Caylee/Casey Anthony Trial: Judge Calls The Defense Liars And The Prosecution Resurrects The Fumblerooski

Orlando, FL-  Judge Perry calls the defense team Liars- Not a good sign. Yesterday, during Chief Judge Perry’s announcement to the jury about the tentative schedule for the remainder of the murder trial against Casey Anthony, defense counsel Cheney Mason objected and asked for a sidebar.

Mason: We don’t have any obligation to put on any evidence at all. and you just told the jurors you expect us to be putting on evidence, and we may or we may not.

Mason went on to request that the Judge instruct the jury that they are not obligated to put on a defense, and claimed Jeff Ashton agreed with him.

       Chief Judge Perry: Then Y’all lied to me.

       Mason:NO. Chief Judge Perry: “Yes the Hell you did…”  If you don’t put on any   evidence, then I will do that.

       Mason: Well, we are, so don’t worry about it.

      Chief Judge Perry: ..” I will take I cannot trust one thing your side says, anymore.

 

Heh?  I would like to give the benefit of the doubt to his honor, as I did not believe a word this defense had to say going into this trial, let alone 3 weeks later. The State, after establishing what they believe is the origin of the disappearing heart residue on the duct tape came from stickers in the drawer with Caylee’s birth announcements, and re-calling Cindy Anthony for a little light impeachment is headed to the finish line tomorrow.

*Insert defense’s motion for mistrial late today*  Denied.

To those of you, and there are many, screaming from the hilltops.. “Is that all you got?”  “OMG, is this girl gonna walk?”  “What about Dr. Hall?”  “How the Hell is Dominick Casey getting out of testifying?” I say chillax.  This prosecution team is simply resurrecting the F U M B L E R O O S K I.

The State of Florida, has ALWAYS known this case is going to verdict on THE LAST WORD from the prosecution, or the rebuttal portion of the trial. 

 Given the defense’s opening statement, there is no question in my mind, nor should there be in yours, that the ludicrous allegations made on the first day, cannot possibly be brought to bear, and while the prosecutions case in chief was meticulous, it is not the “barn burner” for a reason.

Linda Drane Burdick is going to leave that ball on the field for a spell.  Ashton will surreptitiously pick it up and head to the end zone unchallenged. 

 After all, that play did originate at the Orange Bowl.

    All I can say is when you get to listen/watch huntington in the “hot seat” w/ the amazing ASA Ashton firing questions, turn the ringer off phone, make sure you have a comfy chair [as huntington was the only defense witness] & something to drink ‘cuz you will not want to miss a second of the “schooling he gets…”

    Wowza . . . JB’s Bar tab appears to be increasing with yesterday’s and today’s shenanigins with sneaking in expert testimonies not included in their reports.

    Regarding JB’s texting at the podium, this texting has been going on a while at the defense table. Strictly just my opinion, on the other end may possibly be “consultants” . . . oh, like . . . LKB or others “behind the scenes” guiding JB real time, while observing the trial and testimony from afar.

    My fondest wish for young Dr. Huntington is that he practice a few more times in front of the mirror before testifying to anything more than a speeding ticket. Ever. The weird grinning and smirking is not becoming on someone professing to be an expert in the bugs that feed on dead children.

    Score for the prosecution. Him testifying vs Drs. G, Haskell and Vass would be like, well, me doing it.

    What in the world was the defense thinking hiring this media-grubbing senile old fool??
    The man needed to retire a decade or two ago.

    First Spitz acknowledges he only did 2 interviews. (Detroit Free Press and one in Orlando)
    Jeff Ashton: “How about 48 Hours”
    Spitz: “I don’t remember”
    Ashton: “How about the Today Show?”
    Spitz: “I don’t remember”

    And then …
    Spitz said something like … “Because this was a big case in the media I would have done this and that in the autopsy”
    Ashton: “So, because is a big profile case, you would conduct an autopsy differently than the average autopsy?”
    Ashton: “You like high profile cases don’t you Dr Spitz”

    In Spitz’s theory …
    someone took the body, then placed duct tape on it (once it was a skeleton), then replaced the skull in the swamp, and THEN … someone from the Orange County ME’s office “draped the hair mass over the skull”
    Spitz really said this — unbelievable.

    It’s all a vast conspiracy by the State, the ME’s office, all of LE, the FBI, and hundreds of other witnesses against Casey Anthony.
    Everyone is out to frame her, don’t you know?? lol

    Dr Spitz grabbed his skull off the ledge of the podium after Jeff Ashton was done questioning him about it.

    ** The MANDIBLE was left behind. **

    Spitz had to angrily reach up to the ledge a second time to grab the mandible.
    Which only further bolsters the State’s claim that the duct tape was holding the mandible to the skull.

    Have the results of the soil samples taken from the Ant’s backyard ever been made public, keeping in mind the areas where we recently heard K-9′s Gerus and Bones alerted to?
    This bug expert’s testimony triggered a remembering of the testimony of the K9′s handlers in how Gerus and Bones were reacting to the area by the playhouse and why 2 of their final alerts may have been a slight distance apart . . .

    Defense’s bug expert talked yesterday about the primary bugs in the early stages and how they would leave a “trail”.

    Man, oh man . . . I’m thinking the K9′s picked up on a “trail” that did NOT ORIGINATE from the pool, but rather the trail started closer to the playhouse and then ended a distance AWAY FROM the pool – - – indicating to me that little Caylee did not drown because she was not in the pool nor was her little body removed from the pool after death, and indicating that little Caylee was placed somewhere close to the playhouse in the beginning after she died.

    The other question that popped in from the bug expert’s testimony was what all, in terms of photographs from the trunk of the car, did he look at?
    Did he not see the spare tire well that had all those leaves in it or maybe he did but found nothing of interest perhaps TO HIM?

    Oh yeah, hearing yesterday how he NEVER SAW THE CAR TRUCK IN PERSON until 2 years later . . . wth . . . just wth.

    So, starting with a google for soil test results yesterday, I came across a VERY INFORMATIVE article dated March 15, 2011 (during a time when I was not really keeping up that much) written by the best of the best . . . Blink. :)

    Well Blink if you think that about the Huntington cross examination, wait until you see what happened to Dr. Spitz.

    Dr. Spitz stated on the stand that he had been doing forensics for 56 years. I am sorry for him. Every person who has a medical or other technical profession has to come to the relization that at some point, they cannot keep up due to health problems. While Dr. Spitz can still get around and carry a briefcase, IMO he is too shakey to perform an autopsy and his memory is in even worse shape.

    Jeff Ashton was very gentle and careful with Dr. Spitz. It was very clear to me that Dr. Spitz should never be allowed to perform another autopsy or testify in a court case. It was really painful to watch.

    This case is being defended by a team of people who, IMO are very poorly qualified. Putting the young DR. Huntington on the stand and trying to get him to provide the expertise they needed was a very poor choice. He needs to get out of the classroom and spend time finding out the reality of the everyday world.

    I respect education. It takes a lot of hard work to obtain a PHD in a technical field. However, from life’s experiences, I have learned that it is possible to have a doctorate with little to no experience of working in the field for which it is recieved. This to me is absolutely insanity. Teaching is a great opportunity to learn about the subject, but if you have never applied your skills to real world situations, you just are parroting something from a textbook.

    Trying to tie in the pig experiment in an open trunk to decomposition of a human in a closed trunk is an imposible job. That is why I included the pig story. The pig skin is so tough that it takes weeks for a pig to complete the bloat phase and it never ever ruptures like the thin skin of humans.

    I hope the young Dr. Huntington learned a valuable lesson from this experience.

    And, if you havn’t watched todays court, you have another suprise to watch. Mr. Baez got a real chewing from judge Perry for not following the rules. In fact, he stated that he would entertain a contempt charge from the prosecution following the Anthony trial.

    What is interesting is that it seems the Prosecution’s objections during direct are merely warnings that the cross isn’t going to be pretty, and in hindsight, the Defense probably has wished for some sustained objections.

    You are quite correct that nicotine is/was used as an insectide. It was still in use until WWII. There were several companies that sold it. My grandmother had a package at one time. It has been too long for me to remember the brand name. You could look for it in some of the organic gardening publications or on a web site.

    It was ground into a powder and looked like a tobacco product known as “snuff”.

    Your assesment of young inexperienced Dr. Huntington is the same as mine. Wow! Jeff Ashton made mincemeat of his direct testimony. And I fully agree with Chelsea’s post about lack of integrity.

    Lurker here. I agree with some of your theories on the case, so I don’t post.

    My question/observation is… does anyone remember hearing someone say that George mumbled under his breath about how his wife is going to divorce him “over this?” I believe he said that while at the tow yard. Why would he say that at that time and place?

    I believe it was because he felt he was “right” about Casey yet again, and Cindy felt it forced Casey, and adult, btw, to act out.

    I have had the best time ever! Yesterday Dr. Tiny Tim Huntington left Court with his tail between his legs and today Dr. W. Senile Spitz was well and truly annihilated by Mr Ashton. His testimony was cringe making, toe curlingly awful! I applaud Mr Ashton for his restraint when questioning Dr Spitz, immense patience was required as he rambled, tried to put his Rubix Cube skull back together, dropped it, continuously whacking the microphone causing dreadful accustic problems for me. As Mr Chelsea wanted to go out today, having worked all week, I had to watch the recorded version later – had the hump all day!! It did mean that I rarely got to see Casey Anthony’s reaction especially when Baez got really hauled over the coals by JBP. I believe at the end of the trial he will be dealt with severally even if it is by the Law Society and not by being held in contempt by the Judge. I truly believe we stand a good chance of getting Justice for Caylee thanks to this awesome Prosecution. Wish I knew what was going through Juror #4′s mind today. According to Kathi Belich who was in Court Dr Spitz was floundering with his theory regarding how the duct tape was attached and several jury members were actually sniggering! I find it impossible to describe the testimony this once exulted man gave, it needs to be seen to be believed. Made for brillliant viewing however and to his credit, he apparently told Kathi Bellich afterwards that the Prosecutor had done a good job on cross. Well that’s my fix for the day. I hope I don’t have to go into rehab when this is all over!!

    I honestly started feeling pity for the elderly doctor. When he replied that he didn’t recall breaking the skull, I just felt sorry for the poor old man. He was apparently a very highly regarded expert in his field. I would imagine that anyone who has ever been called as a witness for the defense is regretting ever having anything to do with Jose Baez and Miss Anthony.
    While it is somewhat entertaining to watch the defense team flounder, it’s just sad that it had to come to this to bring justice to little Caylee.

    If you were watching real close to see how the demo mandible was attached to the skull, you could see two straight line springs with loop attachments. This was done so that the mandible could move.

    Poor Dr. Spitz could not replace it due to shaking hands. Jeff Ashton attempted to help him, but it takes pressure in a certain way to get it back together. Mr. Ashton just gave up and left it laying on the shelf of the witness stand. It appears that the good doctor’s short term memory is in trouble and of course this affects his long term memory as well.

    If the jurors are laughing at some of the inane testimony produced by the defense, then they are likely to believe very little of it and go with what the state has presented.

    Tim Huntington reference to tobacco spit in empty cans of soda that attracted his description of the flies to the trash in the trunk and not the the paper towels.

    Well I have used regular tobacco in Jerry Bakers mixes The Master Gardener for my garden to get rid of insects. Spit that contains food could attract flies but if your chewing tobbacco do you have food in your mouth. Made no sense to me. But I don’t chew.

    Dr. Spitz was a good wittness for the Prosecution after Mr. Ashtons questions. Don’t think Mason rehabilatated him.

    Dr. Spitz tranished his career with the Spector case. Was getting 5 thousand a day. But you know what I think I learned is that adoposcere in hair is sticky when dry and perhaps that whats kept the tape adhereing to the right side of the head. Will have to look his little black stuff at the base of the L side of skull.

    For some who stop working they loose their idenity because work is their life. Can you imagine 60 thousands autopsys. I mean when did he have time for his family? All though he has three children two boy Docs and daug who is a lawyer.

    She’s almost swaying & her eye lids look heavy …

    Could it be she or def asked for ‘something’ to ‘calm’ her since she was looking ‘too perky’ for the subject being discussed but of course that wouldn’t be what was said to obtain the ‘drug’ ??

    I saw today’s testimony too and it got so bad that my stomach was full of anxiety, waiting for the DR to forget the next unforgettable kind of thing then go completely ballistic until medics arrive to whisk him away.

    What I don’t understand is how Cheney and Baez could of been dealing with him enough to at least detect the aging factor and STILL put him on the stand. Did they think everyone would be blinded by the man’s credentials or are they purposely trying to f-up the case at this point. They were both laughing during the Dr and Ashton’s heated cross examine.

    I guess one benefit to being a sociopath – you can have a day like today take you closer to the death chamber – and still not even flinch.

    Which started when “Spitz said the duct tape being put on after Caylee remains were left as bones”.

    IMO this is the 2nd-day Baez has put a witness on the stand that State did not know of certain aspects of each witnesses testimony. Each witness stated to the Judge “[it] was JB they spoke/discuss the subject in question with”.

    Yesterday Dr Huntington & decomp. Today Dr. Rodriguez w/duct tape.

    To me AJMO those are 2-separate issues of contempt of a court order. IMO Baez has gone out of his way to actual “hamper” the STATE as well, he has/is disrupting the cout’s normal process.

    A person found in contempt of court is called a “contemnor.”
    To prove contempt, the prosecutor or complainant [in this case the Judge after the State brought each issue to the Court's attention] must prove the four elements of contempt:

    Existence of a lawful order
    The contemnor’s knowledge of the order
    The contemnor’s ability to comply
    The contemnor’s failure to comply

    JP is now stating by Tuesday he will be looking @ HOW the trial is proceeding & will be considering “running court session until 3pm Saturday & 5:30 ~ 6:00pm during the week days”.

    Today, whenever saw JP [sitting @ bench] his face showed “deep frustration.”

    This is telling to me. Perry said Buenoano had no remorse. This girl, Casey is being robbed of a decent defense. Her Jose is selling her down the proverbial river, all for his imagined notoriety after the fact. I wish someone could stop this runaway train. Truly, Casey is not getting a fair trial. She is represented by a bunch of clowns with an agenda of their own. As Judge Perry said in the old video, greed does not pay and I have no doubt he knows exactly which lawyer is looking to have his greed pay off.. Everything about this case is deeply saddening. Judge Perry will prevail and mete out the right justice.

    After weeks of overnight campouts, shouting matches and finally a brawl, a new system for obtaining tickets to the Casey Anthony trial made a smooth debut this afternoon.

    Under the new rules, anyone wanting tickets to the trial must line up at 4 p.m. on weekdays outside the Orange County Courthouse the day before the court session they wish to attend.

    Court personnel take down names and IDs, and those who make the cut return at 8 a.m. the following day with the same ID. They are then given tickets in the order in which their names were taken down, and led into court at about 8:15.

    Anyone wanting to attend Monday court sessions must be in line outside the courthouse to sign up by 1 p.m. Saturday.

    Authorities at the courthouse made the changes in response to a fight that broke out overnight. At about 5 a.m., at least two men tried to cut to the front of the ticket line. Witnesses and people involved in the fight said other people in line resisted the men and fought back when the two started throwing punches.     This afternoon, more than 30 people stood in line by 3:20 p.m. for the 4 p.m. sign-up. Everyone was calm and polite, and all those on hand at 4 p.m. were able to sign up for tickets. The court accommodates about 50 members of the public for each session.

    OK, I feel somewhat guilty for my last post blasting the last two defense experts but my emotions were on a real roller coaster especially when it appeared Dr Spitz might appear credible to the Jury insinuating an element of doubt. I just so want this girl held responsible for the death of little Caylee. However, at the end of the day neither of these experts needed agree to attend and the distinct feeling I had was it was purely for the notoriety, not even for the fee. They must have known the details of the case and had a choice, not like the attorney who has a duty to defend his client to very best of his ability (limited though it may be). Oh dear, I’m doing it again, I best go!. JMO

    I have to disagree with a previous poster who said that Casey was not getting a fair trial. IMO she is getting alot better than she deserves. She is indigent and is getting high priced attorneys to represent her along with some very good expert witnesses etc. She is getting way more than most folks in her situation would ever dream of getting. In fact it is almost sickening all she has gotten when her daughter Caylee got nothing, zip, nada. If her counsel is not good, thats her own damn fault..maybe just maybe she is getting exactly what her karma deserves. Princess Casey needs a wake up call and I hope this trial gives her one. God Bless baby Caylee, she would have been wishing JOJO happy fathers day this yr if Casey hadn’t decided that her baby didn’t deserve to see grandma and JOJO any more. So I feel no sympathy at all for any of her court problems..NONE, ZIP, NADA.

    Back in January Judge Perry had ordered that all the experts must submit reports that included *everything* that they would testify to.
    On Saturday, Baez starts to question Dr Rodriquez on issues that were NOT included in that report.
    Immediate objection from Jeff Ashton.
    Judge Perry had the jury exit the courtroom and gave Baez a dressing down.
    (Even this doesn’t deter Baez though – he argues the point further with Judge Perry – complete with more eye rolling.)

    Judge Perry says:
    “Mr Baez, let me say this – this is not my first rodeo. I’ve tried one or two cases.”
    “What you’re basically saying Sir, is that you can pick which Court orders you comply with, and which Court orders you don’t”
    “This was not inadvertent.”

    And the biggie …
    “I will reserve the decision if I will proceed with contempt charges at the conclusion.”
