects to move forward with Condiment Verdi, the undersigned does not feel that our firm could best represent Beinz's interests for a launch design or additional campaign needs for this product.

You see where I am headed with this, right?

The hypothetical client launched anyway, and it was an abysmal failure.

Expensive focus group, expensive launch, expensive loss.

The BAEZ LAW FIRM is no stranger to expensive losses, however.  It would seem that although Casey Anthony and members of her family, were the recipients of at least $275K from abc, a large amount of which is still unaccounted for, money is no object.

Also appearing on the 48Hours episode and introduced as a former member of Casey Anthony's defense team, Linda Kenney Baden discusses what is not in evidence.

Did I miss a release floating around somewhere? Would the fact that she is former council for the defendant in the instant case PRECLUDE her from discussing what is tantamount to work product?  Who waived this privilege for her statements?

Additionally, as she claims to have departed from the defense team in October 2010 due to the inability to pay travel expenses, who is paying for her travel expenses and any monies for her appearance on 48 hours?

People- she still works for Casey Anthony as a consultant, she was present and identified at the deposition of  Dr. Timothy Huntington in January 2011.

Again, I say, how is she being paid now?

In theory, if an attorney withdraws their appearance, in her case, pro hac vice, can they return as a consultant paid for by another source? YOU BETCHA.

Last Friday Jose Baez argued before the court that he has concerns that his client would be unduly influenced or PREJUDICED by pre-trial publicity in this case.

He was of course denied, because contrary to what has seemingly occurred to date in this case, the Supreme Court of Florida does not give a rats azz about Nielson.

Short Version: CBS and this defense has engaged Richard Gabriel and Decision Analysis for EXACTLY the purpose of influencing potential jurors.  Says so, right on his webume.

Is that the role of the media during sweeps  now?

Sometimes, successful longevity tested products DO gain some alterations to their iconic reference.

For example, a fave of mine as a kid, and widely sold to this day in hundreds of variations of product distributables, is also used synonymously with suicide and altering rational thought.

Don't drink the Cool-aid folks.  Drink the Kool-aid.  Big difference, one is real.

Wow. What a novel concept.

Influencing criminal case outcomes to sell more advertising based on consumer interest.

I certainly hope the net result of that is not maternal homicide for diaper ads cash to get away with it.

What next, "Big things come in little packages" on the side of a funeral urn?

Be appropriately horrified.  Do something about it.

Yeah, the verdi condiment was so predestined to be a nonstarter.

I confessed; I watched the program last night. The focus group portrayed as a mock jury was just disgusting. What percentage of the viewers will get that difference?

So what something can I do about it? Boycott the advertisers to set a precedent? I could/would do that.

However, I watch very little television. (I had to both plug it in and hook up the cable connection on the one in the bedroom last night.) And I think my brain has adapted to completely tune out the commercials. So tell me who the advertisers were and I’ll commence boycotting.

    Or . . . what?

  2. Darth says:

so is there anything that judge perry can do!? or are his hands tied becouse of the pallet court appeals? THIS has to stop! it is overly disgusting the lengths this defense team has gone to to aquitt a TRUELY GUILTY CLIENT! and in the end all the time the victim THE ONLY VICTIM OF THIS CASE get’s smeard and her memory spat on ALL THE D*** time!

  3. lizzy says:

Baez is still promising to explain the 31-day delay, including the partying, when the trial begins. What’s he going to say? My creative skills hit a wall on this one.

Even if he lays the blame on GA, or claims an accident, how can that explain the partying? (“Oh my dad accidentally killed my daughter, so I had to blow off some steam” just doesn’t fly.)

Is Zanny going to have been a cover she used to protect GA? Will he claim an accident, and that GA told Casey that Caylee was fine, and he had her somewhere in good hands for a while so that Cindy wouldn’t find out about the injury and try to get custody?

I just can’t figure out an even semi-plausible cover story. The paragraph above is my best attempt.

And I can’t STAND that smirk Baez gets every time he promises to explain it in the opening statement. Has he tested out different stories on focus groups? Did they show the response from the one that sold the best?

  4. chelsea says:

Blink, maybe this is an odd question but….. Is a Defense Attorney legally or morally obliged to use any method available to get a Defendant off at Trial? I truly could not live with myself if I knew without doubt that my client were guilty of killing her 3 year old child in the manner that Casey Anthony did, and that it were my efforts that subsequently allowed a killer of such a heinous act to go free. I have banged on about Casey not having a conscience but I am beginning to believe that neither have Baez and Mason. Is this all about money, ego, 15 mins. of fame? Please allay my fears Blink even if it is only to explain that Casey could still be found guilty of manslaughter and would still face a severe punishment. I feel sick to my stomach!!!

    Great article Blink!
What can be done? It seems like it’s a bad precedent to allow or ignore not to mention infuriating, given Baez and Mason’s mantra about the State spending “millions” or whatever term they use.
This case is high profile, doesn’t the JAC have a vested interest in this? Doesn’t the FBA have any cause for concern? I don’t understand how this type of behavior continues, from the minute it began there has been one questionable or unethical choice one after the next.

Maybe if you can answer one other thing, do you see the evolving testimony of key witnesses (cindy, george) as witness tampering?

  7. Word Girl says:

    Mock,mock,mock!

The jury won’t stand for any Mock-Mock jokes in the real trial.
I believe they will be appalled and take their business seriously.

Caylee Marie Anthony is SO beyond this, and SO over it…
    Let Lady Justice weigh in.

  8. A Texas Grandfather says:

Thank GOD I didn’t watch this farce. IMO Linda Kenny Baden is a disgrace to her husband and the legal profession.

If she did not have a proper release from the court for this foray into idiocy, maybe the court should bring a large fine and begin disbarment proceedings in the State of Florida, if she actually has a
    Florida license.

If the state of Florida has expended money to the defendant as an indigent, they should sieze all of the CBS funds and appoint an accounting firm to recover the state monies.

It is time for lady justice to get tough with the crazy and possibly illeagal tactics of Mr. Flyez.

  9. FRG says:

    Blink,

Thank you so much for the article!

JB told KC she would have a mistrial! He is doing anything possible to reach his goal! He forgot one thing, the trial is in Florida, not California (no offense to people from California, please) therefore JB and CM are in for a surprise, they are no match for Cochran, and KC is no OJ Simpson! KC will go down!

Now, I would like to say LKB that if KC walks she should hire KC to babysit for her grandkids after all she said KC is a good mother! Insert rolling eyes here!

    Sick, sick people!

Now, how JB is allowed to practice law is beyond me! When will Florida Bar really investigate JB’s affairs?

I do hope the judge gets wind of the show. I also wonder what can he and what will he do if anything!
now can baez complain about the locations for jury selection? and did the judge allow him to hang himself and of course it will come back and bite him in his motherlicker!!

I know the judge is aware of the 48 hr things he mentioned without coming out and directly saying it but of course it went over baez head!! as does everything else!!

when baez goes to appeal anything the judge can hold him over a barrel and what I dont get and maybe momof 3 and blink can xplain??
why did baez tell the judge he wanted no cameras in the courtroom and when the judge said he couldnt do that baez said theres always a first time!!!

I think mason is egging baez on and has been for sometime!!! he tells him what he can do and not do and what he should do!!!

blink isnt there something that can be done? by the honroable judge!! dont you think family members and colleagues of the judge have enlightened him about the 48 hrs even though he was aware he didnt have any idea until they actualy aired it!! or he had an idea!!

help can something be done to put a stop to this????

Mock jury in law schools requires BOTH sides to be able to presented….This focus group was a DISGUSTING JOKE, the butt of which was poor sweet Caylee!. I nearly threw something at the HD plasma TV, I was so infuriated!! This was nothinmg more than a BIG marketing ploy with as much integrity as a Side Show barker!

Blik _ i just hope that this did not taint the jury pool!!! The unmitigated nerve of Bozo to say on Friday at the hearing about barring the media at the trial. The only one who has been out there in front of the media (except when they’re running from WFTV’s Kathi Belich) is Bozo and NotPerryMason!!

  13. cherylz says:

I did not watch it…couldn’t bring myself to. How can those people live with themselves, is beyond me.

  14. Kleat says:

Yes!! Begs the question about JAC rules of ‘payment in kind’ to indigent clients. And about the original almost 300 thousand, did Baez spirit away x no of dollars for his ready to withdraw at a certain point, to become ‘consultants’ (pre-paid consultants, also there are possible pre-paid experts such as Reichs and Kobilinsky, for whom the pay-slips will be forthcoming from CBS as well for last night’s re-performance. Can’t imagine Reichs, with her regular television series and book deals, would give anything away for free to CBS).

Investigating what I call the Mock 12, their payment whatever form it would take, is something the JAC might overlook, fighting CBS might be more than they have time for. But other questions about the choice of these ‘jurors/panelists’ should include first off, whether these people had other agendas, anti-DP for example, and were any vetted for their opinions on a DP (IOW, would they even qualify for a DP case?).

CBS is setting a new low standard for ethics in journalism.

I am so absolutely galled that this chit continues.

I don’t believe there is any way that Judge Perry is not aware of these recent sleazy dealings of the DT with 48hours/CBS and Richard Gabriel.
The man must get up each day and read/watch the news.
I remember Judge Perry saying he’s up every morning at 5am … I imagine he has his routine and catching up with the world is part of that.
It would be difficult NOT to hear/read of this latest DT bullcrap in the media of central FL.

Will Judge Perry do anything pre-trial about this ?? – or hold his tongue to try to get this trial finished without appellate issues to worry about.

How about the JAC ?? Seems to me it would be their job to investigate the shady financial wranglings that went on between the DT and CBS that effectively paid the fee of Richard Gabriel.

Are both just waiting until the trial is over – and then let the FL Bar review all the dirty money deals and unethical behavior in which Baez and Mason et al have involved themselves in ??

Just when ya think you’ve seen it all and that the DT couldn’t be any more of a bunch of slimeballs – they find ways to top themselves.
One saving grace is that the media in the area will not keep this crap quiet.
They will expose all the dirty and unethical dealings. IMO

At the end of the day …
I believe that not only will justice come for the sweet babe Caylee … but also that Baez/Mason and associates will face the consequences of their unscrupulous and unethical tactics.

  22. Eloise says:

Terrific article Blink! Just need a glass of Casey on the side.

Despite all the wrangling the DT did, has done and will do, they still continue to omit the most important part to their story. Empathy for the missing and murdered baby. That’s the ticket folks, even with all their tricks they can’t fake the missing link that will make the jurors KNOW that Casey is guilty.

HJBP must have a plan in mind to handle this situation. I am certain he was well aware of the impending programming. I mean can we imagine JA not mentioning it? lol.

In the big picture, Judge Perry is the best assessor of the traffic flow in this case. He’s aware of the Grand Jury, he’s heard mulitple pre-trial motions, he understands the depth and breath of this case.

He will supervise the selection of his Jury. He will instruct this Jury and caution them as he sees fit. He believes in the system and believes that justice will prevail. He is very much in charge of this situation and I believe, as much as I hope, he will see that some degree of justice is provided for the Innocent–in this case, named Caylee Marie

  34. KZ says:

Well, one thing I know for sure. If “IT” was an accident, and my sorry backside was festering in jail charged with first degree murder and the DP, my lungs and my larynx would be SINGING accident and all of the details at the top of my screechy voice. Wild horses couldn’t keep me from telling everyone who would listen about the TERRIBLE accident that befell my sweet little toddler. And what a complete bonehead I was 2 1/2 years ago for making up the stoopid “Zanny the Imaginanny” story.

So…if accident is what the defense team would like to advance, I’m all ears, as a prospective mock jury member. Let’s hear it directly from your lips, Casey. With 7 counts against you, all you’ll be convicted of is 4 counts of lying (4 years)–which are a foregone conclusion if you testify to accident, and aggravated child abuse for not reporting Caylee missing for over a month (up to 30 years). Oh wait– involuntary manslaughter as a lesser charge– how much does that carry? 4 years or so? So all you’ll get is 38 years! Score! Eligible for parole at about the (postmenopausal)age of 55! (80% of sentence served.) And we all know that eligible for parole rarely results in parole on the first go-around.

No, this 48 Hours special did not help the defense, IMO.

the 48 hrs did not help the defense quite the contrary they shot themselves in the foot.

  39. Sandy says:

    Hi Everyone,
This is my first post here although I am a faithful follower. First of all, I would like to say that bc of 48 Hrs. publicizing/prejudicing the potential jurors, I believe HHJP has every right to negate going outside of ORL to find unbiased jurors. The defense obviously wasn’t worried about potential jurors seeing his slanted view of the jurors verdict, so let’s save FL some money, and pick a jury from ORL.

Also, it is my theory that Baez is going to claim that Caylee’s death was an accident, and Casey went into a ‘disassociative state’ (kinda like another personality emerged) due to the trauma of Caylee’s death. She was so traumatized by this, that her bizarre behavior wasn’t actually “her”, but someone she unwittingly became (post traumatic stress), due to the event. Literally, splitting off from her conscious self, and having another personality emerge to take over dealing with the babies death. Hence; dancing, shopping, partying, and all other consciousness of guilt behavior.

    Blink, any thoughts?

Until this gets to the penalty phase, Casey can scream crazy through her eye daggers only.

If these legal baffoons did their jobs correctly, this “focus group” should have been conducted 2 years ago, and what it would have told them is 2 things.

    1. Mount a mental defense, as in, what Terry Lenemen was brought on for, and imo was largely rejected by Baez’s need for funding. Make no mistake about it. The Casey Anthony kitty was worth nothing if there was no salacious trial.

    2. Reasonable people will resist the fact that she murdered her own child by nature, and in that regard, the state would offer a plea deal with a proffer that was true, if it was, and this girl would get out of prison young enough to nauseate the free world some more.

What was NOT seen by the focus group, of course, were any autopsy photos, crime scene photos, or of course, the ever popular fact that this girl made $275K at a minimum.

However, let me tell you what is going to seal the fate of Casey Anthony.

It is none of the above.

When the State humps (sorry, Jersey term and is a verb or noun) that trunk liner into the courtroom, and the jurors and gallery get a wiff of what will unmistakenly be the smell of death, it will make the barf-o-rama scene from Stand By Me look like a nursery rhyme.

Did y’all catch Mr. Baez say.. “the trunk stunk..” lol. Told ya.

The offering of expert witnesses which was all dang hearsay and not “exam based” as a counter to “consciousness of guilt” was laughable.

That said, it continues to slay me that 11 lawyers, what is likely to be over a million dollars in legal fees, and of course Major Media backing to affect outcome, are all going to fail.

No wonder this girl thought she could get out of this.

  40. Jnpgh says:

lizzy @9:43 pm – I agree with you totally! ALl those “alleged” jurors indeed did look around at each other so much as to way “IS THIS WHEN WE’RE SUPPOSED TO STAND??

Also – I bet that whatever payment was made (for Gabriel, Linda Kenney Baden, Bozo and NotPerryMason – as well as the focus group members) were all paid by CBS who stuck the advertisers for that expebse.

CBS already “owned” all the pictures and the tapes of $indy and Gigolo-George ….so the advertisers footed the bill.

All that I want to make sure is that the Prosecution has pictures of all those “focus group members” …so that – just in case they get a jury summons ….they CAN’T come on to the actual jury.

I hope taht Linda Drane Burdick and Jeff Aston has printouts of the various scenes of those 12 low-lifes so taht they can’t be “planted” on to the final jury or alternates. I don’t know who long ago this “focus group” (rolling of eyes) was recorded …but I trust Bozo as far as I can throw him …and that ain’t far.

    Thanks BLINK!!!!!!!!!

  41. Mom3.0 says:

Excellent article Blink- Thanks for telling it like it is. Something is definitely wrong with The defense taking to the airwaves in this 48hrs “mockumentary”.

I watched the show- yuck- first it was boring- second it glossed over every major point in this case- the duct tape- the zanny lie- Caylee missing- the 911 calls- the jail house visits- the bug evidence- ect. The footage that they showed was a thinly masked attempt to sway non-informed people regarding Casey’s case-

The theme seemed to be- Hey look what she and her family went through….nasty rotten protesters…. Casey was a loving mother Clearly something went wrong… She didnt murder her daughter…Caylee was too cute….Something is wrong with this family dynamic…*IF* something happened… it had to be an accident… she freaked out, she was scared….to believe otherwise is ludicrous… there is a very compelling reason (she chooses to sit in jail for nearly 3 years…and told lie after lie…and waited 31 days…ect)
*According to LKB she lies because of how she was treated…and how she grew up- of course she lies wouldnt you if you were an Anthony?*

The new lies by Cindy & George were disgusting- (for instance: pp) Casey met up with some old friends she hadnt seen and decided to catch up–so I wasnt worried about Caylee & Casey not coming home… I walked them to the car and blew kisses to them as they were leaving…. the old lies were obvious and tedious.

The defense experts and “consultants” and lawyers were sickening. Disgraceful…. (pp) Did George do this? I guess we’ll just have to wait to see what comes out at trial… I wont speculate outside of the courtroom, everything will come out at trial… This is the biggest case with the least amount of evidence I have ever seen in my entire career… the flies are extremely common…the trash is the reason for the smell… Casey cant get a fair trial because of all the media attention…so CBS brought in the defense’s Jury consultant to what? help? How? & Who?

Certainly it was not unbiased and WHO paid all these people? Reichs- got a shot of her book…what did everyone else gain?

    We are led to assume
Casey couldnt have done it…but George might have or RK might have…or Cindy…or Jesse Grund or????…wait it had to be an accident.-

There was no mystery in this program…other than who got paid and how much and when.

Yes Blink, it was a disgraceful attempt to repackage Casey as the victim she always said she was…It was a repackaging of the lies and of the Anthonys – Cindy as clueless and George as dismissive… both as foder. Caylee as dead and gone but “OUR GIRL” too cute to kill outright- and LE/State as overzealous…

We have a year to change people’s perspectives…we are on the same team….

Snipped from Cindy letter to Casey-

-I love you, Casey Marie, and I know that you were the greatest mom and that you don’t deserve to be where you are. It’s about time that we work as a team. You and I are great together and I cannot think of a better person to fight for than you. We need to fight for Caylee as well. As long as you are in jail then Caylee is not getting justice either. She is still our primary focus. I know you would go to the end of the earth to protect her. Everyone has lost sight of her in all of this. .. Somebody needs to be punished for destroying our family. I am going to fight for you and Caylee until I die. We have a year to change people’s perception. Most people believe in you already anyway, it’s just a few Nancy Grace diehards. We can keep her at bay as well.-

    ——-
I want to let the Defense know that their new marketing ploy failed, miserably.

I have friends and family that do not care about this case…but they do watch 48 hours…

They all said the same thing:

—(pp) That guy (jury consultant) works for the defense…so does everyone else that mentioned any evidence being not enough….her family obviously are trying to protect her… thats too bad about those crazy protesters….her family cant be that bad, they didnt punch out those crazies…& they let her live there rent free and babysat…the defense team must really be scared to go on this show and only say that there is a compelling reason for all of her behaviors and then offer up that it was an accident. That poor little girl- she was so sweet… Its sick they are trying to pin this on her grandpa and grandma….how sad her mom didnt want her… why didnt she just let her parents raise her….they were good enough to babysit…. do you think she chloroformed her before she put on the duct tape? I hope she spends the rest of her child bearing years in jail.

So, IMO Defense, The New Improved Casey BS marketing ploy-is a total failure…JFYI

Great Job Blink and team- Loved your pics- No one I know drank the Casey Coolaid, it was not drinkable- and obviously was tainted and should have contained this:

warning- harmful if “swallowed”- in case of contact- immediately wash out eyes- contains noxious BS – may turn consumer into a blind misinformed gullible baffoon-

    AJMO

    Lol, nice assessment Mom 3.0-

Having spent years of my life drafting creative briefs, conducting thinktanks, client distillations on and offsite for their ultimate message development, it was clear to me what was “supposed” to be the subliminal takeaway from the 48 hours episode.

Their goal was to impart that a juror that convicts Casey Anthony will be seen as one of those derelict protesters outside of the Anthony home, specifically the ones screaming obscenities in front of small children and the one that closed her door on her own child.

What they failed to take into account in this “synopsis” is that not only is their client and her family unlikable, they themselves are grossly under-skilled on basic criminal law process and procedure.

How the hell do they then expect to “weave in” that very concept when on a very basic level, the disparity of something I like to call “finesse”, in skill level and delivery between the prosecution and the state is so wide you could drive the bus through it on the way to George.

Part of crafting a message and strategy MUST take into account the “product” and the assets with which one has to “drive it.”

This will have the same effect on a jury as zoo-goer’s feel when the babboons are slinging their poop at them.

They know that they are being pelted with poop, and they want it to stop before it sticks to them.

Thank you God for sending us chica!! – You make my day, I laugh out loud at your comments even though inwardly I ache at the demise of a child called Caylee Marie; murdered by her mother and forgotten by her grandparents. My only hope is Lee can dig deep and honour his beautiful little neice by telling the Truth at Trial.
Had to smile at Word Girl’s F error!! lol.

  43. JustJill says:

It was stated that the “mock” jury heard only 4-1/2 hours of testimony of evidence from the state. I’m pretty confident that the State of Florida will take considerably longer in presenting the evidence against Casey than 4-1/2 hours. I don’t think this program did anything to help the defense/Casey. It was simply a disgrace. I am very disappointed in Linda Baden Kinney too.

  44. GinaB says:

Blink – you mention the State bringing the trunk liner into the courtroom for all to see and smell, what a horrible thing for the jurors to have to endure. I wonder how Baez and Mason plan on coaching Casey to react to that. The whole courtroom will undoubtedly be horrified, and what, Casey and her defense team, will just sit there and pretend the smell is from just garbage? They have no shame, they are despicable.

This is exactly what I am saying. I am very concerned about the level of “morbid” these citizens will have to endure.

When you review just the forensics of this case, and I am speaking generally on purpose, factor in the age of the victim, this is one hell of an emotional burden while folks are away from their families for 2 months.

I feel for them, truly, but I just want to point out that the circumstances we are talking about will convict Casey Anthony once and for all.

  45. GinaB says:

Her fate is sealed. It doesn’t matter how many notebooks, pencils or binders they give Casey to wildly flip through during damaging testimony or how hard they try to coach her, she is going down. I agree with you 100%, Blink, and I am happy that you point out all of the circumstances that will ultimately convict her. Too bad Casey’s own attorneys can’t do that for her, because, if they did, Casey would have begged for a plea deal a long time ago.

  46. Morgyn says:

Wow Blink I hadn’t thought of the prosecutors actually being able to bring the trunk liner into the courtroom. How gut wrenching (no pun intended) this will be for the jurors and spectators. Jose has said all along that there will be an “AHA” moment during the trial and this could well be it, though I’m sure that’s not what he meant.

    Not what he meant, correct.
    B

  47. TiaMaria says:

And another thing that is going to contribute to the needle in her arm? Her demeanor in the courtroom. The jury is going to be facing her, now that her buffoons, um, er, attorneys have made the dramatic choice of the table directly across from them.

They will be able to get a great view of her doing at least one of the following: Poking her eyeballs to try to conjur tears (but no moisture), laughing, giggling and feeling up any man within 8 feet, playing paralegal, writing her memoirs for her book deal, or staring straight ahead like the cold, unfeeling monster she is. Anything but paying attention to what is being testified to.

On the odd chance that she DOES pay attention, or show any real emotion, it will be those obvious sparks of hatred and disdain that fly from her eyes when she is “betrayed” by a former friend, relative or the much-hated-for-being-successful-and-anything-Casey-is-not Linda Drane-Burdick or Jeff Ashton.

No jury consultant or behavioral coach in the world is going to be successful at changing the real Casey or hiding who she is from that jury.

  48. Jnpgh says:

Blink, do you think that they’ll bring the actual trunk liner into the courtroom, or do you think that they’ll take the jury to “expeirence” the deathmobile in an OCSO evidence bay???

I remember for Thomas Capano that they brought the actual cooler (that he had put Anne Marie Fahey’s body in) into the court-room, and the two bailiffs who brought it in almost seemed like pall-barers bringing in a casket. With Scott Peterson, they went to some evidence warehouse to see the boat. Mark Geragos (Scott’s attorney) had been saying that the boat was too small for Laci’s body to have fit in. But evidently, when the jurors got there, one of the women jurors (roughly the size of Laci) got in the boat …showing that indeed it was not too small. Evidently THAT was one of the “AHA” moments of the Scott Peterson trial.

Do you agree though that Bozo and NotPerryMason will NEVER put Casey on the stand (either for guilt or penalty phase)??? Meaning, that if it is now supposedly an accident, she would need to TESTIFY to that extent. Right now, aren’t they stuck with the Zani story because that’s what’s in her sowrn statement and her interveiws and 911 tape, correct??

    thanks, Blink!!

I think they plan to present the liner and have it admitted into evidence while the defense will object and be overruled.
    B

  49. KZ says:

Wow, Blink– you really think they will bring the trunk liner INTO the courtroom?? For the jury to small and examine in person– not just from photos and reports? I had not seriously considered this. That is just stunning to think about. Very sobering. Especially if Dr. Vass is there for his testimony. Dr. Vass’s GC/ MS reports might not be needed after all, just his own statement that “that” odor is the small of human decomposition. And of just about anyone associated with this case, HE should know.

Man, what a sobering thought. But if they can do it, I hope they do. Caylee left evidence behind, and to have that evidence in the courtroom really feels like justice is coming.
